		<official-title>To amend the Family and Medical Leave Act of 1993 and
		  title 5, United States Code, to provide leave for family members of members of
		  regular components of the Armed Forces, and leave to care for covered veterans,
		  and for other purposes.</official-title>

		<section id="idCCBD6D7FB8C5494E96D560B16A6DAA81" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Supporting Military Families Act of
			 2009</short-title></quote>.</text>
		</section><title id="HCD5B7DAFDCED4113A87E1B14384DF1D0"><enum>I</enum><header>General
			 Requirements for Leave</header>
			<section id="HFED430B2B91A4A04BBA3A6AFEC299D38"><enum>101.</enum><header>Definition of
			 covered active duty</header>
				<subsection id="H472B383CFA0F49168F95FBD630CEA7A0"><enum>(a)</enum><header>Definition</header><text>Section
			 101 of the Family and Medical Leave Act of 1993 (29 U.S.C. 2611) is
			 amended—</text>
					<paragraph id="HEFB61D724CB44772ABB2697BC3517368"><enum>(1)</enum><text>by striking
			 paragraph (14) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="H3CFC865CA2FA4FEF9F744573CB5020FA" style="OLC">
							<paragraph id="H9E039877CCBF4B5798B519745F179361"><enum>(14)</enum><header>Covered active
				duty</header><text>The term <term>covered active duty</term> means—</text>
								<subparagraph id="HD788AD46A74E49FF8F9899A0E4C99DD9"><enum>(A)</enum><text>in the case of a
				member of a regular component of the Armed Forces, duty during the deployment
				of the member with the Armed Forces to a foreign country; and</text>
								</subparagraph><subparagraph id="H0450A34DF44744D6B0A3E55816279175"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a member of a reserve
				component of the Armed Forces, duty during the deployment of the member with
				the Armed Forces to a foreign country under a call or order to active duty
				under a provision of law referred to in section 101(a)(13)(B) of title 10,
				United States Code.</text>
								</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H0B5EBC0692044F42980BE07BA9731422"><enum>(2)</enum><text>by striking
			 paragraph (15) and redesignating paragraphs (16) through (19) as paragraphs
			 (15) through (18), respectively.</text>
					</paragraph></subsection><subsection id="HC979D9F10AC949B4A4291C1923EF2ACB"><enum>(b)</enum><header>Leave</header><text>Section
			 102 of the Family and Medical Leave Act of 1993 (29 U.S.C. 2612) is
			 amended—</text>
					<paragraph id="HD7BE8D0F8F0B48F08092D923687AE919"><enum>(1)</enum><text>in subsection
			 (a)(1)(E)—</text>
						<subparagraph id="HEBD6D4CF9C98461584112EA08D8AE408"><enum>(A)</enum><text>by striking
			 <quote>active duty</quote> each place it appears and inserting <quote>covered
			 active duty</quote>; and</text>
						</subparagraph><subparagraph id="H9153C255B9DA4766A165940C3335C639"><enum>(B)</enum><text>by striking
			 <quote>in support of a contingency operation</quote>; and</text>
						</subparagraph></paragraph><paragraph id="HBF974C8FFE4A4CF8BD074E8E829A1C78"><enum>(2)</enum><text>in subsection
			 (e)(3)—</text>
						<subparagraph id="HCCB1B2D5BCB24674995E440898ECA2A2"><enum>(A)</enum><text>in the paragraph
			 heading, by striking <quote><header-in-text level="paragraph" style="OLC">active duty</header-in-text></quote> and inserting
			 <quote><header-in-text level="paragraph" style="OLC">covered active
			 duty</header-in-text></quote>;</text>
						</subparagraph><subparagraph id="H0CA5F15BE0AB47F6AACF17866266C0F7"><enum>(B)</enum><text>by striking
			 <quote>active duty</quote> each place it appears and inserting <quote>covered
			 active duty</quote>; and</text>
						</subparagraph><subparagraph id="HA8C0F899EBC442D18DE62BF24DB5E156"><enum>(C)</enum><text>by striking
			 <quote>in support of a contingency operation</quote>.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H5FF012570E9B4C9D828C412F0C622414"><enum>(c)</enum><header>Conforming
			 amendment</header><text>Section 103(f) of the Family and Medical Leave Act of
			 1993 (29 U.S.C. 2613(f)) is amended, in the subsection heading, by striking
			 <quote><header-in-text level="subsection" style="OLC">Active
			 duty</header-in-text></quote> each place it appears and inserting
			 <quote><header-in-text level="subsection" style="OLC">Covered active
			 duty</header-in-text></quote>.</text>
				</subsection></section><section id="H412C9BFD692541ACBDF9D7785FD62ABD"><enum>102.</enum><header>Definition of
			 covered servicemember</header><text display-inline="no-display-inline">Paragraph (15) of section 101 of the Family
			 and Medical Leave Act of 1993 (29 U.S.C. 2611) (as redesignated by section 101
			 of this Act) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H923E46B84B3C4D49BF89E2FBBE5DB954" style="OLC">
					<paragraph id="H95BBA3109AD942AD8400866EE5B34649"><enum>(15)</enum><header>Covered
				servicemember</header><text>The term <term>covered servicemember</term>
				means—</text>
						<subparagraph id="H29CDE724E4D34F388763D2C8D043E894"><enum>(A)</enum><text>a member of the
				Armed Forces (including a member of the National Guard or Reserves) who is
				undergoing medical treatment, recuperation, or therapy, is otherwise in
				outpatient status, or is otherwise on the temporary disability retired list,
				for a serious injury or illness; or</text>
						</subparagraph><subparagraph id="HBDC103A5B5044C92891474BBEE4DDEFF"><enum>(B)</enum><text>a veteran who is
				undergoing medical treatment, recuperation, or therapy, for a serious injury or
				illness and who was a member of the Armed Forces (including a member of the
				National Guard or Reserves) at any time during the period of 5 years preceding
				the date on which the veteran undergoes that medical treatment, recuperation,
				or
				therapy.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H789DBE0D0EA04DD3BD3DC367B2A289BA"><enum>103.</enum><header>Definitions of
			 serious injury or illness; veteran</header><text display-inline="no-display-inline">Section 101 of the Family and Medical Leave
			 Act of 1993 (29 U.S.C. 2611) is further amended by striking paragraph (18) (as
			 redesignated by section 101 of this Act) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H8B7FBC89F9B64F62BE74A334B0738DAE" style="OLC">
					<paragraph id="HB89FD5BDD94347F3B193D6292401BC3D"><enum>(18)</enum><header>Serious injury
				or illness</header><text>The term <term>serious injury or
				illness</term>—</text>
						<subparagraph id="HFB5DED86DAD34BBCBDD23A89C430FB82"><enum>(A)</enum><text>in the case of a
				member of the Armed Forces (including a member of the National Guard or
				Reserves), means an injury or illness that was incurred by the member in line
				of duty on active duty in the Armed Forces (or existed before the beginning of
				the member’s active duty and was aggravated by service in line of duty on
				active duty in the Armed Forces) and that may render the member medically unfit
				to perform the duties of the member's office, grade, rank, or rating;
				and</text>
						</subparagraph><subparagraph id="HF3C9EA7A12F44EDB938610D4E30F4952"><enum>(B)</enum><text>in the case of a
				veteran who was a member of the Armed Forces (including a member of the
				National Guard or Reserves) at any time during a period described in paragraph
				(15)(B), means an injury or illness that was incurred by the member in line of
				duty on active duty in the Armed Forces (or existed before the beginning of the
				member’s active duty and was aggravated by service in line of duty on active
				duty in the Armed Forces) and that manifested itself before or after the member
				became a veteran.</text>
						</subparagraph></paragraph><paragraph id="H73273D2EB54C41FAB9F43BFD33ACCFE6"><enum>(19)</enum><header>Veteran</header><text>The
				term <term>veteran</term> has the meaning given the term in section 101 of
				title 38, United States
				Code.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HF782DFE370B343919957038EF44B1837"><enum>104.</enum><header>Technical
			 amendment</header><text display-inline="no-display-inline">Section 102(e)(2)(A)
			 of the Family and Medical Leave Act of 1993 (29 U.S.C. 2612(e)(2)(A)) is
			 amended by striking <quote>or parent</quote> and inserting <quote>parent, or
			 next of kin</quote>.</text>
			</section><section id="id91916952D5494AA69298FEF719413D1A"><enum>105.</enum><header>Regulations</header><text display-inline="no-display-inline">The Secretary of Labor, after consultation
			 with the Secretary of Defense and Secretary of Veterans Affairs, shall
			 prescribe such regulations as are necessary to carry out the amendments made by
			 this title.</text>
			</section></title><title id="H97FB9C71802B4921817E150AB7ECD28B"><enum>II</enum><header>Leave for civil
			 service employees</header>
			<section id="H31BE48B731DD44A4BA99C84276B2D991"><enum>201.</enum><header>Exigency leave
			 for servicemembers on covered active duty</header>
				<subsection id="H9670BA2DF77342EB8817100240FE6980"><enum>(a)</enum><header>Definition</header><text>Section
			 6381(7) of title 5, United States Code, is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H00DE1A4916CD47979BE938CE50D7C6F4" style="USC">
						<paragraph id="HEC04CFEA82AD45FDA59784C88D9B0454"><enum>(7)</enum><text>the term
				<term>covered active duty</term> means—</text>
							<subparagraph id="HC0996EAD9C4E4372BD5B1827A52E0EB8"><enum>(A)</enum><text>in the case of a
				member of a regular component of the Armed Forces, duty during the deployment
				of the member with the Armed Forces to a foreign country; and</text>
							</subparagraph><subparagraph id="H99C5184E9F3640B59A04F00E46BC980E"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a member of a reserve
				component of the Armed Forces, duty during the deployment of the member with
				the Armed Forces to a foreign country under a call or order to active duty
				under a provision of law referred to in section 101(a)(13)(B) of title 10,
				United States
				Code;</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H1BE87B9FCC224902BF3DDE61D7448E7B"><enum>(b)</enum><header>Leave</header><text>Section
			 6382 of title 5, United States Code, is amended—</text>
					<paragraph id="H4A4E80D9B15A440893D507086FB4EAC8"><enum>(1)</enum><text>in subsection
			 (a)(1), by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H4CDFF3CAF5914006878789F1E946E994" style="USC">
							<subparagraph id="H55F5780D7FDE44FD94AA3968D3F73192" indent="up1"><enum>(E)</enum><text display-inline="yes-display-inline">Because of any qualifying exigency arising
				out of the fact that the spouse, or a son, daughter, or parent of the employee
				is on covered active duty (or has been notified of an impending call or order
				to covered active duty) in the Armed
				Forces.</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H1DD7D3B2B6A1467F8D025438D434A8E0"><enum>(2)</enum><text>in subsection
			 (b)(1), by inserting after the second sentence the following: <quote>Subject to
			 subsection (e)(3) and section 6383(f), leave under subsection (a)(1)(E) may be
			 taken intermittently or on a reduced leave schedule.</quote>;</text>
					</paragraph><paragraph id="H6837F6D44FF14CD785083927A9124619"><enum>(3)</enum><text>in subsection (d),
			 by striking <quote>or (D)</quote> and inserting <quote>(D), or (E)</quote>;
			 and</text>
					</paragraph><paragraph id="HED859EE264294FE38212DB51109E6AD9"><enum>(4)</enum><text>in subsection (e),
			 by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H698E846BA58F4BDC8A261C8284451D17" style="USC">
							<paragraph id="H6A7D10E91CB14FBCB317266CD1B478D3" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In any case in which the necessity for
				leave under subsection (a)(1)(E) is foreseeable, whether because the spouse, or
				a son, daughter, or parent, of the employee is on covered active duty, or
				because of notification of an impending call or order to covered active duty,
				the employee shall provide such notice to the employer as is reasonable and
				practicable.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="HDB750985992B4BA1B3C8B534745E0187"><enum>(c)</enum><header>Certification</header><text>Section
			 6383(f) of title 5, United States Code, is amended by striking <quote>section
			 6382(a)(3)</quote> and inserting <quote>paragraph (1)(E) or (3) of section
			 6382(a)</quote>.</text>
				</subsection></section><section id="H684398E7938A4AB99115B9ED360C01E6"><enum>202.</enum><header>Definition of
			 covered servicemember</header><text display-inline="no-display-inline">Paragraph (8) of section 6381 of title 5,
			 United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H44F5326004C94AD9B2C254BDCE5CE4DD" style="USC">
					<paragraph id="H07214961977F4AAA8E571CDB763B4FE7"><enum>(8)</enum><text>the term
				<term>covered servicemember</term> means—</text>
						<subparagraph id="HA05F30A6C7704ADFBD0168FB7A19FE83"><enum>(A)</enum><text>a member of the
				Armed Forces (including a member of the National Guard or Reserves) who is
				undergoing medical treatment, recuperation, or therapy, is otherwise in
				outpatient status, or is otherwise on the temporary disability retired list,
				for a serious injury or illness; or</text>
						</subparagraph><subparagraph id="HC50CD7A141674E22BB4A6AEAE80A4885"><enum>(B)</enum><text>a veteran who is
				undergoing medical treatment, recuperation, or therapy, for a serious injury or
				illness and who was a member of the Armed Forces (including a member of the
				National Guard or Reserves) at any time during the period of 5 years preceding
				the date on which the veteran undergoes that medical treatment, recuperation,
				or
				therapy;</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HD5617957961443DC893A84276714967B"><enum>203.</enum><header>Definitions of
			 serious injury or illness; veteran</header><text display-inline="no-display-inline">Section 6381 of title 5, United States Code,
			 is further amended—</text>
				<paragraph id="id953D2C0BD9654123AF71BFD29B59833B"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (10), by striking
			 <quote>and</quote> at the end; and</text>
				</paragraph><paragraph id="id834AF4B14A6F4A02937C296BADA2941F"><enum>(2)</enum><text display-inline="yes-display-inline">by striking paragraph (11) and inserting
			 the following:</text>
					<quoted-block display-inline="no-display-inline" id="H3F60C3CF5BE44AFAA37D272D9DD8DB69" style="USC">
						<paragraph id="H6DCA64D2938C4DF197CC757FFD8F8584"><enum>(11)</enum><text>the term
				<quote>serious injury or illness</quote>—</text>
							<subparagraph id="H54736B976815464387A18E60FEBEA2D2"><enum>(A)</enum><text>in the case of a
				member of the Armed Forces (including a member of the National Guard or
				Reserves), means an injury or illness that was incurred by the member in line
				of duty on active duty in the Armed Forces (or existed before the beginning of
				the member’s active duty and was aggravated by service in line of duty on
				active duty in the Armed Forces) and that may render the member medically unfit

				and</text>
							</subparagraph><subparagraph id="HBA61F20537784718BB80B45C8A363E06"><enum>(B)</enum><text>in the case of a

				(8)(B), means an injury or illness that was incurred by the member in line of
				duty on active duty in the Armed Forces (or existed before the beginning of the
				member’s active duty and was aggravated by service in line of duty on active
				duty in the Armed Forces) and that manifested itself before or after the member
				became a veteran; and</text>
							</subparagraph></paragraph><paragraph id="H55EF33F1D8204B22B198372838FAD0F4"><enum>(12)</enum><text>the term
				<term>veteran</term> has the meaning given the term in section 101 of title 38,
				United States
				Code.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="H85274EA366784D868F8AC925195B7F46" section-type="subsequent-section"><enum>204.</enum><header>Technical
			 amendment</header><text display-inline="no-display-inline">Section
			 6382(e)(2)(A) of title 5, United States Code, is amended by striking <quote>or
			 parent</quote> and inserting <quote>parent, or next of kin</quote>.</text>
			</section><section id="idBB17FE753D5F488EB8227E562435A2A3"><enum>205.</enum><header>Regulations</header><text display-inline="no-display-inline">The Office of Personnel Management, after
			 consultation with the Secretary of Defense and Secretary of Veterans Affairs,
			 shall prescribe such regulations as are necessary to carry out the amendments
			 made by this title.</text>
