		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Take Back Your Health Act of
			 2009</short-title></quote>.</text>
		</section><section id="ID61fa4bde70474d5088d22dc1a3421dbb"><enum>2.</enum><header>Coverage of
			 intensive lifestyle treatment</header>
			<subsection id="ID8974c4d6e67440648874e9352cd5e0f0"><enum>(a)</enum><header>Intensive
			 lifestyle treatment program</header>
				<paragraph id="ID72280fe4c0ab4adaba87fab929ddfb7a"><enum>(1)</enum><header>In
			 general</header><text>Section 1861 of the Social Security Act (42 U.S.C. 1395x)
			 is amended—</text>
					<subparagraph id="ID32a61bfacb1d48f5ae1e8d442c5c7197"><enum>(A)</enum><text>in subsection
			 (s)(2)—</text>
						<clause id="IDb0e5d81119584af796871d30a85b92e7"><enum>(i)</enum><text>in
			 subparagraph (DD) by striking <quote>and</quote> at the end;</text>
						</clause><clause id="IDdab89894b95149f386198913d7653b44"><enum>(ii)</enum><text>in
			 subparagraph (EE) by inserting <quote>and</quote> at the end; and</text>
						</clause><clause id="ID1aa06425df2a411cb400cc31956b0d52"><enum>(iii)</enum><text>by adding at
			 the end the following new subparagraph:</text>
							<quoted-block display-inline="no-display-inline" id="id0501AA67EA684C6E98C6F13C0A2D19D3" style="OLC">
								<subparagraph id="ID11907c3007724fbb9890db16240c951c"><enum>(FF)</enum><text>items and
				services furnished under an intensive lifestyle treatment program (as defined
				in paragraph (hhh)(1)) to eligible beneficiaries (as defined in paragraph
				(hhh)(4));</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="ID65e4241dc90d43b0966850bd89b84d13"><enum>(B)</enum><text>by adding at the
			 end the following new subsection:</text>
						<quoted-block display-inline="no-display-inline" id="id9D5002A2B3554139BBA773C704913BAB" other-style="archaic-paragraph" style="other"><subsection id="IDb5a83589bebb46c8b5bec19aa70b4f94"><enum>(hhh)</enum><header>Intensive lifestyle treatment
		  program</header><paragraph commented="no" display-inline="yes-display-inline" id="idBBAF30479C5F4E2D89FEF2A167FF22A1"><enum>(1)</enum><text>The term
				<term>intensive lifestyle treatment program</term> means a physician-supervised
				program (as defined in paragraph (2)) that furnishes the items and services
				described in paragraph (3) intended to beneficially affect the progression of
				chronic diseases to eligible beneficiaries (as defined in paragraph
				(4)).</text>
								</paragraph><paragraph id="id46161C68851941728A26F7B8D3B5C6DF" indent="up1"><enum>(2)</enum><text>A program described in this paragraph
				is a program under which—</text>
									<subparagraph id="idE415CD23D76E4CFC8FA7D256AE2B5A85"><enum>(A)</enum><text>items and services under the program
				are delivered—</text>
										<clause id="id6E8B86804D13408A84D4E7867E3393C8"><enum>(i)</enum><text>in a physician's office or
				clinic;</text>
										</clause><clause id="idC882AB374A424229B29AF145001D5984"><enum>(ii)</enum><text>in a hospital on an outpatient
				basis; or</text>
										</clause><clause id="id25A10C519ADD4D3EBD1D175F7153722D"><enum>(iii)</enum><text>in other settings determined
				appropriate by the Secretary;</text>
										</clause></subparagraph><subparagraph id="id66AD55F535BB42C8819C023F92B4B660"><enum>(B)</enum><text>a physician (as defined in section
				1861(r)(1)) is immediately available and accessible for medical consultation
				and medical emergencies at all times items and services are being furnished
				under the program, except that, in the case of items and services furnished
				under such a program in a hospital, such availability shall be presumed;</text>
									</subparagraph><subparagraph id="idC574A4A601D44BD88DD4739206B9F7B9"><enum>(C)</enum><text>individualized treatment is furnished
				under a written plan established and designed by a physician (as so defined) in
				advance of the start of the program and reviewed and signed by a physician
				every 60 days that describes—</text>
										<clause id="idEB4E068FD10747B3ADFCAC3CDD791E3A"><enum>(i)</enum><text>the individual's diagnosis;</text>
										</clause><clause id="id0FD5DEEE119C46B5ABBB1ED652491FF2"><enum>(ii)</enum><text>the type, amount, frequency, and
				duration of the items and services furnished under the plan; and</text>
										</clause><clause id="idB6E952B21A464E0CAE496211DC9F7E9F"><enum>(iii)</enum><text>the goals set for the individual
				under the plan;</text>
										</clause></subparagraph><subparagraph id="id0891E97327D2440D9DAB03A46A7B85FE"><enum>(D)</enum><text>items and services may be provided in
				a series of 72 one-hour sessions (as defined in section 1848(b)(6)), up to 6
				sessions per day, over a period of 18 weeks, and may include group sessions
				with up to 15 other eligible beneficiaries; and</text>
									</subparagraph><subparagraph id="id834EBE8EBE8B49C4B51576253201E69B"><enum>(E)</enum><text>items and services may be
				provided—</text>
										<clause id="idA9063F03AE194DDC886706A8EE79466A"><enum>(i)</enum><text>by an intensive lifestyle
				team;</text>
										</clause><clause id="idF3DB11F6B61C47A0AC90DDCF6F4D3F58"><enum>(ii)</enum><text>under the direction of a physician
				(as so defined); and</text>
										</clause><clause id="idF0A9A1E537C6473386C019D8D430A6DD"><enum>(iii)</enum><text>if determined appropriate by the
				Secretary, in the case of such items and services provided in underserved
				areas, by a physician assistant, nurse practitioner, or clinical nurse
				specialist as provided under State law.</text>
										</clause></subparagraph></paragraph><paragraph id="id3FD48EC4CD93478C87646965A7C01E4F" indent="up1"><enum>(3)</enum><text>The items and services described in
				this paragraph are—</text>
									<subparagraph id="id3D27D4A3C6544DD297362C1E9661ED16"><enum>(A)</enum><text>exercise;</text>
									</subparagraph><subparagraph id="id6B29E28D97A14514A91BE96A80A88746"><enum>(B)</enum><text>risk factor modification, including
				education, counseling, and behavioral intervention (to the extent such
				education, counseling, and behavioral intervention is closely related to the
				individual's care and treatment and is tailored to the individual's
				needs);</text>
									</subparagraph><subparagraph id="idF72455B805BC4164BF93B692A22669FC"><enum>(C)</enum><text>psychosocial assessment;</text>
									</subparagraph><subparagraph id="idA4189CC6A8564F8AA1A3D14DA93CE56E"><enum>(D)</enum><text>provider consultation;</text>
									</subparagraph><subparagraph id="id612ABDE486A94F4DBCC449C209A1FD52"><enum>(E)</enum><text>care coordination;</text>
									</subparagraph><subparagraph id="idDC5FE18DC54A46389F409C19D0EB46C5"><enum>(F)</enum><text>medication management;</text>
									</subparagraph><subparagraph id="id1FF23BE4C50F4212BF4DD2E49AB2CBC4"><enum>(G)</enum><text>medical nutritional therapy;</text>
									</subparagraph><subparagraph id="id47DD32AC8826431B89D61B31ABC28925"><enum>(H)</enum><text>tobacco cessation;</text>
									</subparagraph><subparagraph id="idF2A3299607F44CD6911BD281D62DFAA3"><enum>(I)</enum><text>outcomes assessment; and</text>
									</subparagraph><subparagraph id="id72BBB926B3044766AF99E82B4709E48D"><enum>(J)</enum><text>such other items and services as the
				Secretary determines appropriate, but only if such items and services
				are—</text>
										<clause id="id2867A8969F8E4007817C46A3836488A6"><enum>(i)</enum><text>reasonable and necessary for the
				diagnosis or active treatment of the individual's condition;</text>
										</clause><clause id="idCBD91C06977D431D885BABBAC298E2F7"><enum>(ii)</enum><text>reasonably expected to improve or
				maintain the individual's condition and functional level; and</text>
										</clause><clause id="idF0ABD5A7227742ECBD9875766E61E288"><enum>(iii)</enum><text>furnished under such guidelines
				relating to the frequency and duration of such items and services as the
				Secretary shall establish, taking into account accepted norms of medical
				practice and the reasonable expectation of improvement of the
				individual.</text>
										</clause></subparagraph></paragraph><paragraph id="id656A87280055417698DF54B721AD70FA" indent="up1"><enum>(4)</enum><text>The term <term>eligible
				beneficiary</term> means an individual who is entitled to, or enrolled for,
				benefits under part A and enrolled under this part and who has been diagnosed
				with 1 or more of the following conditions:</text>
									<subparagraph id="id6361F139EEA942AE9B43989B0418B549"><enum>(A)</enum><text>Coronary heart disease.</text>
									</subparagraph><subparagraph id="ID047387df48074bbda7b14b520c48c3b2"><enum>(B)</enum><text>Type 2 diabetes.</text>
									</subparagraph><subparagraph id="IDd362ec9f80c74b79ac5271fb864bbf1e"><enum>(C)</enum><text>Metabolic syndrome.</text>
									</subparagraph><subparagraph id="ID9eb52f64b5b44b8585f8622b5a10aa3b"><enum>(D)</enum><text>Prostate cancer.</text>
									</subparagraph><subparagraph id="IDa3306cf9596442caac8b28f18e4a3faa"><enum>(E)</enum><text>Breast
				cancer.</text>
									</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="ID2e56ac7aced64b75bb58f1aa99a1680c"><enum>(2)</enum><header>Payment for
			 intensive lifestyle treatment programs</header>
					<subparagraph id="ID6a0d838d88f34923bbfcad0ba94ef842"><enum>(A)</enum><header>Inclusion in
			 physicians' services</header><text>Section 1848(j)(3) of the Social Security
			 Act (42 U.S.C. 1395w–4(j)(3)) is amended by inserting <quote>(2)(FF),</quote>
			 after <quote>(2)(EE).</quote>.</text>
					</subparagraph><subparagraph id="ID8416067f7073484d894d0467d60f16d7"><enum>(B)</enum><header>Conforming
			 amendment</header><text>Section 1848(b) of the Social Security Act (42 U.S.C.
			 1395w–4(b)) is amended by adding at the end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="id6805969029AE49BD81B4226EFA5DFAA5" style="traditional-inline">
							<paragraph id="ID93f46ad0312941519863d103651ad374"><enum>(6)</enum><header>Treatment of
				intensive lifestyle treatment program</header>
								<subparagraph id="ID2e231f7bc9ec4f7da0474ed43a2761a1"><enum>(A)</enum><header>In
				general</header><text>In the case of an intensive lifestyle treatment program
				described in section 1861(hhh)(2), the Secretary shall establish an aggregate
				payment for items and services furnished under such program (as described in
				section 1861(hhh)(3)) not to exceed the cost to the program under this title
				for a hospitalization for a similarly situated eligible beneficiary, subject to
				the limitation under subparagraph (C).</text>
								</subparagraph><subparagraph id="ID7a0aed58addb467dbf1977ed7060658d"><enum>(B)</enum><header>Payment
				schedule</header><text>The Secretary shall—</text>
									<clause id="IDceaded543ba6480cb4589058789b3df6"><enum>(i)</enum><text>make a payment to
				such a program in an amount that is equal to 50 percent of the amount
				established under subparagraph (A) upon completion of the initial consultation
				under the program; and</text>
									</clause><clause id="IDf3c9b73a6e6c408c96c310cadb457962"><enum>(ii)</enum><text>subject to the
				limitation described in subparagraph (C), make a second payment to a program
				for the balance of the amount defined in subparagraph (A) upon completion of
				treatment under the program.</text>
									</clause></subparagraph><subparagraph id="IDe508b56b588e4c87a533998968a36a02"><enum>(C)</enum><header>Limitation</header>
									<clause id="IDe8977652f2ac4f989368093686051f1a"><enum>(i)</enum><header>In
				general</header><text>Notwithstanding the provisions of subparagraph (B), an
				intensive lifestyle treatment program shall not receive the payment described
				in subparagraph (B)(ii) unless it documents, upon the completion of the program
				by an eligible beneficiary, that services provided to such beneficiary under
				the program are beneficially affecting the progression of chronic disease or
				diseases in the beneficiary, as measured under clause (ii) with respect to 2 or
				more of the following measures:</text>
										<subclause commented="no" id="ID43c8190216b0482f8090f9b025693742"><enum>(I)</enum><text>Measures
				described in subclauses (I) through (V) of section 1861(eee)(4)(A)(ii).</text>
										</subclause><subclause id="IDa71017b479d74cb4b5f7e9a9fbbab1f8"><enum>(II)</enum><text>High density
				lipoprotein.</text>
										</subclause><subclause id="ID53dc310ee88340bbb49591fc55156ae2"><enum>(III)</enum><text>Hemoglobin
				A1C.</text>
										</subclause><subclause id="ID6ffbffa3ac1b4d10bcf6ada19dbdc5d7"><enum>(IV)</enum><text>C-reactive
				protein.</text>
										</subclause><subclause id="ID3355105b429d4905931f560aaf87455d"><enum>(V)</enum><text>Waist
				size.</text>
										</subclause><subclause id="ID597ae267ca894da2904685efece00814"><enum>(VI)</enum><text>Elimination of
				cotinine level as evidence that the eligible beneficiary no longer uses
				tobacco.</text>
										</subclause><subclause id="ID64ddfc8ae6c94fd3a9af403a1b2d3cb2"><enum>(VII)</enum><text>Prostate
				specific antigen or other prognostic biomarkers of prostate cancer.</text>
										</subclause><subclause id="ID7eacc696fac14349bd8907e997812ae3"><enum>(VIII)</enum><text>Prognostic
				biomarkers of breast cancer.</text>
										</subclause></clause><clause id="idDD66C7171C7A4BF393E6CB0CDF2BBA02"><enum>(ii)</enum><header>Measurement</header><text>The
				Secretary shall determine the beneficial progression of chronic disease or
				diseases under clause (i), using the level of 2 or more of the measures
				described in subclause (i) before receiving services under such program and
				such levels after completion of treatment under the program—</text>
										<subclause id="id94EC9A0F32354668B4B0EA7FFE7025EF"><enum>(I)</enum><text>by normalization
				(as defined by the Secretary); and</text>
										</subclause><subclause id="id97FCABC4D3244CD1A7FDD73866695270"><enum>(II)</enum><text>in the case
				of—</text>
											<item id="id8946EA1B09EB4D66AFBF1292EEF70107"><enum>(aa)</enum><text>measures
				described in subclauses (I) through (V), (VII), and (VIII), by at least 10
				percent reduction; or</text>
											</item><item id="id137205353D1F49529E1E8617B87BAF20"><enum>(bb)</enum><text>the measure
				described in subclause (VI), by elimination.</text>
											</item></subclause></clause><clause id="ID19d97f8b07a14c308f3437a77a1c62b3"><enum>(iii)</enum><header>Refund of
				payments or costs in certain circumstances</header><text>In the case of an
				eligible beneficiary who, within 1 year of receiving an initial consultation
				under the program, receives any other treatment covered under part A or this
				part for any condition that relates to the initial diagnosis resulting in
				eligibility for the intensive lifestyle treatment program, except for a
				physician office visit for the purpose of making adjustments to medication
				prescribed to the eligible beneficiary, such program shall refund to the
				Secretary the lesser of—</text>
										<subclause id="IDe331742906104ff3affc886a21169d32"><enum>(I)</enum><text>any payments made
				under paragraph (B) for services provided to the eligible beneficiary under the
				program; or</text>
										</subclause><subclause id="ID6a6bbd15f60046d79f1ce06aacdc774d"><enum>(II)</enum><text>the cost of such
				other treatment covered under part A or this part such condition.</text>
										</subclause></clause></subparagraph><subparagraph id="ID2dad8a6207f44fcfa69d693c643b7842"><enum>(D)</enum><header>Coverage of
				sessions</header>
									<clause id="idB9874B974E3C40ACB569D4BD71B667EC"><enum>(i)</enum><header>In
				general</header><text>Items and services provided under the program in a series
				of 72 one-hour sessions (as defined in clause (ii)), up to 6 sessions per day,
				over a period of 18 weeks shall, subject to the limitation under subparagraph
				(C), be eligible for the aggregate payment established under subparagraph
				(A).</text>
									</clause><clause id="id2159756AB23744AD8E3935315BEB8453"><enum>(ii)</enum><header>Definition of
				session</header><text>Each of the services described in subparagraphs (A)
				through (J) of section 1861(hhh)(3), when furnished for 1 hour, is a separate
				session under an intensive lifestyle treatment
				program.</text>
									</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="ID58d685464e4a47aca136fc99abbb730c"><enum>(b)</enum><header>Copayments for
			 intensive lifestyle treatment items and services</header><text>Section
			 1833(a)(1) of the Social Security Act (42 U.S.C. 1395l(a)(1)) is
			 amended—</text>
				<paragraph id="IDa3037bc4e7eb4eb1a39f3d2bb2bdea8a"><enum>(1)</enum><text>by striking
			 <quote>and</quote> before (W);</text>
				</paragraph><paragraph id="ID54514fec79b047239d87fe85362b450b"><enum>(2)</enum><text>by inserting
			 before the semicolon at the end the following: <quote>, and (X) with respect to
			 items and services furnished under an intensive lifestyle treatment program (as
			 defined in section 1861(hhh)(2)), the amount paid shall be 100 percent of the
			 lesser of the actual charge for the services or the amount determined under
			 section 1848(b)(6)(A)</quote>.</text>
				</paragraph></subsection><subsection id="ID2a959d2b7d884f97b234791eb2fff8c0"><enum>(c)</enum><header>Lifestyle
			 rewards program</header><text>Title XVIII of the Social Security Act is amended
			 by adding at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="id95A45A1C4E0E4B07B9625D8AFB000F5E" style="OLC">
					<section id="ID5bcc1fcaf44248eaafb7b15bc91c008d"><enum>1899.</enum><header>Lifestyle
				Rewards Programs</header>
						<subsection id="IDeca5351dbd6d4641941fa85f164aaf5a"><enum>(a)</enum><header>Establishment</header><text>The
				Secretary shall establish a Lifestyle Rewards Program (in this section referred
				to as the <term>program</term>) for eligible beneficiaries (as defined in
				section 1861(s)(2)(hhh)(4)) who have successfully completed an intensive
				lifestyle treatment program (as defined in section 1861(hhh)(2)) and meet the
				requirements described in subsection (b).</text>
						</subsection><subsection id="ID19a8a3a7196c4dde99f7de831688dcf5"><enum>(b)</enum><header>Requirements</header><text>In
				order to receive an award under the program, an eligible beneficiary
				must—</text>
							<paragraph id="IDa3844ab64187495abd2cc5f8b5192e1c"><enum>(1)</enum><text>demonstrate that
				the program has beneficially affected the progression of chronic disease or
				diseases in the beneficiary upon completion of the program, as measured under
				clause (ii) of section 1848(b)(6)(C) with respect to 2 or more of the measures
				described in clause (i) of such section; and</text>
							</paragraph><paragraph id="IDca60196a134c41708eb20a4f174b1672"><enum>(2)</enum><text>during the 1 year
				period beginning on the date of an initial consultation under the lifestyle
				treatment program, receive no other treatment under part A or this part for any
				condition that relates to the initial diagnosis resulting in eligibility for
				the intensive lifestyle treatment program, except for a physician office visit
				for the purpose of making adjustments to medication prescribed to the eligible
				beneficiary.</text>
							</paragraph></subsection><subsection id="ID30a26f9f671542c3a9778adb9d709455"><enum>(c)</enum><header>Form of
				reward</header><text>The Secretary shall make such award to eligible
				beneficiaries described in subsection (a) in such form and manner as the
				Secretary, by regulation, shall prescribe.</text>
						</subsection><subsection id="ID045e54848c88449dabecd3841db14a5d"><enum>(d)</enum><header>Amount of
				reward</header><text>The amount of such award for each such eligible
				beneficiary shall be
				$200.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDba4e8c2e9bd1496198d3b7d7be07930f"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to items and
			 services furnished on or after January 1, 2010.</text>
			</subsection></section><section id="ID91e373f485d74cd385c71ea169cff487"><enum>3.</enum><header>Sense of the
			 Congress</header><text display-inline="no-display-inline">It is the sense of
			 the Congress that the services provided under a intensive lifestyle treatment
			 program (as defined in section 1861(hhh)(2) of the Social Security Act, as
			 added by section 2(a))—</text>
			<paragraph id="idC949DCBD8EED4C32962AFD8A7824A681"><enum>(1)</enum><text display-inline="yes-display-inline">would benefit individuals with chronic
			 diseases who are not enrolled in the Medicare Program under title XVIII of the
			 Social Security Act; and</text>
			</paragraph><paragraph id="id0DB2F51594824840B656785A9FBFD391"><enum>(2)</enum><text display-inline="yes-display-inline">should be covered by all public and private
			 payers.</text>
