		<legis-type>A BILL</legis-type>
		<official-title>To permit Amtrak passengers to safely transport firearms
		  and ammunition in their checked baggage.</official-title>

		<section id="idF8C819C2E1674E24A30E69C0AB5F6EF9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Amtrak Secure Transportation of
			 Firearms Act</short-title></quote>.</text>
		</section><section id="id4BD250DCED7143E999DE1C965DDF4522" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph id="ID164bab1533ac44d880ec4a0da92ec895"><enum>(1)</enum><text>The Second
			 Amendment to the Constitution of the United States provides that <quote>the
			 right of the people to keep and bear Arms, shall not be
			 infringed</quote>.</text>
			</paragraph><paragraph id="IDcc04706197d34151a1d48aaf90e69350"><enum>(2)</enum><text>The Supreme Court
			 of the United States ruled, in District of Columbia v. Heller, that <quote>the
			 Second Amendment protects an individual right to possess a firearm . . . and to
			 use that arm for traditionally lawful purposes</quote>.</text>
			</paragraph><paragraph id="ID920a8e32bf3745a5a57a54ef5d289c14"><enum>(3)</enum><text>At one time,
			 Amtrak accepted firearms in secure checked baggage.</text>
			</paragraph><paragraph id="ID4b9d4a595f294e6180fb70d62429c51f"><enum>(4)</enum><text>While airline
			 passengers may transport firearms and ammunition in secure checked baggage when
			 declared during the check-in process, Amtrak passengers are not permitted to
			 transport firearms and ammunition in secure checked baggage.</text>
			</paragraph><paragraph id="ID3ce20a3f722040a3b1b3a97793dabdbe"><enum>(5)</enum><text>Law-abiding gun
			 owners should not be penalized for seeking alternative means of travel,
			 particularly on a federally subsidized rail line.</text>
			</paragraph><paragraph id="ID41e1fbba71fc441cae90dbe59cd7d925"><enum>(6)</enum><text>Congress needs to
			 ensure that Amtrak does not override the Second Amendment rights of law-abiding
			 citizens.</text>
			</paragraph></section><section id="id5B2F25BCEBCF437793F68D558AD036CB" section-type="subsequent-section"><enum>3.</enum><header>Secure transportation
			 of firearms on passenger trains</header><text display-inline="no-display-inline">Section 24305 of title 49, United States
			 Code, is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idF5676C24D5EF4B7A972C7D15578E7E85" style="OLC">
				<subsection id="idE2F260E9FD5C48C4B7C8689CD832104D"><enum>(g)</enum><header>Secure
				transportation of firearms</header><text>If an Amtrak station accepts checked
				baggage for a specific Amtrak route, an Amtrak passenger holding a ticket for
				such route shall be allowed to place an unloaded firearm or starter pistol in a
				checked bag on such route if—</text>
					<paragraph id="ID496cb3ee0c08444ba7f6a9c9a8d4091b"><enum>(1)</enum><text>before checking
				the bag or boarding the train, the passenger declares to Amtrak, either orally
				or in writing, that the firearm is in his or her bag and is unloaded;</text>
					</paragraph><paragraph id="ID01e4c5f8115246fe93ba00d65ebcb7b0"><enum>(2)</enum><text>the firearm is
				carried in a hard-sided container;</text>
					</paragraph><paragraph id="ID533cff755c9f4c239bdae158fb65cb55"><enum>(3)</enum><text>such container is
				locked; and</text>
					</paragraph><paragraph id="IDb37a373292454b3ca9f1ff723687b380"><enum>(4)</enum><text>only the
				passenger has the key or combination for such container.</text>
					</paragraph></subsection><subsection id="id4872AAB71143412FBC38F3982C89F30C"><enum>(h)</enum><header>Small arms
				ammunition</header><text>An Amtrak passenger shall be allowed to place small
				arms ammunition for personal use in a checked bag on an Amtrak route if the
				ammunition is securely packed—</text>
					<paragraph id="id62EAB19EABA844308707E7F08A3C99E2"><enum>(1)</enum><text>in fiber, wood,
				or metal boxes; or</text>
					</paragraph><paragraph id="id2F3BB7B5EF9D4719A9604D844FAFAFE9"><enum>(2)</enum><text>in other
				packaging specifically designed to carry small amounts of ammunition.</text>
					</paragraph></subsection><subsection id="idB5FD9F3F37FF44B1B92D6ACFA0612992"><enum>(i)</enum><header>Applicability</header><text>Subsections
				(g) and (h) shall not apply in any fiscal year in which Amtrak does not receive
				Federal financial
				assistance.</text>
