		<official-title display="yes">To establish a section within the Criminal
		  Division of the Department of Justice to enforce human rights laws, to make
		  technical and conforming amendments to criminal and immigration laws pertaining
		  to human rights violations, and for other purposes. </official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Human Rights Enforcement Act of
			 2009</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id6C8F08D52E4143B38602C14F28F94FA4" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Section to enforce human rights
			 laws</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID5c043d9c39094720b813f73523b97f34"><enum>(a)</enum><header display-inline="yes-display-inline">Repeal</header><text display-inline="yes-display-inline">Section 103(h) of the Immigration and
			 Nationality Act (8 U.S.C. 1103(h)) is repealed.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID46642e8c8c064ed7bebb008ebf700f96"><enum>(b)</enum><header display-inline="yes-display-inline">Section To enforce human rights
			 laws</header><text display-inline="yes-display-inline">Chapter 31 of title 28,
			 United States Code, is amended by inserting after section 509A the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id9F0126A14AA248CC85FF52D8170704CC" style="USC">
					<section commented="no" display-inline="no-display-inline" id="id28E65F7113D64CB9A3508F6F30E2A3E8" section-type="subsequent-section"><enum>509B.</enum><header display-inline="yes-display-inline">Section to enforce human rights
				laws</header>
						<subsection commented="no" display-inline="no-display-inline" id="id90DB7834B61C46669C52C8B2E19A98FA"><enum>(a)</enum><text display-inline="yes-display-inline">Not later than 90 days after the date of
				the enactment of the <short-title>Human Rights Enforcement
				Act of 2009</short-title>, the Attorney General shall establish a section
				within the Criminal Division of the Department of Justice with responsibility
				for the enforcement of laws against suspected participants in serious human
				rights offenses.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="idD1ABA26C3A1241F283910784E54AA71F"><enum>(b)</enum><text display-inline="yes-display-inline">The section established under subsection
				(a) is authorized to—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="idADF4D354BE8E4FA897AA84CDA9454F80"><enum>(1)</enum><text display-inline="yes-display-inline">take appropriate legal action against
				individuals suspected of participating in serious human rights offenses;
				and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id27981F08DC34412E9D87A57CD318C65D"><enum>(2)</enum><text display-inline="yes-display-inline">coordinate any such legal action with the
				United States Attorney for the relevant jurisdiction.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8E08529E1B9E454F8666B1B63CE319B0"><enum>(c)</enum><text display-inline="yes-display-inline">The Attorney General shall, as appropriate,
				consult with the Secretary of Homeland Security and the Secretary of
				State.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id6065FF94E67F4918B210691910D9BB6B"><enum>(d)</enum><text display-inline="yes-display-inline">In determining the appropriate legal action
				to take against individuals who are suspected of committing serious human
				rights offenses under Federal law, the section shall take into consideration
				the availability of criminal prosecution under the laws of the United States
				for such offenses or in a foreign jurisdiction that is prepared to undertake a
				prosecution for the conduct that forms the basis for such offenses.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="idB37FD262266B46D4B6A23366E9DE1F7D"><enum>(e)</enum><text display-inline="yes-display-inline">The term <term>serious human rights
				offenses</term> includes violations of Federal criminal laws relating to
				genocide, torture, war crimes, and the use or recruitment of child soldiers
				under sections 1091, 2340, 2340A, 2441, and 2442 of title 18, United States
				Code.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDe512ece5fe494e94b4c09ac5d36e4051"><enum>(c)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of
			 chapter 31 of the title 28, United States Code, is amended by inserting after
			 the item relating to section 509A the following:</text>

					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID9e0a90f9e3d94f2abddb749befc854b3" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Technical and conforming
			 amendments</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID7c4071aeb1e549508d8fc0d56155fda6"><enum>(a)</enum><header display-inline="yes-display-inline">Genocide</header><text display-inline="yes-display-inline">Section 1091 of title 18, United States
			 Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDc9acb680ba524e2c8cdb4772d23c6e2c"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID2075e64b56444341a0494980814a60e4"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>, in a circumstance
			 described in subsection (d)</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc9a268769e604e869e09b72ec2a124e9"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>or attempts to do
			 so,</quote>;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID239a57d3e78b47a986aeb635d6a92bee"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c), by striking <quote>in a
			 circumstance described in subsection (d)</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID26342cbb5af14eff96befd82bc7c105d"><enum>(3)</enum><text display-inline="yes-display-inline">by striking subsection (d) and (e);
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf2830fc48cef4d1088aec3f1d9697a3c"><enum>(4)</enum><text display-inline="yes-display-inline">by inserting after subsection (c) the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="idAB84725844AA474E9D8FE436180DDDA1" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="ID1783a8efc3da4feb8313c3e8ffd489c9"><enum>(d)</enum><header display-inline="yes-display-inline">Attempt and conspiracy</header><text display-inline="yes-display-inline">Any person who attempts or conspires to
				commit an offense under this section shall be punished in the same manner as a
				person who completes the offense.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID3b4241ff8dc24df79728f1054988ed0c"><enum>(e)</enum><header display-inline="yes-display-inline">Jurisdiction</header><text display-inline="yes-display-inline">There is jurisdiction over the offenses
				described in subsections (a), (c), and (d) if—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="IDc3c40ee430064b138b594252a37095e3"><enum>(1)</enum><text display-inline="yes-display-inline">the offense is committed in whole or in
				part within the United States; or</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID693a52cdcc214a17ace21e69ec66fade"><enum>(2)</enum><text display-inline="yes-display-inline">regardless of where the offense is
				committed, the alleged offender is—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID2a03e6c5c2ef4a5aa346a21f2eb54f03"><enum>(A)</enum><text display-inline="yes-display-inline">a national of the United States (as that
				term is defined in section 101 of the Immigration and Nationality Act (8 U.S.C.
				1101));</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDfce46e1d9b4a401dab93a9db13e5b1d7"><enum>(B)</enum><text display-inline="yes-display-inline">an alien lawfully admitted for permanent
				residence in the United States (as that term is defined in section 101 of the
				Immigration and Nationality Act (8 U.S.C. 1101));</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID590902ba88dc4eeeab3e7dc156a3643c"><enum>(C)</enum><text display-inline="yes-display-inline">a stateless person whose habitual residence
				is in the United States; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID859a00412ef043c986117ef3b9ea8993"><enum>(D)</enum><text display-inline="yes-display-inline">present in the United States.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID1c984b0eafca46448c37a6077c44fdb3"><enum>(f)</enum><header display-inline="yes-display-inline">Nonapplicability of certain
				limitations</header><text display-inline="yes-display-inline">Notwithstanding
				section 3282, in the case of an offense under this section, an indictment may
				be found, or information instituted, at any time without
				limitation.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9192317DEEA0496C887D5745287D7263"><enum>(b)</enum><header display-inline="yes-display-inline">Immigration and Nationality
			 Act</header><text display-inline="yes-display-inline">Section 212(a)(3)(E)(ii)
			 of the Immigration and Nationality Act (8 U.S.C. 1182(a)(3)(E)(ii)) is amended
			 by striking <quote>conduct outside the United States that would, if committed
			 in the United States or by a United States national, be</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDaeb4f7eef6d649beb5f4a3ec01842640"><enum>(c)</enum><header display-inline="yes-display-inline">Applicability</header><text display-inline="yes-display-inline">The amendments made by subsections (b),
			 (c), and (d) of the Child Soldiers Accountability Act of 2008 (Public Law
			 110–340) shall apply to offenses committed before, on, or after the date of the
			 enactment of the Child Soldiers Accountability Act of 2008.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDd515c4d495514cb0bd5a9d2fe7247914"><enum>(d)</enum><header display-inline="yes-display-inline">Material support for genocide or child
			 soldier recruitment</header><text display-inline="yes-display-inline">Section
			 2339A(a) of title 18, United States Code, is amended by—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDa04809f3bfab498aac2dacb6047b6432"><enum>(1)</enum><text display-inline="yes-display-inline">inserting <quote>, 1091</quote> after
			 <quote>956</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1c640924ef5b4a879db5f8da4abf606c"><enum>(2)</enum><text display-inline="yes-display-inline">striking <quote>, or 2340A</quote> and
			 inserting <quote>, 2340A, or 2442</quote>.</text>
				</paragraph></subsection></section></legis-body>
