			 purposes</header>
			<subsection id="HBE128F3C04BF42C98D6B34008774EFBA"><enum>(a)</enum><header>Congressional
			 findings</header><text display-inline="yes-display-inline">The Congress finds
			 that—</text>
				<paragraph id="H5A0BC82F3EB54E51BBAC9CD44E204F58"><enum>(1)</enum><text display-inline="yes-display-inline">making the United States energy efficient
			 is essential for enhancing national security, fighting climate change, and
			 creating jobs;</text>
				</paragraph><paragraph id="H810BF9215972480684A18F9413C8C12F"><enum>(2)</enum><text display-inline="yes-display-inline">unchecked use of energy resources poses a
			 significant threat to the national security, economy, public health, and
			 welfare of the people of the United States, the well-being of other nations,
			 and the global environment;</text>
				</paragraph><paragraph id="HE67B91BF48414B7EB15B171D9F92FA04"><enum>(3)</enum><text>prompt, decisive
			 action is critical to encourage energy efficiency and conservation and the
			 development of renewable energy sources for housing, commercial structures, and
			 other buildings, and to create sustainable communities; and</text>
				</paragraph><paragraph id="H91D9837EB907484DAFF8BA51AF46B1FA"><enum>(4)</enum><text display-inline="yes-display-inline">it is possible and desirable to reduce
			 energy consumption in the United States while employing—</text>
					<subparagraph id="HF32F88120E084F5D81E3DC539050265C"><enum>(A)</enum><text>cost containment
			 measures;</text>
					</subparagraph><subparagraph id="H49915E03E7604674B5F0EE894844A5DE"><enum>(B)</enum><text>periodic review of
			 requirements;</text>
					</subparagraph><subparagraph id="HC0D16A88248C400B896551309C97B4F7"><enum>(C)</enum><text>an aggressive
			 program for deploying advanced energy technology; and</text>
					</subparagraph><subparagraph id="HF4DC75B8B7C1476EA3C84FEB222C6543"><enum>(D)</enum><text>programs to assist
			 low- and middle-income energy consumers.</text>
					</subparagraph></paragraph></subsection><subsection id="H4CB16CA98E6E432D8FB6006F1E355B43"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of this Act are—</text>
				<paragraph id="HDF0A696C824B4177B8B9F023F6EDD38"><enum>(1)</enum><text display-inline="yes-display-inline">to encourage the use of energy efficiency
			 and conservation methods in Federal housing programs;</text>
				</paragraph><paragraph id="idE5A32B9730F04280B8400566FFEADB73"><enum>(2)</enum><text>to expand the use
			 of energy efficient mortgages;</text>
				</paragraph><paragraph id="HDA29605E2F9140FBA7B66007E04679E9"><enum>(3)</enum><text>to provide for the
			 development and installation of renewable energy sources for housing,
			 commercial structures, and other buildings;</text>
				</paragraph><paragraph id="HC8CED6ED8BF642EA898550F457D33260"><enum>(4)</enum><text>to create
			 sustainable communities;</text>
				</paragraph><paragraph id="id81E12840416E4D7FAF2AE3318EDCABB5"><enum>(5)</enum><text>to support the
			 creation of a stable <quote>green jobs</quote> sector by increasing demand for
			 energy efficient products and professionals with expertise in green building
			 standards; and</text>
				</paragraph><paragraph id="H68FF504D3737443FBD72AA104B824C71"><enum>(6)</enum><text>to achieve these
			 goals while preserving the development, benefits, and affordability of Federal
			 housing programs.</text>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="H3CF1F56DE8B347928C4FD1A13001ECB1" section-type="subsequent-section"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions shall
			 apply:</text>
			<paragraph id="HCF981CF065BA47869848C9C932AAAD70"><enum>(1)</enum><header>Energy
			 audit</header><text>The term <term>energy audit</term> means an investment
			 grade energy audit conducted for purposes of paragraph (2)(B)(iii), in
			 accordance with such standards as the Secretary shall establish, after optional
			 consultation with any advisory committee established pursuant to section
			 7(c)(2) of this Act.</text>
			</paragraph><paragraph id="id824FBA64F0024A2E9EE8A9BC4881560F"><enum>(2)</enum><header>Enhanced energy
			 efficiency standards</header><text>The term <term>enhanced energy efficiency
			 standards</term> means any one of the following:</text>
				<subparagraph id="idC3C80F364D5F41FE881A4EAD0585FCAC"><enum>(A)</enum><header>Green building
			 standards</header><text>Green building standards, as that term is defined in
			 paragraph (3).</text>
				</subparagraph><subparagraph id="id81978CF81E014AA6B66850E33517F8DB"><enum>(B)</enum><header>Residential
			 structures</header><text>In the case of a residential single family or
			 multifamily structure, standards established by the Secretary, by regulation,
			 that—</text>
					<clause id="idD087B20AAF974DD09532C27BE641CCD5"><enum>(i)</enum><text>impose
			 requirements additional to, or more stringent than, minimum energy efficiency
			 standards, as that term is defined in paragraph (6);</text>
					</clause><clause id="idCCFD953345BD4409A2ABDC2614B16878"><enum>(ii)</enum><text>in
			 the case of a newly constructed structure, are identical to the Energy Star
			 standards established by the Environmental Protection Agency, or any successor
			 thereto adopted by the Secretary by regulation;</text>
					</clause><clause id="id773D9F5D79944701B067C05FC4E8DC17"><enum>(iii)</enum><text>in the case of
			 an existing structure, require a reduction in energy consumption from the
			 previous level of consumption for the structure, as determined in accordance
			 with energy audits performed both before and after any rehabilitation or
			 improvements undertaken to reduce such consumption, that exceeds the reduction
			 necessary for compliance with minimum energy efficiency standards.</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA5DB68FE28414614919F4065438A0CF2"><enum>(C)</enum><header>Nonresidential
			 structures</header><text>In the case of a nonresidential structure, include
			 such energy efficiency and conservation requirements, standards, checklists, or
			 rating systems for nonresidential structures as the Secretary determines are
			 necessary.</text>
				</subparagraph></paragraph><paragraph id="idB8F215E3E44D41988B0483B38B360101"><enum>(3)</enum><header>Green building
			 standards</header><text>The term <term>green building standards</term> means
			 systems and standards for residential and nonresidential structures that are
			 established or adopted by the Secretary, by regulation, and that—</text>
				<subparagraph id="id68B818B5843945748F5F6DFEF68AF54E"><enum>(A)</enum><text>require the use
			 of sustainable design principles to—</text>
					<clause id="id3744D5A0294F4B2E931F573898FF0FA2"><enum>(i)</enum><text>reduce the use of
			 nonrenewable resources;</text>
					</clause><clause id="id8786DC97A57E4BF38D595E49D147B844"><enum>(ii)</enum><text>encourage energy
			 efficient construction and rehabilitation and the use of renewable energy
			 resources;</text>
					</clause><clause id="id085D938C7DCC413FA3EBD5C8B575978C"><enum>(iii)</enum><text>minimize the
			 impact of development on the environment;</text>
					</clause><clause id="idF50D121B46D045D886CD6B0FAD5C1A1B"><enum>(iv)</enum><text>improve indoor
			 air quality;</text>
					</clause><clause id="id087D25A0508446EA90C0AB57370BE661"><enum>(v)</enum><text>maximize water
			 conservation; and</text>
					</clause><clause id="id51E3C9AD1DFB45AE91E61C6F1EA10090"><enum>(vi)</enum><text>encourage the
			 selection of building materials that reduce adverse impacts on the
			 environment;</text>
					</clause></subparagraph><subparagraph id="id2CCEA9C648194E2CA81CD02773282F68"><enum>(B)</enum><text>impose
			 requirements additional to, or more stringent than, minimum energy efficiency
			 standards, as that term is defined in paragraph (6);</text>
				</subparagraph><subparagraph id="id0321D0E3A0604DE8823BC81B7F720556"><enum>(C)</enum><text>include—</text>
					<clause commented="no" id="H6E0375908E404C1194B89747BED2EB0"><enum>(i)</enum><text>the national Green
			 Communities criteria checklist for residential construction, which provides
			 criteria for the design, development, and operation of affordable housing, or
			 any successor thereto adopted by the Secretary by regulation;</text>
					</clause><clause commented="no" id="H3BB83AFDB13C496E861E426E19854D14"><enum>(ii)</enum><text display-inline="yes-display-inline">the Leadership in Energy and Environmental
			 Design (LEED) certification for new construction, the LEED for Homes rating
			 system, the LEED for Core and Shell rating system, as applicable, or any
			 successors thereto adopted by the Secretary by regulation;</text>
					</clause><clause id="HD52E4FAC32BF40F6B5242513225EE9AF"><enum>(iii)</enum><text>the Green Globes
			 assessment and rating system of the Green Building Initiative;</text>
					</clause><clause id="H111F056ABED3487CB165D032F31EF75"><enum>(iv)</enum><text display-inline="yes-display-inline">in the case of manufactured housing, the
			 Energy Star standards established by the Environmental Protection Agency with
			 respect to fixtures, appliances, and equipment in such housing, or any
			 successor thereto adopted by the Secretary by regulation;</text>
					</clause><clause display-inline="no-display-inline" id="H7C852549EB10483A80D0E7D35DB2F374"><enum>(v)</enum><text display-inline="yes-display-inline">the National Green Building Standard,
			 only—</text>
						<subclause id="H6ACD59D46AC8428FA2834442BD4D808E"><enum>(I)</enum><text>if such standard
			 is ratified under the American National Standards Institute process;</text>
						</subclause><subclause id="H07A56A09B4034A80A8E404FFEE3F9DE"><enum>(II)</enum><text>upon expiration of
			 the 180-day period beginning upon such ratification; and</text>
						</subclause><subclause id="HB00D4B595D6145298FE0432C91E925CC"><enum>(III)</enum><text>if, during such
			 180-day period, the Secretary does not reject the applicability of such
			 standard for purposes of this paragraph; and</text>
						</subclause></clause><clause id="HE5AC251D3BEB47CBBF9F58A97D31C042"><enum>(vi)</enum><text display-inline="yes-display-inline">any other requirement, standard, checklist,
			 or rating system for green building or sustainability that the
			 Secretary—</text>
						<subclause id="idFD7E3FCE81034AB3BC1CADE8630AD1B1"><enum>(I)</enum><text display-inline="yes-display-inline">determines is necessary for a specific type
			 of residential single family or multifamily structure; or</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="idBB74055B26AA4B53AE4E7B1C55D4DB23"><enum>(II)</enum><text display-inline="yes-display-inline">may determine to adopt or apply not later
			 than 180 days after the date of receipt of any written request, made in such
			 form as the Secretary shall provide, for such adoption and application;
			 and</text>
						</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF66F5F285EFA4B4A84F631EA5A152EF0"><enum>(D)</enum><text>may be waived by
			 the Secretary, if the Secretary determines that waiver of such regulations
			 would promote enhanced energy efficiency or conservation.</text>
				</subparagraph></paragraph><paragraph id="HD981013AB5674F529F32ED0788AF177C"><enum>(4)</enum><header>HUD</header><text>The
			 term <term>HUD</term> means the Department of Housing and Urban
			 Development.</text>
			</paragraph><paragraph id="H2A5D5467D25142D40098B0D3C73BCF32"><enum>(5)</enum><header>HUD
			 assistance</header><text>The term <term>HUD assistance</term> means financial
			 assistance that is awarded, competitively or noncompetitively, allocated by
			 formula, or provided by HUD through loan insurance or guarantee.</text>
			</paragraph><paragraph id="idFC79ABCFA2014425A7FB42A0524AD58E"><enum>(6)</enum><header>Minimum energy
			 efficiency standards</header>
				<subparagraph id="idDB19D93DD5A140CB831DD249ACBDC2F5"><enum>(A)</enum><header>In
			 general</header><text>The term <term>minimum energy efficiency standards</term>
			 has the meaning given that term by regulations of the Secretary.</text>
				</subparagraph><subparagraph id="id155B5E67F3DF46A8994D29C33A4BCBFF"><enum>(B)</enum><header>Regulations for
			 residential structures</header><text>Regulations issued by the Secretary under
			 subparagraph (A) shall, in the case of a residential single family or
			 multifamily structure—</text>
					<clause id="H3BEFF1762A294704BC16A25810B1C5FF"><enum>(i)</enum><text display-inline="yes-display-inline">require the structure to comply with the
			 applicable provisions of the American Society of Heating, Refrigerating, and
			 Air-Conditioning Engineers Standard 90.1–2007, or any successor thereto adopted
			 by the Secretary, by regulation;</text>
					</clause><clause id="H6E9B1C5B869744E2B343FCD523B7D455"><enum>(ii)</enum><text display-inline="yes-display-inline">require the structure to comply with the
			 applicable provisions of the 2009 International Energy Conservation Code, or
			 any successor thereto adopted by the Secretary, by regulation;</text>
					</clause><clause id="H90324FAFE631487AB3D0A6F46100AFF9"><enum>(iii)</enum><text display-inline="yes-display-inline">in the case of an existing
			 structure—</text>
						<subclause id="id7A106972C04749CBA0880BD42EE988EF"><enum>(I)</enum><text display-inline="yes-display-inline">where the Secretary determines such action
			 is cost effective, require—</text>
							<item id="id3D59EF1022534B9C950A185929158254"><enum>(aa)</enum><text display-inline="yes-display-inline">the structure to have undergone
			 rehabilitation or improvements that are completed after the date of enactment
			 of this Act; and</text>
							</item><item id="id5E210DFA54354B70858CF211EF7045E7"><enum>(bb)</enum><text display-inline="yes-display-inline">the energy consumption for the structure to
			 have been reduced by not less than 20 percent from the previous level of
			 consumption, as determined in accordance with energy audits performed both
			 before and after any rehabilitation or improvements undertaken to reduce such
			 consumption;</text>
							</item></subclause><subclause id="id9BDC152A378B43F3881991E310F92D4E"><enum>(II)</enum><text>if the structure
			 has 4 stories or more, require the structure to demonstrate a 20 percent
			 improvement in the proposed building performance rating when compared to a
			 baseline building performance rating resulting from a whole building project
			 simulation conducted in accordance with the Building Performance Rating Method
			 in Appendix G of American Society of Heating, Refrigerating, and
			 Air-Conditioning Engineers Standard 90.1–2004, or any successor thereto adopted
			 by the Secretary, by regulation; and</text>
						</subclause><subclause id="idA8D24A57AADD413698984B6769997DC7"><enum>(III)</enum><text>if the
			 structure has fewer than 4 stories, require the structure to demonstrate, by
			 modeling based on the Home Energy Rating System Index of the Residential Energy
			 Services Network, a 20 percent improvement in the proposed building performance
			 rating; and</text>
						</subclause></clause><clause id="HF15D9947F53E41ADAEFA6CF5D10771DF"><enum>(iv)</enum><text display-inline="yes-display-inline">require the structure to comply with any
			 provisions of such other energy efficiency requirements, standards, checklists,
			 or ratings systems as the Secretary determines are necessary for a specific
			 type of residential single family or multifamily structure; and</text>
					</clause></subparagraph><subparagraph id="H3F79234EB06E49388B982C7EDA8DA991"><enum>(C)</enum><header>Regulations for
			 nonresidential structures</header><text display-inline="yes-display-inline">Regulations issued by the Secretary under
			 subparagraph (a) shall, in the case of a nonresidential structure that is
			 constructed or rehabilitated with HUD assistance—</text>
					<clause id="idA20B0AA176514A4AB71D8B4D2B7E01A5"><enum>(i)</enum><text display-inline="yes-display-inline">require the structure to be not less than
			 30 percent more energy efficient than required by local residential and
			 commercial building codes regarding energy efficiency; and</text>
					</clause><clause id="id38CAAC9227374C23975FFC32934CFC47"><enum>(ii)</enum><text display-inline="yes-display-inline">require the structure to comply with such
			 additional energy efficiency requirements, standards, checklists, or rating
			 systems as the Secretary determines are applicable to nonresidential
			 structures.</text>
					</clause></subparagraph></paragraph><paragraph id="HAE7D83B67587407E82FC3794BA9E21C2"><enum>(7)</enum><header>Nonresidential
			 structures</header><text>The term <term>nonresidential structures</term> means
			 only nonresidential structures that are appurtenant to single family or
			 multifamily housing residential structures, or those that are funded by the
			 Secretary through the HUD Community Development Block Grant program established
			 under title I of the Housing and Community Development Act of 1974 (42 U.S.C.
			 5301 et seq.).</text>
			</paragraph><paragraph id="HBD1DE2AE1A2E4AE8B6106FA4D6C76C65"><enum>(8)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term>, unless otherwise specified, means the Secretary of
			 Housing and Urban Development.</text>
			</paragraph></section><section id="HB30C8DB0CCD34F84AAF76411C118D655"><enum>4.</enum><header>Implementation of
			 energy efficiency participation incentives for HUD programs</header><text display-inline="no-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the Secretary shall issue such regulations as may be
			 necessary to establish annual energy efficiency participation incentives to
			 encourage participants in programs administered by the Secretary, including
			 recipients under programs for which HUD assistance is provided, to achieve
			 substantial improvements in energy efficiency.</text>
		</section><section id="id0C098D25F0434FF7838FFBC45496F95E"><enum>5.</enum><header>Incentives for
			 energy efficient mortgages and location efficient mortgages</header>
			<subsection id="idC5E809247AE04F9F91F69233CA6C44E8"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">The Secretary shall
			 establish budget-neutral incentives for encouraging lenders to make, and
			 homebuyers and homeowners to participate in, energy efficient mortgages and
			 location efficient mortgages.</text>
			</subsection><subsection id="id375E95E8173443E1B4E852A0921A7898"><enum>(b)</enum><header>Incentives</header><text display-inline="yes-display-inline">The incentives required under subsection
			 (a) may include—</text>
				<paragraph id="idEE91247B098A448A81B8E4D00C15E145"><enum>(1)</enum><text display-inline="yes-display-inline">fee reductions;</text>
				</paragraph><paragraph id="id1C36F828C6424B68A990D67AFAB55461"><enum>(2)</enum><text display-inline="yes-display-inline">fee waivers;</text>
				</paragraph><paragraph id="id0DB0329ECB4D495A8857B21B4E2F86CE"><enum>(3)</enum><text display-inline="yes-display-inline">interest rate reductions; and</text>
				</paragraph><paragraph id="id60E50ADD26C640C7B79A5EBC5C71AE7B"><enum>(4)</enum><text>adjustment of
			 mortgage qualifications.</text>
				</paragraph></subsection><subsection id="id229D8FC5864F4102B97214A92B0CB051"><enum>(c)</enum><header>Additional
			 consideration</header><text display-inline="yes-display-inline">In establishing
			 the incentives required under subsection (a), the Secretary shall consider the
			 lower risk of default on energy efficient mortgages and location efficient
			 mortgages in comparison to mortgages that are not energy efficient or location
			 efficient.</text>
			</subsection><subsection id="id276527510C7447859211ADCB134286AA"><enum>(d)</enum><header>Definitions</header><text>The
			 terms <term>energy efficient mortgage</term> and <term>location efficient
			 mortgage</term> have the same meaning as in section 1335(e) of the Federal
			 Housing Enterprises Financial Safety and Soundness Act of 1992 (12 U.S.C.
			 4565(e)) (as added by section 8 of this Act).</text>
			</subsection></section><section id="H51A75701389C4C3EB9415EDC22C0BAE1"><enum>6.</enum><header>Mortgage
			 incentives for energy efficient multifamily housing</header>
			<subsection id="H9388FA4BADCF45D18FD3C0C2A9042FB8"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 establish—</text>
				<paragraph id="id2F4FE294E3E846EDB3E4235C2479E4AB"><enum>(1)</enum><text display-inline="yes-display-inline">incentives for increasing the energy
			 efficiency of multifamily housing that is subject to a mortgage to be insured
			 under title II of the National Housing Act (12 U.S.C. 1707 et seq.) so that
			 such housing meets minimum energy standards; and</text>
				</paragraph><paragraph id="id8B9BF922E802495FBF953BD8CFDBAEEC"><enum>(2)</enum><text display-inline="yes-display-inline">incentives to encourage compliance of such
			 housing with enhanced energy efficiency standards, to the extent that such
			 incentives are based on the impact that savings on utility costs have on the
			 operating costs of the housing, as determined by the Secretary.</text>
				</paragraph></subsection><subsection id="H77ED900D34404A6B9936C55D3D81CB53"><enum>(b)</enum><header>Incentives</header><text display-inline="yes-display-inline">The incentives required under subsection
			 (a) may include, for any such multifamily housing that meets minimum energy
			 efficiency standards—</text>
				<paragraph id="H7A3D478B23874A9BA14B13006580B923"><enum>(1)</enum><text>providing a
			 discount on the chargeable premiums for the mortgage insurance for such housing
			 from the amount otherwise chargeable for such mortgage insurance;</text>
				</paragraph><paragraph id="H2D867CD6E5AD421BB200E228C94D308E"><enum>(2)</enum><text display-inline="yes-display-inline">allowing mortgages to exceed the dollar
			 amount limits otherwise applicable under law to the extent such additional
			 amounts are used to finance improvements or measures designed to meet the
			 standards referred to in subsection (a); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF0E89D77D8484A399EFCE45B12F06C4"><enum>(3)</enum><text>reducing the amount
			 that the owner of such multifamily housing is required to contribute.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id8E01BDD3A9CA49CAACDAF3F38F785D3B"><enum>7.</enum><header>Energy
			 efficiency and conservation demonstration program for multifamily housing
			 projects assisted with project-based rental assistance</header>
			<subsection id="H0B3C4ABF5A69463C8FD66FAA6BAB700"><enum>(a)</enum><header>Authority</header>
				<paragraph id="id212DD1108D5E48FB92C527E50A171FEA"><enum>(1)</enum><header>In
			 General</header><text display-inline="yes-display-inline">For multifamily
			 housing projects for which project-based rental assistance is provided under a
			 covered multifamily assistance program, the Secretary shall, subject to the
			 availability of amounts provided in advance in appropriation Acts, carry out a
			 program to demonstrate the effectiveness of funding a portion of the costs of
			 meeting enhanced energy efficiency standards.</text>
				</paragraph><paragraph id="id178EBA46BE1D4AFDAB8444320DECA215"><enum>(2)</enum><header>Indian
			 housing</header><text display-inline="yes-display-inline">At the discretion of
			 the Secretary, the demonstration program required under paragraph (1) may
			 include incentives for housing that is assisted with Indian housing block
			 grants provided pursuant to the Native American Housing Assistance and
			 Self-Determination Act of 1996 (25 U.S.C. 4101 et seq.), but only to the extent
			 that such inclusion does not violate such Act, regulations promulgated pursuant
			 to such Act, and the goal of such Act of tribal self-determination.</text>
				</paragraph></subsection><subsection id="H13685A0B441F4BF6B714D08E15BCAC71"><enum>(b)</enum><header>Goals</header><text display-inline="yes-display-inline">The demonstration program under this
			 section shall be carried out in a manner that—</text>
				<paragraph id="HD94969A0448141CEBADC9CE200932D3E"><enum>(1)</enum><text>protects the
			 financial interests of the Federal Government;</text>
				</paragraph><paragraph id="H5648A379A02A4206BC9730CCCD157E59"><enum>(2)</enum><text>reduces the
			 proportion of funds provided by the Federal Government and by owners and
			 residents of multifamily housing projects that are used for costs of utilities
			 for such projects;</text>
				</paragraph><paragraph id="HF6572383FD0244DA920094975531C1F6"><enum>(3)</enum><text>encourages energy
			 efficiency and conservation by owners and residents of multifamily housing
			 projects and installation of renewable energy improvements, such as
			 improvements providing for use of solar, wind, geothermal, or biomass energy
			 sources;</text>
				</paragraph><paragraph id="H621252346A444CC8BE56A4EE40120059"><enum>(4)</enum><text>creates incentives
			 for project owners to carry out such energy efficiency renovations and
			 improvements by allowing a portion of the savings in operating costs resulting
			 from such renovations and improvements to be retained by the project owner,
			 notwithstanding otherwise applicable limitations on dividends;</text>
				</paragraph><paragraph id="id9EF613AE38054550982141EE74172646"><enum>(5)</enum><text>allows project
			 owners and tenants to share the savings in operating costs resulting from such
			 renovations and improvements in accordance with an appropriate ratio;</text>
				</paragraph><paragraph id="HC69142CBDD4D4C528C27A2471D16CE0"><enum>(6)</enum><text display-inline="yes-display-inline">promotes the installation, in existing
			 residential buildings, of energy efficient and cost-effective improvements and
			 renewable energy improvements, such as improvements providing for use of solar,
			 wind, geothermal, or biomass energy sources;</text>
				</paragraph><paragraph id="H943B401198EF473FB3154B09C7B216F"><enum>(7)</enum><text>tests the efficacy
			 of a variety of energy efficiency measures for multifamily housing projects of
			 various sizes and in various geographic locations;</text>
				</paragraph><paragraph id="H5D51F5BED8A041B8929102DEC044591C"><enum>(8)</enum><text>tests methods for
			 addressing the various, and often competing, incentives that impede owners and
			 residents of multifamily housing projects from working together to achieve
			 energy efficiency or conservation; and</text>
				</paragraph><paragraph id="HCD8E70E5BC0449BBAF329EC93983E629"><enum>(9)</enum><text>creates a database
			 of energy efficiency and conservation, and renewable energy, techniques, energy
			 savings management practices, and energy efficiency and conservation financing
			 vehicles.</text>
				</paragraph></subsection><subsection id="H87453E101ED34E879D63833608521CD6"><enum>(c)</enum><header>Approaches</header><text display-inline="yes-display-inline">In carrying out the demonstration program
			 under this section, the Secretary may take the following actions:</text>
				<paragraph id="H0375D831134B4B88AF33067041EAAFA1"><enum>(1)</enum><text display-inline="yes-display-inline">Enter into agreements with the Building
			 America Program of the Department of Energy and other consensus committees
			 under which such programs, partnerships, or committees assume some or all of
			 the functions, obligations, and benefits of the Secretary with respect to
			 energy savings.</text>
				</paragraph><paragraph id="H52B9F74D36E744D486E82681435D63E0"><enum>(2)</enum><text display-inline="yes-display-inline">Establish advisory committees to advise the
			 Secretary and any such third party partners on technological and other
			 developments in the area of energy efficiency and the creation of an energy
			 efficiency and conservation credit facility and other financing opportunities
			 that—</text>
					<subparagraph id="id56F60D03A9EA4C438C6F9A5ACFD21F60"><enum>(A)</enum><text display-inline="yes-display-inline">include representatives of homebuilders,
			 realtors, architects, nonprofit housing organizations, environmental protection
			 organizations, renewable energy organizations, State housing finance agencies,
			 and advocacy organizations for low-income individuals, the elderly, and persons
			 with disabilities; and</text>
					</subparagraph><subparagraph id="idE18EE0B10CC24B03AF4AFFD14CBD3E3D"><enum>(B)</enum><text display-inline="yes-display-inline">are not subject to the Federal Advisory
			 Committee Act (5 U.S.C. App.).</text>
					</subparagraph></paragraph><paragraph id="HEC0BC309D4BD4D468E1216D5E2A7C87C"><enum>(3)</enum><text>Develop a
			 competitive process for the award of such additional assistance for multifamily
			 housing projects seeking to implement energy efficiency, renewable energy
			 sources, or conservation measures.</text>
				</paragraph><paragraph id="HEF4D7240B8304D21976D76CDE545993B"><enum>(4)</enum><text display-inline="yes-display-inline">Waive or modify any existing Federal
			 regulatory provision that would otherwise impair the implementation or
			 effectiveness of the demonstration program under this section, including
			 provisions relating to methods for rent adjustments, comparability standards,
			 maximum rent schedules, and utility allowances. Notwithstanding the preceding
			 provisions of this paragraph, the Secretary may not waive any statutory
			 requirement relating to fair housing, nondiscrimination, labor standards, or
			 the environment, except pursuant to existing authority to waive nonstatutory
			 environmental and other applicable requirements.</text>
				</paragraph></subsection><subsection id="HBF1DDBFF9DB54DABB823F265DAEBF0E4"><enum>(d)</enum><header>Requirement</header><text display-inline="yes-display-inline">During the 4-year period beginning 12
			 months after the date of enactment of this Act, the Secretary shall carry out
			 demonstration programs under this section with respect to not fewer than 50,000
			 dwelling units.</text>
			</subsection><subsection id="H3EE45A7962D64E33A2783C60699DD19"><enum>(e)</enum><header>Selection</header>
				<paragraph id="H776A972B215247C0BE665C209822EACB"><enum>(1)</enum><header>Scope</header>
					<subparagraph id="idDB971370C54246BBA8684BB8346377B1"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In order to provide a
			 broad and representative profile for use in designing a program which can
			 become operational and effective nationwide, the Secretary shall carry out the
			 demonstration program under this section with respect to dwelling units located
			 in a wide variety of geographic areas and project types assisted by the various
			 covered multifamily assistance programs and using a variety of energy
			 efficiency and conservation and funding techniques to reflect differences in
			 climate, types of dwelling units, technical and scientific methodologies, and
			 financing options.</text>
					</subparagraph><subparagraph id="id79A38882104F4790ACA6360FF8A06DFE"><enum>(B)</enum><header>Indian
			 lands</header><text display-inline="yes-display-inline">The Secretary shall
			 ensure that the geographic areas included in the demonstration program under
			 this section include dwelling units on Indian lands (as that term is defined in
			 section 2601 of the Energy Policy Act of 1992 (25 U.S.C. 3501)), to the extent
			 that dwelling units on Indian land have the type of residential structures that
			 are the focus of the demonstration program.</text>
					</subparagraph></paragraph><paragraph id="HE4B14B3DE14345FE974092E6F5B2CD"><enum>(2)</enum><header>Priority</header><text display-inline="yes-display-inline">The Secretary shall provide priority for
			 selection for participation in the program under this section based on the
			 extent to which, as a result of assistance provided, the project will meet
			 minimum energy efficiency standards or enhanced energy efficiency
			 standards.</text>
				</paragraph></subsection><subsection id="H3CD8D72AC5C2406BB4D179197EA86984"><enum>(f)</enum><header>Use of existing
			 partnerships</header><text display-inline="yes-display-inline">To the extent
			 feasible, the Secretary shall—</text>
				<paragraph id="HB3F99F090A7A48359B4D956341A127DD"><enum>(1)</enum><text display-inline="yes-display-inline">utilize the Partnership for Advancing
			 Technology in Housing of the Department of Housing and Urban Development to
			 assist in carrying out the requirements of this section and to provide
			 education and outreach regarding the demonstration program authorized under
			 this section; and</text>
				</paragraph><paragraph id="H0DDF6C1367C143A181FBC9413B8D81DA"><enum>(2)</enum><text display-inline="yes-display-inline">consult with the Secretary of Energy, the
			 Administrator of the Environmental Protection Agency, and the Secretary of the
			 Army regarding utilizing the Building America Program of the Department of
			 Energy, the Energy Star Program, and the Army Corps of Engineers, respectively,
			 to determine the manner in which such programs might assist in carrying out the
			 goals of this section and providing education and outreach regarding the
			 demonstration program authorized under this section.</text>
				</paragraph></subsection><subsection id="H429209A9D0804844BEE2639DD580C871"><enum>(g)</enum><header>Reports</header>
				<paragraph id="HDDEB927DD7174D7499C9B30596F76D11"><enum>(1)</enum><header>Annual
			 report</header><text display-inline="yes-display-inline">Not later than 2 years
			 after the date of enactment of this Act, and for each year thereafter during
			 the term of the demonstration program, the Secretary shall submit to Congress a
			 report that describes and assesses the demonstration program under this
			 section.</text>
				</paragraph><paragraph id="H965DFD916C704C8CA84C50007EEDF542"><enum>(2)</enum><header>Final
			 report</header><text display-inline="yes-display-inline">Not later than 6
			 months after the expiration of the 4-year period described in subsection (d),
			 the Secretary shall submit to Congress a final report assessing the
			 demonstration program that—</text>
					<subparagraph id="H94C9284B98ED483294021B11EC25A104"><enum>(A)</enum><text>assesses the
			 potential for expanding the demonstration program on a nationwide basis;
			 and</text>
					</subparagraph><subparagraph id="H80368E39FE8042B89B3B228D82489EA1"><enum>(B)</enum><text>includes
			 descriptions of—</text>
						<clause id="HA2B47369D2A343EC8C5DFFB495A77E88"><enum>(i)</enum><text>the
			 size of each multifamily housing project for which assistance was provided
			 under the program;</text>
						</clause><clause id="H150871D5EAFE4ED9A6B764D3FBB0C453"><enum>(ii)</enum><text>the
			 geographic location of each project assisted, by State and region;</text>
						</clause><clause id="HAAB061DCDC71456B9B1BE8E7765C12A1"><enum>(iii)</enum><text>the criteria
			 used to select the projects for which assistance is provided under the
			 program;</text>
						</clause><clause id="H72A71E17CCD24FA3B756EDB3D5C3867"><enum>(iv)</enum><text>the
			 energy efficiency and conservation measures and financing sources used for each
			 project that is assisted under the program;</text>
						</clause><clause id="HCB2595DACF6C4BBE8825186223688B53"><enum>(v)</enum><text display-inline="yes-display-inline">the difference, before and during
			 participation in the demonstration program, in the amount of the monthly
			 assistance payments under the covered multifamily assistance program for each
			 project assisted under the program;</text>
						</clause><clause id="H9C3CDC4C35F54300A480D800D5484CBE"><enum>(vi)</enum><text>the
			 average length of the term of the assistance provided under the program for a
			 project;</text>
						</clause><clause id="HEFB01BDB8F58493E85654D424676F2D1"><enum>(vii)</enum><text>the aggregate
			 amount of savings generated by the demonstration program and the amount of
			 savings expected to be generated by the program over time on a per-unit and
			 aggregate program basis;</text>
						</clause><clause id="H433EAD48B046498F931CE6B348C6F314"><enum>(viii)</enum><text>the functions
			 performed in connection with the implementation of the demonstration program
			 that were transferred or contracted out to any third parties;</text>
						</clause><clause id="H10633E650E6A454782000000733D8302"><enum>(ix)</enum><text>an
			 evaluation of the overall successes and failures of the demonstration program;
			 and</text>
						</clause><clause id="H3CB42E69262547B5866800632D26D656"><enum>(x)</enum><text>recommendations
			 for any actions to be taken as a result of such successes and failures.</text>
						</clause></subparagraph></paragraph><paragraph id="H9361EC6918834900B36CA3BA747D003F"><enum>(3)</enum><header>Contents</header><text>Each
			 annual report pursuant to paragraph (1) and the final report pursuant to
			 paragraph (2) shall include—</text>
					<subparagraph id="HE65B0069397F44FDA8FB7073D62D8EC5"><enum>(A)</enum><text>a description of
			 the status of each multifamily housing project selected for participation in
			 the demonstration program under this section; and</text>
					</subparagraph><subparagraph id="H4C63983EF4A44A91A14CA97500588060"><enum>(B)</enum><text>findings from the
			 program and recommendations for any legislative actions.</text>
					</subparagraph></paragraph></subsection><subsection id="H7E8EE76393F447AE87E9011BF2F38701"><enum>(h)</enum><header>Covered
			 multifamily assistance program</header><text display-inline="yes-display-inline">For purposes of this section, the term
			 <quote>covered multifamily assistance program</quote> means—</text>
				<paragraph id="H1C4BB39F739D47B6BEC12FAAB1C215A3"><enum>(1)</enum><text display-inline="yes-display-inline">the program under section 8 of the United
			 States Housing Act of 1937 (42 U.S.C. 1437f) for project-based rental
			 assistance;</text>
				</paragraph><paragraph id="HC21D9A84E12F4DBE8F7499C74EB16B69"><enum>(2)</enum><text>the program under
			 section 202 of the Housing Act of 1959 (12 U.S.C. 1701q) for assistance for
			 supportive housing for the elderly;</text>
				</paragraph><paragraph id="H5E4CFA32306943899BBAE70005E376B5"><enum>(3)</enum><text>the program under
			 section 811 of the Cranston-Gonzalez National Affordable Housing Act (42 U.S.C.
			 8013) for supportive housing for persons with disabilities; and</text>
				</paragraph><paragraph id="HAC564E3BCA944F81941EC5EF55E3682"><enum>(4)</enum><text>the program for
			 assistance under the Native American Housing Assistance and Self-Determination
			 Act of 1996 (25 U.S.C. 4111).</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="HB32CD23740C04F49A12743936B0678F8"><enum>(i)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to carry out this section $50,000,000 for each
			 fiscal year in which the demonstration program under this section is carried
			 out.</text>
			</subsection><subsection id="H10C4607EF6AB4D15AE4255B12FECAC"><enum>(j)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the Secretary shall issue any regulations necessary to
			 carry out this section.</text>
			</subsection></section><section id="HB69E386ECF4249E1A7F7EFDB033B8D00"><enum>8.</enum><header>Additional credit
			 for Fannie Mae and Freddie Mac housing goals for energy efficient
			 mortgages</header><text display-inline="no-display-inline">Section 1336(a) of
			 the Housing and Community Development Act of 1992 (12 U.S.C. 4566(a)) is
			 amended—</text>
			<paragraph id="HE69ADE9C2089463EBE4D76408665D437"><enum>(1)</enum><text>in paragraph (2),
			 by striking <quote>paragraph (5)</quote> and inserting <quote>paragraphs (5)
			 and (6)</quote>; and</text>
			</paragraph><paragraph id="H0C22689B849E4AE3AD127616A7D24CD2"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block id="HC17F4E6B90154528B1ED5086B4DC8329" style="OLC">
					<paragraph id="H716FE6FFF4114B8B90C46062842F4B19"><enum>(6)</enum><header>Additional
				energy efficiency credit</header>
						<subparagraph id="HBD8AF9FE52CF447DAA2D578500A9EE23"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">In assigning credit
				toward achievement under this section of the housing goals for mortgage
				purchase activities of the enterprises, the Director shall assign—</text>
							<clause id="H16CDA6A5402C4BF3B83864E709A69EF4"><enum>(i)</enum><text display-inline="yes-display-inline">more than 125 percent credit, for purchases
				that—</text>
								<subclause id="HA1BA03C4B03847F8957D2240AC392EB2"><enum>(I)</enum><text>comply with the
				requirements of such goals; and</text>
								</subclause><subclause id="HF81508FABEE242E8A11DCDADCB0029EE"><enum>(II)</enum><text>support housing
				that meets minimum energy efficiency standards, as that term is defined in
				section 3 of the <short-title>Energy Efficiency in Housing
				Act of 2009</short-title>; and</text>
								</subclause></clause><clause id="H9ECAB5347598465BA7E000952B092D96"><enum>(ii)</enum><text display-inline="yes-display-inline">credit in addition to credit under clause
				(i), for purchases that—</text>
								<subclause id="HB9BFA6FE444E420C87E87CE05BEA7005"><enum>(I)</enum><text>comply with the
				requirements of such goals; and</text>
								</subclause><subclause id="H04964AAC571D4620AA96648C383364DD"><enum>(II)</enum><text>support housing
				that complies with enhanced energy efficiency standards, as that term is
				defined in section 3 of such Act.</text>
								</subclause></clause></subparagraph><subparagraph id="H41F377FAA1C6470CB0A8D8DFEFB35B5F"><enum>(B)</enum><header>Treatment of
				additional credit</header><text>The availability of additional credit under
				this paragraph shall not be used to increase any housing goal, subgoal, or
				target established under this
				subpart.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section display-inline="no-display-inline" id="H77832CA63AD1407586DC167D00FF71F9" section-type="subsequent-section"><enum>9.</enum><header>Duty to serve
			 underserved markets for energy efficient and location efficient
			 mortgages</header><text display-inline="no-display-inline">Section 1335 of the
			 Federal Housing Enterprises Financial Safety and Soundness Act of 1992 (12
			 U.S.C. 4565) is amended—</text>
			<paragraph id="H8E94E880EFB04FB39765AAEBADBC2395"><enum>(1)</enum><text>in subsection
			 (a)(1), by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H087B936AA9F9458A865C0033A36CC191" style="OLC">
					<subparagraph commented="no" id="H26EB2C4ACC194516819C2D2568EE8901"><enum>(D)</enum><header>Markets for
				energy efficient and location efficient mortgages</header>
						<clause commented="no" id="H467A1A552B104938B400B700B9434BE7"><enum>(i)</enum><header>Duty</header><text>Except
				as provided in clause (ii), the enterprise shall develop loan products and
				flexible underwriting guidelines to facilitate a secondary market for energy
				efficient and location efficient mortgages on housing for very low-, low-, and
				moderate-income families, and for second and junior mortgages made for purposes
				of energy efficiency or renewable energy improvements.</text>
						</clause><clause commented="no" id="H438B2F253E3D45E7B964516FDD9BE965"><enum>(ii)</enum><header>Authority to
				suspend</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of this section, the Director may suspend the applicability of
				the requirement under clause (i) with respect to an enterprise, for such period
				as is necessary, if the Director determines that exigent circumstances exist
				and such suspension is appropriate to ensure the safety and soundness of the

						</clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HFF79CF0C78DF4B00BBA65DBCCC81B9A7"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HA7CAC22A913D4EBFBD9951B8DEED2AE" style="OLC">
					<subsection id="H57288B537AC449F00000238F241C2865"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section, the following
				definitions shall apply:</text>
						<paragraph id="H0AF1929AF9C04EE480F3AE6D784B7477"><enum>(1)</enum><header>Energy efficient
				mortgage</header><text>The term <quote>energy efficient mortgage</quote> means
				a mortgage loan under which the income of the borrower, for purposes of
				qualification for such loan, is considered to be increased by—</text>
							<subparagraph id="id4CFAE9283D0541D9B5AF0DB8BEFBB02A"><enum>(A)</enum><text>not less than $1
				for each $1 of savings projected to be realized by the borrower as a result of
				cost-effective energy saving design, construction, or improvements (including
				use of renewable energy sources, such as solar, geothermal, biomass, and wind,
				superinsulation, energy-saving windows, insulating glass and film, and radiant
				barrier) for the home for which the loan is made; or</text>
							</subparagraph><subparagraph id="idC61BAA19C29B4C1EB881A1CBED2F4882"><enum>(B)</enum><text>a ratio of income
				to savings determined by the Director.</text>
							</subparagraph></paragraph><paragraph id="H4120DB72BA8042AA9556889393E463D9"><enum>(2)</enum><header>location
				efficient mortgage</header><text display-inline="yes-display-inline">The term
				<quote>location efficient mortgage</quote> means a mortgage loan under
				which—</text>
							<subparagraph id="HF0AD03FAADB14451A2DB265CA0E107E"><enum>(A)</enum><text display-inline="yes-display-inline">the income of the borrower, for purposes of
				qualification for such loan, is considered to be increased by—</text>
								<clause id="id5DE089E531F840218CEDF876EB2D0E52"><enum>(i)</enum><text display-inline="yes-display-inline">not less than $1 for each $1 of savings
				projected to be realized by the borrower because the location of the home for
				which the loan is made will result in decreased transportation costs for the
				household of the borrower; or</text>
								</clause><clause id="id49648788A261488BA4CB9EA345553B3E"><enum>(ii)</enum><text>a ratio of
				income to savings determined by the Director; or</text>
								</clause></subparagraph><subparagraph id="H6A73768BB18944CC9B3F4DF91B2F8F20"><enum>(B)</enum><text>the sum of the
				principal, interest, taxes, and insurance due under the mortgage loan is
				decreased by—</text>
								<clause id="id3C5357728A2A47BF908E818DB203F608"><enum>(i)</enum><text>not less than $1
				for each $1 of savings projected to be realized by the borrower because the
				location of the home for which loan is made will result in decreased
				transportation costs for the household of the borrower; or</text>
								</clause><clause id="id25ACC5DB9603470EB08EB3E88A4D1E0D"><enum>(ii)</enum><text>a ratio of
				principal, interest, taxes, and insurance due under the mortgage to savings
				projected to be realized by the borrower determined by the
				Director.</text>
								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section display-inline="no-display-inline" id="HA4ED7BF9308546AFAB0200D9DA9C017" section-type="subsequent-section"><enum>10.</enum><header>Consideration of
			 energy efficiency under FHA mortgage insurance programs and Native American and
			 Native Hawaiian loan guarantee programs</header>
			<subsection id="HDC8903A6B50E47D6ACEBC5F777FC7640"><enum>(a)</enum><header>FHA mortgage
			 insurance</header>
				<paragraph id="H9ABA9A1E60664BA5BF1000B3735A428"><enum>(1)</enum><header>Requirement</header><text display-inline="yes-display-inline">Title V of the National Housing Act is
			 amended by adding after section 542 (12 U.S.C. 1735f–20) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H77180430990B4FEAB756FBACB3008D73" style="OLC">
						<section id="HC4EA8130F1E44D9E9F5100F1A8316CD0"><enum>543.</enum><header>Consideration
				of energy efficiency</header>
							<subsection id="H6A3958CC9EDB4793BED1E77667FCA8DF"><enum>(a)</enum><header>Underwriting
				standards</header><text display-inline="yes-display-inline">In establishing
				underwriting standards for mortgages on single family housing that meets
				minimum energy efficiency standards, as that term is defined in section 3 of
				the <short-title>Energy Efficiency in Housing Act of
				2009</short-title>, that are insured under this Act, the Secretary shall
				consider the impact that savings on utility costs has on the income of the
				mortgagor.</text>
							</subsection><subsection id="HC565E042551D438FBFB1F69CC5F8824"><enum>(b)</enum><header>Goal</header><text>It
				is the sense of the Congress that, in carrying out this Act, the Secretary
				should endeavor to insure mortgages on single family housing that meets minimum
				energy efficiency standards, as that term is defined in section 3 of the
				<short-title>Energy Efficiency in Housing Act of
				2009</short-title>, such that at least 50,000 such mortgages are insured during
				the period beginning on the date of enactment of such Act and ending on
				December 31,
				2012.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H9E235C3E9ABF467F0054197BE2EBF680"><enum>(2)</enum><header>Reporting on
			 defaults</header><text>Section 540(b)(2) of the National Housing Act (12 U.S.C.
			 1735f–18(b)(2)) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H663734348ECF43098CF8C311002EF4EB" style="OLC">
						<subparagraph id="HA93545A5CA5840FFB5B1092F62607204"><enum>(C)</enum><text display-inline="yes-display-inline">With respect to each collection period that
				commences after December 31, 2011—</text>
							<clause id="idE05823D8A28E42548FB6AA33567C6EA4"><enum>(i)</enum><text display-inline="yes-display-inline">the total number of mortgages on single
				family housing that meets minimum energy efficiency standards, as that term is
				defined in section 3 of the <short-title>Energy Efficiency
				in Housing Act of 2009</short-title>, that are insured by the Secretary during
				the applicable collection period;</text>
							</clause><clause id="id2072962EE9104D22AA845570954F7CB7"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of defaults and foreclosures
				occurring on such mortgages during such period;</text>
							</clause><clause id="id74B2CB5201D54886B5566563A23D9B43"><enum>(iii)</enum><text display-inline="yes-display-inline">the percentage of the total of such
				mortgages insured during such period on which defaults and foreclosure
				occurred; and</text>
							</clause><clause id="idAA29C1F481FA4FFD87F8C36087D63BF9"><enum>(iv)</enum><text display-inline="yes-display-inline">the rate for such period of defaults and
				foreclosures on such mortgages compared to the overall rate for such period of
				defaults and foreclosures on mortgages for single family housing insured under
				this Act by the
				Secretary.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="HD123D309773A4711936054005562FFE9"><enum>(b)</enum><header>Indian housing
			 loan guarantees</header>
				<paragraph id="H3D1C3D3016B341E685DAE7338B12ACB7"><enum>(1)</enum><header>Requirement</header><text display-inline="yes-display-inline">Section 184 of the Housing and Community
			 Development Act of 1992 (12 U.S.C. 1715z–13a) is amended—</text>
					<subparagraph id="HEA5038B8493149FAA84582F4A70CD5E"><enum>(A)</enum><text>by redesignating
			 subsection (l) as subsection (m); and</text>
					</subparagraph><subparagraph id="H4B81DFD4CCDE455B00D494D9E4E8F12"><enum>(B)</enum><text>by inserting after
			 subsection (k) the following:</text>
						<quoted-block display-inline="no-display-inline" id="HB3BFBDB15475476383D98F000049B476" style="OLC">

				savings on utility costs has on the portion of the income of the borrower that
				is available to service the mortgage
				debt.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H6603C8AF6AAA4D2D833B4E529218AA95"><enum>(2)</enum><header>Reporting on
			 defaults</header><text display-inline="yes-display-inline">Section 540(b)(2) of
			 the National Housing Act (12 U.S.C. 1735f–18(b)(2)), as amended by subsection
			 (a)(2) of this section, is amended by adding at the end the following:</text>

							</clause><clause id="idC781AA7AEE4A4396B6FDE3D3E22C318A"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of defaults and foreclosures
				that occur on such loans during such period;</text>
							</clause><clause id="idF32F43C4086D4B43920402CC0917C2BE"><enum>(iii)</enum><text display-inline="yes-display-inline">the percentage of the total number of such
				loans guaranteed during such period on which defaults and foreclosures
				occurred; and</text>
							</clause><clause id="idE06776940F4246228FA5BAA4C6D1E510"><enum>(iv)</enum><text display-inline="yes-display-inline">the rate for such period of defaults and
				foreclosures on such loans compared to the overall rate for such period of
				defaults and foreclosures on loans for single family housing guaranteed under
				section 184 of such
				Act.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="H627B2956D93B499588171EF31E31061D"><enum>(c)</enum><header>Native Hawaiian
			 housing loan guarantees</header>
				<paragraph id="H4E3624F4324D4833ACB5C541FB34396B"><enum>(1)</enum><header>Requirement</header><text display-inline="yes-display-inline">Section 184A of the Housing and Community
			 Development Act of 1992 (12 U.S.C. 1715z–13b) is amended by adding at the end
			 the following:</text>
					<quoted-block display-inline="no-display-inline" id="HE6420D25BA3D4D93A91532D8F5D3877E" style="OLC">
						<subsection id="HA0B4A21BF86348679B2C00ADA0A34D00"><enum>(m)</enum><header>energy efficient
				housing requirement</header><text display-inline="yes-display-inline">The
				Secretary shall establish a method to consider, in its underwriting standards
				for loans for single family housing that meets minimum energy efficiency
				standards, as that term is defined in section 3 of the

						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H69740A48320D4FFC9FD0004822583348"><enum>(2)</enum><header>Reporting on
			 defaults</header><text display-inline="yes-display-inline">Section 540(b)(2) of
			 the National Housing Act (12 U.S.C. 1735f–18(b)(2)), as amended by the
			 preceding provisions of this section, is amended by adding at the end the
			 following:</text>

				2009</short-title>, that are guaranteed by the Secretary during the applicable
				collection period;</text>
							</clause><clause id="id8371E3BA36FF427DB2BF4EC25010B387"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of defaults and foreclosures
				occurring on such loans during such period;</text>
							</clause><clause id="id92614B50FF154F15A5EAB73064FD718E"><enum>(iii)</enum><text display-inline="yes-display-inline">the percentage of the total of such loans
				guaranteed during such period on which defaults and foreclosures occurred;
				and</text>
							</clause><clause id="id8855C98F48404860B88F6DEDA54B6A63"><enum>(iv)</enum><text display-inline="yes-display-inline">the rate for such period of defaults and
				foreclosures on such loans compared to the overall rate for such period of
				defaults and foreclosures on loans for single family housing guaranteed under
				such section
				184A.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="HA019F73B476A4786A4247D48F900469E"><enum>11.</enum><header>Energy efficient
			 mortgages education and outreach campaign</header><text display-inline="no-display-inline">Section 513 of the Housing and Community
			 Development Act of 1992 (12 U.S.C. 1701z–16 note) is amended by adding at the
			 end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HE3CA4228BAA64273A9E7578986FAB000" style="OLC">
				<subsection id="HF401E93268334913A658E750D93E3F88"><enum>(g)</enum><header>Education and
				outreach campaign</header>
					<paragraph id="H92BCDBD73F8A476FAA685B615D442C29"><enum>(1)</enum><header>Development of
				energy efficient mortgage outreach program</header>
						<subparagraph id="H65728E2A2E0E4273916BAB33C4D12C6F"><enum>(A)</enum><header>Commission</header><text display-inline="yes-display-inline">The Secretary, in consultation and
				coordination with the Secretary of Energy, the Secretary of Education, the
				Secretary of Agriculture, and the Administrator of the Environmental Protection
				Agency, shall establish a commission to develop and recommend model mortgage
				products and underwriting guidelines that provide market-based incentives to
				prospective home buyers, lenders, and sellers to incorporate energy efficiency
				upgrades in new mortgage loan transactions.</text>
						</subparagraph><subparagraph id="H5462908A92E7405500A6B73B136B2EEB"><enum>(B)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 24 months after the date of
				enactment of this subsection, the Secretary shall submit to Congress a written
				report on the results of work of the commission established pursuant to
				subparagraph (A) and that identifies model mortgage products and underwriting
				guidelines that may encourage energy efficiency.</text>
						</subparagraph></paragraph><paragraph id="H6F09973D3D2D40F0A2281512DEB1D306"><enum>(2)</enum><header>Implementation</header>
						<subparagraph id="idBF125FD4B8574A2BB53E1652965BF85E"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">After submission of
				the report under paragraph (1)(B), the Secretary, in consultation and
				coordination with the Secretary of Energy, the Secretary of Education, and the
				Administrator of the Environmental Protection Agency, shall carry out a public
				awareness, education, and outreach campaign based on the findings of the
				commission established pursuant to paragraph (1) to inform and educate
				residential lenders and prospective borrowers regarding the availability,
				benefits, advantages, and terms of—</text>
							<clause id="id9CCA9AC3747F4A9FA7DBC16763B0559B"><enum>(i)</enum><text display-inline="yes-display-inline">energy efficient mortgages made available
				pursuant to this section;</text>
							</clause><clause id="idAC21F226378F498F882688ABB8353F1D"><enum>(ii)</enum><text display-inline="yes-display-inline">energy efficient mortgages that meet the
				requirements of section 1334A of this Act; and</text>
							</clause><clause id="id3BEC0AA2E5644F2FBEFD8AC85C251182"><enum>(iii)</enum><text display-inline="yes-display-inline">other mortgages, including mortgages for
				multifamily housing, that have energy improvement features.</text>
							</clause></subparagraph><subparagraph id="id1AF27E8F7F594725BA2F448EABC7F1FB"><enum>(B)</enum><header>Contracting</header><text display-inline="yes-display-inline">The Secretary may enter into a contract
				with an appropriate entity to publicize and market such mortgages through
				appropriate media.</text>
						</subparagraph></paragraph><paragraph id="H5DB5AB41C5A8455E00E0B7A48532BBE"><enum>(3)</enum><header>Renewable energy
				home product expositions</header><text display-inline="yes-display-inline">It
				is the sense of Congress that the Secretary of Housing and Urban Development
				should work with appropriate entities to organize and hold renewable energy
				expositions that provide an opportunity for the public to view and learn about
				renewable energy products for the home that are currently on the market.</text>
					</paragraph><paragraph id="id0BA0135A67AB4CD1BF403EC381508DA6"><enum>(4)</enum><header>Authorization
				of appropriations</header><text display-inline="yes-display-inline">There is
				authorized to be appropriated to the Secretary to carry out this subsection
				$5,000,000 for each of fiscal years 2010 through
				2013.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H2D7A0CF07CD245B5BFAA19E4F4249E3C"><enum>12.</enum><header>Collection of
			 information on energy efficient and location efficient mortgages through Home
			 Mortgage Disclosure Act</header>
			<subsection id="H3503306FE595487596885FEF1D531496"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 304(b)(1) of
			 the Home Mortgage Disclosure Act of 1975 (12 U.S.C. 2803(b)(1)) is
			 amended—</text>
				<paragraph id="H42FAB1D519834F62A7134DB8EC50192E"><enum>(1)</enum><text>in paragraph (3),
			 by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="HCAA8F40B9AD943DF93A72BAC9C21585"><enum>(2)</enum><text>in
			 paragraph (4), by striking the period at the end and inserting a semicolon;
			 and</text>
				</paragraph><paragraph id="H813D0B9C64BE4EE0AB1FCE1179D28BB5"><enum>(3)</enum><text>by adding at the

				efficient mortgages (as such term is defined in section 1334A of the Housing

						</paragraph><paragraph id="HCE8639895C1345809E812365F875A924"><enum>(6)</enum><text display-inline="yes-display-inline">the number and dollar amount of mortgage
				loans for single family housing and for multifamily housing that are location
				efficient mortgages (as such term is defined in section 1334A of Housing and
				Community Development Act of
				1992).</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H5E0A1F6CCB974546B2FEFE96D6F39708"><enum>(b)</enum><header>Applicability</header><text>The
			 amendment made by subsection (a) shall apply with respect to the first calendar
			 year that begins after the expiration of the 30-day period beginning on the
			 date of enactment of this Act.</text>
			</subsection></section><section id="H1997D3782BFB4219A2F204D19092523B"><enum>13.</enum><header>Energy
			 efficiency certifications for housing with mortgages insured by
			 FHA</header><text display-inline="no-display-inline">Section 526 of the
			 National Housing Act (12 U.S.C. 1735f–4(a)) is amended—</text>
			<paragraph id="H3C176664A68B4C84961929290000518E"><enum>(1)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="H93D0CACB1583411EA7800829266168BD"><enum>(A)</enum><text>by striking
			 <quote>, other than manufactured homes,</quote> each place that term
			 appears;</text>
				</subparagraph><subparagraph id="H6F75082F32F64E859EFA5EFF4B84BE05"><enum>(B)</enum><text>by inserting after
			 the period at the end the following: <quote>The energy performance requirements
			 developed and established by the Secretary under this section for manufactured
			 homes shall require Energy Star ratings for wall fixtures, appliances, and
			 equipment in such homes.</quote>;</text>
				</subparagraph><subparagraph id="H344E205F70D74F56BC8F01FEF44FC865"><enum>(C)</enum><text display-inline="yes-display-inline">by striking <quote>(a) To</quote> and
			 inserting the following:</text>

			 end the following:</text>
					<quoted-block id="H13C7DFCAC3FD4DA09160EFFF4DAAFC47" style="OLC">
						<paragraph id="HD0E8865664804585AA5F11C916AD0874"><enum>(2)</enum><header>Certification</header><text display-inline="yes-display-inline">The Secretary shall require, with respect
				to any single family or multifamily residential housing subject to a mortgage
				insured under this Act, that any approval or certification of the housing for
				meeting any energy efficiency or conservation criteria, standards, or
				requirements pursuant to this title and any approval or certification required
				pursuant to this title with respect to energy conserving improvements or any
				renewable energy sources, such as wind, solar energy, geothermal, or biomass,
				shall be conducted only by an individual certified by a home energy rating
				system provider that has been accredited to conduct such ratings by the Home
				Energy Ratings System Council, the Residential Energy Services Network, or such
				other appropriate national organization, as the Secretary may provide, or by a
				licensed professional architect or engineer that has been accredited as a LEED
				Accredited Professional by the Green Building Certification Institute. If any
				organization makes a request to the Secretary for approval to accredit
				individuals to conduct energy efficiency or conservation ratings, the Secretary
				shall review and approve or disapprove such request not later than 6 months
				after receipt of such request.</text>
						</paragraph><paragraph id="id9BD90C8BE5324C2597984DBED04B3041"><enum>(3)</enum><header>Listing</header><text>Each
				regional office of the Department of Housing and Urban Development shall
				maintain a list of individuals certified by a home energy rating system
				provider that has been accredited to conduct such ratings by the Home Energy
				Ratings System Council, the Residential Energy Services Network, or such other
				appropriate national organizations or professionals as the Secretary may
				designate. Such list shall indicate that home energy rating system providers
				accredited by the Residential Energy Services Network are preferred by the
				Department of Housing and Urban Development.</text>
						</paragraph><paragraph id="HC874D4F0BA2C4CCB8EDEF8694EA4E116"><enum>(4)</enum><header>Periodic
				Examination of Method</header><text>The Secretary shall periodically examine
				the method used to conduct inspections for compliance with the requirements
				under this section, analyze various other approaches for conducting such
				inspections, and review the costs and benefits of the current method compared
				with other methods.</text>

				</subparagraph></paragraph><paragraph commented="no" id="HC7ACA2EA37454B9691570321C0EC3F45"><enum>(2)</enum><text>in subsection

				Safety</header><text>The</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section><section id="HA6062A915ED141518F66556DA2E6FC9E"><enum>14.</enum><header>Assisted housing
			 energy loan pilot program</header>
			<subsection id="H55E88B33F4884744A9D8A65690676A7"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">Not later than 12 months after the date of
			 enactment of this Act, the Secretary shall develop and implement a pilot
			 program to facilitate the financing of cost-effective capital improvements for
			 covered assisted housing projects to improve the energy efficiency and
			 conservation of such projects.</text>
			</subsection><subsection id="id3FF58EC6B9234DF6AD97D6E7E55C5A8C"><enum>(b)</enum><header>Number of
			 lenders</header><text>The pilot program under this section shall involve not
			 less than 3 and not more than 5 lenders.</text>
			</subsection><subsection id="HA621532D7B5340D39D51F95DF674E62F"><enum>(c)</enum><header>Loans</header><text display-inline="yes-display-inline">The pilot program under this section shall
			 provide for a privately financed loan to be made for a covered assisted housing
			 project that—</text>
				<paragraph id="H1CFC3701BB8C48CC9EAEA426308B7F44"><enum>(1)</enum><text display-inline="yes-display-inline">finances capital improvements for the
			 project that meet such requirements as the Secretary shall establish, and may
			 involve contracts with third parties to perform such capital improvements,
			 including the design of such improvements by licensed professional architects
			 or engineers;</text>
				</paragraph><paragraph id="HB22749B0672046848F61D264782D4415"><enum>(2)</enum><text>has a term to
			 maturity that is—</text>
					<subparagraph id="id2E9875B146F44D20A63AAFAE0015AA55"><enum>(A)</enum><text>not more than 20
			 years; and</text>
					</subparagraph><subparagraph id="idB99DCD8CDC5A42949B7D32E4C0DD2FD5"><enum>(B)</enum><text>necessary to
			 realize cost savings sufficient to repay such loan;</text>
					</subparagraph></paragraph><paragraph id="H2CD1E34F696E44A3AF6E3DBADA6C31E"><enum>(3)</enum><text>is
			 secured by a mortgage subordinate to the mortgage for the project that is
			 insured under title II of the National Housing Act; and</text>
				</paragraph><paragraph id="H70CA2EE02852401C9CE91A912432E56"><enum>(4)</enum><text>provides for a
			 reduction in the remaining principal obligation under the loan based on the
			 actual cost savings realized from the capital improvements financed with the
			 loan.</text>
				</paragraph></subsection><subsection id="H22668E883CA941068D46C7E17521947C"><enum>(d)</enum><header>Underwriting
			 standards</header><text>The Secretary shall establish underwriting requirements
			 for loans made under the pilot program under this section, which shall—</text>
				<paragraph id="H6AB07FB4FEC64F1F946F1FFB2B008820"><enum>(1)</enum><text>require the cost
			 savings projected to be realized from the capital improvements financed with
			 the loan, during the term of the loan, to exceed the costs of repaying the
			 loan;</text>
				</paragraph><paragraph id="H4845A147096043BCBC572F1F63DCB5FA"><enum>(2)</enum><text>allow the designer
			 or contractor involved in designing capital improvements to be financed with a
			 loan under the program to carry out such capital improvements; and</text>
				</paragraph><paragraph id="H381E176408154FAE828B34D47400321F"><enum>(3)</enum><text>include such
			 energy, audit, property, financial, ownership, and approval requirements as the
			 Secretary considers appropriate.</text>
				</paragraph></subsection><subsection id="HE4688FFCCBD84A3990DB00DDFD28B04"><enum>(e)</enum><header>Treatment of
			 savings</header><text>The pilot program under this section shall provide that
			 the financial benefit from any reduction in the cost of utilities resulting
			 from capital improvements financed with a loan made under the program shall be
			 shared between the project owner and the tenants in accordance with an
			 appropriate ratio, as determined by the Secretary.</text>
			</subsection><subsection id="H5FD067A4F5D445BFA9A436753DF89EF1"><enum>(f)</enum><header>Covered assisted
			 housing projects</header><text>For purposes of this section, the term
			 <quote>covered assisted housing project</quote> means a housing project
			 that—</text>
				<paragraph id="HD0446990F5CC41E2AA41DB374D9CB3C4"><enum>(1)</enum><text>is financed by a
			 loan or mortgage that is—</text>
					<subparagraph id="H7F0E8DD690604CB4A23CB94B45D2C514"><enum>(A)</enum><text>insured by the
			 Secretary under paragraph (3) or (4) of section 221(d) of the National Housing
			 Act (12 U.S.C. 1715l(d)), and bears interest at a rate determined under the
			 proviso of section 221(d)(5) of such Act; or</text>
					</subparagraph><subparagraph id="H55EC2B70C5A14726A813B4008B9B65B"><enum>(B)</enum><text>insured or assisted
			 under section 236 of the National Housing Act (12 U.S.C. 1715z–1);</text>
					</subparagraph></paragraph><paragraph id="H36EECAD36B8840CFA6DD9BB4C8006D1C"><enum>(2)</enum><text>at the time a loan
			 under this section is made, is provided project-based rental assistance under
			 section 8 of the United States Housing Act of 1937 (42 U.S.C. 1437f) for 50
			 percent or more of the dwelling units in the project; and</text>
				</paragraph><paragraph id="HF39A34AF52414AFFA4654CFB52322BE6"><enum>(3)</enum><text>is not a housing
			 project owned or held by the Secretary, or subject to a mortgage held by the
			 Secretary.</text>
				</paragraph></subsection></section><section id="HB554527E79084E4CBEB9CED64B151077"><enum>15.</enum><header>HOPE VI green
			 developments requirement</header>
			<subsection id="H7D688DE3F0C44D5ABEFFD0679DF2E62"><enum>(a)</enum><header>Mandatory
			 component</header><text display-inline="yes-display-inline">Section 24(e) of
			 the United States Housing Act of 1937 (42 U.S.C. 1437v(e)) is amended by adding
			 at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H37A8C7FA386E45CC97FAE2C3FAC188C" style="OLC">
					<paragraph id="HC66462B01A69437B9BED8BB05D365D00"><enum>(4)</enum><header>Green
				developments requirement</header>
						<subparagraph id="H1668F790C99245F0B1A67CFCBE507439"><enum>(A)</enum><header>Requirement</header><text display-inline="yes-display-inline">The Secretary may not make a grant under
				this section to an applicant unless the proposed revitalization plan of the
				applicant to be carried out with such grant amounts meets the following
				requirements:</text>
							<clause id="HE881B5F64616430DB52CDD68F6D28BAB"><enum>(i)</enum><header>Residential
				construction</header><text>All residential construction under the proposed plan
				complies with—</text>
								<subclause id="id72B9AEF449C04D75A24C809FBA7765A9"><enum>(I)</enum><text>all mandatory
				items of the national Green Communities criteria checklist for residential
				construction and rehabilitation and such nonmandatory items of such checklist
				as are necessary for a residential construction to receive—</text>
									<item id="H94D65F0D29424F729D52BF5CF35BC078"><enum>(aa)</enum><text>25
				points, in the case of any proposed plan (or portion thereof) consisting of new
				construction; and</text>
									</item><item id="H1E3950625CD54546BC621D8E470079D8"><enum>(bb)</enum><text>20
				points, in the case of any proposed plan (or portion thereof) consisting of
				rehabilitation; or</text>
									</item></subclause><subclause id="idE7B31D00F5D04D8B8E6FC8B37746411A"><enum>(II)</enum><text>a substantially
				equivalent standard, as determined by the Secretary.</text>
								</subclause></clause><clause id="H4078B4F799D4429900EF9FDE5F12D200"><enum>(ii)</enum><header>Nonresidential
				construction</header><text>All nonresidential construction under the proposed
				plan complies with all minimum required levels of the green building rating
				systems and levels identified by the Secretary pursuant to subparagraph (C), as
				such systems and levels are in effect at the time of the application for the
				grant.</text>
							</clause></subparagraph><subparagraph id="H8B7F0E95F5A6400D00A6C000E10910E0"><enum>(B)</enum><header>Verification</header>
							<clause id="HC0D67F876B534477A6E75C0899410043"><enum>(i)</enum><header>In
				general</header><text>The Secretary shall verify, or provide for verification
				sufficient to ensure, that each revitalization plan carried out with amounts
				from a grant under this section complies with the requirements under
				subparagraph (A).</text>
							</clause><clause id="HCDA382167C2F4C9600A2EBBF20E83D34"><enum>(ii)</enum><header>Timing</header><text>In
				providing for such verification, the Secretary shall establish procedures to
				ensure such compliance with respect to each grantee, and shall submit a report
				to Congress with respect to the compliance of each grantee—</text>
								<subclause id="H7742CDFFE3EA4F65A2C2DDA3AE3D5D4B"><enum>(I)</enum><text>not later than 6
				months after execution of the grant agreement under this section for the
				grantee; and</text>
								</subclause><subclause id="H6932775F1E6545C1B149B1D656E5E7D5"><enum>(II)</enum><text>on completion of
				the revitalization plan of the grantee.</text>
								</subclause></clause></subparagraph><subparagraph id="HB2344F84F3554D10BC6BD14D241168F"><enum>(C)</enum><header>Identification of
				green buildings rating systems and levels</header>
							<clause id="HDBBED4C5E60D4857B34BD5662BF2F8AA"><enum>(i)</enum><header>In
				general</header><text>For purposes of this paragraph, the Secretary, in
				consultation with the Secretary of Energy, shall identify rating systems and
				levels for green buildings that the Secretary determines to be the most likely
				to encourage a comprehensive and environmentally sound approach to ratings and
				standards for green buildings.</text>
							</clause><clause id="H0D34DC6EA56143B0888032DD9B055936"><enum>(ii)</enum><header>Criteria</header><text>In
				identifying the green rating systems and levels under clause (i), the Secretary
				shall take into consideration—</text>
								<subclause id="HF008B456750B485B8D2E4EF2BF00C486"><enum>(I)</enum><text>the ability and
				availability of assessors and auditors to independently verify the criteria and
				measurement of metrics at the scale necessary to implement this
				paragraph;</text>
								</subclause><subclause id="HFF3B992C5D5840CAA100C238BAB264"><enum>(II)</enum><text>the ability of the
				applicable ratings system organizations to collect and reflect public
				comment;</text>
								</subclause><subclause id="HAE6E811709644BFF9222185DFAF54712"><enum>(III)</enum><text>the ability of
				the standards to be developed and revised through a consensus-based
				process;</text>
								</subclause><subclause id="HF995D3DE1EE84D7D828851C33EB7FE00"><enum>(IV)</enum><text display-inline="yes-display-inline">an evaluation of the robustness of the
				criteria for a high-performance green building, which shall give credit for
				promoting—</text>
									<item id="HEB0CFE7DE1DB43F40029915D5DD9BEEA"><enum>(aa)</enum><text>efficient and
				sustainable use of water, energy, and other natural resources;</text>
									</item><item id="HD7487349595348F7927FC9778831ACCE"><enum>(bb)</enum><text>use
				of renewable energy sources;</text>
									</item><item id="HDF16ADBF331E4EA79D81D5F7D8A55035"><enum>(cc)</enum><text display-inline="yes-display-inline">improved indoor and outdoor environmental
				quality through enhanced indoor and outdoor air quality, thermal comfort,
				acoustics, outdoor noise pollution, day lighting, pollutant source control,
				sustainable landscaping, and use of building system controls and low- or
				no-emission materials, including preference for materials with no added
				carcinogens that are classified as Group 1 Known Carcinogens by the
				International Agency for Research on Cancer; and</text>
									</item><item id="H74482B2CF5E245C3BDDEE91511727F65"><enum>(dd)</enum><text>such other
				criteria as the Secretary determines to be appropriate; and</text>
									</item></subclause><subclause id="HBE2BCC1D14964638A596DEA11C35E1E2"><enum>(V)</enum><text>national
				recognition within the building industry.</text>
								</subclause></clause><clause id="HA12195F8E72041868BCA1512106C4E"><enum>(iii)</enum><header>Five-year
				evaluation</header><text>At least once every 5 years, the Secretary shall
				conduct a study to evaluate and compare available third party green building
				rating systems and levels, taking into account the criteria listed in clause
				(ii).</text>
							</clause><clause id="idA0ED9F30D35543858A2FF8BAB4F9EA3C"><enum>(iv)</enum><header>Review and
				update</header><text>Within 90 days of the completion of each study required by
				clause (iii), the Secretary shall review and update the rating systems and
				levels, or identify alternative systems and levels for purposes of this
				paragraph, taking into account the conclusions of such study.</text>
							</clause></subparagraph><subparagraph id="HA0E8661D1893427AB08B6FA87E15193F"><enum>(D)</enum><header>Applicability
				and updating of standards</header>
							<clause id="H8E1241F172AD46F9AC28F89044032168"><enum>(i)</enum><header>Applicability</header><text>Except
				as provided in clause (ii), the national Green Communities criteria checklist
				and green building rating systems and levels referred to in subparagraph (A)
				that are in effect for purposes of this paragraph are such checklist systems
				and levels as in existence on the date of enactment of the
				<short-title>Energy Efficiency in Housing Act of
				2009</short-title>.</text>
							</clause><clause id="H10BC6D8ACB6C4C80AE0085F1E529D4D7"><enum>(ii)</enum><header>Updating</header><text>The
				Secretary may, by regulation, adopt and apply for purposes of this paragraph,
				future amendments and supplements to, and editions of, the national Green
				Communities criteria checklist, any standard or standards that the Secretary
				has determined to be substantially equivalent to such checklist, and the green
				building ratings systems and levels identified by the Secretary pursuant to
				subparagraph
				(C).</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HBD884B513B574518AA2B188E17E460B8"><enum>(b)</enum><header>Selection
			 criteria; graded component</header><text>Section 24(e)(2) of the United States
			 Housing Act of 1937 (42 U.S.C. 1437v(e)(2)) is amended—</text>
				<paragraph id="H26420D493A8847B588AD1DACD73ED503"><enum>(1)</enum><text>in subparagraph
			 (K), by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="H58A227A8C112461C87C3849F37C00E2"><enum>(2)</enum><text>by
			 redesignating subparagraph (L) as subparagraph (M); and</text>
				</paragraph><paragraph id="H004642498E5F439500ADF740FEBF78BD"><enum>(3)</enum><text>by inserting after
			 subparagraph (K) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H170A4586A8384A8AAC8B869F6E0666EB" style="OLC">
						<subparagraph id="H5FBC4CC8ABC946C5B3AAC85B6F76C15F"><enum>(L)</enum><text display-inline="yes-display-inline">the extent to which the proposed
				revitalization plan—</text>
							<clause id="H7ADEB71DC2A94AE7941BF757CFF6F1E"><enum>(i)</enum><text>in
				the case of residential construction, complies with the nonmandatory items of
				the national Green Communities criteria checklist identified in paragraph
				(4)(A)(i), or any substantially equivalent standard or standards as determined
				by the Secretary, but only to the extent such compliance exceeds the compliance
				necessary to accumulate the number of points required under such paragraph;
				and</text>
							</clause><clause id="HFB75ABFE191A40708300A63BD4CB359F"><enum>(ii)</enum><text>in the case of
				nonresidential construction, complies with the components of the green building
				rating systems and levels identified by the Secretary pursuant to paragraph
				(4)(C), but only to the extent such compliance exceeds the minimum level
				required under such systems and levels;
				and</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H7D468F0839D34044BA29CD4F292C94DB"><enum>16.</enum><header>Consideration of
			 energy efficiency improvements in appraisals</header>
			<subsection id="HF26389D1A0914FA2A69655822714C5D9"><enum>(a)</enum><header>Appraisals in
			 connection with federally related transactions</header>
				<paragraph id="HD9B45B9E08094799A697B8B349CF9C4F"><enum>(1)</enum><header>Requirement</header><text display-inline="yes-display-inline">Section 1110 of the Financial Institutions
			 Reform, Recovery, and Enforcement Act of 1989 (12 U.S.C. 3339) is
			 amended—</text>
					<subparagraph id="H5102D54804004BD281E17155351FF300"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="H1BEA9FC1FA534497905B041983758BCA"><enum>(B)</enum><text>by redesignating
			 paragraph (2) as paragraph (3); and</text>
					</subparagraph><subparagraph id="H5ED59BA19A704C4AA1A0707328E9727"><enum>(C)</enum><text>by inserting after

				accordance with appraisal standards that require, in determining the value of a
				property, consideration of the ongoing utility savings and increased value from
				the savings that result from—</text>
								<subparagraph id="idFF5F27573D9946239D3C6635621D03C2"><enum>(A)</enum><text display-inline="yes-display-inline">any renewable energy sources for the
				property; or</text>
								</subparagraph><subparagraph id="idB2D56AFCB2C943BDB4C80E3A1DE3DED5"><enum>(B)</enum><text display-inline="yes-display-inline">energy efficiency or energy conserving
				improvements or features of the property;
				and</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H3814DCB4CE41438400ACB30972667657"><enum>(2)</enum><header>Revision of
			 appraisal standards</header><text display-inline="yes-display-inline">Each
			 Federal financial institution regulatory agency shall, not later than 6 months
			 after the date of enactment of this Act, revise its standards for the
			 performance of real estate appraisals in connection with federally related
			 transactions under the jurisdiction of the agency to comply with the
			 requirement under the amendments made by paragraph (1).</text>
				</paragraph></subsection><subsection id="H58E75C9C5A804D8E89C767C51CF6A9B2"><enum>(b)</enum><header>Appraiser
			 certification and licensing requirements</header><text display-inline="yes-display-inline">Section 1116 of the Financial Institutions
			 Reform, Recovery, and Enforcement Act of 1989 (12 U.S.C. 3345) is
			 amended—</text>
				<paragraph id="HB6D1D7DBE7474E8483E94FA275118EE7"><enum>(1)</enum><text>in subsection (a),
			 by inserting before the period at the end the following: <quote>and meets the
			 requirements established pursuant to subsection (f) for qualifications
			 regarding consideration of any renewable energy sources for, or energy
			 efficiency or energy conserving improvements or features of, the
			 property</quote>;</text>
				</paragraph><paragraph id="H5DC254C9F14A4A369E28ECC815B9D52E"><enum>(2)</enum><text>in subsection (c),
			 by inserting before the period at the end the following: <quote>, which shall
			 include compliance with the requirements established pursuant to subsection (f)
			 regarding consideration of any renewable energy sources for, or energy
			 efficiency or energy conserving improvements or features of, the
			 property</quote>;</text>
				</paragraph><paragraph commented="no" id="H7C5A15A108CC43908B2534246D4FFF63"><enum>(3)</enum><text>in subsection (e),
			 by striking <quote>The</quote> and inserting <quote>Except as provided in
			 subsection (f), the</quote>; and</text>
				</paragraph><paragraph id="H44B543054C824F419129348BA020BC45"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HA52332A4AC464580B275B7A66416E185" style="OLC">
						<subsection id="HB7E203FF4EAF41DA872EF857D433EDB5"><enum>(f)</enum><header>Requirements for
				appraisers regarding energy efficiency features</header><text display-inline="yes-display-inline">The Appraisal Subcommittee shall establish
				requirements for State certification of State certified real estate appraisers
				and for State licensing of State licensed appraisers, to ensure that appraisers
				consider and are qualified to consider, in determining the value of a property,
				any renewable energy sources for, or energy efficiency or energy conserving
				improvements or features of, the
				property.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H006BA724BA584758B772F47BF79F94CD"><enum>(c)</enum><header>Guidelines for
			 appraising photovoltaic and solar thermal measures and training of
			 appraisers</header><text>Section 1122 of the Financial Institutions Reform,
			 Recovery, and Enforcement Act of 1989 (12 U.S.C. 3351) is amended by adding at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H240F89FA44B94904B7AB67F4BA4649E" style="OLC">
					<subsection id="HD28F66748ECE41A58E85C0E2C7C7055B"><enum>(g)</enum><header>Guidelines for
				appraising photovoltaic and solar thermal measures and training of
				appraisers</header><text display-inline="yes-display-inline">The Appraisal
				Subcommittee shall, in consultation with the Secretary of Housing and Urban
				Development, the Federal National Mortgage Association, and the Federal Home
				Loan Mortgage Corporation, establish specific guidelines for—</text>
						<paragraph id="HF251A284D4A040B4B400D3BEF0A513CC"><enum>(1)</enum><text>appraising off-
				and on-grid photovoltaic and solar thermal measures for compliance with the
				appraisal standards prescribed pursuant to section 1110(2);</text>
						</paragraph><paragraph id="HE04E9C02B05F492CA6922E485B6F07F4"><enum>(2)</enum><text>requirements under
				section 1116(f) for certification of State certified real estate appraisers and
				for State licensing of State licensed appraisers, to ensure that appraisers
				consider, and are qualified to consider, such photovoltaic and solar thermal
				measures in determining the value of a property; and</text>
						</paragraph><paragraph id="HA519CE19EAFD4E0691634B3635916BAD"><enum>(3)</enum><text>training of
				appraisers to meet the requirements established pursuant to paragraph (2) of
				this
				subsection.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H447F8456F7A4486BAFC66BB9F9005769"><enum>17.</enum><header>Additional
			 requirements for the Housing Assistance Council</header><text display-inline="no-display-inline">The Secretary shall require the Housing
			 Assistance Council—</text>
			<paragraph id="H479AC73541FD4EDEA887008918B884B2"><enum>(1)</enum><text>to encourage each
			 organization that receives assistance from the Council with any amounts made
			 available from the Secretary to provide that any structure or building
			 developed or assisted under projects, programs, and activities funded with such
			 amounts complies with enhanced energy efficiency standards; and</text>
			</paragraph><paragraph id="HF029558E22CA4792BFBA5C1EA76E6E59"><enum>(2)</enum><text>to establish
			 incentives to encourage each such organization to provide that any such
			 structure or building complies with enhanced energy efficiency
			 standards.</text>
			</paragraph></section><section id="H2041798B53CB4B2FABFEFA10ADC37BB3"><enum>18.</enum><header>Rural housing
			 and economic development assistance</header><text display-inline="no-display-inline">The Secretary shall—</text>
			<paragraph id="HC00880603C0E4A4387E4468FCC0AEF"><enum>(1)</enum><text display-inline="yes-display-inline">encourage each tribe, agency, organization,
			 corporation, and other entity that receives any assistance from the Office of
			 Rural Housing and Economic Development of the Department of Housing and Urban
			 Development to provide that any structure or building developed or assisted
			 under activities funded with such amounts complies with minimum energy
			 efficiency standards; and</text>
			</paragraph><paragraph id="H661EE2E7EC464C87B6ED5D72FDCD8C3D"><enum>(2)</enum><text>establish
			 incentives to encourage each such tribe, agency, organization, corporation, and
			 other entity to provide that any such structure or building comply with
			 enhanced energy efficiency standards.</text>
			</paragraph></section><section id="H37576053ED2244DF8576DBCC3A32F99"><enum>19.</enum><header>Revolving fund
			 for loans to States and Indian tribes to carry out renewable energy sources
			 activities</header>
			<subsection id="H150560F68E38433EAC53FCDFB692E982"><enum>(a)</enum><header>Establishment of
			 Fund</header><text>There is established in the Treasury of the United States a
			 revolving fund, to be known as the <quote>Alternative Energy Sources State
			 Revolving Fund</quote>.</text>
			</subsection><subsection id="HF1F5D39AF28F47EC93DFFBCFEA553C1B"><enum>(b)</enum><header>Credits</header><text>The
			 Fund shall be credited with—</text>
				<paragraph id="H1C30306551214A20A2A0639F6F3DADA6"><enum>(1)</enum><text>any amounts
			 appropriated to the Fund pursuant to subsection (g);</text>
				</paragraph><paragraph id="H144EEDDC65374C6FAD32396543755668"><enum>(2)</enum><text>any amounts of
			 principal and interest from loan repayments received by the Secretary pursuant
			 to subsection (d)(7); and</text>
				</paragraph><paragraph id="HB75C7912A7F94F85A310F8D58730C24C"><enum>(3)</enum><text>any interest
			 earned on investments of amounts in the Fund pursuant to subsection (e).</text>
				</paragraph></subsection><subsection id="HDB976F0BA3C644D8B66E47BB6DF0387F"><enum>(c)</enum><header>Expenditures</header>
				<paragraph id="HECA970C8ABFB4961A71267309F53B404"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), on request by the Secretary,
			 the Secretary of the Treasury shall transfer from the Fund to the Secretary
			 such amounts as the Secretary determines are necessary to provide loans under
			 subsection (d)(1).</text>
				</paragraph><paragraph id="HE0A570F31B704483B5D2877674E9E1AB"><enum>(2)</enum><header>Administrative
			 expenses</header><text>Of the amounts in the Fund, not more than 5 percent
			 shall be available for each fiscal year to pay the administrative expenses of
			 the Department of Housing and Urban Development to carry out this
			 section.</text>
				</paragraph></subsection><subsection id="H222996BA8D3F4F53992B8466F5E30815"><enum>(d)</enum><header>Loans to States
			 and Indian tribes</header>
				<paragraph id="HB3C1E622580C46CB85CB7ECAF15FE0FD"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 use amounts in the Fund to provide loans to States and Indian tribes to provide
			 incentives to owners of single family and multifamily housing, commercial
			 properties, and public buildings to provide—</text>
					<subparagraph id="H65DE8CBCDBB34166BC7F0077ACFACF43"><enum>(A)</enum><text display-inline="yes-display-inline">renewable energy sources for such
			 structures, such as wind, wave, solar, biomass, or geothermal energy sources,
			 including incentives to companies and businesses to change their source of
			 energy to such renewable energy sources and for changing the sources of energy
			 for public buildings to such renewable energy sources;</text>
					</subparagraph><subparagraph id="H6E84B46D6C10411D8C16E5893C195198"><enum>(B)</enum><text>energy efficiency
			 and energy conserving improvements and features for such structures; or</text>
					</subparagraph><subparagraph id="H18896075449846EDB42EBAAD83F6D6"><enum>(C)</enum><text>infrastructure
			 related to the delivery of electricity and hot water for structures lacking
			 such amenities.</text>
					</subparagraph></paragraph><paragraph id="H931E27EAE83C4D2DB0286957E3441782"><enum>(2)</enum><header>Eligibility</header><text display-inline="yes-display-inline">To be eligible to receive a loan under this
			 subsection, a State or Indian tribe, directly or through an appropriate State
			 or tribal agency, shall submit to the Secretary an application at such time, in
			 such manner, and containing such information as the Secretary may
			 require.</text>
				</paragraph><paragraph id="H63B913D92BE64FCD004B6781BB39D4C9"><enum>(3)</enum><header>Criteria for
			 approval</header><text display-inline="yes-display-inline">The Secretary may
			 approve an application of a State or Indian tribe under paragraph (2) only if
			 the Secretary determines that the State or tribe will use the funds from the
			 loan under this subsection to carry out a program to provide incentives
			 described in paragraph (1) that—</text>
					<subparagraph id="H79F062B6E6134F24BCBD400004B2DA7"><enum>(A)</enum><text display-inline="yes-display-inline">requires that any such renewable energy
			 sources, and energy efficiency and energy conserving improvements and features,
			 developed pursuant to assistance under the program result in compliance of the
			 structure so improved with minimum energy efficiency standards; and</text>
					</subparagraph><subparagraph id="H96CF9D2D2D994D3793B54F8BC119029E"><enum>(B)</enum><text display-inline="yes-display-inline">includes such compliance and audit
			 requirements as the Secretary determines are necessary to ensure that the
			 program is operated in a sound and effective manner.</text>
					</subparagraph></paragraph><paragraph id="H05070094BB084A4882F1767757C1E57B"><enum>(4)</enum><header>Preference</header><text display-inline="yes-display-inline">In making loans during each fiscal year,
			 the Secretary shall give preference to States and Indian tribes that have not
			 previously received a loan under this subsection.</text>
				</paragraph><paragraph id="H5DED77C3E36D4E0889899B00D9007F86"><enum>(5)</enum><header>Maximum
			 amount</header><text>The aggregate outstanding principal amount from loans
			 under this subsection to any single State or Indian tribe may not exceed
			 $500,000,000.</text>
				</paragraph><paragraph id="H39044DB014A44D3186FF0474018BEBE4"><enum>(6)</enum><header>Loan
			 terms</header><text display-inline="yes-display-inline">Each loan under this
			 subsection shall have a term to maturity of not more than 10 years and shall
			 bear interest at an annual rate, determined by the Secretary, that shall not
			 exceed the interest rate charged by the Federal Reserve Bank of New York to
			 commercial banks and other depository institutions for very short-term loans
			 under the primary credit program, as most recently published in the Federal
			 Reserve Statistical Release on selected interest rates (daily or weekly), and
			 commonly referred to as the H.15 release, preceding the date of a determination
			 for purposes of applying this paragraph.</text>
				</paragraph><paragraph id="H8B5D353C0DF643B6A09E1488BE7DFC25"><enum>(7)</enum><header>Loan
			 repayment</header><text display-inline="yes-display-inline">The Secretary shall
			 require full repayment of each loan made under this section.</text>
				</paragraph></subsection><subsection id="H9DAB788E0C5A44A497532308A09E3E35"><enum>(e)</enum><header>Investment of
			 Amounts</header>
				<paragraph id="HB55EDB043AB1496EAF5ECB599F1982F"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of the Treasury shall invest such amounts
			 in the Fund that are not, in the judgment of the Secretary of the Treasury,
			 required to meet needs for current withdrawals.</text>
				</paragraph><paragraph commented="no" id="HCA3943E023344AAD965DCC9C2CA045EB"><enum>(2)</enum><header>Obligations of
			 United States</header><text>Investments may be made only in interest-bearing
			 obligations of the United States.</text>
				</paragraph></subsection><subsection id="H9FD9F0E2E0804B4E87DC42106F46AF18"><enum>(f)</enum><header>Reports</header>
				<paragraph id="H4C9B2D483CA845D3AF5F3BA99B09998"><enum>(1)</enum><header>Reports to
			 Secretary</header><text display-inline="yes-display-inline">For each year
			 during the term of a loan made under subsection (d), the State or Indian tribe
			 that received the loan shall submit to the Secretary a report describing the
			 State or tribal alternative energy sources program for which the loan was made
			 and the activities conducted under the program using the loan funds during that
			 year.</text>
				</paragraph><paragraph id="H600CD40B66F249D98C1394E419B1856"><enum>(2)</enum><header>Report to
			 Congress</header><text>Not later than September 30 of each year that loans made
			 under subsection (d) are outstanding, the Secretary shall submit a report to
			 Congress describing the total amount of such loans provided under subsection
			 (d) to each eligible State and Indian tribe during the fiscal year ending on
			 such date, and an evaluation on effectiveness of the Fund.</text>
				</paragraph></subsection><subsection id="HA15934761C274785AF43CB8698A671D5"><enum>(g)</enum><header>Authorization of
			 Appropriations</header><text>There is authorized to be appropriated to the Fund
			 $5,000,000,000.</text>
			</subsection><subsection id="H557779C761294718AA0053946DF38205"><enum>(h)</enum><header>Definitions</header><text>In
			 this section, the following definitions shall apply:</text>
				<paragraph id="H19DD7E10197048FC004399A6A0A8B83D"><enum>(1)</enum><header>Indian
			 tribe</header><text display-inline="yes-display-inline">The term <quote>Indian
			 tribe</quote> has the meaning given such term in section 4 of the Native
			 American Housing Assistance and Self-Determination Act of 1996 (25 U.S.C.
			 4103).</text>
				</paragraph><paragraph id="H815D2C29112B4FC28B4E0501B3CFC0C1"><enum>(2)</enum><header>State</header><text>The
			 term <quote>State</quote> means each of the several States, the Commonwealth of
			 Puerto Rico, the District of Columbia, the Commonwealth of the Northern Mariana
			 Islands, Guam, the Virgin Islands, American Samoa, the Trust Territories of the
			 Pacific, or any other possession of the United States.</text>
				</paragraph></subsection></section><section id="idC234E254629C44CD864E7CECA573F591"><enum>20.</enum><header>Competitive
			 grant program to increase sustainable low-income community development
			 capacity</header>
			<subsection id="ID0e54beff74e046d99c6cbadd0c053ea1"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="ID2b49857746164c3b97f42cc714209a1b"><enum>(1)</enum><header>Eligible
			 community development organization</header><text>The term <term>eligible
			 community development organization</term> means—</text>
					<subparagraph id="ID27c6f020d1884ac9840fb748a5ab151c"><enum>(A)</enum><text>a unit of general
			 local government, as that term is defined in section 104 of the
			 Cranston-Gonzalez National Affordable Housing Act (42 U.S.C. 12704));</text>
					</subparagraph><subparagraph id="ID47300592917a46558ce7040d128b41ff"><enum>(B)</enum><text>a community
			 housing development organization, as that term is defined in section 104 of the
			 Cranston-Gonzalez National Affordable Housing Act (42 U.S.C. 12704));</text>
					</subparagraph><subparagraph id="IDec105248f94044298db595e137a39de9"><enum>(C)</enum><text>an Indian tribe
			 or tribally designated housing entity, as those terms are defined in section 4
			 of the Native American Housing Assistance and Self-Determination Act of 1996
			 (25 U.S.C. 4103)); and</text>
					</subparagraph><subparagraph id="IDbd26046ce4ac44829b79c55dea93da6f"><enum>(D)</enum><text>a public housing
			 agency, as that term is defined in section 3(b) of the United States Housing
			 Act of 1937 (42 U.S.C. 1437(b)).</text>
					</subparagraph></paragraph><paragraph id="IDe631374d4abc4a8d9fe103133cbee7f0"><enum>(2)</enum><header>Low-income
			 community</header><text>The term <term>low-income community</term> means a
			 census tract in which 50 percent or more of the households have an annual
			 income that is less than 80 percent of the greater of—</text>
					<subparagraph id="ID00c8daa101cf4423ac29c76bb00ec868"><enum>(A)</enum><text>the median gross
			 income for that year for the area in which the census tract is located;
			 or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID361584afba93458eb6dece821646ef99"><enum>(B)</enum><text>the median gross
			 income for that year for the State in which the census tract is located.</text>
					</subparagraph></paragraph><paragraph id="ID92cd58f500394c30836949ea0018e173"><enum>(3)</enum><header>Nonprofit
			 organization</header><text>The term <term>nonprofit organization</term> has the
			 same meaning as in section 104 of the Cranston-Gonzalez National Affordable
			 Housing Act (42 U.S.C. 12704).</text>
				</paragraph></subsection><subsection id="IDe23a4231b4ad488286d7759c44610b95"><enum>(b)</enum><header>Program
			 established</header><text>The Secretary shall establish a competitive grant
			 program to make grants to nonprofit organizations to—</text>
				<paragraph id="ID9a6153d94816493e967c4c7c5186c3de"><enum>(1)</enum><text>carry out a
			 project described in subsection (c);</text>
				</paragraph><paragraph id="id904E236D08B44078B36731354E6B24C7"><enum>(2)</enum><text>train, educate,
			 support, or advise an eligible community development organization that carries
			 out a project described in subsection (c);</text>
				</paragraph><paragraph id="id422E1E00B59E4149843E504700658C31"><enum>(3)</enum><text>provide planning
			 and design assistance to eligible community development organizations;</text>
				</paragraph><paragraph id="IDb5a32c1b667447a09b28607a13677a0d"><enum>(4)</enum><text>make loans or
			 grants to eligible community development organizations; or</text>
				</paragraph><paragraph id="ID118b5c1810034259a4ddcfb9a2b1e83a"><enum>(5)</enum><text>carry out other
			 activities consistent with this section, as the Secretary determines
			 appropriate.</text>
				</paragraph></subsection><subsection id="id5970E960C314481B94611CF3ADDB5941"><enum>(c)</enum><header>Projects</header><text>The
			 projects described in this subsection are projects—</text>
				<paragraph id="id090A8855041142D395822FDB6CE620D7"><enum>(1)</enum><text>that take into
			 consideration minimum energy efficiency standards, enhanced energy efficiency
			 standards, and green building standards; and</text>
				</paragraph><paragraph id="idDEA86635F0E2426C8E9A1BCA9448F30E"><enum>(2)</enum><text>that—</text>
					<subparagraph id="id6E2CF504622642598E5EAAF36C55B15D"><enum>(A)</enum><text>improve the
			 energy efficiency of residential and nonresidential structures;</text>
					</subparagraph><subparagraph id="id9DA55188CD8C4685993E98720F5FAFB1"><enum>(B)</enum><text>promote resource
			 conservation and reuse;</text>
					</subparagraph><subparagraph id="idB57654A006144BEA93FE216E745AF631"><enum>(C)</enum><text>include design
			 strategies to maximize the energy efficiency of residential and nonresidential
			 structures;</text>
					</subparagraph><subparagraph id="id2563F16922E8431DA34E529A1932402F"><enum>(D)</enum><text>install or
			 construct renewable energy improvements for residential and nonresidential
			 structures, including wind, wave, solar, biomass, and geothermal energy
			 sources; or</text>
					</subparagraph><subparagraph id="idBDF5E372D700405AB4013EBD64872C66"><enum>(E)</enum><text>promote the
			 effective use of existing infrastructure in affordable housing and economic
			 development activities in low-income communities.</text>
					</subparagraph></paragraph></subsection><subsection id="id2ED0D885374148838869BD9F8DAFEDA6"><enum>(d)</enum><header>Priority</header><text>In
			 making grants under this section, the Secretary shall give priority to
			 activities that will result in compliance with minimum energy efficiency
			 standards, enhanced energy efficiency standards, and green building
			 standards.</text>
			</subsection><subsection id="IDd9e223fbaa114988b70b6bc8e018de81"><enum>(e)</enum><header>Application</header><text>A
			 nonprofit organization that desires a grant under this section shall submit to
			 the Secretary an application at such time, in such manner, and containing such
			 information as the Secretary may require.</text>
			</subsection><subsection id="IDdc332f8183ea408e98d140aba3507a29"><enum>(f)</enum><header>Award of
			 contracts</header><text>Any contract for architectural or engineering services
			 that is funded with amounts from grants made under this section shall be
			 awarded in accordance with chapter 11 of title 40, United States Code (relating
			 to selection of architects and engineers).</text>
			</subsection><subsection id="IDf76b04572249477996f659c5fe0228d5"><enum>(g)</enum><header>Federal
			 share</header>
				<paragraph id="id17C7124EFCD04425A03CA0DC1928A11F"><enum>(1)</enum><header>Amount of
			 Federal share</header><text>The Federal share of the cost of a project under
			 this section may not exceed 50 percent.</text>
				</paragraph><paragraph id="id6D854640A42E423598153FE7947B09DB"><enum>(2)</enum><header>Form of
			 non-Federal share</header><text>The non-Federal share of the cost of a project
			 under this section may be in cash or in-kind.</text>
				</paragraph></subsection><subsection id="ID47a2b21427b4499ba485e9a8e92af608"><enum>(h)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated to the
			 Secretary such sums as may be necessary to carry out this section.</text>
			</subsection></section><section id="idC64F077E1CAE4BD7BA6581C8EDBBA21C"><enum>21.</enum><header>Insurance
			 coverage for loans for financing of renewable energy systems leased for
			 residential use</header>
			<subsection id="H210A450104AD43CF87C6EBBF5EBEE9DA"><enum>(a)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of this section are—</text>
				<paragraph id="HA2F3B3D8CFD94871B1D195B9ABF1655B"><enum>(1)</enum><text>to encourage
			 residential use of renewable energy systems by minimizing upfront costs and
			 providing immediate utility cost savings to consumers through leasing of such
			 systems to homeowners;</text>
				</paragraph><paragraph id="H9DCC399FF0CE442490023EBAC98332FD"><enum>(2)</enum><text>to reduce carbon
			 emissions and the use of nonrenewable resources;</text>
				</paragraph><paragraph id="H4FEE883CB7984E50928B46B49E018DCD"><enum>(3)</enum><text>to encourage
			 energy efficient residential construction and rehabilitation;</text>
				</paragraph><paragraph id="H0D2460F70A7643F980B9E5A9B6CD1A94"><enum>(4)</enum><text>to encourage the
			 use of renewable resources by homeowners;</text>
				</paragraph><paragraph id="H5EB3B167E0324379B8F5CBABB52AE62C"><enum>(5)</enum><text>to minimize the
			 impact of development on the environment;</text>
				</paragraph><paragraph id="HBF528E6B8FCA4AAAAB4D8FDB7FCC674E"><enum>(6)</enum><text>to reduce consumer
			 utility costs; and</text>
				</paragraph><paragraph id="H55FFA3D42E094A4885F3C6065247A340"><enum>(7)</enum><text>to encourage
			 private investment in the green economy.</text>
				</paragraph></subsection><subsection id="H60EDADB60763477FADC9986246F80502"><enum>(b)</enum><header>Definitions</header><text>As
			 used in this section, the following definitions shall apply:</text>
				<paragraph commented="no" id="id96C948DCEE344621B49EC66A1A7E63C4"><enum>(1)</enum><header>Authorized
			 renewable energy lender</header><text>The term <term>authorized renewable
			 energy lender</term> means a lender authorized by the Secretary to make a loan
			 under this section.</text>
				</paragraph><paragraph id="HD84F9A3125114B86A98303882EA4775A"><enum>(2)</enum><header>Renewable energy
			 system lease</header><text display-inline="yes-display-inline">The term
			 <term>renewable system energy lease</term> means an agreement between an
			 authorized renewable energy system owner and a homeowner for a term of not less
			 than 5 years, pursuant to which the homeowner—</text>
					<subparagraph id="idA086727F57784D03A4448DEEFC0C8425"><enum>(A)</enum><text display-inline="yes-display-inline">grants an easement to such renewable energy
			 system owner to install, maintain, use, and otherwise access the renewable
			 energy system; and</text>
					</subparagraph><subparagraph id="id58B06EF185DA4079B6A1A32CE3D6F22E"><enum>(B)</enum><text>agrees to—</text>
						<clause id="idC37762E9E6EA4370A612487FEB3C3D64"><enum>(i)</enum><text display-inline="yes-display-inline">lease the use of such system from such
			 renewable energy system owner; or</text>
						</clause><clause id="id14053E2A17DB4434AB93C8213A83C668"><enum>(ii)</enum><text>purchase
			 electric power from such renewable energy system owner.</text>
						</clause></subparagraph></paragraph><paragraph id="H1F9D4F96D3AE42299951978768CAEE13"><enum>(3)</enum><header>Renewable energy
			 manufacturer</header><text>The term <term>renewable energy manufacturer</term>
			 means a manufacturer of renewable energy systems.</text>
				</paragraph><paragraph id="idCEDD91A7398B456BABC3E296B425452F"><enum>(4)</enum><header>Renewable
			 energy system owner</header><text>The term <term>renewable energy system
			 owner</term> means a homebuilder, a manufacturer or installer of a renewable
			 energy system, or any other person, as determined by the Secretary.</text>
				</paragraph><paragraph id="HA549B7E11AF2444FA98808C6FFF2D3F6"><enum>(5)</enum><header>Renewable energy
			 system</header><text>The term <term>renewable energy system</term> means a
			 system of energy derived from—</text>
					<subparagraph id="id2F8008CC21304CEBAB118736965422D1"><enum>(A)</enum><text>a wind, solar
			 (including photovoltaic and solar thermal), biomass (including biodiesel), or
			 geothermal source; or</text>
					</subparagraph><subparagraph id="id0121F9199DB14289A12ED20AD94041B9"><enum>(B)</enum><text>hydrogen derived
			 from biomass or water using an energy source described in subparagraph
			 (A).</text>
					</subparagraph></paragraph></subsection><subsection id="HED12D767C9EE4ACC9E364B03D553A816"><enum>(c)</enum><header>Authority</header>
				<paragraph id="idA53A43183791429FBD38269D4AA6E0A2"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary may,
			 upon application by an authorized renewable energy system owner, insure or make
			 a commitment to insure a loan made by an authorized renewable energy lender to
			 a renewable energy system owner to finance the acquisition of a renewable
			 energy system for lease to a homeowner for use at the residence of such
			 homeowner.</text>
				</paragraph><paragraph id="id5C4C882D16414EC0BAACB1383329AA42"><enum>(2)</enum><header>Terms and
			 conditions</header><text>The Secretary may prescribe such terms and conditions
			 for insurance under paragraph (1) as are consistent with the purposes of this
			 section.</text>
				</paragraph></subsection><subsection id="H62A70EE9A0E943F5A8BED297CE1E1313"><enum>(d)</enum><header>Limitation on
			 principal amount</header>
				<paragraph id="HE8F5ECE8257D4FCA9B4450A981B69CB9"><enum>(1)</enum><header>Limitation</header><text display-inline="yes-display-inline">The principal amount of a loan insured
			 under this section shall not exceed the residual value of the renewable energy
			 system to be acquired with the loan.</text>
				</paragraph><paragraph id="H8239DC19322843D38070184DC706858C"><enum>(2)</enum><header>Residual
			 value</header><text>For purposes of this subsection—</text>
					<subparagraph id="HF402138A6AB2423FA3C2F5419277BE28"><enum>(A)</enum><text>the residual value
			 of a renewable energy system is the fair market value of the future revenue
			 stream from the sale of the expected remaining electricity production from the
			 system, pursuant to the easement granted in accordance with subsection (e);
			 and</text>
					</subparagraph><subparagraph id="HE918A7964E6B409688F01F5089DFE7E2"><enum>(B)</enum><text>the fair market
			 value of the future revenue stream for each year of the remaining life of the
			 renewable energy system shall be determined based on the net present value of
			 the power output production warranty for such renewable energy system provided
			 by the renewable energy manufacturer and the forecast of regional residential
			 electricity prices made by the Energy Information Administration of the
			 Department of Energy.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="H02EFD42C745E42ABB1CA70B2231B464D"><enum>(e)</enum><header>Easement</header><text>The
			 Secretary may not insure a loan under this section unless the renewable energy
			 system owner certifies, in accordance with such requirements as the Secretary
			 shall establish, consistent with the purposes of this section, that the systems
			 financed will be leased only to homeowners that grant easements to install,
			 maintain, use, and otherwise access the system that include the right to sell
			 electricity produced during the life of the renewable energy system to a
			 wholesale or retail electrical power grid.</text>
			</subsection><subsection commented="no" id="H222AA48279D7474F969F1CCF0E6B1DB2"><enum>(f)</enum><header>Discount or
			 prepayment</header><text display-inline="yes-display-inline">To encourage the
			 use of renewable energy systems, the Secretary shall ensure that a discount
			 given to a homeowner by a renewable energy system owner or other investor or
			 prepayment of a renewable energy system lease by a renewable energy system
			 owner does not adversely affect the mortgage requirements of such
			 homeowner.</text>
			</subsection><subsection id="HB3DFC421ACF84AB68303C52658A75299"><enum>(g)</enum><header>Eligibility of
			 lenders</header><text>The Secretary may not insure a loan under this section
			 unless the lender making the loan—</text>
				<paragraph id="H8EFE60EE0AC94361B502BB3003759628"><enum>(1)</enum><text>is an institution
			 that—</text>
					<subparagraph id="id43467D486B2D470DA100FCBFEA8B90C3"><enum>(A)</enum><text>qualifies as a
			 green banking center under section 8(x) of the Federal Deposit Insurance Act
			 (12 U.S.C. 1818(x)) or section 206(x) of the Federal Credit Union Act (12
			 U.S.C. 1786(x)); or</text>
					</subparagraph><subparagraph id="H62279823BD414460BD97011B3A8E75F0"><enum>(B)</enum><text>meets such other
			 requirements as the Secretary shall establish for participation of renewable
			 energy lenders in the program under this section; and</text>
					</subparagraph></paragraph><paragraph id="HDEF0591FD592477493A68FC98AA08E95"><enum>(2)</enum><text>meets such
			 qualifications as the Secretary shall establish for all lenders for
			 participation in the program under this section.</text>
				</paragraph></subsection><subsection id="H93D977A2840A4357AB94BAD2A7A32FD4"><enum>(h)</enum><header>Certificate of
			 insurance</header>
				<paragraph id="id898D25EE5E4547CBB50E6ED5F3F3D2AD"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall issue to a lender that is insured
			 under this section a certificate that serves as evidence of insurance coverage
			 under this section.</text>
				</paragraph><paragraph id="idBEC60014665F4FB3B8756509DCEA7E00"><enum>(2)</enum><header>Contents of
			 certificate</header><text display-inline="yes-display-inline">The certificate
			 required under paragraph (1) shall set forth the fair market value of the
			 future revenue stream for each year of the remaining life of the renewable
			 energy system.</text>
				</paragraph><paragraph id="H0EE38A62EC72493AB17B576AD6331E94"><enum>(3)</enum><header>Full Faith and
			 Credit</header><text>The certificate required under paragraph (1) shall be
			 backed by the full faith and credit of the United States.</text>
				</paragraph></subsection><subsection id="H645B790EC7D747EEA41A9B610EC1489D"><enum>(i)</enum><header>Payment of
			 insurance claim</header>
				<paragraph id="H7687F60291A54947BB02B67FA9A9B4F0"><enum>(1)</enum><header>Filing of
			 claim</header><text display-inline="yes-display-inline">The Secretary shall
			 provide for the filing of claims for insurance under this section and the
			 payment of such claims.</text>
				</paragraph><paragraph id="id9206CE01D73546B881C882A0BC469251"><enum>(2)</enum><header>Payment of
			 claim</header><text display-inline="yes-display-inline">A claim under paragraph
			 (1) may be paid only upon a default under the loan insured under this section
			 and the assignment, transfer, and delivery to the Secretary of—</text>
					<subparagraph id="idC5822C98DF074E25BE666C1D33401700"><enum>(A)</enum><text display-inline="yes-display-inline">all rights and interests arising under the
			 loan; and</text>
					</subparagraph><subparagraph id="idE49936B700204CE78B95907222B5DB24"><enum>(B)</enum><text display-inline="yes-display-inline">all claims of the lender or the assigns of
			 the lender against the borrower or others arising under the loan
			 transaction.</text>
					</subparagraph></paragraph><paragraph id="H7BB8CC06DE98497493A61BC276B56A3B"><enum>(3)</enum><header>Lien</header>
					<subparagraph id="id9F104E1C3E76495AA7E7A95CD0C87562"><enum>(A)</enum><header>In
			 general</header><text>Upon payment of a claim for insurance of a loan under
			 this section, the Secretary shall hold a lien on the underlying renewable
			 energy system assets and any associated revenue stream from the use of such
			 system, which shall be superior to all other liens on such assets.</text>
					</subparagraph><subparagraph id="id64F624D2B66A4BA39F332398928952AC"><enum>(B)</enum><header>Residual
			 value</header><text>The residual value of such renewable energy system and the
			 revenue stream from the use of such system shall be not less than the unpaid
			 balance of the loan amount covered by the certificate of insurance.</text>
					</subparagraph><subparagraph id="id839B691F6D8146B2894528D170C6DE97"><enum>(C)</enum><header>Revenue from
			 sale</header><text>The Secretary shall be entitled to any revenue generated by
			 such renewable energy system from selling electricity to the grid when an
			 insurance claim has been paid out.</text>
					</subparagraph></paragraph></subsection><subsection id="H18B61EDA0BEF4EE3A8B1AC1520C3D07B"><enum>(j)</enum><header>Assignment and
			 transferability of insurance</header><text>A renewable energy system owner or
			 an authorized renewable energy lender that is insured under this section may
			 assign or transfer the insurance in whole or in part, to another owner or
			 lender, subject to such requirements as the Secretary may prescribe.</text>
			</subsection><subsection id="HACAD22F8A55A40A28BB17717EE48DB19"><enum>(k)</enum><header>Premiums and
			 charges</header>
				<paragraph id="H4BB1E452024C432780BCB3F2367E889C"><enum>(1)</enum><header>Insurance
			 premiums</header>
					<subparagraph id="idE4E699E69FB1440FABC2DE6EC9CD9C11"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 fix and collect premiums for insurance of loans under this section, that shall
			 be paid by the applicant renewable energy system owner at the time of issuance
			 of the certificate of insurance to the lender and shall be adequate, in the
			 determination of the Secretary, to cover the expenses and probable losses of
			 administering the program under this section.</text>
					</subparagraph><subparagraph id="id191F13E8FF4C448294481A1D1B58C504"><enum>(B)</enum><header>Deposit of
			 premium</header><text display-inline="yes-display-inline">The Secretary shall
			 deposit any premiums collected under this subsection in the Renewable Energy
			 Lease Insurance Fund established under subsection (l).</text>
					</subparagraph></paragraph><paragraph id="HAE7565DAF61B4C96B477D49974E4CA21"><enum>(2)</enum><header>Prohibition on
			 other charges</header><text>Except as provided in paragraph (1), the Secretary
			 may not assess any other fee (including a user fee), insurance premium, or
			 charge in connection with loan insurance provided under this section.</text>
				</paragraph></subsection><subsection id="H304664D805AF49B0BB3299AE43A146BF"><enum>(l)</enum><header>Renewable Energy
			 Lease Insurance Fund</header>
				<paragraph id="HC810D29E6C6A4229A5269332FFA08115"><enum>(1)</enum><header>Fund
			 Established</header><text display-inline="yes-display-inline">There is
			 established in the Treasury of the United States the Renewable Energy Lease
			 Insurance Fund (referred to in this subsection as the <quote>Fund</quote>),
			 which shall be available to the Secretary without fiscal year limitation, for
			 the purpose of providing insurance under this section.</text>
				</paragraph><paragraph id="H4CD184B035364FA780C5FFF6CCFC8ACF"><enum>(2)</enum><header>Credits</header><text>The
			 Fund shall be credited with any premiums collected under subsection (k)(1), any
			 amounts collected by the Secretary under subsection (i)(3), and any associated
			 interest or earnings.</text>
				</paragraph><paragraph id="H51698817E11F460287DEAD5D73FCD266"><enum>(3)</enum><header>Availability</header><text>Amounts
			 in the Fund shall be available to the Secretary for fulfilling any obligations
			 with respect to insurance for loans provided under this section and paying
			 administrative expenses in connection with this section.</text>
				</paragraph><paragraph id="idF66F897537F44625ABE03C653BDBF649"><enum>(4)</enum><header>Excess
			 amounts</header><text>The Secretary may invest in obligations of the United
			 States any amounts in the Fund determined by the Secretary to be in excess of
			 amounts required at the time of such determination to carry out this
			 section.</text>
				</paragraph></subsection><subsection id="HA3E834B94A0D4392942CE1483865D758"><enum>(m)</enum><header>Regulations</header>
				<paragraph id="idC5A335EC7F6948EFABE9AEE29F4BEC8D"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall issue such regulations as may be
			 necessary to carry out this section.</text>
				</paragraph><paragraph id="idA35DA211D7E74231831DD3A8DF788B7A"><enum>(2)</enum><header>Timing</header><text>Not
			 later than 180 days after the date of enactment of this Act, the Secretary
			 shall issue interim or final regulations.</text>
				</paragraph></subsection><subsection id="H7FE82F6579EA41269A354F1037C23946"><enum>(n)</enum><header>Ineligibility
			 for Purchase by Federal Financing Bank</header><text>Notwithstanding any other
			 provision of law, no debt obligation that is insured or committed to be insured
			 by the Secretary under this section shall be subject to the Federal Financing
			 Bank Act of 1973 (12 U.S.C. 2281 et seq.).</text>
			</subsection><subsection id="id7E42794BF39E4CE5BA3BF6718BEC3577"><enum>(o)</enum><header>Termination of
			 authority</header><text>The authority of the Secretary to insure and make
			 commitments to insure new loans under this Act shall terminate 10 years after
			 the date of enactment of this Act.</text>
			</subsection></section><section id="H6EA869313DBB4290A165EB66DB5D0699"><enum>22.</enum><header>Green banking
			 centers</header>
			<subsection id="H114CEEC54BA24D2BA0DC314408C47EC2"><enum>(a)</enum><header>Insured
			 depository institutions</header><text display-inline="yes-display-inline">Section 8 of the Federal Deposit Insurance
			 Act (12 U.S.C. 1818) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HBA9E7A947A904F7DBDAF7E3D10BBF809" style="OLC">
					<subsection id="H90A811F4B97E4C9F9F9276E8A000A5A2"><enum>(x)</enum><header>Green banking
				centers</header>
						<paragraph id="H55487B65B4A44EE2B121FA6DBD50B887"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Federal banking
				agencies shall prescribe guidelines encouraging the establishment and
				maintenance of green banking centers by insured depository institutions to
				provide any consumer who seeks information on obtaining a mortgage, home
				improvement loan, or home equity loan with additional information on—</text>
							<subparagraph id="H7B68EC39E06F4917A505A019C56F8301"><enum>(A)</enum><text>obtaining a home
				energy rating or audit for the residence for which such mortgage or loan is
				sought;</text>
							</subparagraph><subparagraph id="H1320F77B03DD42DC9BCBFB3B64FF865"><enum>(B)</enum><text display-inline="yes-display-inline">obtaining financing for cost-effective
				energy-saving improvements to such property; and</text>
							</subparagraph><subparagraph id="H8625311EDCFC46A0A2557029B3B2178F"><enum>(C)</enum><text display-inline="yes-display-inline">obtaining beneficial terms for any mortgage
				or loan, or qualifying for a larger mortgage or loan, secured by a residence
				which meets or will meet energy efficiency standards.</text>
							</subparagraph></paragraph><paragraph id="HBAA3D1B19AA74D95B6AE2C12A72CA358"><enum>(2)</enum><header>Information and
				referrals</header><text>The information made available to consumers under
				paragraph (1) may include—</text>
							<subparagraph id="HF0665A84D6BF4ED6AF20D994341B7581"><enum>(A)</enum><text display-inline="yes-display-inline">information on obtaining a home energy
				rating and contact information on qualified energy raters in the area of the
				residence;</text>
							</subparagraph><subparagraph id="H52B4BFBD08F94B23A5554E2C4257A347"><enum>(B)</enum><text display-inline="yes-display-inline">information on the secondary market
				guidelines that permit lenders to provide more favorable terms by allowing
				lenders to increase the ratio on debt-to-income requirements or to use the
				projected utility savings as a compensating factor;</text>
							</subparagraph><subparagraph id="HA518B859DFBC4C739B14CD06CE5707E"><enum>(C)</enum><text display-inline="yes-display-inline">information including eligibility
				information about, and contact information for, any conservation or renewable
				energy programs, grants, or loans offered by the Secretary of Housing and Urban
				Development, including the Energy Efficient Mortgage Program;</text>
							</subparagraph><subparagraph id="H5358653197C74B3685B8C0E0FEB2BB6"><enum>(D)</enum><text display-inline="yes-display-inline">information including eligibility
				information about, and contact information for, any conservation or renewable
				energy programs, grants, or loans offered for qualified military personal,
				reservists, and veterans by the Secretary of Veterans Affairs;</text>
							</subparagraph><subparagraph id="H9FBB33EAE0BE4595BE1FC7A41EAF2B71"><enum>(E)</enum><text display-inline="yes-display-inline">information about, and contact information
				for, the Office of Efficiency and Renewable Energy at the Department of Energy,
				including the weatherization assistance program;</text>
							</subparagraph><subparagraph id="HDCCA55B6853D4CBFBA0667A8E4396EDB"><enum>(F)</enum><text display-inline="yes-display-inline">information about, and contact information
				for, the Energy Star Program of the Environmental Protection Agency;</text>
							</subparagraph><subparagraph id="HB0E4AEE97A5740A49E84AE48862CCDAA"><enum>(G)</enum><text>information from,
				and contact information for, the Federal Citizen Information Center of the
				General Services Administration on energy efficient mortgages and loans, home
				energy rating systems, and the availability of energy efficient mortgage
				information from a variety of Federal agencies; and</text>
							</subparagraph><subparagraph id="H88428CF1435F4F569BDA5CEBAF657DCC"><enum>(H)</enum><text>such other
				information as the agencies or the insured depository institution may determine
				to be appropriate or
				useful.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA008EA67A4F644AB9BBF4D9878AAC4E6"><enum>(b)</enum><header>Insured credit
			 unions</header><text>Section 206 of the Federal Credit Union Act (12 U.S.C.
			 1786) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HB5458AB1B37540E9A665FB41DB1366E7" style="OLC">
					<subsection id="H9A986771A94945EC94ADE3A9574DA6F2"><enum>(x)</enum><header>Green banking
				centers</header>
						<paragraph id="H2544090BC85C4497A5855C4CFDB6A9C2"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Board shall
				prescribe guidelines encouraging the establishment and maintenance of green
				banking centers by insured credit unions to provide any member who seeks
				information on obtaining a mortgage, home improvement loan, or home equity loan
				with additional information on—</text>
							<subparagraph id="H70477BC56A314F7DAE13D469A172E9C0"><enum>(A)</enum><text>obtaining a home
				energy rating or audit for the residence for which such mortgage or loan is
				sought;</text>
							</subparagraph><subparagraph id="H2A9FA16672854E71A9A71D7241D4F7B4"><enum>(B)</enum><text display-inline="yes-display-inline">obtaining financing for cost-effective
				energy-saving improvements to such property; and</text>
							</subparagraph><subparagraph id="HEAEA5308D50F478BBF7599193BB2D6DF"><enum>(C)</enum><text display-inline="yes-display-inline">obtaining beneficial terms for any mortgage
				or loan, or qualifying for a larger mortgage or loan, secured by a residence
				which meets or will meet energy efficiency standards.</text>
							</subparagraph></paragraph><paragraph id="HD081758A4C2142969F49B86EDCE2D74B"><enum>(2)</enum><header>Information and
				referrals</header><text>The information made available to members under
				paragraph (1) may include—</text>
							<subparagraph id="H15EF41248F3044258811CD72D2DE90C9"><enum>(A)</enum><text display-inline="yes-display-inline">information on obtaining a home energy
				rating and contact information on qualified energy raters in the area of the
				residence;</text>
							</subparagraph><subparagraph id="H4A17CB2F9DA545FF8D1B1217FA13147"><enum>(B)</enum><text display-inline="yes-display-inline">information on the secondary market

				Development, including the Energy Efficient Mortgage Program;</text>
							</subparagraph><subparagraph id="H22A3CA8A64BF47BE8BBFF223ABA3F6EE"><enum>(D)</enum><text display-inline="yes-display-inline">information including eligibility
				information about, and contact information for, any conservation or renewable
				energy programs, grants, or loans offered for qualified military personnel,
				reservists, and veterans by the Secretary of Veterans Affairs;</text>
							</subparagraph><subparagraph id="H203B80AD29C246D993A8500038CF6180"><enum>(E)</enum><text display-inline="yes-display-inline">information about, and contact information
				for, the Office of Efficiency and Renewable Energy at the Department of Energy,
				including the weatherization assistance program;</text>
							</subparagraph><subparagraph id="H394251E3DB2D4A5890114DE1F211D6BF"><enum>(F)</enum><text>information from,
				and contact information for, the Federal Citizen Information Center of the
				General Services Administration on energy efficient mortgages and loans, home
				energy rating systems, and the availability of energy efficient mortgage
				information from a variety of Federal agencies;</text>
							</subparagraph><subparagraph id="id9C17247C92064F8D9466AE6B69E48DC7"><enum>(G)</enum><text>information about
				incentives or financial products that are available for projects that are
				consistent with or certified under minimum energy efficiency standards,
				enhanced efficiency standards, or green building standards, as those terms are
				defined in section 3 of the <short-title>Energy Efficiency
				in Housing Act of 2009</short-title>; and</text>
							</subparagraph><subparagraph id="HCE9356ECE23946228BAA1D35FB3B00D8"><enum>(H)</enum><text>such other
				information as the Board or the insured credit union may determine to be
				appropriate or
				useful.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H8C3A087B4FF944C7B9C09E98F4B0F1FB"><enum>23.</enum><header>GAO reports on
			 availability of affordable mortgages</header>
			<subsection id="H75210BDC6D844EBCBC2B5758317EA04C"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Comptroller General of the United
			 States shall periodically, as necessary to comply with subsection (b), examine
			 the impact of this Act and the amendments made by this Act on the availability
			 of affordable mortgages in various areas throughout the United States,
			 including cities having older infrastructure and limited space for the
			 development of new housing.</text>
			</subsection><subsection id="H4BA35AD49542494291EBCAFBEB960A9"><enum>(b)</enum><header>Triennial
			 reports</header>
				<paragraph id="idE65687FF2DF1452D9C2B348656F7F158"><enum>(1)</enum><header>Report
			 required</header><text display-inline="yes-display-inline">The Comptroller
			 General shall submit a report once every 3 years to the Committee on Banking,
			 Housing, and Urban Affairs of the Senate and the Committee on Financial
			 Services of the House of Representatives.</text>
				</paragraph><paragraph id="id04680F32B5D14DB0BB4C483B3475D810"><enum>(2)</enum><header>Contents of
			 report</header><text display-inline="yes-display-inline">The report under
			 paragraph (1) shall include—</text>
					<subparagraph id="HDC99CB902D354CDC81B99E5A4E2E700"><enum>(A)</enum><text>a detailed
			 statement of the most recent findings pursuant to subsection (a); and</text>
					</subparagraph><subparagraph id="H0C6FB249342B4B2C936BCC8FF7C6F87D"><enum>(B)</enum><text display-inline="yes-display-inline">if the Comptroller General finds that this
			 Act or the amendments made by this Act have directly or indirectly resulted in
			 consequences that limit the availability or affordability of mortgages in any
			 area or areas within the United States, including any city having older
			 infrastructure and limited space for the development of new housing, any
			 recommendations for any additional actions at the Federal, State, or local
			 levels that the Comptroller General considers necessary or appropriate to
			 mitigate such effects.</text>
					</subparagraph></paragraph><paragraph id="id1D7E68B206434E49BE98AF428F3BC744"><enum>(3)</enum><header>Timing</header><text display-inline="yes-display-inline">The first report under paragraph (1) shall
			 be submitted not later than 3 years after the date of enactment of this
			 Act.</text>
				</paragraph></subsection></section><section id="HCB465B8D4CAE487FA0FE60AEF1094D69"><enum>24.</enum><header>Public housing
			 energy cost report</header>
			<subsection id="HE2B94D4E7AF544CF8043CBAFCC434848"><enum>(a)</enum><header>Collection of
			 information by HUD</header>
				<paragraph id="id9F94CC4649E947B5BBD59329F57B11A2"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 obtain from each public housing agency, at such time as may be necessary to
			 comply with the reporting requirement under subsection (b), information
			 regarding the energy costs for public housing administered or operated by the
			 agency.</text>
				</paragraph><paragraph id="idCA019F40C5244EE2BFA668634F32D095"><enum>(2)</enum><header>Type of
			 information</header><text display-inline="yes-display-inline">For each public
			 housing agency, such information shall include the monthly energy costs
			 associated with each separate building and development of the agency, for the
			 most recently completed 12-month period for which such information is
			 available, and such other information as the Secretary determines is
			 appropriate in determining which public housing buildings and developments are
			 most in need of repairs and improvements to reduce energy needs and costs and
			 become more energy efficient.</text>
				</paragraph></subsection><subsection id="H6F122A7991F343FEB817AF948EDDC57B"><enum>(b)</enum><header>Report</header><text>Not
			 later than 12 months after the date of enactment of this Act, the Secretary
			 shall submit to Congress a report setting forth the information collected
			 pursuant to subsection (a).</text>
