		<official-title>To protect United States citizens and residents from
		  unlawful arrest and detention.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Protect Citizens and Residents
			 from Unlawful Detention Act</short-title></quote>.</text>
		</section><section id="ID671017a3bfb041e398f64a256b3daaa6"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="ID0cf83e23908f4170a8afcafbb4aa14f2"><enum>(1)</enum><text>Officials at
			 United States Immigration and Customs Enforcement have mistakenly detained and
			 deported United States citizens and lawful permanent residents.</text>
			</paragraph><paragraph id="ID5fbb88919067419fa3556a69e6e2bab5"><enum>(2)</enum><text>Mistaken
			 identities, bureaucratic mix-ups, and discriminatory attitudes further
			 contribute to unconstitutional actions against United States citizens, lawful
			 permanent residents, and other persons lawfully present in the United
			 States.</text>
			</paragraph><paragraph id="ID6d7efb7e742e4e29bc11320d0e4d660d"><enum>(3)</enum><text>The United States
			 should not be a country in which United States citizens and lawful permanent
			 residents are mistakenly or unlawfully detained, deported, or mistreated by
			 government agents.</text>
			</paragraph><paragraph id="ID1415aad5cdd94e00a8e27b41c135c0a4"><enum>(4)</enum><text>No person in the
			 United States should be subject to government actions that deny basic
			 protections or constitutional rights.</text>
			</paragraph></section><section id="ID146562b58e784126a8622af7c98c39f4"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id09BC0978C85B49F6BAFB2FC1D2B54605"><enum>(1)</enum><header>Detainee</header><text>The
			 term <term>detainee</term> means an individual detained during an
			 immigration-related enforcement activity.</text>
			</paragraph><paragraph id="id4A519CBF8C9D4F05874DA954A3AB993D"><enum>(2)</enum><header>Detention</header><text>The
			 term <term>detention</term>, in the context of an immigration-related
			 enforcement activity, means government custody or any other deprivation of the
			 freedom of movement of an individual by government agents.</text>
			</paragraph><paragraph id="ID3f3691a3c1704026b2e34c72d17cbdbd"><enum>(3)</enum><header>Detention
			 facility</header><text>The term <term>detention facility</term> means any
			 Federal, State, or local government facility, or any facility providing
			 services under government contract, which is used to hold immigration detainees
			 for more than 72 hours.</text>
			</paragraph><paragraph id="ID64ef9ff7cdde49428980fcbc815c9b46"><enum>(4)</enum><header>Immigration-related
			 enforcement activity</header><text>The term <term>immigration-related
			 enforcement activity</term> means any action by a government agent in
			 which—</text>
				<subparagraph id="IDaccfdca11a2242f88064c6df88f6eb42"><enum>(A)</enum><text>an individual
			 suspected of an immigration violation is detained for such violation; or</text>
				</subparagraph><subparagraph id="IDed824709b99a4693bafd18abc42cbb23"><enum>(B)</enum><text>an individual who
			 has been detained by government agents is questioned about a possible
			 immigration violation.</text>
				</subparagraph></paragraph><paragraph id="ID43c68a8e7ba541f58f70ef9278cd3932"><enum>(5)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Homeland Security.</text>
			</paragraph><paragraph id="idE623E0ACD5F04DA28270C0A3AFA1E093"><enum>(6)</enum><header>Secure
			 alternatives program</header><text>The term <term>secure alternatives
			 program</term> means any custodial or noncustodial program under which an
			 individual is screened and provided with appearance assistance services or
			 placed in supervision programs, as needed, to ensure that the individual
			 appears at all immigration interviews, appointments, and removal or deportation
			 hearings.</text>
			</paragraph></section><section id="IDc4e36e0edb244b1197136051035870c0"><enum>4.</enum><header>Protections
			 against unlawful detentions of United States citizens</header>
			<subsection id="ID23018ea3ae1147138c130834f3506fb6"><enum>(a)</enum><header>Notifications</header>
				<paragraph id="IDc0d925269725426d9c0ab612bc75a3d1"><enum>(1)</enum><header>In
			 general</header><text>Prior to questioning an individual who has been detained
			 on the basis of a suspected immigration violation or has been detained during
			 an immigration-related enforcement activity, a Department of Homeland Security
			 or other officer must first advise the detainee, in the language spoken by the
			 detainee that—</text>
					<subparagraph id="IDeb554cddd631441d90853df94f850870"><enum>(A)</enum><text>the detainee has
			 the right to be represented by counsel at no expense to the Federal
			 Government;</text>
					</subparagraph><subparagraph id="ID537756251d0042458d60b2fbd0fd8414"><enum>(B)</enum><text>the detainee may
			 remain silent; and</text>
					</subparagraph><subparagraph id="IDd19eb7a2768f46cb8ff4844ed6e293e2"><enum>(C)</enum><text>any statement
			 made by the detainee may be used against the detainee in a subsequent removal
			 or criminal proceeding.</text>
					</subparagraph></paragraph><paragraph id="IDc7603ed738254f939eac4d115416292e"><enum>(2)</enum><header>Effect of
			 violation</header><text>Any evidence obtained by an officer from a detainee in
			 violation of paragraph (1) may not be—</text>
					<subparagraph id="idB92F7001D8404F92A55AFECE5FBC16B6"><enum>(A)</enum><text>admissible in a
			 removal proceeding against the detainee; or</text>
					</subparagraph><subparagraph id="id7A70287392CE49BF99926F36EBE3439F"><enum>(B)</enum><text>used to confirm
			 that the detainee is a noncitizen for purposes of issuing an immigration
			 detainer.</text>
					</subparagraph></paragraph></subsection><subsection id="ID0949aef66a4447709b842f54c10187f8"><enum>(b)</enum><header>Access to
			 counsel</header>
				<paragraph id="IDc5b99f6bcae44779b13db6e2a99b3553"><enum>(1)</enum><header>In
			 general</header><text>An individual who is subject to or detained during an
			 immigration-related enforcement activity may be represented by legal counsel at
			 any time.</text>
				</paragraph><paragraph id="IDc1d05da6c86f47979f38fd16c6d46bf7"><enum>(2)</enum><header>List of free
			 legal services</header><text>The examining officer shall, in the language
			 spoken by the individual being detained—</text>
					<subparagraph id="ID829e0b6812494d8d9977063db1d3da2a"><enum>(A)</enum><text>provide the
			 individual, at the time of detention of an individual for an
			 immigration-related violation, with a list of available free or low-cost legal
			 services provided by organizations and attorneys that are located in the region
			 in which the arrest occurred; and</text>
					</subparagraph><subparagraph id="ID954c1e93cc9b4f1094a57f098ea50d90"><enum>(B)</enum><text>certify on the
			 Notice to Appear issued to such individual that such a list was provided to the
			 individual.</text>
					</subparagraph></paragraph><paragraph id="ID9ab20610dd9a4d6e902204f744e52e5d"><enum>(3)</enum><header>Amendment</header><text>Section
			 236 of the Immigration and Nationality Act (8 U.S.C. 1226) is amended—</text>
					<subparagraph id="id66EC039F52D44015B538968C40B650A7"><enum>(A)</enum><text>by redesignating
			 subsection (e) as subsection (l);</text>
					</subparagraph><subparagraph id="id478A30FBCA164F779A344397E8AE50C6"><enum>(B)</enum><text>by redesignating
			 subsections (b), (c), (d), and (e) as subsections (f), (g), and (h), and (i)
			 respectively; and</text>
					</subparagraph><subparagraph id="id0851061F134F4BFEBB6F4AE247369E7F"><enum>(C)</enum><text>by inserting
			 before subsection (l), as redesignated, the following:</text>
						<quoted-block display-inline="no-display-inline" id="id96064A94BCFB453BBD6504A884382C5F" style="OLC">
							<subsection id="id106832BEB5D34BE88D1754A9EF89A637"><enum>(k)</enum><header>Right of access
				to counsel</header><text>An individual may be represented by counsel of the
				individual’s choosing while being subject to any immigration-related
				enforcement activity, including—</text>
								<paragraph id="idE8E0D693A1264C099DAD8A3B8EC1075A"><enum>(1)</enum><text>interviews;</text>
								</paragraph><paragraph id="idFFD2F6178963454285A8D75F119708EC"><enum>(2)</enum><text>processing
				appointments;</text>
								</paragraph><paragraph id="id878B51B9164247C6B2F7B0BAF084D9AE"><enum>(3)</enum><text>booking or intake
				questions;</text>
								</paragraph><paragraph id="id50B0851EE99549A2BD50DB2796E1DE9D"><enum>(4)</enum><text>hearings;
				and</text>
								</paragraph><paragraph id="idFCC9C819D6764A62B3207FF23A801B13"><enum>(5)</enum><text>any procedure
				that may result in a conclusion that the detainee will be detained or removed
				from the United
				States.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="id2EC811F7300D474899B5A1DCD4693989"><enum>(c)</enum><header>Notice</header>
				<paragraph id="idB7386B00B5CD4E47BADFDC4718066C6C"><enum>(1)</enum><header>Amendment</header><text>Section
			 236 of such Act, as amended by subsection (b)(3), if further amended by
			 inserting before subsection (k), the following:</text>
					<quoted-block display-inline="no-display-inline" id="id33FC1670425447EB8B0C3AA8CE5774F4" style="OLC">
						<subsection id="idE0647D5EABCF4F71B114372CC71A2260"><enum>(j)</enum><header>Notice and
				charges</header>
							<paragraph id="id3D1AE629D50B4904A06A8B617024F7F3"><enum>(1)</enum><header>In
				general</header><text>Not later than 48 hours after the commencement of a
				detention of an individual under this section, the Secretary of Homeland
				Security shall—</text>
								<subparagraph id="id5F98F06C49CE4635ABA021E6768E6444"><enum>(A)</enum><text>file a Notice to
				Appear or other relevant charging document with the immigration court closest
				to the location at which the individual was apprehended; and</text>
								</subparagraph><subparagraph id="idDEA6458BD56243AB9497C300EAC53493"><enum>(B)</enum><text>serve such notice
				or charging document on the individual.</text>
								</subparagraph></paragraph><paragraph id="id364FE66A62D5490DBDAF7E741EC44956"><enum>(2)</enum><header>Custody
				determination</header><text>Any individual who is detained under this section
				for more than 48 hours shall be brought before an immigration judge for a
				custody determination not later than 72 hours after the commencement of such
				detention unless the individual waives the right in accordance with paragraph
				(3).</text>
							</paragraph><paragraph id="id70956AE458CD43EABE59EAEDCE62094B"><enum>(3)</enum><header>Waiver</header><text>The
				requirements of this subsection may be waived for not more than 7 days if the
				detainee—</text>
								<subparagraph id="id9820FAAB84454D26AAFE50B995E2A962"><enum>(A)</enum><text>enters into a
				written agreement with the Department of Homeland Security to waive such
				requirements; and</text>
								</subparagraph><subparagraph id="id46A83957CC8D41FB931145AD20C2BACF"><enum>(B)</enum><text>is prima facie
				eligible for immigration benefits or demonstrates prima facie eligibility for a
				defense against
				removal.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idDC4789A4021D49BB9EBEE0138E1D2714"><enum>(2)</enum><header>Applicability
			 of other law</header><text>Nothing in section 236(f) of the Immigration and
			 Nationality Act, as added by paragraph (1), may be construed to repeal section
			 236A of such Act (8 U.S.C. 1226a).</text>
				</paragraph></subsection><subsection id="idD6B72F5E984F4E7485F22E7BEE28FE3D"><enum>(d)</enum><header>Issuance of
			 detainers</header>
				<paragraph id="id808F15B7E68C41F78984B7C9EB74072B"><enum>(1)</enum><header>Limitation</header><text>An
			 official of the Department of Homeland Security may not issue a detainer in any
			 context unless the official attests under oath that—</text>
					<subparagraph id="idACA3D07A6F934033AE20B9C67288DD85"><enum>(A)</enum><text>the official has
			 confirmed through lawfully obtained evidence that the individual who is the
			 subject of the detainer is not a United States citizen; and</text>
					</subparagraph><subparagraph id="id3BB27A3E87DF45A5848DEA9625830685"><enum>(B)</enum><text>the information
			 obtained regarding the alienage of such individual on the detainer is
			 correct.</text>
					</subparagraph></paragraph><paragraph id="id5D68CFAC718A43C291C92ADF44294CCB"><enum>(2)</enum><header>Notice</header><text>An
			 official of the Department of Homeland Security shall serve each detainer
			 issued on the individual who is the subject of the detainer.</text>
				</paragraph><paragraph id="idA8D103799B444C7A97ECBDF071E300BF"><enum>(3)</enum><header>Rulemaking</header>
					<subparagraph id="id878CA874217043FC9CD3A0EEBADF53F6"><enum>(A)</enum><header>Alienage</header><text>The
			 Secretary shall issue regulations that require officials of the Department of
			 Homeland Security to confirm, before issuing a detainer, the alienage of the
			 individual to be made subject to such detainer.</text>
					</subparagraph><subparagraph id="id81B6C82DCF8C4887A6B6C42688E43731"><enum>(B)</enum><header>Confirmation of
			 alienage</header><text>The regulation required under subparagraph (A) shall
			 require officials of the Department of Homeland Security to confirm the
			 alienage of an individual through lawfully obtained information,
			 including—</text>
						<clause id="id5B2ED73DCC5D4723A7595881ABE63116"><enum>(i)</enum><text>the
			 name of the individual;</text>
						</clause><clause id="id911B1D884B36499FA22186CC12FAB224"><enum>(ii)</enum><text>the date of
			 birth of the individual; or</text>
						</clause><clause id="id50428A568C7E4F91BBB97D1EDCE0E337"><enum>(iii)</enum><text>the
			 fingerprints of the individual.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="idAB79796D614745118DC9463B3619DE5F"><enum>(e)</enum><header>Access to
			 telephones</header>
				<paragraph id="idAD62CD4E3B9F43B69FCB9F35F6287868"><enum>(1)</enum><header>In
			 general</header><text>Not later than 6 hours after the commencement of a
			 detention of an individual during an immigration-related enforcement activity,
			 an official of the Department of Homeland Security shall provide the individual
			 with access to a telephone to make free telephone calls to—</text>
					<subparagraph id="id7059B7EDFCA848B3B980621A766984D5"><enum>(A)</enum><text>the consulate of
			 the individual;</text>
					</subparagraph><subparagraph id="idF8A52BE52ADD480BBD9E99D0F2A09678"><enum>(B)</enum><text>designated free
			 legal-service providers or legal representatives who are providing free
			 representation for the individual;</text>
					</subparagraph><subparagraph id="idA1ADA5363A114C06914DE0CAD1D4F293"><enum>(C)</enum><text>an office of the
			 United States Immigration and Customs Enforcement;</text>
					</subparagraph><subparagraph id="idA34A97A37A3045659EFEB53E5741485A"><enum>(D)</enum><text>an immigration
			 court or the Board of Immigration Appeals;</text>
					</subparagraph><subparagraph id="idD13CD124D89945AA84F7341AE81353B9"><enum>(E)</enum><text>the Office of the
			 Inspector General of the Department of Homeland Security;</text>
					</subparagraph><subparagraph id="idFFE0C153626B474E989AA3E1A3CC490A"><enum>(F)</enum><text>the Office for
			 Civil Rights and Civil Liberties of the Department of Homeland Security;
			 and</text>
					</subparagraph><subparagraph id="id5610E5F99CD14F6F8665D2775F8FF4BE"><enum>(G)</enum><text>any Federal or
			 State court in which the detainee is or may become involved in a legal
			 proceeding.</text>
					</subparagraph></paragraph><paragraph id="id791C63243E1D43F5A654866925B4818F"><enum>(2)</enum><header>Confidential
			 telephone calls</header>
					<subparagraph id="id8283D8B6169644888664A025441E2231"><enum>(A)</enum><header>Free
			 confidential telephone calls</header><text>A detainee shall be permitted to
			 make confidential telephone calls at no charge to the detainee if the detainee
			 is—</text>
						<clause id="id127317C6BEC848D69E8E43D9FA855EC1"><enum>(i)</enum><text>subject to
			 expedited removal; or</text>
						</clause><clause id="idD5DD8744C8EE4869A3A9C4990BEC88A3"><enum>(ii)</enum><text>experiencing a
			 personal or family emergency, including the need to arrange care for
			 dependents.</text>
						</clause></subparagraph><subparagraph id="id3730739412B048C281E5D84A5D3AAE21"><enum>(B)</enum><header>Additional
			 confidential telephone calls</header><text>A detainee shall be permitted to
			 make additional confidential telephone calls at no cost to the Federal
			 Government.</text>
					</subparagraph></paragraph></subsection><subsection id="id8E52800B8F4E4E7FB9C8A48D0E1FBCDC"><enum>(f)</enum><header>Protection of
			 community-Based organizations, faith-Based organizations and other
			 institutions</header>
				<paragraph id="id2F0D697EB03847508F48314E431C8749"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall issue regulations requiring officials
			 of the Department of Homeland Security to—</text>
					<subparagraph id="idEF69E50527C14848864503418813F362"><enum>(A)</enum><text>prohibit the
			 apprehension of persons on the premises or in the immediate vicinity of—</text>
						<clause id="id325C8A0E26D44BCD82E424A58C349C2F"><enum>(i)</enum><text>a
			 childcare provider;</text>
						</clause><clause id="id1F65DA9D07194161A96E94F9D3D778D2"><enum>(ii)</enum><text>a
			 school;</text>
						</clause><clause id="id5C940AC0BA8E4C6C84DA8279757AA34B"><enum>(iii)</enum><text>a
			 legal-service provider;</text>
						</clause><clause id="id1922585F1AF6456EBA480C04DE428873"><enum>(iv)</enum><text>a
			 Federal court or State court proceeding;</text>
						</clause><clause id="id2B6A2C730ED249C19CCC247A0A1D5D8B"><enum>(v)</enum><text>an
			 administrative proceeding;</text>
						</clause><clause id="id9FA897F26F6F481ABB6B3B0E08420D39"><enum>(vi)</enum><text>a
			 funeral home;</text>
						</clause><clause id="idEFEBB207621B44BA82FC88AC2AD6E430"><enum>(vii)</enum><text>a
			 cemetery;</text>
						</clause><clause id="idA0D4787B0BBC4EFF99577866B0ADE637"><enum>(viii)</enum><text>a college,
			 university, or community college;</text>
						</clause><clause id="id70B45E094CD44C3182DD61C37D05CB93"><enum>(ix)</enum><text>a
			 victim services agency;</text>
						</clause><clause id="id6E7ECA485B2E4564A52FCB66079B462A"><enum>(x)</enum><text>a
			 social service agency;</text>
						</clause><clause id="id1B722A49805A4E4ABC20FE2D3B2B8CE8"><enum>(xi)</enum><text>a
			 hospital or emergency care center;</text>
						</clause><clause id="id5B151157C5D944E8B54C4955292763B9"><enum>(xii)</enum><text>a
			 health care clinic; and</text>
						</clause><clause id="idB1BD0A08386F4487964CA8ADB2AAE0D0"><enum>(xiii)</enum><text>a place of
			 worship; and</text>
						</clause></subparagraph><subparagraph id="idEE455D0EB6404E78A2794592F098F181"><enum>(B)</enum><text>tightly control
			 investigative operations at the locations described in subparagraph (A).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8292C760776945FB8ABB1DE556DE5767"><enum>(2)</enum><header>Notice to
			 appear</header><text>The Secretary shall amend the Notice to Appear form to
			 include a statement that no immigration enforcement activity was undertaken in
			 any of the locations described in paragraph (1)(A).</text>
				</paragraph></subsection><subsection id="IDfa0e285aa39548219c909b70f7c1909d"><enum>(g)</enum><header>Transfer of
			 detainees</header>
				<paragraph id="ID9e0ddf8cb40847ada4fca86c36a1e28c"><enum>(1)</enum><header>Procedures</header><text>In
			 adopting procedures relating to the transfer of individuals detained under
			 section 236 of the Immigration and Nationality Act (8 U.S.C. 1226), the
			 Secretary shall promulgate regulations requiring officials of the Department of
			 Homeland Security to give substantial weight to—</text>
					<subparagraph id="ID7a55dabc722e43708845b5f1dea1fd50"><enum>(A)</enum><text>the access of the
			 detainee to legal representation;</text>
					</subparagraph><subparagraph id="IDdc0ca1da1bac4ea2964cb03cf3d570f3"><enum>(B)</enum><text>the residence of
			 the detainee prior to apprehension;</text>
					</subparagraph><subparagraph id="ID9fdec9c6e1554a23959fcdd7796baddf"><enum>(C)</enum><text>the location of
			 family members of the detainee;</text>
					</subparagraph><subparagraph id="IDeec432a0c9ed41d3b264ba33a5c0ab1a"><enum>(D)</enum><text>the stage of any
			 legal proceeding involving the detainee, including Federal, State, or
			 administrative proceedings;</text>
					</subparagraph><subparagraph id="ID2d8fafbe25dd480ebc4c59c03a0c1188"><enum>(E)</enum><text>the proximity of
			 the transferee facility to the venue of any legal proceeding described in
			 subparagraph (D);</text>
					</subparagraph><subparagraph id="IDae5f6a8fd2904be0a621d93c372288bb"><enum>(F)</enum><text>the health and
			 medical fitness of the detainee; and</text>
					</subparagraph><subparagraph id="ID65dcac25de954aa387e3abccccbe64cf"><enum>(G)</enum><text>whether the
			 detainee has a pending application for relief with United States Citizenship
			 and Immigration Services or the Executive Office for Immigration Review.</text>
					</subparagraph></paragraph><paragraph id="IDe27e8c2e28b5479e95f2c4e6f954d31f"><enum>(2)</enum><header>Notice</header><text>Unless
			 exigent circumstances dictate an immediate transfer, the Secretary—</text>
					<subparagraph id="IDace522c3f99a43c2a06d278cf772d1ba"><enum>(A)</enum><text>shall provide at
			 least 72-hour notice to the detainee in the language spoken by the detainee and
			 to the representative of record before transferring a detainee to another
			 detention facility; and</text>
					</subparagraph><subparagraph id="ID53b72c4288a2406fa5b863156abd72f0"><enum>(B)</enum><text>may not transfer
			 the detainee until the detainee has received any custody hearing for which the
			 detainee is eligible.</text>
					</subparagraph></paragraph><paragraph id="id6DBE19615C6A41E8B1D9C491D21401EA"><enum>(3)</enum><header>Additional
			 requirements</header>
					<subparagraph id="IDfaaa3472e17744b9b61c13e3ab9679cd"><enum>(A)</enum><header>In
			 general</header><text>Absent exigent circumstances, such as a natural disaster
			 or comparable emergency, the Secretary may not transfer a detainee who has an
			 existing attorney-client relationship to another facility if the transfer of
			 the detainee would—</text>
						<clause id="ID8ab8c392fb3f43e6aaff1c2afac3421c"><enum>(i)</enum><text>impair the
			 existing attorney-client relationship;</text>
						</clause><clause id="IDf04f512208cc4010b038955a2f1e2083"><enum>(ii)</enum><text>prejudice the
			 rights of the detainee in any legal proceeding; or</text>
						</clause><clause id="IDd32a2dc942dd427db9aede6b5ab20bda"><enum>(iii)</enum><text>affect the
			 ability of the detainee to present evidence or witnesses.</text>
						</clause></subparagraph><subparagraph id="IDe4862f4be46b4ec3ba7fab89983ccfca"><enum>(B)</enum><header>Legal rights of
			 detainees</header><text>In any custody, bond, or removal decision involving a
			 detainee detained under section 236 of the Immigration and Nationality Act (8
			 U.S.C. 1226)—</text>
						<clause id="idA49494258BBA437EB9C8723A05914FDE"><enum>(i)</enum><text>legal precedent
			 in the location of apprehension shall control any custody, bond, or removal
			 decision; and</text>
						</clause><clause id="id4BDF788DE4B14F1FAC29AA64344F08B5"><enum>(ii)</enum><text>in
			 cases of ambiguity, an immigration judge shall use the rule of lenity in
			 choosing from among the laws of the relevant circuits.</text>
						</clause></subparagraph><subparagraph id="IDca73bee9046e478cb79ca608c9944361"><enum>(C)</enum><header>Record</header><text>If
			 a detainee is transferred, the Secretary shall prepare a record of—</text>
						<clause id="idC057E026DA2F46E6A4B78F867653D688"><enum>(i)</enum><text>the
			 reasons necessitating the transfer; and</text>
						</clause><clause id="idF0299D879D1B4DB5878E49CF8D099647"><enum>(ii)</enum><text>actions taken to
			 ameliorate any adverse effect on the legal rights of the detainee.</text>
						</clause></subparagraph><subparagraph id="idB1EC0875C59945C38C985B5EAC12E7A6"><enum>(D)</enum><header>Investigation</header><text>If
			 a detainee makes an allegation of retaliation, such allegation shall be
			 investigated by an independent entity.</text>
					</subparagraph></paragraph></subsection><subsection id="ID9422264d74a2490fbe08e9bb4cf8527e"><enum>(h)</enum><header>Training</header><text>The
			 Secretary, in consultation with the Civil Rights and Civil Liberties Officer,
			 shall provide all officers of the Department of Homeland Security, other
			 Federal agencies, and all State and local officers involved in
			 immigration-enforcement activities with periodic training regarding—</text>
				<paragraph id="idA1EF41756206466AA2DE2CA7F8B306F3"><enum>(1)</enum><text>immigration
			 law;</text>
				</paragraph><paragraph id="idF5FAE39C5983491EB93A7AF4F455E223"><enum>(2)</enum><text>civil rights
			 law;</text>
				</paragraph><paragraph id="id906AD3EE8841412B80DC85F177EF68AB"><enum>(3)</enum><text>medical and
			 mental health needs and treatment;</text>
				</paragraph><paragraph id="idE0D21FC3FFA9475594A69B651BB8D0B4"><enum>(4)</enum><text>due process
			 protections; and</text>
				</paragraph><paragraph id="idF276E68D807B4E409F263A7E8E064686"><enum>(5)</enum><text>humanitarian
			 guidelines under current law, including—</text>
					<subparagraph id="IDcec850940f454a868a1375224aa37fc7"><enum>(A)</enum><text>the right of
			 access to immigration legal counsel; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7ed4c0086e0f4842ab100cc4a67d1f08"><enum>(B)</enum><text>the appropriate
			 treatment of vulnerable populations during immigration-related enforcement
			 activities.</text>
					</subparagraph></paragraph></subsection></section><section id="ID0fb6e76682414d61b19f8cab8f9dda83"><enum>5.</enum><header>Basic
			 protections for vulnerable populations</header>
			<subsection id="id0BE645041A5E4B45B8E94F9AB4BA426D"><enum>(a)</enum><header>Vulnerable
			 populations</header>
				<paragraph id="ID3cf2a489ff8c4f0ca8bba521167ff8e6"><enum>(1)</enum><header>In
			 general</header><text>Not later than 72 hours after the commencement of an
			 immigration-related enforcement activity, the Department of Homeland Security
			 shall screen each detainee to determine whether the detainee is a member of a
			 vulnerable population.</text>
				</paragraph><paragraph id="id86A16C3531FB4B269F1F697DB64C0964"><enum>(2)</enum><header>Vulnerable
			 populations</header><text>A member of a vulnerable population includes any of
			 the following:</text>
					<subparagraph id="id2F74B5B1DA414CD59AC795813B51D989"><enum>(A)</enum><text>Individuals with
			 a nonfrivolous claim to United States citizenship.</text>
					</subparagraph><subparagraph id="ID190feab5fcde47aaae9775ffd5c43501"><enum>(B)</enum><text>Individuals who
			 have a disability or have been determined by a medically trained professional
			 to have medical or mental health needs.</text>
					</subparagraph><subparagraph id="ID7810ca22ccbc4d0d971d35fb73fa7716"><enum>(C)</enum><text>Pregnant or
			 nursing women.</text>
					</subparagraph><subparagraph id="IDc824c4305f0b4d5cb572a8dea1fbb355"><enum>(D)</enum><text>Individuals who
			 are detained with 1 or more of their children, and their detained
			 children.</text>
					</subparagraph><subparagraph id="ID46b752a252384275ac2ad1458fd5f21c"><enum>(E)</enum><text>Individuals who
			 provide financial, physical, and other direct support to their minor children,
			 parents, or other dependents.</text>
					</subparagraph><subparagraph id="ID9a0d8e72f738476689b98acc94a6c364"><enum>(F)</enum><text>Individuals who
			 are at least 65 years of age.</text>
					</subparagraph><subparagraph id="ID803296b7fc334e47889d9d7865109930"><enum>(G)</enum><text>Children (as
			 defined in section 101(b)(1) of the Immigration and Nationality Act (8 U.S.C.
			 1101(b)(1))).</text>
					</subparagraph><subparagraph id="ID5eb90993a39343d695f6edb5ef792262"><enum>(H)</enum><text>Victims of abuse,
			 violence, crime, or human trafficking.</text>
					</subparagraph><subparagraph id="IDfdd025865cfc475680d0ecd910f1f907"><enum>(I)</enum><text>Individuals who
			 have been referred for a credible fear interview, a reasonable fear interview,
			 or an asylum hearing.</text>
					</subparagraph><subparagraph id="idE5290E6847A547D3942555CF4282944F"><enum>(J)</enum><text>Stateless
			 individuals.</text>
					</subparagraph><subparagraph id="ID6e412bf2e2db4513ba502a4d8c7693dc"><enum>(K)</enum><text>Individuals who
			 have applied or intend to apply for asylum, withholding of removal, or
			 protection under the Convention Against Torture and Other Cruel, Inhuman or
			 Degrading Treatment or Punishment, done at New York, December 10, 1984, and
			 entered into force June 26, 1987.</text>
					</subparagraph><subparagraph id="IDef9a471dfd19407f830f7d332c2de5ea"><enum>(L)</enum><text>Individuals who
			 make a prima facie case for eligibility for relief under any provision of the
			 Immigration and Nationality Act (8 U.S.C. 1101 et seq.), including returning
			 lawful permanent residents.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe6394efe93144b16a6eabcba7ce01951"><enum>(M)</enum><text>Any group
			 designated by the Secretary as a vulnerable population.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id694D7B08275E4A228CF0538A6B3A3D84"><enum>(b)</enum><header>Options
			 regarding detention decisions for vulnerable populations</header><text>Section
			 236 of the Immigration and Nationality Act, as amended by this Act, is further
			 amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idD0B4F9951A30435B9CC402DEAB7B6189"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id98EC567AA1014EC2BBB35D61A5F45596"><enum>(A)</enum><text>in the matter
			 preceding paragraph (1), by striking <quote>(c)</quote> and inserting
			 <quote>(g)</quote>; and</text>
					</subparagraph><subparagraph id="ID339c8c2c9e9144ce950e3f6eaee42655"><enum>(B)</enum><text>in paragraph
			 (2)—</text>
						<clause id="ID9ebe0bbb97ff49258da3365d96aa14d9"><enum>(i)</enum><text>in
			 subparagraph (A), by striking <quote>or</quote> at the end;</text>
						</clause><clause id="ID6c7e1e521afa498c959e70853a80ab1b"><enum>(ii)</enum><text>in
			 subparagraph (B), by striking <quote>but</quote> and inserting
			 <quote>or</quote>; and</text>
						</clause><clause id="ID9cd7f95afe81443a90871a7e1fa477e0"><enum>(iii)</enum><text>by adding at
			 the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="id1C1DA697E2F445728A1A57DB7BABDFC7" style="OLC">
								<subparagraph id="idCCE91F06DF2041799C17A071328C6644"><enum>(C)</enum><text>the individual’s
				own
				recognizance;</text>
								</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="ID3e9ce41cc42a495f823ce4250585b7ce"><enum>(C)</enum><text>by redesignating
			 paragraph (3) as paragraph (4); and</text>
					</subparagraph><subparagraph id="ID8aa6bd78584d4c6eb414689708277580"><enum>(D)</enum><text>by inserting
			 after paragraph (2) the following:</text>
						<quoted-block display-inline="no-display-inline" id="id195091DEB78A4533808B8213490EEDEB" style="OLC">
							<paragraph id="id8E8466D8CBC1494D9028ECF02FF7A9C2"><enum>(3)</enum><text>may enroll the
				alien in a secure alternatives program;
				but</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="ID9c08c23cfe514af3b5476f38f5df7322"><enum>(2)</enum><text>by inserting
			 after subsection (a) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id58C460EBA4AF41DB88EF2B330F0367F5" style="OLC">
						<subsection id="idA13E0A8B60BA4122BBF4FED45D59796E"><enum>(b)</enum><header>Detention
				decisions</header>
							<paragraph commented="no" id="id348ABF1B77074DF7A2101364004F63F0"><enum>(1)</enum><header>Criteria to be
				considered</header><text>If an alien is not subject to mandatory detention
				under subsection (g) or section 236A, the criteria that the Secretary or the
				Attorney General shall use to demonstrate that detention of the alien is
				necessary are the following:</text>
								<subparagraph commented="no" id="idDFACD21E51DA48449A82652A43CFA1B6"><enum>(A)</enum><text>Whether the alien
				poses a risk to public safety, including a risk to national security.</text>
								</subparagraph><subparagraph commented="no" id="IDf4d267ca532a4d05a4b5371e2ddbc628"><enum>(B)</enum><text>Whether—</text>
									<clause commented="no" id="id85E203571E45419A90406D8E636DCCD8"><enum>(i)</enum><text>the alien poses a
				risk of flight; and</text>
									</clause><clause commented="no" id="id740232F8E5E544ABA93E1E30AFFE284A"><enum>(ii)</enum><text>there are no
				conditions of release that will reasonably ensure that the alien will appear
				for immigration proceedings, including bond or other conditions of release that
				reduce the risk of flight.</text>
									</clause></subparagraph></paragraph><paragraph id="id56237FAF51D64EDCA79943B834523428"><enum>(2)</enum><header>Exception for
				mandatory detainees</header><text>The requirements described in paragraph (1)
				shall not apply if the Secretary of Homeland Security demonstrates by
				substantial evidence that the alien is subject to detention under subsection
				(g).</text>
							</paragraph></subsection><subsection id="IDdd4b1737b0cb438898869d1414c47745"><enum>(c)</enum><header>Custody
				decisions for vulnerable populations</header>
							<paragraph id="ID92fc6eb8fc7f435392300763737eda7d"><enum>(1)</enum><header>In
				general</header><text>Not later than 72 hours after an individual is detained
				under this section (unless the 72-hour requirement is waived in writing by the
				individual), an individual who is a member of a vulnerable population (as
				defined by section 5(a)(3) of the <short-title>Protect
				Citizens and Residents from Unlawful Detention Act</short-title>) shall be
				released from the custody of the Department of Homeland Security and shall not
				be subject to electronic monitoring unless the Department demonstrates by a
				preponderance of the evidence that the individual—</text>
								<subparagraph id="ID1283f39cfebf4665ab39a457c97531e8"><enum>(A)</enum><text>is subject to
				mandatory custody or mandatory detention under subsection (g) or section
				236A;</text>
								</subparagraph><subparagraph id="IDe543c3431f9947388818a36e59b74209"><enum>(B)</enum><text>poses a risk to
				the national security of the United States; or</text>
								</subparagraph><subparagraph id="IDb3a5079184594a4599272fdec3289ae4"><enum>(C)</enum><text>is a flight risk
				and the risk cannot be mitigated through supervision in a non-custodial secure
				alternatives program.</text>
								</subparagraph></paragraph><paragraph id="ID9d9b643f2ec94783a808cf8bc7d046eb"><enum>(2)</enum><header>Release</header><text>An
				individual shall be released from custody under this subsection—</text>
								<subparagraph id="ID67901cc8467e41208628205174fa32e1"><enum>(A)</enum><text>on the
				individual’s own recognizance;</text>
								</subparagraph><subparagraph id="IDf0356b6c109c4e72bc1952db0a0a6ed4"><enum>(B)</enum><text>by posting a
				minimum bond under subsection (a)(2)(a); or</text>
								</subparagraph><subparagraph id="ID3bc7173e011a42379ad6aa26fda612e6"><enum>(C)</enum><text>on parole in
				accordance with section 212(d)(5)(A).</text>
								</subparagraph></paragraph></subsection><subsection id="IDc63ce2a558124ea0947601a5fb817aa9"><enum>(d)</enum><header>Decisions To
				detain aliens</header>
							<paragraph id="IDaf0e5def2468405baf822558498c3b7e"><enum>(1)</enum><header>In
				general</header><text>All detention decisions under this section shall—</text>
								<subparagraph id="IDb941239f250042ce9944a10f47532524"><enum>(A)</enum><text>be made in
				writing by an official of the Department of Homeland Security;</text>
								</subparagraph><subparagraph id="ID8b60302cf9b848cb858c039903ec74b8"><enum>(B)</enum><text>specify the
				reasons for the decision, if the decision is made to continue the detention
				without bond or parole; and</text>
								</subparagraph><subparagraph id="ID24aec54acc5c41c5b6e3a467a260c6b2"><enum>(C)</enum><text>be served upon
				the detainee, in the language spoken by the alien, not later than 72 hours
				after—</text>
									<clause id="ID2fa10f79eb754ff6b075e427b2349ef3"><enum>(i)</enum><text>the commencement
				of the detention; or</text>
									</clause><clause id="ID97dc0b1c35914c29a48cedb821d4fe97"><enum>(ii)</enum><text>a positive
				determination of credible fear of persecution or reasonable fear of persecution
				or torture, if the detainee is subject to section 235 or 241(a)(5).</text>
									</clause></subparagraph></paragraph><paragraph id="IDb25dcfeaef3240c3bbb970b80816c039"><enum>(2)</enum><header>Redetermination</header>
								<subparagraph id="ID34bcf6089e4d49fc844103c2915a99aa"><enum>(A)</enum><header>Request</header><text>Any
				alien detained by the Department of Homeland Security, at any time after being
				served with the decision described in paragraph (1)(A), may request a
				redetermination of such decision by an immigration judge.</text>
								</subparagraph><subparagraph id="ID10f8e532b83545abb9c2aea5ec55b805"><enum>(B)</enum><header>Other
				decisions</header><text>All custody decisions by the Secretary of Homeland
				Security shall be subject to redetermination by an immigration judge.</text>
								</subparagraph><subparagraph id="IDf9c5279b30064984a5fe5a2e23dc96c3"><enum>(C)</enum><header>Savings
				provision</header><text>Nothing in this paragraph may be construed to prevent a
				detainee from requesting a bond redetermination.</text>
								</subparagraph></paragraph></subsection><subsection id="IDdd91168520cc443eb167096fe2b32f82"><enum>(e)</enum><header>Secure
				alternatives programs</header>
							<paragraph id="id0468CA7D379E4F2EB1F05DF0B6B80A0E"><enum>(1)</enum><header>In
				general</header><text>The Secretary of Homeland Security shall establish secure
				alternatives programs to ensure public safety and appearances at immigration
				proceedings.</text>
							</paragraph><paragraph id="id1F84E9B0447044D480B39AECA29A4000"><enum>(2)</enum><header>Contract
				authority</header><text>The Secretary shall contract with nongovernmental
				organizations to conduct screening of detainees, provide appearance assistance
				services, and operate community-based supervision programs.</text>
							</paragraph><paragraph id="id48E2445292EF4A49A24CA8A6C87595C8"><enum>(3)</enum><header>Individualized
				determinations</header><text>When deciding whether to use secure alternatives,
				the Secretary shall make an individualized determination and review each case
				on a monthly basis.</text>
							</paragraph><paragraph id="id4535DDDED9304668BAAB8E281B9B2D20"><enum>(4)</enum><header>Custody</header><text>If
				an individual is not eligible for release from custody, the Secretary shall
				consider the alien for placement in secure alternatives that maintain custody
				over the alien, including the use of electronic ankle devices. The Secretary
				may use secure alternatives programs to maintain custody over any alien
				detained under this Act except for aliens detained under section
				236A.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="IDb1ec08f7d64e464296f163d71be19f34"><enum>6.</enum><header>Reports on
			 protections from unlawful detention</header>
			<subsection id="IDeed3dc37866b410e878adc8b6276f4e3"><enum>(a)</enum><header>Report
			 requirement</header><text>Not later than 1 year after the date of the enactment
			 of this Act, and annually thereafter, the Secretary shall prepare and submit a
			 report to Congress that describes the impact of worksite and fugitive
			 operations on United States citizens, lawful permanent residents, and
			 individuals otherwise lawfully present in the United States.</text>
			</subsection><subsection id="ID137feed2ef1e4a9cba57de0e11f13901"><enum>(b)</enum><header>Content</header><text>The
			 report submitted under subsection (a) shall include an assessment of—</text>
				<paragraph id="IDef006afb8a6144f2b5c3661edd0a5236"><enum>(1)</enum><text>the number of
			 individuals detained during worksite or nonworksite operations who are
			 children, United States citizens, or adult lawful permanent residents;</text>
				</paragraph><paragraph id="ID0ba0a552778e488dbfdb17a8a84b5ed5"><enum>(2)</enum><text>immigration-related
			 arrests at homes, schools, places of worship, medical care facilities, victim
			 services agencies, social services agencies, and community centers;</text>
				</paragraph><paragraph id="ID6bae955ddfc5408c8e818b10d5a04922"><enum>(3)</enum><text>arrests,
			 detentions, and removals of individuals who are—</text>
					<subparagraph id="id496A1FE4B3F24581B3227186C107E0CC"><enum>(A)</enum><text>sole
			 caregivers;</text>
					</subparagraph><subparagraph id="id3915003733F3401EB5F0D64949C38611"><enum>(B)</enum><text>primary earners
			 of income in a family;</text>
					</subparagraph><subparagraph id="id393483D37BBB40B4AA92A329451BDA78"><enum>(C)</enum><text>pregnant or
			 nursing mothers; or</text>
					</subparagraph><subparagraph id="idE754CEFA63A648E6AADF4A6390EAF347"><enum>(D)</enum><text>members of other
			 vulnerable groups subject to immigration-related enforcement activity;</text>
					</subparagraph></paragraph><paragraph id="IDe7f6bebec61d41ebb03e501c50160b4e"><enum>(4)</enum><text>transfers of
			 immigrants during the course of a raid or immigration-enforcement activity,
			 including—</text>
					<subparagraph id="IDc5a589b848654878ada1f87db7c48142"><enum>(A)</enum><text>whether the
			 immigrants had access to legal counsel before being transferred; and</text>
					</subparagraph><subparagraph id="ID74a33b27f96a4a40be98952d5ba23766"><enum>(B)</enum><text>whether the
			 immigrants received notice of an impending transfer;</text>
					</subparagraph></paragraph><paragraph id="ID27e8b7348756461b8f4dd85e5b5b1098"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idC80699199CB7457C9A417373B2AF74F1"><enum>(A)</enum><text>United States
			 Immigration and Customs Enforcement protocol for humanitarian screening during
			 a worksite enforcement action;</text>
					</subparagraph><subparagraph id="ID34749ca61dec4d5197a854e3232cf673" indent="up1"><enum>(B)</enum><text>the compliance with such protocol;
			 and</text>
					</subparagraph><subparagraph id="IDd8b07ea3b7eb499e9498aabaac40e751" indent="up1"><enum>(C)</enum><text>the nature of any related protocol in
			 smaller worksite or nonworksite actions;</text>
					</subparagraph></paragraph><paragraph id="ID19f2d2e21fe74ca5b2fe5653db4495fd"><enum>(6)</enum><text>collateral
			 arrests under the National Fugitive Operations Program and worksite enforcement
			 initiatives;</text>
				</paragraph><paragraph id="ID07821c81a1b44efda5ee63fbbff61837"><enum>(7)</enum><text>whether
			 individuals detained in an immigration-related enforcement activity are
			 notified of their right to counsel;</text>
				</paragraph><paragraph id="ID0e7e1d0c837348a6b575c24e9727ed45"><enum>(8)</enum><text>whether United
			 States Immigration and Customs Enforcement agents—</text>
					<subparagraph id="idAA42A42AE97641A1A5ED9637E39BCD34"><enum>(A)</enum><text>use excessive
			 force in executing warrants, arrests, detentions, or other
			 immigration-enforcement activities;</text>
					</subparagraph><subparagraph id="id3100A446A45344F78D38C7D135CD2891"><enum>(B)</enum><text>enter private
			 homes or residences without a search warrant or consent; or</text>
					</subparagraph><subparagraph id="id8E9936E3512E40C9BB8FAF3EE12AC0BA"><enum>(C)</enum><text>display and use
			 weapons during immigration-enforcement activities or interrogations;</text>
					</subparagraph></paragraph><paragraph id="ID474433eddf9d479d96a70d05a2dbb3d4"><enum>(9)</enum><text>the extent to
			 which United States Immigration and Customs Enforcement cooperates and
			 coordinates with State and local law enforcement during immigration enforcement
			 activities;</text>
				</paragraph><paragraph id="IDaf765e24ba7d47b5b3a675fb5fd19671"><enum>(10)</enum><text>whether United
			 States Immigration and Customs Enforcement agents identify themselves when
			 entering a location for enforcement purposes;</text>
				</paragraph><paragraph id="IDdf31b0e1a95845e2993f21c956ac7555"><enum>(11)</enum><text>the conditions
			 under which individuals are confined;</text>
				</paragraph><paragraph id="IDe6e6a3c18b624820bf79be38c3f0233d"><enum>(12)</enum><text>whether
			 detainees are provided access to a telephone;</text>
				</paragraph><paragraph id="IDd4548a956c834443a0eedebb41ec2f33"><enum>(13)</enum><text>whether
			 detainees are notified of their rights in a language they can
			 understand;</text>
				</paragraph><paragraph id="ID4e79e4c6afe3495b855f65b3860f4234"><enum>(14)</enum><text>whether
			 individuals detained during a raid or an immigration enforcement activity are
			 forced or coerced to sign any documents or waive any rights without consulting
			 with an attorney;</text>
				</paragraph><paragraph id="IDf2a62844c5814e0bb1ce58245a6bba56"><enum>(15)</enum><text>the procedures
			 used by the Department of Homeland Security—</text>
					<subparagraph id="id1B6670F8008D4571A4DAC1A73470BA6C"><enum>(A)</enum><text>to notify agents
			 about humanitarian standards regarding enforcement actions; and</text>
					</subparagraph><subparagraph id="idA0EF8C6CEA4B4342B439F3925D16D690"><enum>(B)</enum><text>hold agents
			 accountable when they violate such standards;</text>
					</subparagraph></paragraph><paragraph id="ID15ec74da2f724b788d0fa70d26b93a14"><enum>(16)</enum><text>the per detainee
			 cost of each raid involving more than 50 detainees;</text>
				</paragraph><paragraph id="ID829c93caf5f84a66a0e098ed3dd5eb17"><enum>(17)</enum><text>the number of
			 United States Immigration and Customs Enforcement agents disciplined for
			 violations in detention proceedings; and</text>
				</paragraph><paragraph id="ID8a054e661f4d4eeba347325e0115f806"><enum>(18)</enum><text>recommendations
			 for improving worksite operations and fugitive operations.</text>
				</paragraph></subsection><subsection id="ID6afdf08087ce4be3a5cd997b1bc96228"><enum>(c)</enum><header>Authorization
			 of appropriations</header><text>There is authorized to be appropriated such
			 sums as may be necessary to carry out this section.</text>
			</subsection></section><section id="ID1ce568add7aa47e998ec0b6672be78cc"><enum>7.</enum><header>Immigration and
			 customs enforcement ombudsman</header>
			<subsection id="ID7f1498fae8df4f26b74a235a4fee991a"><enum>(a)</enum><header>Establishment</header><text>Subtitle
			 D of title III of the Homeland Security Act of 2002 (6 U.S.C. 251 et seq.) is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idF003B07C2AD64351B1C10C3948BAF10D" style="OLC">
					<section id="ID031ec0f3d90c4bb4bc9885da95298f04"><enum>447.</enum><header>Immigration
				and customs enforcement ombudsman</header>
						<subsection id="ID7fc29fc499d74a219f892ec8c70533a4"><enum>(a)</enum><header>In
				general</header><text>There established in the Department of Homeland Security
				a position of Immigration and Customs Enforcement Ombudsman (referred to in
				this section as the <quote>Ombudsman</quote>).</text>
						</subsection><subsection id="id3E0244D24EB74698807FB471E536DB66"><enum>(b)</enum><header>Requirements</header><text>The
				Ombudsman shall—</text>
							<paragraph id="id88738A70CA9C43E28B7BCB011319F3F8"><enum>(1)</enum><text>report directly
				to the Assistant Secretary for Immigration and Customs Enforcement (referred to
				in this section as the <quote>Assistant Secretary</quote>); and</text>
							</paragraph><paragraph id="idBD64FE1EAB534A6FA5662EC577EA0747"><enum>(2)</enum><text>have a background
				in immigration law.</text>
							</paragraph></subsection><subsection id="IDae3dec71d142489a96f76f9c88989f5a"><enum>(c)</enum><header>Functions</header><text>The
				Ombudsman shall—</text>
							<paragraph id="ID5cd33fefb9d341318dfbf68dd6d9ebfa"><enum>(1)</enum><text>undertake regular
				and unannounced inspections of detention facilities and local offices of United
				States Immigration and Customs Enforcement to determine whether the facilities
				and offices comply with relevant policies, procedures, standards, laws, and
				regulations;</text>
							</paragraph><paragraph id="IDba2ba3ad0e8a4c6da0a86b00708ddc07"><enum>(2)</enum><text>report all
				findings of compliance or noncompliance of the facilities and local offices
				described in paragraph (1) to the Secretary and the Assistant Secretary;</text>
							</paragraph><paragraph id="IDa33cc6b2fd524d8da80ff783d8332df5"><enum>(3)</enum><text>develop
				procedures for detainees or their representatives to submit confidential
				written complaints directly to the Ombudsman;</text>
							</paragraph><paragraph id="IDebfc2e5214644788896a34ddf7a7dade"><enum>(4)</enum><text>investigate and
				resolve all complaints, including confidential and anonymous complaints,
				related to decisions, recommendations, acts, or omissions made by the Assistant
				Secretary or the Commissioner of United States Customs and Border Protection in
				the course of custody and detention operations;</text>
							</paragraph><paragraph id="IDb53ab9e4d6d54c6fbc6b2487b8084d0c"><enum>(5)</enum><text>initiate
				investigations into allegations of systemic problems at detention
				facilities;</text>
							</paragraph><paragraph id="IDdf39e6d079364a7e903036af1b6d1c58"><enum>(6)</enum><text>conduct any
				review or audit relating to detention, as directed by the Secretary or
				Assistant Secretary;</text>
							</paragraph><paragraph id="ID1fb0ccdbcbbb4cc392a087c05132a4de"><enum>(7)</enum><text>refer matters, as
				appropriate, to the Office of Inspector General of the Department of Justice,
				the Office of Civil Rights and Civil Liberties of the Department, or any other
				relevant office or agency;</text>
							</paragraph><paragraph id="ID41c16b0939b742d6afc1a3ff92ab7796"><enum>(8)</enum><text>propose changes
				in the policies or practices of United States Immigration and Customs
				Enforcement to improve the treatment of United States citizens and residents,
				immigrants, detainees, and others subject to immigration-related enforcement
				operations;</text>
							</paragraph><paragraph id="ID97d047465cf44341924541bf8e13c5d5"><enum>(9)</enum><text>establish a
				public advisory group consisting of nongovernmental organization
				representatives and Federal, State, and local government officials with
				expertise in detention and vulnerable populations to provide the Ombudsman with
				input on—</text>
								<subparagraph id="IDf987fe186e9c4120993d01c327d8ec55"><enum>(A)</enum><text>the priorities of
				the Ombudsman; and</text>
								</subparagraph><subparagraph id="ID0afbf180c2344c43a4ff0173d66f42c4"><enum>(B)</enum><text>current practices
				of United States Immigration and Customs Enforcement; and</text>
								</subparagraph></paragraph><paragraph id="ID42c7545bdfbe47d589c9dac9c9ae0b32"><enum>(10)</enum><text>recommend to the
				Assistant Secretary personnel action based on any finding of
				noncompliance.</text>
							</paragraph></subsection><subsection id="IDd9f24d85600d4dd0b2e60fd941cba0b3"><enum>(d)</enum><header>Annual
				report</header>
							<paragraph id="ID2d6c941c1e754145b67cb3ccf6de7548"><enum>(1)</enum><header>Objectives</header><text>Not
				later than June 30 of each year, the Ombudsman shall prepare and submit a
				report to the Committee on the Judiciary of the Senate and the Committee on the
				Judiciary of the House of Representatives on the objectives of the Office of
				the Ombudsman for the next fiscal year.</text>
							</paragraph><paragraph id="ID61da864eb93e43f68ec316a77b243827"><enum>(2)</enum><header>Contents</header><text>Each
				report submitted under paragraph (1) shall include—</text>
								<subparagraph id="ID1bb176fd39db4745b9aeef009dde9ac9"><enum>(A)</enum><text>full and
				substantive analysis of the objectives of the Office of the Ombudsman;</text>
								</subparagraph><subparagraph id="ID6691f3d7c5614f51abf3a3aa59093ecd"><enum>(B)</enum><text>statistical
				information regarding such objectives;</text>
								</subparagraph><subparagraph id="ID32272f200daa480c8486d9e9378fbe08"><enum>(C)</enum><text>a description of
				each detention facility found to be in noncompliance with the detention
				standards of the Department of Homeland Security or other applicable
				regulations;</text>
								</subparagraph><subparagraph id="ID2c5a0578c9d4465a9e94437a9ded7c51"><enum>(D)</enum><text>a description of
				the actions taken by the Department of Homeland Security to remedy any findings
				of noncompliance or other identified problems;</text>
								</subparagraph><subparagraph id="ID50da40de9c8e45d290ec0b786acd7571"><enum>(E)</enum><text>information
				regarding whether the actions described in subparagraph (D) resulted in
				compliance with detention standards;</text>
								</subparagraph><subparagraph id="ID6ecdbd6a7cd1411da443b95f1374d771"><enum>(F)</enum><text>a summary of the
				most pervasive and serious problems encountered by individuals subject to the
				enforcement operations of the Department of Homeland Security, including a
				description of the nature of such problems; and</text>
								</subparagraph><subparagraph id="ID8307030f53e042549d618869f5a4a88f"><enum>(G)</enum><text>such other
				information as the Ombudsman may consider
				advisable.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID8c2ef25e887c497b8c7f26039e1fb7da"><enum>(b)</enum><header>Amendment</header><text>The
			 table of contents in section 1(b) of the Homeland Security Act of 2002 (6
			 U.S.C. 101 et seq.) is amended by inserting after the item relating to section
			 446 the following:</text>

			 enactment of this Act, the Secretary shall promulgate regulations to implement
			 this Act and the amendments made by this Act.</text>
