		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Postal Service Retiree Health
			 Benefits Funding Reform Act of 2009</short-title></quote>.</text>
		</section><section id="ID91ccc4aeb5bb4818a97b79138a4dd01d"><enum>2.</enum><header>Government
			 contributions</header><text display-inline="no-display-inline">Section
			 8906(g)(2)(A) of title 5, United States Code, is amended by striking
			 <quote>shall through September 30, 2016, be paid by the United States Postal
			 Service, and thereafter</quote>.</text>
		</section><section id="ID4f1052bc71a24f6280433ab8167ac710"><enum>3.</enum><header>Postal Service
			 Retiree Health Benefits Fund</header><text display-inline="no-display-inline">Section 8909a of title 5, United States
			 Code, is amended—</text>
			<paragraph id="ID062a163102a2493dbe18a9dddef7b7c5"><enum>(1)</enum><text>in the section
			 heading, by striking <quote><header-in-text level="section" style="USC">Benefit</header-in-text></quote> and inserting
			 <quote><header-in-text level="section" style="USC">Benefits</header-in-text></quote>; and</text>
			</paragraph><paragraph id="IDd0bdf0e1eacd44d19358abf919c2e874"><enum>(2)</enum><text>in subsection
			 (d)—</text>
				<subparagraph id="ID8cafc3fd0cab4b5ba9f855b7eb8134e8"><enum>(A)</enum><text>in paragraph
			 (2)(B)—</text>
					<clause id="ID0d88a0630c8d44d4a989d0317cfd4c9e"><enum>(i)</enum><text>by
			 striking <quote>2017</quote> and inserting <quote>2020</quote>; and</text>
					</clause><clause id="IDfc32c3f3e73d47bea5ad40a1024bd736"><enum>(ii)</enum><text>by
			 striking <quote>2056</quote> and inserting <quote>2059</quote>;</text>
					</clause></subparagraph><subparagraph id="ID27f5b4ab33f34aeaa9d23f15dfdf598b"><enum>(B)</enum><text>in paragraph
			 (3)—</text>
					<clause id="ID436f7d61ad10451c8a7433790ffd32cd"><enum>(i)</enum><text>by
			 striking the matter preceding subparagraph (B) and inserting the
			 following:</text>

				Postal Service shall pay into such Fund—</text>
									<clause id="id6423F07A72464425B1B36C3C9D490967" indent="up1"><enum>(i)</enum><text>$5,400,000,000, not later than
				September 30, 2007;</text>
									</clause><clause id="id08D1BA239DEA4D499DC839CAADD6FE11" indent="up1"><enum>(ii)</enum><text>$5,600,000,000, not later than
				September 30, 2008;</text>
									</clause><clause id="id03B461FD567B478A9CB925357A564681" indent="up1"><enum>(iii)</enum><text>$1,700,000,000, not later than
				September 30, 2009;</text>
									</clause><clause id="id6FB20281ADAA4521A95DCF7DE8492337" indent="up1"><enum>(iv)</enum><text>$1,700,000,000, not later than
				September 30, 2010;</text>
									</clause><clause id="id280FF70B60574214878332F2A457A5F0" indent="up1"><enum>(v)</enum><text>$3,100,000,000, not later than
				September 30, 2011;</text>
									</clause><clause id="id558FB926E94E4C20B633A3CA68410C0A" indent="up1"><enum>(vi)</enum><text>$3,900,000,000, not later than
				September 30, 2012;</text>
									</clause><clause id="id2CA22D39A12E403FA897C063E9695C49" indent="up1"><enum>(vii)</enum><text>$4,100,000,000, not later than
				September 30, 2013;</text>
									</clause><clause id="idE358B02044DF40948287B6C8833E4DD5" indent="up1"><enum>(viii)</enum><text>$4,300,000,000, not later than
				September 30, 2014;</text>
									</clause><clause id="id3D5D8CC33D244D7D8E3C2FAD4EBD6862" indent="up1"><enum>(ix)</enum><text>$4,500,000,000, not later than
				September 30, 2015;</text>
									</clause><clause id="idCF3DD0DDB4374B389F02876FDD2FD615" indent="up1"><enum>(x)</enum><text>$4,700,000,000, not later than
				September 30, 2016;</text>
									</clause><clause id="idF5B5F2AA24984F10BE1C5413609624A3" indent="up1"><enum>(xi)</enum><text>$4,900,000,000, not later than
				September 30, 2017;</text>
									</clause><clause id="idE8104534B25A4C4BAB66F368096765FB" indent="up1"><enum>(xii)</enum><text>$5,100,000,000, not later than
				September 30, 2018; and</text>
									</clause><clause id="id3B11160386A74DD795ED6383F8984F6E" indent="up1"><enum>(xiii)</enum><text>$5,300,000,000, not later than
				September 30,
				2019.</text>
									</clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</clause><clause id="id3135A7C0087541BBA032F82FEA14FDFD"><enum>(ii)</enum><text>by
			 redesignating subparagraph (B) as subparagraph (C), and inserting after
			 subparagraph (A) the following:</text>
						<quoted-block display-inline="no-display-inline" id="id2CDD5A5CB1B64950ADCC9C6A71182681" style="OLC">
							<subparagraph id="id8FB951052DCC49C6A1F14759D122B278"><enum>(B)</enum><text>Not later than
				September 30, 2009, and by September 30 of each succeeding year through 2019,
				the United States Postal Service shall pay into such Fund the net present value
				computed under paragraph (1).</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</clause><clause id="id6833AD629E88490FAA1596511A0165FC"><enum>(iii)</enum><text>in subparagraph
			 (C) (as redesignated in this subparagraph), by striking <quote>2017</quote> and
			 inserting <quote>2020</quote>; and</text>
					</clause></subparagraph><subparagraph id="id8EABBF4D33EC4106B503807EA5A56C4B"><enum>(C)</enum><text>in paragraph 4,
			 by striking <quote>financial reporting under subchapter II of chapter 35 of
			 title 31</quote> and inserting <quote>valuations under chapter
			 84</quote>.</text>
				</subparagraph></paragraph></section><section id="IDa850d9c687be4a5ea5ba3797d0a9a295"><enum>4.</enum><header>Temporary
			 increase to Postal Service borrowing limitations</header>
			<subsection id="id7FEFA24058F14D7FA6ED0DF954F007BC"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">For fiscal years 2009
			 and 2010, section 2005(a) of title 39, United States Code, shall be applied by
			 substituting <quote>$5,000,000,000</quote> for the limitation specified in
			 paragraph (1).</text>
			</subsection><subsection changed="deleted" id="id85648687FE5341A5937E15A790DD6538" reported-display-style="strikethrough"><enum>(b)</enum><header>Maximum amount
			 limitation and repayment</header><text display-inline="yes-display-inline">Any
			 amount borrowed under the increase in borrowing authority provided under
			 subsection (a) of this section—</text>
				<paragraph id="id65A6AB3CBD004F13AE54BDC7817999E7"><enum>(1)</enum><text display-inline="yes-display-inline">shall not apply to the maximum amount
			 allowable under section 2005(a)(2) of title 39, United States Code; and</text>
				</paragraph><paragraph id="id9790406302944A7D9FF11EEA5535796C"><enum>(2)</enum><text display-inline="yes-display-inline">shall be repaid by the Postal Service to
			 the United States Treasury by not later than the end of fiscal year
			 2019.</text>
				</paragraph></subsection><subsection changed="added" id="id68FCB6D1D5034E23BC59C7B82F17B07A" reported-display-style="italic"><enum>(b)</enum><header>Repayment and
			 limitation on outstanding debt</header><text display-inline="yes-display-inline">Any amount borrowed under the increase in
			 borrowing authority provided under subsection (a) of this section shall be
			 repaid by the Postal Service to the United States Treasury by not later than
			 the end of fiscal year 2019. The Postal Service's total outstanding debt may
			 not exceed the maximum amount allowable under section 2005(a)(2) of title 39,
			 United States Code.</text>
			</subsection></section><section changed="added" id="idC14B597DDC4E4B8DBBB3473FE288E6DF" reported-display-style="italic"><enum>5.</enum><header>Consideration of Postal
			 Service financial condition</header><text display-inline="no-display-inline">Section 1207(c)(2) of title 39, United
			 states Code, is amended by inserting <quote>The arbitration board shall
			 consider the financial condition of the Postal Service in making any
			 decision.</quote> after the first sentence.</text>
		</section><section changed="added" id="idFDB6E130BE964931BD237C2640FC6656" reported-display-style="italic"><enum>6.</enum><header>Assessment of future
			 business model of the postal service</header><text display-inline="no-display-inline">Section 710(a) of the Postal Accountability
			 and Enhancement Act (Public Law 109–435; 120 Stat. 3247) is amended by striking
			 the first and second sentences and inserting <quote>The Comptroller General of
			 the United States shall prepare and submit to the President and Congress a
			 report that evaluates the options and strategies for the long-term structural
			 and operational reforms of the United States Postal Service necessary to
			 achieve financial stability and long-term fiscal viability. The final report
			 required by this section shall be submitted by March 31, 2010.</quote>.</text>
		</section><section changed="added" id="id6C39C06E3F324F05A698EBE762F8BE40" reported-display-style="italic"><enum>7.</enum><header>Prohibition on
			 bonuses</header><text display-inline="no-display-inline">Section 3686 of title
			 39, United states Code, is amended—</text>
			<paragraph id="id6C111E04C758491BB019489D13944137"><enum>(1)</enum><text>by redesignating
			 subsection (e) as subsection (f); and</text>
			</paragraph><paragraph id="id728AB692C829456485AD6385465CCFDC"><enum>(2)</enum><text>by inserting after
			 subsection (d) the following:</text>
				<quoted-block changed="added" display-inline="no-display-inline" id="id480A882FC6644996A30F5086A08656B9" reported-display-style="italic" style="OLC">
					<subsection id="idA1724142FFA044869E8960DB3FB70FEE"><enum>(e)</enum><header>Prohibition on
				bonuses</header><text>Notwithstanding any provision of this section, including
				subsection (c), any bonus under this section—</text>
						<paragraph id="id862CCCF46A3948C68350501B455AD5E4"><enum>(1)</enum><text>subject to paragraph (2),
				shall be paid on October 1 following the date such bonus would have otherwise
				been paid if not for this subsection; and</text>
						</paragraph><paragraph id="id31A55968548B45759CDAF6C3E2645607"><enum>(2)</enum><text>shall not be paid if the
				Postal Service had a year-end net loss for the fiscal year preceding that
				October
				1.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section changed="deleted" id="ID3cfeae9244de43e8a28f1b6b8f1430fe" reported-display-style="strikethrough"><enum>5.</enum><header>Effective date
			 and application</header>
			<subsection id="id00BF622ECB5E428AAABC5281E839B53D"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">This Act, including
			 the amendments made by this Act, shall be effective as of October 1,
			 2008.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDcbd85964d6474e389891888a4a9ab748"><enum>(b)</enum><header>Application to
			 fiscal year 2009 payments</header><text>Any payments made by the Postal Service
			 under section 8906(g)(2)(A) of title 5, United States Code, for which the
			 Postal Service is not obligated to pay by reason of the amendment made by
			 section 2 of this Act shall be credited against the payments due by September
			 30, 2009, under section 8909a(d)(3) of title 5, United States Code, as amended
			 by this Act.</text>
			</subsection></section><section changed="added" id="id0AB3B51822C44F11AF5B7A6860B82281" reported-display-style="italic"><enum>8.</enum><header>Effective dates and
			 application</header>
			<subsection id="idD4BB19A07C8749F6B1A4EB2B83F000BE"><enum>(a)</enum><header>In general</header>
				<paragraph id="id4D236CFC866C4697A00FE0273C036264"><enum>(1)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">Sections 2, 3, and 4,
			 including the amendments made by those sections, shall be effective as of
			 October 1, 2008.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9D718826533447CCA1A83DFB908422E3"><enum>(2)</enum><header>Application to fiscal
			 year 2009 payments</header><text>Any payments made by the Postal Service under
			 section 8906(g)(2)(A) of title 5, United States Code, for which the Postal
			 Service is not obligated to pay by reason of the amendment made by section 2 of
			 this Act shall be credited against the payments due by September 30, 2009,
			 under section 8909a(d)(3) of title 5, United States Code, as amended by this
			 Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idDCDA97C19EFB4A5DB323501A3A41807D"><enum>(b)</enum><header>Other
			 provisions</header><text>The amendments made by sections 5, 6, and 7 shall take
			 effect on the date of enactment of this Act.</text>
