			 of 1950</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID775eb65fb10744f9adb963efb6f1253a"><enum>(a)</enum><header display-inline="yes-display-inline">Termination of Act</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idE7394ACFFEB34E3DB05FB508A59D58F0"><enum>(1)</enum><header display-inline="yes-display-inline">Termination</header><text display-inline="yes-display-inline">Section 717 of the Defense Production Act
			 of 1950 (50 U.S.C. App. 2166) is amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idA4852DDC8AD341E98354BCE7CEAD9B3E"><enum>(A)</enum><text display-inline="yes-display-inline">by striking subsections (a) and (b) and
			 inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="idA2F77740A0BF42F898DCF5379426749B" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="id6D961055A36A4D34A9EFB2A827F0C7C1"><enum>(a)</enum><text display-inline="yes-display-inline">Title I (except section 104), title III,
				and title VII (except sections 707, 708, and 721) shall terminate on September
				30, 2014, except that all authority extended under title III on or after the
				date of enactment of the <short-title>Defense Production
				Act Reauthorization of 2009</short-title> shall be effective for any fiscal
				year only to such extent or in such amounts as are provided in advance in
				appropriations Acts.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="IDd0284977551a41569fa3b7a6a646164d"><enum>(b)</enum><text display-inline="yes-display-inline">Notwithstanding subsection (a), any agency
				created under a provision of law that is terminated under subsection (a) may
				continue in existence, for purposes of liquidation, for a period not to exceed
				6 months, beginning on the date of termination of the provision authorizing the
				creation of such agency under subsection
				(a).</text>
							</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC54DB695E0C047D3AB255940FBDECCE3"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (c), by striking the second

			 1950 (50 U.S.C. App. 2062) is amended to read as follows:</text>

					<section commented="no" display-inline="no-display-inline" id="ID7b93774135a24e8e9d214db856a97fee" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Declaration of policy</header>
						<subsection commented="no" display-inline="no-display-inline" id="id570760CD066B41BD8F5A4C9C6DEB63FD"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress finds that—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="IDb6916d9a5e3a4c2a94fda116447f116e"><enum>(1)</enum><text display-inline="yes-display-inline">the security of the United States is
				dependent on the ability of the domestic industrial base to supply materials
				and services for the national defense and to prepare for and respond to
				military conflicts, natural or man-caused disasters, or acts of terrorism
				within the United States;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4f8de10d06764423985f9641d23c4c48"><enum>(2)</enum><text display-inline="yes-display-inline">to ensure the vitality of the domestic
				industrial base, actions are needed—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID7240ad76627f407e9b083b66ebee01ee"><enum>(A)</enum><text display-inline="yes-display-inline">to promote industrial resources
				preparedness in the event of domestic or foreign threats to the security of the
				United States;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6b5541c47e0d4f4ba89a0e8e1d7648fb"><enum>(B)</enum><text display-inline="yes-display-inline">to support continuing improvements in
				industrial efficiency and responsiveness;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2d0fae338d3048b8b6f8435c072af8af"><enum>(C)</enum><text display-inline="yes-display-inline">to provide for the protection and
				restoration of domestic critical infrastructure operations under emergency
				conditions; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd920a6b3e77d446bb6baf28ab56780d5"><enum>(D)</enum><text display-inline="yes-display-inline">to respond to actions taken outside of the
				United States that could result in reduced supplies of strategic and critical
				materials, including energy, necessary for national defense and the general
				economic well-being of the United States;</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1d003203df3e42c7b1880d79ab5cd772"><enum>(3)</enum><text display-inline="yes-display-inline">in order to provide for the national
				security, the national defense preparedness effort of the United States
				Government requires—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID2cf35f935c0a4ffc8cde7cb31b89bc45"><enum>(A)</enum><text display-inline="yes-display-inline">preparedness programs to respond to both
				domestic emergencies and international threats to national defense;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf91655a00776408e972c9fa1c3f58eb0"><enum>(B)</enum><text display-inline="yes-display-inline">measures to improve the domestic industrial
				base for national defense;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb3bb3905b346487a8363b1a1b79a533b"><enum>(C)</enum><text display-inline="yes-display-inline">the development of domestic productive
				capacity to meet—</text>
									<clause commented="no" display-inline="no-display-inline" id="idD7A27C60E3B24CA4A55D7356A9429AF4"><enum>(i)</enum><text display-inline="yes-display-inline">essential national defense needs that can
				result from emergency conditions; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id3008F92C52E84F93A586A88C7D105322"><enum>(ii)</enum><text display-inline="yes-display-inline">unique technological requirements;
				and</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf295c18500d541a0906261187f5b54ae"><enum>(D)</enum><text display-inline="yes-display-inline">the diversion of certain materials and
				facilities from ordinary use to national defense purposes, when national
				defense needs cannot otherwise be satisfied in a timely fashion;</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID68d9009629a34c93a59423c4a441bddb"><enum>(4)</enum><text display-inline="yes-display-inline">to meet the requirements referred to in
				this subsection, this Act provides the President with an array of authorities
				to shape national defense preparedness programs and to take appropriate steps
				to maintain and enhance the domestic industrial base;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf61a1671f4954f6ab7a298b3664ef022"><enum>(5)</enum><text display-inline="yes-display-inline">in order to ensure national defense
				preparedness, it is necessary and appropriate to assure the availability of
				domestic energy supplies for national defense needs;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe3704a97aaba4394ab3f84b08ebc7937"><enum>(6)</enum><text display-inline="yes-display-inline">to further assure the adequate maintenance
				of the domestic industrial base, to the maximum extent possible, domestic
				energy supplies should be augmented through reliance on renewable energy
				sources (including solar, geothermal, wind, and biomass sources), more
				efficient energy storage and distribution technologies, and energy conservation
				measures;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3737c2aacc614659ba250d71dd281eee"><enum>(7)</enum><text display-inline="yes-display-inline">much of the industrial capacity that is
				relied upon by the United States Government for military production and other
				national defense purposes is deeply and directly influenced by—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID28ab3cfc9ae242f2b33e6f73f7f0f95c"><enum>(A)</enum><text display-inline="yes-display-inline">the overall competitiveness of the
				industrial economy of the United States; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID26ee1048c6f2474eabc3e5588e26be68"><enum>(B)</enum><text display-inline="yes-display-inline">the ability of industries in the United
				States, in general, to produce internationally competitive products and operate
				profitably while maintaining adequate research and development to preserve
				competitiveness with respect to military and civilian production; and</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID255114f86ba342e2977d78eb08a8e80d"><enum>(8)</enum><text display-inline="yes-display-inline">the inability of industries in the United
				States, especially smaller subcontractors and suppliers, to provide vital parts
				and components and other materials would impair the ability to sustain the
				Armed Forces of the United States in combat for longer than a short
				period.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID499e60795e324391bff6bdc0e8fb372d"><enum>(b)</enum><header display-inline="yes-display-inline">Statement of policy</header><text display-inline="yes-display-inline">It is the policy of the United States
				that—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="IDe38386b5c41746868fc02ea7c1dd05ae"><enum>(1)</enum><text display-inline="yes-display-inline">to ensure the adequacy of productive
				capacity and supply, Federal departments and agencies that are responsible for
				national defense acquisition should continuously assess the capability of the
				domestic industrial base to satisfy production requirements under both
				peacetime and emergency conditions, specifically evaluating the availability of
				adequate production sources, including subcontractors and suppliers, materials,
				skilled labor, and professional and technical personnel;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe6e42090fd5140168a3988d9e0b2e8c0"><enum>(2)</enum><text display-inline="yes-display-inline">every effort should be made to foster
				cooperation between the defense and commercial sectors for research and
				development and for acquisition of materials, components, and equipment;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8aafaf8f5ca2457a9dcb7e43811fc1d3"><enum>(3)</enum><text display-inline="yes-display-inline">plans and programs to carry out the
				purposes of this Act should be undertaken with due consideration for promoting
				efficiency and competition;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2abaaf77c466442380a2e950f550d363"><enum>(4)</enum><text display-inline="yes-display-inline">in providing United States Government
				financial assistance under this Act to correct a domestic industrial base
				shortfall, the President should give consideration to the creation or
				maintenance of production sources that will remain economically viable after
				such assistance has ended;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb8f2a181fb1c4d9082f6f8e226eb7d76"><enum>(5)</enum><text display-inline="yes-display-inline">authorities under this Act should be used
				to reduce the vulnerability of the United States to terrorist attacks, and to
				minimize the damage and assist in the recovery from terrorist attacks that
				occur in the United States;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc3134c7a4b9f466d819fca7b16bdf02a"><enum>(6)</enum><text display-inline="yes-display-inline">in order to ensure productive capacity in
				the event of an attack on the United States, the United States Government
				should encourage the geographic dispersal of industrial facilities in the
				United States to discourage the concentration of such productive facilities
				within limited geographic areas that are vulnerable to attack by an enemy of
				the United States;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD101EA8AB44E4CC6B79EACE9FC8FB79F"><enum>(7)</enum><text display-inline="yes-display-inline">to ensure that essential national defense
				requirements are met, consideration should be given to stockpiling strategic
				materials, to the extent that such stockpiling is economical and feasible;
				and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID269a107ddd7e4afaa5d12aa7efe1406e"><enum>(8)</enum><text display-inline="yes-display-inline">in the construction of any industrial
				facility owned by the United States Government, in the rendition of any
				financial assistance by the United States Government for the construction,
				expansion, or improvement of any industrial facility, and in the production of
				goods and services, under this Act or any other provision of law, each
				department and agency of the United States Government should apply, under the
				coordination of the Federal Emergency Management Agency, when practicable and
				consistent with existing law and the desirability for maintaining a sound
				economy, the principle of geographic dispersal of such facilities in the
				interest of national
				defense.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDdb1356b0acb843c497d536978a86ff49" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Priority in contracts and
			 orders</header><text display-inline="no-display-inline">Section 101 of the
			 Defense Production Act of 1950 (50 U.S.C. App. 2071) is amended by adding at
			 the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id29F9B92113264868B9D5FA62DD755409" style="OLC">
				<subsection commented="no" display-inline="no-display-inline" id="idE09FE315DA4C45BEB1F16DD3B74857A8"><enum>(d)</enum><text display-inline="yes-display-inline">The head of each Federal agency to which
				the President delegates authority under this section shall—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idFD79A0F066D6469EA285306AD9132B8B"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 270 days after the date of
				enactment of the <short-title>Defense Production Act
				Reauthorization of 2009</short-title>, issue final rules, in accordance with
				section 553 of title 5, United States Code, that establish standards and
				procedures by which the priorities and allocations authority under this section
				is used to promote the national defense, under both emergency and nonemergency
				conditions; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id07A2DEF7738C40B689208EE405F72B15"><enum>(2)</enum><text display-inline="yes-display-inline">as appropriate and to the extent
				practicable, consult with the heads of other Federal agencies to develop a
				consistent and unified Federal priorities and allocations
				system.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="ID55b26b50662f4734804f418b7781f75f" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Designation of energy as a strategic and
			 critical material</header><text display-inline="no-display-inline">Section 106
			 of the Defense Production Act of 1950 (50 U.S.C. App. 2076) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="IDfb8fe36d7e6844db928eb0e0cac4f242"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>such designation</quote>
			 and all that follows through <quote>(1)</quote> and inserting <quote>such
			 designation</quote>;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID518e465aab6b4be1906dcbff01ba35ee"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>; or</quote> and
			 inserting a period; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id666569A9C61A4CCBA7E4EEF80A3D4C1A"><enum>(3)</enum><text display-inline="yes-display-inline">by striking paragraph (2).</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID4c3fa6ab647940ae90422c0c71eb2ae2" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Strengthening domestic
			 capability</header><text display-inline="no-display-inline">Section 107 of the
			 Defense Production Act of 1950 (50 U.S.C. App. 2077) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="IDf7fed8eda1994048bbdbc5dd52663ec6"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="ID7da039163bad4fdfa3efb4044152b2bf"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>restore,</quote> after
			 <quote>modernize,</quote>; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf2a7f98e57614b649e32fe6dd0a07154"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>materials,</quote>
			 after <quote>items,</quote>; and</text>

			 critical technology items, essential materials, and industrial
			 resources</quote>.</text>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="id4CA3B6A1BC964300920BFFA3B2B41C94" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Expansion of productive capacity and
			 supply</header><text display-inline="no-display-inline">Title III of the
			 Defense Production Act of 1950 (50 U.S.C. App. 2091 et seq.) is amended to read
			 as follows:</text>

					<section commented="no" display-inline="no-display-inline" id="IDA434BB25814A4A73A4646314CB64DF24" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">Presidential Authorization for the National
				Defense</header>
						<subsection commented="no" display-inline="no-display-inline" id="id9660367B2E6444D6AAC421459D82FAF6"><enum>(a)</enum><header display-inline="yes-display-inline">Expediting production and deliveries or
				services</header>
							<paragraph commented="no" display-inline="no-display-inline" id="idD52657FEA43B44D0BE3870D7324FF1DB"><enum>(1)</enum><header display-inline="yes-display-inline">Authorized activities</header><text display-inline="yes-display-inline">To reduce current or projected shortfalls
				of industrial resources, critical technology items, or essential materials
				needed for national defense purposes, subject to such regulations as the
				President may prescribe, the President may authorize a guaranteeing agency to
				provide guarantees of loans by private institutions for the purpose of
				financing any contractor, subcontractor, provider of critical infrastructure,
				or other person in support of production capabilities or supplies that are
				deemed by the guaranteeing agency to be necessary to create, maintain,
				expedite, expand, protect, or restore production and deliveries or services
				essential to the national defense.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe0eb03ac33ec45be83d0f9b35936fe34"><enum>(2)</enum><header display-inline="yes-display-inline">Presidential determinations
				required</header><text display-inline="yes-display-inline">Except during a
				period of national emergency declared by Congress or the President, a loan
				guarantee may be entered into under this section only if the President
				determines that—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID7a374ebdbeda4b4a984a7655b0073d67"><enum>(A)</enum><text display-inline="yes-display-inline">the loan guarantee is for an activity that
				supports the production or supply of an industrial resource, critical
				technology item, or material that is essential for national defense
				purposes;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2e0c60409a9e43a4b4e19361259ddb67"><enum>(B)</enum><text display-inline="yes-display-inline">without a loan guarantee, credit is not
				available to the loan applicant under reasonable terms or conditions sufficient
				to finance the activity;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID973a79a4b1e94d8bbb4e1103f3f5b5ed"><enum>(C)</enum><text display-inline="yes-display-inline">the loan guarantee is the most cost
				effective, expedient, and practical alternative for meeting the needs of the
				Federal Government;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5de72254788a48a5a6479cafe85d7e20"><enum>(D)</enum><text display-inline="yes-display-inline">the prospective earning power of the loan
				applicant and the character and value of the security pledged provide a
				reasonable assurance of repayment of the loan to be guaranteed;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc1a189cbfe9643cfb823df44661c4087"><enum>(E)</enum><text display-inline="yes-display-inline">the loan to be guaranteed bears interest at
				a rate determined by the Secretary of the Treasury to be reasonable, taking
				into account the then-current average yield on outstanding obligations of the
				United States with remaining periods of maturity comparable to the maturity of
				the loan;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDab2d181302c5495f94b2c314214e7465"><enum>(F)</enum><text display-inline="yes-display-inline">the loan agreement for the loan to be
				guaranteed provides that no provision of the loan agreement may be amended or
				waived without the consent of the fiscal agent of the United States for the
				guarantee; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID91649be5cd414f4cafae92be2f716b24"><enum>(G)</enum><text display-inline="yes-display-inline">the loan applicant has provided or will
				provide—</text>
									<clause commented="no" display-inline="no-display-inline" id="idD21FBD7EEF8C4C6B9213AFD1590311E8"><enum>(i)</enum><text display-inline="yes-display-inline">an assurance of repayment, as determined by
				the President; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id952E8D256D264336A93AB48CE858DB91"><enum>(ii)</enum><text display-inline="yes-display-inline">security—</text>
										<subclause commented="no" display-inline="no-display-inline" id="id4F88B057A6B14BBCB52ED37F94459C9E"><enum>(I)</enum><text display-inline="yes-display-inline">in the form of a performance bond,
				insurance, collateral, or other means acceptable to the fiscal agent of the
				United States; and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="id9E6CC384125A45BDB130DC0DE833FFB9"><enum>(II)</enum><text display-inline="yes-display-inline">in an amount equal to not less than 20
				percent of the amount of the loan.</text>
										</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4A399B0DA41A4DB2AC495CB26440592F"><enum>(3)</enum><header display-inline="yes-display-inline">Limitations on loans</header><text display-inline="yes-display-inline">Loans under this section may be—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id6EB50D38EC9844C9B3D584EC2E867B97"><enum>(A)</enum><text display-inline="yes-display-inline">made or guaranteed under the authority of
				this section only to the extent that an appropriations Act—</text>
									<clause commented="no" display-inline="no-display-inline" id="id08FB09E4390645AA90F0A45F55012EC4"><enum>(i)</enum><text display-inline="yes-display-inline">provides, in advance, budget authority for
				the cost of such guarantees, as defined in section 502 of the Federal Credit
				Reform Act of 1990 (2 U.S.C. 661a); and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idD7BE99B40EEF4FB0B42086708B485870"><enum>(ii)</enum><text display-inline="yes-display-inline">establishes a limitation on the total loan
				principal that may be guaranteed; and</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA805171BC22B4223A4ADB972F4F31FE1"><enum>(B)</enum><text display-inline="yes-display-inline">made without regard to the limitations of
				existing law, other than section 1341 of title 31, United States Code.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID031F9A88063547558226D28A8845C4FE"><enum>(b)</enum><header display-inline="yes-display-inline">Fiscal agents of the United States</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id8C6B2ADC14BC4C598F65CF9390105FB1"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Any Federal agency or any Federal reserve
				bank, when designated by the President, is hereby authorized to act, on behalf
				of any guaranteeing agency, as fiscal agent of the United States in the making
				of such contracts of guarantee and in otherwise carrying out the purposes of
				this section.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD29AF8284A4C479E934D3195CDEA7A41"><enum>(2)</enum><header display-inline="yes-display-inline">Funds</header><text display-inline="yes-display-inline">All such funds as may be necessary to
				enable any fiscal agent described in paragraph (1) to carry out any guarantee
				made by it on behalf of any guaranteeing agency shall be supplied and disbursed
				by or under authority from such guaranteeing agency.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB7256EA39F5A45589886DE5E68DE82F1"><enum>(3)</enum><header display-inline="yes-display-inline">Limit on liability</header><text display-inline="yes-display-inline">No fiscal agent described in paragraph (1)
				shall have any responsibility or accountability, except as agent in taking any
				action pursuant to or under authority of this section.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBC48E21A287344019E29037776111923"><enum>(4)</enum><header display-inline="yes-display-inline">Reimbursements</header><text display-inline="yes-display-inline">Each fiscal agent described in paragraph
				(1) shall be reimbursed by each guaranteeing agency for all expenses and losses
				incurred by such fiscal agent in acting as agent on behalf of such guaranteeing
				agency, including, notwithstanding any other provision of law, attorneys' fees
				and expenses of litigation.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDB844EFA52F6E4EB1B21E68756CD17DD1"><enum>(c)</enum><header display-inline="yes-display-inline">Oversight</header>
							<paragraph commented="no" display-inline="no-display-inline" id="idFD2F8016C70847CAB72FAD8B2E863FE1"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">All actions and operations of fiscal agents
				under authority of or pursuant to this section shall be subject to the
				supervision of the President, and to such regulations as the President may
				prescribe.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id19A7F05A19CD45498B976518A40485ED"><enum>(2)</enum><header display-inline="yes-display-inline">Other authority</header><text display-inline="yes-display-inline">The President is authorized to
				prescribe—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id8A6DB6C47F874F9B9B44D92EEC9D3B69"><enum>(A)</enum><text display-inline="yes-display-inline">either specifically or by maximum limits or
				otherwise, rates of interest, guarantee and commitment fees, and other charges
				which may be made in connection with loans, discounts, advances, or commitments
				guaranteed by the guaranteeing agencies through fiscal agents under this
				section; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id09C557DDD08046A38F8517216F010CE9"><enum>(B)</enum><text display-inline="yes-display-inline">regulations governing the forms and
				procedures (which shall be uniform to the extent practicable) to be utilized in
				connection with such guarantees.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id063800DDB78F401F890D96FA7DB67F91"><enum>(d)</enum><header display-inline="yes-display-inline">Aggregate guarantee amounts</header>
							<paragraph commented="no" display-inline="no-display-inline" id="idADFF1E2E28BF4F4FA3A87528D66C2808"><enum>(1)</enum><header display-inline="yes-display-inline">Industrial resource and critical technology
				shortfalls</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="id37C7B973A7074ACEA55FD898D8C2F4CC"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If the making of any guarantee or
				obligation of the Federal Government under this title relating to a domestic
				industrial base shortfall would cause the aggregate outstanding amount of all
				guarantees for such shortfall to exceed $50,000,000, any such guarantee may be
				made only—</text>
									<clause commented="no" display-inline="no-display-inline" id="id9F2434A8945E41A49E9CE364B9CF3EEF"><enum>(i)</enum><text display-inline="yes-display-inline">if the President has notified the Committee
				on Banking, Housing, and Urban Affairs of the Senate and the Committee on
				Financial Services of the House of Representatives in writing of the proposed
				guarantee; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idFABFC84933F94A52AF405B4B4D51A1D2"><enum>(ii)</enum><text display-inline="yes-display-inline">after the 30-day period following the date
				on which notice under clause (i) is provided.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA1F0113662874D758CF05AB0E0A730B9"><enum>(B)</enum><header display-inline="yes-display-inline">Waivers authorized</header><text display-inline="yes-display-inline">The requirements of subparagraph (A) may be
				waived—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID98E308254C1E4A75B1C405851AB17A58"><enum>(i)</enum><text display-inline="yes-display-inline">during a period of national emergency
				declared by Congress or the President; or</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID9F0F7B9422A14EE3AD9C9939EC8DEA98"><enum>(ii)</enum><text display-inline="yes-display-inline">upon a determination by the President, on a
				nondelegable basis, that a specific guarantee is necessary to avert an
				industrial resource or critical technology item shortfall that would severely
				impair national defense capability.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID761E8B15E2DA404EAB4FDF62E5D1C281"><enum>(2)</enum><header display-inline="yes-display-inline">Other limitations</header><text display-inline="yes-display-inline">The authority conferred by this section
				shall not be used primarily to prevent the financial insolvency or bankruptcy
				of any person, unless—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID98C3057C73F443A98D2676BEEB9D9931"><enum>(A)</enum><text display-inline="yes-display-inline">the President certifies that the insolvency
				or bankruptcy would have a direct and substantially adverse effect upon
				national defense production; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID15223254C8394769B61D5B69F31EACB2"><enum>(B)</enum><text display-inline="yes-display-inline">a copy of the certification under
				subparagraph (A), together with a detailed justification thereof, is
				transmitted to the Committee on Banking, Housing, and Urban Affairs of the
				Senate and the Committee on Financial Services of the House of Representatives
				not later than 10 days prior to the exercise of that authority for such
				use.</text>
								</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID3A7631D836DC4A0CB6E94B2AA84BDC7A" section-type="subsequent-section"><enum>302.</enum><header display-inline="yes-display-inline">Loans to Private Business
				enterprises</header>
						<subsection commented="no" display-inline="no-display-inline" id="id239E02117F494FC8B9F3B8F0AFBAF95C"><enum>(a)</enum><header display-inline="yes-display-inline">Loan
				Authority</header><text display-inline="yes-display-inline">To reduce current
				or projected shortfalls of industrial resources, critical technology items, or
				materials essential for the national defense, the President may make provision
				for loans to private business enterprises (including nonprofit research
				corporations and providers of critical infrastructure) for the creation,
				maintenance, expansion, protection, or restoration of capacity, the development
				of technological processes, or the production of essential materials, including
				the exploration, development, and mining of strategic and critical metals and
				minerals.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID1180154346FB45CB89FD6A27DBAD620B"><enum>(b)</enum><header display-inline="yes-display-inline">Conditions of loans</header><text display-inline="yes-display-inline">Loans may be made under this section on
				such terms and conditions as the President deems necessary, except that—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID16575B27F1CF4088A871CDB53CFB4FE3"><enum>(1)</enum><text display-inline="yes-display-inline">financial assistance may be extended only
				to the extent that it is not otherwise available from private sources on
				reasonable terms; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDA94D8C571474FE79296FBB356AF5B02"><enum>(2)</enum><text display-inline="yes-display-inline">during periods of national emergency
				declared by the Congress or the President, no such loan may be made unless the
				President determines that—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDE29CD6AFAEE945D9B9F5DC7F68B95A01"><enum>(A)</enum><text display-inline="yes-display-inline">the loan is for an activity that supports
				the production or supply of an industrial resource, critical technology item,
				or material that is essential to the national defense;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD4E88BD3B95F4378B53A29E8B12EA31B"><enum>(B)</enum><text display-inline="yes-display-inline">without the loan, United States industry
				cannot reasonably be expected to provide the needed capacity, technological
				processes, or materials in a timely manner;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE2A723DF5720487C9F34333B35538B86"><enum>(C)</enum><text display-inline="yes-display-inline">the loan is the most cost-effective,
				expedient, and practical alternative method for meeting the need;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDfe162dd597924bcb99925a2705afd5b4"><enum>(D)</enum><text display-inline="yes-display-inline">the prospective earning power of the loan
				applicant and the character and value of the security pledged provide a
				reasonable assurance of repayment of the loan in accordance with the terms of
				the loan, as determined by the President; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc3dd0907846b4dbd8ff4f506bed79201"><enum>(E)</enum><text display-inline="yes-display-inline">the loan bears interest at a rate
				determined by the Secretary of the Treasury to be reasonable, taking into
				account the then-current average yield on outstanding obligations of the United
				States with remaining periods of maturity comparable to the maturity of the
				loan.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idB46A35D64FF84D0393C672B485A8AB0D"><enum>(c)</enum><header display-inline="yes-display-inline">Limitations on loans</header><text display-inline="yes-display-inline">Loans under this section may be—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id327788D4A5FA4610B2D37B9BAB2A97C3"><enum>(1)</enum><text display-inline="yes-display-inline">made or guaranteed under the authority of
				this section only to the extent that an appropriations Act—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id91157FD0E4A74849A4DB5AD763F9E9F1"><enum>(A)</enum><text display-inline="yes-display-inline">provides, in advance, budget authority for
				the cost of such guarantees, as defined in section 502 of the Federal Credit
				Reform Act of 1990 (2 U.S.C. 661a); and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id18000AA906454C78884E5A48A10D76CA"><enum>(B)</enum><text display-inline="yes-display-inline">establishes a limitation on the total loan
				principal that may be guaranteed; and</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id605B547E05E24F3BB31CBAC6ED0FA4D1"><enum>(2)</enum><text display-inline="yes-display-inline">made without regard to the limitations of
				existing law, other than section 1341 of title 31, United States Code.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID98c6fcadec524c98a8d8fe8f22d4cee7"><enum>(d)</enum><header display-inline="yes-display-inline">Aggregate loan amounts</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id9B8197034C1245D485E282816026C521"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If the making of any loan under this
				section to correct a shortfall would cause the aggregate outstanding amount of
				all obligations of the Federal Government under this title relating to such
				shortfall to exceed $50,000,000, such loan may be made only—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idD659745D87A7499ABE90973053744DBB"><enum>(A)</enum><text display-inline="yes-display-inline">if the President has notified the Committee
				on Banking, Housing, and Urban Affairs of the Senate and the Committee on
				Financial Services of the House of Representatives, in writing, of the proposed
				loan; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBA41E8E71C09491F82898D23473DF98E"><enum>(B)</enum><text display-inline="yes-display-inline">after the 30-day period following the date
				on which notice under subparagraph (A) is provided.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID31a08eb705874f6b9d3271e7a8c1fe56"><enum>(2)</enum><header display-inline="yes-display-inline">Waivers authorized</header><text display-inline="yes-display-inline">The requirements of paragraph (1) may be
				waived—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID46b93fdaadbc4261b5db98e5dd38d909"><enum>(A)</enum><text display-inline="yes-display-inline">during a period of national emergency
				declared by the Congress or the President; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID85a0e29872ce4bc5b4a0782a1b05d5bc"><enum>(B)</enum><text display-inline="yes-display-inline">upon a determination by the President, on a
				nondelegable basis, that a specific loan is necessary to avert an industrial
				resource or critical technology shortfall that would severely impair national
				defense capability.</text>
								</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID216E5415375D4DAD823B7D9757BE1A83" section-type="subsequent-section"><enum>303.</enum><header display-inline="yes-display-inline">Other Presidential Action
				Authorized</header>
						<subsection commented="no" display-inline="no-display-inline" id="idD6DFC01CA92F40F789F3F3D67F8F08AF"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header>
							<paragraph commented="no" display-inline="no-display-inline" id="IDECF42C58DA2C40189934A245465960F7"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">To create, maintain, protect, expand, or
				restore domestic industrial base capabilities essential for the national
				defense, the President may make provision—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID23EF4FABE589491A858DE55513DC258D"><enum>(A)</enum><text display-inline="yes-display-inline">for purchases of or commitments to purchase
				an industrial resource or a critical technology item, for Government use or
				resale;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID25D094870A3942D2AC183A51E5E9ACA4"><enum>(B)</enum><text display-inline="yes-display-inline">for the encouragement of exploration,
				development, and mining of critical and strategic materials, and other
				materials;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID96b6945249444aa5a414220512848586"><enum>(C)</enum><text display-inline="yes-display-inline">for the development of production
				capabilities; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf12b1b2bd820400985d66b2a52e07544"><enum>(D)</enum><text display-inline="yes-display-inline">for the increased use of emerging
				technologies in security program applications and the rapid transition of
				emerging technologies—</text>
									<clause commented="no" display-inline="no-display-inline" id="id6540C3CDF2D94EA0BAFE5BAEB572FDA8"><enum>(i)</enum><text display-inline="yes-display-inline">from Government-sponsored research and
				development to commercial applications; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id36AE3323282144049DD3EF5632386061"><enum>(ii)</enum><text display-inline="yes-display-inline">from commercial research and development to
				national defense applications.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4CB1E1BF47BA467ABBE387496E5122E5"><enum>(2)</enum><header display-inline="yes-display-inline">Treatment of certain agricultural
				commodities</header><text display-inline="yes-display-inline">A purchase for
				resale under this subsection shall not include that part of the supply of an
				agricultural commodity which is domestically produced, except to the extent
				that such domestically produced supply may be purchased for resale for
				industrial use or stockpiling.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4734D08D3737470D8D8F3EDD7FE40AA4"><enum>(3)</enum><header display-inline="yes-display-inline">Terms
				of sales</header><text display-inline="yes-display-inline">No commodity
				purchased under this subsection shall be sold at less than—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDD398517124F8468B85001E247EABDE64"><enum>(A)</enum><text display-inline="yes-display-inline">the established ceiling price for such
				commodity, except that minerals, metals, and materials shall not be sold at
				less than the established ceiling price, or the current domestic market price,
				whichever is lower; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1659FF895ECC48BDB3E0C2855CF95507"><enum>(B)</enum><text display-inline="yes-display-inline">if no ceiling price has been established,
				the higher of—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID6A2AF0B2E56D4FBB867726691A3ADEEA"><enum>(i)</enum><text display-inline="yes-display-inline">the current domestic market price for such
				commodity; or</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID58BA81D4B81542F9B7A0E8236D811EE3"><enum>(ii)</enum><text display-inline="yes-display-inline">the minimum sale price established for
				agricultural commodities owned or controlled by the Commodity Credit
				Corporation, as provided in section 407 of the Agricultural Act of 1949 (7
				U.S.C. 1427).</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE15CB4C2FB654830A2B56645DA5946DC"><enum>(4)</enum><header display-inline="yes-display-inline">Delivery
				dates</header><text display-inline="yes-display-inline">No purchase or
				commitment to purchase any imported agricultural commodity shall specify a
				delivery date which is more than 1 year after the date of termination of this
				section.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0CEDEAF248554007821BC5C10154A11C"><enum>(5)</enum><header display-inline="yes-display-inline">Presidential determinations</header><text display-inline="yes-display-inline">Except as provided in paragraph (7), the
				President may not execute a contract under this subsection unless the President
				determines that—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID744FDE232EF14E0DB2ADDE0DF0D8D806"><enum>(A)</enum><text display-inline="yes-display-inline">the industrial resource, material, or
				critical technology item is essential to the national defense; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD547FFD57F2243E08B8F15E8D4FBD555"><enum>(B)</enum><text display-inline="yes-display-inline">without Presidential action under this
				section, United States industry cannot reasonably be expected to provide the
				capability for the needed industrial resource, material, or critical technology
				item in a timely manner.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID73d5a2036c6247b892e6ac852b6d9590"><enum>(6)</enum><header display-inline="yes-display-inline">Notification to Congress of
				shortfall</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID919e2387c21c4ac99b0d087d69fefd45"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (7), the
				President shall provide written notice to the Committee on Banking, Housing,
				and Urban Affairs of the Senate and the Committee on Financial Services of the
				House of Representatives of a domestic industrial base shortfall prior to
				taking action under this subsection to remedy the shortfall. The notice shall
				include the determinations made by the President under paragraph (5).</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe8e20f2d145d469fb53c2a2030f0671b"><enum>(B)</enum><header display-inline="yes-display-inline">Aggregate amounts</header><text display-inline="yes-display-inline">If the taking of any action under this
				subsection to correct a domestic industrial base shortfall would cause the
				aggregate outstanding amount of all such actions for such shortfall to exceed
				$50,000,000, the action or actions may be taken only after the 30-day period
				following the date on which the Committee on Banking, Housing, and Urban
				Affairs of the Senate and the Committee on Financial Services of the House of
				Representatives have been notified in writing of the proposed action.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID50178A87C3A940958063041D48EF7540"><enum>(7)</enum><header display-inline="yes-display-inline">Waivers authorized</header><text display-inline="yes-display-inline">The requirements of paragraphs (1) through
				(6) may be waived—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDDC9344D91AF4405B934C63485084F34C"><enum>(A)</enum><text display-inline="yes-display-inline">during a period of national emergency
				declared by the Congress or the President; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3F3A3BB677EC448D91B5804EB76A7DDA"><enum>(B)</enum><text display-inline="yes-display-inline">upon a determination by the President, on a
				nondelegable basis, that action is necessary to avert an industrial resource or
				critical technology item shortfall that would severely impair national defense
				capability.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0FB643B46F7945E2B98DC4A6CF1DE8B6"><enum>(b)</enum><header display-inline="yes-display-inline">Exemption for certain
				limitations</header><text display-inline="yes-display-inline">Subject to the
				limitations in subsection (a), purchases and commitments to purchase and sales
				under subsection (a) may be made without regard to the limitations of existing
				law (other than section 1341 of title 31, United States Code), for such
				quantities, and on such terms and conditions, including advance payments, and
				for such periods, but not extending beyond a date that is not more than 10
				years from the date on which such purchase, purchase commitment, or sale was
				initially made, as the President deems necessary, except that purchases or
				commitments to purchase involving higher than established ceiling prices (or if
				no such established ceiling prices exist, currently prevailing market prices)
				or anticipated loss on resale shall not be made, unless it is determined that
				supply of the materials could not be effectively increased at lower prices or
				on terms more favorable to the Government, or that such purchases are necessary
				to assure the availability to the United States of overseas supplies.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDACDA79088175460B94BA98DABFCE28A1"><enum>(c)</enum><header display-inline="yes-display-inline">Presidential findings</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id4C5A53FE23B94F50BF044EDE599FF35B"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The President may take the actions
				described in paragraph (2), if the President finds that—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID5A54C77033EA4F5BA01F4E578E01C71C"><enum>(A)</enum><text display-inline="yes-display-inline">under generally fair and equitable ceiling
				prices, for any raw or nonprocessed material, there will result a decrease in
				supplies from high-cost sources of such material, and that the continuation of
				such supplies is necessary to carry out the objectives of this title; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1ABACFAC52F4409F9C0A48B3D6E76591"><enum>(B)</enum><text display-inline="yes-display-inline">an increase in cost of transportation is
				temporary in character and threatens to impair maximum production or supply in
				any area at stable prices of any materials.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4A514EE0157848819C90A49795AA6F34"><enum>(2)</enum><header display-inline="yes-display-inline">Subsidy payments authorized</header><text display-inline="yes-display-inline">Upon a finding under paragraph (1), the
				President may make provision for subsidy payments on any such domestically
				produced material, other than an agricultural commodity, in such amounts and in
				such manner (including purchases of such material and its resale at a loss),
				and on such terms and conditions, as the President determines to be necessary
				to ensure that supplies from such high-cost sources are continued, or that
				maximum production or supply in such area at stable prices of such materials is
				maintained, as the case may be.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9D57064F5E4D4ACCA736CE3E0582F7F2"><enum>(d)</enum><header display-inline="yes-display-inline">Incidental authority</header><text display-inline="yes-display-inline">The procurement power granted to the
				President by this section shall include the power to transport and store and
				have processed and refined any materials procured under this section.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID5abe176cd43e44f880062ae90ebad553"><enum>(e)</enum><header display-inline="yes-display-inline">Installation of equipment in industrial
				facilities</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id2D38BC8764F245919E3E3A923B75674B"><enum>(1)</enum><header display-inline="yes-display-inline">Installation authorized</header><text display-inline="yes-display-inline">If the President determines that such
				action will aid the national defense, the President is authorized—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID684a9dbb5d7f4d94bffe62beccbcb48b"><enum>(A)</enum><text display-inline="yes-display-inline">to procure and install additional
				equipment, facilities, processes or improvements to plants, factories, and
				other industrial facilities owned by the Federal Government;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1831b25c704b47259f590da8b23747aa"><enum>(B)</enum><text display-inline="yes-display-inline">to procure and install equipment owned by
				the Federal Government in plants, factories, and other industrial facilities
				owned by private persons;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID46d1871f6c0f48989188da151af6dd0a"><enum>(C)</enum><text display-inline="yes-display-inline">to provide for the modification or
				expansion of privately owned facilities, including the modification or
				improvement of production processes, when taking actions under section 301,
				302, or this section; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDdacd38ffcb2b48ab8f8212b29b46dc85"><enum>(D)</enum><text display-inline="yes-display-inline">to sell or otherwise transfer equipment
				owned by the Federal Government and installed under this subsection to the
				owners of such plants, factories, or other industrial facilities.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id590C2FD02ACF441C8ED6CBA81CF5EAAF"><enum>(2)</enum><header display-inline="yes-display-inline">Indemnification</header><text display-inline="yes-display-inline">The owner of any plant, factory, or other
				industrial facility that receives equipment owned by the Federal Government
				under this section shall agree—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id262B4FA401A54EB688650AB69A9D57A5"><enum>(A)</enum><text display-inline="yes-display-inline">to waive any claim against the United
				States under section 107 or 113 of the Comprehensive Environmental Response,
				Compensation, and Liability Act of 1980 (42 U.S.C. 9607 and 9613); and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCA4F1AB4668C4F64B29DB77CFD2CFEC3"><enum>(B)</enum><text display-inline="yes-display-inline">to indemnify the United States against any
				claim described in paragraph (1) made by a third party that arises out of the
				presence or use of equipment owned by the Federal Government.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID454636DCCAF4408D8ADFD4B8E1D1BD72"><enum>(f)</enum><header display-inline="yes-display-inline">Excess metals, minerals, and
				materials</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id1F10E6C43F734822ADF09C91EB111D00"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law
				to the contrary, metals, minerals, and materials acquired pursuant to this
				section which, in the judgment of the President, are excess to the needs of
				programs under this Act, shall be transferred to the National Defense Stockpile
				established by the <act-name parsable-cite="SCMSPA">Strategic and Critical
				Materials Stock Piling Act</act-name> (50 U.S.C. 98 et seq.), when the
				President deems such action to be in the public interest.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDB7AB8A070214180984FB535AC54A96E"><enum>(2)</enum><header display-inline="yes-display-inline">Transfers at no charge</header><text display-inline="yes-display-inline">Transfers made pursuant to this subsection
				shall be made without charge against or reimbursement from funds appropriated
				for the purposes of the Strategic and Critical Materials Stock Piling Act (50
				U.S.C. 98 et seq.), except that costs incident to such transfer, other than
				acquisition costs, shall be paid or reimbursed from such funds.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0CC862EB31C34FB1B1A07B44AFF210AC"><enum>(g)</enum><header display-inline="yes-display-inline">Substitutes</header><text display-inline="yes-display-inline">When, in the judgement of the President, it
				will aid the national defense, the President may make provision for the
				development of substitutes for strategic and critical materials, critical
				components, critical technology items, and other industrial resources.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="ID39384BD732F24DE6930F1F62729F64E3" section-type="subsequent-section"><enum>304.</enum><header display-inline="yes-display-inline">Defense Production Act Fund</header>
						<subsection commented="no" display-inline="no-display-inline" id="IDB588D2A8912A450FA4B672FA847E04CD"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment of fund</header><text display-inline="yes-display-inline">There is established in the Treasury of the
				United States a separate fund to be known as the <quote>Defense Production Act
				Fund</quote> (in this section referred to as the <quote>Fund</quote>).</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID2C4BEC1CD11946A9A9A3A678158BC971"><enum>(b)</enum><header display-inline="yes-display-inline">Moneys
				in fund</header><text display-inline="yes-display-inline">There shall be
				credited to the Fund—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID31FE6A71474C4979A4035BDBE9B5368B"><enum>(1)</enum><text display-inline="yes-display-inline">all moneys appropriated for the Fund, as
				authorized by section 711; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID931180B8BBF24981AEF36A51AC729F0D"><enum>(2)</enum><text display-inline="yes-display-inline">all moneys received by the Fund on
				transactions entered into pursuant to section 303.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID4B6523324BA84007BD33FDA19D8ADE7F"><enum>(c)</enum><header display-inline="yes-display-inline">Use of fund</header><text display-inline="yes-display-inline">The Fund shall be available to carry out
				the provisions and purposes of this title, subject to the limitations set forth
				in this Act and in appropriations Acts.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDF33BD0131AB4491C82376CA2E0C03C92"><enum>(d)</enum><header display-inline="yes-display-inline">Duration of fund</header><text display-inline="yes-display-inline">Moneys in the Fund shall remain available
				until expended.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID7D070E81B6F54F48B3525F9A835CE766"><enum>(e)</enum><header display-inline="yes-display-inline">Fund balance</header><text display-inline="yes-display-inline">The Fund balance at the close of each
				fiscal year shall not exceed $750,000,000, excluding any moneys appropriated to
				the Fund during that fiscal year or obligated funds. If, at the close of any
				fiscal year, the Fund balance exceeds $750,000,000, the amount in excess of
				$750,000,000 shall be paid into the general fund of the Treasury.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID69584D33D2D34031977D8A35A6F9476F"><enum>(f)</enum><header display-inline="yes-display-inline">Fund manager</header><text display-inline="yes-display-inline">The President shall designate a Fund
				manager. The duties of the Fund manager shall include—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="IDB3C4D45824BD4DA0A78EAF328C8AA6FC"><enum>(1)</enum><text display-inline="yes-display-inline">determining the liability of the Fund in
				accordance with subsection (g);</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID61E1F0AFE3D64580981D48397E6B3307"><enum>(2)</enum><text display-inline="yes-display-inline">ensuring the visibility and accountability
				of transactions engaged in through the Fund; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA7AA7FF100AA420098FAAF1FADC15D1D"><enum>(3)</enum><text display-inline="yes-display-inline">reporting to the Congress each year
				regarding activities of the Fund during the previous fiscal year.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID3FF41822E4354EC09345A33399AC002A"><enum>(g)</enum><header display-inline="yes-display-inline">Liabilities against fund</header><text display-inline="yes-display-inline">When any agreement entered into pursuant to
				this title after December 31, 1991, imposes any contingent liability upon the
				United States, such liability shall be considered an obligation against the
				Fund.</text>
						</subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="ID24b8fa7cd7674a9d9e3626c6ac6b2dc6" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">Section 702 of the Defense Production Act of
			 1950 (50 U.S.C. App. 2152) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="ID67a16bcd8d8544378ae876919e9fb587"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking
			 <quote>military equipment identified by the Secretary of Defense</quote> and
			 inserting <quote>equipment identified by the President</quote>;</text>

				United States;</text>

				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="ID63201bb36c6548f39ff9905147ede28e" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Voluntary agreements and plans of action
			 for national defense</header><text display-inline="no-display-inline">Section
			 708 of the Defense Production Act of 1950 (50 U.S.C. App. 2158) is
			 amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="ID4762c7227ae64e82912502ccf8b74a4f"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id27E5B46522E04BE79CEFD98E26F4999E"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking
			 <quote>defense of the United States</quote> and all that follows through the
			 period and inserting <quote>national defense.</quote>; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id56E3B8A8E3C9476DBAD16B1527DDD419"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

				nondelegable basis, that a specific voluntary agreement or plan of action is
				necessary to meet national defense requirements resulting from an event that
				degrades or destroys critical infrastructure—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idF0287CCBDB7B445BA1D035E66275EFBF"><enum>(A)</enum><text display-inline="yes-display-inline">an
				individual that has been delegated authority under paragraph (1) with respect
				to such agreement or plan shall not be required to consult with the Attorney
				General or the Federal Trade Commission under paragraph (2)(B); and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE114D0ABC6A94C57B9AA2F27EAC9F87E"><enum>(B)</enum><text display-inline="yes-display-inline">the President shall publish a rule in
				accordance with subsection (e)(2)(B) and publish notice in accordance with
				subsection (e)(3)(B) with respect to such agreement or plan as soon as is
				practicable under the
				circumstances.</text>
							</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2d1d1133bdeb498899ef13a3ee12b042"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (f)(2)—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id0B63889C730247FF988F0F6C4466AF8D"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>two years</quote> each
			 place that term appears and inserting <quote>5 years</quote>; and</text>

				agreement or plan of action approved pursuant to this section that complies

			 employees; printing and distribution of reports</header><text display-inline="no-display-inline">Section 710 of the Defense Production Act of

			 Committee</header><text display-inline="no-display-inline">Section 722 of the
			 Defense Production Act of 1950 (50 U.S.C. App. 2171) is amended to read as
			 follows:</text>

				<section commented="no" display-inline="no-display-inline" id="id631F0975F0BF434287AD073C42546F44" section-type="subsequent-section"><enum>722.</enum><header display-inline="yes-display-inline">Defense Production Act Committee</header>
					<subsection commented="no" display-inline="no-display-inline" id="idF83F272E8F1145DCB4597BBC571EEB91"><enum>(a)</enum><header display-inline="yes-display-inline">Committee established</header><text display-inline="yes-display-inline">There is established the Defense Production
				Act Committee (in this section referred to as the <quote>Committee</quote>),
				which shall advise the President on the effective use of the authority under
				this Act by the departments, agencies, and independent establishments of the
				Federal Government to which the President has delegated authority under this
				Act.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id64BD0A0B84FC43399094086CCD4C1E7C"><enum>(b)</enum><header display-inline="yes-display-inline">Membership</header>
						<paragraph commented="no" display-inline="no-display-inline" id="idB9332C294457456999B2DD02316B8DBB"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The members of the Committee shall
				be—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idB8B069DC19D64CBA89BF83B5D2F023A7"><enum>(A)</enum><text display-inline="yes-display-inline">the head of each Federal agency to which
				the President has delegated authority under this Act; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC81367F4EDAA4F99B4934BA4DC51FBE3"><enum>(B)</enum><text display-inline="yes-display-inline">the Chairperson of the Council of Economic
				Advisors.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA8B1029FCA584C20A4D21BF806455BB8"><enum>(2)</enum><header display-inline="yes-display-inline">Chairperson</header><text display-inline="yes-display-inline">The President shall designate 1 member of
				the Committee as the Chairperson of the Committee.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id639AEE529CDE45E7AFD38D83457238B4"><enum>(c)</enum><header display-inline="yes-display-inline">Executive director</header>
						<paragraph commented="no" display-inline="no-display-inline" id="idE035F3550771465FA90E5F3AEB751611"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The President shall appoint an Executive
				Director of the Defense Production Act Committee (in this section referred to
				as the <quote>Executive Director</quote>), who shall—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idB2119D7EB15F4BC6B049D574F07DC349"><enum>(A)</enum><text display-inline="yes-display-inline">be responsible to the Chairperson of the
				Committee; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id94B40D84194743FBBCF12A639E502D0B"><enum>(B)</enum><text display-inline="yes-display-inline">carry out such activities relating to the
				Committee as the Chairperson may determine.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8E579C16B2DB46B0B4C13B4B66E536D2"><enum>(2)</enum><header display-inline="yes-display-inline">Appointment</header><text display-inline="yes-display-inline">The appointment by the President shall not
				be subject to the advice and consent of the Senate.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id99A2FB73B57E4CB487DF924FDA5E37D2"><enum>(3)</enum><header display-inline="yes-display-inline">Compensation</header><text display-inline="yes-display-inline">For pay periods beginning on or after the
				date on which each Chairperson is appointed, funds for the pay of the Executive
				Director shall be paid from appropriations to the salaries and expenses account
				of the department or agency of the Chairperson of the Committee. The Executive
				Director shall be compensated at a rate of pay equivalent to that of a Deputy
				Assistant Secretary (or a comparable position) of the Federal agency of the
				Chairperson of the Committee.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id19FE9E0224D448F894ECBD72EF29ECC3"><enum>(d)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than the end of the first quarter
				of each calendar year, the Committee shall submit to the Committee on Banking,
				Housing, and Urban Affairs of the Senate and the Committee on Financial
				Services of the House of Representatives a report signed by each member of the
				Committee that contains—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="idC2F9A0DE93484CE0902CAFA9A9F27FDD"><enum>(1)</enum><text display-inline="yes-display-inline">a review of the authority under this Act of
				each department, agency, or independent establishment of the Federal Government
				to which the President has delegated authority under this Act;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id87465762DAE34E82BDD5B58F91823D8D"><enum>(2)</enum><text display-inline="yes-display-inline">recommendations for the effective use of
				the authority described in paragraph (1) in a manner consistent with the
				statement of policy under section 2(b);</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE61BB8D8FE3945319459246125D23F31"><enum>(3)</enum><text display-inline="yes-display-inline">recommendations for legislation,
				regulations, executive orders, or other action by the Federal Government
				necessary to improve the use of the authority described in paragraph (1);
				and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id01ABBFD6ADE149E38FE43FA9BC97F92A"><enum>(4)</enum><text display-inline="yes-display-inline">recommendations for improving information
				sharing between departments, agencies, and independent establishments of the
				Federal Government relating to all aspects of the authority described in
				paragraph (1).</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0708C3AA1FF544F7B456B29F7D12D5ED"><enum>(e)</enum><header display-inline="yes-display-inline">Federal Advisory Committee
				Act</header><text display-inline="yes-display-inline">The provisions of the
				Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the
				Committee.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="idFE67F3A4685F4FE3A304844CF3A4E4F4" section-type="subsequent-section"><enum>12.</enum><header display-inline="yes-display-inline">Annual report on impact of offsets</header>
			<subsection commented="no" display-inline="no-display-inline" id="idB3A4A790C34446BC8DE50520EB69CDA7"><enum>(a)</enum><header display-inline="yes-display-inline">Annual report</header><text display-inline="yes-display-inline">Title VII of the Defense Production Act of
			 1950 (50 U.S.C. App. 2151 et seq.) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id8167ADE93C634AEBAABEB822B85DF3D5" style="OLC">
					<section commented="no" display-inline="no-display-inline" id="ID9D32EB2014304F25BF5F7CB9597D6EA2" section-type="subsequent-section"><enum>723.</enum><header display-inline="yes-display-inline">Annual report on impact of offsets</header>
						<subsection commented="no" display-inline="no-display-inline" id="id7E4EBEA258734D15A2184CC30C4BE41A"><enum>(a)</enum><header display-inline="yes-display-inline">Report required</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID38C701C7129641278263E50E784DA17A"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The President shall submit to the Committee
				on Banking, Housing, and Urban Affairs of the Senate and the Committee on
				Financial Services of the House of Representatives, a detailed annual report on
				the impact of offsets on the defense preparedness, industrial competitiveness,
				employment, and trade of the United States.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID81DB0D45DA854F08BFCBEF724348E59D"><enum>(2)</enum><header display-inline="yes-display-inline">Duties of the secretary of
				commerce</header><text display-inline="yes-display-inline">The Secretary of
				Commerce (hereafter in this subsection referred to as the
				<quote>Secretary</quote>) shall—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID7C5E9244BF7442AAB282168395B155FA"><enum>(A)</enum><text display-inline="yes-display-inline">prepare the report required by paragraph
				(1);</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC3D7A14AB2CE4A0D8A441BC55DBDB887"><enum>(B)</enum><text display-inline="yes-display-inline">consult with the Secretary of Defense, the
				Secretary of the Treasury, the Secretary of State, and the United States Trade
				Representative in connection with the preparation of such report; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC8F766BCACF2401CB16485BE72DAED5F"><enum>(C)</enum><text display-inline="yes-display-inline">function as the President's Executive Agent
				for carrying out this section.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2F90E8DA29664F42BFB95E4CC65448AA"><enum>(b)</enum><header display-inline="yes-display-inline">Interagency studies and related
				data</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID7E315EADA37E48F5B53A21A59159441A"><enum>(1)</enum><header display-inline="yes-display-inline">Purpose of report</header><text display-inline="yes-display-inline">Each report required under subsection (a)
				shall identify the cumulative effects of offset agreements on—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDA48572578C29454F857E6368925B6430"><enum>(A)</enum><text display-inline="yes-display-inline">the full range of domestic defense
				productive capability (with special attention paid to the firms serving as
				lower-tier subcontractors or suppliers); and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID515B71859FD94FFFBCBCE84C4E3A0388"><enum>(B)</enum><text display-inline="yes-display-inline">the domestic defense technology base as a
				consequence of the technology transfers associated with such offset
				agreements.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD25D3CA057EB4BCF8170AA53A4524958"><enum>(2)</enum><header display-inline="yes-display-inline">Use of data</header><text display-inline="yes-display-inline">Data developed or compiled by any agency
				while conducting any interagency study or other independent study or analysis
				shall be made available to the Secretary to facilitate the execution of the
				Secretary's responsibilities with respect to trade offset and countertrade
				policy development.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9760FE22C70447668C29D08FD8978C5A"><enum>(c)</enum><header display-inline="yes-display-inline">Notice of offset agreements</header>
							<paragraph commented="no" display-inline="no-display-inline" id="IDB8CE8D118384436D8672D2E013FD9DDE"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If a United States firm enters into a
				contract for the sale of a weapon system or defense-related item to a foreign
				country or foreign firm and such contract is subject to an offset agreement
				exceeding $5,000,000 in value, such firm shall furnish to the official
				designated in the regulations promulgated pursuant to paragraph (2) information
				concerning such sale.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD637CA0815AB4A3C80CE204CEBCB1A98"><enum>(2)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">The information to be furnished under
				paragraph (1) shall be prescribed in regulations promulgated by the Secretary.
				Such regulations shall provide protection from public disclosure for such
				information, unless public disclosure is subsequently specifically authorized
				by the firm furnishing the information.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0DCC00E90674427C920026CE24CF7B7B"><enum>(d)</enum><header display-inline="yes-display-inline">Contents of report</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID902EA6F9540444F180D6174F25554ED1"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each report under subsection (a) shall
				include—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDD6741B48B3ED40099425F9A864F7C2C7"><enum>(A)</enum><text display-inline="yes-display-inline">a net assessment of the elements of the
				industrial base and technology base covered by the report;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD9EF42B8CAAF462A8CC8835CF3546FEE"><enum>(B)</enum><text display-inline="yes-display-inline">recommendations for appropriate remedial
				action under the authority of this Act, or other law or regulations;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID533F25BFC7164F25935531FC1F3C606F"><enum>(C)</enum><text display-inline="yes-display-inline">a summary of the findings and
				recommendations of any interagency studies conducted during the reporting
				period under subsection (b);</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF7779CEBF1904C0080A39ED6B07920B8"><enum>(D)</enum><text display-inline="yes-display-inline">a summary of offset arrangements concluded
				during the reporting period for which information has been furnished pursuant
				to subsection (c); and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID75C1DEE04AE641C68E5F21EE0AB1F08E"><enum>(E)</enum><text display-inline="yes-display-inline">a summary and analysis of any bilateral and
				multilateral negotiations relating to the use of offsets completed during the
				reporting period.</text>

				recommendations</header><text display-inline="yes-display-inline">Each report
				required under this section shall include any alternative findings or
				recommendations offered by any departmental Secretary, agency head, or the
				United States Trade Representative to the Secretary.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0526DD55EBF04773A3A015B094EB81C6"><enum>(e)</enum><header display-inline="yes-display-inline">Utilization of annual report in
				negotiations</header><text display-inline="yes-display-inline">The findings and
				recommendations of the reports required by subsection (a), and any interagency
				reports and analyses shall be considered by representatives of the United
				States during bilateral and multilateral negotiations to minimize the adverse
				effects of
				offsets.</text>
