			 4 of title I of the Trade Act of 1974 (19 U.S.C. 2171) is amended by adding at
			 the end the following:</text>

				Enforcement Division and Deputy United States Trade Representative for Trade
				Enforcement</header>
							<subsection id="id8BAA51E22FDA45C8AB0F12DB7A1A4828"><enum>(a)</enum><header>Establishment
				of Trade Enforcement Division</header><text>There is established within the
				Office of the United States Trade Representative a Trade Enforcement Division
				(in this section referred to as the <term>Division</term>).</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id3A0BE7BABC924783AA52531BE3F60469"><enum>(b)</enum><header>Establishment
				of position of Deputy United States Trade Representative for Trade
				Enforcement</header>
								<paragraph commented="no" display-inline="no-display-inline" id="id3072DF0D723C4CFB9E2B95E9B74E5F20"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Division shall be
				headed by a Deputy United States Trade Representative for Trade
				Enforcement.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0DFB7C4A4625470DB1BB94946D4DBF60"><enum>(2)</enum><header>Appointment and
				nomination</header><text display-inline="yes-display-inline">The Deputy United
				States Trade Representative for Trade Enforcement shall be appointed by the
				President, by and with the advice and consent of the Senate. As an exercise of
				the rulemaking power of the Senate, any nomination of the Deputy United States
				Trade Representative for Trade Enforcement submitted to the Senate for its
				advice and consent, and referred to a committee, shall be referred to the
				Committee on Finance.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2F39A2CBEA72452EBF7C5F0179C503FC"><enum>(3)</enum><header>Rank</header><text display-inline="yes-display-inline">The Deputy United States Trade
				Representative for Trade Enforcement shall hold office at the pleasure of the
				President and shall have the rank of Ambassador.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDe5baefc1c7bf4d198049f2e076de8119"><enum>(c)</enum><header>Functions of
				Deputy United States Trade Representative for Trade Enforcement</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID5ae3d49c55704247873c2f0cac7496a3"><enum>(1)</enum><header>Principal
				function</header><text display-inline="yes-display-inline">The principal
				function of the Deputy United States Trade Representative for Trade Enforcement
				shall be to ensure that United States trading partners comply with trade
				agreements to which the United States is a party.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF27800A94C8A4B04BFBCC06BFF97C215"><enum>(2)</enum><header>Additional
				functions</header><text display-inline="yes-display-inline">The Deputy United
				States Trade Representative for Trade Enforcement shall—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id033C91AC724D413A974AE173E839A09B"><enum>(A)</enum><text display-inline="yes-display-inline">assist the United States Trade
				Representative in investigating and prosecuting disputes before the World Trade
				Organization and pursuant to other bilateral or regional trade agreements to
				which the United States is a party;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2C65556CD1AB4BE9A8359A6EE893A082"><enum>(B)</enum><text display-inline="yes-display-inline">assist the United States Trade
				Representative in carrying out the United States Trade Representative's
				functions under section 141(d);</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE2EAA09A1D3241D6BAB2B829A90BFC0E"><enum>(C)</enum><text display-inline="yes-display-inline">make recommendations with respect to the
				administration of United States trade laws relating to barriers imposed by
				foreign governments to the importation of United States goods, services, and
				intellectual property, and other trade matters; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9ED4AD125D034FBF80FDCB2337D23A39"><enum>(D)</enum><text display-inline="yes-display-inline">perform such other functions as the United
				States Trade Representative may direct.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id11093C476EC14F85B9990C0073BDA6C3"><enum>(d)</enum><header>Office of Trade
				Assistance for Small Businesses</header>
								<paragraph id="H7E70194FAC2145B385A200CA462E5311"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established within the Division
				the Office of Trade Assistance for Small Businesses.</text>
								</paragraph><paragraph id="HEC6267C3524343FDB9651970F8809769"><enum>(2)</enum><header>Functions</header><text>The
				Office of Trade Assistance for Small Businesses shall provide technical and
				legal assistance and advice to eligible small businesses to enable such small
				businesses to prepare and file petitions (other than those that, in the opinion
				of the Office, are frivolous) under section 302.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2E1F022963414FB292D0F2BB2C5C8712"><enum>(3)</enum><header>Eligible small
				business defined</header><text>The term <quote>eligible small business</quote>
				means any business concern that, in the judgment of the Office of Trade
				Assistance for Small Businesses, due to its size, has neither adequate internal
				resources nor financial ability to obtain qualified outside assistance in
				preparing and filing petitions and complaints under section 302. In determining
				whether a business concern is an <quote>eligible small business</quote>, the
				Office of Trade Assistance for Small Businesses may consult with the
				Administrator of the Small Business Administration and the heads of other
				appropriate Federal departments and
				agencies.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id4688B266758E4C98ADBC43243E61A0C5"><enum>(b)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">The table of
			 contents for the Trade Act of 1974 is amended by inserting after the item
			 relating to section 141 the following:</text>

			 title 5, United States Code, is amended by striking <quote>Deputy United States
			 Trade Representatives (3).</quote> and inserting <quote>Deputy United States
			 Trade Representatives (4).</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idB6C55B3E6F5A48AFB5692AB4CD3575A9"><enum>(d)</enum><header>Conforming
			 repeal</header><text>Section 2112 of the Bipartisan Trade Promotion Authority
			 Act of 2002 (19 U.S.C. 3812) is repealed.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id761510192DBD41FF843CBB606AE8463C"><enum>102.</enum><header>Identification
			 of trade enforcement priorities</header>
				<subsection commented="no" display-inline="no-display-inline" id="id87562639E82F4EC18C72B5F261B05218"><enum>(a)</enum><header>In
			 general</header><text>Title III of the Trade Act of 1974 (19 U.S.C. 2411 et
			 seq.) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idD65AC33D64EF4F098CA3C0180AC0C122" style="OLC">
						<section id="idD87962C948034E8297C04E0914EDEE2E"><enum>311.</enum><header>Identification
				of trade enforcement priorities</header>
							<subsection id="IDaf709afe19454fc68a4dd63da5c8c80d"><enum>(a)</enum><header>Identification
				and annual report</header>
								<paragraph id="ID06181fbc7c234350aa5255d6489516be"><enum>(1)</enum><header>In
				general</header><text>Not later than 75 days after the submission of the report
				required by section 181(b), the Trade Representative shall annually—</text>
									<subparagraph id="ID834261b425fe427d8db1a322f69de664"><enum>(A)</enum><text>identify United
				States trade enforcement priorities;</text>
									</subparagraph><subparagraph id="ID43e8f779563841f8905211e33ec1fa49"><enum>(B)</enum><text>identify
				enforcement actions that the Trade Representative has taken during the previous
				year and review the impact such enforcement actions have had on trade barriers
				in foreign countries;</text>
									</subparagraph><subparagraph id="ID32fafa30345b4bdaae1dd10284962d47"><enum>(C)</enum><text>identify trade
				practices of foreign countries on which the Trade Representative will focus
				enforcement efforts (in this section referred to as <quote>priority foreign
				country trade practices</quote>);</text>
									</subparagraph><subparagraph id="ID47a6c7bfb5744dbba92cdf6fa39c38df"><enum>(D)</enum><text>submit to the
				Committee on Finance of the Senate and the Committee on Ways and Means of the
				House of Representatives a report on the priorities, actions, and practices
				identified in subparagraphs (A), (B), and (C); and</text>
									</subparagraph><subparagraph id="id2EE6E176ACC6465986652CD957C52411"><enum>(E)</enum><text>publish the
				report required by subparagraph (D) in the Federal Register.</text>
									</subparagraph></paragraph><paragraph id="IDf17394f335424e60aeb55ca2c4efeb94"><enum>(2)</enum><header>Factors To
				consider</header><text>In identifying priority foreign country trade practices
				under paragraph (1)(C), the Trade Representative shall focus on the practices
				the elimination of which the Trade Representative determines will have the most
				potential to increase United States economic growth, either directly or through
				the establishment of a beneficial precedent. The Trade Representative shall
				take into account all relevant factors, including—</text>
									<subparagraph id="IDe7415fd0fce144a8b75b2a7ee889d1f0"><enum>(A)</enum><text>the major
				barriers and trade distorting practices described in the most recent available
				report submitted under section 181(b), including any practices identified
				pursuant to a review of a trade agreement conducted under section 1377 of the
				Omnibus Trade and Competitiveness Act of 1988 (19 U.S.C. 3106);</text>
									</subparagraph><subparagraph id="id68B80A5EDA6A40DDAE3BC8AB6CBA26A0"><enum>(B)</enum><text>the findings and
				practices described in the most recent available report required under—</text>
										<clause id="id353CEF2B8C9A45EB9BE1C5E873B1440D"><enum>(i)</enum><text>section
				182;</text>
										</clause><clause id="idF542027E915C45519BDD3E1C792B3BEE"><enum>(ii)</enum><text>section 3005 of
				the Omnibus Trade and Competitiveness Act of 1988 (22 U.S.C. 5305);</text>
										</clause><clause id="id4C0FF185EBE042D989E5BA3B1C35763A"><enum>(iii)</enum><text>section 421 of
				the U.S.-China Relations Act of 2000 (22 U.S.C. 6951); and</text>
										</clause><clause id="id2734F93D308745FB9FDEDBB6777ACB3F"><enum>(iv)</enum><text>any other report
				relating to international trade and investment prepared by the Trade
				Representative or any other agency;</text>
										</clause></subparagraph><subparagraph id="ID688fca1033e3420da6081ef55afe97f1"><enum>(C)</enum><text>the trade
				agreements to which a foreign country is a party and the compliance of the
				foreign country with such agreements;</text>
									</subparagraph><subparagraph id="ID7b20599785d249ffa4bc6ad5e6426302"><enum>(D)</enum><text>the medium- and
				long-term implications of the procurement plans of foreign governments;
				and</text>
									</subparagraph><subparagraph id="ID319f8c99bbf54539b6eff393fe1677f3"><enum>(E)</enum><text>the international
				competitive position and export potential of United States products and
				services.</text>
									</subparagraph></paragraph><paragraph id="IDe6885cb4a8af47cc88115da562a32ccd"><enum>(3)</enum><header>Other items in
				report</header><text>The Trade Representative may include in the report
				required by paragraph (1)(D) a description of foreign country trade practices
				that may in the future warrant identification as priority foreign country trade
				practices.</text>
								</paragraph></subsection><subsection id="ID9a71d25a1cd345d0862250eb72accaf1"><enum>(b)</enum><header>Consultation</header>
								<paragraph id="IDd37f57b0dc104b45ba864520cf39bb8d"><enum>(1)</enum><header>In
				general</header><text>Not later than 45 days after the submission of the report
				required by section 181(b), the Trade Representative shall consult with the
				Committee on Finance of the Senate and the Committee on Ways and Means of the
				House of Representatives with respect to the priorities, actions, and practices
				to be identified in the report required by subsection (a)(1)(D).</text>
								</paragraph><paragraph id="ID6479c5c6956f49bba43c8e2d324a0572"><enum>(2)</enum><header>Vote of
				committee</header><text>If, as a result of the consultations described in
				paragraph (1), either the Committee on Finance of the Senate or the Committee
				on Ways and Means of the House of Representatives requests by majority vote
				that a trade practice of a foreign country be identified as a priority foreign
				country trade practice, the Trade Representative shall include such
				identification in the report required by subsection
				(a)(1)(D).<italic></italic></text>
								</paragraph><paragraph id="IDba52e9938eca473093da3571c26ae341"><enum>(3)</enum><header>Determination
				not to include priority foreign country trade practices</header><text>The Trade
				Representative may determine not to include the identification of a priority
				foreign country trade practice requested under paragraph (2) in the report
				required by subsection (a)(1)(D) only if—</text>
									<subparagraph id="idE6D9F6AF09FD4250BE9E32F269BD28B1"><enum>(A)</enum><text>the Trade
				Representative finds that—</text>
										<clause id="ID32b846cc559b49f79ca05969327300fa"><enum>(i)</enum><text>the practice is
				already being addressed—</text>
											<subclause id="id529CDBD99790432A91F30975BD20E2FC"><enum>(I)</enum><text>under provisions
				of United States trade law;</text>
											</subclause><subclause id="idA213F7098B3242ECA6D1462FF9834D70"><enum>(II)</enum><text>under the
				Uruguay Round Agreements (as defined in section 2(7) of the Uruguay Round
				Agreements Act (19 U.S.C. 3501(7)));</text>
											</subclause><subclause id="idE7875386119D4A3586F3B012221EAC5B"><enum>(III)</enum><text>under any
				bilateral or regional trade agreement; or</text>
											</subclause><subclause id="idCE884723EDD441FC8A2D19CFF80A7A08"><enum>(IV)</enum><text>as part of trade
				negotiations with the foreign country or other countries engaging in the
				practice; and</text>
											</subclause></clause><clause id="id8B4434CFD9AE4DC8890C93E416D5637A"><enum>(ii)</enum><text>progress is
				being made toward the elimination of the practice; or</text>
										</clause></subparagraph><subparagraph id="ID2f890cb91f98458fa9670ea66f2c7979"><enum>(B)</enum><text>the Trade
				Representative finds that identification of the practice as a priority foreign
				country trade practice would be contrary to the interests of the United
				States.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDedb46f64d8164659b227942ed4f7de48"><enum>(4)</enum><header>Reasons for
				determination</header><text display-inline="yes-display-inline">In the case of
				a determination made pursuant to paragraph (3), the Trade Representative shall
				set forth in detail the reasons for that determination in the report required
				by subsection (a)(1)(D).</text>
								</paragraph></subsection><subsection id="id6A99077E56AA43CD8F6B81896DA0C52F"><enum>(c)</enum><header>Investigation
				and resolution</header>
								<paragraph commented="no" id="IDbcffa01bb7bb4d7f92ad7e4d2a576533"><enum>(1)</enum><header>In
				general</header><text>Upon submission of the report required by subsection
				(a)(1)(D), the Trade Representative shall, with respect to any priority foreign
				country trade practice identified, seek satisfactory resolution with the
				foreign country or countries engaging in the practice pursuant to paragraph
				(2). A satisfactory resolution may include the elimination of the practice or,
				if elimination of the practice is not feasible, the provision of compensatory
				trade benefits.</text>
								</paragraph><paragraph id="ID1cc5a707a1c34ad19004605ca5bbf1ba"><enum>(2)</enum><header>Consultations;
				investigations</header><text>Not later than 120 days after the submission of
				the report required by subsection (a)(1)(D), the Trade Representative shall,
				with respect to any priority foreign country trade practice identified in the
				report—</text>
									<subparagraph id="IDfce14e5d43c94133923124fa7a790bd1"><enum>(A)</enum><text>initiate dispute
				settlement consultations in the World Trade Organization;</text>
									</subparagraph><subparagraph id="ID5419d473a5eb4984ab2a169dbe965a30"><enum>(B)</enum><text>initiate dispute
				settlement consultations under the applicable provisions of any bilateral or
				regional trade agreement to which the United States is a party;</text>
									</subparagraph><subparagraph id="ID8a595b04fefc4fae9e3ef3a1c034df95"><enum>(C)</enum><text>initiate an
				investigation under section 302(b);</text>
									</subparagraph><subparagraph id="ID61720dfdff084f64bd5610f067bea94d"><enum>(D)</enum><text>seek to negotiate
				an agreement that provides for the elimination of the priority foreign country
				trade practice or, if elimination of the practice is not feasible, an agreement
				that provides for compensatory trade benefits; or</text>
									</subparagraph><subparagraph id="IDa5ae4e1475e146999d659ebcab9b6487"><enum>(E)</enum><text>take any other
				action necessary to eliminate the priority foreign country trade
				practice.</text>
									</subparagraph></paragraph><paragraph id="IDdbaac6d0e56d48cc94bfe002f3c2e455"><enum>(3)</enum><header>Report</header><text>On
				the day on which the Trade Representative takes action under subparagraph (E)
				of paragraph (2), the Trade Representative shall submit to Congress a
				report—</text>
									<subparagraph id="id1CDDB66B5C20499DA851FCE5D2A160D1"><enum>(A)</enum><text>describing the
				action taken under such subparagraph and the reasons for taking the action;
				and</text>
									</subparagraph><subparagraph id="idAC65524AA9DD4CB890888D1B9E3DB09C"><enum>(B)</enum><text>stating in detail
				the reasons the Trade Representative did not take action under subparagraphs
				(A) through (D) of paragraph (2).</text>
									</subparagraph></paragraph></subsection><subsection id="id0377ABCFEBD348F886018D4B4F621DDB"><enum>(d)</enum><header>Additional
				reporting</header><text>Not later than 6 months after the date of the enactment
				of this Act, and every 6 months thereafter, the Trade Representative shall
				report to the Committee on Finance of the Senate and the Committee on Ways and
				Means of the House of Representatives on—</text>
								<paragraph id="id4FF535C38CB747DA8F9E416B4FAACAA2"><enum>(1)</enum><text>the progress
				being made to achieve the trade enforcement priorities identified in subsection
				(a)(1)(A); and</text>
								</paragraph><paragraph id="id1AB346F10B3845E0A022EEF0243E327D"><enum>(2)</enum><text>the steps being
				taken to address the priority foreign country trade practices identified in
				subsection
				(a)(1)(C).</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" id="H87021201E83B49D88B81CD91C500857C"><enum>(b)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">The table of
			 contents of the Trade Act of 1974 is amended by inserting after the item
			 relating to section 310 the following:</text>

			 of position</header><text>Section 141(b)(2) of the Trade Act of 1974 (19 U.S.C.
			 2171(b)(2)) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="id5FD051CBEEBD4975A9B3799FE0F6D8F4" style="OLC">
						<paragraph id="ID1575b02627cc4f4eb40402cfb3986215" indent="up1"><enum>(2)</enum><text>There shall be in the Office 3 Deputy
				United States Trade Representatives, 1 Chief Agricultural Negotiator, and 1
				Chief Manufacturing Negotiator who shall all be appointed by the President, by
				and with the advice and consent of the Senate. As an exercise of the rulemaking
				power of the Senate, any nomination of a Deputy United States Trade
				Representative, the Chief Agricultural Negotiator, or the Chief Manufacturing
				Negotiator submitted to the Senate for its advice and consent, and referred to
				a committee, shall be referred to the Committee on Finance. Each Deputy United
				States Trade Representative, the Chief Agricultural Negotiator, and the Chief
				Manufacturing Negotiator shall hold office at the pleasure of the President and
				shall have the rank of
				Ambassador.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="ID08083e00fce54f41ba709d7d74a2d112"><enum>(b)</enum><header>Functions of
			 position</header><text>Section 141(c) of the Trade Act of 1974 (19 U.S.C.
			 2171(c)) is amended—</text>
					<paragraph id="idD6DABA7CCCFA4846899761ADA222D211"><enum>(1)</enum><text>by moving
			 paragraph (5) 2 ems to the left; and</text>

				of the Chief Manufacturing Negotiator shall be to conduct trade negotiations
				and to enforce trade agreements relating to United States manufacturing
				products and services. The Chief Manufacturing Negotiator shall be a vigorous
				advocate on behalf of United States manufacturing interests and shall perform
				such other functions as the United States Trade Representative may
				direct.</text>
								</subparagraph><subparagraph id="idE9BFCA3543094F13A180620174DF4D20" indent="up1"><enum>(B)</enum><text>Not later than 1 year after the date
				of the enactment of this paragraph, and annually thereafter, the Chief
				Manufacturing Negotiator shall submit to the Committee on Finance of the Senate
				and the Committee on Ways and Means of the House of Representatives a report on
				the actions taken by the Chief Manufacturing Negotiator in the preceding
				year.</text>
								</subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="IDcde97206005e414fb7fccf644b8742e7"><enum>(c)</enum><header>Compensation</header><text>Section
			 5314 of title 5, United States Code, as amended by section 101(c), is further
			 amended by inserting <quote>Chief Manufacturing Negotiator.</quote> after
			 <quote>Chief Agricultural Negotiator.</quote>.</text>
				</subsection><subsection id="IDe97aa78eb4214541939b8c4e54b8ac5d"><enum>(d)</enum><header>Technical
			 amendments</header><text>Section 141(e) of the Trade Act of 1974 (19 U.S.C.
			 2171(e)) is amended—</text>

					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idF28770DD12734F14932E31EFBABEA065"><enum>104.</enum><header display-inline="yes-display-inline">Plan for addressing nontariff barriers to
			 market access</header><text display-inline="no-display-inline">Not later than
			 180 days after the date of the enactment of this Act, the Deputy United States
			 Trade Representative for Trade Enforcement shall submit to the Committee on
			 Commerce, Science, and Transportation and the Committee on Finance of the
			 Senate and the Committee on Energy and Commerce and the Committee on Ways and
			 Means of the House of Representatives a plan for addressing nontariff barriers
			 affecting market access for United States companies in any country with respect
			 to which the United States has entered into a bilateral or regional trade
			 agreement or is negotiating such an agreement.</text>

			 enforcement of intellectual property rights</header>
			<subtitle id="H1D235C3EE8314416955B5600CDDA53EF"><enum>A</enum><header>Definitions
			 </header>
				<section id="H09F2AAD0FFC34B759E296C09912BDED0"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
					<paragraph id="HE61FD13AFECD4A9B8C2CDDE74C6BCB8D"><enum>(1)</enum><header>Advisory
			 committee</header><text display-inline="yes-display-inline">The term
			 <term>Advisory Committee</term> means the Advisory Committee on Import Safety
			 and Intellectual Property Rights Enforcement established pursuant to section
			 251.</text>
					</paragraph><paragraph id="HE03EBAD491EA45AF0042692EDF3FB3E"><enum>(2)</enum><header>Commissioner</header><text>The
			 term <term>Commissioner</term> means the Commissioner responsible for U.S.
			 Customs and Border Protection.</text>
					</paragraph><paragraph id="H890CBBCA415D4F92902FAE2402FA64B7"><enum>(3)</enum><header>Counterfeiting;
			 counterfeit goods</header>
						<subparagraph id="HC117CCCE7E80433688B624AB24BDB876"><enum>(A)</enum><header>Counterfeiting</header><text>The
			 term <term>counterfeiting</term> means activities related to production of or
			 trafficking in goods, including packaging, that bear a spurious mark or
			 designation that is identical to or substantially indistinguishable from a mark
			 or designation protected under the trademark laws or related laws. </text>
						</subparagraph><subparagraph id="H0049FFBAB1124C4CB37F833CBD3CD29E"><enum>(B)</enum><header>Counterfeit
			 goods</header><text>The term <term>counterfeit goods</term> means goods
			 described in subparagraph (A).</text>
						</subparagraph></paragraph><paragraph id="HC428B2E1DEC14145A56629F2489F21E"><enum>(4)</enum><header>Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the
			 Director of Intellectual Property Rights Enforcement of the Department of the
			 Treasury established under section 211.</text>
					</paragraph><paragraph id="H25AFCC7F22774BCD8DC324487DF0B868"><enum>(5)</enum><header>Enforcement of
			 intellectual property rights</header><text>The term <term>enforcement of
			 intellectual property rights</term> means activities to enforce—</text>
						<subparagraph id="idCC43D10C7FF8454CAE99638DE16E217C"><enum>(A)</enum><text>copyrights,
			 patents, trademarks, and other forms of intellectual property, including
			 activities to control counterfeiting and piracy; and</text>
						</subparagraph><subparagraph id="id06B6F2248B114CFCB5918F291CDC4A1E"><enum>(B)</enum><text>exclusion orders
			 issued by the United States International Trade Commission by reason of any of
			 subparagraphs (B) through (E) of subsection (a)(1) of section 337 of the Tariff
			 Act of 1930 (19 U.S.C. 1337(a)(1) (B) through (E)).</text>
						</subparagraph></paragraph><paragraph id="H6A4CB68ECAA247C8989E40DDD471B6CA"><enum>(6)</enum><header>Exclusion
			 order</header><text>The term <term>exclusion order</term> means an order of the
			 United States International Trade Commission issued under section 337 (d) or
			 (e) of the Tariff Act of 1930 (19 U.S.C. 1337 (d) and (e)) to exclude goods
			 from entry into the United States.</text>
					</paragraph><paragraph id="H515CEB69150B406D8B15EDA00E9BFA3"><enum>(7)</enum><header>Piracy; pirated
			 goods</header>
						<subparagraph id="HB95C50A5D9C74E5F879E233DE06128EB"><enum>(A)</enum><header>Piracy</header><text>The
			 term <term>piracy</term> means activities related to production of or
			 trafficking in unauthorized copies or phonorecords of works protected under
			 title 17, United States Code, or related laws.</text>
						</subparagraph><subparagraph id="H8BC98882287B4DFE951313083979199C"><enum>(B)</enum><header>Pirated
			 goods</header><text>The term <term>pirated goods</term> means copies or
			 phonorecords described in subparagraph (A).</text>
						</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H75B12365F2374A15A7FA1DDF36E0219F"><enum>(8)</enum><header>Secretary</header><text>Except
			 as otherwise provided, the term <term>Secretary</term> means the Secretary of
			 the Treasury.</text>
					</paragraph><paragraph display-inline="no-display-inline" id="id8F06D54ED23F44DAA8399A46685E1E4F"><enum>(9)</enum><header>Transshipment</header><text>The
			 term <term>transshipment</term> means the shipment of goods through one country
			 that is an intermediate destination to another country that is the final
			 destination of the goods.</text>
					</paragraph></section></subtitle><subtitle id="idBF1765E2EB8F46E68204FC6C9DCE8B99"><enum>B</enum><header>Coordination of
			 enforcement of intellectual property rights</header>
				<section id="HD93594A803B545398911F4B6337E7987"><enum>211.</enum><header>Director of
			 Intellectual Property Rights Enforcement</header>
					<subsection display-inline="no-display-inline" id="H1660B7A3C4704C66A61974A5C11CD550"><enum>(a)</enum><header>Establishment</header><text>There
			 is established within the Department of the Treasury the position of Director
			 of Intellectual Property Rights Enforcement.</text>
					</subsection><subsection id="H6F92ED456D2D485BBAA1DD756019769D"><enum>(b)</enum><header>Appointment</header><text>The
			 Director shall be appointed by the Secretary, and shall be responsible to and
			 shall report directly to the Deputy Secretary of the Treasury.</text>
					</subsection><subsection id="HAA110E5DA27F47A5B509E3A575EB6B00"><enum>(c)</enum><header>Duties</header><text>The
			 Director shall—</text>
						<paragraph id="H3385EA12D8F941E9BEEA67EE69514F21"><enum>(1)</enum><text>coordinate all
			 activities of the Department of the Treasury involving the enforcement of
			 intellectual property rights and coordinate with U.S. Customs and Border
			 Protection and U.S. Immigration and Customs Enforcement with respect to such
			 enforcement;</text>
						</paragraph><paragraph id="HF48A9782948741B1A159ED6F9BC2BA5"><enum>(2)</enum><text>oversee the
			 development and implementation of the strategic plan for the enforcement of
			 intellectual property rights required under section 212;</text>
						</paragraph><paragraph id="H6192C3382056406D84A8007382CE234D"><enum>(3)</enum><text>coordinate the
			 policy and regulatory changes set forth in this title;</text>
						</paragraph><paragraph id="H373A4B5F93AD4AE4856168E8615CF18F"><enum>(4)</enum><text>serve as staff
			 representative of the Department of the Treasury in interagency bodies with
			 responsibility for coordination of activities involving the enforcement of
			 intellectual property rights;</text>
						</paragraph><paragraph id="HDE2FC9E5FF47498DA2B8CE4976AF9B89"><enum>(5)</enum><text>conduct an
			 evaluation of the effectiveness of the organizational structure of U.S. Customs
			 and Border Protection for reducing the entry into the United States of
			 counterfeit or pirated goods, goods in violation of exclusion orders, and other
			 goods in violation of other intellectual property rights; and</text>
						</paragraph><paragraph id="H902A21D8D70E48B0BFE6C94EC9D4F29"><enum>(6)</enum><text display-inline="yes-display-inline">carry out other duties, as assigned by the
			 Secretary or Deputy Secretary of the Treasury, to improve the effectiveness of
			 the efforts of the Department of the Treasury under the laws within its
			 jurisdiction with respect to the enforcement of intellectual property
			 rights.</text>
						</paragraph></subsection></section><section id="H1E0610959136457EAB092BF614A81375"><enum>212.</enum><header>Strategic plan
			 for the enforcement of intellectual property rights</header>
					<subsection id="H1D2AA02BD42A46A7885498A2541171D0"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Director shall
			 develop, for approval by the Deputy Secretary of the Treasury, an annual
			 strategic plan for the enforcement of intellectual property rights.</text>
					</subsection><subsection id="H306FDACC7AE74DBD947DBB2CF0BC491D"><enum>(b)</enum><header>Consultation</header><text>In
			 developing the annual strategic plan required under subsection (a), the
			 Director shall consult with—</text>
						<paragraph id="H82FEACEEB5934A6599889C9885752400"><enum>(1)</enum><text>the Advisory
			 Committee;</text>
						</paragraph><paragraph id="H809A804E7E0F4E25A67DCD55719DEFC5"><enum>(2)</enum><text>the U.S. Customs
			 and Border Protection Intellectual Property Rights Coordinator and the U.S.
			 Immigration and Customs Enforcement Intellectual Property Rights Coordinator
			 appointed under section 213;</text>
						</paragraph><paragraph id="H085A8D2A1A4D4C948E6BAE8388AB4FC9"><enum>(3)</enum><text display-inline="yes-display-inline">all entities within the Department of the
			 Treasury with expertise and experience in the enforcement of intellectual
			 property rights;</text>
						</paragraph><paragraph id="H057907FEBEA046B49EC258E0A50051A5"><enum>(4)</enum><text display-inline="yes-display-inline">other agencies of the executive branch
			 engaged in the enforcement of intellectual property rights, including any
			 officials designated to coordinate such enforcement efforts on an interagency
			 basis; and</text>
						</paragraph><paragraph id="HEBD137A3482F48718BBC9BE7994C11FD"><enum>(5)</enum><text display-inline="yes-display-inline">officials from foreign law enforcement
			 agencies and international organizations, including the World Customs
			 Organization, with experience and expertise in border control measures relating
			 to the enforcement of intellectual property rights.</text>
						</paragraph></subsection><subsection id="HC3C411CD1F024C14ADD884EA6DA31200"><enum>(c)</enum><header>Contents of
			 plan</header><text display-inline="yes-display-inline">The annual strategic
			 plan shall set forth objectives, goals, and strategies for more effective use
			 of the authorities of U.S. Customs and Border Protection and U.S. Immigration
			 and Customs Enforcement relating to the enforcement of intellectual property
			 rights, and shall—</text>
						<paragraph id="HDE0D70D478BE4EA3AA07E9674230C795"><enum>(1)</enum><text>provide for
			 specific measurement of the current effectiveness of enforcement tools,
			 including targeting, examination, post-entry auditing, and penalty
			 actions;</text>
						</paragraph><paragraph id="HE719C920438A456DAA78CACA84119D39"><enum>(2)</enum><text>give priority to
			 those enforcement tools determined under paragraph (1) to be most
			 effective;</text>
						</paragraph><paragraph id="H37783668555B496DBC5E5B9EE68884BD"><enum>(3)</enum><text display-inline="yes-display-inline">identify best practices, both in the United
			 States and abroad, with respect to the enforcement of intellectual property
			 rights, taking into account the practices of enforcement authorities of other
			 countries, and implement those practices;</text>
						</paragraph><paragraph id="H4B6723886DC848F491A285E62BBEE291"><enum>(4)</enum><text display-inline="yes-display-inline">identify and apply the specific performance
			 measures to be used to evaluate the progress of U.S. Customs and Border
			 Protection and U.S. Immigration and Customs Enforcement in improving the
			 effectiveness of efforts relating to the enforcement of intellectual property
			 rights;</text>
						</paragraph><paragraph id="H5C467F7652CE4A07AC73E4DD4D789EC5"><enum>(5)</enum><text display-inline="yes-display-inline">address border control programs
			 administered by U.S. Customs and Border Protection and U.S. Immigration and
			 Customs Enforcement at ports of entry for passengers and freight, and at points
			 of entry for postal and courier services, as well as for goods being
			 transshipped through United States ports and in the process of being exported
			 from the United States;</text>
						</paragraph><paragraph commented="no" id="id488126AF564B418996B28E6C9E7BA19F"><enum>(6)</enum><text>require
			 cooperation between U.S. Customs and Border Protection and U.S. Immigration and
			 Customs Enforcement and State and local law enforcement agencies with respect
			 to the enforcement of intellectual property rights and sharing information with
			 respect to detained shipments of goods suspected of violating intellectual
			 property rights at ports of entry;</text>
						</paragraph><paragraph id="H0023D80385004A2584F1FCBBCC723FB"><enum>(7)</enum><text display-inline="yes-display-inline">recommend the optimal feasible allocation
			 of human, financial, physical, and technological resources that U.S. Customs
			 and Border Protection and U.S. Immigration and Customs Enforcement should use
			 to achieve the goals of the annual strategic plan;</text>
						</paragraph><paragraph id="HD87B7455D0CE42CDACC828F6EDB024"><enum>(8)</enum><text display-inline="yes-display-inline">report on the key activities of U.S.
			 Customs and Border Protection and U.S. Immigration and Customs Enforcement
			 during the preceding year with respect to the enforcement of intellectual
			 property rights; and</text>
						</paragraph><paragraph id="H76D82695699A4FBCBE008D1DAE9BBCE4"><enum>(9)</enum><text display-inline="yes-display-inline">contain such other information as the
			 Director considers appropriate to convey what U.S. Customs and Border
			 Protection and U.S. Immigration and Customs Enforcement will do, over the
			 following year, with respect to the enforcement of intellectual property rights
			 and reducing the costs that violations of intellectual property rights impose
			 on the United States economy and public safety.</text>
						</paragraph></subsection><subsection id="idA7E339ACF3194036814B98627AF4E259"><enum>(d)</enum><header>Approval of
			 plan by Deputy Secretary of the Treasury</header><text>The Director shall
			 submit the annual strategic plan to the Deputy Secretary of the Treasury for
			 approval, who shall ensure that the plan is consistent with any other relevant
			 interagency strategic plans.</text>
					</subsection><subsection id="HB049FD1178F648C983E627ABC6D508C7"><enum>(e)</enum><header>Submission to
			 Congress</header><text display-inline="yes-display-inline">After approving the
			 annual strategic plan under subsection (d), the Deputy Secretary of the
			 Treasury shall transmit the annual strategic plan to the Committee on Finance
			 of the Senate and the Committee on Ways and Means of the House of
			 Representatives, along with any recommendations of the Department of the
			 Treasury for statutory changes or funding authorizations needed to improve the
			 effectiveness of the Department’s efforts with respect to the enforcement of
			 intellectual property rights.</text>
					</subsection><subsection id="H494C2879739E419AB44E7B35D314C921"><enum>(f)</enum><header>Timing</header><text>The
			 Deputy Secretary of the Treasury shall submit the annual strategic plan under
			 subsection (d) not later than 180 days after the date of the enactment of this
			 Act and annually thereafter.</text>
					</subsection></section><section id="H820896EE252A4CB0BE7B8F8EAD7C7659"><enum>213.</enum><header>U.S. Customs
			 and Border Protection and U.S. Immigration and Customs Enforcement intellectual
			 property rights coordinators</header>
					<subsection id="H65B99653D976461795D2CB2FB6D08143"><enum>(a)</enum><header>U.S. Customs and
			 Border Protection Intellectual Property Rights Coordinator</header>
						<paragraph display-inline="no-display-inline" id="HF5DB122FF46A4EE7BED43EABFDB1EC3D"><enum>(1)</enum><header>Appointment</header><text display-inline="yes-display-inline">The Commissioner shall appoint a U.S.
			 Customs and Border Protection coordinator of intellectual property rights
			 enforcement activities (in this subtitle referred to as the <quote>U.S. Customs
			 and Border Protection Intellectual Property Rights Coordinator</quote>), who
			 shall report directly to the Commissioner.</text>
						</paragraph><paragraph id="H6F7F9D6E194A47B5BF60357237D50076"><enum>(2)</enum><header>Duties</header><text>The
			 U.S. Customs and Border Protection Intellectual Property Rights Coordinator
			 shall—</text>
							<subparagraph id="H52E06C68756445F9A28717F15BE5B1B8"><enum>(A)</enum><text>assist the
			 Director of Intellectual Property Rights Enforcement of the Department of the
			 Treasury in the development of the annual strategic plan and coordinate the
			 implementation of those aspects of the plan that involve U.S. Customs and
			 Border Protection;</text>
							</subparagraph><subparagraph id="HF7EF4A0DCF9D4B19A3FC47CF2E30B172"><enum>(B)</enum><text display-inline="yes-display-inline">coordinate all efforts, at all ports of
			 entry and elsewhere, carried out by U.S. Customs and Border Protection with
			 respect to the enforcement of intellectual property rights, including training
			 and staffing;</text>
							</subparagraph><subparagraph id="HBC2745E9433E4F01ABEE865033F25806"><enum>(C)</enum><text>supervise the
			 implementation of those aspects of the regulatory and policy reforms set out in
			 this title that involve U.S. Customs and Border Protection and submit a report
			 on such activities to the Director to be included in the annual strategic plan
			 required under section 212; and</text>
							</subparagraph><subparagraph id="H98F8CF26D49B41C29EF6FCA73FF422FA"><enum>(D)</enum><text display-inline="yes-display-inline">carry out such other duties, as assigned by
			 the Commissioner, the purpose of which are to improve the performance of U.S.
			 Customs and Border Protection with respect to the enforcement of intellectual
			 property rights.</text>
							</subparagraph></paragraph></subsection><subsection id="H9678C54EB95A49E8A1A13EE16B8450B1"><enum>(b)</enum><header>U.S. Immigration
			 and Customs Enforcement intellectual property rights coordinator</header>
						<paragraph display-inline="no-display-inline" id="H12D2816B80134EA19F87B59071EA4617"><enum>(1)</enum><header>Appointment</header><text display-inline="yes-display-inline">The Assistant Secretary for United States
			 Immigration and Customs Enforcement shall appoint an U.S. Immigration and
			 Customs Enforcement coordinator of intellectual property enforcement activities
			 (in this subtitle referred to as the <quote>U.S. Immigration and Customs
			 Enforcement Intellectual Property Rights Coordinator</quote>), who shall report
			 directly to the Assistant Secretary for U.S. Immigration and Customs
			 Enforcement.</text>
						</paragraph><paragraph id="H03B3526105684B67AB20002464D668D6"><enum>(2)</enum><header>Duties</header><text>The
			 U.S. Immigration and Customs Enforcement Intellectual Property Rights
			 Coordinator shall—</text>
							<subparagraph id="H056B0DB846B4423CA565E1E180A75D00"><enum>(A)</enum><text>assist the
			 Director of Intellectual Property Rights Enforcement of the Department of the
			 Treasury in the development of the annual strategic plan and coordinate the
			 implementation of those aspects of the plan that involve U.S. Immigration and
			 Customs Enforcement;</text>
							</subparagraph><subparagraph id="H11C49DF8DD98471BA80395E1B9EFE8F5"><enum>(B)</enum><text display-inline="yes-display-inline">coordinate all efforts carried out by U.S.
			 Immigration and Customs Enforcement with respect to the enforcement of
			 intellectual property rights, including training and staffing;</text>
							</subparagraph><subparagraph id="HA586C0F4641A48708CA76E4BB588C88C"><enum>(C)</enum><text>supervise the
			 implementation of those aspects of the regulatory and policy reforms set out in
			 this title that involve U.S. Immigration and Customs Enforcement; and</text>
							</subparagraph><subparagraph id="H8843E1E0594D46B6973C5357A0001C"><enum>(D)</enum><text display-inline="yes-display-inline">carry out such other duties, as assigned by
			 the Assistant Secretary for U.S. Immigration and Customs Enforcement, the
			 purpose which are to improve the performance of U.S. Immigration and Customs
			 Enforcement with respect to the enforcement of intellectual property
			 rights.</text>
							</subparagraph></paragraph></subsection></section></subtitle><subtitle id="HDAAB8146FA3D4DD188FDB2F9591883E0"><enum>C</enum><header>Regulatory and
			 policy improvements with respect to combating counterfeiting and
			 piracy</header>
				<section id="HFBA45C1FC8CE47C9A5313953A154CFB2"><enum>221.</enum><header>Identification
			 of certain unlawful goods</header>
					<subsection id="HAE8D0A3C92A94538BD700506BAB3BCD2"><enum>(a)</enum><header>In
			 general</header><text>The Secretary, acting through the Commissioner, shall
			 prescribe regulations to apply risk assessment modeling techniques to border
			 enforcement activities with respect to combating counterfeiting and piracy.
			 Such efforts shall include—</text>
						<paragraph id="HB84A2F4B09BE45EB862F1DEB953E5127"><enum>(1)</enum><text>preparing a report
			 on and evaluation of the pilot project of U.S. Customs and Border Protection
			 with respect to shipments of counterfeit or pirated products;</text>
						</paragraph><paragraph id="HD0B49B1E2FF943F99D53B10369AF62BE"><enum>(2)</enum><text>expanding the
			 pilot project to allow for the use of the Automated Targeting System in risk
			 assessment modeling; and</text>
						</paragraph><paragraph id="H8B666800E2C144CE81034210D25C7842"><enum>(3)</enum><text>developing a plan
			 for the development, testing, evaluation, and continuous improvement of risk
			 assessment modeling techniques to facilitate the enforcement of intellectual
			 property rights.</text>
						</paragraph></subsection><subsection id="HB28DB2CAE0F9485CB652C9675C8F5F8E"><enum>(b)</enum><header>Inclusion in
			 strategic plan</header><text>The report described in subsection (a)(1), and the
			 plan described in subsection (a)(3), shall be included in the annual strategic
			 plan that is required under section 212.</text>
					</subsection></section><section commented="no" id="HCC2F1DBD84E6455F92274C09F225572E"><enum>222.</enum><header>Training in new
			 technologies</header>
					<subsection commented="no" id="H16B57919359240BA9D7800C16600641B"><enum>(a)</enum><header>Training of
			 personnel</header><text display-inline="yes-display-inline">The Commissioner
			 shall consult with the Advisory Committee to determine the feasibility of
			 training U.S. Customs and Border Protection personnel in the use of new
			 technological means for detecting and identifying, at ports of entry,
			 counterfeit and pirated goods, and goods that are subject to exclusion orders,
			 whether for entry into the United States or for transshipment to other
			 destinations.</text>
					</subsection><subsection commented="no" id="H01033E8B4C2C4823B653F723F9FF9886"><enum>(b)</enum><header>Identification
			 of technologies and sources of training</header><text display-inline="yes-display-inline">In consultation with the Advisory
			 Committee, the Commissioner shall identify—</text>
						<paragraph commented="no" id="H74D0FF6B201B42B498AB3403A0538185"><enum>(1)</enum><text display-inline="yes-display-inline">cost-effective technologies for detecting
			 and identifying goods described in subsection (a) at ports of entry; and</text>
						</paragraph><paragraph commented="no" id="H50FFFF8D6EB54C7DA2E193F88311A5F8"><enum>(2)</enum><text>economical sources
			 for training U.S. Customs and Border Protection personnel in the use of such
			 technologies.</text>
						</paragraph></subsection><subsection commented="no" id="H32E339D28B3C49E38474A94EBC0200F7"><enum>(c)</enum><header>Regulatory and
			 policy changes</header><text>The Comptroller General of the United States shall
			 submit to Congress a report analyzing the costs and benefits of making
			 regulatory and policy changes to enable the receipt of donations of hardware,
			 software, equipment, and similar technologies, and the acceptance of training
			 and other support services, from the private sector, to facilitate the training
			 of personnel of U.S. Customs and Border Protection under subsection (a).</text>
					</subsection></section><section id="HBD9D88C3135B40DAB198B35940E7296E"><enum>223.</enum><header>Disclosure of
			 information and samples of shipments to intellectual property
			 owners</header><text display-inline="no-display-inline">The Commissioner shall
			 prescribe regulations to—</text>
					<paragraph id="H6DD2213E11F549AEB18C4966445918E2"><enum>(1)</enum><text display-inline="yes-display-inline">improve the process of making samples of
			 shipments of goods suspected of violating intellectual property rights
			 available to the owners of copyrights, trademarks, patents, and other forms of
			 intellectual property, in an efficient and cost-effective manner, for the
			 purpose of inspection or analysis, including by developing a process under
			 which—</text>
						<subparagraph id="id4F0C5B7F358846EFBFE79CA8574DDD8C"><enum>(A)</enum><text display-inline="yes-display-inline">a requirement that such an owner post a
			 bond to receive such a sample may be waived if the value of the sample is less
			 than $100; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id019F02B9C09D467C90111631B28C3CBD"><enum>(B)</enum><text>such an owner may
			 elect to obtain a continuous bond with respect to such samples; and</text>
						</subparagraph></paragraph><paragraph id="HFB0511363D1E419E8D782F78F022E168"><enum>(2)</enum><text>increase
			 disclosure to owners of copyrights, trademarks, patents, and other forms of
			 intellectual property of information about shipments of goods that have been
			 detained at ports of entry on suspicion that the importation into, or
			 transshipment through, the United States of those goods would violate the
			 intellectual property rights of such owners, including—</text>
						<subparagraph id="H87756A1B75BC4511B85FFE71B40007BB"><enum>(A)</enum><text>providing a
			 detailed description of the goods, including information on the packaging of
			 the goods such as expiration dates and model, lot, batch, part, or serial
			 numbers or universal product codes (UPC);</text>
						</subparagraph><subparagraph id="id7B3FC6D1CF17454890F92D214ACBD732"><enum>(B)</enum><text>providing
			 photographs of the goods that do not mask identifying information about the
			 goods;</text>
						</subparagraph><subparagraph id="id05C31A1F9474474ABED4E6D01B070E87"><enum>(C)</enum><text>disclosing the
			 identities and contact information of all parties involved in the shipments,
			 including importers, exporters, declarants, consignees, freight forwarders, and
			 warehouse owners;</text>
						</subparagraph><subparagraph id="HA6C3206993B049F49F55787F726CAE23"><enum>(D)</enum><text>identifying points
			 of origin and destination of the shipments; and</text>
						</subparagraph><subparagraph id="H50658BDB638D4EB5A6DE46E000DBBF25"><enum>(E)</enum><text>providing any
			 other documents relating to the shipments.</text>
						</subparagraph></paragraph></section><section id="HF0BFDA46D5DF4F399B35FACE4207E255"><enum>224.</enum><header>Improvements to
			 recordation process</header>
					<subsection id="H678752B8655B4FA686069F6FB7EF62B"><enum>(a)</enum><header>Improvements in
			 recordation process</header><text>The Commissioner shall prescribe regulations
			 to ensure that the system for recordation of copyrights, trademarks, patents,
			 and other forms of intellectual property that may be subject to recordation,
			 does not impede the rapid seizure of goods that violate the rights of the
			 owners of such copyrights, trademarks, patents, and other forms of intellectual
			 property.</text>
					</subsection><subsection id="H4F846BB5A92A4D49A1ADCBA2DA000384"><enum>(b)</enum><header>Simultaneous
			 recordation</header>
						<paragraph commented="no" id="HFE9D4B451F374E97881734206300BCE3"><enum>(1)</enum><header>In
			 general</header><text>In consultation with the Under Secretary of Commerce for
			 Intellectual Property and Director of the United States Patent and Trademark
			 Office, and the Register of Copyrights, the Commissioner shall develop a system
			 pursuant to which—</text>
							<subparagraph commented="no" id="id371A8809C3C84188BA1F9222F8ECAB72"><enum>(A)</enum><text>trademarks may be
			 recorded with U.S. Customs and Border Protection simultaneously with the
			 issuance of trademark registration; and</text>
							</subparagraph><subparagraph commented="no" id="idFC37636EB0F1452C883742D2AAD5492F"><enum>(B)</enum><text>copyrights of
			 audiovisual works and sound recordings may be recorded with U.S. Customs and
			 Border Protection simultaneously with the filing of an application for a
			 certificate of copyright registration or an application for registration of
			 another intellectual property right under title 17, United States Code.</text>
							</subparagraph></paragraph><paragraph id="H330D5FEC8EFF4DFAB10775F882785DD5"><enum>(2)</enum><header>Definitions</header><text>In
			 this subsection, the terms <quote>audiovisual works</quote> and <quote>sound
			 recordings</quote> have the meanings given those terms in section 101 of title
			 17, United States Code.</text>
						</paragraph></subsection></section><section id="H9318C97A17974F2293DE3367F229DA5"><enum>225.</enum><header>Identification
			 of low-risk importers</header>
					<subsection id="H10A87AF4429243D7002DE72B5160BCEE"><enum>(a)</enum><header>In
			 general</header><text>The Commissioner shall develop a voluntary certification
			 program for importers that have taken specific measures to strengthen and
			 protect their supply chains to prevent the infiltration into the international
			 supply chain of counterfeit and pirated goods, goods that are the subject to
			 exclusion orders, and goods that violate other forms of intellectual property
			 rights.</text>
					</subsection><subsection id="id1C347F7793FE4460B8485AF4C1B4D2A5"><enum>(b)</enum><header>Self-certification</header><text>The
			 voluntary certification program developed under subsection (a) shall rely
			 primarily on self-certification by importers in determining the eligibility of
			 importers for the program.</text>
					</subsection><subsection id="ID256e4c60c52447858bd0d8d2506851ae"><enum>(c)</enum><header>Third party
			 verifications</header><text>The Commissioner shall identify any circumstances,
			 such as importation from any country with a history of being identified under
			 section 182 of the Trade Act of 1974 (19 U.S.C. 2242) as denying adequate and
			 effective protection of intellectual property rights, under which third party
			 verifications shall be required to determine the eligibility of importers for
			 the voluntary certification program.</text>
					</subsection><subsection id="ID90d410a0ac9e44739110a687f0366226"><enum>(d)</enum><header>Benefits</header><text>An
			 importer determined to be eligible for the voluntary certification program and
			 to have taken the measures required under subsection (a) may receive benefits
			 with respect to customs requirements, such as reduced inspections from U.S.
			 Customs and Border Protection.</text>
					</subsection><subsection id="H433498B265164420A4402C55748C14FA"><enum>(e)</enum><header>Definition</header><text>In
			 this section, the term <quote>international supply chain</quote> has the
			 meaning given that term in section 2 of the Security and Accountability for
			 Every Port Act of 2006 (6 U.S.C. 901).</text>
					</subsection></section><section id="H17F42C076E6440D7A93EB25DE55153D9"><enum>226.</enum><header><quote>Watch
			 List</quote> database</header>
					<subsection id="ID98785011519141458b9b41ee1e2825f1"><enum>(a)</enum><header>In
			 general</header><text>The Secretary, acting through the Commissioner, shall
			 develop and implement a database of importers, shippers, freight forwarders,
			 and other participants in the import, export, and transshipment process, whose
			 activities the Commissioner determines merit special scrutiny at ports of entry
			 because of the risk of importation, exportation, or transshipment of goods that
			 violate intellectual property rights or exclusion orders.</text>
					</subsection><subsection id="IDb821bd385c15408babc6457e4ea92115"><enum>(b)</enum><header>Plan</header><text>The
			 Secretary, acting through the Commissioner, shall develop a plan to implement
			 the database required under subsection (a). The plan shall—</text>
						<paragraph id="id31CDF5C9A9EB4CFE83606AA518BABD71"><enum>(1)</enum><text>identify
			 legitimate information sources to be used in determining whether to place
			 persons on the database from—</text>
							<subparagraph id="id3A74C099183A43E4AA30673F73458478"><enum>(A)</enum><text>within U.S.
			 Customs and Border Protection;</text>
							</subparagraph><subparagraph id="id15A9E593CBB44065BF2858FFD5121ABB"><enum>(B)</enum><text>other law
			 enforcement sources; and</text>
							</subparagraph><subparagraph id="idB3F5ED4BB57C436C92E54F2FBD98A307"><enum>(C)</enum><text>the private
			 sector;</text>
							</subparagraph></paragraph><paragraph id="ID05f5d768fdc0437a9eb5d0ad3f66c19b"><enum>(2)</enum><text>establish
			 criteria under which the database should be made available—</text>
							<subparagraph id="idAE84F7B9DC7D4F3B8DDCE50DC8C868F0"><enum>(A)</enum><text>to qualified
			 officers of U.S. Customs and Border Protection and other law enforcement
			 agencies;</text>
							</subparagraph><subparagraph id="id25D7D4C4D701438DB00F80A23A457D27"><enum>(B)</enum><text>for intelligence
			 purposes; and</text>
							</subparagraph><subparagraph id="id4969A0E2A72A438EA4B791F996C302F8"><enum>(C)</enum><text>for use in
			 identifying shipments for enhanced inspection;</text>
							</subparagraph></paragraph><paragraph id="ID76804d84d5a348f49225d568db6a066e"><enum>(3)</enum><text>identify any
			 regulatory or policy changes that are necessary to make the database
			 operational;</text>
						</paragraph><paragraph id="idC5839006B5474C769A49B71B80E90174"><enum>(4)</enum><text>contain any
			 recommendations for statutory changes to improve the effectiveness of the
			 database;</text>
						</paragraph><paragraph id="idEE5669A7CBC74143BD5B5240A9826F91"><enum>(5)</enum><text>include an
			 estimate of the resources necessary to implement and operate the database and
			 to evaluate its effectiveness; and</text>
						</paragraph><paragraph id="idF3E03245FDA94FFCBE70D756DB1C4720"><enum>(6)</enum><text>include a
			 timetable for implementation of the database.</text>
						</paragraph></subsection><subsection id="H6FBEF57CBAD2480181B1A7F092223FD2"><enum>(c)</enum><header>Consultations
			 with Advisory Committee</header><text>The Commissioner shall consult with the
			 Advisory Committee on the development of criteria for the database.</text>
					</subsection><subsection id="H5BAB842C156C47CDB6802D93588072DE"><enum>(d)</enum><header>Timing</header><text>The
			 Commissioner shall complete the plan required under subsection (b) in a timely
			 fashion that will permit the inclusion of the plan in the first annual
			 strategic plan required under section 212.</text>
					</subsection></section><section id="HD91FEF348F414134007CACBDAFD0E125"><enum>227.</enum><header>Civil fines for
			 importation of pirated or counterfeit goods</header>
					<subsection id="H5796ADE1629C421FAE997F97A1A38C0"><enum>(a)</enum><header>Limitation on
			 mitigation, dismissal, and vacation of fines</header><text display-inline="yes-display-inline">Unless otherwise ordered by a court of
			 competent jurisdiction, any civil fine imposed pursuant to section 526(f) of
			 the Tariff Act of 1930 (19 U.S.C. 1526(f))—</text>
						<paragraph id="H7D0518E1A16D495A9C2331B0E63DA9FB"><enum>(1)</enum><text>may not be
			 mitigated, except pursuant to regulations issued by the Commissioner;
			 and</text>
						</paragraph><paragraph id="HB3D169E4366C461B919162EE5569DE4F"><enum>(2)</enum><text>may not be
			 dismissed or vacated, except pursuant to regulations issued by the Commissioner
			 that require the specific approval of the Commissioner or the Commissioner’s
			 designee for such dismissal or vacation.</text>
						</paragraph></subsection><subsection id="H566A6D20DD394C828273B8F3544158B2"><enum>(b)</enum><header>Extraordinary
			 cases</header><text>In issuing regulations under subsection (a), the
			 Commissioner shall ensure that the mitigation, dismissal, or vacation of civil
			 fines for involvement in the importation, exportation, or transshipment of
			 pirated or counterfeit goods is limited to extraordinary cases in which the
			 interests of justice will clearly be served by such action.</text>
					</subsection></section><section id="id916F181B652D44FF85C1E3C01074F0A1"><enum>228.</enum><header>Report on
			 effective collection techniques</header>
					<subsection id="IDf09e98cb87314561b701b21da856330c"><enum>(a)</enum><header>In
			 general</header><text>The Commissioner shall submit to the Committee on Finance
			 of the Senate and the Committee on Ways and Means of the House of
			 Representatives a report on—</text>
						<paragraph id="ID5853840c01d441e89ecd371816034063"><enum>(1)</enum><text>the extent to
			 which U.S. Customs and Border Protection uses effective collection techniques
			 for collecting civil fines imposed on persons that import, export, or transship
			 pirated or counterfeit goods;</text>
						</paragraph><paragraph id="id8FC1CDCD80FF431A8262D618C6084D68"><enum>(2)</enum><text>any
			 recommendations with respect to improving the use of such techniques by U.S.
			 Customs and Border Protection;</text>
						</paragraph><paragraph id="ID1538413d02eb4a6ba9a6d473169190a4"><enum>(3)</enum><text>any
			 recommendations with respect to whether—</text>
							<subparagraph id="id3CDF567E7F734E43BF94DCA06E3BD124"><enum>(A)</enum><text>owners of
			 copyrights or trademarks should be authorized to pursue and collect fines
			 imposed as a result of activities that violate such copyrights or trademarks;
			 and</text>
							</subparagraph><subparagraph id="id92660B47D7B446A58191FFB534D15938"><enum>(B)</enum><text>such owners
			 should be allowed to retain some or all of any funds so collected; and</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd500a2ebcb7b4fa29e06bbe8c85e446e"><enum>(4)</enum><text>any other
			 recommendations for statutory, regulatory, or policy changes not under the
			 control of U.S. Customs and Border Protection to improve the agency’s
			 ability—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idD1C22C3B13214018B6170591A98EB371"><enum>(A)</enum><text>to impose civil
			 fines on persons that import, export, or transship pirated or counterfeit
			 goods, at levels that would deter such importation, exportation, and
			 transshipment; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id87D32BFF6AF446A0B81C7959877256F0"><enum>(B)</enum><text>to collect such
			 fines.</text>
							</subparagraph></paragraph></subsection><subsection id="ID1afcd8e476574e3083be84d29c2d717e"><enum>(b)</enum><header>Effective
			 collection techniques</header><text>In this section, the term <term>effective
			 collection techniques</term> includes—</text>
						<paragraph id="IDb1bc9c1f4b1f408ca8e275b42146e699"><enum>(1)</enum><text>confiscation of
			 the proceeds of actions for which civil fines can be imposed;</text>
						</paragraph><paragraph id="ID2995b3c4d6cc4f6baead1b726aa9b296"><enum>(2)</enum><text>seizure of
			 property acquired with such proceeds;</text>
						</paragraph><paragraph id="ID72b66fc731884d97a4c3029bc50781ff"><enum>(3)</enum><text>imposition of
			 liens on the real or personal property of persons upon whom civil fines are
			 imposed;</text>
						</paragraph><paragraph id="ID571f8ad636084bfd8eeee06c13862dce"><enum>(4)</enum><text>use of bonds to
			 secure full payment of fines;</text>
						</paragraph><paragraph id="idE967CF7326AC4AA5A0AA79C8ECCFD6EC"><enum>(5)</enum><text>in any case in
			 which an entity is liable and has no assets or is no longer in business,
			 holding liable any person who—</text>
							<subparagraph id="id58856664C5A540558E0263DF2E6073AC"><enum>(A)</enum><text>was an officer or
			 director of the entity;</text>
							</subparagraph><subparagraph id="id3A9500D3EE224C078F2407F856ECFDEC"><enum>(B)</enum><text>in the case of a
			 corporation, held at least 5 percent (by vote or value) of the capital
			 structure of the corporation; or</text>
							</subparagraph><subparagraph id="id0EBA449A3A9B49DFB4696AC603F99E21"><enum>(C)</enum><text>in the case of
			 any other entity, held interests representing at least 5 percent of the capital
			 structure of the entity; and</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc8fa21d61cc645bfbf690a21e68bfa66"><enum>(6)</enum><text>engaging private
			 sector entities to collect civil fines imposed.</text>
						</paragraph></subsection></section></subtitle><subtitle id="H4FF0B1D9FEED435690D28E639D826CAF"><enum>D</enum><header>Training
			 enhancements</header>
				<section id="H550C5E7228A74407A9C24FD009960"><enum>231.</enum><header>International
			 training and technical assistance enhancements</header><text display-inline="no-display-inline">The Secretary shall take the necessary
			 steps—</text>
					<paragraph id="H333E309AB11F4F8C8219D2BF9132587"><enum>(1)</enum><text display-inline="yes-display-inline">to increase staffing and resources of
			 offices of U.S. Customs and Border Protection and U.S. Immigration and Customs
			 Enforcement engaged in providing training and technical assistance to the
			 customs services and enforcement agencies of other countries in order to
			 improve the effectiveness of such customs services and enforcement agencies
			 with respect to—</text>
						<subparagraph id="id720F10DC61C24BB381AC86FC919F5B95"><enum>(A)</enum><text display-inline="yes-display-inline">detecting and intercepting the exportation,
			 importation, and transshipment of counterfeit or pirated goods, goods that are
			 the subject to exclusion orders, and goods that violate other forms of
			 intellectual property rights; and</text>
						</subparagraph><subparagraph id="id8D49474DFD424ED39C41B21513A0812B"><enum>(B)</enum><text>imposing
			 penalties on persons that export, import, or transship counterfeit or pirated
			 goods at levels that will deter such exportation, importation, and
			 transshipment; and</text>
						</subparagraph></paragraph><paragraph id="H2CE4E608F9CF416BA3CE2B2C83B64F41"><enum>(2)</enum><text display-inline="yes-display-inline">to ensure that the Director, in order to
			 make the most efficient and effective use of training and technical assistance
			 resources—</text>
						<subparagraph id="H6F4CE23287DC454D81FF2F4B7E6C28F5"><enum>(A)</enum><text>coordinates the
			 international training and technical assistance activities of U.S. Customs and
			 Border Protection and U.S. Immigration and Customs Enforcement as part of the
			 Director’s coordination responsibilities under section 211;</text>
						</subparagraph><subparagraph id="H5D025EAE8DA743E9BB0916C2FC448FF"><enum>(B)</enum><text>gives priority to
			 international training and technical assistance activities in countries in
			 which such activities can be carried out most effectively and with the greatest
			 benefit to protecting the intellectual property rights of United States
			 persons;</text>
						</subparagraph><subparagraph id="HF364153F093A49949D3489A877810050"><enum>(C)</enum><text>takes steps to
			 minimize duplication, overlap, or inconsistency of international training and
			 technical assistance efforts; and</text>
						</subparagraph><subparagraph id="HCDFD9D761FF9404E97B9008CAF6F24BE"><enum>(D)</enum><text display-inline="yes-display-inline">coordinates such activities of the
			 Department of the Treasury with international training and technical assistance
			 activities against counterfeiting and piracy carried out by other agencies, and
			 enhances the participation of Department of the Treasury personnel in
			 interagency training and technical assistance activities in this field.</text>
						</subparagraph></paragraph></section></subtitle><subtitle id="HAC616C473F4C429AADA0198CE31821C7"><enum>E</enum><header>New legal tools
			 for border enforcement</header>
				<section id="HD5F9D8284C9840AA9952FDFD8E94B2F8"><enum>241.</enum><header>Expanded
			 prohibitions on importation, exportation, and transshipment of counterfeit or
			 pirated goods</header>
					<subsection id="id5709657851CC4CAE81E65C12F66D13EC"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 526 of the
			 Tariff Act of 1930 (19 U.S.C. 1526) is amended—</text>
						<paragraph id="HF3FACA8E2D5949CFA0ED955F98A1403B"><enum>(1)</enum><text>in the section
			 heading, by inserting <quote><header-in-text level="section" style="OLC">or
			 protected by copyright</header-in-text></quote> after <quote><header-in-text level="section" style="OLC">trademark</header-in-text></quote>;</text>
						</paragraph><paragraph commented="no" id="H94C55C42B1C9495097CC48B793BD86D7"><enum>(2)</enum><text>in subsection (e),
			 by striking <quote>Any such merchandise</quote> and all that follows through
			 <quote>15 U.S.C. 1124),</quote> and inserting <quote>Any merchandise bearing a
			 counterfeit mark (as defined in section 2320(e) of title 18, United States
			 Code) that is imported into the United States, exported out of the United
			 States, or transshipped through the United States</quote>; and</text>
						</paragraph><paragraph id="H3642C82C3A404249B6794723E78244D"><enum>(3)</enum><text>in
			 subsection (f)—</text>
							<subparagraph id="idFA8AF10FCBC14B3E96F3A7C3E139DC65"><enum>(A)</enum><text>by striking
			 paragraph (1) and inserting the following:</text>
								<quoted-block id="H41CEF6E80C974F45A7F420174DD62123" style="OLC">
									<paragraph id="H49F9675D0B5D4378945F884998750349" indent="up1"><enum>(1)</enum><text>Any person who engages in, directs,
				assists financially or otherwise, or aids and abets the importation,
				exportation, or transshipment of merchandise that is seized under subsection
				(e) of this section, or under regulations issued pursuant to section 603(c) of
				title 17, United States Code, shall be subject to a civil
				fine.</text>
									</paragraph><after-quoted-block>; </after-quoted-block></quoted-block>
							</subparagraph><subparagraph id="H1301D8AB4A1643AA9499AD371379C6C0"><enum>(B)</enum><text>by redesignating
			 paragraph (4) as paragraph (5); and</text>
							</subparagraph><subparagraph id="H04D42C8BFD524B77AE375104EB90DAE3"><enum>(C)</enum><text>by inserting after
			 paragraph (3) the following:</text>
								<quoted-block id="H59FA6C23007B48C68B412586E59BAC46" style="OLC">
									<paragraph id="H516BADC91C01461B855E6B49C5963829" indent="up1"><enum>(4)</enum><text>When the seizure of merchandise that
				results in the imposition of a civil fine is made under circumstances
				indicating that the importation, exportation, or transshipment of the
				merchandise was for the purpose of sale or public distribution of the
				merchandise, the maximum fine amounts set forth in paragraphs (2) and (3) shall
				be
				tripled.</text>

				2320(b) of title 18, United States Code, or section 526(e) of this Act.</text>
							</subsection><subsection id="ID28ae4767e6b145f38ea1c96a29725c0e"><enum>(b)</enum><header>Procedure for
				exercise of authority To litigate or appeal</header>
								<paragraph id="idDF48B7E06AF041B5B165DF0D84372724"><enum>(1)</enum><header>In
				general</header><text>Prior to commencing, defending, or intervening in any
				civil forfeiture proceeding referred to in subsection (a), the Chief Counsel
				shall submit a written notification to the Attorney General with respect to the
				proposed proceeding.</text>
								</paragraph><paragraph id="ID256a76c14a764a739f6c9b73e24e7880"><enum>(2)</enum><header>Failure to
				respond</header><text>If, not later than 120 days after the date on which the
				Chief Counsel submits the notification to the Attorney General under paragraph
				(1), the Attorney General has failed to commence, defend, or intervene in the
				proposed proceeding, the Chief Counsel may commence, defend, or intervene in,
				and supervise the litigation of, the proceeding and any appeal of the
				proceeding in the name of the Chief Counsel.</text>
								</paragraph><paragraph id="idC8F02E8B524840BFB594872922331303"><enum>(3)</enum><header>Authority of
				Attorney General to intervene</header><text>Nothing in this subsection
				precludes the Attorney General from intervening on behalf of the United States
				in any civil forfeiture proceeding under section 2320(b) of title 18, United
				States Code, or in any appeal of such a proceeding, as may be otherwise
				provided by
				law.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</section></subtitle><subtitle id="HD4557AAA482E41AEAB62DC6BCB90008F"><enum>F</enum><header>Administrative
			 provisions</header>
				<section id="id1ECABA7A01F948DCB4E6A6E0775C4DB3"><enum>251.</enum><header>Advisory
			 Committee on Import Safety and Intellectual Property Enforcement</header>
					<subsection id="idEE31C12D1ACA44C29C5AD37E62559613"><enum>(a)</enum><header>Establishment</header>
						<paragraph id="id350286BB864B4F17B69FF7C251552EAB"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary, acting
			 through the Commissioner and the Assistant Secretary for U.S. Immigration and
			 Customs Enforcement, shall establish an advisory committee which shall be known
			 as the Advisory Committee on Import Safety and Intellectual Property Rights
			 Enforcement (in this section referred to as the <quote>Advisory
			 Committee</quote>).</text>
						</paragraph><paragraph id="idBEF856561B0E45E68D38E7449156A20C"><enum>(2)</enum><header>Membership</header><text display-inline="yes-display-inline">The Advisory Committee shall consist of 20
			 members appointed by the Secretary. In making appointments to the Advisory
			 Committee, the Secretary shall ensure that—</text>
							<subparagraph commented="no" id="id22B522E9F8094931928249B1FAB91F9A"><enum>(A)</enum><text>the membership of
			 the Advisory Committee is representative of the individuals and organizations
			 affected by the enforcement of import safety standards and intellectual
			 property rights by U.S. Customs and Border Protection and U.S. Immigration and
			 Customs Enforcement;</text>
							</subparagraph><subparagraph id="id6E1E0AB1F32B4A48B651719A2FD47591"><enum>(B)</enum><text>at least one
			 member of the Advisory Committee is a representative of organized labor;</text>
							</subparagraph><subparagraph id="id78AED80F77274C748C522DDF613E07A8"><enum>(C)</enum><text>at least one
			 member of the Advisory Committee is a representative of consumer groups;
			 and</text>
							</subparagraph><subparagraph id="id5BA617217D454E55A1306BA2C861BC1A"><enum>(D)</enum><text>not more than 10
			 members of the Advisory Committee belong to the same political party.</text>
							</subparagraph></paragraph></subsection><subsection id="id72B75C279FC0437FB5D312BAA75851DB"><enum>(b)</enum><header>Duties</header><text>The
			 Advisory Committee shall—</text>
						<paragraph id="id958834047ABE4D379C0FFFCD517E7A5B"><enum>(1)</enum><text>provide advice to
			 the Secretary, the Commissioner, and the Assistant Secretary for U.S.
			 Immigration and Customs Enforcement on all matters involving the enforcement of
			 import safety standards and intellectual property rights by U.S. Customs and
			 Border Protection and U.S. Immigration and Customs Enforcement; and</text>
						</paragraph><paragraph id="idD72958CF0D154E1A9B2C21BD243654A4"><enum>(2)</enum><text>submit an annual
			 report to the Committee on Finance of the Senate and the Committee on Ways and
			 Means of the House of Representatives that shall—</text>
							<subparagraph id="id963EC424DE9D4C67918BF25FBA12F3AC"><enum>(A)</enum><text>describe the
			 operations of the Advisory Committee during the preceding year; and</text>
							</subparagraph><subparagraph id="idD201603A1E3E4D378C32B3AE6E81ED55"><enum>(B)</enum><text display-inline="yes-display-inline">set forth any recommendations of the
			 Advisory Committee with respect the enforcement of import safety standards and
			 intellectual property rights by U.S. Customs and Border Protection and U.S.
			 Immigration and Customs Enforcement.</text>
							</subparagraph></paragraph></subsection><subsection id="id3F45ADF6F82A443A895AF7E080588E86"><enum>(c)</enum><header>Presiding
			 officers</header><text>The Commissioner and the Assistant Secretary for U.S.
			 Immigration and Customs Enforcement shall jointly preside over meetings of the
			 Advisory Committee.</text>
					</subsection></section><section commented="no" display-inline="no-display-inline" id="HA01712CCA2B04909A6C68BCC44DFAC9C"><enum>252.</enum><header>Staffing
			 enhancements at U.S. Customs and Border Protection</header><text display-inline="no-display-inline">There
			 are authorized to be appropriated to U.S. Customs and Border Protection such
			 funds as may be necessary for additional personnel (as determined in accordance
			 with the Resource Allocation Model established pursuant to section 301(h) of
			 the Customs Procedural Reform and Simplification Act of 1978 (19 U.S.C.
			 2075(h)) to carry out the additional responsibilities of U.S. Customs and
			 Border Protection under this title regarding the importation, transshipment,
			 and exportation of counterfeit or pirated goods, goods that are the subject to
			 exclusion orders, and goods that violate other forms of intellectual property
			 rights.</text>
				</section><section commented="no" display-inline="no-display-inline" id="H00B2215C8DC641B0AF81AB7DFD8285C5" section-type="subsequent-section"><enum>253.</enum><header>Staffing
			 enhancements at U.S. Immigration and Customs Enforcement</header><text display-inline="no-display-inline">There are authorized to be appropriated to
			 U.S. Immigration and Customs Enforcement such funds as may be necessary for
			 additional personnel to carry out the additional responsibilities of U.S.
			 Immigration and Customs Enforcement under this title regarding the enforcement
			 of intellectual property rights, including for developing and implementing a
			 training program with respect to the enforcement of intellectual property
			 rights for each U.S. Immigration and Customs Enforcement attaché office outside
			 the United States.</text>
				</section><section commented="no" display-inline="no-display-inline" id="H50AF38706747492AB3CF002E467F55E5" section-type="subsequent-section"><enum>254.</enum><header>Regulatory
			 authority</header><text display-inline="no-display-inline">The Secretary may
			 issue such regulations as are necessary to carry out this title.</text>
