		<official-title display="yes">To provide for the release of water from
		  the marketable yield pool of water stored in the Ruedi Reservoir for the
		  benefit of endangered fish habitat in the Colorado River, and for other
		  purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="id3B6C83B3D36747A1BA91FBF3FC47D4A5" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Endangered fish recovery implementation
			 programs</header>
			<subsection commented="no" display-inline="no-display-inline" id="id9A69D2E4A53640A2AA770AC4692F934D"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">Section 2 of Public Law 106–392 (114 Stat.
			 1602) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id8CC43048449540C79FF5E582E7B25F4C" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="idFDC54147AD8F44908D384F0C0236226C"><enum>(11)</enum><header display-inline="yes-display-inline">Marketable yield pool</header><text display-inline="yes-display-inline">The term <term>marketable yield pool</term>
				means the portion of the regulatory capacity that, as of the date of enactment
				of this paragraph, is dedicated to marketing purposes.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA692B356685A4BF181E0FF2FD58F8A03"><enum>(12)</enum><header display-inline="yes-display-inline">Regulatory capacity</header><text display-inline="yes-display-inline">The term <term>regulatory capacity</term>
				has the meaning given the term in the publication entitled <quote>Operating
				Principles, Fryingpan-Arkansas Project, Adopted by the State of Colorado, April
				30, 1959 (as amended December 30, 1959, and December 9, 1960)</quote>, as
				printed as House Document No. 130 in accordance with House Resolution 91, 87th
				Congress, agreed to March 15, 1961.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC73AD00121024322B7EC18EC43AFF962"><enum>(13)</enum><header display-inline="yes-display-inline">Ruedi Reservoir</header><text display-inline="yes-display-inline">The term <term>Ruedi Reservoir</term> means
				the component of the Fryingpan-Arkansas Project of the Bureau of Land
				Management that is located—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idB6C159012E4445E5BB625ED933222665"><enum>(A)</enum><text display-inline="yes-display-inline">on the Fryingpan River; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC8BDE1629524443A9A46A03A67C1BCF9"><enum>(B)</enum><text display-inline="yes-display-inline">in western
				Colorado.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idC385B885C86B4432AB357A5C397C6841"><enum>(b)</enum><header display-inline="yes-display-inline">Authorization To fund recovery
			 programs</header><text display-inline="yes-display-inline">Section 3 of Public
			 Law 106–392 (114 Stat. 1603) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id2854D78A48F34CA180EA4E2ED5BA97B9"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (e) through
			 (h) as subsections (f) through (i), respectively; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCCBD1D144E344C01A563B0D68AFE149B"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (d) the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id02C3702885134F529643B14BFE25F5E4" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="idA25176D862594E19BECAFADCCFE7CD23"><enum>(e)</enum><header display-inline="yes-display-inline">Allocation of Ruedi Reservoir marketable
				yield pool</header>
							<paragraph commented="no" display-inline="no-display-inline" id="idEC50E82DE9754747BE053D98021631C0"><enum>(1)</enum><header display-inline="yes-display-inline">Release of water</header><text display-inline="yes-display-inline">For fiscal year 2013, and each fiscal year
				thereafter, at the request of the Director of the United States Fish and
				Wildlife Service (referred to in this subsection as the <term>Director</term>),
				5,412.5 acre-feet of water shall be released from the marketable yield pool of
				water stored in the Ruedi Reservoir for the benefit of endangered fish habitat
				in the Colorado River.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9FA1B597E42247A5B4C03AAB68B5C8E4"><enum>(2)</enum><header display-inline="yes-display-inline">Timing of release</header><text display-inline="yes-display-inline">To the maximum extent practicable, and
				unless otherwise requested by the Director, the release of water under
				paragraph (1) shall occur during the late summer months to enhance low water
				flows in areas that comprise the endangered fish habitat in the Colorado
				River.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCB89AA6F105648B7820FD3CA99016B14"><enum>(3)</enum><header display-inline="yes-display-inline">No requirement for contract or other
				agreement</header><text display-inline="yes-display-inline">The release of
				water under paragraph (1) may be carried out without the formation or execution
				of any contract or other agreement.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC0EA56B688BD4DBBAADDBC96E224FF04"><enum>(4)</enum><header display-inline="yes-display-inline">Reimbursement</header><text display-inline="yes-display-inline">The capital, operational, maintenance, and
				replacement costs that arise from the release of water under paragraph (1)
				shall not be reimbursable.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB82731FA7B07471ABBDAAD49BEFD28E0"><enum>(5)</enum><header display-inline="yes-display-inline">Effect</header><text display-inline="yes-display-inline">The release of water under paragraph (1)
				shall satisfy 50 percent of the obligation of certain water users to provide
				10,825 acre-feet of water, as described in the document—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idF3C9A571107840C4A17B4BE5A5ED5FFF"><enum>(A)</enum><text display-inline="yes-display-inline">entitled <quote>Final Programmatic
				Biological Opinion for Bureau of Reclamation's Operations and Depletions, Other
				Depletions, and Funding and Implementation of Recovery Program Actions in the
				Upper Colorado River above the Confluence with the Gunnison River</quote>;
				and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6C4A8289A1414C279128D02E412559DE"><enum>(B)</enum><text display-inline="yes-display-inline">published by the Director on December 20,
				1999.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id91F32C84718940248560DCBDF2D5C6AB"><enum>(6)</enum><header display-inline="yes-display-inline">Effective
				date</header><text display-inline="yes-display-inline">This subsection shall
				take effect on the date on which the Secretary complies with the
				<act-name parsable-cite="NEPA69">National Environmental Policy Act of
				1969</act-name> (42 U.S.C. 4321 et seq.) regarding the release of water under
				paragraph
				(1).</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
