			 Wood Products Act</short-title></quote>.</text>

			<subsection id="idF9C1E40B3FB94F3EB7A227CB6CE7D16D"><enum>(a)</enum><header>Amendment</header><text>The
			 Toxic Substances Control Act (15 U.S.C. 2601 et seq.) is amended by adding at
			 the end the following:</text>

						<section id="idA31774941F4549078D049CF538B64DB2"><enum>601.</enum><header>Formaldehyde
				standards</header>
							<subsection id="id7E0A98E2EEDB4379A701508A1BDD3F51"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph id="id7E6CB7E67CD14C19A94A36E2458A9B02"><enum>(1)</enum><header>Finished
				good</header>
									<subparagraph id="idCB2252A5EA184B669D7A0C557C99CD1F"><enum>(A)</enum><header>In
				general</header><text>The term <term>finished good</term> means any good or
				product (other than a panel) containing—</text>
										<clause id="idA988F1F6F29A4D4C8D5B4AABAE686D19"><enum>(i)</enum><text>hardwood
				plywood;</text>
										</clause><clause id="id517DE1DBDCC444A59CC882E7104E294E"><enum>(ii)</enum><text>particleboard;
				or</text>
										</clause><clause id="idAAE7EB2DDC9D4FD19672E2BFAB7F6350"><enum>(iii)</enum><text>medium-density
				fiberboard.</text>
										</clause></subparagraph><subparagraph id="id8F4119D849E240F3BE86FFB044DD5022"><enum>(B)</enum><header>Inclusions</header><text>The
				term <term>finished good</term> includes—</text>
										<clause id="idBD587F91C5DA4724B656CE934924A14E"><enum>(i)</enum><text>manufactured
				housing; and</text>
										</clause><clause id="idC67A1B32DBA744F5A291881D1D57EF86"><enum>(ii)</enum><text>recreational
				vehicles.</text>
										</clause></subparagraph><subparagraph id="id3F971BEE54FA4BF8B9EB4DC6D5188C12"><enum>(C)</enum><header>Exclusions</header><text>The
				term <term>finished good</term> does not include—</text>
										<clause id="idCB6A4D520B06485885CD3A24D4B640CD"><enum>(i)</enum><text>any component part
				or other part used in the assembly of a finished good; or</text>
										</clause><clause id="id5101CCC3D1A246D19637FB050134A1C7"><enum>(ii)</enum><text>any finished good
				that has previously been sold or supplied to an individual or entity that
				purchased or acquired the finished good in good faith for purposes other than
				resale, such as—</text>
											<subclause id="idE4A9D8582C2E4AA98BAB869CF51E2F5F"><enum>(I)</enum><text>an antique;
				or</text>
											</subclause><subclause id="idFAE9A17F366B41A291F2429EAA9EABCF"><enum>(II)</enum><text>secondhand
				furniture.</text>
											</subclause></clause></subparagraph></paragraph><paragraph id="ID67ee0c5c937946359c782f0ad8be8072"><enum>(2)</enum><header>Hardwood
				plywood</header>
									<subparagraph id="id359616618E8F474591817E8F980429B7"><enum>(A)</enum><header>In
				general</header><text>The term <term>hardwood plywood</term> means a hardwood
				or decorative panel that is—</text>
										<clause id="id674D77580C81450A8920AAA243B67109"><enum>(i)</enum><text>intended for
				interior use; and</text>
										</clause><clause id="id1C0BB8A6D1CC4C9584D60A7377E587AC"><enum>(ii)</enum><text>composed of (as
				determined under the standard numbered ANSI/HPVA HP–1–2004 (or a successor
				standard)) an assembly of layers or plies of veneer, joined by an adhesive
				with—</text>
											<subclause id="id5910D32257424DC4B8DB56A9BCE1934D"><enum>(I)</enum><text>lumber
				core;</text>
											</subclause><subclause id="id40392E31F8B54BC6B93CAE1D930BB89E"><enum>(II)</enum><text>particleboard
				core;</text>
											</subclause><subclause id="idDCFFFA3A2A0047DCA37F9F652B4DCF7B"><enum>(III)</enum><text>medium-density
				fiberboard core;</text>
											</subclause><subclause id="id844BDBC1E15A4A88870ACD94B0BE22E5"><enum>(IV)</enum><text>hardboard core;
				or</text>
											</subclause><subclause id="id786584602BD54CB68A326DF8C7C60EDA"><enum>(V)</enum><text>any other special
				core or special back material.</text>
											</subclause></clause></subparagraph><subparagraph id="id13CE62681218429D9A06DA7206DA3151"><enum>(B)</enum><header>Exclusions</header><text>The
				term <term>hardwood plywood</term> does not include—</text>
										<clause id="id7570B52FC3CE400CA7784C7F678145AA"><enum>(i)</enum><text>a laminated
				product;</text>
										</clause><clause id="idE7CE33C3C8B14B22B63B8D85C9C34438"><enum>(ii)</enum><text>military-specified
				plywood;</text>
										</clause><clause id="id367031BB08DF4921A7F3ADA7C7E13354"><enum>(iii)</enum><text>curved plywood;
				or</text>
										</clause><clause id="idE6BB0C6270504E7783F787AF4A01F68F"><enum>(iv)</enum><text>any other product
				specified in—</text>
											<subclause id="idE49F4DC5DB3741A788993717E5261DA8"><enum>(I)</enum><text>the standard
				entitled <quote>Voluntary Product Standard–Structural Plywood</quote> and
				numbered PS 1–07 (or a successor standard); or</text>
											</subclause><subclause id="id9C75D230D174443FB5026FC88D30E834"><enum>(II)</enum><text>the standard
				entitled <quote>Voluntary Product Standard–Performance Standard for Wood-Based
				Structural-Use Panels</quote> and numbered PS 2–04 (or a successor
				standard).</text>
											</subclause></clause></subparagraph></paragraph><paragraph id="ID8f793918eda044ed88eb12b0b070c45d"><enum>(3)</enum><header>Laminated
				product</header><text>The term <term>laminated product</term> means a
				product—</text>
									<subparagraph id="id7E550DDDC6CB40F78A89105CD4F1F391"><enum>(A)</enum><text>in which a wood
				veneer is affixed to—</text>
										<clause id="idC46543A9BB0A4FBCB316687BA99196C7"><enum>(i)</enum><text>a particleboard
				platform;</text>
										</clause><clause id="idD1F88034AA0F45B9B6383E8A9C7E65B2"><enum>(ii)</enum><text>a medium-density
				fiberboard platform; or</text>
										</clause><clause id="id7B376060A9684255BDA09CB6D0EDA7D8"><enum>(iii)</enum><text>a veneer-core
				platform; and</text>
										</clause></subparagraph><subparagraph id="id7D1892D783A348ECBB8FCA69B9738810"><enum>(B)</enum><text>that is—</text>
										<clause id="idA8E293CDEC1C46A8AAF57DD5A43DCBDF"><enum>(i)</enum><text>a component
				part;</text>
										</clause><clause id="idFF0B14E2DD1648B5BEC3E46CA5418F18"><enum>(ii)</enum><text>used in the
				construction or assembly of a finished good; and</text>
										</clause><clause id="id90800F3866CF4F8398F8177DBA32A996"><enum>(iii)</enum><text>produced by the
				manufacturer or fabricator of the finished good in which the product is
				incorporated.</text>
										</clause></subparagraph></paragraph><paragraph id="ID2beb286ad11a44bd85a330baf6ff8c18"><enum>(4)</enum><header>Medium-density
				fiberboard</header><text>The term <term>medium-density fiberboard</term> means
				a panel composed of cellulosic fibers made by dry forming and pressing a
				resinated fiber mat (as determined under the standard numbered ANSI A208.2–2009
				(or a successor standard)).</text>
								</paragraph><paragraph id="ID38d10c4ba8014051a392aeff7b50b292"><enum>(5)</enum><header>No-added
				formaldehyde-based resin</header>
									<subparagraph id="id41FC796FA7BC41E6AE76A030D82803D1"><enum>(A)</enum><header>In
				general</header><text>The term <term>no-added formaldehyde-based resin</term>
				means a resin formulated with no added formaldehyde as part of the resin
				cross-linking structure that meets the performance standard contained in
				section 93120.3(c) of title 17, California Code of Regulations (as in effect on
				July 28, 2009).</text>
									</subparagraph><subparagraph id="idD876F2F4AF60414CAB38517A8D1487D0"><enum>(B)</enum><header>Inclusions</header><text>The
				term <term>no-added formaldehyde-based resin</term> may include any resin made
				from—</text>
										<clause id="id6DC97EFB65554492B937841943102BF5"><enum>(i)</enum><text>soy;</text>
										</clause><clause id="idF31F1CE099824879936A01488BD01FEF"><enum>(ii)</enum><text>polyvinyl
				acetate; or</text>
										</clause><clause id="id6D31CFB1F2B641BFBA2ABB0DF9FEEA62"><enum>(iii)</enum><text>methylene
				diisocyanate.</text>
										</clause></subparagraph></paragraph><paragraph id="IDd22dc240a8ac4095aff5367d320f159f"><enum>(6)</enum><header>Particleboard</header>
									<subparagraph id="idC366565FE4B64A8D932790FFC5B5D546"><enum>(A)</enum><header>In
				general</header><text>The term <term>particleboard</term> means a panel
				composed of cellulosic material in the form of discrete particles (as
				distinguished from fibers, flakes, or strands) that are pressed together with
				resin (as determined under the standard numbered ANSI A208.1–2009 (or a
				successor standard)).</text>
									</subparagraph><subparagraph id="idA9C0A61EDC11404492D8B70B80DEC90C"><enum>(B)</enum><header>Exclusions</header><text>The
				term <term>particleboard</term> does not include any product specified in the
				standard entitled <quote>Voluntary Product Standard–Performance Standard for
				Wood-Based Structural-Use Panels</quote> and numbered PS 2–04 (or a successor
				standard).</text>
									</subparagraph></paragraph><paragraph id="id462479819F6247B5B6519B8AE0ACA8E3"><enum>(7)</enum><header>Ultra
				low-emitting formaldehyde resin</header>
									<subparagraph id="idA98F1B5768ED4981876C83C9094ECC12"><enum>(A)</enum><header>In
				general</header><text>The term <term>ultra low-emitting formaldehyde
				resin</term> means a resin formulated using a process the average formaldehyde
				emissions of which are consistently below the phase 2 emission standards
				contained in the airborne toxic control measure for composite wood products
				described in section 93120.3(d) of title 17, California Code of Regulations (as
				in effect on July 28, 2009).</text>
									</subparagraph><subparagraph id="idBA783953DB7040619B61606429C69477"><enum>(B)</enum><header>Inclusions</header><text>The
				term <term>ultra low-emitting formaldehyde resin</term> may include—</text>
										<clause id="id589A85E491774430B62D668C28907060"><enum>(i)</enum><text>melamine-urea-formaldehyde
				resin;</text>
										</clause><clause id="id294C9B3E391A4C3D87C7380B28C5F3B2"><enum>(ii)</enum><text>phenol
				formaldehyde resin; and</text>
										</clause><clause id="idB5D8CD689D9E471B8A4105120CB857CA"><enum>(iii)</enum><text>resorcinol
				formaldehyde resin.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="idB4B53AA404E6496EB06C76020A37B866"><enum>(b)</enum><header>Requirement</header>
								<paragraph id="idCE1CFE9673D34701BF5678BA20782777"><enum>(1)</enum><header>In
				general</header><text>Except as provided in subsection (d), effective beginning
				on the date that is 180 days after the date of enactment of this section, the
				formaldehyde emission standard contained in table 1 of section 93120.2(a) of
				title 17, California Code of Regulations (relating to an airborne toxic control
				measure to reduce formaldehyde emissions from composite wood products) (as in
				effect on July 28, 2009), shall apply to hardwood plywood, medium-density
				fiberboard, and particleboard sold, supplied, offered for sale, or manufactured
				in the United States.</text>
								</paragraph><paragraph id="id44A88327BC5A4937BA0A7D075264EA85"><enum>(2)</enum><header>Applicability</header><text>The
				formaldehyde emission standard referred to in paragraph (1) shall apply
				regardless of whether an applicable hardwood plywood, medium-density
				fiberboard, or particleboard is—</text>
									<subparagraph id="idBF7F7CF314254BA6947E05ADC44D3563"><enum>(A)</enum><text>in the form of an
				unfinished panel; or</text>
									</subparagraph><subparagraph id="id57AF0E94B3734456A5EF8B4715E3EE69"><enum>(B)</enum><text>incorporated into
				a finished good.</text>
									</subparagraph></paragraph></subsection><subsection id="ID938035f1944242f5a1c6ce09c5a44dcb"><enum>(c)</enum><header>Exemptions</header><text>The
				formaldehyde emission standard referred to in subsection (b)(1) shall not apply
				to—</text>
								<paragraph id="idDBFF393938D24C49AFF7890A248165EE"><enum>(1)</enum><text>hardboard;</text>
								</paragraph><paragraph id="idEDE290754A35460A9CD98B9AB953D42F"><enum>(2)</enum><text>structural
				plywood, as specified in the standard entitled <quote>Voluntary Product
				Standard–Structural Plywood</quote> and numbered PS 1–07 (or a successor
				standard);</text>
								</paragraph><paragraph id="id872EFBB00DFA40119EA8AC5E1B9D6BD4"><enum>(3)</enum><text>structural panels,
				as specified in the standard entitled <quote>Voluntary Product
				Standard–Performance Standard for Wood-Based Structural-Use Panels</quote> and
				numbered PS 2–04 (or a successor standard);</text>
								</paragraph><paragraph id="id1C9C61FD2D874E6D94C06438A800AA9F"><enum>(4)</enum><text>structural
				composite lumber, as specified in the standard entitled <quote>Standard
				Specification for Evaluation of Structural Composite Lumber Products</quote>
				and numbered ASTM D 5456–06 (or a successor standard);</text>
								</paragraph><paragraph id="id5C7946D420E94D5992A89D82156B34C0"><enum>(5)</enum><text>oriented strand
				board;</text>
								</paragraph><paragraph id="id62AAC5763E2A49AF9E60F3DD2FA78956"><enum>(6)</enum><text>glued laminated
				lumber, as specified in the standard entitled <quote>Structural Glued Laminated
				Timber</quote> and numbered ANSI A190.1–2002 (or a successor standard);</text>
								</paragraph><paragraph id="id2402AF43DB524509AB9F5C3511C84ECF"><enum>(7)</enum><text>prefabricated wood
				I-joists, as specified in the standard entitled <quote>Standard Specification
				for Establishing and Monitoring Structural Capacities of Prefabricated Wood
				I-Joists</quote> and numbered ASTM D 5055–05 (or a successor standard);</text>
								</paragraph><paragraph id="idD976330BFCEE468192510BEDD7FA7542"><enum>(8)</enum><text>finger-jointed
				lumber;</text>
								</paragraph><paragraph id="id5FF6F500B91B43CAAD51117A808FD97C"><enum>(9)</enum><text>wood packaging
				(including pallets, crates, spools, and dunnage); or</text>
								</paragraph><paragraph id="idD63FA03C209749C2A4278A90880699E5"><enum>(10)</enum><text>composite wood
				products used inside new vehicles (as defined in section 430 of the California
				Vehicle Code) (excluding recreational vehicles), rail cars, boats, aerospace
				craft, or aircraft.</text>
								</paragraph></subsection><subsection id="ID606a68bbcc25431aa9b656a9ce5a5ff6"><enum>(d)</enum><header>Regulations</header>
								<paragraph id="id5625AD3FB2F14A39ABEE96511C81C0A5"><enum>(1)</enum><header>In
				general</header><text>Not later than January 1, 2011, the Administrator shall
				promulgate regulations to implement the formaldehyde emission standard required
				under subsection (b) in a manner that ensures that compliance with the standard
				is equivalent to compliance with the standard contained in table 1 of section
				93120.2(a) of title 17, California Code of Regulations (as in effect on July
				28, 2009).</text>
								</paragraph><paragraph id="idCDC053F9DE484F6AB7FBCFFAEF8ECF4B"><enum>(2)</enum><header>Inclusions</header><text>The
				regulations promulgated pursuant to paragraph (1) shall include provisions
				relating to—</text>
									<subparagraph id="IDbeb9a74587c94a25bba7a9a973d56ddc"><enum>(A)</enum><text>labeling;</text>
									</subparagraph><subparagraph id="IDc8a755dfe2a9470bbfcc9b624c2d1cf0"><enum>(B)</enum><text>chain of custody
				requirements;</text>
									</subparagraph><subparagraph id="ID79a5445ecf2d43fc89144d189d1c935b"><enum>(C)</enum><text>sell-through
				provisions;</text>
									</subparagraph><subparagraph id="ID4f9eced06bf243fe92761ca7842f59e1"><enum>(D)</enum><text>ultra low-emitting
				formaldehyde resins;</text>
									</subparagraph><subparagraph id="IDf135ab1d42e240f2be192deac3770194"><enum>(E)</enum><text>no-added
				formaldehyde-based resins;</text>
									</subparagraph><subparagraph id="ID60194d4ed60048f891a80a1240f83aac"><enum>(F)</enum><text>finished
				goods;</text>
									</subparagraph><subparagraph id="IDbacca85e1668494e818123c5fef24773"><enum>(G)</enum><text>third-party
				testing and certification;</text>
									</subparagraph><subparagraph id="IDddc0fcd9bb0843a5ae5d571cd15c67ea"><enum>(H)</enum><text>auditing and
				reporting of third-party certifiers;</text>
									</subparagraph><subparagraph id="ID3eb0ef3f1e7742ed92ba5a07005baa94"><enum>(I)</enum><text>recordkeeping;
				and</text>
									</subparagraph><subparagraph id="ID54f2d3d289e74419bba768aaf4f3de06"><enum>(J)</enum><text>enforcement.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id455137B831D542E3AA2A799908F20694"><enum>(3)</enum><header display-inline="yes-display-inline">Import regulations</header><text display-inline="yes-display-inline">Not later than July 1, 2011, the
				Administrator, in coordination with the Commissioner of Customs and Border
				Protection and other appropriate Federal departments and agencies, shall revise
				regulations promulgated pursuant to section 13 as the Administrator determines
				to be necessary to ensure compliance with this section.</text>
								</paragraph><paragraph id="ID07cbb059d2cc4918b1f2587b90d186d1"><enum>(4)</enum><header>Modification of
				standards</header><text>The Administrator may modify, by regulation, any
				reference to an industry standard contained in this subsection if the standard
				is subsequently updated.</text>
								</paragraph></subsection><subsection id="IDa37672f4a516494d9e8690294895762e"><enum>(e)</enum><header>Prohibited
				acts</header><text>An individual or entity that violates any requirement under
				this section (including any regulation promulgated pursuant to subsection (d))
				shall be considered to have committed a prohibited act under section
				15.</text>
							</subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDa4566dc80d6f4fcabb6c1867edfe3be7"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of contents of the Toxic Substances Control
			 Act (15 U.S.C. prec. 2601) is amended by adding at the end the
			 following:</text>

			 Congress</header><text display-inline="no-display-inline">Not later than
			 December 31, 2010, and annually thereafter through December 31, 2014, the
			 Administrator of the Environmental Protection Agency shall submit to the
			 Committee on Environment and Public Works of the Senate and the Committee on
			 Energy and Commerce of the House of Representatives a report describing, with
			 respect to the preceding calendar year—</text>
			<paragraph id="id4FAD13A100D444DD957AA80AEE6E0DD2"><enum>(1)</enum><text display-inline="yes-display-inline">the status of the measures carried out or

			 Toxic Substances Control Act (15 U.S.C. 2601 et seq.) is amended by adding at
			 the end the following:</text>

				standards</header>
							<subsection id="id78d9f2ae-7dac-4998-8f4c-f6c9f9637a59"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph id="id2daa3131-2fb5-4ddb-9822-d3606d5808dd"><enum>(1)</enum><header>Finished good</header>
									<subparagraph id="ida4f18846-b6bd-485f-a1d3-fa0e7127fff2"><enum>(A)</enum><header>In
				general</header><text>The term <term>finished good</term> means any good or
				product (other than a panel) containing—</text>
										<clause id="id93382a58-1576-445e-b8fe-13e6b06bf814"><enum>(i)</enum><text>hardwood plywood;</text>
										</clause><clause id="idf2c1aa4c-5c41-4170-9032-fd730f1e52a2"><enum>(ii)</enum><text>particleboard; or</text>
										</clause><clause id="ideec2fa48-718e-4fbc-8458-0a627da6a78d"><enum>(iii)</enum><text>medium-density
				fiberboard.</text>
										</clause></subparagraph><subparagraph id="id7b8a0703-ca15-4ac7-bfc7-9463baa29361"><enum>(B)</enum><header>Exclusions</header><text>The
				term <term>finished good</term> does not include—</text>
										<clause id="id87521fbe-c543-4321-89af-721e205a158c"><enum>(i)</enum><text>any component part or
				other part used in the assembly of a finished good; or</text>
										</clause><clause id="idb2a73b33-bf12-429b-a249-8af2039c51e9"><enum>(ii)</enum><text>any finished good that
				has previously been sold or supplied to an individual or entity that purchased
				or acquired the finished good in good faith for purposes other than resale,
				such as—</text>
											<subclause id="idd0ea4006-735b-44f0-ac0d-3df40f9cf395"><enum>(I)</enum><text>an antique; or</text>
											</subclause><subclause id="ida4d64f9e-4c66-4e31-9f71-abe8364f6bf1"><enum>(II)</enum><text>secondhand
				furniture.</text>
											</subclause></clause></subparagraph></paragraph><paragraph id="id7B061D001A864E8C960A67556F3FEF87"><enum>(2)</enum><header>Hardboard</header><text>The
				term <term>hardboard</term> means a composite panel composed of cellulosic
				fibers manufactured with a wet process using—</text>
									<subparagraph id="idB4CEFCBE97B04B7091FFECE71687C6CA"><enum>(A)</enum><text>no resins; or</text>
									</subparagraph><subparagraph id="id77D207EE8E984F83BD597EE0B0927CBD"><enum>(B)</enum><text>resins that have no added
				formaldehyde.</text>
									</subparagraph></paragraph><paragraph id="idb8295286-1616-49ca-bcb6-00b05064ef74"><enum>(3)</enum><header>Hardwood
				plywood</header>
									<subparagraph id="id2cc0ae10-9f8e-44de-a850-5ff45b9bca83"><enum>(A)</enum><header>In
				general</header><text>The term <term>hardwood plywood</term> means a hardwood
				or decorative panel that is—</text>
										<clause id="id014fb7ed-8884-4f32-9b23-4b46216dc873"><enum>(i)</enum><text>intended for interior
				use; and</text>
										</clause><clause id="id2cefd80d-a249-4093-8a15-d5096a38a526"><enum>(ii)</enum><text>composed of (as
				determined under the standard numbered ANSI/HPVA HP–1–2004 (or a successor
				standard)) an assembly of layers or plies of veneer, joined by an adhesive
				with—</text>
											<subclause id="id99dc64d1-52f5-4f02-8ccc-a76e905c4e29"><enum>(I)</enum><text>lumber core;</text>
											</subclause><subclause id="idaac5fe96-32d8-4461-ba63-cc5fb8710f4c"><enum>(II)</enum><text>particleboard
				core;</text>
											</subclause><subclause id="id4484fddf-d2a9-4ba1-8f54-67c17749191c"><enum>(III)</enum><text>medium-density
				fiberboard core;</text>
											</subclause><subclause id="id10c1e7b9-1a84-41e6-a218-20fc59cad311"><enum>(IV)</enum><text>hardboard core;
				or</text>
											</subclause><subclause id="id8942ade5-4e02-49a6-bd54-4b4e75dacd22"><enum>(V)</enum><text>any other special core or
				special back material.</text>
											</subclause></clause></subparagraph><subparagraph id="ida6a7be6b-af95-4d26-81f9-b2b4ac916471"><enum>(B)</enum><header>Exclusions</header><text>The
				term <term>hardwood plywood</term> does not include—</text>
										<clause id="id8c13775e-ca2f-4063-bf72-6ab16c3cbfc9"><enum>(i)</enum><text>military-specified
				plywood;</text>
										</clause><clause id="id40d3b685-34fc-414e-a1c6-232805ddde47"><enum>(ii)</enum><text>curved plywood;
				or</text>
										</clause><clause id="ida9a571f7-a382-4293-9af5-e8773fa0ecdb"><enum>(iii)</enum><text>any other product
				specified in—</text>
											<subclause id="id58333b54-e022-4a5e-9a84-4ee812e2caba"><enum>(I)</enum><text>the standard entitled
				<quote>Voluntary Product Standard–Structural Plywood</quote> and numbered PS
				1–07 (or a successor standard); or</text>
											</subclause><subclause id="id7f7552b9-585f-4285-af2b-6fda4aed5c1a"><enum>(II)</enum><text>the standard entitled
				<quote>Voluntary Product Standard–Performance Standard for Wood-Based
				Structural-Use Panels</quote> and numbered PS 2–04 (or a successor
				standard).</text>
											</subclause></clause></subparagraph><subparagraph id="ID1bd6c984de2e49a7b2fd0806c1030796"><enum>(C)</enum><header>Laminated
				products</header>
										<clause id="id886F988D3E7F48329A2F8BC0A263186E"><enum>(i)</enum><header>In
				general</header><text>The Administrator shall conduct a rulemaking process
				pursuant to subsection (d) that uses all available and relevant information
				from State authorities (including the California Air Resources Board),
				industry, and other available sources of such information, and analyzes such
				information to determine, at the discretion of the Administrator, whether the
				definition of hardwood plywood should exempt any laminated product. The
				Administrator may also modify any aspect of the definition contained in clause
				(ii) before including it in such regulations.</text>
										</clause><clause id="id6267AB6CA72749F1A7C387D335E51BBC"><enum>(ii)</enum><header>Laminated
				product</header><text>The term <term>laminated product</term> means a
				product—</text>
											<subclause id="id33D697E572FF481289B72FBB196ED662"><enum>(I)</enum><text>in which a wood veneer is
				affixed to—</text>
												<item id="id4C8D70D738864E058C39763D08FE7066"><enum>(aa)</enum><text>a particleboard
				platform;</text>
												</item><item id="id0B214D209E6E4C72AAADE48B07B422B9"><enum>(bb)</enum><text>a medium-density
				fiberboard platform; or</text>
												</item><item id="idF877A64742154288BE74172EB3FA88DF"><enum>(cc)</enum><text>a veneer-core platform;
				and</text>
												</item></subclause><subclause id="idFBD4EF1F27634FCFBE948D8571AC64A8"><enum>(II)</enum><text>that is—</text>
												<item id="id174BDC4A17F54B2B82A8792CEDC44FD9"><enum>(aa)</enum><text>a component part;</text>
												</item><item id="id7F36872A28F74DB086EEBFE54E0FD2F2"><enum>(bb)</enum><text>used in the construction
				or assembly of a finished good; and</text>
												</item><item id="id60220947A85A4315A9F70402F9131718"><enum>(cc)</enum><text>produced by the
				manufacturer or fabricator of the finished good in which the product is
				incorporated.</text>
												</item></subclause></clause></subparagraph></paragraph><paragraph id="id417e31a1-1922-40aa-9fa6-caa7a28f00be"><enum>(4)</enum><header>Medium-density
				fiberboard</header><text>The term <term>medium-density fiberboard</term> means
				a panel composed of cellulosic fibers made by dry forming and pressing a
				resinated fiber mat (as determined under the standard numbered ANSI A208.2–2009
				(or a successor standard)).</text>
								</paragraph><paragraph id="id5f828da7-5185-4409-99c5-c7c22018093c"><enum>(5)</enum><header>No-added
				formaldehyde-based resin</header>
									<subparagraph id="id3bb1697e-e89b-44a9-9425-ca8b3393da06"><enum>(A)</enum><header>In
				general</header><text>The term <term>no-added formaldehyde-based resin</term>
				means a resin formulated with no added formaldehyde as part of the resin
				cross-linking structure that meets the performance standard contained in
				section 93120.3(c) of title 17, California Code of Regulations (as in effect on
				July 28, 2009).</text>
									</subparagraph><subparagraph id="idd6f1428d-f526-4a16-9087-cd8cf1e36a2e"><enum>(B)</enum><header>Inclusions</header><text>The
				term <term>no-added formaldehyde-based resin</term> may include any resin made
				from—</text>
										<clause id="ida2eb2d8f-4dad-4ba9-985a-5ce730e6c808"><enum>(i)</enum><text>soy;</text>
										</clause><clause id="idb842adc4-e498-44b4-a337-e2d6ca0b0753"><enum>(ii)</enum><text>polyvinyl acetate;
				or</text>
										</clause><clause id="iddc907e83-a93b-4a0a-a615-8a9b2aecf1c8"><enum>(iii)</enum><text>methylene
				diisocyanate.</text>
										</clause></subparagraph></paragraph><paragraph id="id28c1aec2-8522-42d1-883d-5121d1fb205e"><enum>(6)</enum><header>Particleboard</header>
									<subparagraph id="id18ffa3d3-22a6-4bea-865b-57316b150183"><enum>(A)</enum><header>In
				general</header><text>The term <term>particleboard</term> means a panel
				composed of cellulosic material in the form of discrete particles (as
				distinguished from fibers, flakes, or strands) that are pressed together with
				resin (as determined under the standard numbered ANSI A208.1–2009 (or a
				successor standard)).</text>
									</subparagraph><subparagraph id="id43930d47-f083-4eb7-b948-99217cb762d1"><enum>(B)</enum><header>Exclusions</header><text>The
				term <term>particleboard</term> does not include any product specified in the
				standard entitled <quote>Voluntary Product Standard–Performance Standard for
				Wood-Based Structural-Use Panels</quote> and numbered PS 2–04 (or a successor
				standard).</text>
									</subparagraph></paragraph><paragraph id="id3efce894-6900-4b2e-83a0-4b2509d2a7d3"><enum>(7)</enum><header>Ultra low-emitting
				formaldehyde resin</header>
									<subparagraph id="id6a6ef41b-2afd-4689-90d5-cfa6323d835c"><enum>(A)</enum><header>In
				general</header><text>The term <term>ultra low-emitting formaldehyde
				resin</term> means a resin formulated using a process the average formaldehyde
				emissions of which are consistently below the phase 2 emission standards
				contained in the airborne toxic control measure for composite wood products
				described in section 93120.3(d) of title 17, California Code of Regulations (as
				in effect on July 28, 2009).</text>
									</subparagraph><subparagraph id="idad05c6b1-82d4-4f3b-981a-47e07225a2a8"><enum>(B)</enum><header>Inclusions</header><text>The
				term <term>ultra low-emitting formaldehyde resin</term> may include—</text>
										<clause id="id5c008839-ee72-40b3-8e86-741e28d7755f"><enum>(i)</enum><text>melamine-urea-formaldehyde
				resin;</text>
										</clause><clause id="idc297ba8d-b0fc-4e60-8405-52e34c5d0352"><enum>(ii)</enum><text>phenol formaldehyde
				resin; and</text>
										</clause><clause id="ide8f12e12-3c2d-4067-aa01-b266a7469b02"><enum>(iii)</enum><text>resorcinol formaldehyde
				resin.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="idf1d0d50f-6453-4364-8213-515c2b9d12b1"><enum>(b)</enum><header>Requirement</header>
								<paragraph id="id904d4893-6c09-4288-bae5-909cc4ef6b29"><enum>(1)</enum><header>In
				general</header><text>Except as provided in an applicable sell-through
				regulation promulgated pursuant to subsection (d), effective beginning on the
				date that is 180 days after the date of promulgation of those regulations, the
				formaldehyde emission standard contained in table 1 of section 93120.2(a) of
				title 17, California Code of Regulations (relating to an airborne toxic control
				measure to reduce formaldehyde emissions from composite wood products) (as in
				effect on July 28, 2009), shall apply to hardwood plywood, medium-density
				fiberboard, and particleboard sold, supplied, offered for sale, or manufactured
				in the United States.</text>
								</paragraph><paragraph id="id11d1e850-2238-4f76-a19c-036fec19cfc0"><enum>(2)</enum><header>Applicability</header><text>The
				formaldehyde emission standard referred to in paragraph (1) shall apply
				regardless of whether an applicable hardwood plywood, medium-density
				fiberboard, or particleboard is—</text>
									<subparagraph id="idb4bc6d26-20cc-4027-9d85-e36cbadd9401"><enum>(A)</enum><text>in the form of an
				unfinished panel; or</text>
									</subparagraph><subparagraph id="id9d7f0900-34c1-4e35-ad46-0dfb9d3de67c"><enum>(B)</enum><text>incorporated into a
				finished good.</text>
									</subparagraph></paragraph></subsection><subsection id="id63603b3e-a958-4469-b267-9647e05d78a9"><enum>(c)</enum><header>Exemptions</header><text>The
				formaldehyde emission standard referred to in subsection (b)(1) shall not apply
				to—</text>
								<paragraph id="id7f066d28-adaa-4246-b9fa-3da2b849787a"><enum>(1)</enum><text>hardboard;</text>
								</paragraph><paragraph id="id734b4941-5448-4f1a-919e-27f959e3f87b"><enum>(2)</enum><text>structural plywood, as
				specified in the standard entitled <quote>Voluntary Product Standard–Structural
				Plywood</quote> and numbered PS 1–07 (or a successor standard);</text>
								</paragraph><paragraph id="idb2a2e96e-5f3a-4618-a327-8eb7e2256310"><enum>(3)</enum><text>structural panels, as
				specified in the standard entitled <quote>Voluntary Product
				Standard–Performance Standard for Wood-Based Structural-Use Panels</quote> and
				numbered PS 2–04 (or a successor standard);</text>
								</paragraph><paragraph id="idb7063730-9f67-4272-bf17-c86d949d3fe2"><enum>(4)</enum><text>structural composite
				lumber, as specified in the standard entitled <quote>Standard Specification for
				Evaluation of Structural Composite Lumber Products</quote> and numbered ASTM D
				5456–06 (or a successor standard);</text>
								</paragraph><paragraph id="id645dd35d-db73-4692-9c81-b06ecc1dd391"><enum>(5)</enum><text>oriented strand
				board;</text>
								</paragraph><paragraph id="id4ac2d156-a09e-461e-8846-171ba5f41682"><enum>(6)</enum><text>glued laminated lumber,
				as specified in the standard entitled <quote>Structural Glued Laminated
				Timber</quote> and numbered ANSI A190.1–2002 (or a successor standard);</text>
								</paragraph><paragraph id="id99e337e3-f9b2-4902-9470-5e788da777b5"><enum>(7)</enum><text>prefabricated wood
				I-joists, as specified in the standard entitled <quote>Standard Specification
				for Establishing and Monitoring Structural Capacities of Prefabricated Wood
				I-Joists</quote> and numbered ASTM D 5055–05 (or a successor standard);</text>
								</paragraph><paragraph id="id6b593244-6469-48f5-9172-2607fe2b66bc"><enum>(8)</enum><text>finger-jointed
				lumber;</text>
								</paragraph><paragraph id="id6592138b-09e3-4cc2-9cd4-0a08e70a4b52"><enum>(9)</enum><text>wood packaging (including
				pallets, crates, spools, and dunnage); or</text>
								</paragraph><paragraph id="iddfd77b58-38bd-4cdc-b578-3ec081c239b7"><enum>(10)</enum><text>composite wood products
				used inside new vehicles (as defined in section 430 of the California Vehicle
				Code) (excluding recreational vehicles), rail cars, boats, aerospace craft, or
				aircraft.</text>
								</paragraph></subsection><subsection id="id39bd34d8-3bc1-44a3-aa63-cb201a42df1b"><enum>(d)</enum><header>Regulations</header>
								<paragraph id="id7125f17a-9be2-425b-af62-9438610bdedd"><enum>(1)</enum><header>In
				general</header><text>Not later than July 1, 2012, the Administrator shall
				promulgate regulations to implement the formaldehyde emission standard required
				under subsection (b) in a manner that ensures that compliance with the standard
				is equivalent to compliance with the standard contained in table 1 of section
				93120.2(a) of title 17, California Code of Regulations (as in effect on July
				28, 2009).</text>
								</paragraph><paragraph id="id00ff718f-2b1e-4748-bf0c-101db2686d5f"><enum>(2)</enum><header>Inclusions</header><text>The
				regulations promulgated pursuant to paragraph (1) shall include provisions
				relating to—</text>
									<subparagraph id="iddb132409-d07c-4cb7-b246-8fcaa5974f61"><enum>(A)</enum><text>labeling;</text>
									</subparagraph><subparagraph id="idb3192e97-4bf9-4ab9-86eb-d7b490daeaa9"><enum>(B)</enum><text>chain of custody
				requirements;</text>
									</subparagraph><subparagraph id="id48c0d51c-635d-41d1-b0b3-96636c2292f3"><enum>(C)</enum><text>sell-through
				provisions;</text>
									</subparagraph><subparagraph id="idffe333a7-bdcd-4965-96bf-48572bd76e1c"><enum>(D)</enum><text>ultra low-emitting
				formaldehyde resins;</text>
									</subparagraph><subparagraph id="id3882be01-9eab-49a2-a25e-c408e6d4abd1"><enum>(E)</enum><text>no-added
				formaldehyde-based resins;</text>
									</subparagraph><subparagraph id="idefd1e609-24d5-44de-91b3-aa41e370a6cd"><enum>(F)</enum><text>finished goods;</text>
									</subparagraph><subparagraph id="id6df4e1e2-e2d5-4ca7-bcd2-9d425d2cb4fb"><enum>(G)</enum><text>third-party testing and
				certification;</text>
									</subparagraph><subparagraph id="id4c219e60-c61c-4d74-be81-89c713f88566"><enum>(H)</enum><text>auditing and reporting of
				third-party certifiers;</text>
									</subparagraph><subparagraph id="id8fee13ca-4e2b-47ce-a79a-c10ddd85abfb"><enum>(I)</enum><text>recordkeeping;</text>
									</subparagraph><subparagraph id="id1f6fc3aa-d05d-4612-8167-0deef7af63ef"><enum>(J)</enum><text>enforcement; and</text>
									</subparagraph><subparagraph id="id73F11D84A0044463980AB08DF32CECB1"><enum>(K)</enum><text>laminated
				products.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2558687e-082a-462d-b975-15e84b03da8a"><enum>(3)</enum><header display-inline="yes-display-inline">Import regulations</header><text display-inline="yes-display-inline">Not later than July 1, 2012, the
				Administrator, in coordination with the Commissioner of Customs and Border
				Protection and other appropriate Federal departments and agencies, shall revise
				regulations promulgated pursuant to section 13 as the Administrator determines
				to be necessary to ensure compliance with this section.</text>
								</paragraph><paragraph id="ida4d78e6a-42e3-4866-9a61-9f118d6e5fab"><enum>(4)</enum><header>Modification of
				standards</header><text>The Administrator may modify, by regulation, any
				reference to an industry standard contained in this subsection if the standard
				is subsequently updated.</text>
								</paragraph></subsection><subsection id="idf676bc46-6d42-465e-b1bb-5bbd92565aea"><enum>(e)</enum><header>Prohibited
				acts</header><text>An individual or entity that violates any requirement under
				this section (including any regulation promulgated pursuant to subsection (d))
				shall be considered to have committed a prohibited act under section
				15.</text>
							</subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id1f0ac2bd-2997-4f26-851d-4be5101081e5"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of contents of the Toxic Substances Control
			 Act (15 U.S.C. prec. 2601) is amended by adding at the end the
			 following:</text>

			 relevant industries have achieved compliance with the requirements under that
			 title.</text>
			</paragraph></section><section changed="added" committee-id="SSEV00" id="id742FA2486B88482F9852474773B67865" reported-display-style="italic"><enum>4.</enum><header>Modification of
			 regulation</header><text display-inline="no-display-inline">Not later than 180
			 days after the date on which the Administrator of the Environmental Protection
			 Agency promulgates regulations under section 601(d)(1) of the Toxic Substances
			 Control Act (as added by section 2(a)), the Secretary of Housing and Urban
			 Development shall update the regulation contained in section 3280.308 of title
			 24, Code of Federal Regulations (as in effect on the date of enactment of this
			 Act), to ensure that the regulation reflects the standards established by
			 section 601 of the Toxic Substances Control Act (as so added).</text>
