		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Department of Veterans Affairs
			 Hospital Quality Report Card Act of 2009</short-title></quote>.</text>
		</section><section id="id6D6E0CB67B8E45C6A6A1D4D5BBEDC2D4"><enum>2.</enum><header>Department of
			 Veterans Affairs Hospital Quality Report Card Initiative</header>
			<subsection id="id6083B08F04D34294A556E5B819D4C754"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this section is to provide
			 for the establishment within the Department of Veterans Affairs of an
			 initiative to be known as the <quote>Hospital Quality Report Card
			 Initiative</quote> to ensure that information on the quality and performance of
			 hospitals administered by the Secretary of Veterans Affairs is readily
			 available and accessible for purposes as follows:</text>
				<paragraph id="idD22CA459CFE448F38369D5B315FFC11C"><enum>(1)</enum><text>To inform
			 patients and consumers about health care quality in such hospitals.</text>
				</paragraph><paragraph id="idD35804EB04144236A9BAB81DC83109A1"><enum>(2)</enum><text>To assist health
			 care providers of the Department of Veterans Affairs in identifying
			 opportunities for quality improvement and cost containment.</text>
				</paragraph><paragraph id="idE499F9A23EA946C48A899829156910C2"><enum>(3)</enum><text>To enhance the
			 understanding of policy makers and public officials of health care issues,
			 raise public awareness of hospital quality issues, and help constituents of
			 such policy makers and officials identify quality health care options for the
			 Department of Veterans Affairs.</text>
				</paragraph></subsection><subsection id="id9BF1C93EF6124F04AB9DFEA2C115EE00"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">Subchapter I of chapter 17 of title 38,
			 United States Code, is amended by inserting after section 1706 the following
			 new section:</text>
				<quoted-block display-inline="no-display-inline" id="id29957ECAD8554844AE17114C3A8A0EF5" style="USC">
					<section id="id6B0C69C66C014A6A950F7D3417DBBFCC" section-type="subsequent-section"><enum>1706A.</enum><header>Management of
				health care: Hospital Quality Report Card Initiative</header>
						<subsection id="ID0b5d035ef9124758bc1a9dc07a1be797"><enum>(a)</enum><header>In
				general</header><text>Not later than 18 months after the date of the enactment
				of the <short-title>Department of Veterans Affairs
				Hospital Quality Report Card Act of 2009</short-title>, the Secretary shall
				establish and implement an initiative, to be known as the <quote>Hospital
				Quality Report Card Initiative</quote> (in this section referred to as the
				<term>Initiative</term>), to report on health care quality in Department
				medical centers.</text>
						</subsection><subsection id="IDbecd04ac5f1d423bb29d966168ae2784"><enum>(b)</enum><header>Publication of
				information on quality and performance of Department medical
				centers</header><paragraph commented="no" display-inline="yes-display-inline" id="id46A616A7B530479F84D2DA67D5F7135D"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idFFC59EC2F4034DD7AE61FED9BF6A6777"><enum>(A)</enum><text>Under the Initiative,
				not less frequently than twice each year, the Secretary shall make available to
				the public a report containing the most current information on the quality and
				performance of each Department medical center. Such information shall include
				quality measures that allow for an assessment with respect to health care
				provided by Department medical centers, of the following:</text>
									<clause id="IDb1e19e408334448eac64d9910951896f" indent="up2"><enum>(i)</enum><text>Effectiveness.</text>
									</clause><clause id="ID3906a9fe6dcf40ff899fa21ccc3f3432" indent="up2"><enum>(ii)</enum><text>Safety.</text>
									</clause><clause id="ID7052128df1f34d2d985a67b99ff1cd7d" indent="up2"><enum>(iii)</enum><text>Timeliness.</text>
									</clause><clause id="ID8192fa84eb1f4239a67b43d86e242ad6" indent="up2"><enum>(iv)</enum><text>Efficiency.</text>
									</clause><clause id="ID29a045727c3441ddb95429ea31974344" indent="up2"><enum>(v)</enum><text>Patient centered.</text>
									</clause><clause id="id67D2A5135E4649D78ECBFDCB9CEAE758" indent="up2"><enum>(vi)</enum><text>Patient satisfaction.</text>
									</clause><clause id="id63AB3F92F28E43BE8F62BE34D0239751" indent="up2"><enum>(vii)</enum><text>Satisfaction of health professionals
				employed at Department medical centers.</text>
									</clause><clause id="ID2f5107325e9b47af8c26300b2ac2379a" indent="up2"><enum>(viii)</enum><text>The equity of care provided to
				various patient populations, including female, geriatric, disabled, rural,
				homeless, mentally ill, and racial and ethnic minority populations.</text>
									</clause></subparagraph><subparagraph id="idC0C88743DE534A87B67B56C99A381C5C" indent="up2"><enum>(B)</enum><text>For each quality measure reported
				under subparagraph (A), the Secretary shall include a quality measure
				represented by an incremental letter grade scale, with <quote>A+</quote> being
				the highest and <quote>F</quote> being the lowest, based on information
				reported in paragraph (2) and such other information as the Secretary considers
				appropriate.</text>
								</subparagraph></paragraph><paragraph id="id35C58CF7396440A992AB475824352342" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id1BAAA59B3D534212A5CA20FAC4DFB62B"><enum>(A)</enum><text>In reporting
				information pursuant to paragraph (1), the Secretary shall, except as provided
				in subparagraph (B), include to the maximum extent practicable information
				about Department medical centers relating to—</text>
									<clause id="idF1DB6C1EDBD846AFBCE57DEEBA680848" indent="up1"><enum>(i)</enum><text>staffing levels of nurses and other
				health professionals, as appropriate;</text>
									</clause><clause id="id6791AF0A350649FDB1E0A42CF68B3517" indent="up1"><enum>(ii)</enum><text>rates of nosocomial
				infections;</text>
									</clause><clause id="idE6A1E2F43FD646C3892B314D5C56DB7B" indent="up1"><enum>(iii)</enum><text>the volume of each of the different
				types of procedures performed;</text>
									</clause><clause id="id87F0FBB0F25E4D11A3793727486DC39B" indent="up1"><enum>(iv)</enum><text>hospital sanctions and other
				violations;</text>
									</clause><clause id="idCCC22FB7318C4AE79A759BB2EE75B911" indent="up1"><enum>(v)</enum><text>the quality of care provided to
				various patient populations, including female, geriatric, disabled, rural,
				homeless, mentally ill, and racial and ethnic minority populations;</text>
									</clause><clause id="id64FE33AC21734D14B0BC19213BEEF9C5" indent="up1"><enum>(vi)</enum><text>the availability of emergency rooms,
				intensive care units, maternity care, and specialty services;</text>
									</clause><clause id="id420D698C2619414C83093E6974108834" indent="up1"><enum>(vii)</enum><text>the quality of care in various
				hospital settings, including inpatient, outpatient, emergency, maternity, and
				intensive care unit settings;</text>
									</clause><clause id="id54E757DE20CB48618DDB485F593F9C62" indent="up1"><enum>(viii)</enum><text>ongoing patient safety
				initiatives;</text>
									</clause><clause id="id856532D756E94CF99B200B8410203A48" indent="up1"><enum>(ix)</enum><text>use of health information technology
				systems; and</text>
									</clause><clause id="id45012BE556334408B24B3C971412097B" indent="up1"><enum>(x)</enum><text>such other matters the Secretary
				considers appropriate.</text>
									</clause></subparagraph><subparagraph id="idFE4975966F054B969F5E312649C20942" indent="up1"><enum>(B)</enum><text>In making a report available to the
				public under paragraph (1), the Secretary may provide information in addition
				to the information required by subparagraph (A) or provide information in lieu
				of the information required by subparagraph (A) if the Secretary—</text>
									<clause id="id836E246DBFB3439984807BA2471AF07C"><enum>(i)</enum><text>not later than 15 days before the date
				on which such report is made available to the public, submits to the Committee
				on Veterans' Affairs of the Senate and the Committee on Veterans' Affairs of
				the House of Representatives a certification in writing that such additional or
				substituted information is more appropriate for purposes of carrying out the
				requirement of paragraph (2)(B); and</text>
									</clause><clause id="id4BFA06EE6AC54A5BB955325DCB99306E"><enum>(ii)</enum><text>includes in such report and
				certification an indication of which information has been added or substituted
				under this subparagraph.</text>
									</clause></subparagraph></paragraph><paragraph id="IDba7029ab871c4a30aca63923f2d2dec4" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id6B00AD80BD824FB1B6A204ED02460FDB"><enum>(A)</enum><text>In reporting
				information as provided for under paragraph (1), the Secretary may risk adjust
				quality measures to account for differences relating to—</text>
									<clause id="ID451547e643c34d7989fa5fb2ca9a2521" indent="up1"><enum>(i)</enum><text>the characteristics of the reporting
				Department medical center, such as licensed bed size, geography, and teaching
				hospital status; and</text>
									</clause><clause id="ID72a72e10170b4f1b89756fcd2933ff75" indent="up1"><enum>(ii)</enum><text>patient characteristics, such as
				health status, severity of illness, and socioeconomic status.</text>
									</clause></subparagraph><subparagraph id="idF0F069DAFAA74926AE31D52008645C60" indent="up1"><enum>(B)</enum><text>If the Secretary reports data under
				paragraph (1) using risk-adjusted quality measures, the Secretary shall
				establish procedures for making the unadjusted data available to the public in
				a manner determined appropriate by the Secretary.</text>
								</subparagraph></paragraph><paragraph id="IDf0499abc042a4dffa3dc722accf192fe" indent="up1"><enum>(4)</enum><text>Under the Initiative, the Secretary
				may verify information reported under this subsection to ensure accuracy and
				validity.</text>
							</paragraph><paragraph id="ID6844919e6aae4ba9a15167615e754038" indent="up1"><enum>(5)</enum><text>Before disclosing to the public any
				information under this subsection, the Secretary shall disclose the methodology
				for the reporting of such information and the nature and scope of such
				information to each—</text>
								<subparagraph id="id43904641E35547D4996C10286D6D4D64"><enum>(A)</enum><text>organization the Secretary considers
				relevant to such information; and</text>
								</subparagraph><subparagraph id="id589F289034934A99A24E273953D402CC"><enum>(B)</enum><text>Department medical center that is the
				subject of such information.</text>
								</subparagraph></paragraph><paragraph id="id4777E30F8AF54481B06CE66F7CCB3D71" indent="up1"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id7158B048E43F46A4BDABE9A7705D0DDD"><enum>(A)</enum><text>For each report made
				available to the public under paragraph (1), the Secretary shall submit to the
				Committee on Veterans' Affairs of the Senate and the Committee on Veterans'
				Affairs of the House of Representatives a copy of such report.</text>
								</subparagraph><subparagraph id="idD84A79EB924646B3AC0CCB740828EA8F" indent="up1"><enum>(B)</enum><text>The Secretary shall ensure that each
				report made available to the public under paragraph (1) is made
				available—</text>
									<clause id="id3B87D09B0D5541C6A3979A1CEEE4B1DF"><enum>(i)</enum><text>in an electronic format;</text>
									</clause><clause id="id207443EEB61A461B866FB4C4A94CB23F"><enum>(ii)</enum><text>in a manner that can be understood by
				individuals who are not medical professionals and individuals with low
				functional health literacy; and</text>
									</clause><clause id="idF7F7562D0896417C9954C25ED30F73F5"><enum>(iii)</enum><text>at each Department medical centers
				covered by the report.</text>
									</clause></subparagraph><subparagraph id="id95561E65AAD04B2EB641E53E9CAE57E2" indent="up1"><enum>(C)</enum><text>The Secretary shall ensure that
				information on health care quality is provided in a manner that is conducive
				for comparisons with other local hospitals or regional hospitals, as
				appropriate.</text>
								</subparagraph><subparagraph id="id9B94947611264B64BA06A6117B34709A" indent="up1"><enum>(D)</enum><text>The Secretary shall establish
				procedures for making the information covered by reports made available to the
				public under paragraph (1) available to the public upon request in
				non-electronic format, such as through a toll-free telephone number.</text>
								</subparagraph></paragraph><paragraph id="IDc9f0be94787544c1851ca6d7a276d45f" indent="up1"><enum>(7)</enum><text>The analytic methodologies and
				limitations on information sources utilized by the Secretary to develop and
				disseminate the comparative information under this subsection shall be
				identified and acknowledged in a notice or disclaimer as part of the
				dissemination of such information, and include the appropriate and
				inappropriate uses of such information.</text>
							</paragraph></subsection><subsection id="ID828b85904e004348ad1a20f9b5698d92"><enum>(c)</enum><header>Identifying and
				reporting actions that could lead to false or artificial improvements in
				quality measurements</header><text>Not less frequently than annually, the
				Secretary shall compare quality measures data submitted by each Department
				medical center to the Secretary with quality measures data submitted to the
				Secretary in the prior year or years by each such Department medical center in
				order to identify and report actions that could lead to false or artificial
				improvements in the quality measurements of such Department medical
				centers.</text>
						</subsection><subsection id="ID5f19e50b8e9a42d7902f225eaefb9ae8"><enum>(d)</enum><header>Privacy and
				security</header><paragraph commented="no" display-inline="yes-display-inline" id="idF3DF016702604D07A51E3D32E7E285BA"><enum>(1)</enum><text>The Secretary shall
				develop and implement effective safeguards to protect against the unauthorized
				use or disclosure of Department medical center data that is reported under this
				section.</text>
							</paragraph><paragraph id="IDa7b5433e900c461194af6e762d30087a" indent="up1"><enum>(2)</enum><text>The Secretary shall develop and
				implement effective safeguards to protect against the dissemination of
				inconsistent, incomplete, invalid, inaccurate, or subjective Department medical
				center data.</text>
							</paragraph><paragraph id="IDa87e11be268c4ac69588e3dd3e991bcf" indent="up1"><enum>(3)</enum><text>The Secretary shall ensure that
				identifiable patient data shall not be released to the public.</text>
							</paragraph></subsection><subsection id="id2B390B597D144C6992D9FDF2DFC9E687"><enum>(e)</enum><header>Periodic
				reports</header><paragraph commented="no" display-inline="yes-display-inline" id="idCD64EA3EF9BC4985842055B005331426"><enum>(1)</enum><text>The Secretary shall
				periodically submit to Congress a report on the effectiveness of the
				Initiative.</text>
							</paragraph><paragraph id="id60AEE3AAAF624A0D8BDD50F18AF7C631" indent="up1"><enum>(2)</enum><text>Each report required by paragraph (1)
				shall include the following:</text>
								<subparagraph id="id82FC745ED115479796D2C773CA0C6756"><enum>(A)</enum><text>An assessment of the effectiveness of
				the Initiative in meeting the purpose described in section 2(a) of the
				<short-title>Department of Veterans Affairs Hospital
				Quality Report Card Act of 2009</short-title>.</text>
								</subparagraph><subparagraph id="id6BF160AECC8547FF9D552DEA2DC75039"><enum>(B)</enum><text>A description of the measures the
				Secretary can undertake to ensure that the Initiative meets such
				purpose.</text>
								</subparagraph></paragraph><paragraph id="idEDFE4BA1A15245558A5ED14CE2C9A6AC" indent="up1"><enum>(3)</enum><text>The Secretary shall carry out each
				measure the Secretary includes in a report under paragraph (2)(B).</text>
							</paragraph><paragraph id="idC457B2C089E04190B4965E7759FE5EF8" indent="up1"><enum>(4)</enum><text>The Secretary shall make each report
				submitted under paragraph (1) available to the public.</text>
							</paragraph></subsection><subsection id="IDfaef5591d9f54aecb5312805f798d95c"><enum>(f)</enum><header>Department
				medical center defined</header><text>In this section, the term <term>Department
				medical center</term> means a Department of Veterans Affairs Medical Center
				administered by the Secretary.</text>
						</subsection><subsection id="IDbc240d46a669487aa72824a8e5c39907"><enum>(g)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated to
				carry out this section such sums as may be necessary for each of fiscal years
				2010 through
				2018.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id06554306F9F74C49B44BB12D1701F524"><enum>(c)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 17 of
			 such title is amended by inserting after the item relating to section 1706 the
			 following new item:</text>
