			 coordination for low-income Medicare beneficiaries</header>
				<subsection commented="no" display-inline="no-display-inline" id="id24E1DE57C0274B7690096088C366DA93"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment of Federal coordinated health
			 care office</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idD0834BA8E61140799AA44548B707D5DB"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="id73AE331CF24C4C739E40975DBE447199"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than October 1, 2009, the
			 Secretary of Health and Human Services (in this section referred to as the
			 <quote>Secretary</quote>) shall establish a Federal Coordinated Health Care
			 Office.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id699BCDA744AC469F965E6394436A2AA4"><enum>(B)</enum><header display-inline="yes-display-inline">Establishment and reporting to CMS
			 administrator</header><text display-inline="yes-display-inline">The Federal
			 Coordinated Health Care Office shall—</text>
							<clause commented="no" display-inline="no-display-inline" id="id0302ED1BF0EA4E558909124F2CD4C5F0"><enum>(i)</enum><text display-inline="yes-display-inline">be established within the Centers for
			 Medicare &amp; Medicaid Services; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idF2548B8A01B743A4844B2AC5E06D2739"><enum>(ii)</enum><text display-inline="yes-display-inline">report directly to the Administrator of the
			 Centers for Medicare &amp; Medicaid Services.</text>
							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id32AAF7C7B6794B21A02EB273067946E8"><enum>(2)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of the Federal Coordinated
			 Health Care Office is to bring together officials of the Medicare and Medicaid
			 programs at the Centers for Medicare &amp; Medicaid Services in order
			 to—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id87D1299B499C42CC97E09129AA21A8FF"><enum>(A)</enum><text display-inline="yes-display-inline">more effectively integrate benefits under
			 the Medicare program under title XVIII of the Social Security Act and the
			 Medicaid program under title XIX of such Act; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAA34314E26B442519C0316B18C315108"><enum>(B)</enum><text display-inline="yes-display-inline">improve the coordination between the
			 Federal Government and States for individuals eligible for benefits under both
			 such programs in order to ensure that such individuals get full access to the
			 items and services to which they are entitled under titles XVIII and XIX of the
			 Social Security Act.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa22b13949d9b40b194a0a35a53f1c624"><enum>(3)</enum><header display-inline="yes-display-inline">Goals</header><text display-inline="yes-display-inline">The goals of the Federal Coordinated Health
			 Care Office are as follows:</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="IDdd7c31e463e440498e8ea1bdcbb0fd44"><enum>(A)</enum><text display-inline="yes-display-inline">Providing dual eligible individuals full
			 access to the benefits to which such individuals are entitled under the
			 Medicare and Medicaid programs.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id37801A905B9B4B62BF0105DD680F952A"><enum>(B)</enum><text display-inline="yes-display-inline">Simplifying the processes for dual eligible
			 individuals to access the items and services they are entitled to under the
			 Medicare and Medicaid programs.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID29b712db1ebf4170ad88b8d077db105a"><enum>(C)</enum><text display-inline="yes-display-inline">Improving the quality of health care and
			 long-term services for dual eligible individuals.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDdb0e8fd446e442128b1da65d7e79fd32"><enum>(D)</enum><text display-inline="yes-display-inline">Increasing beneficiary understanding of and
			 satisfaction with coverage under the Medicare and Medicaid programs.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDce4ecf049cd64040acd75f3de8a17c69"><enum>(E)</enum><text display-inline="yes-display-inline">Eliminating regulatory conflicts between
			 rules under the Medicare and Medicaid programs.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDbb687453a4d14f338c4c471587ff130a"><enum>(F)</enum><text display-inline="yes-display-inline">Improving care continuity and ensuring safe
			 and effective care transitions.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDabcc906121b6469894ca04bc91a6e66f"><enum>(G)</enum><text display-inline="yes-display-inline">Eliminating cost-shifting between the
			 Medicare and Medicaid program and among related health care providers.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDcb25cc9f39a543cfb9d36d615c280c80"><enum>(H)</enum><text display-inline="yes-display-inline">Improving the quality of performance of
			 providers of services and suppliers under the Medicare and Medicaid
			 programs.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8a3627b0a2074f8c8f1b302b3821106c"><enum>(4)</enum><header display-inline="yes-display-inline">Specific responsibilities</header><text display-inline="yes-display-inline">The specific responsibilities of the
			 Federal Coordinated Health Care Office are as follows:</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="IDb81e4949f6994b51bafd0aa066fb4a6c"><enum>(A)</enum><text display-inline="yes-display-inline">Providing States, specialized MA plans for
			 special needs individuals (as defined in section 1859(b)(6) of the Social
			 Security Act (42 U.S.C. 1395w–28(b)(6))), physicians and other relevant
			 entities or individuals with the education and tools necessary for developing
			 programs that align benefits under the Medicare and Medicaid programs for dual
			 eligible individuals.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID31d4c5fc906a43e380b8c1606e58c0fb"><enum>(B)</enum><text display-inline="yes-display-inline">Working with the Director of the
			 Congressional Budget Office and the Director of the Office of Management and
			 Budget, and in consultation with the Medicare Payment Advisory Commission and
			 the Medicaid and CHIP Payment and Access Commission, to, not later than January
			 1, 2011, establish dynamic scoring for benefits for dual eligible individuals
			 to account for total spending and savings for comparable risk groups under the
			 Medicare program.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9b42397f4f1c4e67a16f6db06a484466"><enum>(C)</enum><text display-inline="yes-display-inline">Supporting State efforts to coordinate and
			 align acute care and long-term care services for dual eligible individuals with
			 other items and services furnished under the Medicare program.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf6bf4a9cf40344078f18ab3f139c0e55"><enum>(D)</enum><text display-inline="yes-display-inline">Providing support for coordination of
			 contracting and oversight by States and the Centers for Medicare &amp; Medicaid
			 Services with respect to the integration of the Medicare and Medicaid programs
			 in a manner that is supportive of the goals described in paragraph (3).</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA50DADF581AF44D1A8BEE2C3809E3B8A"><enum>(5)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">The Secretary shall, as part of the budget
			 transmitted under section 1105(a) of title 31, United States Code, submit to
			 Congress an annual report containing recommendations for legislation that would
			 improve care coordination and benefits for dual eligible individuals.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5E684277EB4A479FB50480EEBDDBF9DE"><enum>(b)</enum><header display-inline="yes-display-inline">Addition of Medicaid representatives to
			 Medicare Payment Advisory Commission and consultation with Medicaid and CHIP
			 Payment and Access Commission</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id51CAFF7EDF384605B20AB61AA80B522B"><enum>(1)</enum><header display-inline="yes-display-inline">Addition of Medicaid representative to
			 Medicare Payment Advisory Commission</header><text display-inline="yes-display-inline">Section 1805(c)(2)(B) of the Social
			 Security Act (42 U.S.C. 1395b–6(c)(2)(B)) is amended by adding at the end the
			 following sentence: <quote>Such membership shall also include at least 2
			 individuals who are nationally recognized for their expertise in financing,
			 benefits, and provider payment policies under the program under title
			 XIX.</quote>.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1A457B1ED6EB4FABBF4E493B18BE0181"><enum>(2)</enum><header display-inline="yes-display-inline">Consultation with Medicaid and CHIP Payment
			 and Access Commission</header><text display-inline="yes-display-inline">Section
			 1805(b) of the Social Security Act (42 U.S.C. 1395b–6(b)) is amended by adding
			 at the end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="idBFBAD276BF804E888897B8C2D7418B78" style="OLC">
							<paragraph commented="no" display-inline="no-display-inline" id="id322C7F69BB514C548DEED00BA7FF6B0D"><enum>(9)</enum><header display-inline="yes-display-inline">Consultation with Medicaid and CHIP Payment
				and Access Commission</header><text display-inline="yes-display-inline">In
				carrying out the duties of the Commission under this subsection, the Commission
				shall consult with the Medicaid and CHIP Payment and Access Commission
				established under section 506 of the Children's Health Insurance Program
				Reauthorization Act of 2009 (Public Law 111–3) on an ongoing
				basis.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0B197F65D0AC402A8A76055AE68ED774"><enum>(c)</enum><header display-inline="yes-display-inline">MACPAC funding and technical
			 amendments</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id664DF3F303A644508698E5B45C2B0A3B"><enum>(1)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">Section 1900(f) of the Social Security Act
			 (42 U.S.C. 1396(f)) is amended—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id970E9356609C429D9E10A4F9956CEB6A"><enum>(A)</enum><text display-inline="yes-display-inline">in the subsection heading, by striking
			 <quote><header-in-text level="subsection" style="OLC">Authorization of
			 appropriations</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Funding</header-in-text></quote>;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id01785A50873746819FEEF97274F350FA"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting
			 <quote>(other than for fiscal year 2009)</quote> before <quote>in the same
			 manner</quote>; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8024D3044E1D4A3D9EEDCB1638329A51"><enum>(C)</enum><text display-inline="yes-display-inline">by striking paragraph (2) and inserting the
			 following:</text>
							<quoted-block display-inline="no-display-inline" id="id712C5373FA0F40778F3FFCE5660C7831" style="OLC">
								<paragraph commented="no" display-inline="no-display-inline" id="ID5FC6F1F356A841AF987851867A6E60DA"><enum>(2)</enum><header display-inline="yes-display-inline">Appropriation</header><text display-inline="yes-display-inline">Out of any funds in the Treasury not
				otherwise appropriated, there is appropriated to MACPAC $11,403,000 for fiscal
				year 2009 to carry out the provisions of this section.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8271795E63904742BBFFA716D7F91A49"><enum>(3)</enum><header display-inline="yes-display-inline">Authorization</header><text display-inline="yes-display-inline">In addition to amounts made available under
				paragraph (2), there are authorized to be appropriated for fiscal years
				beginning with fiscal year 2010, such sums as may be necessary to carry out the
				provisions of this section.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id07A0168938424557B98E4FAA6C04F221"><enum>(4)</enum><header display-inline="yes-display-inline">Availability</header><text display-inline="yes-display-inline">Amounts made available under paragraphs (2)
				and (3) to carry out the provisions of this section shall remain available
				until
				expended.</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAAF7B1DF62774A66B2EE0DD499CBB61B"><enum>(2)</enum><header display-inline="yes-display-inline">Technical amendments</header><text display-inline="yes-display-inline">Section 1900(b) of such Act (42 U.S.C.
			 1396) is amended—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id825876FF88C14B7C9C42F5728B9F0E3B"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)(D), by striking
			 <quote>June 1</quote> and inserting <quote>June 15</quote>; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id07DFB309A60B45868E9E59E5B34B0877"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

								<paragraph commented="no" display-inline="no-display-inline" id="id115237B7337B4ADEA7A388CC61F728BA"><enum>(10)</enum><header display-inline="yes-display-inline">Consultation with MedPAC</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="idCB3FCFE7F5234A94896B1DFC38E34792"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">MACPAC shall regularly consult with the
				Medicare Payment Advisory Commission (in this paragraph referred to as
				<quote>MedPAC</quote>) established under section 1805 in carrying out its
				duties under this section.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBC4ACC4636B74634A89E20DE1D04BBFE"><enum>(B)</enum><header display-inline="yes-display-inline">Data sharing</header><text display-inline="yes-display-inline">MACPAC and MedPAC shall have unrestricted
				access to all deliberations, records, and nonproprietary data of the other such
				entity, respectively, immediately upon the request of the either such
				entity.</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5CA5B8885ADB4327A61FE7C1B6D92B61"><enum>(d)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id24A1A4C5DF114B9D85B1B957E897827D"><enum>(1)</enum><text display-inline="yes-display-inline">requires mandatory integrated care under
			 the Medicare or Medicaid programs under titles XVIII and XIX, respectively, of
			 the Social Security Act;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2284EE648A9445CF8FE6F7883A7C1BCF"><enum>(2)</enum><text display-inline="yes-display-inline">promotes enrollment in specialized MA plans
			 for special needs individuals (as defined in section 1859(b)(6) of the Social
			 Security Act (42 U.S.C. 1395w–28(b)(6)));</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCCA2EC502C6B46F59E51BCB5F153DA9D"><enum>(3)</enum><text display-inline="yes-display-inline">promotes the development of Medicaid
			 managed care for dual eligible individuals; or</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD81B9726116A4797A5856B0DCBBB2F45"><enum>(4)</enum><text display-inline="yes-display-inline">prevents dual eligible individuals from
			 electing to remain in the original Medicare fee-for-service option, or the
			 right to make such election being protected.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id84335765C005443CB87CBB86EA5A2045" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Creating a Medicare operated prescription
			 drug plan option</header>
				<subsection commented="no" display-inline="no-display-inline" id="HDC18650C6AB34DFD88315D60837B40BE"><enum>(a)</enum><header display-inline="yes-display-inline">Medicare operated prescription drug plan
			 option</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idC45C99D9EF194D10ADEFBA386B55B17D"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subpart 2 of part D of the Social Security
			 Act is amended by inserting after section 1860D–11 (42 U.S.C. 1395w–111) the
			 following new section:</text>
						<quoted-block act-name="Social Security Act" display-inline="no-display-inline" id="HA0A9A310850040659668E182C1D4E15" style="traditional"><section commented="no" display-inline="no-display-inline" id="H31DA414080414370BB2DFCDB97F260F7" section-type="subsequent-section"><enum>1860D–11A.</enum><header>Medicare operated prescription drug plan
		  option</header><subsection commented="no" display-inline="yes-display-inline" id="H0C2337C9FD774CECBCA9C1D86F947058"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				part, for each year (beginning with 2011), in addition to any plans offered
				under section 1860D–11, the Secretary shall offer one or more Medicare operated
				prescription drug plans (as defined in subsection (b)) with a service area that
				consists of the entire United States and shall enter into negotiations in
				accordance with section 1860D–11A(i) with pharmaceutical manufacturers to
				reduce the purchase cost of covered part D drugs for eligible part D
				individuals who enroll in such a plan.</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="H5EE6750D9C524B5581DB9F0040A70082"><enum>(b)</enum><header display-inline="yes-display-inline">Medicare operated prescription drug plan
				defined</header><text display-inline="yes-display-inline">For purposes of this
				part, the term <term>Medicare operated prescription drug plan</term> means a
				prescription drug plan that offers qualified prescription drug coverage and
				access to negotiated prices described in section 1860D–2(a)(1)(A).</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="HB189D00F52DB4CF2B633C1BD9DE06600"><enum>(c)</enum><header display-inline="yes-display-inline">Monthly beneficiary premium</header>
									<paragraph commented="no" display-inline="no-display-inline" id="HD18736703B544A2F8F7BC94D6243DF9C"><enum>(1)</enum><header display-inline="yes-display-inline">Qualified prescription drug
				coverage</header><text display-inline="yes-display-inline">The monthly
				beneficiary premium for qualified prescription drug coverage and access to
				negotiated prices described in section 1860D–2(a)(1)(A) to be charged under a
				Medicare operated prescription drug plan shall be uniform nationally. Such
				premium for months in 2010 and each succeeding year shall be equal to the
				product of—</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="idFF6FD47E692949AFAB38584E5FCFC364"><enum>(A)</enum><text display-inline="yes-display-inline">the beneficiary premium percentage (as
				specified in section 1860D–13(a)(3)); and</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8DA7D4E35A7A470EA85A3842DD7AD329"><enum>(B)</enum><text display-inline="yes-display-inline">the average monthly per capita actuarial
				cost of offering the Medicare operated prescription drug plan for the year
				involved, including administrative expenses.</text>
										</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf4428ed175144b2da24b018d015e4990"><enum>(2)</enum><header display-inline="yes-display-inline">Premium subsidy for applicable subsidy
				eligible individuals</header>
										<subparagraph commented="no" display-inline="no-display-inline" id="id54054AE245BB485D8B33F5658098FF10"><enum>(A)</enum><header display-inline="yes-display-inline">Full subsidy eligible
				individuals</header><text display-inline="yes-display-inline">In the case of an
				applicable subsidy eligible individual described in paragraph (4)(A), the
				individual is entitled under this section to an income-related premium subsidy
				equal to 100 percent of the monthly beneficiary premium of the Medicare
				operated prescription drug plan.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCF0F704C9F31403B95ADB3D4909899F9"><enum>(B)</enum><header display-inline="yes-display-inline">Other subsidy eligible
				individuals</header><text display-inline="yes-display-inline">In the case of an
				applicable subsidy eligible individual described in paragraph (4)(B), the
				individual is entitled under this section to an income-related premium subsidy
				determined on a linear sliding scale as follows:</text>
											<clause commented="no" display-inline="no-display-inline" id="idA434DE7053C14861B5B8450C5D228C8B"><enum>(i)</enum><text display-inline="yes-display-inline">One hundred percent of the amount described
				in subparagraph (A) for individuals with incomes at or below 135 percent of
				such level.</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="id149A79068F4945508F1CA605466A724A"><enum>(ii)</enum><text display-inline="yes-display-inline">Seventy-five percent of such amount for
				individuals with incomes above 135 percent of such level and at or below 140
				percent of such level.</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="id6E3545C8EA2D4D77B62B2795631ED858"><enum>(iii)</enum><text display-inline="yes-display-inline">Fifty percent of such amount for
				individuals with incomes above 140 percent of such level and at or below 145
				percent of such level.</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="id4E3CA9998F0C4CC28D6863D79D6E3127"><enum>(iv)</enum><text display-inline="yes-display-inline">Twenty-five percent of such amount for
				individuals with incomes above 145 percent of such level and below 150 percent
				of such level.</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="idE19206D6A570434C872D97185A2BD92F"><enum>(v)</enum><text display-inline="yes-display-inline">Zero percent of such amount for individuals
				with incomes at 150 percent of such level.</text>
											</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID21ee8f0c94914a91b5289254cb816f7f"><enum>(3)</enum><header display-inline="yes-display-inline">Cost-sharing for applicable subsidy
				eligible individuals</header>
										<subparagraph commented="no" display-inline="no-display-inline" id="id40F87915C0424EF0B843D7265D38C39D"><enum>(A)</enum><header display-inline="yes-display-inline">Full-subsidy eligible
				individuals</header><text display-inline="yes-display-inline">In the case of an
				applicable subsidy eligible individual described in paragraph (4)(A), the
				provisions of section 1860D–14(a)(1) shall apply, except the premium subsidy
				under paragraph (2)(A) shall be substituted for the premium subsidy under
				subparagraph (A) of such section 1860D–14(a)(1).</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID78F648BFCDF3445CB99B5AAC40AC0EC5"><enum>(B)</enum><header display-inline="yes-display-inline">Other subsidy eligible
				individuals</header><text display-inline="yes-display-inline">In the case of an
				applicable subsidy eligible individual described in paragraph (4)(B), the
				provisions of section 1860D–14(a)(2) shall apply, except the premium subsidy
				under paragraph (2)(B) shall be substituted for the premium subsidy under
				subparagraph (A) of such section 1860D–14(a)(2).</text>
										</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id864B2943965C454D9367DBC618ACEEEA"><enum>(4)</enum><header display-inline="yes-display-inline">Definition of applicable subsidy eligible
				individuals</header><text display-inline="yes-display-inline">For purposes of
				paragraphs (2) and (3), the term <term>applicable subsidy eligible
				individual</term> means the following:</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="id26AD44FE8CD9485CB54BE3FD95165D27"><enum>(A)</enum><header display-inline="yes-display-inline">Full-subsidy eligible individuals</header>
											<clause commented="no" display-inline="no-display-inline" id="id6C95B2F1B6CB42529BCC1FA6A93ED535"><enum>(i)</enum><header display-inline="yes-display-inline">Individuals with income below 135 percent
				of poverty line</header><text display-inline="yes-display-inline">Any
				individual who—</text>
												<subclause commented="no" display-inline="no-display-inline" id="idC3CD07A6331E45B4A79FEE5B5226C8C9"><enum>(I)</enum><text display-inline="yes-display-inline">is enrolled in a Medicare operated
				prescription drug plan;</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="id0CAEE0826C92499DB5225AC456C27540"><enum>(II)</enum><text display-inline="yes-display-inline">is determined to have income that is below
				135 percent of the poverty line applicable to a family of the size involved;
				and</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="id6FCA3AA3D6BA48EFA040A5E34077772D"><enum>(III)</enum><text display-inline="yes-display-inline">meets the resources requirement described
				in section 1860D–14(a)(3)(E), as amended by section 201 of the
				<short-title>Medicare Prescription Drug Coverage
				Improvement Act</short-title>.</text>
												</subclause></clause><clause commented="no" display-inline="no-display-inline" id="idD5BF766387A04F05B195BEAC8A4FCBDC"><enum>(ii)</enum><header display-inline="yes-display-inline">Certain other individuals</header><text display-inline="yes-display-inline">Any individual who is enrolled in a
				Medicare operated prescription drug plan who—</text>
												<subclause commented="no" display-inline="no-display-inline" id="idD2EBAA72E8964F439465EE17B915C380"><enum>(I)</enum><text display-inline="yes-display-inline">is a full-benefit dual eligible individual
				(as defined in section 1935(c)(6));</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="id4CB7DDB4C93F4A59A8F2DAC0251D8A94"><enum>(II)</enum><text display-inline="yes-display-inline">receives benefits under the supplemental
				security income program under title XVI; or</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="idA5EEAB12804D4F039E0EFDA02BE541F3"><enum>(III)</enum><text display-inline="yes-display-inline">is eligible for medical assistance under
				clause (i), (iii), or (iv) of section 1902(a)(10)(E).</text>
												</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id751EDF9149AA40EE8A2B7FD0ACA2BDB3"><enum>(B)</enum><header display-inline="yes-display-inline">Other subsidy eligible
				individuals</header><text display-inline="yes-display-inline">Any individual
				who—</text>
											<clause commented="no" display-inline="no-display-inline" id="idD72318EFFFAB437E98689217C5EDEDDA"><enum>(i)</enum><text display-inline="yes-display-inline">is not described in paragraph (1);</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="id4267F51950EB4711892CA53A16A2381C"><enum>(ii)</enum><text display-inline="yes-display-inline">is enrolled in a Medicare operated
				prescription drug plan;</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="idDC812DB399984E1390313FCEDC725365"><enum>(iii)</enum><text display-inline="yes-display-inline">is determined to have income that is below
				150 percent of the poverty line applicable to a family of the size involved;
				and</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="id718CC4017D0D4BE6A7C0AE158077674C"><enum>(iv)</enum><text display-inline="yes-display-inline">meets the resources requirement described
				in section 1860D–14(a)(3)(E), as amended by section 201 of the
				<short-title>Medicare Prescription Drug Coverage
				Improvement Act</short-title>.</text>
											</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB439B4C46D694E3597DAF502FF553800"><enum>(d)</enum><header display-inline="yes-display-inline">Use of a formulary and formulary
				incentives</header>
									<paragraph commented="no" display-inline="no-display-inline" id="H17CD44524199408191CB1C741FEF6DCC"><enum>(1)</enum><header display-inline="yes-display-inline">Use of a formulary</header>
										<subparagraph commented="no" display-inline="no-display-inline" id="id242C2CAB7FD64CDB99BE9DA019CE7F3A"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">With respect to the operation of a Medicare
				operated prescription drug plan, the Secretary shall establish and apply a
				formulary (and may include formulary incentives described in paragraph
				(5)(C)(ii)) in accordance with this subsection in order to—</text>
											<clause commented="no" display-inline="no-display-inline" id="H74BB91B732EA41958B163DC804C5EFA4"><enum>(i)</enum><text display-inline="yes-display-inline">increase patient safety;</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="HD71FC5E191DE48D883330352293F8F15"><enum>(ii)</enum><text display-inline="yes-display-inline">increase appropriate use and reduce
				inappropriate use of drugs; and</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="H978948A5638148FA9F1CAABF692BED03"><enum>(iii)</enum><text display-inline="yes-display-inline">reward value.</text>
											</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0BCB43FBCC324C5A85AD24755665ACD7"><enum>(B)</enum><header display-inline="yes-display-inline">Default initial formulary</header><text display-inline="yes-display-inline">Until such time as the Secretary
				establishes and applies the initial formulary under paragraph (5), a Medicare
				operated prescription drug plan shall be required to include all drugs approved
				for safety and effectiveness as a prescription drug under the Federal Food,
				Drug, and Cosmetic Act that are covered part D drugs (and may include formulary
				incentives described in paragraph (5)(C)(ii)).</text>
										</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF12C140B470F4520AE9D6F59952BEEA8"><enum>(2)</enum><header display-inline="yes-display-inline">Requirements for formularies</header><text display-inline="yes-display-inline">The Secretary shall establish a formulary
				that meets the following requirements:</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="idEB79D0B1B45B4D89B56A5C71991A28BF"><enum>(A)</enum><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the
				formulary includes the covered outpatient drugs of any manufacturer which has
				entered into and complies with an agreement with the Secretary under this
				section.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0F0FB550BE554D9F8A0941F7B532A0D3"><enum>(B)</enum><text display-inline="yes-display-inline">A covered outpatient drug may be excluded
				with respect to the treatment of a specific disease or condition for an
				identified population (if any) only if, based on the drug's labeling (or, in
				the case of a drug the prescribed use of which is not approved under the
				Federal Food, Drug, and Cosmetic Act but is a medically accepted indication (as
				defined in section 1860D–2(e)(4))), the excluded drug does not have a
				significant, clinically meaningful therapeutic advantage in terms of safety,
				effectiveness, or clinical outcome of such treatment for such population over
				other drugs included in the formulary and there is a written explanation
				(available to the public) of the basis for the exclusion.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDAA079403A004622B204007E79298EED"><enum>(C)</enum><text display-inline="yes-display-inline">The Secretary permits coverage of a drug
				excluded from the formulary pursuant to a prior authorization program that is
				consistent with paragraph (3).</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8A0098620ADA4A148024D105B5DAB64A"><enum>(D)</enum><text display-inline="yes-display-inline">The formulary meets such other requirements
				as the Secretary may impose in order to achieve program savings consistent with
				protecting the health of program beneficiaries.</text>
										</subparagraph><continuation-text commented="no" continuation-text-level="paragraph">A prior authorization program
				established under paragraph (3) is not a formulary subject to the requirements
				of this paragraph.</continuation-text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id46878628F40E46FAB40C39A89CB7B74F"><enum>(3)</enum><header display-inline="yes-display-inline">Requirements of prior authorization
				programs</header><text display-inline="yes-display-inline">The Secretary may
				require, with respect to drugs dispensed on or after July 1, 1991, the approval
				of the drug before its dispensing for any medically accepted indication (as
				defined in section 1860D–2(e)(4)) only if the system providing for such
				approval—</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="id56136DC2FD7C4BF080121DA33A713CF6"><enum>(A)</enum><text display-inline="yes-display-inline">provides response by telephone or other
				telecommunication device within 24 hours of a request for prior authorization;
				and</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA2DC7D69B32E4E5493CF26B24E25D69D"><enum>(B)</enum><text display-inline="yes-display-inline">provides for the dispensing of at least a
				72-hour supply of a covered outpatient prescription drug in an emergency
				situation (as defined by the Secretary).</text>
										</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id03CA0EDE38AF40A8A2A16C1C0D7760D5"><enum>(4)</enum><header display-inline="yes-display-inline">Other permissible
				restrictions</header><text display-inline="yes-display-inline">The Secretary
				may impose limitations, with respect to all such drugs in a therapeutic class,
				on the minimum or maximum quantities per prescription or on the number of
				refills, if such limitations are necessary to improve patient safety,
				discourage waste, or address instances of fraud or abuse by individuals in any
				manner authorized under this Act.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC6912F2DA54F495588A7D912F895484E"><enum>(5)</enum><header display-inline="yes-display-inline">Development of initial formulary</header>
										<subparagraph commented="no" display-inline="no-display-inline" id="H60980591DC3F44D7A0AB9E22D651C191"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In selecting covered part D drugs for
				inclusion in a formulary, the Secretary shall consider clinical benefit and
				price.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC1352769698E40D4B41E00C46F6096FF"><enum>(B)</enum><header display-inline="yes-display-inline">Role of AHRQ</header><text display-inline="yes-display-inline">The Director of the Agency for Healthcare
				Research and Quality shall be responsible for assessing the clinical benefit of
				covered part D drugs and making recommendations to the Secretary regarding
				which drugs should be included in the formulary. In conducting such assessments
				and making such recommendations, the Director shall—</text>
											<clause commented="no" display-inline="no-display-inline" id="H7C6E51E13DD140B8A5F2CB5754F8F8BE"><enum>(i)</enum><text display-inline="yes-display-inline">consider safety concerns including those
				identified by the Federal Food and Drug Administration;</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="H99B9C003A2E641FAB939A8D17CA391C3"><enum>(ii)</enum><text display-inline="yes-display-inline">use available data and evaluations, with
				priority given to randomized controlled trials, to examine clinical
				effectiveness, comparative effectiveness, safety, and enhanced compliance with
				a drug regimen;</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="H3A688020DECD42B4884F41F2C0CC526D"><enum>(iii)</enum><text display-inline="yes-display-inline">use the same classes of drugs developed by
				United States Pharmacopeia for this part;</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="H39BC0D79F23A420783BC341ECE760129"><enum>(iv)</enum><text display-inline="yes-display-inline">consider evaluations made by—</text>
												<subclause commented="no" display-inline="no-display-inline" id="HFEC056C2D75C49FF91B104E137AC2500"><enum>(I)</enum><text display-inline="yes-display-inline">the Director under section 1013 of Medicare
				Prescription Drug, Improvement, and Modernization Act of 2003;</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="H5A67B0657B6148259FD52147E8A919AA"><enum>(II)</enum><text display-inline="yes-display-inline">other Federal entities, such as the
				Secretary of Veterans Affairs; and</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="H8FDCE04345C8451DB651C91696C6AFCB"><enum>(III)</enum><text display-inline="yes-display-inline">other private and public entities, such as
				the Drug Effectiveness Review Project and Medicaid programs; and</text>
												</subclause></clause><clause commented="no" display-inline="no-display-inline" id="HE9B5D29EF3F24419A9CE9B8EE32DAA79"><enum>(v)</enum><text display-inline="yes-display-inline">recommend to the Secretary—</text>
												<subclause commented="no" display-inline="no-display-inline" id="H49A577C80E5B4510B546FE01BD54F0D9"><enum>(I)</enum><text display-inline="yes-display-inline">those drugs in a class that provide a
				greater clinical benefit, including fewer safety concerns or less risk of
				side-effects, than another drug in the same class that should be included in
				the formulary;</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="H37FBAF5ED76646208048D3060157C77B"><enum>(II)</enum><text display-inline="yes-display-inline">those drugs in a class that provide less
				clinical benefit, including greater safety concerns or a greater risk of
				side-effects, than another drug in the same class that should be excluded from
				the formulary; and</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="H01FF969DBF174D018831DFD3B1D0C493"><enum>(III)</enum><text display-inline="yes-display-inline">drugs in a class with same or similar
				clinical benefit for which it would be appropriate for the Secretary to
				competitively bid (or negotiate) for placement on the formulary.</text>
												</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H43D2D6F7414745AAADD5E2003F86AAF8"><enum>(C)</enum><header display-inline="yes-display-inline">Consideration of AHRQ
				recommendations</header>
											<clause commented="no" display-inline="no-display-inline" id="H1E858AD74C4F4A2894EE447FBD16074E"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than January 1, 2011, the
				Secretary, after taking into consideration the recommendations under
				subparagraph (B)(v), shall establish a formulary, and formulary incentives, to
				encourage use of covered part D drugs that—</text>
												<subclause commented="no" display-inline="no-display-inline" id="H37B577844DFD4083BD605F46AAB4E6CD"><enum>(I)</enum><text display-inline="yes-display-inline">have a lower cost and provide a greater
				clinical benefit than other drugs;</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="HDE0F601196D9499FBADCE3333BE10075"><enum>(II)</enum><text display-inline="yes-display-inline">have a lower cost than other drugs with
				same or similar clinical benefit; and</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="HC762B4D8841041398F111B751F32F928"><enum>(III)</enum><text display-inline="yes-display-inline">drugs that have the same cost but provide
				greater clinical benefit than other drugs.</text>
												</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H8AEC98112EF3408A847F8CF9D344ED1"><enum>(ii)</enum><header display-inline="yes-display-inline">Formulary incentives</header><text display-inline="yes-display-inline">The formulary incentives under clause (i)
				may be in the form of one or more of the following:</text>
												<subclause commented="no" display-inline="no-display-inline" id="HD53182D0F7BA4BD19136C044E6F7D300"><enum>(I)</enum><text display-inline="yes-display-inline">Tiered copayments.</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="HBD27324498964F05A7D299F973227D4D"><enum>(II)</enum><text display-inline="yes-display-inline">Prior authorization.</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="HE82747DEE09241D894F69CA0BB49BDA"><enum>(III)</enum><text display-inline="yes-display-inline">Step therapy.</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="HFD071B11908242768F6E1213F674313D"><enum>(IV)</enum><text display-inline="yes-display-inline">Medication therapy management.</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="H8FE3C4F2305D4662A6EFF9DC6795343"><enum>(V)</enum><text display-inline="yes-display-inline">Generic drug substitution.</text>
												</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H0A977849F99E43FC8583F9C00CD7E"><enum>(iii)</enum><header display-inline="yes-display-inline">Flexibility</header><text display-inline="yes-display-inline">In applying such formulary incentives the
				Secretary may decide not to impose any cost-sharing for a covered part D drug
				for which—</text>
												<subclause commented="no" display-inline="no-display-inline" id="H5B1B242BB2A54AF9AA00E2F727B20026"><enum>(I)</enum><text display-inline="yes-display-inline">the elimination of cost sharing would be
				expected to increase compliance with a drug regimen; and</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="HE725CD45D40B4B4C9B85F33D689B72"><enum>(II)</enum><text display-inline="yes-display-inline">compliance would be expected to produce
				savings under part A or B or both.</text>
												</subclause></clause><clause commented="no" display-inline="no-display-inline" id="idC0CF5C58C07E4181A106420AFBBF0978"><enum>(iv)</enum><header display-inline="yes-display-inline">Development of transparent process to
				explain formulary incentives</header><text display-inline="yes-display-inline">Not later than January 1, 2011, the
				Secretary shall develop and implement a transparent process to identify and
				explain to beneficiaries formulary incentives under clause (i). Such process
				shall be designed to assist beneficiaries in understanding how prior
				authorization requests and other formulary incentives will be evaluated.</text>
											</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC4FA0255219E438D93079D85E166E5B3"><enum>(6)</enum><header display-inline="yes-display-inline">Limitations on formulary</header><text display-inline="yes-display-inline">In any formulary established under this
				subsection, the formulary may not be changed during a year, except—</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="HDE151D5D7F234021AEF3874D692EBCDB"><enum>(A)</enum><text display-inline="yes-display-inline">to add a generic version of a covered part
				D drug that entered the market;</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA814B1D05B234312AAC3CEF90072DA6C"><enum>(B)</enum><text display-inline="yes-display-inline">to remove such a drug for which a safety
				problem is found; and</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE450C938FF8047DD930355FCD4DA1D"><enum>(C)</enum><text display-inline="yes-display-inline">to add a drug that the Secretary identifies
				as a drug which treats a condition for which there has not previously been a
				treatment option or for which a clear and significant benefit has been
				demonstrated over other covered part D drugs.</text>
										</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC2435311A2344656BCC9C21BEC72B2BA"><enum>(7)</enum><header display-inline="yes-display-inline">Adding drugs to the initial
				formulary</header>
										<subparagraph commented="no" display-inline="no-display-inline" id="HD0C01A90A52A41E095E804254E218FD5"><enum>(A)</enum><header display-inline="yes-display-inline">Use of advisory committee</header><text display-inline="yes-display-inline">The Secretary shall establish and appoint
				an advisory committee (in this paragraph referred to as the <quote>advisory
				committee</quote>)—</text>
											<clause commented="no" display-inline="no-display-inline" id="H876853358F354F2DB1A2EF0347D377B4"><enum>(i)</enum><text display-inline="yes-display-inline">to review petitions from drug
				manufacturers, health care provider organizations, patient groups, and other
				entities for inclusion of a drug in, or other changes to, such formulary;
				and</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="HDFDB2B45944E4D48A2985C59DF00C7DD"><enum>(ii)</enum><text display-inline="yes-display-inline">to recommend any changes to the formulary
				established under this subsection.</text>
											</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFFD8A16B8B6444CB836E74804432ACDD"><enum>(B)</enum><header display-inline="yes-display-inline">Composition</header><text display-inline="yes-display-inline">The advisory committee shall be composed of
				9 members and shall include representatives of physicians, pharmacists, and
				consumers and others with expertise in evaluating prescription drugs. The
				Secretary shall select members based on their knowledge of pharmaceuticals and
				the Medicare and Medicaid populations. Members shall be deemed to be special
				Government employees for purposes of applying the conflict of interest
				provisions under section 208 of title 18, United States Code, and no waiver of
				such provisions for such a member shall be permitted.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD4C65A5D4DEF403DA1D932A73EE94237"><enum>(C)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">The advisory committee shall consult, as
				necessary, with physicians who are specialists in treating the disease for
				which a drug is being considered.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H71359D6EAD174B879DE3083C001D9435"><enum>(D)</enum><header display-inline="yes-display-inline">Request for studies</header><text display-inline="yes-display-inline">The advisory committee may request the
				Agency for Healthcare Research and Quality or an academic or research
				institution to study and make a report on a petition described in subparagraph
				(A)(ii) in order to assess—</text>
											<clause commented="no" display-inline="no-display-inline" id="HA1B3273D3AE2411D89B4E2E9D3D008AA"><enum>(i)</enum><text display-inline="yes-display-inline">clinical effectiveness;</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="H416791A28839424997A2EBA2DA7147"><enum>(ii)</enum><text display-inline="yes-display-inline">comparative effectiveness;</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="H0AB572144B5645E196E2582D1D827965"><enum>(iii)</enum><text display-inline="yes-display-inline">safety; and</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="H22D495E36D36437E8240A430B81B3182"><enum>(iv)</enum><text display-inline="yes-display-inline">enhanced compliance with a drug
				regimen.</text>
											</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1E50ABDA375545BB86C850262F3B6000"><enum>(E)</enum><header display-inline="yes-display-inline">Recommendations</header><text display-inline="yes-display-inline">The advisory committee shall make
				recommendations to the Secretary regarding—</text>
											<clause commented="no" display-inline="no-display-inline" id="H103853DAF64B4BDCB782D8E5D72C1CC6"><enum>(i)</enum><text display-inline="yes-display-inline">whether a covered part D drug is found to
				provide a greater clinical benefit, including fewer safety concerns or less
				risk of side-effects, than another drug in the same class that is currently
				included in the formulary and should be included in the formulary;</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="H263429899D034189875D71F398D082ED"><enum>(ii)</enum><text display-inline="yes-display-inline">whether a covered part D drug is found to
				provide less clinical benefit, including greater safety concerns or a greater
				risk of side-effects, than another drug in the same class that is currently
				included in the formulary and should not be included in the formulary;
				and</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="HA9140279A66E42289FB046C11965CCA8"><enum>(iii)</enum><text display-inline="yes-display-inline">whether a covered part D drug has the same
				or similar clinical benefit to a drug in the same class that is currently
				included in the formulary and whether the drug should be included in the
				formulary.</text>
											</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB6062E9E326C438A85B44BA9F8EC947E"><enum>(F)</enum><header display-inline="yes-display-inline">Limitations on review of manufacturer
				petitions</header><text display-inline="yes-display-inline">The advisory
				committee shall not review a petition of a drug manufacturer under subparagraph
				(A)(ii) with respect to a covered part D drug unless the petition is
				accompanied by the following:</text>
											<clause commented="no" display-inline="no-display-inline" id="HC433E14D728147BCB72DB5C83136D122"><enum>(i)</enum><text display-inline="yes-display-inline">Raw data from clinical trials on the safety
				and effectiveness of the drug.</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="H48BAB825214B440CAC6833F559C597FD"><enum>(ii)</enum><text display-inline="yes-display-inline">Any data from clinical trials conducted
				using active controls on the drug or drugs that are the current standard of
				care.</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="HBDB24B68A9B04CC2AF7B0799A7A9E812"><enum>(iii)</enum><text display-inline="yes-display-inline">Any available data on comparative
				effectiveness of the drug.</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="HBFAA534F656E4446A7596BA03B7C1251"><enum>(iv)</enum><text display-inline="yes-display-inline">Any other information the Secretary
				requires for the advisory committee to complete its review.</text>
											</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5F49F5837CEE4226971DD149FA248C13"><enum>(G)</enum><header display-inline="yes-display-inline">Response to recommendations</header><text display-inline="yes-display-inline">The Secretary shall review the
				recommendations of the advisory committee and if the Secretary accepts such
				recommendations the Secretary shall modify the formulary established under this
				subsection accordingly. Nothing in this section shall preclude the Secretary
				from adding to the formulary a drug for which the Director of the Agency for
				Healthcare Research and Quality or the advisory committee has not made a
				recommendation.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1D360EAF5C3E4D269D6025BF13ABE34"><enum>(H)</enum><header display-inline="yes-display-inline">Notice of changes</header><text display-inline="yes-display-inline">The Secretary shall provide timely notice
				to beneficiaries and health professionals about changes to the formulary or
				formulary incentives.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2E2FFD1C0A0F46CB927065FC6BF4F539"><enum>(I)</enum><header display-inline="yes-display-inline">Stability of benefit</header><text display-inline="yes-display-inline">Once a covered part D drug has been added
				to the formulary established under this subsection, the drug may not be removed
				from the formulary for at least a 3-year period, unless the Secretary
				determines there are safety or efficacy concerns with respect to the
				drug.</text>
										</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id625D8BA5944041D6B0BCE8D5CB51FC76"><enum>(8)</enum><header display-inline="yes-display-inline">Non-excludable drugs</header><text display-inline="yes-display-inline">The following drugs or classes of drugs
				shall not be excluded from the default initial formulary (as described in
				paragraph (1)(B)) or the initial formulary established by the Secretary (as
				described in paragraph (5)):</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="id0756358BAB034A2698C7A729B23BD7EE"><enum>(A)</enum><text display-inline="yes-display-inline">Barbiturates.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEF34B3B6868A44EDA71DA1C2B73B9231"><enum>(B)</enum><text display-inline="yes-display-inline">Benzodiazepines.</text>
										</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H830429A2B4EF4D948B00B90932946E9D"><enum>(e)</enum><header display-inline="yes-display-inline">Informing beneficiaries</header>
									<paragraph commented="no" display-inline="no-display-inline" id="id695C0544BD914B7AB8C0A217038CCEA2"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall take steps to inform
				beneficiaries about the availability of a Medicare operated prescription drug
				plan or plans including providing information in the annual handbook
				distributed to all beneficiaries and adding information to the official public
				Medicare website related to prescription drug coverage available through this
				part.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id91CB7D9896764432B4D18C26A01003DC"><enum>(2)</enum><header display-inline="yes-display-inline">Sole responsibility for marketing by the
				secretary</header>
										<subparagraph commented="no" display-inline="no-display-inline" id="id22FD3AD9C75A4E9E9C75C89E87C39306"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall have sole
				responsibility for marketing Medicare operated prescription drug plans.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9C66749A8905460B9805B177BEF0BEFE"><enum>(B)</enum><header display-inline="yes-display-inline">Authorization</header><text display-inline="yes-display-inline">There is authorized to be appropriated to
				the Secretary such sums as are necessary to carry out such marketing.</text>
										</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H04497A7CA5F4471586887C29E6DDAE50"><enum>(f)</enum><header display-inline="yes-display-inline">Application of all other requirements for
				prescription drug plans</header><text display-inline="yes-display-inline">Except as specifically provided in this
				section, any Medicare operated drug plan shall meet the same requirements as
				apply to any other prescription drug plan, including the requirements of
				section 1860D–4(b)(1) relating to assuring pharmacy access.</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="ID1b249c9c3385435f879ea7e89dba4e50"><enum>(g)</enum><header display-inline="yes-display-inline">Automatic enrollment</header><text display-inline="yes-display-inline">The Secretary shall establish procedures to
				provide for the automatic enrollment of subsidy eligible individuals (as
				defined in section 1860D–14(a)(3)) in a Medicare operated prescription drug
				plan in the case where such individuals lose their current prescription drug
				coverage, become part D eligible individuals, or in instances where the amount
				of the monthly beneficiary premium under the prescription drug plan the
				individual is enrolled in is greater than the premium subsidy amount described
				in section 1860D–14(b).</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="idDC3C89CBA2864FC0B062A65FD23CF227"><enum>(h)</enum><header display-inline="yes-display-inline">Rule of construction regarding eligibility
				for medical assistance</header><text display-inline="yes-display-inline">In no
				case may enrollment in a Medicare operated prescription drug plan affect the
				eligibility of an individual to receive medical assistance under a State plan
				under title
				XIX.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4CBB003A62F54B2FB16735731494A92C"><enum>(2)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 this subsection shall take effect as if included in the enactment of section
			 101 of the Medicare Prescription Drug, Improvement, and Modernization Act of
			 2003.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HCF302F98F9044938A66C5C07E4C7729E"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendments</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id7CE24969ECEB46D6924C422A47736A2D"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="HC9B29C27FC5D4D4F9316E5996B2BC38"><enum>(A)</enum><text display-inline="yes-display-inline">Section 1860D–3(a) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1395w–103(a)) is amended by adding at the end the following new
			 paragraph:</text>

			 (42 U.S.C. 1395w–28(f)) is amended—</text>

				Committee for Quality Assurance under which the National Committee for Quality
				Assurance shall develop an accreditation (and reaccreditation) program for all

				in subsection (b)(6)(B)(ii).</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id159C180351D041B7B2B2327EE69F4DEF"><enum>(B)</enum><header display-inline="yes-display-inline">Requirement</header><text display-inline="yes-display-inline">The requirement described in this
				subparagraph is that, effective for plan years beginning on or after January 1,
				2012, a specialized MA plan for special needs individuals (as so defined) meet
				the accreditation standards developed by the National Committee for Quality
				Assurance under the contract under subparagraph
				(A).</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idAB99A5D2D4E3424D83881D45A37578B1"><enum>(b)</enum><header display-inline="yes-display-inline">Revisions relating to specialized Medicare
			 Advantage plans for special needs individuals</header><text display-inline="yes-display-inline">Section 1859 of the Social Security Act (42
			 U.S.C. 1395w–28) is amended—</text>

				described in subsection (b)(6)(B)(ii) up-front information about formularies
				and utilization management strategies under the plan as part of the information
				disclosed under section 1852(c)(1).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6e548949a8e1467da19679781c6e3e93"><enum>(2)</enum><header display-inline="yes-display-inline">Premium</header><text display-inline="yes-display-inline">The premium under the plan does not exceed
				the premium subsidy amount described in section 1860D–14(b).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDF0AB70F7C5F44208B48202D6685609A"><enum>(3)</enum><header display-inline="yes-display-inline">Formulary</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="idCB5F648454FF4B639471A743C3E294AA"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the plan has a
				formulary that, based on the most recent data available, covers at
				least—</text>
										<clause commented="no" display-inline="no-display-inline" id="idEFF0A0A37BB64CE0952CA2C4156B2443"><enum>(i)</enum><text display-inline="yes-display-inline">95 percent of the 200 most commonly
				prescribed non-duplicative generic covered part D drugs for the population of
				individuals entitled to (or enrolled for) benefits under part A or enrolled
				under part B; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="idB7ED2388BE774E62B87123D67D2C9742"><enum>(ii)</enum><text display-inline="yes-display-inline">95 percent of the 200 most commonly
				prescribed non-duplicative brand name covered part D drugs for such
				population.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idACB1972AFFB0433B8F0E91A97447236A"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusion of drugs in certain categories
				and classes</header><text display-inline="yes-display-inline">The plan
				formulary shall include all covered part D drugs in the categories and classes
				identified by the Secretary under section 1860D–4(b)(3)(G)(i).</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID493fb20355824a5dbd67bfa9be0453a1"><enum>(4)</enum><header display-inline="yes-display-inline">Pharmacy access</header><text display-inline="yes-display-inline">The plan secures participation in its
				network of a sufficient number of pharmacies that dispense (other than by mail
				order) drugs directly to patients to ensure convenient access by at least 90
				percent of enrollees who are residing in long-term care facilities within the
				region.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc09b12a95dbc452182b733490b2e795d"><enum>(5)</enum><header display-inline="yes-display-inline">Operation of a dedicated customer
				assistance phone line</header><text display-inline="yes-display-inline">The
				plan shall maintain a toll-free number or numbers for inquiries concerning the
				plan that is solely for the use of such individuals, the designated
				representatives of such individuals (including designated family members),
				advocates of such individuals, providers of services, and suppliers.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID501933ac3002498aa27d80f5a8505ee0"><enum>(6)</enum><header display-inline="yes-display-inline">E-prescribing</header><text display-inline="yes-display-inline">The plan adopts electronic prescribing for
				enrollees, in accordance with section 1860D–4(e), to coordinate care.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDddd91efdcac1455eaa1f57783ce79451"><enum>(7)</enum><header display-inline="yes-display-inline">Demonstrate experience and
				expertise</header><text display-inline="yes-display-inline">The plan
				demonstrates, to the satisfaction of the Secretary, with input from the States,
				sufficient experience and expertise in serving low-income, publicly insured, or
				previously uninsured populations.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfeab8c52a9914befbb82e59760ca9b94"><enum>(8)</enum><header display-inline="yes-display-inline">Reducing health disparities</header><text display-inline="yes-display-inline">The plan has established and implemented
				systems and processes which have been approved by the Secretary to address and
				reduce health disparities based on race, ethnicity, gender, age, and
				socio-economic status.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe0247ac5b2474d0e8819f5c3c8382b5b"><enum>(9)</enum><header display-inline="yes-display-inline">Proficiency in care
				coordination</header><text display-inline="yes-display-inline">The plan
				demonstrates, to the satisfaction of the Secretary, proficiency in care
				coordination for the purpose of providing, or arranging for the provision of,
				services to assist individuals enrolled in the plan in obtaining access to
				other public and private benefits, including services to address non-medical
				and psycho-social
				needs.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1C5E3D7CE0BA461796DB3CAF5E3F437F"><enum>(c)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to plan year beginning on or after January 1,
			 2011.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id40E4DEF312F14272A1AA918E276D87F4" section-type="subsequent-section"><enum>104.</enum><header display-inline="yes-display-inline">Providing better care coordination for
			 low-income beneficiaries in Medicare part D</header>
				<subsection commented="no" display-inline="no-display-inline" id="ID847254ff93b3438f8a31d92ab70ab70e"><enum>(a)</enum><header display-inline="yes-display-inline">Continuous updating of eligibility and
			 enrollment data for dual eligible individuals</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idEA06BA3AFD4D4338B1D271C42D1441CE"><enum>(1)</enum><header display-inline="yes-display-inline">State requirement</header><text display-inline="yes-display-inline">Section 1935(a) of the Social Security Act
			 (42 U.S.C. 1396u–5(a)) is amended by adding at the end the following new
			 paragraph:</text>

				parts C and D, respectively, of title XVIII (including eligibility
				determinations under paragraph (2) and screening and enrollment under paragraph
				(3)) not less frequently than on a weekly
				basis.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA188F89C2F1D4C5C94ABB591F9E6818C"><enum>(2)</enum><header display-inline="yes-display-inline">Secretarial requirements</header><text display-inline="yes-display-inline">Section 1935(d) of the Social Security Act
			 (42 U.S.C. 1396u–5(d)) is amended by adding at the end the following new
			 paragraph:</text>

			 U.S.C. 1305w–28), as amended by section 103, is amended by adding at the end
			 the following new subsection:</text>

								<paragraph commented="no" display-inline="no-display-inline" id="idEF7323639D604F5D8173EA7605886E31"><enum>(1)</enum><header display-inline="yes-display-inline">Identification by the
				Secretary</header><text display-inline="yes-display-inline">Beginning on
				January 1, 2010, the Secretary shall clearly identify all dual eligible
				individuals that are enrolled in MA plans and prescription drug plans for the
				current plan year and reflect the low-income subsidy status of such individuals
				for each plan year in every data record file maintained in the Medicare
				electronic database and every such file that is used to enroll or adjudicate
				claims for such individuals.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id88A9783AEAC34BD487EFAA4F290DE89E"><enum>(2)</enum><header display-inline="yes-display-inline">Identification by MA plans and prescription
				drug plans</header><text display-inline="yes-display-inline">Beginning on
				January 1, 2010, each MA plan and prescription drug plan shall clearly identify
				all dual eligible individuals that are enrolled in the plan for the current
				plan year and reflect the low-income subsidy status of such individuals for the
				plan year in every data record file maintained by the plan that is used to
				enroll or adjudicate claims for such individuals under the plan.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0BAD0B2331474D0A8931CEDE78FCA9A2"><enum>(3)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">The Secretary shall establish regulations
				to carry out this subsection. Such regulations shall require that—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID8035fcc7abc24f12bdf7c40b8a75a1b3"><enum>(A)</enum><text display-inline="yes-display-inline">for each plan year and each dual eligible
				individual, the Secretary identify on the Medicare enrollment database dual
				eligible status that has been verified with a State or the District of
				Columbia;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID36dcc028def148a4b387ee529ed8c2bf"><enum>(B)</enum><text display-inline="yes-display-inline">for each plan year and each dual eligible
				individual, the Secretary identify on the Medicare enrollment database the
				low-income subsidy level of the individual; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe420b9a9651440acb6b1c43a4e85d5a1"><enum>(C)</enum><text display-inline="yes-display-inline">each data file that is necessary to ensure
				that such dual eligible status is transmitted to an MA plan or a prescription
				drug plan, at the time the Secretary certifies the enrollment of the dual
				eligible individual in the plan.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF36706862A7846EDBE6B10C36CF80505"><enum>(4)</enum><header display-inline="yes-display-inline">Definition of dual eligible

				are full-benefit dual eligible individuals (as defined in
				<external-xref legal-doc="act" parsable-cite="SSA/1935(c)(6)">section
				1935(c)(6)</external-xref>) and any formularies under the plans such
				individuals are enrolled in as the Secretary determines appropriate to carry
				out paragraph (2). Such information shall be submitted—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id5AC6DD2DBBD54D3A9ECB46B00994B63D"><enum>(A)</enum><text display-inline="yes-display-inline">on a rolling basis (as determined
				appropriate by the Secretary); and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD5A9A424B3114BA29D68A8A73737270A"><enum>(B)</enum><text display-inline="yes-display-inline">using a single, uniform reporting
				process.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id248A6151E7E34602A2EEC70FBCB24358"><enum>(2)</enum><header display-inline="yes-display-inline">Collection and sharing of
				data</header><text display-inline="yes-display-inline">The Secretary shall
				collect data on the drug utilization of full-benefit dual eligible individuals
				(as so defined) and on any formularies under the plans such individuals are
				enrolled in. The Secretary shall share such data with the States and the
				District of Columbia on as close to a real-time basis as
				possible.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id267A4B64E3FA44A18AF966FCE4819830"><enum>(2)</enum><header display-inline="yes-display-inline">Effective
			 Date</header><text display-inline="yes-display-inline">The amendment made by
			 paragraph (1) shall take effect on January 1, 2010.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID6c2ab3ad87b14d88a737ea74c0a8b9fd" section-type="subsequent-section"><enum>105.</enum><header display-inline="yes-display-inline">Improving transition of new dual eligible
			 individuals to Medicare prescription drug coverage and presumptive eligibility
			 for low-income subsidies</header>
				<subsection commented="no" display-inline="no-display-inline" id="ID4b9d7007e8894c18bd2b71897ef21a77"><enum>(a)</enum><header display-inline="yes-display-inline">Updating the point of sale facilitated
			 enrollment process</header>
					<paragraph commented="no" display-inline="no-display-inline" id="ID70244420ab344f26ab1bed918cfdf8f4"><enum>(1)</enum><header display-inline="yes-display-inline">Providing better initial protection for
			 dual eligible individuals</header><text display-inline="yes-display-inline">Beginning January 1, 2011, each contractor
			 under the Point of Sale Facilitated Enrollment process of the Department of
			 Health and Human Services shall enroll full-benefit dual eligible individuals
			 (as defined in section 1935(c)(6)) into a Medicare operated prescription drug
			 plan under section 1860D–11A of the Social Security Act, as added by section
			 102.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDff5a3a08a18649bebac85f984eb924ef"><enum>(2)</enum><header display-inline="yes-display-inline">Competitive Bidding of Point of Sale
			 Contract</header><text display-inline="yes-display-inline">The Secretary of
			 Health and Human Services shall establish procedures to ensure that each
			 contract entered into under such process on or after January 1, 2010, under the
			 Medicare program under title XVIII of the Social Security Act is rebid every 3
			 years through a competitive bidding process.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3a0afdb64dc34cfc94bb42260ed6968e"><enum>(3)</enum><header display-inline="yes-display-inline">Requiring Better Education about Point of
			 Sale facilitated enrollment process</header><text display-inline="yes-display-inline">Not later than January 1, 2010, the
			 Secretary of Health and Human Services shall have a comprehensive plan in place
			 for proactively educating beneficiaries under the Medicare prescription drug
			 program under part D of title XVIII of the Social Security Act, pharmacists,
			 skilled nursing facilities (as defined in section 1819(a) of such Act (42
			 U.S.C. 1395i–3(a))), nursing facilities (as defined in section 1919(a) of such
			 Act (42 U.S.C. 1396r(a))), counselors under State health insurance assistance
			 programs (SHIPs), and other advocacy organizations (including disability
			 organizations) about the Point of Sale Facilitated Enrollment process. Under
			 such plan—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idCCE47946D1084BF5A771DCC318B4C731"><enum>(A)</enum><text display-inline="yes-display-inline">information about the Point of Sale
			 Facilitated Enrollment process shall be included in all mailers to the entities
			 and individuals described in the preceding sentence prior to the annual,
			 coordinated election period described in section 1851(e)(3) of the Social
			 Security Act (42 U.S.C. 1395w–21(e)(3)); and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAF16CED2AEA542549F19427C8DE5872D"><enum>(B)</enum><text display-inline="yes-display-inline">a description of such process and other
			 relevant information shall be prominently displayed on the Medicare Internet
			 website throughout the year.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5a8c668bc6cb4497bf97f5ff0c99fa78"><enum>(4)</enum><header display-inline="yes-display-inline">Mandatory Use of Point of Sale facilitated
			 enrollment process</header><text display-inline="yes-display-inline">Section
			 1860D–4(b)(1) of the Social Security Act (42 U.S.C. 1395w–104(b)(1)) is amended
			 by adding at the end the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="id8E6E9626E9E54A6786DB697F7E80850F" style="OLC">
							<subparagraph commented="no" display-inline="no-display-inline" id="id34C8E2CF241D43148B84158C241E16BE"><enum>(F)</enum><header display-inline="yes-display-inline">Mandatory use of point of sale facilitated
				enrollment process</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
				beginning January 1, 2011, the terms and conditions under subparagraph (A)
				shall require participating pharmacies to use the Point of Sale Facilitated
				Enrollment process of the Department of Health and Human
				Services.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0eab0978d2e04d00a9a26a7058cccc9d"><enum>(b)</enum><header display-inline="yes-display-inline">Presumptive eligibility and mandatory
			 transition period for subsidy eligible individuals</header><text display-inline="yes-display-inline">Section
			 1860D–14 of the Social Security Act (42 U.S.C. 1395w–104) is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idD13F7781913E449784B440406A3D63EB"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (d) as
			 subsection (e); and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC959163F581F4E9B8935349FE2AA2FCD"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (c) the
			 following new subsection:</text>

								<paragraph commented="no" display-inline="no-display-inline" id="id38CC418FFB244745B75414268E2366B3"><enum>(1)</enum><header display-inline="yes-display-inline">Presumptive eligibility</header><text display-inline="yes-display-inline">An individual shall be presumed to be a
				subsidy eligible individual (as defined in section 1860D–14(a)(3)) if the
				individual presents at the pharmacy with—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="idFC4798726F614098B4BCDA7CF09EDFD1"><enum>(A)</enum><text display-inline="yes-display-inline">reliable evidence of—</text>
										<clause commented="no" display-inline="no-display-inline" id="id0704C4BA19D54EF585BE5C0FD0E55E80"><enum>(i)</enum><text display-inline="yes-display-inline">Medicaid enrollment, such as a Medicaid
				card, recent history of Medicaid billing in the pharmacy patient profile, a
				copy of a current Medicaid award letter, or confirmation from a Medicaid
				enrollment database; or</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id91B0A55E77564DA1B78FEEBB64774BC0"><enum>(ii)</enum><text display-inline="yes-display-inline">eligibility for an income-related subsidy
				under section 1860D–14, such as a low-income subsidy notice from the Secretary
				or the Commissioner of Social Security, or confirmation from a Social Security
				enrollment database; and</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDF9402E4FBB34E83AACF226BB46C9EBA"><enum>(B)</enum><text display-inline="yes-display-inline">reliable evidence of Medicare enrollment,
				such as a Medicare identification card, a Medicare enrollment approval letter,
				a Medicare Summary Notice, or confirmation from an official Medicare hotline or
				Medicare database.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID452d2aea1ca847abab3066d87f7cbcd9"><enum>(2)</enum><header display-inline="yes-display-inline">Making subsidy eligible individuals
				whole</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="id6CF7DD2CD2C1419C872D14414B370E6B"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In the case of a subsidy eligible
				individual (as so defined) who, between November 15, 2005, and December 31,
				2009, has wrongly been forced to pay higher co-payments, premiums, and
				deductibles than those applicable under this part and part C for such
				individual, the subsidy eligible individual shall be eligible for compensation
				under the program under this title.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD595C2263F11466FA27766ABCE15C528"><enum>(B)</enum><header display-inline="yes-display-inline">Establishment of process for refund of
				amount incorrectly paid</header><text display-inline="yes-display-inline">The
				Secretary shall establish a process under which—</text>
										<clause commented="no" display-inline="no-display-inline" id="idEDD43F1637A542189903C1ECA1B42704"><enum>(i)</enum><text display-inline="yes-display-inline">prescription drug plans and MA–PD plans are
				billed for copayments and deductibles inappropriately charged to subsidy
				eligible individuals during retroactive coverage periods;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="idE87676C9911B49118842EB372BCB0939"><enum>(ii)</enum><text display-inline="yes-display-inline">the amounts incorrectly paid by the subsidy
				eligible individual as a result of those inappropriate charges are refunded
				directly to the individual, either through a rebate on future payments of
				premiums under part B or through a direct payment to the individual; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="idE060C3A217A649C1ADE875331E993AAE"><enum>(iii)</enum><text display-inline="yes-display-inline">prescription drug plans and MA–PD plans are
				required to provide detailed accounting to the Secretary of the basis for any
				rebate or payment to a subsidy eligible individual under this subparagraph,
				including the applicable period of retroactive coverage for the subsidy
				eligible individual and whether the rebate or credit is with respect to an
				inappropriately charged copayment or deductible.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4B03BA4BF5D5497BA1A8C5727A930F1A"><enum>(C)</enum><header display-inline="yes-display-inline">Notification</header><text display-inline="yes-display-inline">Subsidy eligible individuals shall be
				notified of the requirements of this subsection in their 2010 plan year
				materials.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id438BD0B056BF49A7B7627BDE8BECDA38"><enum>(D)</enum><header display-inline="yes-display-inline">No effect on eligibility for other
				benefits</header><text display-inline="yes-display-inline">Amounts refunded to
				a subsidy eligible individual under this subsection shall be disregarded for
				purposes of determining or continuing the beneficiary's eligibility for receipt
				of benefits under any other Federal, State, or locally funded assistance
				program, including benefits paid under titles II, XVI, XVIII, XIX, or
				XXI.</text>
									</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID4557599808ee42faa011658a823560ba" section-type="subsequent-section"><enum>106.</enum><header display-inline="yes-display-inline">Required information on transition from
			 skilled nursing facilities and nursing facilities to part D plans</header>
				<subsection commented="no" display-inline="no-display-inline" id="idD4E6490AACBD4550B5B8E0FA12DD1DD6"><enum>(a)</enum><header display-inline="yes-display-inline">Skilled nursing facilities</header><text display-inline="yes-display-inline">Section 1819(b) of the Social Security Act
			 (42 U.S.C. 1395i–3(b)) is amended by adding at the end the following new
			 paragraph:</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="idF680844C201A4ED39105310E5B1D7DF6"><enum>(b)</enum><header display-inline="yes-display-inline">Nursing facilities</header><text display-inline="yes-display-inline">Section 1919(b) of the Social Security Act
			 (42 U.S.C. 1395i–3(b)) is amended by adding at the end the following new
			 paragraph:</text>

			 packaging</header>
				<subsection commented="no" display-inline="no-display-inline" id="id5BD9BC0C41EB4B7F97E3F419BAB16BB6"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1860D–4(b)(3) of the Social
			 Security Act (42 U.S.C. 1395w–104(b)(3)) is amended by adding at the end the
			 following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="id33F4A6368F6B4C4BB94267905600BA60" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="idE3F3FEA757AA4EC49593954B342322F6"><enum>(G)</enum><header display-inline="yes-display-inline">Streamlined pharmacy compliance packaging
				for dual eligible individuals</header><text display-inline="yes-display-inline">A PDP sponsor of a prescription drug plan
				shall streamline pharmacy compliance packaging for individuals enrolled in the
				plan who—</text>
							<clause commented="no" display-inline="no-display-inline" id="idB1F0D5489E12467EB336E3A706B685E8"><enum>(i)</enum><text display-inline="yes-display-inline">are entitled to medical assistance under a
				State plan under title XVIII; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id0015085D6532492D9869E5637E2E1311"><enum>(ii)</enum><text display-inline="yes-display-inline">reside in a nursing
				home.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id2BE23452EE7046B0921C103C143211F6"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 subsection (a) shall apply to drugs dispensed on or after January 1,
			 2010.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="H7861A1F74D4241C583A33203D39D7D02" section-type="subsequent-section"><enum>108.</enum><header display-inline="yes-display-inline">Lowering covered part D drug prices on
			 behalf of Medicare beneficiaries</header>
				<subsection commented="no" display-inline="no-display-inline" id="ID15da2840f02d4007a6aee2e8f36be20d"><enum>(a)</enum><header display-inline="yes-display-inline">Repeal of prohibition</header><text display-inline="yes-display-inline">Section 1860D–11 of the Social Security Act
			 (42 U.S.C. 1395w–111) is amended by striking subsection (i) and inserting the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id1B4FD6D48972492CAC5F798B9772B3F9" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="ID0bac99c192514f37a10f98ebc2bcc57e"><enum>(i)</enum><header display-inline="yes-display-inline">Lowering covered part D drug
				prices</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id9D9F608558724AE4B5D3AFA98D27D7FD"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall reduce the purchase
				cost of covered part D drugs by implementing 2 or more of the following
				strategies on an annual basis (beginning with 2011):</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id168E69D3BC1C447D9776D7D96CF27F18"><enum>(A)</enum><text display-inline="yes-display-inline">Negotiating directly with pharmaceutical
				manufacturers for additional discounts, rebates, and other price concessions
				that may be made available to Medicare operated prescription drug plans under
				section 1860D–11A for covered part D drugs.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC6A5797B96A24323B0CA9742C34B60AD"><enum>(B)</enum><text display-inline="yes-display-inline">Entering into rebate agreements with
				manufacturers to provide to the Secretary a rebate for any covered outpatient
				drug of a manufacturer dispensed during a rebate period specified in the
				agreement to a subsidy eligible individual described (or treated as described)
				in section 1860D–14(a)(1) for which payment was made by a PDP sponsor under
				part D of title XVIII or an MA organization under part C of such title for such
				period in an amount determined in the same manner as the rebate amount for such
				drug would have been determined under subsection (c) of section 1927 if the
				dispensing of the drug to such individual was paid for by a State and subject
				to a rebate agreement entered into under such section (and allocating any such
				rebates received among the prescription drug plans of such PDP sponsors and
				MA–PD plans offered by such organizations based on the enrollment of such
				individuals in such plans).</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id94EB6880C30B462EB09725E4D7D02649"><enum>(C)</enum><text display-inline="yes-display-inline">In consultation with the Director of the
				Agency for Healthcare Research and Quality, using data from relevant and
				unbiased studies on the comparative clinical effectiveness of covered part D
				drugs to—</text>
									<clause commented="no" display-inline="no-display-inline" id="idC76DE761E72B456E84BE785197A8DD29"><enum>(i)</enum><text display-inline="yes-display-inline">educate physicians and pharmacists;
				and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id0F0E1209350B4AD9B9822F1C3FC92D66"><enum>(ii)</enum><text display-inline="yes-display-inline">provide information to PDP sponsors of
				prescription drug plans and MA organizations offering MA–PD plans for use in
				making decisions regarding plan formularies.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3E7BDDA448BB4B9FB57120A2832B4BBC"><enum>(D)</enum><text display-inline="yes-display-inline">Instituting prescription drug prices
				negotiated under the Federal Supply Schedule of the General Services
				Administration for the reimbursement of covered part D drugs.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE8714C04929C4C4196EE3A0F1B9D5225"><enum>(2)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be
				construed as preventing the PDP sponsor of a prescription drug plan or an MA
				organization offering an MA–PD plan from obtaining a discount or reduction of
				the price for a covered part D drug below the price negotiated by the Secretary
				for a Medicare-operated plan under paragraph (1)(A).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD0E644A967A74F2CA545BA648F28B6BB"><enum>(3)</enum><header display-inline="yes-display-inline">Annual reports to congress</header><text display-inline="yes-display-inline">Not later than January 1, 2012, and
				annually thereafter, the Secretary shall submit to the Committee on Finance of
				the Senate and to the Committee on Ways and Means, the Committee on Energy and
				Commerce, and the Committee on Oversight and Government Reform of the House of
				Representatives a report on the strategies implemented by the Secretary under
				paragraph (1) to achieve lower prices on covered part D drugs for
				beneficiaries, including the prices of such covered part D drugs and any price
				concessions achieved by the Secretary as a result of such
				implementation.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="idEB15E75324B341B48C7449C9E0C215B9" section-type="subsequent-section"><enum>109.</enum><header display-inline="yes-display-inline">Correction of flaws in determination of
			 phased-down State contribution for Federal assumption of prescription drug
			 costs for dually eligible individuals</header><text display-inline="no-display-inline">Section 1935(c) of the Social Security Act
			 (42 U.S.C. 1396u–5(c)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idB32EC21CABC64FA1B64330DF063CEF9B"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), in the matter preceding
			 subparagraph (A), by striking <quote>Each</quote> and inserting <quote>Subject
			 to paragraph (7), each</quote>; and</text>

				promulgate regulations for modifying the factors used to determine the product
				under paragraph (1)(A) for each State and month that take into account the
				following with respect to each State:</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idF70509948185422F88BD06BC47330FF7"><enum>(A)</enum><text display-inline="yes-display-inline">Factoring into the determination of base
				year State Medicaid per capita expenditures for covered part D drugs for
				full-benefit dual eligible individuals under paragraph (3) all payments
				collected by a State under agreements under section 1927 for outpatient
				prescription drugs purchased in 2003 (not just for such payments that were
				collected by the State in 2003).</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID103647303d934ba793cba5fa8f66d2d7"><enum>(B)</enum><text display-inline="yes-display-inline">Pharmacy cost savings measures implemented
				by the State during the period that begins with 2003 and ends with 2006.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB518ACF008CF4CBFA1EFD50BFC7E8B80"><enum>(C)</enum><text display-inline="yes-display-inline">Substituting under paragraph (4) a
				State-specific growth factor in lieu of the national applicable growth factor
				for 2004 and succeeding years based on the annual percentage increase in the
				State's average per capita aggregate expenditures for covered outpatient
				drugs.</text>

				procedures for adjusting payments to States under section 1903(a) to take into
				account any overpayments or underpayments which the Secretary determines on the

										<subparagraph commented="no" display-inline="no-display-inline" id="id0FA7B178542A4834957BDEDAAA774FF5"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall develop and maintain a
				plan complaint system, (in this subsection referred to as the
				<quote>system</quote>) to—</text>
											<clause commented="no" display-inline="no-display-inline" id="idCE4D5BD7701E4B329FB76089807D060F"><enum>(i)</enum><text display-inline="yes-display-inline">collect and maintain information on plan
				complaints;</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="idB396CBA6B1EF4DA395063AC6924F1926"><enum>(ii)</enum><text display-inline="yes-display-inline">track plan complaints from the date the
				complaint is logged into the system through the date the complaint is resolved;
				and</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="id5E52499488474E8E893660ABD2644673"><enum>(iii)</enum><text display-inline="yes-display-inline">otherwise improve the process for reporting
				plan complaints.</text>
											</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id054EFCD60A2549A8938D4B4EA8BEA3F8"><enum>(B)</enum><header display-inline="yes-display-inline">Timeframe</header><text display-inline="yes-display-inline">The Secretary shall have the system in
				place by not later than the date that is 6 months after the date of enactment
				of this subsection.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDB73D54067C443EF9F480662B53A7E48"><enum>(C)</enum><header display-inline="yes-display-inline">Plan complaint defined</header><text display-inline="yes-display-inline">In this subsection, the term <quote>plan
				complaint</quote> means a complaint that is received (including by telephone,
				letter, e-mail, or any other means) by the Secretary (including by a regional
				office, the Medicare Beneficiary Ombudsman, a subcontractor, a carrier, a
				fiscal intermediary, and a Medicare administrative contractor) from a Medicare
				Advantage eligible individual or a part D eligible individual (or an individual
				representing such an individual) regarding a Medicare Advantage organization, a
				Medicare Advantage plan, a prescription drug plan sponsor, or a prescription
				drug plan, including, but not limited to, complaints relating to marketing,
				enrollment, covered drugs, premiums and cost-sharing, and plan customer
				service, grievances and appeals, participating providers. Such term also
				includes plan complaints that are received by the Secretary directly from the
				organization offering the plan relating to complaints by such
				individuals.</text>
										</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFB38B332F17F44C0AA5464F4C5CC43F5"><enum>(2)</enum><header display-inline="yes-display-inline">Process criteria</header><text display-inline="yes-display-inline">In developing the system, the Secretary
				shall establish a process for reporting plan complaints. Such process shall
				meet the following criteria:</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="IDec7ef4fa872942559e37aff536a41caa"><enum>(A)</enum><header display-inline="yes-display-inline">Accessible</header><text display-inline="yes-display-inline">The process is widely known and easy to
				use.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID16ec249c4fda40e3921b0601c6dfb1b2"><enum>(B)</enum><header display-inline="yes-display-inline">Investigative capacity</header><text display-inline="yes-display-inline">The process involves the appropriate
				experts, resources, and methods to assess complaints and determine whether they
				reflect an underlying pattern.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc99fa88653b34179b05b5335c82c7c56"><enum>(C)</enum><header display-inline="yes-display-inline">Intervention and
				follow-through</header><text display-inline="yes-display-inline">The process
				triggers appropriate interventions and monitoring based on substantiated
				complaints.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID95effb57767747499d945b49afd23e5d"><enum>(D)</enum><header display-inline="yes-display-inline">Quality improvement
				orientation</header><text display-inline="yes-display-inline">The process
				guides quality improvement.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe19ea82bd5cc4b22a5a48c12c3d55400"><enum>(E)</enum><header display-inline="yes-display-inline">Responsiveness</header><text display-inline="yes-display-inline">The process routinely provides consistent,
				clear, and substantive responses to complaints.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDeb939ef471d14872a934160b6b8c1ae0"><enum>(F)</enum><header display-inline="yes-display-inline">Timelines</header><text display-inline="yes-display-inline">Each process step is completed within a
				reasonable, established timeframe, and mechanisms exist to deal quickly with
				complaints of an emergency nature requiring immediate attention.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4f2ded362cad4f7ba5fd0bd2716a3768"><enum>(G)</enum><header display-inline="yes-display-inline">Objective</header><text display-inline="yes-display-inline">The process is unbiased, balancing the
				rights of each party.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf2367e6b38c545e7b7d5addb6197d836"><enum>(H)</enum><header display-inline="yes-display-inline">Public Accountability</header><text display-inline="yes-display-inline">The process makes complaint information
				available to the public.</text>
										</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4D82ECF86B3A4B69919D80484E7396CD"><enum>(3)</enum><header display-inline="yes-display-inline">Standard data reporting
				requirements</header>
										<subparagraph commented="no" display-inline="no-display-inline" id="idAA2A910FF1A840A786DC8ECA6B2F8AB7"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall establish standard data
				reporting requirements for reporting plan complaints under the system.</text>

				form</header><text display-inline="yes-display-inline">The Secretary shall
				develop a model electronic complaint form to be used for reporting plan

				front page of the Medicare.gov Internet website and on the Internet website of
				the Medicare Beneficiary Ombudsman.</text>
										</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id53F51F5ED39D42A99737F9CC438A04DC"><enum>(4)</enum><header display-inline="yes-display-inline">All complaints required to be logged into
				the system</header><text display-inline="yes-display-inline">Every plan
				complaint shall be logged into the system.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id818E7ED47DED402AA6119C7B65F61475"><enum>(5)</enum><header display-inline="yes-display-inline">Casework notations</header><text display-inline="yes-display-inline">The system shall provide for the inclusion
				of any casework notations throughout the complaint process on the record of a
				plan complaint.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFCF0BBA68B4D4FA3956F40CDBA7E8A80"><enum>(6)</enum><header display-inline="yes-display-inline">Medicare Beneficiary
				Ombudsman</header><text display-inline="yes-display-inline">The Secretary shall
				carry out this subsection acting through the Medicare Beneficiary
				Ombudsman.</text>
									</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDe2033434351e4470b2242acf86ec18f5"><enum>(b)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">There are authorized to be appropriated
			 such sums as may be necessary for the costs of carrying out section 1808(d) of
			 the Social Security Act, as added by subsection (a).</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID43dc74e9c1264311978bf93095711c8c"><enum>(c)</enum><header display-inline="yes-display-inline">Reports</header>
						<paragraph commented="no" display-inline="no-display-inline" id="id2AC786A141004192B4AFAC70439C7A94"><enum>(1)</enum><header display-inline="yes-display-inline">Secretary</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="id603BE819FC9C4A2F8222F4DBCEC9964A"><enum>(A)</enum><header display-inline="yes-display-inline">Ongoing study</header><text display-inline="yes-display-inline">The Medicare Beneficiary Ombudsman (under
			 subsection (c) of section 1808) of the Social Security Act (42 U.S.C. 1395b–9)
			 shall conduct an ongoing study of the plan complaint system established under
			 subsection (d) of such section (as added by subsection (a)), in this subsection
			 referred to as the <quote>system</quote>. Such study shall include an analysis
			 of—</text>
								<clause commented="no" display-inline="no-display-inline" id="id06799283408A442B9ADCA3ECD6400C14"><enum>(i)</enum><text display-inline="yes-display-inline">the numbers and types of complaints
			 reported under the system;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idEB6E7A28F3924D6A9F7603295FBD7880"><enum>(ii)</enum><text display-inline="yes-display-inline">geographic variations in such
			 complaints;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id356B94706E2C4D4093708868C63D1FD7"><enum>(iii)</enum><text display-inline="yes-display-inline">the timeliness of agency or plan responses
			 to such complaints; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id3E43F60D16284652951C49CA323FA78C"><enum>(iv)</enum><text display-inline="yes-display-inline">the resolution of such complaints.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id09E14C36CE3D41E7B7172B06E625E0B9"><enum>(B)</enum><header display-inline="yes-display-inline">Quarterly reports</header><text display-inline="yes-display-inline">Not later than 6 months after the
			 implementation of the system, and every 3 months thereafter, the Secretary of
			 Health and Human Services shall submit to Congress a report on the study
			 conducted under subparagraph (A), together with recommendations for such
			 legislation and administrative actions as the Secretary determines
			 appropriate.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID34d1c7857c2d4bea89aaf9d7377762cb"><enum>(2)</enum><header display-inline="yes-display-inline">Inspector General</header><text display-inline="yes-display-inline">The Inspector General of the Department of
			 Health and Human Services shall conduct an evaluation of the system. Not later
			 than 1 year after the implementation of the system, the Inspector General shall
			 submit to Congress a report on such evaluation, together with recommendations
			 for such legislation and administrative actions as the Inspector General
			 determines appropriate.</text>
						</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDa4c38bea4fc048ceaf7e64a7fee1dc46" section-type="subsequent-section"><enum>213.</enum><header display-inline="yes-display-inline">Uniform exceptions and appeals
			 process</header>
					<subsection commented="no" display-inline="no-display-inline" id="id3CDD89A925AA4CF1ADB5FE0C2D563BE5"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1860D–4(b)(3) of the Social
			 Security Act (42 U.S.C. 1395w–104(b)(3)), as amended by section 107, is amended
			 by adding at the end the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="id85BE94E8115F456A9573735D08C0B348" style="OLC">
							<subparagraph commented="no" display-inline="no-display-inline" id="id4F654D8FDE204FD08576C83981280B5F"><enum>(G)</enum><header display-inline="yes-display-inline">Use of single, uniform exceptions and
				appeals process</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				part, a PDP sponsor of a prescription drug plan or an MA organization offering
				an MA–PD plan shall—</text>
								<clause commented="no" display-inline="no-display-inline" id="id90EBC958B7334961B9F2A4E14E2BD7EC"><enum>(i)</enum><text display-inline="yes-display-inline">use a single, uniform exceptions and
				appeals process with respect to the determination of prescription drug coverage
				for an enrollee under the plan; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id2115F8FD2ECF44D09546701DD7DEF215"><enum>(ii)</enum><text display-inline="yes-display-inline">provide instant access to such process by
				enrollees through a toll-free telephone number and an Internet
				website.</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id0EEA2731B49B49CD83455ACDB03AC490"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 subsection (a) shall apply to exceptions and appeals on or after January 1,
			 2011.</text>
					</subsection></section><section commented="no" display-inline="no-display-inline" id="idD1A25A614C5D49DDB89F770A22A9D277" section-type="subsequent-section"><enum>214.</enum><header display-inline="yes-display-inline">Prohibition on conditioning Medicaid
			 eligibility for individuals enrolled in certain creditable prescription drug
			 coverage on enrollment in the Medicare part D drug program</header>
					<subsection commented="no" display-inline="no-display-inline" id="id7A0164413BB847FDB53B19B4A74A2559"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1935 of the Social Security Act (42
			 U.S.C. 1396v) is amended by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id827A892BBC1445F5ACDA63F4665330F5" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="id4442DE9D68F146E0968B4E1550ADB7B0"><enum>(f)</enum><header display-inline="yes-display-inline">Prohibition on conditioning eligibility for
				medical assistance for individuals enrolled in certain creditable prescription
				drug coverage on enrollment in Medicare prescription drug benefit</header>
								<paragraph commented="no" display-inline="no-display-inline" id="idE921DBB829EB44B891E5E872754A4E1D"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A State shall not condition eligibility for
				medical assistance under the State plan for a part D eligible individual (as
				defined in section 1860D–1(a)(3)(A)) who is enrolled in creditable prescription
				drug coverage described in any of subparagraphs (C) through (H) of section
				1860D–13(b)(4) on the individual's enrollment in a prescription drug plan under
				part D of title XVIII or an MA–PD plan under part C of such title.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id62E0F6741A6542F1BC5C40829DA1BD08"><enum>(2)</enum><header display-inline="yes-display-inline">Coordination of benefits with part D for
				other individuals</header><text display-inline="yes-display-inline">Nothing in
				this subsection shall be construed as prohibiting a State from coordinating
				medical assistance under the State plan with benefits under part D of title
				XVIII for individuals not described in paragraph
				(1).</text>

			 report on part D formularies' inclusion of drugs commonly used by dual
			 eligibles</header>
					<subsection commented="no" display-inline="no-display-inline" id="ID7EAAA2D9A1AD49D2B81CEF3856CEA766"><enum>(a)</enum><header display-inline="yes-display-inline">Ongoing study</header><text display-inline="yes-display-inline">The Inspector General of the Department of
			 Health and Human Services shall conduct an ongoing study of the extent to which
			 formularies used by prescription drug plans and MA–PD plans under part D
			 include drugs commonly used by full-benefit dual eligible individuals (as
			 defined in section 1935(c)(6) of the Social Security Act (42 U.S.C.
			 1396u–5(c)(6))).</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID0736846830384B9E8677E224D9E3C2F6"><enum>(b)</enum><header display-inline="yes-display-inline">Annual
			 reports</header><text display-inline="yes-display-inline">Not later than July 1
			 of each year (beginning with 2010), the Inspector General shall submit to
			 Congress a report on the study conducted under paragraph (1), together with
			 such recommendations as the Inspector General determines appropriate.</text>
					</subsection></section><section commented="no" display-inline="no-display-inline" id="id535B2155527441AEBFCCA4E767CB22DE" section-type="subsequent-section"><enum>216.</enum><header display-inline="yes-display-inline">HHS ongoing study and annual reports on
			 coverage for dual eligibles</header>
					<subsection commented="no" display-inline="no-display-inline" id="idB019B8F45E0C46AE99DCF3C41414306C"><enum>(a)</enum><header display-inline="yes-display-inline">Ongoing study</header>
						<paragraph commented="no" display-inline="no-display-inline" id="id0BCC0880A3AB41909A1E0D49AC85C565"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services
			 (in this section referred to as the <quote>Secretary</quote>) shall conduct an
			 ongoing study to track—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idF6210B40611A4212ADF179636BCFB18F"><enum>(A)</enum><text display-inline="yes-display-inline">how many of the new full benefit dual
			 eligible individuals (as defined in section 1935(c)(6) of the Social Security
			 Act (42 U.S.C. 1395u–5(c)(6))) enroll in a plan under part D of title XVIII of
			 such Act and receive retroactive prescription drug coverage under the plan;
			 and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4C42810CC92F4E2987937A0C6F678DB3"><enum>(B)</enum><text display-inline="yes-display-inline">if such retroactive coverage is provided to
			 such individuals—</text>
								<clause commented="no" display-inline="no-display-inline" id="id444B18CD7D544DC48C76B726D9FCCA4A"><enum>(i)</enum><text display-inline="yes-display-inline">the number of months of coverage provided;
			 and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idD80E4ED1547B49D4BA925A6221654117"><enum>(ii)</enum><text display-inline="yes-display-inline">the amount of reimbursements to individuals
			 and to individuals that made payments for prescription drugs on their behalf
			 for costs incurred during retroactive coverage periods.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC48937596F04418793C45A5D5D1540B0"><enum>(2)</enum><header display-inline="yes-display-inline">Data to use</header><text display-inline="yes-display-inline">In conducting the study with respect to the
			 requirements under paragraph (1)(B), the Secretary shall examine prescription
			 drug utilization data reported by Medicare part D plans.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA129752FECEA4A3785EA2E0EB2795480"><enum>(b)</enum><header display-inline="yes-display-inline">Annual reports on ongoing
			 study</header><text display-inline="yes-display-inline">Not later than March 1
			 of each year (beginning with 2010), the Secretary shall submit a report to
			 Congress containing the results of the study conducted under subsection (a),
			 together with recommendations for such legislation and administrative action as
			 the Secretary determines appropriate.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id5DADF3B6B0CD4758B9CF6CD0A002B612"><enum>(c)</enum><header display-inline="yes-display-inline">Annual reports on spending and
			 outcomes</header><text display-inline="yes-display-inline">Not later than
			 January 1 of each year (beginning with 2013), the Secretary shall collect data
			 and submit a report to Congress that includes the following information:</text>
						<paragraph commented="no" display-inline="no-display-inline" id="idC57DB2EB8CEC46718574503A8CD11F9D"><enum>(1)</enum><text display-inline="yes-display-inline">Annual total expenditures (disaggregated by
			 Federal and State expenditures) for dually eligible beneficiaries under title
			 XVIII and under State plans and waivers under title XIX.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFFD5500CFAF94692A7BE00160A88A7A1"><enum>(2)</enum><text display-inline="yes-display-inline">An analysis of health outcomes for dually
			 eligible beneficiaries, disaggregated by subtypes of beneficiaries (as
			 determined by the Secretary).</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0A3308A8448F43E086D82D94BC5ED075"><enum>(3)</enum><text display-inline="yes-display-inline">An analysis of the extent to which dually
			 eligible beneficiaries are able to access benefits under title XVIII and under
			 State plans and waivers under title XIX.</text>
						</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id7B7551F4FCAB4C419801569A28FD2FE3" section-type="subsequent-section"><enum>217.</enum><header display-inline="yes-display-inline">Authority to obtain
			 information</header><text display-inline="no-display-inline">Title XVIII of the
			 Social Security Act (42 U.S.C. 1395 et seq.) is amended by adding at the end
			 the following new section:</text>

						<section commented="no" display-inline="no-display-inline" id="id004A8196A9E242EF835CC9656BFAAA62" section-type="subsequent-section"><enum>1899.</enum><header>Authority of the Comptroller General to obtain
		  information</header><text display-inline="yes-display-inline">No provision in this Act in effect on the
				date of enactment of this section or enacted after such date shall be construed
				to limit, amend, or supersede the authority of the Comptroller General of the
				United States to obtain agency records pursuant to section 716 of title 31,
				United States Code, including any information obtained by, or disclosed to, the
				Secretary under part C or D of this title, except to the extent that such
				provision expressly and specifically refers to this section and provides for
				such limitation, amendment, or
				supersession.</text>
