		<legis-type display="yes">A BILL</legis-type>
		<official-title display="yes">To require the Secretary of Veterans
		  Affairs to carry out a pilot program to assess the feasibility and advisability
		  of using service dogs for the treatment or rehabilitation of veterans with
		  physical or mental injuries or disabilities, and for other
		  purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="id88C48EBF0FDC44AD83AFC07F1A0B123B" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Service Dogs for Veterans Act of
			 2009</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id2450A2FBB3224102B94FB91081AB5FD0" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Pilot program on use of service dogs for
			 the treatment or rehabilitation of veterans with physical or mental injuries or
			 disabilities</header>
			<subsection commented="no" display-inline="no-display-inline" id="id84E60F8C4459485797745DEED5784BB3"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress makes the following
			 findings:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDd082b1ed1761499c9870d7697953728a"><enum>(1)</enum><text display-inline="yes-display-inline">The United States owes a profound debt to
			 those who have served the United States honorably in the Armed Forces.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa905d2f779bc46609e991d70bf21e280"><enum>(2)</enum><text display-inline="yes-display-inline">Disabled veterans suffer from a range of
			 physical and mental injuries and disabilities.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc9850510b37a477dbbe0e13848bbfc07"><enum>(3)</enum><text display-inline="yes-display-inline">In 2008, the Army reported the highest
			 level of suicides among its soldiers since it began tracking the rate 28 years
			 before 2009.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID82f485415b6347dfaf27f11d34947a1c"><enum>(4)</enum><text display-inline="yes-display-inline">A scientific study documented in the 2008
			 Rand Report entitled <quote>Invisible Wounds of War</quote> estimated that
			 300,000 veterans of Operation Enduring Freedom and Operation Iraqi Freedom
			 currently suffer from post-traumatic stress disorder.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3393d212b2d043eeaf070cdeb562c4f0"><enum>(5)</enum><text display-inline="yes-display-inline">Veterans have benefitted in multiple ways
			 from the provision of service dogs.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd0c0c001811042fba8d2ce9542a7350b"><enum>(6)</enum><text display-inline="yes-display-inline">The Department of Veterans Affairs has been
			 successfully placing guide dogs with the blind since 1961.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd9cff2f1ad3f4ba8953f936f337de3f2"><enum>(7)</enum><text display-inline="yes-display-inline">Thousands of dogs around the country await
			 adoption.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2117B60260D34EEF87A855BEF7ADA997"><enum>(b)</enum><header display-inline="yes-display-inline">Program required</header><text display-inline="yes-display-inline">Not later than 120 days after the date of
			 the enactment of this Act, the Secretary of Veterans Affairs shall commence a
			 three-year pilot program to assess the benefits, feasibility, and advisability
			 of using service dogs for the treatment or rehabilitation of veterans with
			 physical or mental injuries or disabilities, including post-traumatic stress
			 disorder.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idC067A951068942F5BA9F181CE9D15447"><enum>(c)</enum><header display-inline="yes-display-inline">Partnerships</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idDB1694F833BC40CBB0A71B0F91114E7A"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall carry out the pilot
			 program by partnering with nonprofit organizations that—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id5C783A452EB34F2296403C03F12391DE"><enum>(A)</enum><text display-inline="yes-display-inline">have experience providing service dogs to
			 individuals with injuries or disabilities;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9FB2FD43DB6C464F9E1E8024BFDED852"><enum>(B)</enum><text display-inline="yes-display-inline">do not charge fees for the dogs, services,
			 or lodging that they provide; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD0FE512CFF23457C9FD88CB4A5CB74ED"><enum>(C)</enum><text display-inline="yes-display-inline">are accredited by a generally accepted
			 industry-standard accrediting institution.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id11703F3E021F430D92D4AFD58164528A"><enum>(2)</enum><header display-inline="yes-display-inline">Reimbursement of costs</header><text display-inline="yes-display-inline">The Secretary shall reimburse partners for
			 costs relating to the pilot program as follows:</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id690737AEEAA74E09A9241A367DFA79D8"><enum>(A)</enum><text display-inline="yes-display-inline">For the first 50 dogs provided under the
			 pilot program, all costs relating to the provision of such dogs.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDC33399E89AE4DBAA16D28C8F3035D2A"><enum>(B)</enum><text display-inline="yes-display-inline">For dogs provided under the pilot program
			 after the first 50 dogs provided, all costs relating to the provision of every
			 other dog.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE2478B920CCF47E6948D26F5B7B27AE0"><enum>(d)</enum><header display-inline="yes-display-inline">Participation</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idFE365C7612354511ACE8D301F76C40C6"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">As part of the pilot program, the Secretary
			 shall provide a service dog to a number of veterans with physical or mental
			 injuries or disabilities that is greater than or equal to the greater
			 of—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id7CA42639007F49199CA8A89F88AE3139"><enum>(A)</enum><text display-inline="yes-display-inline">200; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9D2AC9C0D2F4464A9D9D76BE9850965C"><enum>(B)</enum><text display-inline="yes-display-inline">the minimum number of such veterans
			 required to produce scientifically valid results with respect to assessing the
			 benefits and costs of the use of such dogs for the treatment or rehabilitation
			 of such veterans.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7B2C44638A724973899378507346A656"><enum>(2)</enum><header display-inline="yes-display-inline">Composition</header><text display-inline="yes-display-inline">The Secretary shall ensure that—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idFE44864CBAF94EA1937CE5F01DC57FF4"><enum>(A)</enum><text display-inline="yes-display-inline">half of the participants in the pilot
			 program are veterans who suffer primarily from a mental health injury or
			 disability; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC10391172F3742C3A4BD8A2D315A9A4C"><enum>(B)</enum><text display-inline="yes-display-inline">half of the participants in the pilot
			 program are veterans who suffer primarily from a physical injury or
			 disability.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4D2577E7374841B58277D0C9C69501D6"><enum>(e)</enum><header display-inline="yes-display-inline">Study</header><text display-inline="yes-display-inline">In carrying out the pilot program, the
			 Secretary shall conduct a scientifically valid research study of the costs and
			 benefits associated with the use of service dogs for the treatment or
			 rehabilitation of veterans with physical or mental injuries or disabilities.
			 The matters studied shall include the following:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idEB09696F405242069CCA730BECFC4961"><enum>(1)</enum><text display-inline="yes-display-inline">The therapeutic benefits to such veterans,
			 including the quality of life benefits reported by the veterans partaking in
			 the pilot program.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id61D0F96856684232BC545AAE0AA6621E"><enum>(2)</enum><text display-inline="yes-display-inline">The economic benefits of using service dogs
			 for the treatment or rehabilitation of such veterans, including—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id6FC55AA5479345BE8ED4441CC12224AF"><enum>(A)</enum><text display-inline="yes-display-inline">savings on health care costs, including
			 savings relating to reductions in hospitalization and reductions in the use of
			 prescription drugs; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8BE2FAC65EF943BE9386265C5B0EB2F6"><enum>(B)</enum><text display-inline="yes-display-inline">productivity and employment gains for the
			 veterans.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE7ACE04E475D4DD1A1F56BC67B2DC7E0"><enum>(3)</enum><text display-inline="yes-display-inline">The effectiveness of using service dogs to
			 prevent suicide.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3DA562A65BB8463AA6C3A6106D8BA221"><enum>(f)</enum><header display-inline="yes-display-inline">Reports</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id4F0DA7BD776C47D7A0578AB253CA89FE"><enum>(1)</enum><header display-inline="yes-display-inline">Annual report of the
			 Secretary</header><text display-inline="yes-display-inline">After each year of
			 the pilot program, the Secretary shall submit to Congress a report on the
			 findings of the Secretary with respect to the pilot program.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB46596563A0E42778D4B6F1C923C0CA5"><enum>(2)</enum><header display-inline="yes-display-inline">Final report by the National Academy of
			 Sciences</header><text display-inline="yes-display-inline">Not later than 180
			 days after the date of the completion of the pilot program, the National
			 Academy of Sciences shall submit to Congress a report on the results of the
			 pilot program.</text>
				</paragraph></subsection></section></legis-body>
