		<section id="H0016A2AEB7B24DD98C07341F622C5E41" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Improper Payments Elimination and
			 Recovery Act of 2009</short-title></quote>.</text>
		</section><section id="H27BE3BCBE5B04D548C51FBE8B32C157F"><enum>2.</enum><header>Improper Payments
			 Elimination and Recovery</header>
			<subsection id="HC4B21379C6444173AD9D3E007CD234E1"><enum>(a)</enum><header>Susceptible
			 programs and activities</header><text>Section 2 of the Improper Payments
			 Information Act of 2002 (31 U.S.C. 3321 note) is amended by striking subsection
			 (a) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idE026986B2AD9477D8F583BC9CC9CA145" style="OLC">
					<subsection id="IDa0f391b16b5a46448f883099b3979492"><enum>(a)</enum><header>Identification
				of susceptible programs and activities</header>
						<paragraph id="IDf3ef8ec9a91140cc8da7d18d69cd2494"><enum>(1)</enum><header>In
				general</header><text>The head of each agency shall, in accordance with
				guidance prescribed by the Director of the Office of Management and Budget,
				periodically review all programs and activities that the relevant agency head
				administers and identify all programs and activities that may be susceptible to
				significant improper payments.</text>
						</paragraph><paragraph id="ID05d09c837e474ec4aac5d984c3222456"><enum>(2)</enum><header>Frequency</header><text>Reviews
				under paragraph (1) shall be performed for each program and activity that the
				relevant agency head administers during the year after which the
				<short-title>Improper Payments Elimination and Recovery
				Act of 2009</short-title> is enacted and at least once every 3 fiscal years
				thereafter.</text>
						</paragraph><paragraph id="ID23fd346fbb7b4631a251c9b05f235cb3"><enum>(3)</enum><header>Risk
				assessments</header>
							<subparagraph id="IDf71d45c46bac4d8f98ccd68a1ea7cc82"><enum>(A)</enum><header>Definition</header><text>In
				this subsection the term <term>significant</term> means—</text>
								<clause id="idD5E3C7D52A1B4171B40714428E0ADB85"><enum>(i)</enum><text>except as
				provided under clause (ii), that improper payments in the program or activity
				in the preceding fiscal year may have exceeded—</text>
									<subclause id="ID43e81c45cf844773991c9bf161bed4d2"><enum>(I)</enum><text>$10,000,000 of
				all program or activity payments made during that fiscal year reported and 2.5
				percent of program outlays; or</text>
									</subclause><subclause id="ID15ba02c82462434db572fd31c95f4eba"><enum>(II)</enum><text>$100,000,000;
				and</text>
									</subclause></clause><clause id="id04E75C6C43F74CFEACB3567EC3045579"><enum>(ii)</enum><text>with respect to
				fiscal years following September 30th of a fiscal year beginning before fiscal
				year 2013 as determined by the Office of Management and Budget, that improper
				payments in the program or activity in the preceding fiscal year may have
				exceeded—</text>
									<subclause id="idC212B540CA164B5E823FE609B6D4945B"><enum>(I)</enum><text>$10,000,000 of
				all program or activity payments made during that fiscal year reported and 1.5
				percent of program outlays; or</text>
									</subclause><subclause id="idB2058D0A784D43D39DBE8D28CCF9FDC4"><enum>(II)</enum><text>$100,000,000.</text>
									</subclause></clause></subparagraph><subparagraph id="ID2def0c72def14f45826b90a43d12c14a"><enum>(B)</enum><header>Scope</header><text>In
				conducting the reviews under paragraph (1), the head of each agency shall take
				into account those risk factors that are likely to contribute to a
				susceptibility to significant improper payments, such as—</text>
								<clause id="ID3687851a927c4fbe8875da19959133c0"><enum>(i)</enum><text>whether the
				program or activity reviewed is new to the agency;</text>
								</clause><clause id="IDea689fb226a3422f91a05e1b64477104"><enum>(ii)</enum><text>the complexity
				of the program or activity reviewed;</text>
								</clause><clause id="ID5edb2a28ec254cb6bd0e55d01479dc6d"><enum>(iii)</enum><text>the volume of
				payments made through the program or activity reviewed;</text>
								</clause><clause id="ID0c298fc8d7794cd6be76cba654f9ec7f"><enum>(iv)</enum><text>whether payments
				or payment eligibility decisions are made outside of the agency, such as by a
				State or local government;</text>
								</clause><clause id="ID81551c0643084c13b3c45772b0896a31"><enum>(v)</enum><text>recent major
				changes in program funding, authorities, practices, or procedures;</text>
								</clause><clause id="ID6390e4f7edc24975be71a1a7cb56b4d5"><enum>(vi)</enum><text>the level and
				quality of training for personnel responsible for making program eligibility
				determinations or certifying that payments are accurate; and</text>
								</clause><clause id="ID3e0cd65ab5a94d8bbe8947c7b80d63c6"><enum>(vii)</enum><text>significant
				deficiencies in the audit report of the agency or other relevant management
				findings that might hinder accurate payment
				certification.</text>
								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDbfc3002241c443e3987567fb995420e9"><enum>(b)</enum><header>Estimation of
			 improper payments</header><text>Section 2 of the Improper Payments Information
			 Act of 2002 (31 U.S.C. 3321 note) is amended by striking subsection (b) and
			 inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idD8C8C21C056944699F1718DDC21252EF" style="OLC">
					<subsection id="IDbc901e88b7d4476e9a83a0abb03696ee"><enum>(b)</enum><header>Estimation of
				improper payments</header><text>With respect to each program and activity
				identified under subsection (a), the head of the relevant agency shall—</text>
						<paragraph id="ID78cfa573f99f4b13a12f3df6a05dcee3"><enum>(1)</enum><text>produce a
				statistically valid or otherwise appropriate estimate of the improper payments
				made by each program and activity; and</text>
						</paragraph><paragraph id="IDd5efbd56729f4cd4a78f3cc13608247b"><enum>(2)</enum><text>include those
				estimates in the accompanying materials to the annual financial statement of
				the agency required under section 3515 of title 31, United States Code, or
				similar provision of law and applicable guidance of the Office of Management
				and
				Budget.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H20C0190C628242F7B8E5FCCFC0B63003"><enum>(c)</enum><header>Reports on
			 actions To reduce improper payments</header><text>Section 2 of the Improper
			 Payments Information Act of 2002 (31 U.S.C. 3321 note) is amended by striking
			 subsection (c) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H9B3735C3060641EFBC5C1FB796A5BC55" style="OLC">
					<subsection id="HBD0C64F9FC6847FE846E16FE20B82F09"><enum>(c)</enum><header>Reports on
				actions To reduce improper payments</header><text>With respect to any program
				or activity of an agency with estimated improper payments under subsection (b),
				the head of the agency shall provide with the estimate under subsection (b) a
				report on what actions the agency is taking to reduce improper payments,
				including—</text>
						<paragraph id="HA810E4EF869E428487D7D8F3E597B22"><enum>(1)</enum><text>a description of
				the causes of the improper payments, actions planned or taken to correct those
				causes, and the planned or actual completion date of the actions taken to
				address those causes;</text>
						</paragraph><paragraph id="H2307F23F9A994442AAC14E37F55F1C20"><enum>(2)</enum><text>in order to reduce
				improper payments to a level below which further expenditures to reduce
				improper payments would cost more than the amount such expenditures would save
				in prevented or recovered improper payments, a statement of whether the agency
				has what is needed with respect to—</text>
							<subparagraph id="HDD5A1E90937547FEB854F2E2F1C19902"><enum>(A)</enum><text>internal
				controls;</text>
							</subparagraph><subparagraph id="HBCA60D611DD2469684308100DB0000F5"><enum>(B)</enum><text>human capital;
				and</text>
							</subparagraph><subparagraph id="H883D8108CC5043009EC38D032200D2DC"><enum>(C)</enum><text>information
				systems and other infrastructure;</text>
							</subparagraph></paragraph><paragraph id="H3654CF356D474CDC8D52BD1F14A5AA23"><enum>(3)</enum><text>if the agency does
				not have sufficient resources to establish and maintain effective internal
				controls under paragraph (2)(A), a description of the resources the agency has
				requested in its budget submission to establish and maintain such internal
				controls;</text>
						</paragraph><paragraph id="ID9b6e2b4d89bc4fb9b12f09347eaa3a46"><enum>(4)</enum><text>program-specific
				and activity-specific improper payments reduction targets that have been
				approved by the Director of the Office of Management and Budget; and</text>
						</paragraph><paragraph id="IDfe9044bc0a654792812ec0904dc34ab8"><enum>(5)</enum><text>a description of
				the steps the agency has taken to ensure that agency managers, programs, and,
				where appropriate, States and localities are held accountable through annual
				performance appraisal criteria for—</text>
							<subparagraph id="ID57cc92e849a94e8e8e767bdf18e9f333"><enum>(A)</enum><text>meeting
				applicable improper payments reduction targets; and</text>
							</subparagraph><subparagraph id="ID7208d28fdacd4b90aeafeb5ca065d1e8"><enum>(B)</enum><text>establishing and
				maintaining sufficient internal controls, including an appropriate control
				environment, that effectively—</text>
								<clause id="ID0febe0c5b35b43b180230ab6f50788a4"><enum>(i)</enum><text>prevent improper
				payments from being made; and</text>
								</clause><clause id="IDea16f8e089c840ecbaabb9a7849cc958"><enum>(ii)</enum><text>promptly detect
				and recover improper payments that are
				made.</text>
								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H346959F50F87440099B783A74B91B103"><enum>(d)</enum><header>Reports on
			 Actions To recover improper payments</header><text>Section 2 of the Improper
			 Payments Information Act of 2002 (31 U.S.C. 3321 note) is amended—</text>
				<paragraph id="H28ABFF5A3A6A46DD897F1DF91523A87"><enum>(1)</enum><text>by
			 striking subsection (e);</text>
				</paragraph><paragraph id="H3DE5237C967344BB88DE007C5131AAB7"><enum>(2)</enum><text>by redesignating
			 subsections (d) and (f) as subsections (f) and (g), respectively; and</text>
				</paragraph><paragraph id="H00A0DF81C86540BEAF906BEA25FE342"><enum>(3)</enum><text>by
			 inserting after subsection (c) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H4537360CE00A4A4A814FB4A9E55BDA02" style="OLC">
						<subsection id="HCEE2A5BA9CC947AAA507555F52E339AF"><enum>(d)</enum><header>Reports on
				Actions To Recover Improper Payments</header><text>With respect to any improper
				payments identified in recovery audits conducted under section 2(h) of the
				Improper Payments Elimination and Recovery Act of 2009 (31 U.S.C. 3321 note),
				the head of the agency shall provide with the estimate under subsection (b) a
				report on all actions the agency is taking to recover improper payments,
				including—</text>
							<paragraph id="H06B198E85CAB49990042D13B91F0B0B2"><enum>(1)</enum><text>a discussion of
				the methods used by the agency to recover overpayments;</text>
							</paragraph><paragraph id="H4D9EBC438BDE46998D8D1DA3C4982933"><enum>(2)</enum><text>the amounts
				recovered, outstanding, and determined to not be collectable, including the
				percent such amounts represent of the total overpayments of the agency;</text>
							</paragraph><paragraph id="idB82ACF9F0D144D83A77A007A2F0EC618"><enum>(3)</enum><text>if a
				determination has been made that certain overpayments are not collectable, a
				justification for that determination;</text>
							</paragraph><paragraph id="H1FA5EFDA7C0B4766BBCA1FE25B92B257"><enum>(4)</enum><text>an aging schedule
				of the amounts outstanding;</text>
							</paragraph><paragraph id="id4B6F6AAF65204D61B006C8713EE3C381"><enum>(5)</enum><text>a summary of how
				recovered amounts have been disposed of;</text>
							</paragraph><paragraph id="id0963376CFCA548B493846574AD42FAC2"><enum>(6)</enum><text>a discussion of
				any conditions giving rise to improper payments and how those conditions are
				being resolved; and</text>
							</paragraph><paragraph id="idF8BDC4C2063444FDAD08A1A245E0030B"><enum>(7)</enum><text>if the agency has
				determined under section 2(h) of the Improper Payments Elimination and Recovery
				Act of 2009 (31 U.S.C. 3321 note) that performing recovery audits for any
				applicable program or activity is not cost effective, a justification for that
				determination.</text>
							</paragraph></subsection><subsection id="ID1e86927d58f543399ca059ed4df313ef"><enum>(e)</enum><header>Governmentwide
				reporting of improper payments and actions To recover improper
				payments</header>
							<paragraph id="idE2925F2D6E7F4DFDB4D1A4D23DBAAB95"><enum>(1)</enum><header>Report</header><text>Each
				fiscal year the Director of the Office of Management and Budget shall submit a
				report with respect to the preceding fiscal year on actions agencies have taken
				to report information regarding improper payments and actions to recover
				improper payments to—</text>
								<subparagraph id="idF6F1F25E45814EEFB60B035A43EDDE1F"><enum>(A)</enum><text>the Committee on
				Homeland Security and Governmental Affairs of the Senate;</text>
								</subparagraph><subparagraph id="id5BC2A61ACABC4C1DBBE6919DE1DA9DEF"><enum>(B)</enum><text>the Committee on
				Oversight and Government Reform of the House of Representatives; and</text>
								</subparagraph><subparagraph id="id00260CEE29AE4475805B3EAC9F336983"><enum>(C)</enum><text>the Comptroller
				General.</text>
								</subparagraph></paragraph><paragraph id="idC873C14B79384515A90FE01EE5B0719C"><enum>(2)</enum><header>Contents</header><text>Each
				report under this subsection shall include—</text>
								<subparagraph id="IDc5dbed049f1845f1805aa3985ed9fc5c"><enum>(A)</enum><text>a summary of the
				reports of each agency on improper payments and recovery actions submitted
				under this section;</text>
								</subparagraph><subparagraph id="ID8557d90ca1b346958eff63162cd7a464"><enum>(B)</enum><text>an identification
				of the compliance status of each agency to which this Act applies;</text>
								</subparagraph><subparagraph id="ID234646e8ac6749238015503221b6431a"><enum>(C)</enum><text>governmentwide
				improper payment reduction targets; and</text>
								</subparagraph><subparagraph id="ID3da1e08037054e44b26043efdc396d31"><enum>(D)</enum><text>a discussion of
				progress made towards meeting governmentwide improper payment reduction
				targets.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HBA15103F3B7A48FCA1703EE906B584FB"><enum>(e)</enum><header>Definitions</header><text>Section
			 2 of the Improper Payment Information Act of 2002 (31 U.S.C. 3321 note) is
			 amended by striking subsections (f) (as redesignated by this section) and
			 inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H3221F458928947C0A1CC9C99A1B8F61D" style="OLC">
					<subsection id="H01BFE5C7495C487C9958C269EE4672C"><enum>(f)</enum><header>Definitions</header><text>In
				this section:</text>
						<paragraph id="HC3D0A5A6CB2048EAB7A0330036AFACA0"><enum>(1)</enum><header>Agency</header><text>The
				term <term>agency</term> means an executive agency, as that term is defined in
				section 102 of title 31, United States Code.</text>
						</paragraph><paragraph id="HADE0E089967143A09F064396C3BE8740"><enum>(2)</enum><header>Improper
				payment</header><text>The term <term>improper payment</term>—</text>
							<subparagraph id="HC212B4DE501B46D2A9CC556C38E50072"><enum>(A)</enum><text>means any payment
				that should not have been made or that was made in an incorrect amount
				(including overpayments and underpayments) under statutory, contractual,
				administrative, or other legally applicable requirements; and</text>
							</subparagraph><subparagraph id="HDD96F4206BE24152B875C1C41EF3385"><enum>(B)</enum><text>includes any
				payment to an ineligible recipient, any payment for an ineligible good or
				service, any duplicate payment, any payment for a good or service not received
				(except for such payments where authorized by law), and any payment that does
				not account for credit for applicable discounts.</text>
							</subparagraph></paragraph><paragraph id="H8BC0B6AC4B164A72993EEC74F4237FC6"><enum>(3)</enum><header>Payment</header><text>The
				term <term>payment</term> means any transfer or commitment for future transfer
				of Federal funds such as cash, securities, loans, loan guarantees, and
				insurance subsidies to any non-Federal person or entity, that is made by a
				Federal agency, a Federal contractor, a Federal grantee, or a governmental or
				other organization administering a Federal program or activity.</text>
						</paragraph><paragraph id="H50673360DE674C5E93DA878B21068233"><enum>(4)</enum><header>Payment for an
				ineligible good or service</header><text>The term <term>payment for an
				ineligible good or service</term> shall include a payment for any good or
				service that is rejected under any provision of any contract, grant, lease,
				cooperative agreement, or any other procurement
				mechanism.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC21F962A0A834A56B9AB3BBDF1E5E0CD"><enum>(f)</enum><header>Guidance by the
			 Office of Management and Budget</header><text>Section 2 of the Improper
			 Payments Information Act of 2002 (31 U.S.C. 3321 note) is amended by striking
			 subsection (g) (as redesignated by this section) and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HEFF68BD4A1334139B0818FC96CC4D848" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="HC1FAFE489B9D468A9B5D33FEA633BCC3"><enum>(g)</enum><header>Guidance by the
				office of management and Budget</header>
						<paragraph id="H2B463E4B1B4C4A88BD8DACC699C7AB78"><enum>(1)</enum><header>In
				general</header><text>Not later than 6 months after the date of enactment of
				the Improper Payments Elimination and Recovery Act of 2009, the Director of the
				Office of Management and Budget shall prescribe guidance for agencies to
				implement the requirements of this section. The guidance shall not include any
				exemptions to such requirements not specifically authorized by this
				section.</text>
						</paragraph><paragraph id="H6369C21764F44048A504FB6588F496B6"><enum>(2)</enum><header>Contents</header><text>The
				guidance under paragraph (1) shall prescribe—</text>
							<subparagraph id="H497763B6CAA14DEE9453CFC36CC64EFE"><enum>(A)</enum><text>the form of the
				reports on actions to reduce improper payments, recovery actions, and
				governmentwide reporting; and</text>
							</subparagraph><subparagraph id="H57D863D4B4334F539CDFD73D9B1BAF63"><enum>(B)</enum><text>strategies for
				addressing risks and establishing appropriate prepayment and postpayment
				internal
				controls.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="H3E0181B01CB74E8C971C0304C3B91931"><enum>(g)</enum><header>Determination of
			 agency readiness for opinion on internal control</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
			 enactment of this Act, the Director of the Office of Management and Budget
			 shall develop—</text>
				<paragraph id="HB72B7ADCC87542EBAEFCD3D8ACC569F6"><enum>(1)</enum><text>specific criteria
			 as to when an agency should initially be required to obtain an opinion on
			 internal control over financial reporting; and</text>
				</paragraph><paragraph id="HCCF754DD628E421D8FA8B4BD447BFC71"><enum>(2)</enum><text>criteria for an
			 agency that has demonstrated a stabilized, effective system of internal control
			 over financial reporting, whereby the agency would qualify for a multiyear
			 cycle for obtaining an audit opinion on internal control over financial
			 reporting, rather than an annual cycle.</text>
				</paragraph></subsection><subsection id="IDe00198204dd4413f96f3879baf889e8e"><enum>(h)</enum><header>Recovery
			 audits</header>
				<paragraph id="id16253A6EFE3A40598CD72072A97855BD"><enum>(1)</enum><header>Definition</header><text>In
			 this subsection, the term <term>agency</term> has the meaning given under
			 section 2(f) of the Improper Payments Information Act of 2002 (31 U.S.C. 3321
			 note) as redesignated by this Act.</text>
				</paragraph><paragraph id="ID1657c55c83354394ae6a792fe1d3ecb8"><enum>(2)</enum><header>In
			 general</header>
					<subparagraph id="idF3498B7AD95A4890B688728785E0C624"><enum>(A)</enum><header>Conduct of
			 audits</header><text>Except as provided under paragraph (4) and if not
			 prohibited under any other provision of law, the head of each agency shall
			 conduct recovery audits with respect to each program and activity of the agency
			 that expends $1,000,000 or more annually if conducting such audits would be
			 cost-effective.</text>
					</subparagraph><subparagraph id="ID49cf23a76978464da9c1b369b7374168"><enum>(B)</enum><header>Procedures</header><text>In
			 conducting recovery audits under this subsection, the head of an agency—</text>
						<clause id="ID9e56880d174f4f7fab2a06eae046c4a8"><enum>(i)</enum><text>shall give
			 priority to the most recent payments and to payments made in any program or
			 programs identified as susceptible to significant improper payments under
			 section 2(a) of the Improper Payments Information Act of 2002 (31 U.S.C. 3321
			 note);</text>
						</clause><clause id="ID76e7ae299e434e2794bd4260435ec34c"><enum>(ii)</enum><text>shall implement
			 this subsection in a manner designed to ensure the greatest financial benefit
			 to the Government; and</text>
						</clause><clause id="IDba265ba8ed6d4c788cb91ff59dc6ca86"><enum>(iii)</enum><text>may conduct
			 recovery audits directly, by procuring performance of recovery audits by
			 contract (subject to the availability of appropriations), or by any combination
			 thereof.</text>
						</clause></subparagraph><subparagraph id="ID24b6513e3718442d819c382fc86c3fb4"><enum>(C)</enum><header>Recovery audit
			 contracts</header><text>With respect to recovery audits procured by an agency
			 by contract—</text>
						<clause id="ID7629a0519d9a46b19938f5154814eb11"><enum>(i)</enum><text>subject to
			 subparagraph (B)(iii), the head of the agency may authorize the contractor to
			 notify entities (including persons) of potential overpayments made to such
			 entities, respond to questions concerning potential overpayments, and take
			 other administrative actions with respect to overpayment claims made or to be
			 made by the agency; and</text>
						</clause><clause id="ID4cbcf06abb1b45a3b46ee7f04208c5e2"><enum>(ii)</enum><text>such contractor
			 shall have no authority to make final determinations relating to whether any
			 overpayment occurred and whether to compromise, settle, or terminate
			 overpayment claims.</text>
						</clause></subparagraph><subparagraph id="ID6af65dbcad6d40c8b5d61fb6f984ab94"><enum>(D)</enum><header>Contract terms
			 and conditions</header><text>The agency shall include in each contract for
			 procurement of performance of a recovery audit a requirement that the
			 contractor shall—</text>
						<clause id="IDe9d5399a09e048e5a0d0a6d70faba2f4"><enum>(i)</enum><text>provide to the
			 agency periodic reports on conditions giving rise to overpayments identified by
			 the contractor and any recommendations on how to mitigate such conditions;
			 and</text>
						</clause><clause id="ID05f3c1815f4748a9ac313d8f7e9900e2"><enum>(ii)</enum><text>notify the
			 agency of any overpayments identified by the contractor pertaining to the
			 agency or to any other agency or agencies that are beyond the scope of the
			 contract.</text>
						</clause></subparagraph><subparagraph id="ID27cf03bd8b5b40beaef07e9adaa5244a"><enum>(E)</enum><header>Agency action
			 following notification</header><text>An agency shall take prompt and
			 appropriate action in response to a report or notification by a contractor
			 under subparagraph (D)(ii), to collect overpayments and shall forward to other
			 agencies any information that applies to such agencies.</text>
					</subparagraph></paragraph><paragraph id="ID731c65f74f1a490991fd6862fc4d764d"><enum>(3)</enum><header>Disposition of
			 amounts recovered</header>
					<subparagraph id="ID6c5c9ec84aa54e0e9c7d0fecfd0bec6c"><enum>(A)</enum><header>In
			 general</header><text>Amounts collected by agencies each fiscal year through
			 recovery audits conducted under this subsection shall be treated in accordance
			 with this paragraph.</text>
					</subparagraph><subparagraph id="IDa58e216368dc4ce8adcf3173b3dd993e"><enum>(B)</enum><header>Use for
			 financial management improvement program</header><text>Not more than 25 percent
			 of the amounts collected by an agency through recovery audits—</text>
						<clause id="IDd725a9c3e9714175a6107f9e709c8aec"><enum>(i)</enum><text>shall be
			 available, subject to appropriation, to the head of the agency or the State or
			 local government administering the program or activity to carry out the
			 financial management improvement program of the agency under paragraph
			 (4);</text>
						</clause><clause id="ID8f103da472f248f796a613558810cbbc"><enum>(ii)</enum><text>may be credited,
			 if applicable, for that purpose by the head of an agency to any agency
			 appropriations and funds that are available for obligation at the time of
			 collection; and</text>
						</clause><clause id="ID5c8172524fe546709f06c73896644281"><enum>(iii)</enum><text>shall be used
			 to supplement and not supplant any other amounts available for that purpose and
			 shall remain available until expended.</text>
						</clause></subparagraph><subparagraph id="ID294135ace01b434ca444d5bad4fae576"><enum>(C)</enum><header>Use for
			 original purpose</header><text>Not more than 25 percent of the amounts
			 collected by an agency—</text>
						<clause id="ID7ee7a3bceb0e41e1beb55e57f29ade80"><enum>(i)</enum><text><deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">shall be credited
			 to the appropriation or fund, if any, available for obligation at the time of
			 collection </deleted-phrase><added-phrase committee-id="SSGA00" reported-display-style="italic"> shall be deposited and available subject to
			 appropriation</added-phrase> for the same general purposes as the appropriation
			 or fund from which the overpayment was made; and</text>
						</clause><clause id="IDded87493dc834481b4e1039ff1e2fdd3"><enum>(ii)</enum><text>shall remain
			 available for the same period and purposes as the appropriation or fund to
			 which credited.</text>
						</clause></subparagraph><subparagraph id="id669F53E2562842CF843236EF740A13DC"><enum>(D)</enum><header>Use for
			 inspector general activities</header><text>Not more than 5 percent of the
			 amounts collected by an agency shall be available, subject to appropriation, to
			 the Inspector General of that agency for—</text>
						<clause id="id7754323F7E264531845097193747011E"><enum>(i)</enum><text>the
			 Inspector General to carry out this Act; or</text>
						</clause><clause id="idDB83FCE296C24F888C6F30040683F16F"><enum>(ii)</enum><text>any other
			 activities of the Inspector General relating to investigating improper payments
			 or auditing internal controls associated with payments.</text>
						</clause></subparagraph><subparagraph id="ID41e708d5c1564e06911351170a263e36"><enum>(E)</enum><header>Deposit of
			 proceeds</header><text>Funds made available under subparagraphs (B) and (D) by
			 appropriations shall be—</text>
						<clause id="id0DADEFED4857452CBF9A98BD67A07F6D"><enum>(i)</enum><text>deposited into
			 the appropriate program integrity accounts of the agency or the State or local
			 government administering the program or activity; and</text>
						</clause><clause id="id606775F0FDBD4C4C9D024698C28F8C45"><enum>(ii)</enum><text>expended only as
			 authorized in annual appropriations Acts.</text>
						</clause></subparagraph><subparagraph id="IDe2cab6b54d684ad28b605083e7627caf"><enum>(F)</enum><header>Remainder</header><text>Amounts
			 collected that are not applied in accordance with subparagraphs (B), (C), or
			 (D) or to meet obligations to recovery audit contractors shall be deposited in
			 the Treasury as miscellaneous receipts.</text>
					</subparagraph><subparagraph id="id080EACDD0B944A6B9E9C1B2054BBC89F"><enum>(G)</enum><header>Exceptions
			 relating to entitlement and tax credit programs</header><text>This paragraph
			 shall not apply to amounts collected through recovery audits conducted under
			 this subsection relating to—</text>
						<clause id="id78CBDCCB807F466B90C69F99BCD45983"><enum>(i)</enum><text>entitlement
			 programs under section 3(9) of the Congressional Budget and Impoundment Control
			 Act of 1974 (2 U.S.C. 622(9)); or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID348ecdbfb243442fb4830bdfe819c3b2"><enum>(ii)</enum><text>tax credit
			 programs under the Internal Revenue Code of 1986.</text>
						</clause></subparagraph></paragraph><paragraph id="IDb34d73c71b754dd2b3ca4bfd66ce5c5b"><enum>(4)</enum><header>Financial
			 management improvement program</header>
					<subparagraph id="ID47024211e048410384c6a428c996584f"><enum>(A)</enum><header>Requirement</header><text>The
			 head of each agency shall conduct a financial management improvement program,
			 consistent with rules prescribed by the Director of the Office of Management
			 and Budget.</text>
					</subparagraph><subparagraph id="ID27d640a9247141ccb15881826657479d"><enum>(B)</enum><header>Program
			 features</header><text>In conducting the program, the head of the
			 agency—</text>
						<clause id="IDf636d7e438154a03aadaaa0ab0136f65"><enum>(i)</enum><text>shall, as the
			 first priority of the program, address problems that contribute directly to
			 agency improper payments; and</text>
						</clause><clause id="id4E2E771C4C1044B289038D5660E4BB4A"><enum>(ii)</enum><text>may seek to
			 reduce errors and waste in other agency programs and operations.</text>
						</clause></subparagraph></paragraph><paragraph id="idEE6D88A22E604DFCA366239FD828668B"><enum>(5)</enum><header>Other recovery
			 audit requirements</header>
					<subparagraph id="idE9117691C0794D53BE097CD7CB9BEA4E"><enum>(A)</enum><header>In
			 general</header><text>Subchapter VI of chapter 35 of title 31, United States
			 Code, is repealed.</text>
					</subparagraph><subparagraph id="id9A2B8B2B42EB4C72B89D99A0F73DF146"><enum>(B)</enum><header>Technical and
			 conforming amendments</header>
						<clause id="id20FB688E9ABE43888933DB383634E16B"><enum>(i)</enum><header>Table of
			 sections</header><text>The table of sections for chapter 35 of title 31, United
			 States Code, is amended by striking the matter relating to subchapter
			 VI.</text>
						</clause><clause id="idB68B97C3A0124FF897ED0D4F6E8F995C"><enum>(ii)</enum><header>Definition</header><text>Section
			 3501 of title 31, United States Code, is amended by striking <quote>and
			 subchapter VI of this title</quote>.</text>
						</clause><clause id="idF7D7778ABCB94939B4CD89C7D53D24E8"><enum>(iii)</enum><header>Homeland
			 security grants</header><text>Section 2022(a)(6) of the Homeland Security Act
			 of 2002 (6 U.S.C. 612(a)(6)) is amended by striking <quote>(as that term is
			 defined by the Director of the Office of Management and Budget under section
			 3561 of title 31, United States Code)</quote> and inserting <quote>under
			 section 2(h) of the Improper Payments Elimination and Recovery Act of 2009 (31
			 U.S.C. 3321 note)</quote>.</text>
						</clause></subparagraph></paragraph><paragraph id="id755C95A1617E42B3BF0AB01AC6D3390C"><enum>(6)</enum><header>Rule of
			 construction</header><text>Except as provided under paragraph (5), nothing in
			 this section shall be construed as terminating or in any way limiting
			 authorities that are otherwise available to agencies under existing provisions
			 of law to recover improper payments and use recovered amounts.</text>
				</paragraph></subsection><subsection id="HD28FB533FB184AA394FE927EFA45A3BC"><enum>(i)</enum><header>Report on
			 Recovery Auditing</header><text>Not later than 2 years after the date of the
			 enactment of this Act, the Chief Financial Officers Council established under
			 section 302 of the Chief Financial Officers Act of 1990 (31 U.S.C. 901 note),
			 in consultation with the Council of Inspectors General on Integrity and
			 Efficiency established under section 7 of the Inspector General Reform Act of
			 2009 (Public Law 110–409) and recovery audit experts, shall conduct a study
			 of—</text>
				<paragraph id="id7BE724D24E73488DA20045ACFA56F2A7"><enum>(1)</enum><text>the
			 implementation of subsection (h);</text>
				</paragraph><paragraph id="id70B33850B5DE4D00AA29BD8097C8C0ED"><enum>(2)</enum><text>the costs and
			 benefits of agency recovery audit activities, including those under subsection
			 (h), and including the effectiveness of using the services of—</text>
					<subparagraph id="H1084FED222514B46BF93B2D2D40100D1"><enum>(A)</enum><text>private
			 contractors;</text>
					</subparagraph><subparagraph id="H40E6AAC6CC40464596718C88F37861AF"><enum>(B)</enum><text>agency
			 employees;</text>
					</subparagraph><subparagraph id="HD1B93211C0AB46C19C9227CF351C4D60"><enum>(C)</enum><text>cross-servicing
			 from other agencies; or</text>
					</subparagraph><subparagraph id="HA19031EB895D41AB80074789AD83CF4"><enum>(D)</enum><text>any combination of
			 the provision of services described under subparagraphs (A) through (C);
			 and</text>
					</subparagraph></paragraph><paragraph id="H8542858CDB734D0C993C883700765500"><enum>(3)</enum><text>submit a report on
			 the results of the study to—</text>
					<subparagraph id="H6F145669BEC64F9793F84DC07E00022D"><enum>(A)</enum><text>the Committee on
			 Homeland Security and Governmental Affairs of the Senate;</text>
					</subparagraph><subparagraph id="HE1140F6CC5784CEB878480845B61E690"><enum>(B)</enum><text>the Committee on
			 Oversight and Government Reform of the House of Representatives; and</text>
					</subparagraph><subparagraph id="HD718F486C0314B7C8385C47D1C959FB6"><enum>(C)</enum><text>the Comptroller
			 General.</text>
					</subparagraph></paragraph></subsection></section><section id="HA57F11183E424AE3979DBD21DBD228FD"><enum>3.</enum><header>Compliance</header>
			<subsection id="H12A696C39CAA4DCAA872B3DE81213CE"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H60AAF8C8B7864E4D857547B1EC3BFB3"><enum>(1)</enum><header>Agency</header><text>The
			 term <term>agency</term> has the meaning given under section 2(f) of the
			 Improper Payments Information Act of 2002 (31 U.S.C. 3321 note) as redesignated
			 by this Act.</text>
				</paragraph><paragraph id="id71B4C5D2EBD7456289C12D65F2E8ED87"><enum>(2)</enum><header>Annual
			 financial statement</header><text>The term <term>annual financial
			 statement</term> means the annual financial statement required under section
			 3515 of title 31, United States Code, or similar provision of law.</text>
				</paragraph><paragraph id="H56F4B87B07F64EA5B27C29271800A192"><enum>(3)</enum><header>Compliance</header><text>The
			 term <term>compliance</term> means that the agency—</text>
					<subparagraph id="H91C126124DA24D3ABB499F9B784115F8"><enum>(A)</enum><text>has published an
			 annual financial statement for the most recent fiscal year and posted that
			 report and any accompanying materials required under guidance of the Office of
			 Management and Budget on the agency website;</text>
					</subparagraph><subparagraph id="HD36F4BE925334342806505CC9C904073"><enum>(B)</enum><text>if required, has
			 conducted a program specific risk assessment for each program or activity that
			 conforms with section 2(a) the Improper Payments Information Act of 2002 (31
			 U.S.C. 3321 note);</text>
					</subparagraph><subparagraph id="HAF16B165F0AB4AFD8B6D2E69B92B4C6D"><enum>(C)</enum><text>if required,
			 publishes improper payments estimates for all programs and activities
			 identified under section 2(b) of the Improper Payments Information Act of 2002
			 (31 U.S.C. 3321 note) in the accompanying materials to the annual financial
			 statement;</text>
					</subparagraph><subparagraph id="H925285A212A844F69E4E07EB8536C963"><enum>(D)</enum><text>publishes
			 programmatic corrective action plans prepared under section 2(c) of the
			 Improper Payments Information Act of 2002 (31 U.S.C. 3321 note) that the agency
			 may have in the accompanying materials to the annual financial
			 statement;</text>
					</subparagraph><subparagraph id="HF3114357F9D74118914C43F35F000085"><enum>(E)</enum><text>publishes improper
			 payments reduction targets established under section 2(c) of the Improper
			 Payments Information Act of 2002 (31 U.S.C. 3321 note) that the agency may have
			 in the accompanying materials to the annual financial statement for each
			 program assessed to be at risk, and is meeting such targets; and</text>
					</subparagraph><subparagraph id="id24D0A2AA3D7D46718E74514558548ECE"><enum>(F)</enum><text>has reported an
			 improper payment rate of less than 10 percent for each program and activity for
			 which an estimate was published under section 2(b) of the Improper Payments
			 Information Act of 2002 (31 U.S.C. 3321 note).</text>
					</subparagraph></paragraph></subsection><subsection id="H4733BF0E8D264A3D90052300CF51597D"><enum>(b)</enum><header>Annual
			 compliance report by Inspectors General of Agencies</header><text>Each fiscal
			 year, the Inspector General of each agency shall determine whether the agency
			 is in compliance and submit a report on that determination to—</text>
				<paragraph id="id2085781387BD4E42A8A14F3D8E37A9AF"><enum>(1)</enum><text>the head of the
			 agency;</text>
				</paragraph><paragraph id="id909EDD4DEE6344A7AEADA6A79F76748B"><enum>(2)</enum><text>the Committee on
			 Homeland Security and Governmental Affairs of the Senate;</text>
				</paragraph><paragraph id="idEB6D0D453B1E44C6A9929327D61C07E4"><enum>(3)</enum><text>the Committee on
			 Oversight and Governmental Reform of the House of Representatives; and</text>
				</paragraph><paragraph id="id61C36D914FD34A82958833A05DDF756B"><enum>(4)</enum><text>the Comptroller
			 General.</text>
				</paragraph></subsection><subsection id="ID21be26d018b04296b58177d0d56404f5"><enum>(c)</enum><header>Remediation</header>
				<paragraph id="IDf875517ae4c64a51a075ba2fdad5b14a"><enum>(1)</enum><header>Noncompliance</header>
					<subparagraph id="id513A3073A049464FBEFAABE0D30D5A30"><enum>(A)</enum><header>In
			 general</header><text>If an agency is determined by the Inspector General of
			 that agency not to be in compliance under subsection (b) in a fiscal year, the
			 head of the agency shall submit a plan to Congress describing the actions that
			 the agency will take to come into compliance.</text>
					</subparagraph><subparagraph id="id193D46BD9D8E4423902E4D24B7306296"><enum>(B)</enum><header>Plan</header><text>The
			 plan described under subparagraph (A) shall include—</text>
						<clause id="ID5365714a2f2642f99d01870113ec1493"><enum>(i)</enum><text>measurable
			 milestones to be accomplished in order to achieve compliance for each program
			 or activity;</text>
						</clause><clause id="IDf261af93f3db4df4a63a9e34e9fc6046"><enum>(ii)</enum><text>the designation
			 of a senior agency official who shall be accountable for the progress of the
			 agency in coming into compliance for each program or activity; and</text>
						</clause><clause id="ID90e1ce9cf9434f9f8518502866e97592"><enum>(iii)</enum><text>the
			 establishment of an accountability mechanism, such as a performance agreement,
			 with appropriate incentives and consequences tied to the success of the
			 official designated under clause (ii) in leading the efforts of the agency to
			 come into compliance for each program and activity.</text>
						</clause></subparagraph></paragraph><paragraph id="IDf54683b7eaec447ab38ff0f0f8a88e62"><enum>(2)</enum><header>Noncompliance
			 for 2 fiscal years</header>
					<subparagraph id="idCA4A5827A0F04EBBB922F86B484C3184"><enum>(A)</enum><header>In
			 general</header><text>If an agency is determined by the Inspector General of
			 that agency not to be in compliance under subsection (b) for 2 consecutive
			 fiscal years for the same program or activity, and the Director of the Office
			 of Management and Budget determines that additional funding would help the
			 agency come into compliance, the head of the agency shall obligate additional
			 funding, in an amount determined by the Director, to intensified compliance
			 efforts.</text>
					</subparagraph><subparagraph id="id40DE12C3B20F45BD813EBE0AACD28DCC"><enum>(B)</enum><header>Funding</header><text>In
			 providing additional funding described under subparagraph (A), the head of an
			 agency shall use any reprogramming or transfer authority available to the
			 agency. If after exercising that reprogramming or transfer authority additional
			 funding is necessary to obligate the full level of funding determined by the
			 Director of the Office of Management and Budget under subparagraph (A), the
			 agency shall submit a request to Congress for additional reprogramming or
			 transfer authority.</text>
					</subparagraph></paragraph><paragraph id="IDca1de2918ed34a23b44ff787fdca634b"><enum>(3)</enum><header>Reauthorization
			 proposals</header><text>If an agency is determined by the Inspector General of
			 that agency not to be in compliance under subsection (b) for more than 3
			 consecutive fiscal years for the same program or activity, the head of the
			 agency shall, not later than 30 days after such determination, submit to
			 Congress—</text>
					<subparagraph id="id62308934207E48E081F968EFEE84974B"><enum>(A)</enum><text>reauthorization
			 proposals for each program or activity that has not been in compliance for 3 or
			 more consecutive fiscal years; or</text>
					</subparagraph><subparagraph id="id2006DDB3FB97481FB43AD3FA50CA515C"><enum>(B)</enum><text>proposed
			 statutory changes necessary to bring the program or activity into
			 compliance.</text>
					</subparagraph></paragraph></subsection><subsection id="id1A44A08B83EE4793BD9B065D3EA0242A"><enum>(d)</enum><header>Compliance
			 enforcement pilot programs</header>
				<paragraph id="ID92cf77b2888f47b8a7e247fc56ff7faf"><enum>(1)</enum><header>In
			 general</header><text>The Director of the Office of Management and Budget may
			 establish 1 or more pilot programs which shall test potential accountability
			 mechanisms with appropriate incentives and consequences tied to success in
			 ensuring compliance with this Act and eliminating improper payments.</text>
				</paragraph><paragraph id="IDb91872229e92477abbb8290fe5c54595"><enum>(2)</enum><header>Report</header><text>Not
			 later than 5 years after the date of enactment of this Act, the Director of the
			 Office of Management and Budget shall submit a report to Congress on the
			 findings associated with any pilot programs conducted under paragraph (1). The
			 report shall include any legislative or other recommendations that the Director
			 determines necessary.</text>
				</paragraph></subsection><subsection id="ID6d6a9594e16948bdb8f6e08bd8d8f26d"><enum>(e)</enum><header>Report on Chief
			 Financial Officers Act of 1990</header><text>Not later than 1 year after the
			 date of the enactment of this Act, the Chief Financial Officers Council
			 established under section 302 of the Chief Financial Officers Act of 1990 (31
			 U.S.C. 901 note) and the Council of Inspectors General on Integrity and
			 Efficiency established under section 7 of the Inspector General Reform Act of
			 2009 (Public Law 110–409), in consultation with a broad cross-section of
			 experts and stakeholders in Government accounting and financial management
			 shall—</text>
				<paragraph id="ID0b739dd98e1e49449f0a0560d13f4b1e"><enum>(1)</enum><text>jointly examine
			 the lessons learned during the first 20 years of implementing the Chief
			 Financial Officers Act of 1990 (31 U.S.C. 901) and identify any reforms or
			 improvements to the legislative and regulatory compliance framework for Federal
			 financial management that will optimize Federal agency efforts to—</text>
					<subparagraph id="IDf6c0a0c4558f4aee8668bf2eef7068bb"><enum>(A)</enum><text>publish relevant,
			 timely, and reliable reports on Government finances; and</text>
					</subparagraph><subparagraph id="IDfbb020f79d4647e58beb6c472145e7e7"><enum>(B)</enum><text>implement
			 internal controls that mitigate the risk for fraud, waste, and error in
			 Government programs; and</text>
					</subparagraph></paragraph><paragraph id="ID675ad18ecfee40eeb22f10e8f6b68893"><enum>(2)</enum><text>submit a report
			 on the results of the examination to—</text>
					<subparagraph id="IDfd7b7901f68a42ef8a741abe8471fa4f"><enum>(A)</enum><text>the Committee on
			 Homeland Security and Governmental Affairs of the Senate;</text>
					</subparagraph><subparagraph id="IDbe155c9216d64739a11a51255b7f8dca"><enum>(B)</enum><text>the Committee on
			 Oversight and Government Reform of the House of Representatives; and</text>
					</subparagraph><subparagraph id="ID1049ba14e7cc4ceab2cc29cc7f6b06e4"><enum>(C)</enum><text>the Comptroller
			 General.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
