		<official-title display="yes">To amend the Family and Medical Leave Act
		  of 1993 to clarify the eligibility requirements with respect to airline flight
		  crews. </official-title>

		<section id="H66775F4B0730486C9E4E4518F514AEA7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Airline Flight Crew Technical
			 Corrections Act</short-title></quote>.</text>
		</section><section id="H6AB0F974AE714A519C4495315CE55D76"><enum>2.</enum><header>Leave requirement
			 for airline flight crews</header>
			<subsection id="H3826D929243F46DF937CC9B9FBD289BE"><enum>(a)</enum><header>Inclusion of
			 Airline flight crews</header><text display-inline="yes-display-inline">Section
			 101(2) of the Family and Medical Leave Act of 1993 (29 U.S.C. 2611(2)) is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HC00B00D4C76041CBA70074AE36C434AB" style="OLC">
					<subparagraph id="H2C49374C8CDC4AA18DB9EFAE9DBA00DD"><enum>(D)</enum><header>Airline Flight
				Crews</header>
						<clause id="H2303617CA1DA4FD49453888C531367EF"><enum>(i)</enum><header>Determination</header><text display-inline="yes-display-inline">For purposes of determining whether an
				employee who is a flight attendant or flight crewmember (as such terms are
				defined in regulations of the Federal Aviation Administration) meets the hours
				of service requirement specified in subparagraph (A)(ii), the employee will be
				considered to meet the requirement if—</text>
							<subclause id="HF55C4ED3BF614881AE7C7ECA26EE529F"><enum>(I)</enum><text>the employee has
				worked or been paid for not less than 60 percent of the applicable total
				monthly guarantee, or the equivalent, for the previous 12-month period, for or
				by the employer with respect to whom leave is requested under section 102;
				and</text>
							</subclause><subclause commented="no" id="HABC7CDC74EB848A58B9EDDB50011E6E5"><enum>(II)</enum><text display-inline="yes-display-inline">the employee has worked or been paid for
				not less than 504 hours (not counting time spent on vacation leave or medical
				or sick leave) during the previous 12-month period, for or by that
				employer.</text>
							</subclause></clause><clause commented="no" id="idF2E44D73BD0F40738C84D8EAAD29BA44"><enum>(ii)</enum><header>File</header><text>Each
				employer of an employee described in clause (i) shall maintain on file with the
				Secretary (in accordance with such regulations as the Secretary may prescribe)
				containing information specifying the applicable monthly guarantee with respect
				to each category of employee to which such guarantee applies.</text>
						</clause><clause id="HA9C9C540BD80481ABDD9EB1011DD0641"><enum>(iii)</enum><header>Definition</header><text>In
				this subparagraph, the term <term>applicable monthly guarantee</term>
				means—</text>
							<subclause id="H0A2F0CE1B7464F7A9FB4307DBD371154"><enum>(I)</enum><text display-inline="yes-display-inline">for an employee described in clause (i)
				other than an employee on reserve status, the minimum number of hours for which
				an employer has agreed to schedule such employee for any given month;
				and</text>
							</subclause><subclause id="H39A4130B5C374B8D96B8D379EC0022C6"><enum>(II)</enum><text display-inline="yes-display-inline">for an employee described in clause (i) who
				is on reserve status, the number of hours for which an employer has agreed to
				pay such employee on reserve status for any given month,</text>
							</subclause><continuation-text continuation-text-level="clause">as
				established in the applicable collective bargaining agreement or, if none
				exists, in the employer's
				policies.</continuation-text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="HE916C595B7FC462BB8E23C9883114778"><enum>(b)</enum><header>Calculation of
			 leave for airline flight crews</header><text display-inline="yes-display-inline">Section 102(a) of the Family and Medical
			 Leave Act of 1993 (29 U.S.C. 2612(a)) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HA75AF42D461D4707BE10BDA230DA1248" style="OLC">
					<paragraph commented="no" id="H06563F6ABAD648358DC936DCA7DB1300"><enum>(5)</enum><header>Calculation of
				leave for airline flight crews</header><text display-inline="yes-display-inline">The Secretary may provide, by regulation, a
				method for calculating the leave described in paragraph (1) with respect to
				employees described in section
				101(2)(D).</text>
