			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>United States Secret Service
			 Uniformed Division Modernization Act of 2009</short-title></quote>.</text>
		</section><section id="ID7d6a7b90b537410ba11d9689b096c12d"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to transfer
			 statutory entitlements to pay and hours of work authorized by the District of
			 Columbia Code for current members of the United States Secret Service Uniformed
			 Division from the District of Columbia Code to the United States Code.</text>

			 for United States secret service uniformed division</header>
			<subsection id="IDc8ce8ffc344f434b88bf5f7c9189d750"><enum>(a)</enum><header>Pay for members
			 of the United States secret service uniformed division</header><text>Subpart I
			 of part III of title 5, United States Code, is amended by adding at the end the
			 following:</text>

						<section id="ID5b0a4da2b32546c08141d34c74547760"><enum>10201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter—</text>
							<paragraph id="ID2b02b2abc1904d0cba2264ba22cc47f5"><enum>(1)</enum><text>the term
				<term>member</term> means an employee of the United States Secret Service
				Uniformed Division having the authorities described under section 3056A(b) of
				title 18;</text>
							</paragraph><paragraph id="ID73756d38fe0b451f987c6322cd8ec76b"><enum>(2)</enum><text>the term
				<term>Secretary</term> means the Secretary of the Department of Homeland
				Security; and</text>
							</paragraph><paragraph id="IDca0187862c8146dcacb26e753efed485"><enum>(3)</enum><text>the term
				<term>United States Secret Service Uniformed Division</term> has the meaning
				given that term under section 3056A of title 18.</text>
							</paragraph></section><section id="ID3870cae3b76542db8ba7eb4d888d710d"><enum>10202.</enum><header>Authorities</header>
							<subsection id="ID583167daa9f342d58fc599fcf00d4bc0"><enum>(a)</enum><header>In
				General</header><text>The Secretary is authorized to—</text>
								<paragraph id="IDaac0462287a5406ea09b34acc4b99c43"><enum>(1)</enum><text>fix and adjust
				rates of basic pay for members of the United States Secret Service Uniformed
				Division, subject to the requirements of this chapter;</text>
								</paragraph><paragraph id="ID87672062772f4901b1d22064a90e7a61"><enum>(2)</enum><text>determine what
				constitutes an acceptable level of competence for the purposes of section
				10205;</text>
								</paragraph><paragraph id="ID9b5d85c2add54cedadd35c4491853967"><enum>(3)</enum><text>establish and
				determine the positions at the Officer and Sergeant ranks to be included as
				technician positions; and</text>
								</paragraph><paragraph id="ID6d3bf2e3272e48c0af7127ce624e7bf5"><enum>(4)</enum><text>determine the
				rate of basic pay of a member who is changed or demoted to a lower rank, in
				accordance with section 10208.</text>
								</paragraph></subsection><subsection id="ID3c7f3d46ff864410bd90bd40d63e7b80"><enum>(b)</enum><header>Delegation of
				Authority</header><text>The Secretary is authorized to delegate to the
				designated agent or agents of the Secretary, any power or function vested in
				the Secretary under in this chapter.</text>
							</subsection><subsection id="IDfdd87e1def444c4481f30aef4d730e48"><enum>(c)</enum><header>Regulations</header><text>The
				Secretary may prescribe such regulations as may be necessary to administer this
				chapter.</text>
							</subsection></section><section id="IDba7eac27ad0d499591d9033624cbe95b"><enum>10203.</enum><header>Basic
				pay</header>
							<subsection id="ID8de23f5060684ce5b964257b64abf3bb"><enum>(a)</enum><header>In
				general</header><text>The annual rates of basic pay of members of the United
				States Secret Service Uniformed Division shall be fixed in accordance with the
				following schedule of rates, except that the payable annual rate of basic pay
				for positions at the Lieutenant, Captain, and Inspector ranks is limited to 95
				percent of the rate of pay for level V of the Executive Schedule under
				subchapter II of chapter 53.</text>

						basic pay the Assistant Chief position will be equal to 95 percent of the rate
						of pay for level V of the Executive Schedule. </entry>

											<row><entry align="left" colname="column1" rowsep="0" stub-definition="txt-ldr" stub-hierarchy="1">Chief</entry><entry colname="column2" nameend="column14" namest="column2" rowsep="0">The rate of
						basic pay the Chief position will be equal to the rate of pay for level V of
						the Executive Schedule. </entry>

							</subsection><subsection id="ID0b52d613b34d45de8736d4f1bd88a94d"><enum>(b)</enum><header>Schedule
				Adjustment</header>
								<paragraph id="id9ADAE1D1BA88415CBE5DA1B32C7EB60E"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id058A256FF6184467BE705DDE57037908"><enum>(A)</enum><text display-inline="yes-display-inline">Effective at the beginning of the first pay
				period commencing on or after the first day of the month in which an adjustment
				in the rates of basic pay under the General Schedule takes effect under section
				5303 or other authority, the schedule of annual rates of basic pay of members
				(except the Deputy Chiefs, Assistant Chief and Chief) shall be adjusted by the
				Secretary by a percentage amount corresponding to the percentage adjustment
				made in the rates of pay under the General Schedule.</text>
									</subparagraph><subparagraph id="idC7FCE15474B843B380E2272B1ABECC0E" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The Secretary may establish a methodology
				of schedule adjustment that—</text>
										<clause id="ID17e8e4888d784b2ab3a94cf88280e688"><enum>(i)</enum><text>results in uniform fixed-dollar
				step increments within any given rank; and</text>
										</clause><clause id="ID508894b6010e4312acaefaf72ca27064"><enum>(ii)</enum><text>preserves the established
				percentage differences among rates of different ranks at the same step
				position.</text>
										</clause></subparagraph></paragraph><paragraph id="IDafc7b23b049b439e89cf38f2966934b8"><enum>(2)</enum><text>Notwithstanding
				paragraph (1), the payable annual rate of basic pay for positions at the
				Lieutenant, Captain, and Inspector ranks after adjustment under paragraph (1)
				may not exceed 95 percent of the rate of pay for level V of the Executive
				Schedule under subchapter II of chapter 53.</text>
								</paragraph><paragraph id="ID77152f452291487f93a1e9e876c398ef"><enum>(3)</enum><text>Locality-based
				comparability payments authorized under section 5304 shall be applicable to the
				basic pay for all ranks under this section, except locality-based comparability
				payments may not be paid at a rate which, when added to the rate of basic pay
				otherwise payable to the member, would cause the total to exceed the rate of
				basic pay payable for level IV of the Executive Schedule.</text>
								</paragraph></subsection></section><section id="IDae38f46eb4c74177a01bfed5009bb922"><enum>10204.</enum><header>Rate of pay
				for original appointments</header>
							<subsection id="IDf1cd6c2084c44fbf92e2ea1efa43d77b"><enum>(a)</enum><header>In
				General</header><text>Except as provided in subsection (b), all original
				appointments shall be made at the minimum rate of basic pay for the Officer
				rank set forth in the schedule in section 10203.</text>
							</subsection><subsection id="ID44ae4ad2e90d479ca38c9cfb4ec89e4e"><enum>(b)</enum><header>Exception for
				Superior Qualifications or Special Need</header><text>The Director of the
				United States Secret Service or the designee of the Director may appoint an
				individual at a rate above the minimum rate of basic pay for the Officer rank
				based on the individual’s superior qualifications or a special need of the
				Government for the individual’s services.</text>
							</subsection></section><section id="ID47942ceb8aa44316bd6d1e87305f71df"><enum>10205.</enum><header>Service step
				adjustments</header>
							<subsection id="ID593199f577ad4316ab8e92fd68d0ad82"><enum>(a)</enum><header>Definition</header><text>In
				this section, the term <term>calendar week of active service</term> includes
				all periods of leave with pay or other paid time off, and periods of non-pay
				status which do not cumulatively equal one 40-hour workweek.</text>
							</subsection><subsection id="ID4614e3d4cb9f4cfdb8aafab95b5829cb"><enum>(b)</enum><header>Adjustments</header><text>Each
				member whose current performance is at an acceptable level of competence shall
				have a service step adjustment as follows:</text>
								<paragraph id="ID30d984c3a9da4e5297afbab21471a754"><enum>(1)</enum><text>Each member in
				service step 1, 2, or 3 shall be advanced successively to the next higher
				service step at the beginning of the first pay period immediately following the
				completion of 52 calendar weeks of active service in the member’s service
				step.</text>
								</paragraph><paragraph id="IDeddd36ad586a40b9a295890f1fb1c2e8"><enum>(2)</enum><text>Each member in
				service step 4, 5, 6, 7, 8, 9, 10, or 11 shall be advanced successively to the
				next higher service step at the beginning of the first pay period immediately
				following the completion of 104 calendar weeks of active service in the
				member’s service step.</text>
								</paragraph><paragraph id="ID58731e062c92467c8e57e2b6d01d5386"><enum>(3)</enum><text>Each member in
				service step 12 shall be advanced successively to the next higher service step
				at the beginning of the first pay period immediately following the completion
				of 156 calendar weeks of active service in the member’s service step.</text>
								</paragraph></subsection></section><section id="ID9ee4bc7ea690457bb8f399fea7a65b3d"><enum>10206.</enum><header>Technician
				positions</header>
							<subsection id="ID584d88e98087473087aceef8c14fba85"><enum>(a)</enum><header>In
				General</header><paragraph commented="no" display-inline="yes-display-inline" id="id00AA4036919943B993552737FA33FB2C"><enum>(1)</enum><text>Each member whose
				position is determined under section 10202(a)(3) to be included as a technician
				position shall, on or after such date, receive, in addition to the member’s
				scheduled rate of basic pay, an amount equal to 6 percent of the sum of such
				member’s rate of basic pay and the applicable locality-based comparability
				payment.</text>
								</paragraph><paragraph id="ID1ec0b0adf3f04e4195b8eaaa3ddc197f" indent="up1"><enum>(2)</enum><text>A member described in this subsection
				shall receive the additional compensation authorized by this subsection until
				such time as the member’s position is determined under section 10202(a)(3) not
				to be a technician position, or until the member no longer occupies such
				position, whichever occurs first.</text>
								</paragraph><paragraph id="IDab916caebbaf493c8afa2143c2fbcafc" indent="up1"><enum>(3)</enum><text>The additional compensation
				authorized by this subsection shall be paid to a member in the same manner and
				at the same time as the member’s basic pay is paid.</text>
								</paragraph></subsection><subsection id="ID9a70506ab63b4da8bd8021d10a4fe967"><enum>(b)</enum><header>Exceptions</header><paragraph commented="no" display-inline="yes-display-inline" id="idF72135B74FC649B685A2AF0E6DB76DF2"><enum>(1)</enum><text>Except as provided in
				paragraph (2), the additional compensation authorized by subsection (a)(1)
				shall be considered as basic pay for all purposes, including section
				8401(4).</text>
								</paragraph><paragraph id="ID724dfdadd74e42bb94753261f6580492" indent="up1"><enum>(2)</enum><text>The additional compensation
				authorized by subsection (a)(1) shall not be considered as basic pay for the
				purposes of—</text>
									<subparagraph id="ID04f5479cedf54a9a9355348e66c33351"><enum>(A)</enum><text>section 5304; or</text>
									</subparagraph><subparagraph id="ID87158e27dfd548119f18114feb64a4b7"><enum>(B)</enum><text>section 7511(a)(4).</text>
									</subparagraph></paragraph><paragraph id="IDc05fdf55e3494b5e941c65b7c2c8dcac" indent="up1"><enum>(3)</enum><text>The loss of the additional
				compensation authorized by subsection (a)(1) shall not constitute an adverse
				action for the purposes of section 7512.</text>
								</paragraph></subsection></section><section id="IDf44cd96eec9f43dd8c9ca69dd9c0d5f2"><enum>10207.</enum><header>Promotions</header>
							<subsection id="ID4551eba91bc04b5fac3cf46ab010a979"><enum>(a)</enum><header>In
				General</header><text>Each member who is promoted to a higher rank shall
				receive basic pay at the same step at which such member was being compensated
				prior to the date of the promotion.</text>
							</subsection><subsection id="IDc7047e4bfcb14b6ea2257fced47a3412"><enum>(b)</enum><header>Credit for
				Service</header><text>For the purposes of a service step adjustment under
				section 10205, periods of service at the lower rank shall be credited in the
				same manner as if it was service at the rank to which the employee is
				promoted.</text>
							</subsection></section><section id="ID65e25c93f84a44a1abbeec970d7861f6"><enum>10208.</enum><header>Demotions</header><text display-inline="no-display-inline">When a member is changed or demoted from any
				rank to a lower rank, the Secretary may fix the member’s rate of basic pay at
				the rate of pay for any step in the lower rank which does not exceed the lowest
				step in the lower rank for which the rate of basic pay is equal to or greater
				than the member’s existing rate of basic pay.</text>
						</section><section id="IDa1e1b4dabbb84fea9a71dec632715502"><enum>10209.</enum><header>Clothing
				allowances</header>
							<subsection id="ID3aa5f8859366447e9b1299b3d0e2af82"><enum>(a)</enum><header>In
				General</header><text>In addition to the benefits provided under section 5901,
				the Director of the United States Secret Service or the designee of the
				Director is authorized to provide a clothing allowance to a member assigned to
				perform duties in normal business or work attire purchased at the discretion of
				the employee. Such clothing allowance shall not to be treated as part of the
				member’s basic pay for any purpose (including retirement purposes) and shall
				not be used for the purpose of computing the member’s overtime pay, pay during
				leave or other paid time off, lump-sum payments under section 5551 or section
				5552, workers’ compensation, or any other benefit. Such allowance for any
				member may be discontinued at any time upon written notification by the
				Director of the United States Secret Service or the designee of the
				Director.</text>
							</subsection><subsection id="ID4b53225e92dc47af8ac112dfff992c54"><enum>(b)</enum><header>Maximum amount
				authorized</header><text display-inline="yes-display-inline">A clothing
				allowance authorized under this section shall not exceed $500 per
				annum.</text>
							</subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID809c02a9398e4ee690fa87740aa01196"><enum>(b)</enum><header>Annual leave
			 limitation for members in the Deputy Chief, Assistant Chief, and Chief
			 ranks</header><text>Section 6304(f)(1) of title 5, United States Code, is
			 amended—</text>
				<paragraph id="ID8086cea5096d40ca91804e8aa6948d6f"><enum>(1)</enum><text>in subparagraph
			 (F), by striking <quote>or</quote> after the semicolon;</text>

				</paragraph></subsection></section><section id="IDd25c3015661441feab7f97ff8170a8c1"><enum>4.</enum><header>Miscellaneous
			 provisions</header>
			<subsection id="ID7b39caf0268c4824a7b0d39ae9b1b0bc"><enum>(a)</enum><header>Conversion to
			 new salary schedule in calendar year 2010</header>
				<paragraph id="ID8ab1e60d87804ba5a7c8b9b5dd5bd807"><enum>(1)</enum><header>In
			 General</header>
					<subparagraph id="id80C8A85F9AED4480A44332F5502DB54C"><enum>(A)</enum><header>Rates of pay
			 fixed</header><text>Effective the first day of the first pay period beginning
			 on or after May 1, 2010, the Secretary shall fix the rates of basic pay for
			 members of the United States Secret Service Uniformed Division, as defined
			 under section 10201 of title 5, United States Code, (as added by section 3(a)
			 of this Act) in accordance with the provisions of this subsection.</text>
					</subparagraph><subparagraph id="IDa2020dbdd94148e287f9af4f2afaa936"><enum>(B)</enum><header>Rate based on
			 creditable service</header>
						<clause id="id347D34F01AD54C588978B8415A53B8F5"><enum>(i)</enum><header>In
			 general</header><text>Each member shall be placed in and receive basic pay at
			 the corresponding scheduled rate under chapter 102 of title 5, United States
			 Code, as added by section 3(a) of this Act (after any adjustment under
			 paragraph (3) of this subsection) in accordance with the member’s total years
			 of creditable service, as provided in the table in this clause. If the
			 scheduled rate of basic pay for the step to which the member would be assigned
			 in accordance with this paragraph is lower than the member’s rate of basic pay
			 immediately before the date of enactment of this paragraph, the member shall be
			 placed in and receive basic pay at the next higher service step, subject to the
			 provisions of clause (iv). If the member’s rate of pay exceeds the highest step
			 of the rank, the rate of basic pay shall be determined in accordance with
			 clause (iv).</text>

			 service</header><text>For the purposes of this subsection, a member’s
			 creditable service is any police service in pay status with the United States
			 Secret Service Uniformed Division, the United States Park Police, or the
			 District of Columbia Metropolitan Police Department.</text>
						</clause><clause id="ID71e5bf1303bb46f78ab6a04c8dec1948"><enum>(iii)</enum><header>Step 13
			 conversion maximum rate</header>
							<subclause id="id6006D11CE39940A894D2903C8CC8C80B"><enum>(I)</enum><header>In
			 general</header><text>A member who, at the time of conversion, is in step 13 of
			 any rank below Deputy Chief, is entitled to that rate of basic pay which is the
			 greater of—</text>
								<item id="ID260935f512f3478091b4e7af4dcde450"><enum>(aa)</enum><text>the
			 rate of pay for step 13 under the new salary schedule; or</text>
								</item><item id="IDc59ced99fa1e4bcdb52e03801196913e"><enum>(bb)</enum><text>the
			 rate of pay for step 14 under the pay schedule in effect immediately before
			 conversion.</text>
								</item></subclause><subclause id="idD2BF1FF71DF945D7B9F880F2463116F6"><enum>(II)</enum><header>Step 14
			 rate</header><text>Clause (iv) shall apply to a member whose pay is set in
			 accordance with subclause (I)(bb).</text>
							</subclause></clause><clause id="ID643b0a1a38914791a2d8347a57a26453"><enum>(iv)</enum><header>Adjustment
			 based on former rate of pay</header>
							<subclause id="id3F5750E09CFA429580163E9AE9450016"><enum>(I)</enum><header>Definition</header><text>In
			 this clause, the term <quote>former rate of basic pay</quote> means the rate of
			 basic pay last received by a member before the conversion.</text>
							</subclause><subclause id="id23B3E2E250CA46F0BACC9AAEA6457EF0"><enum>(II)</enum><header>In
			 general</header><text>If, as a result of conversion to the new salary schedule,
			 the member's former rate of basic pay is greater than the maximum rate of basic
			 pay payable for the rank of the member's position immediately after the
			 conversion, the member is entitled to basic pay at a rate equal to the member's
			 former rate of basic pay, and increased at the time of any increase in the
			 maximum rate of basic pay payable for the rank of the member's position by 50
			 percent of the dollar amount of each such increase.</text>
							</subclause><subclause id="id200491AC08CF423DB60692DB5DD85026"><enum>(III)</enum><header>Promotions</header><text>For
			 the purpose of applying section 10207 of title 5, United States Code, relating
			 to promotions, (as added by section 3(a) of this Act) an employee receiving a
			 rate above the maximum rate as provided under this clause shall be deemed to be
			 at step 13.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="IDd546e7aac9734f01a11ee099ce129aea"><enum>(2)</enum><header>Credit for
			 Service</header><text>Each member whose position is converted to the salary
			 schedule under chapter 102 of title 5, United States Code, (as added by section
			 3(a) of this Act) in accordance with this subsection shall be granted credit
			 for purposes of such member’s first service step adjustment made after
			 conversion to the salary schedule under that chapter for all satisfactory
			 service performed by the member since the member’s last increase in basic pay
			 before the adjustment under this section.</text>
				</paragraph><paragraph id="IDf6358ff6392241be8f1cda9af5ee2a9f"><enum>(3)</enum><header>Adjustments
			 during transition</header><text>The schedule of rates of basic pay shall be
			 increased by the percentage of any annual adjustment applicable to the General
			 Schedule authorized under section 5303 of title 5, United States Code, or any
			 other authority, which takes effect during the period which begins on the date
			 of enactment of this Act through the day before the effective date of this Act.
			 The Secretary of Homeland Security may establish a methodology of schedule
			 adjustment that results in uniform fixed-dollar step increments within any
			 given rank and preserves the established percentage differences among rates of
			 different ranks at the same step position.</text>
				</paragraph></subsection><subsection id="IDd55904d77792445ea1772b498c9c5827"><enum>(b)</enum><header>Impact on
			 benefits under the District of Columbia Police and Firefighters’ Retirement and
			 Disability System</header>
				<paragraph id="IDe6882990bf9943069f49b91b35e06ebf"><enum>(1)</enum><header>Salary
			 Increases for Purposes of Certain Pensions and Allowances</header>
					<subparagraph id="IDc87931baf45844e0b229a13ad08e6184"><enum>(A)</enum><header>Deemed
			 increase</header><text>The increases in pay as a result of this Act shall be
			 deemed to be an increase of 2.93 percent in salary of current members for the
			 purposes of section 5–744 or section 5–745 of the District of Columbia
			 Code.</text>
					</subparagraph><subparagraph id="IDfb2a52f29851411d8b6dd21fb78877e2"><enum>(B)</enum><header>Conversion and
			 initial adjustment</header><text>The conversion of positions and members of the
			 United States Secret Service Uniformed Division to appropriate ranks in the
			 salary schedule under section 5–545.01(c) of the District of Columbia Code, and
			 the initial adjustments of rates of basic pay of those positions and
			 individuals in accordance with section 5-561.02(a) of the District of Columbia
			 Code, shall not be treated as an increase in salary for purposes of section
			 5–744 or section 5–745 of the District of Columbia Code.</text>
					</subparagraph></paragraph><paragraph id="ID49cb788c808745b2a203a36643dd4fe8"><enum>(2)</enum><header>Treatment of
			 Retirement Benefits and Pensions of Current and Former
			 Members</header><text>Except as otherwise provided in this Act, nothing in this
			 Act shall affect retirement benefits and pensions of current members and former
			 members who have retired under the District of Columbia Police and
			 Firefighters' Retirement and Disability System.</text>
				</paragraph></subsection></section><section id="IDb05bf837d3494b9d9e3a47201458611a"><enum>5.</enum><header>Technical and
			 conforming amendments</header>
			<subsection id="IDdcb162b543fa4676ac98b4fb8fe78ee8"><enum>(a)</enum><header>In
			 General</header><text>To the extent that any provision of the District of
			 Columbia Code that authorizes an entitlement to pay or hours of work for
			 current members of the United States Secret Service Uniformed Division is not
			 expressly revoked by this Act, such provision shall not apply to such members
			 after the effective date of this Act.</text>
			</subsection><subsection id="IDb55c0870b1384e7287eea2efb6b7be43"><enum>(b)</enum><header>Technical and
			 conforming amendments to the District of Columbia Code</header><text>The
			 District of Columbia Code is amended as follows:</text>
