		<legis-type>A BILL</legis-type>
		<official-title>To establish and clarify that Congress does not authorize
		  persons convicted of dangerous crimes in foreign courts to freely possess
		  firearms in the United States.</official-title>
	</form>
	<legis-body>
		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>No Firearms for Foreign Felons Act
			 of 2009</short-title></quote>.</text>
		</section><section id="idD13731E7A21B4D488948A18D36A8FF02"><enum>2.</enum><header>Definitions</header>
			<subsection id="id0C9DAD7519BE40EDA6D72D450746D315"><enum>(a)</enum><header>Courts</header><text display-inline="yes-display-inline">Section 921(a) of title 18, United States
			 Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idBD0CDF6B71A14518A94FBEA1C538AFA7" style="OLC">
					<paragraph id="id5FB706B3EEDC4FE7A29952DBDEAC4EF2"><enum>(36)</enum><text>The term
				<term>any court</term> includes any Federal, State, or foreign
				court.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idBE68C00A3A0F4DE1A16AEB5D46D0E6ED"><enum>(b)</enum><header>Exclusion of
			 certain felonies</header><text>Section 921(a)(20) of title 18, United States
			 Code, is amended—</text>
				<paragraph id="idC9C351535B81419598A959FFC8922AB2"><enum>(1)</enum><text>in subparagraph
			 (A), by striking <quote>any Federal or State offenses</quote> and inserting
			 <quote>any Federal, State, or foreign offenses</quote>;</text>
				</paragraph><paragraph id="id9DC337F7E933438FA8D47F945083482E"><enum>(2)</enum><text>in subparagraph
			 (B), by striking <quote>any State offense classified by the laws of the
			 State</quote> and inserting <quote>any State or foreign offense classified by
			 the laws of that jurisdiction</quote>; and</text>
				</paragraph><paragraph id="id9C979EE6C9AB44049BE2689DA017A5F5"><enum>(3)</enum><text>in the matter
			 following subparagraph (B), in the first sentence, by inserting before the
			 period the following: <quote>, except that a foreign conviction shall not
			 constitute a conviction of such a crime if the convicted person establishes
			 that the foreign conviction resulted from a denial of fundamental fairness that
			 would violate due process if committed in the United States or from conduct
			 that would be legal if committed in the United States</quote>.</text>
				</paragraph></subsection><subsection id="id93A7AB699E164F66B4821011614B7D5B"><enum>(c)</enum><header>Domestic
			 violence crimes</header><text>Section 921(a)(33) of title 18, United States
			 Code, is amended—</text>
				<paragraph id="idDC4389126914482785EA090D00E0B6C9"><enum>(1)</enum><text>in subparagraph
			 (A), by striking <quote>subparagraph (C)</quote> and inserting
			 <quote>subparagraph (B)</quote>; and</text>
				</paragraph><paragraph id="id6356C4CDE11E45718F48424C96243E15"><enum>(2)</enum><text>in subparagraph
			 (B)(ii), by striking <quote>if the conviction has</quote> and inserting the
			 following:</text>
					<quoted-block display-inline="yes-display-inline" id="idBA6B9AE2F7E0498BAD1D0BC9AEF13680" style="OLC">
						<text>if the
			 conviction—</text><subclause id="id663E77958D2F448E8DC5097D4F38C486" indent="up1"><enum>(I)</enum><text>occurred in a foreign jurisdiction and
				the convicted person establishes that the foreign conviction resulted from a
				denial of fundamental fairness that would violate due process if committed in
				the United States or from conduct that would be legal if committed in the
				United States; or</text>
						</subclause><subclause id="id2180C37CD215445AACF6928D104517CD" indent="up1"><enum>(II)</enum><text>has</text>
						</subclause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="id02C5788A84D54130B0C46098C32F6450"><enum>3.</enum><header>Penalties</header><text display-inline="no-display-inline">Section 924(e)(2)(A)(ii) of title 18, United
			 States Code, is amended—</text>
			<paragraph id="ID78925f61c3ee4d84bd1af36fe195c7ce"><enum>(1)</enum><text>by striking
			 <quote>an offense under State law</quote> and inserting <quote>an offense under
			 State or foreign law</quote>; and</text>
			</paragraph><paragraph id="id98822A68880946B184D1164D0635CFC7"><enum>(2)</enum><text>by inserting
			 before the semicolon the following: <quote>, except that a foreign conviction
			 shall not constitute a conviction of such a crime if the convicted person
			 establishes that the foreign conviction resulted from a denial of fundamental
			 fairness that would violate due process if committed in the United States or
			 from conduct that would be legal if committed in the United
			 States</quote>.</text>
