			 Administration</header>
						<subsection commented="no" display-inline="no-display-inline" id="H0807A393663745EE8944F4790093C3D5"><enum>(a)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">Funds are
			 hereby authorized to be appropriated to the Department of Energy for fiscal
			 year 2010 for the activities of the National Nuclear Security Administration in
			 carrying out programs necessary for national security in the amount of
			 $10,051,215,000, to be allocated as follows:</text>
							<paragraph commented="no" display-inline="no-display-inline" id="H759C3FEC50A946B7902DBC901FBD1471"><enum>(1)</enum><text display-inline="yes-display-inline">For weapons activities,
			 $6,490,619,000.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H069259A6379F4B32ACBA7134E7E08D37"><enum>(2)</enum><text display-inline="yes-display-inline">For defense nuclear nonproliferation
			 activities, including $705,900,000 for fissile materials disposition,
			 $2,136,709,000.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H93C4BEAE79194085BA7E01386F7276EF"><enum>(3)</enum><text display-inline="yes-display-inline">For naval reactors, $1,003,133,000.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H78534EAD19814C9B92000098B36E0552"><enum>(b)</enum><header display-inline="yes-display-inline">Authorization of new plant
			 projects</header><text display-inline="yes-display-inline">From funds referred
			 to in subsection (a) that are available for carrying out plant projects, the
			 Secretary of Energy may carry out new plant projects for the National Nuclear
			 Security Administration as follows:</text>
							<paragraph commented="no" display-inline="no-display-inline" id="H49A67868D4714F8D9E880427EA3EC506"><enum>(1)</enum><text display-inline="yes-display-inline">For readiness in technical base and
			 facilities, the following new plant project:</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="H827CB03E47724AC2BB496FF46CCDC4D0"><enum></enum><text display-inline="yes-display-inline">Project 10–D–501, Nuclear Facility Risk
			 Reduction (NFRR), Y–12 National Security Complex, Oak Ridge, Tennessee,
			 $12,500,000.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1B597F57757A4B48A9E9AAAC807E9EC4"><enum>(2)</enum><text display-inline="yes-display-inline">For defense nuclear security, the following
			 new plant project:</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idE5AB4EC306BF4D7F90AC9D963308569D"><enum></enum><text display-inline="yes-display-inline">Project 10–D–701, Security Improvement
			 Project (SIP), Y–12 National Security Complex, Oak Ridge, Tennessee,
			 $49,000,000.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H584F7017AF27460887C616D5B6D4464D"><enum>(3)</enum><text display-inline="yes-display-inline">For naval reactors, the following new plant
			 projects:</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="HF0FD92337DDE4C3C9305A200E2B410B1"><enum></enum><text display-inline="yes-display-inline">Project 10–D–904, Naval Reactors Facility
			 (NRF) infrastructure upgrades, Naval Reactors Facility, Idaho Falls, Idaho,
			 $700,000.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA792E5ECFDAE4ECBA6001C0286169DBE"><enum></enum><text display-inline="yes-display-inline">Project 10–D–903, Security upgrades, Knolls
			 Atomic Power Laboratory, Knolls Site and Kesselring Site, Schenectady, New
			 York, $1,500,000.</text>
								</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HF0E16B6E39954AA5B0CF6C9ACB917F5" section-type="subsequent-section"><enum>3102.</enum><header display-inline="yes-display-inline">Defense environmental cleanup</header><text display-inline="no-display-inline">Funds are hereby authorized to be
			 appropriated to the Department of Energy for fiscal year 2010 for defense
			 environmental cleanup activities in carrying out programs necessary for
			 national security in the amount of $5,395,831,000.</text>
					</section><section commented="no" display-inline="no-display-inline" id="HFC230BC032FA4CD3A34DF5B094B9D66B" section-type="subsequent-section"><enum>3103.</enum><header display-inline="yes-display-inline">Other defense activities</header><text display-inline="no-display-inline">Funds are hereby authorized to be
			 appropriated to the Department of Energy for fiscal year 2010 for other defense
			 activities in carrying out programs necessary for national security in the
			 amount of $852,468,000.</text>
					</section><section commented="no" display-inline="no-display-inline" id="H32268907780F423B8BD5CB766FEBFF9" section-type="subsequent-section"><enum>3104.</enum><header display-inline="yes-display-inline">Defense nuclear waste
			 disposal</header><text display-inline="no-display-inline">Funds are hereby
			 authorized to be appropriated to the Department of Energy for fiscal year 2010
			 for defense nuclear waste disposal for payment to the Nuclear Waste Fund
			 established in section 302(c) of the Nuclear Waste Policy Act of 1982 (42
			 U.S.C. 10222(c)) in the amount of $98,400,000.</text>
					</section><section commented="no" display-inline="no-display-inline" id="id92203211B9FD4CB9AED7EAEA7EB38186" section-type="subsequent-section"><enum>3105.</enum><header display-inline="yes-display-inline">Funding table</header><text display-inline="no-display-inline">The amounts authorized to be appropriated by
			 sections 3101, 3102, 3103, and 3104 shall be available, in accordance with the
			 requirements of section 4001, for projects, programs, and activities, and in
			 the amounts, specified in the funding table in section 4501.</text>
					</section></subtitle><subtitle commented="no" id="id2F9B5617B98740F7A8252EC672F0F092" level-type="subsequent"><enum>B</enum><header display-inline="yes-display-inline">Program Authorizations, Restrictions, and
			 Limitations</header>
					<section commented="no" display-inline="no-display-inline" id="id94FB258A9EEC4384B5C5653AD6BE931F" section-type="subsequent-section"><enum>3111.</enum><header display-inline="yes-display-inline">Nuclear weapons stockpile life extension
			 program</header><text display-inline="no-display-inline">Section 4204 of the
			 Atomic Energy Defense Act (50 U.S.C. 2524) is amended to read as
			 follows:</text>
						<quoted-block display-inline="no-display-inline" id="idF15D346B5DFC471AA30B20C11764B0DA" style="OLC">
							<section commented="no" display-inline="no-display-inline" id="idB42264AA38524513B9985C9EBCE810E7" section-type="subsequent-section"><enum>4204.</enum><header display-inline="yes-display-inline">Nuclear weapons stockpile life extension
				program</header>
								<subsection commented="no" display-inline="no-display-inline" id="idD263128C441D40EFB87211A06B51076B"><enum>(a)</enum><header display-inline="yes-display-inline">Program required</header><text display-inline="yes-display-inline">The Secretary of Energy shall, in
				consultation with the Secretary of Defense, carry out a program to provide for
				the extension of the effective life of the weapons in the nuclear weapons
				stockpile without nuclear weapons testing.</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="id41F9651F4D8B4530B448AF0B601693A4"><enum>(b)</enum><header display-inline="yes-display-inline">Administrative responsibility for
				program</header>
									<paragraph commented="no" display-inline="no-display-inline" id="idFF20830EAFBC4C5FAF85BFB1A5E55692"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The program under subsection (a) shall be
				carried out through the National Nuclear Security Administration.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id60ECBF9EB4924C749E479B2241651050"><enum>(2)</enum><header display-inline="yes-display-inline">Inclusion of program funds in
				budget</header><text display-inline="yes-display-inline">For each budget
				submitted by the President to Congress under section 1105 of title 31, United
				States Code, the amounts requested for the program under subsection (a) shall
				be clearly identified in the budget justification materials submitted to
				Congress in support of that budget.</text>
									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idD6408D71E06A40C4AE3506D52CBCB06E"><enum>(c)</enum><header display-inline="yes-display-inline">Program plan</header><text display-inline="yes-display-inline">As part of the program under subsection
				(a), the Secretary of Energy shall develop a long-term plan to extend the
				effective life of the weapons in the nuclear weapons stockpile without nuclear
				weapons testing. The plan shall include the following:</text>
									<paragraph commented="no" display-inline="no-display-inline" id="id0C0D0485940B413CBB04B2D14F846D68"><enum>(1)</enum><text display-inline="yes-display-inline">Mechanisms to provide for the manufacture,
				maintenance, and modernization of each weapon design in the nuclear stockpile,
				as needed.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE4CDD249A96A439191ECEF8FD64DF287"><enum>(2)</enum><text display-inline="yes-display-inline">Mechanisms to expedite the collection of
				information necessary for carrying out the program, including information
				relating to the aging of materials and components, new manufacturing
				techniques, and the replacement or substitution of materials.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2C0B83F66E2B4698B87FD5EE2DF83814"><enum>(3)</enum><text display-inline="yes-display-inline">Mechanisms to ensure the appropriate
				assignment of roles and missions for each nuclear weapons laboratory and
				production plant of the Department of Energy, including mechanisms for
				allocation of workload, mechanisms to ensure the carrying out of appropriate
				modernization activities, and mechanisms to ensure the retention of skilled
				personnel.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id18FCDFCE6F5D442A95C77D04C9791565"><enum>(4)</enum><text display-inline="yes-display-inline">Mechanisms to ensure that each national
				laboratory of the National Nuclear Security Administration has full and
				complete access to all weapons data to enable a rigorous peer review process to
				support the annual assessment of the condition of the nuclear weapons stockpile
				required under section 4205.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCA419CBA7C4D4388B760FB02DF494812"><enum>(5)</enum><text display-inline="yes-display-inline">Mechanisms for allocating funds for
				activities under the program, including allocations of funds by weapon type and
				facility.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD0E94BAC6FE14B0295C62F56ADDA1771"><enum>(6)</enum><text display-inline="yes-display-inline">An identification of the funds needed, in
				the current fiscal year and in each of the next 5 fiscal years, to carry out
				the program.</text>
									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id93B6FCB7D18A418299DC907F2FB71B44"><enum>(d)</enum><header display-inline="yes-display-inline">Annual
				updates</header><text display-inline="yes-display-inline">The Secretary of
				Energy shall update the plan required under subsection (c) annually and shall
				submit the updated plan to Congress as part of the plan for maintaining the
				nuclear weapons stockpile submitted to Congress under section 4203(c).</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="id8965C2E457AD4742B60509A5F2086FDB"><enum>(e)</enum><header display-inline="yes-display-inline">Sense of Congress on funding of
				program</header><text display-inline="yes-display-inline">It is the sense of
				Congress that the President should include in each budget for a fiscal year
				submitted to Congress under section 1105 of title 31, United States Code,
				sufficient funds to carry out in that fiscal year the activities under the
				program under subsection (a) that are specified in the most current version of
				the plan required under subsection
				(c).</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</section><section commented="no" display-inline="no-display-inline" id="id0681BCC2AB42460782A52ADFA84F0740" section-type="subsequent-section"><enum>3112.</enum><header display-inline="yes-display-inline">Elimination of nuclear weapons life
			 extension program from exception to requirement to request funds in budget of
			 the President</header><text display-inline="no-display-inline">Section 4209 of
			 the Atomic Energy Defense Act (50 U.S.C. 2529) is amended—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="idC4B068318D0749DF852C0F352B17922C"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c), by striking
			 <quote>necessary—</quote> and all that follows through the period and inserting
			 <quote>necessary to address proliferation concerns.</quote>; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6D3D930E3756408D94F24BEBCCEA4112"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d)—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id420EC668DAD54F1D898C47F51278FAF8"><enum>(A)</enum><text display-inline="yes-display-inline">by striking paragraph (1); and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id677C50B0B6B940EEA4641F7F59AB7641"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (2) and (3) as
			 paragraphs (1) and (2), respectively.</text>
							</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="idBEEA66C4FFD147E99010ECF2EE2BCCEB" section-type="subsequent-section"><enum>3113.</enum><header display-inline="yes-display-inline">Repeal of Reliable Replacement Warhead
			 program</header>
						<subsection commented="no" display-inline="no-display-inline" id="id5E81E4825637492E8E3DEF8B3DF0C98B"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 4204A of the Atomic Energy Defense
			 Act (50 U.S.C. 2524a) is repealed.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="idB9FA44B742B641E08B21A5B4DA29406E"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">The table of contents for that Act is
			 amended by striking the item relating to section 4204A.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="id575402366B88454C9F41F9488FDCDF1C" section-type="subsequent-section"><enum>3114.</enum><header display-inline="yes-display-inline">Authorization of use of International
			 Nuclear Materials Protection and Cooperation program funds for bilateral and
			 multilateral nonproliferation and disarmament activities</header>
						<subsection commented="no" display-inline="no-display-inline" id="idCBD1DEC6F93F422A980289988D887706"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law
			 and subject to subsection (b), the Secretary of Energy may obligate or expend
			 not more than 10 percent of the funds authorized to be appropriated or
			 otherwise made available for the International Nuclear Materials Protection and
			 Cooperation program in a fiscal year to provide assistance for or to otherwise
			 carry out bilateral or multilateral activities relating to nonproliferation or
			 disarmament.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="idBC6CB4CC0526400A8688D2B0FC9CEAA1"><enum>(b)</enum><header display-inline="yes-display-inline">Notification of congressional defense
			 committees</header><text display-inline="yes-display-inline">The Secretary may
			 obligate or expend funds pursuant to subsection (a) if, not less than 15 days
			 before obligating or expending such funds—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id410567ED785740C29F840C7DCE6A710A"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary notifies the congressional
			 defense committees of the intent of the Secretary to obligate or expend such
			 funds; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD78E951649F34B3F82A116251497E5CF"><enum>(2)</enum><text display-inline="yes-display-inline">the President certifies to the
			 congressional defense committees that obligating or expending such funds is
			 necessary to support the national security objectives of the United
			 States.</text>

						<subsection commented="no" display-inline="no-display-inline" id="IDeb6810a7461f4c0a9dc834523deadc2e"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator for Nuclear Security and
			 the Under Secretary for Science of the Department of Energy shall jointly
			 develop a plan to use and fund, over a ten-year period, the following
			 facilities of the Department of Energy:</text>

			 the Los Alamos National Laboratory, New Mexico.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4dd7e636f4f54ed3b70576e07ed53d93"><enum>(3)</enum><text display-inline="yes-display-inline">The <quote>Z</quote> Machine at the Sandia
			 National Laboratories, New Mexico.</text>

			 the enactment of this Act, the Administrator for Nuclear Security and the Under
			 Secretary for Science of the Department of Energy shall submit to the
			 congressional defense committees the plan required by subsection (a).</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID3bb203e52ecf49a2ad061635d6fdf92f"><enum>(c)</enum><header display-inline="yes-display-inline">Requirement to specify source of facility
			 funding in budget requests</header><text display-inline="yes-display-inline">In
			 any budget request for the Department of Energy for a fiscal year that is
			 submitted to Congress after the date of the enactment of this Act, the
			 Secretary of Energy shall identify for that fiscal year the portion of the
			 funding for each facility specified in subsection (a) that is to be provided by
			 the National Nuclear Security Administration and by the Office of Science of
			 the Department of Energy.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="id7C49008761714CF4955E4596C1FC4607" section-type="subsequent-section"><enum>3132.</enum><header display-inline="yes-display-inline">Review of management and operation of
			 certain national laboratories</header>
						<subsection commented="no" display-inline="no-display-inline" id="IDc2f92565a4a9439dac6d98b73f457956"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of
			 the enactment of this Act, the Secretary of Energy shall, in consultation with
			 the Committee on Armed Services of the Senate and the Committee on Armed
			 Services of the House of Representatives, appoint an independent panel of
			 experts to conduct a review of the management and operation of the
			 following:</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id8261A01E861144508A5FE346223083C4"><enum>(1)</enum><text display-inline="yes-display-inline">The Lawrence Livermore National Laboratory,
			 California.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDF41963B7A1144DA8AE6FF9BF44EC45B"><enum>(2)</enum><text display-inline="yes-display-inline">The Los Alamos National Laboratory, New
			 Mexico.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6711AC3A54A94490A5C9F991243D7DA4"><enum>(3)</enum><text display-inline="yes-display-inline">The Sandia National Laboratories, New
			 Mexico.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id577B12D2EB0E4A4C9D4E7C7959B5A6B1"><enum>(b)</enum><header display-inline="yes-display-inline">Administrative provisions</header>
							<paragraph commented="no" display-inline="no-display-inline" id="IDa93a99ab55124512b67576f1ac4c8c22"><enum>(1)</enum><header display-inline="yes-display-inline">Appointment of chairperson</header><text display-inline="yes-display-inline">The Secretary of Energy shall appoint a
			 chairperson of the panel from among the members of the panel.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6078cbc0c3c647a58c829bfed5e81793"><enum>(2)</enum><header display-inline="yes-display-inline">Designation of agency staff to
			 panel</header><text display-inline="yes-display-inline">The Secretary of
			 Energy, the Secretary of Defense, and the Director of National Intelligence
			 shall each designate one or more employees of the Department of Energy, the
			 Department of Defense, and the intelligence community, respectively, to serve
			 as liaisons between the panel and the Department of Energy, the Department of
			 Defense, or the intelligence community, as the case may be.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf7e1bd23e8fc4c3eb5189df532d32f34"><enum>(3)</enum><header display-inline="yes-display-inline">Agency cooperation</header><text display-inline="yes-display-inline">The Secretary of Energy shall, in
			 consultation with the Secretary of Defense and the Director of National
			 Intelligence, ensure that the panel receives full and timely cooperation from
			 the Department of Energy, the Department of Defense, and the Director of
			 National Intelligence in conducting the review required under subsection
			 (a).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE46F33122E8F4FF3A2DC16205219F7E1"><enum>(4)</enum><header display-inline="yes-display-inline">Support from federally funded research and
			 development center</header><text display-inline="yes-display-inline">The
			 Secretary of Energy may use a federally funded research and development center
			 not associated with the Department of Energy to provide support to the
			 panel.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5238b70c52c444c3a2e4409173fe8321"><enum>(c)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">The review required under subsection (a)
			 shall include, with respect to each laboratory specified in such subsection, an
			 evaluation of the following:</text>
							<paragraph commented="no" display-inline="no-display-inline" id="IDc2bab4bea7b34e34a3757ca8676af456"><enum>(1)</enum><text display-inline="yes-display-inline">The quality of the scientific research
			 being conducted at the laboratory, including research with respect to weapons
			 science, nonproliferation, energy, and basic science.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2fe924ef4c2d4f68907274cfc3f73e38"><enum>(2)</enum><text display-inline="yes-display-inline">The quality of the engineering being
			 conducted at the laboratory.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe8fdcc9d8dd24ccca81db5d69ec92772"><enum>(3)</enum><text display-inline="yes-display-inline">The general operations of the laboratory,
			 including the management of facilities and procedures with respect to safety,
			 security, environmental management and compliance, and human capital.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID48d32ec4b22a44fdbd3417dd7e1a8967"><enum>(4)</enum><text display-inline="yes-display-inline">The financial operations of the laboratory,
			 including contract administration, accounting controls, and management of
			 property and equipment.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa8780d99632d4e83bbecc7b27e4f28fd"><enum>(5)</enum><text display-inline="yes-display-inline">The management of work conducted by the
			 laboratory for entities other than the Department of Energy, including academic
			 institutions and other Federal agencies, and interactions between the
			 laboratory and such entities.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID45b7465b3f4149a7801cb0ff2e5cae5e"><enum>(6)</enum><text display-inline="yes-display-inline">The adequacy and effectiveness of the form
			 and scope of current management contracts in implementing the mission of the
			 laboratory.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa85208c7700645f2bba64175b17e728b"><enum>(7)</enum><text display-inline="yes-display-inline">The effectiveness of the management and
			 oversight of the laboratory by the Department of Energy.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5a479a890ec741c7b0d7101688d4b78a"><enum>(d)</enum><header display-inline="yes-display-inline">Report of panel</header><text display-inline="yes-display-inline">The panel shall submit to the Secretary of
			 Energy a report containing the results of the review and any recommendations of
			 the panel resulting from the review.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="idC161A98957A54A419D94564C4EE2DE2D"><enum>(e)</enum><header display-inline="yes-display-inline">Transmittal to Congress</header><text display-inline="yes-display-inline">Not later than January 1, 2011, the
			 Secretary of Energy shall transmit to the Committee on Armed Services of the
			 Senate and the Committee on Armed Services of the House of Representatives the
			 report of the panel submitted under subsection (d) and any comments or
			 recommendations of the Secretary with respect to that report.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="idFF5DF495106244B996E2CC10127F1D48" section-type="subsequent-section"><enum>3133.</enum><header display-inline="yes-display-inline">Inclusion in 2010 stockpile stewardship
			 plan of certain information relating to stockpile stewardship criteria</header>
						<subsection commented="no" display-inline="no-display-inline" id="ID9318a7977f104ab2921a847aa7cf09c9"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Energy shall include in
			 the 2010 stockpile stewardship plan the elements specified in subsection
			 (b).</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID73f412662f974a1d83ca81357c3b91b3"><enum>(b)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">The elements specified in this subsection
			 are the following:</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID566a4ec0d7f24af8bb3467e66846af52"><enum>(1)</enum><text display-inline="yes-display-inline">An update of any information or criteria
			 included in the report on stockpile stewardship criteria submitted under
			 subsection (c) of section 4202 of the Atomic Energy Defense Act (50 U.S.C.
			 2522).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfb11ad416ade4117bc4db59abe85117c"><enum>(2)</enum><text display-inline="yes-display-inline">A description of any additional information
			 identified under paragraph (1) of such subsection (c) or criteria established
			 under subsection (a) of such section 4202 during the period beginning on the
			 date of the submittal of the report under section 3133 of the National Defense
			 Authorization Act for Fiscal Year 2004 (Public Law 108–136; 117 Stat. 1751; 50
			 U.S.C. 2523 note) and ending on the date of the submittal of the 2010 stockpile
			 stewardship plan.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDde3b64a9b5a24fa3a294094cc24776e7"><enum>(3)</enum><text display-inline="yes-display-inline">For each science-based tool developed or
			 modified by the Department of Energy during the period described in paragraph
			 (2) to collect information needed to determine that the nuclear weapons
			 stockpile is safe, secure, and reliable—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDfc46675bbf8d40a4beff6289710e127c"><enum>(A)</enum><text display-inline="yes-display-inline">a description of the relationship of the
			 science-based tool to the collection of such information; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID251785e3fc2d48ca8026e0d898d2e4f1"><enum>(B)</enum><text display-inline="yes-display-inline">a description of criteria for assessing the
			 effectiveness of the science-based tool in collecting such information.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID325c15f4b3a5435ea0d9f1d3245b8b6a"><enum>(c)</enum><header display-inline="yes-display-inline">2010 stockpile stewardship plan
			 defined</header><text display-inline="yes-display-inline">In this section, the
			 term <term>2010 stockpile stewardship plan</term> means the updated version of
			 the plan for maintaining the nuclear weapons stockpile developed under section
			 4203 of the Atomic Energy Defense Act (50 U.S.C. 2523) and required to be
			 submitted to Congress on May 1, 2010, by subsection (c) of such section.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="id2AA159EB4A6F4579B1A1D103AB4E1291" section-type="subsequent-section"><enum>3134.</enum><header display-inline="yes-display-inline">Comptroller General of the United States
			 review of projects carried out by the Office of Environmental Management of the
			 Department of Energy pursuant to the American Recovery and Reinvestment Act of
			 2009</header>
						<subsection commented="no" display-inline="no-display-inline" id="idA6B9E9DE855F47EE9D22A2D1291795FF"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Comptroller General of the United
			 States shall conduct a series of three reviews, as described in subsections
			 (b), (c), and (d), of projects carried out by the Office of Environmental
			 Management of the Department of Energy (in this section referred to as the
			 <quote>Office</quote>) using American Recovery and Reinvestment Act
			 funds.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="idAB58D0477C224370A53522CE90E4FD08"><enum>(b)</enum><header display-inline="yes-display-inline">Phase One review</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id66EA6BA7CE2D411C9D6845D5D1DA165E"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Beginning on the date of the enactment of
			 this Act, the Comptroller General shall conduct a review of the
			 following:</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDd45085be6b2f4056aeaeb1ba6e279be6"><enum>(A)</enum><text display-inline="yes-display-inline">The criteria used by the Office to select
			 projects to be carried out using American Recovery and Reinvestment Act
			 funds.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa7ae7363621646b1859adc67b224db55"><enum>(B)</enum><text display-inline="yes-display-inline">The extent to which lessons learned during
			 previous accelerations of defense environmental cleanup efforts were used in
			 the development of such criteria.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID68f124ed9a894b8180c0bd8655c5f7fa"><enum>(C)</enum><text display-inline="yes-display-inline">The process used by the Office to estimate
			 costs and develop schedules for such projects.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDce0029253bc24757be4e34a0d809f65d"><enum>(D)</enum><text display-inline="yes-display-inline">The process used by the Office for the
			 independent validation of the scope, cost, and schedule for such
			 projects.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4ae3ea1176234bb4b3c3e3dd9e8652b1"><enum>(E)</enum><text display-inline="yes-display-inline">The criteria and methodology used by the
			 Office to measure the contribution of each such project toward reducing the
			 overall costs, and meeting the goals, of defense environmental cleanup.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF5916CEE378C4A4B82D0A28761397011"><enum>(2)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 30 days after the date of
			 the enactment of this Act, the Comptroller General shall submit to the
			 congressional defense committees a report containing the results of the review
			 conducted under paragraph (1).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1550090197844477A50E3E4D53B3B2D2"><enum>(c)</enum><header display-inline="yes-display-inline">Phase Two review</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id893B972048A84747B25D3AE5C7CFCAED"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Comptroller General shall conduct a
			 review, during the period described in paragraph (2), of the following:</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID05e1ad273b154363bbf164fe7b7a32c8"><enum>(A)</enum><text display-inline="yes-display-inline">The implementation of each project carried
			 out using American Recovery and Reinvestment Act funds.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDbbc38bfc454d48e4b1c2292481392325"><enum>(B)</enum><text display-inline="yes-display-inline">The extent to which each such project is
			 meeting the cost and scheduling goals of the project.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd34671de10e140c2a96d7305c77bf4ee"><enum>(C)</enum><text display-inline="yes-display-inline">The number of jobs created or maintained
			 through such projects.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDfd68df6a5c17428693a4eb9e1674b83b"><enum>(D)</enum><text display-inline="yes-display-inline">The adequacy of contract oversight for such
			 projects.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDade5f6faebc7450eb5f869273b792001"><enum>(E)</enum><text display-inline="yes-display-inline">Any technical problems or other problems in
			 connection with such projects that are identified by the Comptroller General in
			 the course of the review.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDcb46731274594adf8033cfe1cbbaa0e3"><enum>(F)</enum><text display-inline="yes-display-inline">Any management and implementation issues or
			 actions, or other systemic issues, identified by the Comptroller General in the
			 course of the review that either hinder or assist the effective management of
			 defense environmental cleanup efforts.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB308BE5A401F4467BC528814954BAB42"><enum>(2)</enum><header display-inline="yes-display-inline">Period described</header><text display-inline="yes-display-inline">The period described in this paragraph is
			 the period—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id97880EBC58EF443DAB3E8975ED8F8C37"><enum>(A)</enum><text display-inline="yes-display-inline">beginning on the date on which the
			 Comptroller General submits the report required under subsection (b)(2);
			 and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id10E0F7CD8B4A40F9917CBAC7318EB27D"><enum>(B)</enum><text display-inline="yes-display-inline">ending on the later of—</text>
									<clause commented="no" display-inline="no-display-inline" id="idE1BDB736BBEB446F88842AB6F1383E28"><enum>(i)</enum><text display-inline="yes-display-inline">the date on which all projects carried out
			 using American Recovery and Reinvestment Act funds have been completed;
			 or</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id944057DA2DEF4ED6AFCBC36EDBAC8C0B"><enum>(ii)</enum><text display-inline="yes-display-inline">the date on which all American Recovery and
			 Reinvestment Act funds have been obligated or expended or are no longer
			 available to be obligated or expended.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEA48F66E448E4CCC851A05CD7DE84176"><enum>(3)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">The Comptroller General shall submit to the
			 congressional defense committees a report on the status of the review conducted
			 under paragraph (1) not later than 30 days after submitting the report required
			 under subsection (b)(2) and every 120 days thereafter until the end of the
			 period described in paragraph (2).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idED0C31EC29584A9EBE5F84CCF3C424C0"><enum>(d)</enum><header display-inline="yes-display-inline">Phase Three review</header>
							<paragraph commented="no" display-inline="no-display-inline" id="idBC358FF0E1BF46D2876060B5B1DFC9DB"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Beginning on the date on which the
			 Comptroller General submits the last report required under subsection (c)(3),
			 the Comptroller General shall conduct a review of the following:</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDdd3e2d2c3f9b40c381b15ee6f36a8cf2"><enum>(A)</enum><text display-inline="yes-display-inline">The implementation of all projects carried
			 out using American Recovery and Reinvestment Act funds, including the number of
			 such projects that were completed, that were not completed, that were completed
			 on budget, that exceeded the budget for such project, that were completed on
			 schedule, and that exceeded the scheduling goals for such project.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe18ad27f88414878bd2ead0b4198f450"><enum>(B)</enum><text display-inline="yes-display-inline">The impact on employment as a result of the
			 completion of such projects.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID31222f2e912e4cb1824f5dbbf4041b90"><enum>(C)</enum><text display-inline="yes-display-inline">Any lessons learned as a result of
			 accelerating such projects.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0764fc17f75b49379a312f7995221512"><enum>(D)</enum><text display-inline="yes-display-inline">The extent to which the achievement of the
			 overall goals of defense environmental cleanup were accelerated, and the
			 overall costs of defense environmental cleanup were reduced, as a result of
			 such projects.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe5c311279d624e2ca3e0e51353978fcc"><enum>(E)</enum><text display-inline="yes-display-inline">Any other issues the Comptroller General
			 considers appropriate with respect to such projects.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id402D1E0BB535432E92B16C80E8B0AF00"><enum>(2)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 90 days after submitting the
			 last report required under subsection (c)(3), the Comptroller General shall
			 submit to the congressional defense committees a report containing the results
			 of the review conducted under paragraph (1).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id419C78D66A3245D6801DEACB0FBE8C89"><enum>(e)</enum><header display-inline="yes-display-inline">American Recovery and Reinvestment Act
			 funds defined</header><text display-inline="yes-display-inline">In this
			 section, the term <term>American Recovery and Reinvestment Act funds</term>
			 means funds made available for the Office of Environmental Management under the
			 heading <quote><header-in-text level="appropriations-intermediate" style="appropriations">Defense Environmental Cleanup</header-in-text></quote>
			 under the heading <quote><header-in-text level="appropriations-major" style="traditional">environmental and other defense
			 activities</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-major" style="appropriations">Department of
			 Energy</header-in-text></quote> under title IV of division A of the American
			 Recovery and Reinvestment Act of 2009 (Public Law 111–5; 123 Stat. 140).</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="idEC37FD3830BE4F48B7ED8F9678BC" section-type="subsequent-section"><enum>3135.</enum><header display-inline="yes-display-inline">Identification in budget materials of
			 amounts for certain Department of Energy pension obligations</header><text display-inline="no-display-inline">The Secretary of Energy shall include in the
			 budget justification materials submitted to Congress in support of the
			 Department of Energy budget for a fiscal year (as submitted with the budget of
			 the President under section 1105(a) of title 31, United States Code) specific
			 identification, as a budgetary line item, of the amounts required to meet the
			 pension obligations of the Department of Energy for contractor employees at
			 each facility of the Department of Energy operated using amounts authorized to
			 be appropriated for the Department of Energy.</text>
					</section><section id="id7B278890ED054261861C86DB8324EA28"><enum>3136.</enum><header>Expansion of
			 authority of Ombudsman of Energy Employees Occupational Illness Compensation
			 Program</header>
						<subsection id="id3F0FBFAFDC64443AB188016D9EAE5C1D"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 3686 of the
			 Energy Employees Occupational Illness Compensation Program Act of 2000 (42
			 U.S.C. 7385s–15) is amended—</text>
							<paragraph id="id4EB3FA70C99F4CD9AD0814BE0EB28C92"><enum>(1)</enum><text>in subsection
			 (c), by inserting <quote>and subtitle B</quote> after <quote>this
			 subtitle</quote> each place it appears;</text>
							</paragraph><paragraph id="idEF7E959873A34BD89C474CB0BB6CF811"><enum>(2)</enum><text>in subsection
			 (d), by inserting <quote>and subtitle B</quote> after <quote>this
			 subtitle</quote>;</text>

				Institute for Occupational Safety and Health ombudsman</header><text>In
				carrying out the duties of the Ombudsman under this section, the Ombudsman
				shall work with the individual employed by the National Institute for
				Occupational Safety and Health to serve as an ombudsman to individuals making
				claims under subtitle
				B.</text>
									</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
							</paragraph></subsection><subsection id="id2E44E91025E84AEAAF7A52917315D7C4"><enum>(b)</enum><header>Construction</header><text>Except
			 as specifically provided in subsection (g) of section 3686 of the Energy
			 Employees Occupational Illness Compensation Program Act of 2000, as amended by
			 subsection (a) of this section, nothing in the amendments made by such
			 subsection (a) shall be construed to alter or affect the duties and functions
			 of the individual employed by the National Institute for Occupational Safety
			 and Health to serve as an ombudsman to individuals making claims under subtitle
			 B of the Energy Employees Occupational Illness Compensation Program Act of 2000
			 (42 U.S.C. 7384l et seq.).</text>
						</subsection></section><section id="idC748EDBF65D141A7803322AAF687A22A"><enum>3137.</enum><header>Comptroller
			 General study of stockpile stewardship program</header>
						<subsection id="ID2ae0cb5b94174589b96e65b74a85fa02"><enum>(a)</enum><header>In
			 general</header><text>The Comptroller General of the United States shall
			 conduct a study of the stockpile stewardship program established under section
			 4201 of the Atomic Energy Defense Act (50 U.S.C. 2521) to determine if the
			 program was functioning, as of December 2008, as envisioned when the program
			 was established.</text>
						</subsection><subsection id="idF57341D6FC844F70BEDD1E674B0AAC3A"><enum>(b)</enum><header>Elements</header><text>The
			 study required by subsection (a) shall include the following:</text>
							<paragraph id="ID92342e8a98674ce0abec0e1041a670a4"><enum>(1)</enum><text>An assessment of
			 whether the capabilities determined to be necessary to maintain the nuclear
			 weapons stockpile without nuclear testing have been implemented and the extent
			 to which such capabilities are functioning.</text>
							</paragraph><paragraph id="ID9817f4c70bca4a08b0e919255c150285"><enum>(2)</enum><text>A review and
			 description of the agreements governing use, management, and support of the
			 capabilities developed for the stockpile stewardship program and an assessment
			 of enforcement of, and compliance with, those agreements.</text>
							</paragraph><paragraph id="ID41129e6bfd7842eda43cd69f910b70e0"><enum>(3)</enum><text>An assessment of
			 plans for surveillance and testing of nuclear weapons in the stockpile and the
			 extent of the compliance with such plans.</text>
							</paragraph><paragraph id="ID97490c8781994a72b776c228d14c6c60"><enum>(4)</enum><text>An assessment
			 of—</text>
								<subparagraph id="id8E18A412AE4F4C4687F7E9DEF7C41F38"><enum>(A)</enum><text>the condition of
			 the infrastructure at the plants and laboratories of the nuclear weapons
			 complex;</text>
								</subparagraph><subparagraph id="idAA986D203536495CA1304C1408C75C78"><enum>(B)</enum><text>the value of
			 nuclear weapons facilities built after 1992;</text>
								</subparagraph><subparagraph id="id26FAA3CCE87B4B55B2666F57E3FE9A37"><enum>(C)</enum><text>any plans that
			 are in place to maintain, improve, or replace such infrastructure;</text>
								</subparagraph><subparagraph id="id88A00084A50248788B3EB75F5E794C31"><enum>(D)</enum><text>whether there is
			 a validated requirement for all planned infrastructure replacement projects;
			 and</text>
								</subparagraph><subparagraph id="id96B304D03AA74B108F76C740D8AA69F5"><enum>(E)</enum><text>the projected
			 costs for each such project and the timeline for completion of each such
			 project.</text>
								</subparagraph></paragraph><paragraph id="IDc9234b19df7041eda9c9d69e55d5a779"><enum>(5)</enum><text>An assessment of
			 the efforts to ensure and maintain the intellectual and technical capability of
			 the nuclear weapons complex to support the nuclear weapons stockpile.</text>
							</paragraph><paragraph id="IDdbc783db3be24844bde94088d85b9ac3"><enum>(6)</enum><text>Recommendations
			 for the stockpile stewardship program going forward.</text>
							</paragraph></subsection><subsection id="IDd88f476e6e2641ebb13a83a546de16e0"><enum>(c)</enum><header>Report</header><text>Not
			 later than 270 days after the date of the enactment of this Act, the
			 Comptroller General shall submit to the congressional defense committees a
			 report containing the results of the study required by subsection (a).</text>
						</subsection></section><section id="idD1B712E13B2D489A95F133B3240CEA2E"><enum>3138.</enum><header>Sense of the
			 Senate on production of molybdenum–99</header>
						<subsection id="id6C6CC65212074FE484A93777A0884779"><enum>(a)</enum><header>Findings</header><text>The
			 Senate makes the following findings:</text>
							<paragraph id="IDc2368a58b2f9410f8b0395a41b02e2c4"><enum>(1)</enum><text>There are fewer
			 than five reactors around the world currently capable of producing
			 molybdenum–99 (Mo–99) and there are no such reactors in the United States that
			 can provide a reliable supply of Mo–99 to meet medical needs.</text>
							</paragraph><paragraph id="ID4cec62d229554d02a9f11717a4496161"><enum>(2)</enum><text>Since November
			 2007, there have been major disruptions in the global availability of Mo–99,
			 including at facilities in Canada and the Netherlands, which have led to
			 shortages of Mo–99-based medical products in the United States and around the
			 world.</text>
							</paragraph><paragraph id="ID2fb8bd3aff0540968ad498977b673e5f"><enum>(3)</enum><text>Ensuring a
			 reliable supply of medical radioisotopes, including Mo–99, is of great
			 importance to the public health.</text>
							</paragraph><paragraph id="ID2286ef53f2024232a55590e19d850437"><enum>(4)</enum><text>It is also a
			 national security priority of the United States, and specifically of the
			 Department of Energy, to encourage the production of low-enriched uranium-based
			 radioisotopes in order to promote a more peaceful international nuclear
			 order.</text>
							</paragraph><paragraph id="IDb5457e11309f40c88e8125658e0e503b"><enum>(5)</enum><text>The National
			 Academy of Sciences has identified a need to establish a reliable capability in
			 the United States for the production of Mo–99 and its derivatives for medical
			 purposes using low-enriched uranium.</text>
							</paragraph><paragraph id="ID8ffd25659fa14589a054688b72746c69"><enum>(6)</enum><text>There also exists
			 a capable industrial base in the United States that can support the development
			 of Mo–99 production facilities and can conduct the processing and distribution
			 of radiopharmaceutical products for use in medical tests worldwide.</text>
							</paragraph></subsection><subsection id="idCACA64089E6844F1B430D5930E3D00B2"><enum>(b)</enum><header>Sense of the
			 Senate</header><text>It is the sense of the Senate that—</text>
							<paragraph id="id51EA8303B5A3493894625A9B9208A384"><enum>(1)</enum><text>radioisotopes and
			 radiopharmaceuticals, including Mo–99 and its derivatives, are essential
			 components of medical tests that help diagnose and treat life-threatening
			 diseases affecting millions of people each year; and</text>
							</paragraph><paragraph id="IDb6db62cb0b904821a769ad4f4e87d568"><enum>(2)</enum><text>the Secretary of
			 Energy should continue and expand a program to meet the need identified by the
			 National Academy of Sciences to ensure a source of Mo–99 and its derivatives
			 for use in medical tests to help ensure the health security of the United
			 States and around the world and promote peaceful nuclear industries through the
			 use of low-enriched uranium.</text>
							</paragraph></subsection></section></subtitle></title><title commented="no" id="idB048C6899E9E4B749C72DA125639E336" level-type="subsequent"><enum>XXXII</enum><header display-inline="yes-display-inline">DEFENSE NUCLEAR FACILITIES SAFETY
			 BOARD</header>
				<section commented="no" display-inline="no-display-inline" id="id4356105B53AF4D069F27CA0B9B8686D1" section-type="subsequent-section"><enum>3201.</enum><header display-inline="yes-display-inline">Authorization</header><text display-inline="no-display-inline">There are authorized to be appropriated for
			 fiscal year 2010, $26,086,000 for the operation of the Defense Nuclear
			 Facilities Safety Board under chapter 21 of the Atomic Energy Act of 1954 (42
			 U.S.C. 2286 et seq.).</text>
				</section></title><title commented="no" id="idE73882D1CDA447DC98E613932A2242A3" level-type="subsequent"><enum>XXXIII</enum><header display-inline="yes-display-inline">MARITIME ADMINISTRATION</header>
				<section commented="no" display-inline="no-display-inline" id="id91572748B2A142B680207585D10518DF" section-type="subsequent-section"><enum>3301.</enum><header display-inline="yes-display-inline">Maritime Administration</header><text display-inline="no-display-inline">Section 109 of title 49, United States Code,
			 is amended to read as follows:</text>

						<section commented="no" display-inline="no-display-inline" id="idC3825C96B14A46539AA9028BCFF60854" section-type="subsequent-section"><enum>109.</enum><header display-inline="yes-display-inline">Maritime Administration</header>
							<subsection commented="no" display-inline="no-display-inline" id="idB1FC21BA119D47BF876DC593E6390D83"><enum>(a)</enum><header display-inline="yes-display-inline">Organization</header><text display-inline="yes-display-inline">The Maritime Administration is an
				administration in the Department of Transportation.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id141ACD32026141978A6BF9972C5B25D9"><enum>(b)</enum><header display-inline="yes-display-inline">Maritime Administrator</header><text display-inline="yes-display-inline">The head of the Maritime Administration is
				the Maritime Administrator, who is appointed by the President by and with the
				advice and consent of the Senate. The Administrator shall report directly to
				the Secretary of Transportation and carry out the duties prescribed by the
				Secretary.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id5A0A8B1914BC4AA19877ADFC37B4C013"><enum>(c)</enum><header display-inline="yes-display-inline">Deputy Maritime Administrator</header><text display-inline="yes-display-inline">The Maritime Administrator shall have a
				Deputy Maritime Administrator, who is appointed in the competitive service by
				the Secretary, after consultation with the Administrator. The Deputy
				Administrator shall carry out the duties prescribed by the Administrator. The
				Deputy Administrator shall be Acting Administrator during the absence or
				disability of the Administrator and, unless the Secretary designates another
				individual, during a vacancy in the office of Administrator.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id896D1C65DEB44C98967F83BCFCF70D73"><enum>(d)</enum><header display-inline="yes-display-inline">Duties and powers vested in
				Secretary</header><text display-inline="yes-display-inline">All duties and
				powers of the Maritime Administration are vested in the Secretary.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="idB2CDD62CF70E4FD49926CC8C5AC5CDE7"><enum>(e)</enum><header display-inline="yes-display-inline">Regional offices</header><text display-inline="yes-display-inline">The Maritime Administration shall have
				regional offices for the Atlantic, Gulf, Great Lakes, and Pacific port ranges,
				and may have other regional offices as necessary. The Secretary shall appoint a
				qualified individual as Director of each regional office. The Secretary shall
				carry out appropriate activities and programs of the Maritime Administration
				through the regional offices.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id56798CEF331A423D96CA8145ED59C5F6"><enum>(f)</enum><header display-inline="yes-display-inline">Interagency and industry
				relations</header><text display-inline="yes-display-inline">The Secretary shall
				establish and maintain liaison with other agencies, and with representative
				trade organizations throughout the United States, concerned with the
				transportation of commodities by water in the export and import foreign
				commerce of the United States, for the purpose of securing preference to
				vessels of the United States for the transportation of those
				commodities.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id18821EF0947C456C87C69405E66D14A3"><enum>(g)</enum><header display-inline="yes-display-inline">Detailing officers from armed
				forces</header><text display-inline="yes-display-inline">To assist the
				Secretary in carrying out duties and powers relating to the Maritime
				Administration, not more than five officers of the armed forces may be detailed
				to the Secretary at any one time, in addition to details authorized by any
				other law. During the period of a detail, the Secretary shall pay the officer
				an amount that, when added to the officer's pay and allowances as an officer in
				the armed forces, make the officer's total pay and allowances equal to the
				amount that would be paid to an individual performing work the Secretary
				considers to be of similar importance, difficulty, and responsibility as that
				performed by the officer during the detail.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="idB3DB3BEC67A64A35B2211AF44D454F6A"><enum>(h)</enum><header display-inline="yes-display-inline">Contracts and audits</header>
								<paragraph commented="no" display-inline="no-display-inline" id="id75311BE9C4804EE19D7D9F12E8EFA84D"><enum>(1)</enum><header display-inline="yes-display-inline">Contracts</header><text display-inline="yes-display-inline">In the same manner that a private
				corporation may make a contract within the scope of its authority under its
				charter, the Secretary may make contracts for the United States Government and
				disburse amounts to—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id2342459081C449CA8545D67A8DEF5C63"><enum>(A)</enum><text display-inline="yes-display-inline">carry out the Secretary's duties and powers
				under this section and subtitle V of title 46; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAC86A897B73F4BB89947CFC47AAE3D34"><enum>(B)</enum><text display-inline="yes-display-inline">protect, preserve, and improve collateral
				held by the Secretary to secure indebtedness.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3A616D2E2D484B2882DCCD55583B4517"><enum>(2)</enum><header display-inline="yes-display-inline">Audits</header><text display-inline="yes-display-inline">The financial transactions of the Secretary
				under paragraph (1) shall be audited by the Comptroller General. The
				Comptroller General shall allow credit for an expenditure shown to be necessary
				because of the nature of the business activities authorized by this section or
				subtitle V of title 46. At least once a year, the Comptroller General shall
				report to Congress any departure by the Secretary from this section or subtitle
				V of title 46.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id020A9D2EBACE49F6BEF4AB132A6206E5"><enum>(i)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header>
								<paragraph commented="no" display-inline="no-display-inline" id="idF0B2D83B2965483F841CC0A36F6D86B8"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as otherwise provided in this
				subsection, there are authorized to be appropriated such amounts as may be
				necessary to carry out the duties and powers of the Secretary relating to the
				Maritime Administration.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEF1844C539C245D9A245D3170DAA8664"><enum>(2)</enum><header display-inline="yes-display-inline">Limitations</header><text display-inline="yes-display-inline">Only those amounts specifically authorized
				by law may be appropriated for the use of the Maritime Administration
				for—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id89611AFB9BFE4EFA813E753B467C7872"><enum>(A)</enum><text display-inline="yes-display-inline">acquisition, construction, or
				reconstruction of vessels;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id832E3F40928044CBB8686E1DBD64C94D"><enum>(B)</enum><text display-inline="yes-display-inline">construction-differential subsidies
				incident to the construction, reconstruction, or reconditioning of
				vessels;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id425496D8B27F4E59A12D06B4D8F0055D"><enum>(C)</enum><text display-inline="yes-display-inline">costs of national defense features;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id42DF71FA5D654B2289EBB8FD9E4485A7"><enum>(D)</enum><text display-inline="yes-display-inline">payments of obligations incurred for
				operating-differential subsidies;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEF721FCAA66642CA915EABF75CF1F658"><enum>(E)</enum><text display-inline="yes-display-inline">expenses necessary for research and
				development activities, including reimbursement of the Vessel Operations
				Revolving Fund for losses resulting from expenses of experimental vessel
				operations;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD11B13D3BAD14548BCC4475D692362EB"><enum>(F)</enum><text display-inline="yes-display-inline">the Vessel Operations Revolving
				Fund;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD791EA275B5D4DDF856E676479A0277C"><enum>(G)</enum><text display-inline="yes-display-inline">National Defense Reserve Fleet
				expenses;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6C28C198422B412C92DF33B163C11DA0"><enum>(H)</enum><text display-inline="yes-display-inline">expenses necessary to carry out part B of
				subtitle V of title 46; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id841BCD465ACE4125AB6BF39762779F4A"><enum>(I)</enum><text display-inline="yes-display-inline">other operations and training expenses
				related to the development of waterborne transportation systems, the use of
				waterborne transportation systems, and general administration.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9DCF099C9EE54621A47FAD6E5A300B09"><enum>(3)</enum><header display-inline="yes-display-inline">Training vessels</header><text display-inline="yes-display-inline">Amounts may not be appropriated for the
				purchase or construction of training vessels for State maritime academies
				unless the Secretary has approved a plan for sharing training vessels between
				State maritime
				academies.</text>
