		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Enhancing Flexibility for Effective
			 Schools Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="IDedcf2b9005f846c088482c3cd756c199" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">References</header><text display-inline="no-display-inline">Except as otherwise specifically provided,
			 whenever in this Act an amendment or repeal is expressed in terms of an
			 amendment to, or a repeal of, a section or other provision, the reference shall
			 be considered to be made to a section or other provision of the Elementary and
			 Secondary Education Act of 1965 (20 U.S.C. 6301 et seq.).</text>
		</section><section commented="no" display-inline="no-display-inline" id="ID6644ae28171643d2b1607a7e983249da" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Adequate yearly progress</header>
			<subsection commented="no" display-inline="no-display-inline" id="id36767901A65C46CC81A04A3C6D3C3170"><enum>(a)</enum><header display-inline="yes-display-inline">Accountability</header><text display-inline="yes-display-inline">Section 1111(b)(2) (20 U.S.C. 6311(b)(2))
			 is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID34a593cb67a94f9baa0c4ac53f81e375"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (I)(ii)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id4A8E72D220194642A01FCF0C923EC70A"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>95 percent</quote> the
			 first place the term appears and inserting <quote>90 percent (which percentage
			 shall be based on criteria established by the State in the State plan)</quote>;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa7726a17ce964235843d7e827da953d1"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>95 percent</quote> the
			 second place the term appears and inserting <quote>90 percent</quote>;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2d8912cedfbb4aeaac7d6c184437ef13"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (K) as
			 subparagraph (N); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc17bb30738fd46ef995c2110fab00deb"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting, after subparagraph (J), the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="idE374649E567E479BACDD098276B79511" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="ID5c63694131864909a208a7e96b650973"><enum>(K)</enum><header display-inline="yes-display-inline">Single count of students</header><text display-inline="yes-display-inline">In meeting the definition of adequate
				yearly progress under subparagraph (C), a student who may be counted in 2 or
				more groups described in subparagraph (C)(v)(II), may be counted as an equal
				fraction of 1 for each such group.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID81765602ccf84fba88262de30f950db6"><enum>(L)</enum><header display-inline="yes-display-inline">Students with disabilities requiring
				alternate assessments</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				part, a State may implement the amendments made to part 200 of title 34, Code
				of Federal Regulations on December 9, 2003 (68 Fed. Reg. 68698) (related to
				achievement of students with significant cognitive disabilities), as if such
				amendments—</text>
							<clause commented="no" display-inline="no-display-inline" id="ID41c5b6b987ef47afb81358680c9b11cc"><enum>(i)</enum><text display-inline="yes-display-inline">permitted the proficient or advanced scores
				on alternate assessments of not more than 3.0 percent of all tested students to
				be considered as proficient or advanced, respectively, for the purposes of
				determining adequate yearly progress, except that—</text>
								<subclause commented="no" display-inline="no-display-inline" id="ID3d07c45edfc44ecfae50d71b331ed533"><enum>(I)</enum><text display-inline="yes-display-inline">any assessment given to any such so
				considered student for the purposes of determining such adequate yearly
				progress shall be required by the individualized education program of such so
				considered student;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="ID520d39a5cab54c70807c2fad8ed1a1f7"><enum>(II)</enum><text display-inline="yes-display-inline">the individualized education program shall
				reflect the need for any such alternate assessment based on the evaluation of
				such so considered student and the services provided such so considered student
				under section 614 of the Individuals with Disabilities Education Act;
				and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="ID812644c6901a47b1af76313f1f0a1b3e"><enum>(III)</enum><text display-inline="yes-display-inline">the individualized education program shall
				include written consent from the parent of such so considered student prior to
				such alternate assessment being administered;</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID209ade6fe8d944daa052c0962a982956"><enum>(ii)</enum><text display-inline="yes-display-inline">used the term <quote>students requiring
				alternate assessments</quote> in lieu of the term <quote>students with the most
				significant cognitive disabilities</quote>; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID0141d5a346c54142bf1089508364bd09"><enum>(iii)</enum><text display-inline="yes-display-inline">permitted the eligibility, of such so
				considered students to have the students' scores of proficient or advanced on
				alternate assessments counted as proficient or advanced for purposes of
				determining adequate yearly progress, to be determined by the State educational
				agency, except that such eligibility shall, at a minimum, include—</text>
								<subclause commented="no" display-inline="no-display-inline" id="IDac9bc4c14ca7490688f4b31aa566037b"><enum>(I)</enum><text display-inline="yes-display-inline">such so considered students who are
				receiving services pursuant to a plan required under section 504 of the
				Rehabilitation Act of 1973;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="ID9f92ff19dcce49e38ad819812a9f40e9"><enum>(II)</enum><text display-inline="yes-display-inline">the students described in subclause (I) who
				are assessed at a grade level below the grade level in which the students are
				enrolled (out of level assessments); and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="ID7ba6291dadf34f54942b949cdde7de4d"><enum>(III)</enum><text display-inline="yes-display-inline">the students described in subclause (I) who
				are considered students with the most significant cognitive disabilities, as
				defined by the State educational agency, on the day before the date of
				enactment of the <short-title>Enhancing Flexibility for
				Effective Schools Act</short-title>.</text>
								</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID093194a484924355bd0fff24c1cdffb3"><enum>(M)</enum><header display-inline="yes-display-inline">Other measures of adequate yearly
				progress</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of this paragraph, a State may establish in the State plan an
				alternative definition of adequate yearly progress, subject to approval by the
				Secretary under subsection (e). Such alternative definition may—</text>
							<clause commented="no" display-inline="no-display-inline" id="ID9fc0dac0377541b48ebca836b395121e"><enum>(i)</enum><text display-inline="yes-display-inline">include measures of student achievement
				over a period of time (such as a growth model or value added accountability
				system) or the progress of some or all of the groups of students described in
				subparagraph (C)(v) to the next higher level of achievement described in
				subparagraph (II) or (III) of paragraph (1)(D)(ii) as a factor in determining
				whether a school, local educational agency, or State has made adequate yearly
				progress, as described in this paragraph; or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID8e81b3f6cfa444989ca83513a65b3dd1"><enum>(ii)</enum><text display-inline="yes-display-inline">use the measures of achievement or the
				progress of groups described in clause (i) as the sole basis for determining
				whether the State, or a local educational agency or school within the State,
				has made adequate yearly progress, if—</text>
								<subclause commented="no" display-inline="no-display-inline" id="IDb0c9a6af20fa452ebc597dcba2404864"><enum>(I)</enum><text display-inline="yes-display-inline">the primary goal of such definition is that
				all students in each group described in subparagraph (C)(v) meet or exceed the
				proficient level of academic achievement, established by the State, not later
				than 12 years after the end of the 2001–2002 school year; and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="ID794e1017345a44f08409349b419f997e"><enum>(II)</enum><text display-inline="yes-display-inline">such definition includes intermediate
				goals, as required under subparagraph
				(H).</text>
								</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDffd057f334534eb8a673fd085953fbf0"><enum>(b)</enum><header display-inline="yes-display-inline">Assessments</header><text display-inline="yes-display-inline">Section 1111(b)(3)(C) (20 U.S.C.
			 6311(b)(3)(C)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id6F3089472DCF4DE79AEAA3A49BDBF655"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (ix), by striking subclause (III)
			 and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id471130253775493E985B45422280FA0B" style="OLC">
						<subclause commented="no" display-inline="no-display-inline" id="ID1cd0297bb21741069c55202afceaee2d"><enum>(III)</enum><text display-inline="yes-display-inline">the inclusion of limited English proficient
				students, who—</text>
							<item commented="no" display-inline="no-display-inline" id="idF4C308280CE242D8BAF068981A23EF30"><enum>(aa)</enum><text display-inline="yes-display-inline">may, consistent with paragraph (2)(M), be
				assessed, as determined by the local educational agency, through the use of an
				assessment which requires achievement of specific gains for up to 3 school
				years from the first year the student is assessed for the purposes of this
				subsection;</text>
							</item><item commented="no" display-inline="no-display-inline" id="ID1bc1a466dc14459a9079d342a537695a"><enum>(bb)</enum><text display-inline="yes-display-inline">may, at the option of the State educational
				agency, be assessed in the first year the student attends school in the United
				States (not including the Commonwealth of Puerto Rico); and</text>
							</item><item commented="no" display-inline="no-display-inline" id="ID533c47b492784173a3a8101a72ccafbe"><enum>(cc)</enum><text display-inline="yes-display-inline">shall not be included in any calculation of
				an adequate yearly progress determination when the student is in the first year
				of attendance at a school in the United States (not including the Commonwealth
				of Puerto Rico).</text>
							</item></subclause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3E9CCEAD0DA449209AE8DFD09916116A"><enum>(2)</enum><text display-inline="yes-display-inline">in clause (x), by inserting <quote>of
			 clause (ix)</quote> after <quote>subclause (III)</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA9BA08BDD1004379AAE9BBF87678EFD1"><enum>(c)</enum><header display-inline="yes-display-inline">Regulations affecting limited English
			 proficient children and children with disabilities</header><text display-inline="yes-display-inline">Section
			 1111 (20 U.S.C. 6311) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id0B381F0D1A8B4032A4ED74D6F6C890B9" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="ID2223d57a15884b9788bb2ce19dfbb995"><enum>(n)</enum><header display-inline="yes-display-inline">Codification of regulations affecting
				limited English proficient children</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				part, this part shall be implemented consistent with the amendments proposed to
				part 200 of title 34 of the Code of Federal Regulations on June 24, 2004 (69
				Fed. Reg. 35462) (relating to the assessment of limited English proficient
				children and the inclusion of limited English proficient children in
				subgroups), as if such amendments permitted students who were previously
				identified as limited English proficient to be included in the group described
				in subsection (b)(2)(C)(v)(II)(dd) for 3 additional years, as determined by a
				local educational agency (based on the individual needs of a child) for the
				purposes of determining adequate yearly
				progress.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID33434e8f7fea4bb5a215bd76cbecd36b" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">School improvement and public school
			 choice</header><text display-inline="no-display-inline">Section 1116(b) (20
			 U.S.C. 6316(b)) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="IDc9288285d75a499c8abeec8be5a49bf1"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="ID30ce3796d7e240318fcb7e97bca0ae4b"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by inserting
			 <quote>(in the same subject for the same group of students, as described in
			 section 1111(b)(2)(C)(v))</quote> after <quote>2 consecutive
			 years</quote>;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID82f56e8426d64b99b73b4ffd665f8c17"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (E)(i)—</text>
					<clause commented="no" display-inline="no-display-inline" id="id75CCE0B583B0483F84327B2D5B54BE84"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>In the case</quote> and
			 inserting <quote>Except as provided in subparagraph (G), in the case</quote>;
			 and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="ID792e04b0378440a4926ff4409242051a"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>all students enrolled in
			 the school with the option to transfer to another public school</quote> and
			 inserting <quote>students who failed to meet the proficient level of
			 achievement on the assessments described in section 1111(b)(3), are enrolled in
			 the school, and are in the group whose academic performance caused the
			 identification under this paragraph, with the option to transfer to one other
			 public school identified by and </quote>; and</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID35a42704d14946e8b3fec32ba569aed2"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idC68C8DBDC2384ACA9B32FE5FE6205C35" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="IDbe2e7e8b9681445fbfe85b528c25090f"><enum>(G)</enum><header display-inline="yes-display-inline">Options</header><text display-inline="yes-display-inline">A local educational agency may offer
				supplemental educational services as described in subsection (e) in place of
				the option to transfer to another public school described in subparagraph (E),
				for the first school year a school is identified for improvement under this
				paragraph.</text>
						</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2966c223d7d2450691304a4d35b6bdc1"><enum>(2)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A) of
			 paragraph (5), by inserting <quote>for the same group of students</quote> after
			 <quote>adequate yearly progress</quote>; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID87291050592749d2b0744284e885923b"><enum>(3)</enum><text display-inline="yes-display-inline">in the matter preceding clause (i) of
			 paragraph (7)(C), by inserting <quote>for the same group of students</quote>
			 after <quote>adequate yearly progress</quote>.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="idCEB147564FDA40EDAB7D5228A670A09B" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Supplemental educational
			 services</header><text display-inline="no-display-inline">Section 1116(e)(4)
			 (20 U.S.C. 6316(e)(4)) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="idCDA4E41755DE4715B35A5A45FFCA07F6"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B), by inserting
			 <quote>(developed through consultation with local educational agencies in the
			 State)</quote> after <quote>objective criteria</quote>;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0D0EA63B72554B70B898916F67F435BE"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking
			 <quote>and</quote> after the semicolon;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCAA7B9ECB74A4C6594F1126ED80D5D2F"><enum>(3)</enum><text display-inline="yes-display-inline">in subparagraph (E), by striking the period
			 and inserting at the end <quote>; and</quote>; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id69755B1BEDC74E34AF837602110EAE4B"><enum>(4)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idEDFDAF1D08ED4CD1A523B52E887CFEEC" style="OLC">
					<subparagraph commented="no" display-inline="no-display-inline" id="IDe5cb96ecab834ff18994f98565ac1052"><enum>(F)</enum><text display-inline="yes-display-inline">develop procedures by which a local
				educational agency may—</text>
						<clause commented="no" display-inline="no-display-inline" id="ID7b15518f3db24a019bda52907592c7e2"><enum>(i)</enum><text display-inline="yes-display-inline">present complaints, and documentation of
				such complaints, to the State educational agency regarding the qualification,
				operation, and evaluation—</text>
							<subclause commented="no" display-inline="no-display-inline" id="id201ED5F7587B4BA59F91C9097EFF9352"><enum>(I)</enum><text display-inline="yes-display-inline">of approved providers; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id6156E3EC5E724F158AFF15BCDB285423"><enum>(II)</enum><text display-inline="yes-display-inline">providers of supplemental educational
				services seeking to become approved providers under this subsection; and</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID06f2c3d936d648569c7f949481af97e2"><enum>(ii)</enum><text display-inline="yes-display-inline">demonstrate to the State educational agency
				that a provider of supplemental educational services should not be approved to
				provide supplemental educational services under this subsection to any students
				attending the schools served by the local educational
				agency.</text>
						</clause></subparagraph><after-quoted-block>.
				</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="id5288F4690AFA4D16BE7903E55BB221CF" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Flexibility for special education middle or
			 secondary school teachers</header><text display-inline="no-display-inline">Section 9101(23)(B)(ii) (20 U.S.C.
			 7801(23)(B)(ii)) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id4A21144912F14326A5486B7B27A2C42F"><enum>(1)</enum><text display-inline="yes-display-inline">in subclause (I), by striking
			 <quote>or</quote> after the semicolon;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id263ADEB4BC474A0B90D3ED7D3234FBA5"><enum>(2)</enum><text display-inline="yes-display-inline">in subclause (II), by striking <quote>;
			 and</quote> and inserting <quote>; or</quote>; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBD193C89F44242D8869B6DDA5ABE739E"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idE4A0551AF3F24231B1005E9854FE65DF" style="OLC">
					<subclause commented="no" display-inline="no-display-inline" id="id9B10241D90EE4F11A9DF08F67766BD81"><enum>(III)</enum><text display-inline="yes-display-inline">in the case of a special education teacher,
				obtaining a State special education certificate that qualifies the teacher to
				teach special education in the State;
				and</text>
					</subclause><after-quoted-block>. </after-quoted-block></quoted-block>
			</paragraph></section></legis-body>
