		  compensation, and for other purposes. </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Assistance for Unemployed Workers
			 Extension Act</short-title></quote>.</text>
		</section><section id="H1DB5E90E04284F63B9C769FD89AC2888" section-type="subsequent-section"><enum>2.</enum><header>Extension of emergency
			 unemployment compensation program</header>
			<subsection id="H0511C2CD6CD8412DAC1EF0B123DB55C2"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 4007 of the
			 Supplemental Appropriations Act, 2008 (Public Law 110–252; 26 U.S.C. 3304
			 note), as amended by section 4 of the Unemployment Compensation Extension Act
			 of 2008 (Public Law 110–449; 122 Stat. 5015) and section 2001(a) of the
			 Assistance for Unemployed Workers and Struggling Families Act (Public Law
			 111–5; 123 Stat. 436), is amended—</text>
				<paragraph id="HCC4EACD4F1ED45CB893C1B472E2BB77F"><enum>(1)</enum><text>by striking
			 <quote>December 31, 2009</quote> each place it appears and inserting
			 <quote>December 31, 2010</quote>;</text>
				</paragraph><paragraph id="H068E07F8926F41C8001621881B268CC2"><enum>(2)</enum><text>in the heading for
			 subsection (b)(2), by striking <quote><header-in-text level="paragraph" style="OLC">december 31, 2009</header-in-text></quote> and inserting
			 <quote><header-in-text level="paragraph" style="OLC">december 31,
			 2010</header-in-text></quote>; and</text>
				</paragraph><paragraph id="H167BAE9BD72E4CAAA900DDED94B27998"><enum>(3)</enum><text>in subsection
			 (b)(3), by striking <quote>May 31, 2010</quote> and inserting <quote>May 31,
			 2011</quote>.</text>
				</paragraph></subsection><subsection id="H74D325F0427A485FB865679596B39A"><enum>(b)</enum><header>Financing
			 provisions</header><text>Section 4004(e)(1) of such Act, as added by section
			 2001(b) of the Assistance for Unemployed Workers and Struggling Families Act
			 (Public Law 111–5; 26 U.S.C. 3304 note), is amended by inserting <quote>and
			 section 2(a) of the <short-title>Assistance for Unemployed
			 Workers Extension Act</short-title></quote> after <quote>Act</quote>.</text>
			</subsection><subsection id="idE5F5CC8BF8704523A02995678CCA764F"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect as if
			 included in the enactment of the Supplemental Appropriations Act, 2008.</text>
			</subsection></section><section id="id5B6D789D0A78453DA9EDB303F609EACC"><enum>3.</enum><header>Extension of
			 increase in unemployment compensation benefits</header>
			<subsection id="idABA4D3D4382249768C84EE3C1C5CBB71"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 2002(e) of
			 the Assistance for Unemployed Workers and Struggling Families Act (Public Law
			 111–5; 123 Stat. 438) is amended—</text>
				<paragraph id="idB047971B9C354BBDB14431D2DFCE05B8"><enum>(1)</enum><text>in paragraph
			 (1)(B), by striking <quote>January 1, 2010</quote> and inserting <quote>January
			 1, 2011</quote>;</text>
				</paragraph><paragraph id="id63F622932AA64F33880E25EB05FD3E95"><enum>(2)</enum><text>in the heading
			 for paragraph (2), by striking <quote><header-in-text level="paragraph" style="OLC">january 1, 2010</header-in-text></quote> and inserting
			 <quote><header-in-text level="paragraph" style="OLC">january 1,
			 2011</header-in-text></quote>; and</text>
				</paragraph><paragraph id="id185C97C1213C4A78BAB37048A69B4C8F"><enum>(3)</enum><text>in paragraph (3),
			 by striking <quote>June 30, 2010</quote> and inserting <quote>June 30,
			 2011</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3F7CE3F010DB4748B5181C94E38FB0C0"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect as if
			 included in the enactment of the Assistance for Unemployed Workers and
			 Struggling Families Act.</text>
			</subsection></section><section id="H21CCE5D2AA45434DB535025E2F32C369" section-type="subsequent-section"><enum>4.</enum><header>Third-tier
			 benefits</header>
			<subsection id="id9C85FE47C6CA4936B4176EA4AEAE1C36"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 4002 of the
			 Supplemental Appropriations Act, 2008 (Public Law 110–252; 26 U.S.C. 3304
			 note), as amended by section 3 of the Unemployment Compensation Extension Act
			 of 2008 (Public Law 110–449; 122 Stat. 5014), is amended by adding at the end
			 the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="idCF00EF00C6734FA19360F9ED0A3FD8FB" style="OLC">
					<subsection id="HBD7D7FF3998A4C11B146AF9E05FE5C7"><enum>(d)</enum><header>Third tier of
				benefits</header>
						<paragraph id="H443FD219E65C418F8E5C35FCB17C4454"><enum>(1)</enum><header>In
				general</header><text>If, at the time that the amount added to an individual’s
				account under subsection (c)(1) (in this subsection referred to as
				<term>additional emergency unemployment compensation</term>) is exhausted or at
				any time thereafter, such individual’s State is in an extended benefit period
				(as determined under paragraph (2)), such account shall be further augmented by
				an amount (in this subsection referred to as <term>further additional emergency
				unemployment compensation</term>) equal to the lesser of—</text>
							<subparagraph id="HB0C2152B92414E8E99E4432E978EDDD9"><enum>(A)</enum><text>50 percent of the
				total amount of regular compensation (including dependents’ allowances) payable
				to the individual during the individual’s benefit year under the State law;
				or</text>
							</subparagraph><subparagraph id="H1994B873B8894FC0B23B008D1E30F500"><enum>(B)</enum><text>13 times the
				individual’s average weekly benefit amount (as determined under subsection
				(b)(2)) for the benefit year.</text>
							</subparagraph></paragraph><paragraph id="H4491A6D822E74A1B965F9EE297B898C7"><enum>(2)</enum><header>Extended benefit
				period</header><text>For purposes of paragraph (1), a State shall be considered
				to be in an extended benefit period, as of any given time, if—</text>
							<subparagraph id="idAECE6836500D4C0FBEAE7852BC136D44"><enum>(A)</enum><text>such a period
				would then be in effect for such State under the Federal-State Extended
				Unemployment Compensation Act of 1970 if section 203(d) of such Act—</text>
								<clause id="idA7ED80A036F144C7B5F5CA26BD7216D0"><enum>(i)</enum><text>were applied by
				substituting <quote>6</quote> for <quote>5</quote> each place it appears;
				and</text>
								</clause><clause id="id59EDDDA6CE1D433E92A4E5D8A7F9A99C"><enum>(ii)</enum><text>did not include
				the requirement under paragraph (1)(A) thereof; or</text>
								</clause></subparagraph><subparagraph id="HA8AF18C6EF844DCFB344DEE4BB38C990"><enum>(B)</enum><text>such a period
				would then be in effect for such State under such Act if—</text>
								<clause id="id830799E7467F496CAC0CE82558C4F6C6"><enum>(i)</enum><text>section 203(f) of
				such Act were applied to such State (regardless of whether the State by law had
				provided for such application); and</text>
								</clause><clause id="idC907141207F54F79977B65503B91FFDD"><enum>(ii)</enum><text>such section
				203(f)—</text>
									<subclause id="H9FD333EA46F6421AB3DB8982F8C4BDA"><enum>(I)</enum><text>were applied by
				substituting <quote>8.5</quote> for <quote>6.5</quote> in paragraph (1)(A)(i)
				thereof; and</text>
									</subclause><subclause id="H19DD41D88FE24531A82CAD18153EC7D1"><enum>(II)</enum><text>did not include
				the requirement under paragraph (1)(A)(ii) thereof.</text>
									</subclause></clause></subparagraph></paragraph><paragraph id="id99DBCE0C07BD44F4BEA5902D50223726"><enum>(3)</enum><header>Coordination
				rule</header><text>Notwithstanding an election under section 4001(e) by a State
				to provide for the payment of emergency unemployment compensation prior to
				extended compensation, such State may pay extended compensation to an otherwise
				eligible individual prior to any further additional emergency unemployment
				compensation, if such individual claimed extended compensation for at least 1
				week of unemployment after the exhaustion of additional emergency unemployment
				compensation.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0BE3CFBB87CE4F8D924FA42BB9BA5F07"><enum>(4)</enum><header>Limitation</header><text>The
				account of an individual may be augmented not more than once under this
				subsection.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id795F1010F87C49858E1797879DEEC584"><enum>(b)</enum><header>Conforming
			 amendments</header><text>Section 4007(b)(2) of such Act, as amended by section
			 3, is amended—</text>
				<paragraph id="id8FEC6FB39FDA4AB5B56CB12F662C7992"><enum>(1)</enum><text>by striking
			 <quote>then section 4002(c)</quote> and inserting <quote>then subsections (c)
			 and (d) of section 4002</quote>; and</text>
				</paragraph><paragraph id="id5BC166EADE1142EBA97E00070CECDF37"><enum>(2)</enum><text>by striking
			 <quote>paragraph (2) of such section)</quote> and inserting <quote>paragraph
			 (2) of such subsection (c) or (d) (as the case may be))</quote>.</text>
				</paragraph></subsection><subsection id="id65BD1CDA8BB44F969DBD6B45795755BC"><enum>(c)</enum><header>Effective
			 date</header>
				<paragraph id="id56F1F451547A4FC6A952E603C0B49564"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), the amendments made by this
			 section shall take effect as if included in the enactment of the Supplemental
			 Appropriations Act, 2008.</text>
				</paragraph><paragraph id="id7E247B6DD0854ADCA8D4F5557F15B5D9"><enum>(2)</enum><header>Additional
			 benefits</header><text>In applying the amendments made by this section, any
			 additional emergency unemployment compensation made payable by such amendment
			 (which would not otherwise have been payable if such amendment had not been
			 enacted) shall be payable only with respect to any week of unemployment
			 beginning on or after the date of the enactment of this Act.</text>
				</paragraph></subsection></section><section id="id6198A086473E4933807FACE759ECC4AF"><enum>5.</enum><header>Extension of
			 full Federal funding of extended unemployment compensation for a limited
			 period</header>
			<subsection id="id40822B1F32B140F29CAF13DA01FB614F"><enum>(a)</enum><header>In
			 general</header><text>Section 2005 of the Assistance for Unemployed Workers and
			 Struggling Families Act (Public Law 111–5; 26 U.S.C. 3304 note) is
			 amended—</text>
				<paragraph id="id04BDE6FF634B4656B1702283E3C61717"><enum>(1)</enum><text>by striking
			 <quote>January 1, 2010</quote> each place it appears and inserting
			 <quote>January 1, 2011</quote>; and</text>
				</paragraph><paragraph id="id3524108074F940509F6DB547D387A6B8"><enum>(2)</enum><text>in subsection
			 (c), by striking <quote>June 1, 2010</quote> and inserting <quote>June 1,
			 2011</quote>.</text>
				</paragraph></subsection><subsection id="H8D5E99477A2F4BB58938A1003462B996"><enum>(b)</enum><header>Extension of
			 temporary Federal matching for the first week of extended benefits for States
			 with no waiting week</header><text>Section 5 of the Unemployment Compensation
			 Extension Act of 2008 (Public Law 110–449; 26 U.S.C. 3304 note), as amended by
			 section 2005(d) of the Assistance for Unemployed Workers and Struggling
			 Families Act (Public Law 111–5; 26 U.S.C. 3304 note), is amended by striking
			 <quote>May 30, 2010</quote> and inserting <quote>May 30, 2011</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id309AC3ADB95542759B4FC5237D32D255"><enum>(c)</enum><header>Effective
			 dates</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id7AD356EED3B04C3BA2B85E7D382B6E3F"><enum>(1)</enum><header>In
			 general</header><text>The amendments made by subsection (a) shall take effect
			 as if included in the enactment of the Assistance for Unemployed Workers and
			 Struggling Families Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4AD448711CD346DABAD03E891327EBB2"><enum>(2)</enum><header>First
			 week</header><text>The amendment made by subsection (b) shall take effect as if
			 included in the enactment of the Unemployment Compensation Extension Act of
			 2008.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id5CE7A17D601B4FFAADF74A82B5FEB3EB"><enum>6.</enum><header>Additional
			 extended unemployment benefits under the Railroad Unemployment Insurance
			 Act</header>
			<subsection commented="no" display-inline="no-display-inline" id="id856CFF7C19164AEE8AE5E718BE0E609E"><enum>(a)</enum><header>Benefits</header><text display-inline="yes-display-inline">Section 2(c)(2)(D) of the Railroad
			 Unemployment Insurance Act, as added by section 2006 of the Assistance for
			 Unemployed Workers and Struggling Families Act (Public Law 111–5; 123 Stat.
			 445), is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id3A9BD532FEA84813B57FDD87DC03A521"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (iii)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id156DD993FAF24882A43F70D003532A0E"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>June 30, 2009</quote>
			 and inserting <quote>June 30, 2010</quote>;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id74F036AA61D640649F5D62D45F1A63D1"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>December 31,
			 2009</quote> and inserting <quote>December 31, 2010</quote>; and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEBEA773858A54767991B6C6563454561"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end of clause (iv) the
			 following: <quote>In addition to the amount appropriated by the preceding
			 sentence, out of any funds in the Treasury not otherwise appropriated, there
			 are appropriated $175,000,000 to cover the cost of additional extended
			 unemployment benefits provided under this subparagraph, to remain available
			 until expended.</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idDF156FF903B74009A06FDFF2658FBD29"><enum>(b)</enum><header>Administrative
			 expenses</header><text display-inline="yes-display-inline">Section 2006(b) of
			 the Assistance for Unemployed Workers and Struggling Families Act (Public Law
			 111–5; 123 Stat. 445) is amended by adding at the end the following: <quote>In
			 addition to funds appropriated by the preceding sentence, out of any funds in
			 the Treasury not otherwise appropriated, there are appropriated to the Railroad
			 Retirement Board $807,000 to cover the administrative expenses associated with
			 the payment of additional extended unemployment benefits under section
			 2(c)(2)(D) of the Railroad Unemployment Insurance Act, to remain available
			 until expended.</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id9C88C3C2B36649379C74047CD64A0B58"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect as if
			 included in the enactment of the Assistance for Unemployed Workers and
			 Struggling Families Act.</text>
			</subsection></section></legis-body>
