		<official-title>To provide United States citizenship for children adopted
		  from outside the United States, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Foreign Adopted Children Equality
			 Act</short-title></quote> or the <quote><short-title>FACE
			 Act</short-title></quote>.</text>
		</section><section id="ID8c9ab8d1d9694eac9f2279510dff887a"><enum>2.</enum><header>Citizenship for
			 children adopted from outside the United States</header>
			<subsection id="idD4B8B63B038246CCBC1B052D0BC90E75"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 320(b) of the
			 Immigration and Nationality Act (8 U.S.C. 1431(b)) is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="id6B0A52A436F14C21B9A2663792334F7D" style="OLC">
					<subsection id="idFAAEFFE950BA4D12A6211DC55552F0DA"><enum>(b)</enum><header>Citizenship for
				children adopted from outside the United States</header>
						<paragraph id="id0430F233D53F45E089C928AF5987C974"><enum>(1)</enum><header>In
				general</header><text>A child born outside the United States automatically
				becomes a citizen of the United States if the Secretary of State is satisfied
				that all of the following conditions are met:</text>
							<subparagraph id="id5BDA15011F9E4E73A338B2BBBCC98EDF"><enum>(A)</enum><text>The child is
				adopted by a parent who is a citizen of the United States.</text>
							</subparagraph><subparagraph id="id0F91E67B06B74A418168709EC9A6E955"><enum>(B)</enum><text>The child is
				younger than 18 years of age.</text>
							</subparagraph><subparagraph id="id81F6DDD2DF3F40B8A95392656DE2CE64"><enum>(C)</enum><text>It is determined
				that each adopting parent is eligible and suitable to adopt the child,
				including determining that the parent is able to support the child and has
				undergone an appropriate criminal background check.</text>
							</subparagraph><subparagraph id="id07EEFA3B9917464DBE6CE2EB71DE46EB"><enum>(D)</enum><text>Prior to the
				adoption, the child was an unmarried individual younger than 18 years of
				age—</text>
								<clause id="ID141205151c22421dae60e438cec34683"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="id50564F44D84B46F4AE701B4D70C6D82B"><enum>(I)</enum><text>whose biological
				parents (or parent, in the case of an individual who has 1 sole or surviving
				parent) or other person or institution that retains legal custody of the
				individual—</text>
										<item id="IDad2d55b78c5c4ba9b1331777a5d2fcf7" indent="up1"><enum>(aa)</enum><text>have freely given their written
				irrevocable consent to the termination of their legal relationship with the
				individual, and to the individual's emigration and adoption and that such
				consent has not been induced by payment or compensation of any kind and has not
				been given prior to the birth of the individual;</text>
										</item><item id="IDe37e2fdb18454deca3a615128a1bc2f0" indent="up1"><enum>(bb)</enum><text>are unable to provide proper care for
				the individual, as determined by the competent authority of the individual's
				residence; or</text>
										</item><item id="ID429335349623435687e34568fb81d66a" indent="up1"><enum>(cc)</enum><text>have voluntarily relinquished the
				individual to the competent authorities pursuant to the law of the individual's
				residence; or</text>
										</item></subclause><subclause id="IDe02d1b44e4d241929e6282b2e0338f9d" indent="up1"><enum>(II)</enum><text>who, as determined by the competent
				authority of the individual’s residence—</text>
										<item id="ID92f7a9797cdb4a7db33c438fa71ba46e"><enum>(aa)</enum><text>has been abandoned or deserted by the
				individual's biological parents or legal guardian; or</text>
										</item><item id="ID4f427e736d36461f99eadae4c8ececd6"><enum>(bb)</enum><text>has been orphaned due to the death or
				disappearance of the individual’s biological parents or legal guardian;
				and</text>
										</item></subclause></clause><clause id="idD0DFD763FEE74406B65CD3D7B9A94B4B"><enum>(ii)</enum><text>with respect to
				whom the Secretary of State—</text>
									<subclause id="idE7A1FDB43AF94ED6BAD1ACC8BF69289C"><enum>(I)</enum><text>is satisfied that
				the proper care will be furnished the individual if admitted to the United
				States;</text>
									</subclause><subclause id="id2F84FAA63D1F4661910A9C53469DB3D8"><enum>(II)</enum><text>is satisfied
				that the purpose of the adoption is to form a bona fide parent-child
				relationship and that the parent-child relationship of the individual and the
				biological parents has been terminated (and in carrying out both obligations
				under this subparagraph, the Secretary of State, in consultation with the
				Secretary of Homeland Security, may consider whether there is a petition
				pending to confer immigrant status on 1 or both of the biological
				parents);</text>
									</subclause><subclause id="id8BDE7BED6A474FD39FDA24F41AED37B0"><enum>(III)</enum><text>is satisfied
				that there has been no inducement, financial or otherwise, offered to obtain
				the consent nor was it given before the birth of the individual; and</text>
									</subclause><subclause id="id32D90E5111E1462E8618D38D996EDE68"><enum>(IV)</enum><text>in consultation
				with the Secretary of Homeland Security, is satisfied that the individual is
				not a security risk.</text>
									</subclause></clause></subparagraph></paragraph><paragraph id="idC1B42FC6CC5844A491FC83556D1F74F1"><enum>(2)</enum><header>Citizenship
				from birth</header><text>An individual who becomes a citizen of the United
				States pursuant to paragraph (1) shall be deemed to have been a citizen of the
				United States at birth and shall be issued a United States Consular Report of
				Birth.</text>
						</paragraph><paragraph id="id55343E56613B4189AEC36DCFED7375DC"><enum>(3)</enum><header>Special rule
				for adoptees who are older than 18 years of age</header>
							<subparagraph id="id04BF9EF09D7A4606B1C57BA1E09AD31B"><enum>(A)</enum><header>In
				general</header><text>A person described in subparagraph (B) shall be deemed to
				have been a citizen of the United States at birth after the approval of an
				application filed within the United States or with a United States
				Embassy.</text>
							</subparagraph><subparagraph id="id41EF7B8579C748CC9D60DCC4BB1CCD04"><enum>(B)</enum><header>Person
				described</header><text>A person described in this clause is a person
				who—</text>
								<clause id="id6169A6631E394455BCD66E095E5F0A58"><enum>(i)</enum><text>is older than 18
				years of age;</text>
								</clause><clause id="id282742FA354F4D24BBC125ADF94E56B9"><enum>(ii)</enum><text>was born outside
				the United States and was adopted by a parent who is a citizen of the United
				States before the date on which the person reached 18 years of age; and</text>
								</clause><clause id="idB83B0805D56E42019235416AD175C57E"><enum>(iii)</enum><text>was described
				in subparagraph (E), (F), or (G) of section 101(b)(1).</text>
								</clause></subparagraph></paragraph><paragraph id="id483E5DF189854A089BAFB444A86997F1"><enum>(4)</enum><header>No liability
				for prior taxes</header><text>An individual who becomes a citizen of the United
				States pursuant to paragraph (1) or (3) may not be liable for any taxes that
				the individual would have paid to the United States as a citizen of the United
				States before the date on which the individual becomes such a
				citizen.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idD3D842F03D754A20B8F8AE6B42B600FC"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="id5DAA33D9D2134A5E87A18D958D9FFB7C"><enum>(1)</enum><header>Heading</header><text>The
			 heading of section 320 of the <act-name parsable-cite="INA">Immigration and
			 Nationality Act</act-name> (8 U.S.C. 1431) is amended to read as
			 follows:</text>
					<quoted-block display-inline="no-display-inline" id="idDDD765704B5E474084FF23917256F18E" style="OLC">
						<appropriations-small id="idE8CFD69A8C774050B47501FE774FC4CC"><header>children
			 born outside the united states; conditions under which citizenship is
			 acquired</header>
						</appropriations-small><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idF8D3945C714D44289DAC7765F333EA49"><enum>(2)</enum><header>Section 301 of
			 the immigration and nationality act</header><text>Section 301 of the
			 Immigration and Nationality Act (8 U.S.C. 1401) is amended—</text>
					<subparagraph id="id13CA0A54C65246B2A648B783AFD135AB"><enum>(A)</enum><text>in subsection
			 (g), by striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="idBC39B868FCA940C58D13335619D67F03"><enum>(B)</enum><text>in subsection
			 (h), by striking the period at the end, inserting a semicolon and
			 <quote>and</quote>; and</text>
					</subparagraph><subparagraph id="id128461C0DDA349C6A739B16F67121AA9"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id9625959E584F4529AD3890EB526C6A27" style="OLC">
							<subsection id="idFFB53E9B02D54EA3ABA53CF2BFC65FB2"><enum>(i)</enum><text>a person deemed a
				citizen at birth pursuant to section
				320(b).</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="ID5C26DD9E362844E38409B01E04EBF96C"><enum>(c)</enum><header>Clerical
			 amendment</header><text>The table of contents of the Immigration and
			 Nationality Act is amended by striking the item relating to section 320 and
			 inserting the following:</text>

					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="id303433318B694E0DA146143AB68DCF0F"><enum>3.</enum><header>Nonimmigrant
			 status for children brought to the United States to be adopted</header><text display-inline="no-display-inline">Section 101(a)(15) of the Immigration and
			 Nationality Act (8 U.S.C. 1101(a)(15)) is amended—</text>
			<paragraph id="idF1A89AB6D4E44D3CA3F140D9A426359A"><enum>(1)</enum><text>in subparagraph
			 (U), by striking <quote>or</quote> at the end;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id876F136281EA401FA55E6CC31C43824B"><enum>(2)</enum><text>in subparagraph
			 (V), by striking the period at the end and inserting <quote>; or</quote>;
			 and</text>
			</paragraph><paragraph id="idAF38B74F7FA64F9B9275EE3C5B44B8A7"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id4419B67C9C52469DA6BE1C2F666900FD" style="OLC">
					<subparagraph id="id2DB73A4E0F7F453C98B5070F7DAD78F1"><enum>(W)</enum><text>an individual
				brought to the United States as a child to be adopted by a citizen of the
				United
				States.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="idED21237E17C54CD59085C81533A920D7"><enum>4.</enum><header>Appeal of notice
			 of intent to deny an adoption</header>
			<subsection id="id9FB42CE36B604027AD046014AE78A868"><enum>(a)</enum><header>Requirement To
			 provide opportunity To appeal</header><text>If the Secretary of State
			 determines that a covered individual is not eligible to be adopted by a citizen
			 or national of the United States on the basis that the conditions described in
			 subsection (c) are not met, the Secretary shall provide—</text>
				<paragraph id="id0872791D60C94570827E1F43D4703462"><enum>(1)</enum><text>a notice of
			 intent to deny the adoption of the child to such citizen or national of the
			 United States; and</text>
				</paragraph><paragraph id="id3B0DC648F9664DA5AD57C8DCEE258F39"><enum>(2)</enum><text>an opportunity
			 for such citizen or national to appeal the determination.</text>
				</paragraph></subsection><subsection id="id6851D1F6F2FB480D8037DF6A463FE103"><enum>(b)</enum><header>Covered
			 individual defined</header><text>In this section, the term <term>covered
			 individual</term> means an individual who—</text>
				<paragraph id="id5416EB1FC47A4756A81D8F613438BC8A"><enum>(1)</enum><text>is younger than
			 18 years of age;</text>
				</paragraph><paragraph id="idF1075C454BD14446A3A69F8CACC8F7E9"><enum>(2)</enum><text>was born in a
			 foreign country; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id442B2CB083184EBA986E8A79F1520C4B"><enum>(3)</enum><text>is seeking to be
			 adopted by a parent who is a citizen or national of the United States.</text>
				</paragraph></subsection><subsection id="idDCDD3C2C24D743799829D3B170154D0B"><enum>(c)</enum><header>Conditions for
			 adoption</header><text>The conditions described in this subsection are met
			 if—</text>
				<paragraph id="idD8231C83D3D045809FE093EC8D9E0998"><enum>(1)</enum><text>the covered
			 individual’s biological parents (or parent, in the case of an individual who
			 has 1 sole or surviving parent) or other person or institution that retains
			 legal custody of the covered individual—</text>
					<subparagraph id="idC27F77E4E36C4BD09B0CEB911FEC6A0A"><enum>(A)</enum><text>have freely given
			 their written irrevocable consent to the termination of their legal
			 relationship with the individual, and to the individual’s emigration and
			 adoption and that such consent has not been induced by payment or compensation
			 of any kind and has not been given prior to the birth of the individual;</text>
					</subparagraph><subparagraph id="idF85678231AAA40A7A760A6A77BE07CE3"><enum>(B)</enum><text>are unable to
			 provide proper care for the individual, as determined by the competent
			 authority in the country of the individual’s residence; or</text>
					</subparagraph><subparagraph id="idD4638EA28A604C938C14BB13055C6E72"><enum>(C)</enum><text>have voluntarily
			 relinquished the individual to the competent authorities pursuant to the law of
			 the country of the individual’s residence; or</text>
					</subparagraph></paragraph><paragraph id="idB0541703333F4780AD8EF0EB99B510FE"><enum>(2)</enum><text>the covered
			 individual, as determined by the competent authority in the country of the
			 individual’s residence—</text>
					<subparagraph id="idC6A2CCEC0A584F8FA84A88C3C43E2C0A"><enum>(A)</enum><text>has been
			 abandoned or deserted by the individual’s biological parents or legal guardian;
			 or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id66915EDAAA2544C0A48605E087464C2D"><enum>(B)</enum><text>has been orphaned
			 due to the death or disappearance of the individual’s biological parents or
			 legal guardian.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idF60988CAD26048BEAA37046677B4E576"><enum>5.</enum><header>Rule of
			 construction</header><text display-inline="no-display-inline">Nothing in this
			 Act, or in any amendment made by this Act, may be construed to—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="idAB4C528F8B1240A49676DCC5D0EB46F4"><enum>(1)</enum><text display-inline="yes-display-inline">abrogate any citizenship rights provided to
			 an adoptee by the adoptee’s country of origin; or</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB5C9EF540AE648298F0ED12357B58BCA"><enum>(2)</enum><text display-inline="yes-display-inline">nullify the facts of the adoptee’s birth
			 history.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="idAD6DEF968C0345C58DDB49D257DD1B74"><enum>6.</enum><header>Sense of
			 Congress</header><text display-inline="no-display-inline">It is the sense of
			 Congress that the government of each foreign country from which children are
			 adopted by citizens of the United States should provide documentation of the
			 adopted children’s original birth history to the adoptive family in accordance
			 with the laws of such country.</text>
