		<official-title>To amend the Toxic Substances Control Act to phase out
		  the use of mercury in the manufacture of chlorine and caustic soda, and for
		  other purposes.</official-title>

		<section id="H568E6ACED53F471890179921B5F823A0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Mercury Pollution Reduction
			 Act</short-title></quote>.</text>
		</section><section id="HB9B0D4C726AD4C36867CD7288071AE8D"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="HFA1AF64843E34FDE85B95F1DBA2400EA"><enum>(1)</enum><text>mercury and
			 mercury compounds are highly toxic to humans, ecosystems, and wildlife;</text>
			</paragraph><paragraph id="H51610FA269D943DCB5F0918686D8C30"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id1640B83F315B46B9B875E3B30F5A369A"><enum>(A)</enum><text>as many as 10 percent
			 of women in the United States of childbearing age have mercury in their
			 bloodstreams at a level that could pose risks to their unborn babies;
			 and</text>
				</subparagraph><subparagraph id="id012E210F1F6F44BD841316EC41AB202B" indent="up1"><enum>(B)</enum><text>hundreds of thousands of children born
			 annually in the United States are at risk of neurological problems relating to
			 mercury exposure in utero;</text>
				</subparagraph></paragraph><paragraph id="H1C951DBECEFC4DFDBA49381957BE956D"><enum>(3)</enum><text>the most
			 significant source of mercury exposure to people in the United States is
			 ingestion of mercury-contaminated fish;</text>
			</paragraph><paragraph id="H043FF8AB9037413797009BFF00D24280"><enum>(4)</enum><text>the long-term
			 solution to mercury pollution is to minimize global mercury use and releases of
			 mercury to eventually achieve reduced contamination levels in the environment,
			 rather than reducing fish consumption, because uncontaminated fish represent a
			 critical and healthy source of nutrition for people worldwide;</text>
			</paragraph><paragraph id="H5B408190D0274EB3986DB1B288C364AF"><enum>(5)</enum><text>mercury pollution
			 is a transboundary pollutant that—</text>
				<subparagraph id="H8E0E8E07B78F4B03B701CEDDE129F772"><enum>(A)</enum><text>is deposited
			 locally, regionally, and globally; and</text>
				</subparagraph><subparagraph id="HBFC18E1D6C0F4E5DAA2CAD6D075E3100"><enum>(B)</enum><text>affects bodies of
			 water—</text>
					<clause id="id36E69B880A534BDCA085EB34E77AC260"><enum>(i)</enum><text>near industrial
			 areas, such as the Great Lakes; and</text>
					</clause><clause id="id39E01959468E4F0FB91EA2BCF73F88F9"><enum>(ii)</enum><text>in
			 remote areas, such as the Arctic Circle;</text>
					</clause></subparagraph></paragraph><paragraph id="H447BFFC69D2B451CB722C2F196760007"><enum>(6)</enum><text>of the
			 approximately 30 facilities in the United States that produce chlorine—</text>
				<subparagraph id="id31F71B4961C640AE987AF8B6D25470B1"><enum>(A)</enum><text>only 5 use the
			 obsolete <quote>mercury cell</quote> chlor-alkali process; and</text>
				</subparagraph><subparagraph id="id4BDCD3CA63D741AA91C7B1EF642080E4"><enum>(B)</enum><text>4 have not yet
			 committed to phasing out mercury use;</text>
				</subparagraph></paragraph><paragraph id="H12CBB49590224C788922055FF92BD2B7"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H113FC69A43A041F1BE9D09F0318FE001"><enum>(A)</enum><text>less than 5 percent of
			 the total quantity of chlorine and caustic soda produced in the United States
			 comes from the chlor-alkali plants described in paragraph (6) that use the
			 mercury cell chlor-alkali process;</text>
				</subparagraph><subparagraph id="H40888035399B4939835C35FE9EDB6DB4" indent="up1"><enum>(B)</enum><text>cost-effective alternatives are
			 available and in use in the remaining 95 percent of chlorine and caustic soda
			 production; and</text>
				</subparagraph><subparagraph id="H4B246865789C4B62BD8009CFCB009FDA" indent="up1"><enum>(C)</enum><text>other countries, including Japan, have
			 already banned the mercury cell chlor-alkali process;</text>
				</subparagraph></paragraph><paragraph id="HABF37D47CCD645B9B88355C6B5B1E5F5"><enum>(8)</enum><text>the chlor-alkali
			 industry acknowledges that—</text>
				<subparagraph id="H34CAF85E52F5455A976334D4AF5B9DC8"><enum>(A)</enum><text>mercury can
			 contaminate products manufactured at mercury cell facilities; and</text>
				</subparagraph><subparagraph id="H24D5C3477E314F24BC070076B3F3BA2"><enum>(B)</enum><text>the use of some of
			 those products results in the direct and indirect release of mercury;</text>
				</subparagraph></paragraph><paragraph id="H3A0A07A03D4D493FA13BB1E67FA0A48B"><enum>(9)</enum><text>despite those
			 quantities of mercury known to have been used or to be in use, neither the
			 chlor-alkali industry nor the Environmental Protection Agency is able—</text>
				<subparagraph id="H8D4C54B89C9F46DA8B00BBB607D7D72"><enum>(A)</enum><text>to adequately
			 account for the disposition of the mercury used at those facilities; or</text>
				</subparagraph><subparagraph id="HEEAA9E0F4AB64DEFB303A77847FB4501"><enum>(B)</enum><text>to accurately
			 estimate current mercury emissions; and</text>
				</subparagraph></paragraph><paragraph id="HBE557608FD47462798E2C678463DA9C3"><enum>(10)</enum><text>it is critically
			 important that the United States work aggressively toward the minimization of
			 supply, demand, and releases of mercury, both domestically and
			 internationally.</text>
			</paragraph></section><section id="HB5ED9FC6DF61464B8811111540A3133D"><enum>3.</enum><header>Statement of
			 policy</header><text display-inline="no-display-inline">It is the policy of the
			 United States that the United States should develop policies and programs that
			 will—</text>
			<paragraph id="HD15AFFCE1ABB4367B264B166516F0245"><enum>(1)</enum><text>reduce mercury use
			 and emissions within the United States;</text>
			</paragraph><paragraph id="HCAE13FA3ECC74C658CD1F9799BB73501"><enum>(2)</enum><text>reduce mercury
			 releases from the reservoir of mercury currently in use or circulation within
			 the United States; and</text>
			</paragraph><paragraph id="HF4CB650698454EAB882C1FB76D992439"><enum>(3)</enum><text>reduce exposures
			 to mercury, particularly exposures of women of childbearing age and young
			 children.</text>
			</paragraph></section><section id="H540734F15F5D4756BAD3E9949CC65146"><enum>4.</enum><header>Use of mercury in
			 chlorine and caustic soda manufacturing</header>
			<subsection id="HFC7FD46F8D4B48F6A812C7CA54A43B35"><enum>(a)</enum><header>In
			 general</header><text>Title I of the Toxic Substances Control Act (15 U.S.C.
			 2601 et seq.) is amended by inserting after section 6 the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD75BD3DEAD0742158585E23B31CFCE3F" style="OLC">
					<section id="H0FA5F8F265B24E4A894DF9C91E9BE91E"><enum>6A.</enum><header>Use of mercury
				in chlorine and caustic soda manufacturing</header>
						<subsection id="H8AE25D772A2F46E6805BB5EE25224DE6"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="H564BBEC0A1AE4DD09C0116A770341B90"><enum>(1)</enum><header>Chlor-alkali
				facility</header><text>The term <term>chlor-alkali facility</term> means a
				facility used for the manufacture of chlorine or caustic soda using a mercury
				cell process.</text>
							</paragraph><paragraph id="H0F108C3AEE0F456A00D6BD342B0862F0"><enum>(2)</enum><header>Hazardous waste;
				solid waste</header><text>The terms <term>hazardous waste</term> and
				<term>solid waste</term> have the meanings given those terms in section 1004 of
				the Solid Waste Disposal Act (42 U.S.C. 6903).</text>
							</paragraph></subsection><subsection id="H90371C1D6E4348AB91E92CA4BBDD6BD"><enum>(b)</enum><header>Prohibition; use
				prior to prohibition</header>
							<paragraph id="H89807BBBADA349EEA10E8E54D47E58EB"><enum>(1)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Effective on the date that is 2 years after
				the date of enactment of this section, the manufacture of chlorine or caustic
				soda using a mercury cell is prohibited in the United States.</text>
							</paragraph><paragraph id="H5BCF01496C3C4B3C9675128459AC6A60"><enum>(2)</enum><header>Export
				ban</header><text display-inline="yes-display-inline">Effective on the date of
				enactment of this section, the export of any mercury, mercury cell, mercury
				compound, or mixture containing mercury by the owner or operator of a
				chlor-alkali facility is prohibited.</text>
							</paragraph></subsection><subsection id="HBD37FC2EC5424E808372E5BFF535D671"><enum>(c)</enum><header>Reporting</header>
							<paragraph id="HA9AB5CA738774AB380EAE87D37F4DC49"><enum>(1)</enum><header>In
				general</header><text>Not later than 2 years after the date of enactment of
				this section, the owner or operator of each chlor-alkali facility shall submit
				to the Administrator and the State in which the chlor-alkali facility is
				located a report that identifies—</text>
								<subparagraph id="HBC08BE4DA5734ACEA3E408B44F43BF75"><enum>(A)</enum><text>each type and
				quantity of mercury-containing hazardous waste and nonhazardous solid waste
				generated by the chlor-alkali facility during the preceding calendar
				year;</text>
								</subparagraph><subparagraph id="H102C1A1B4B1A4865AF6DA38E4800CFA1"><enum>(B)</enum><text>the mercury
				content of the wastes;</text>
								</subparagraph><subparagraph id="H673B17660C3C4886BD4997BA708E63E"><enum>(C)</enum><text>the manner in which
				each waste was managed, including the location of each offsite location to
				which the waste was transported for subsequent handling or management;</text>
								</subparagraph><subparagraph id="HE2ED8F2565894EF68BA5DDC354ECD05"><enum>(D)</enum><text>the volume of
				mercury released, intentionally or unintentionally, into the air or water by
				the chlor-alkali facility, including mercury released from emissions or
				vaporization;</text>
								</subparagraph><subparagraph id="HFB514F08D7DA407ABD9786D61BB66EBF"><enum>(E)</enum><text>the volume of
				mercury estimated to have accumulated in pipes and plant equipment of the
				chlor-alkali facility, including a description of—</text>
									<clause id="H5B8E63DC8747436D85DB12ED8FE66446"><enum>(i)</enum><text>the applicable
				volume for each type of equipment; and</text>
									</clause><clause id="H535B761C0B794512BB98E94FE0389BCF"><enum>(ii)</enum><text>methods of
				accumulation; and</text>
									</clause></subparagraph><subparagraph id="H7D7D728CE0344FC4BA865164B9B6733C"><enum>(F)</enum><text>the quantity and
				forms of mercury found in all products produced for sale by the chlor-alkali
				facility.</text>
								</subparagraph></paragraph><paragraph id="HF63CC1E95D2645C2BCEDD9328050001E"><enum>(2)</enum><header>Avoidance of
				duplication</header><text>To avoid duplication, the Administrator may permit
				the owner or operator of a facility described in paragraph (1) to combine and
				submit the report required under this subsection with any report required to be
				submitted by the owner or operator under subtitle C of the Solid Waste Disposal
				Act (42 U.S.C. 6921 et seq.).</text>
							</paragraph></subsection><subsection id="H847B14E3222248E781D2686CDF5D4375"><enum>(d)</enum><header>Inventory</header>
							<paragraph id="HE5AC7F4B74764205AAFA500D106E724"><enum>(1)</enum><header>In
				general</header><text>For each chlor-alkali facility that ceases operations on
				or after January 1, 2009, not later than 1 year after the date of cessation of
				operations, the Administrator, in consultation with the State in which the
				facility is located, shall conduct a comprehensive mercury inventory covering
				the life and closure of the chlor-alkali facility, taking into account—</text>
								<subparagraph id="H2B6738E79B114B1EA600DFE2B8A1650"><enum>(A)</enum><text>the total quantity
				of mercury purchased to start and operate the chlor-alkali facility;</text>
								</subparagraph><subparagraph id="H6F672DCE3BE84BCBB6F0F0A6D42E9CDB"><enum>(B)</enum><text>the total quantity
				of mercury remaining in mercury cells and other equipment at the time of
				closure of the chlor-alkali facility;</text>
								</subparagraph><subparagraph id="H113B87D1E3BC43D5AF860138AF71A4A3"><enum>(C)</enum><text>the estimated
				quantity of mercury in hazardous waste, nonhazardous solid waste, and products
				generated at the chlor-alkali facility during the operational life of the
				chlor-alkali facility; and</text>
								</subparagraph><subparagraph id="H62A6B77FEAC846BBB480C0A3C4F5903C"><enum>(D)</enum><text>the estimated
				aggregate mercury releases from the chlor-alkali facility into air and other
				environmental media.</text>
								</subparagraph></paragraph><paragraph id="H332627CB0D094F58AEE80606E063DA6B"><enum>(2)</enum><header>Records and
				information</header><text>In carrying out paragraph (1), the Administrator
				shall obtain mercury purchase records and such other information from each
				chlor-alkali facility as the Administrator determines to be necessary to
				determine, as accurately as practicable from available information, the
				magnitude and nature of mercury releases from the chlor-alkali facility into
				air and other environmental media.</text>
							</paragraph><paragraph id="H3187F15C4BE94F60817F1D83C5917E3A"><enum>(3)</enum><header>Authorities</header><text>This
				Administrator shall use the authorities of section 11 and any other appropriate
				authorities of this Act to carry out this
				subsection.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HE390F3B0FC0A4E95B4EFE875009C90"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="H1F46004D34AB40BDB0F01CB6A16C0201"><enum>(1)</enum><header>Table of
			 contents</header><text>The table of contents of the Toxic Substances Control
			 Act (15 U.S.C. 2601 note) is amended by inserting after the item relating to
			 section 6 the following:</text>

			 15 of the Toxic Substances Control Act (15 U.S.C. 2614) is amended by striking
			 <quote>or 6</quote> each place it appears and inserting <quote>, 6, or
			 6A</quote>.</text>
