		<official-title>To prohibit any recipient of emergency Federal economic
		  assistance from using such funds for lobbying expenditures or political
		  contributions, to improve transparency, enhance accountability, encourage
		  responsible corporate governance, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Troubled Asset Relief Program
			 Transparency Reporting Act</short-title></quote>.</text>
		</section><section id="id8DE838D55033474BBC40F1EFD7C9EEEA" section-type="subsequent-section"><enum>2.</enum><header>Prohibition on use of
			 certain Federal funds for lobbying and political contributions</header>
			<subsection id="id79527217574A494284951C8595BE49C7"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this Act, the following definitions
			 shall apply:</text>
				<paragraph id="id87CF218BB7FC42A98B778ED2D4A778A9"><enum>(1)</enum><header>Emergency
			 economic assistance</header><text>The term <term>emergency economic
			 assistance</term> means any funds made available to any recipient under title I
			 of the Emergency Economic Stabilization Act of 2008 (Public Law 110–343) or
			 section 13 of the Federal Reserve Act.</text>
				</paragraph><paragraph id="id019A701565FB4798AA432DD804A26AD9"><enum>(2)</enum><header>Lobbying
			 expenditures</header><text>The term <term>lobbying expenditures</term> has the
			 meaning given under section 4911(c)(1) of the Internal Revenue Code of
			 1986.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC8D3B54BCF9C4A99AE1DBD1077A67B9D"><enum>(3)</enum><header>Political
			 contributions</header><text>The term <term>political contributions</term> means
			 any contribution on behalf of a political candidate or to a separate segregated
			 fund described in section 316(b)(2)(C) of the Federal Election Campaign Act of
			 1971 (2 U.S.C. 441b(b)(2)(C)).</text>
				</paragraph></subsection><subsection id="idBF2EF618E2F64D78B16A40E49FB8D0BB"><enum>(b)</enum><header>Prohibition on
			 the use of emergency economic assistance</header><text display-inline="yes-display-inline">Any recipient of emergency economic
			 assistance and any subsidiary thereof may not use such funds for lobbying
			 expenditures or political contributions.</text>
			</subsection></section><section id="id7AC8A73CFE0543ABA59946D1E7D2BDD2"><enum>3.</enum><header>Guidelines for
			 the use of funds</header>
			<subsection id="id0BBB5D7CF60B414DA5C84AE15D842096"><enum>(a)</enum><header>Guidelines</header><text>Not
			 later than 30 days after the date of enactment of this Act, the Secretary of
			 the Treasury, in consultation with the Comptroller General and the Financial
			 Stability Oversight Board, shall develop and publish corporate governance
			 principles and ethical guidelines for recipients of emergency economic
			 assistance including restrictions governing—</text>
				<paragraph id="ID7e6d83fdc7154a2e8dc2b456cc4be6a6"><enum>(1)</enum><text>the hosting,
			 sponsorship, or payments for conferences and events;</text>
				</paragraph><paragraph id="id19AAD49FB11347BBBC9D678106509E5F"><enum>(2)</enum><text>the use of
			 corporate aircraft, travel accommodations, and travel expenditures;</text>
				</paragraph><paragraph id="id459C46CCF7694344BEF6B44546590F8F"><enum>(3)</enum><text>expenses relating
			 to office or facility renovations or relocations; and</text>
				</paragraph><paragraph id="id172D28E7505F4700B3D2DDE779292964"><enum>(4)</enum><text>expenses relating
			 to entertainment, holiday parties, employee recognition events, or similar
			 ancillary corporate expenses.</text>
				</paragraph></subsection><subsection id="ID6ed02fa382024660953fadc24bc53012"><enum>(b)</enum><header>Internal
			 reporting and oversight</header><text display-inline="yes-display-inline">The
			 Secretary of the Treasury shall publish suggested mechanisms for addressing
			 non-compliance with the guidelines developed pursuant to subsection (a) through
			 enhanced internal reporting and oversight requirements.</text>
			</subsection></section><section id="idC592675C57C84A8DA7243D05C90606F0"><enum>4.</enum><header>Reporting and
			 certification</header>
			<subsection id="id59392CF0902C4F7DB1AB364AAB2893CE"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Each recipient of emergency economic
			 assistance shall file with the Secretary of the Treasury on a quarterly
			 basis—</text>
				<paragraph id="idE0F83FDEEAAE437D82E672BE21E2C31C"><enum>(1)</enum><text display-inline="yes-display-inline">a detailed accounting of how emergency
			 economic assistance is being used, including an explanation of how such funds
			 have been allocated to stabilize financial markets and increase the
			 availability of credit to consumers and businesses; and</text>
				</paragraph><paragraph id="idF5DF55A8CEFF41DD859929BBC05C9E3F"><enum>(2)</enum><text display-inline="yes-display-inline">a certification that—</text>
					<subparagraph id="id2C45BAB0629C498E988115065B1C8FA0"><enum>(A)</enum><text display-inline="yes-display-inline">no emergency economic assistance is being
			 used for lobbying expenditures of political contributions in violation of
			 section 2(b); and</text>
					</subparagraph><subparagraph id="id178E9076AE014C9EBEA78BE55A6E324F"><enum>(B)</enum><text display-inline="yes-display-inline">no emergency economic assistance is being
			 used in violation of the guidelines issued by the Secretary of Treasury under
			 section 3(a).</text>
					</subparagraph></paragraph></subsection><subsection id="id01D60C11C0224A418F510975F0F8ED9A"><enum>(b)</enum><header>Public
			 availability</header><text display-inline="yes-display-inline">Any report or
			 certification filed under this section shall be made publically available by
			 Secretary of the Treasury on-line, and at no cost.</text>
			</subsection></section><section id="id8B78FE667D744BF19AB21F380DDF896C"><enum>5.</enum><header>Penalties</header>
			<subsection id="idE91A4E9E911E43BA8420C59DB499E5BB"><enum>(a)</enum><header>Use of
			 funds</header><text display-inline="yes-display-inline">Any person that
			 violates section 2(b) shall be subject to a civil fine of at least $100,000 per
			 violation.</text>
			</subsection><subsection id="id4DC438429FEF493FAA89F15FB576D144"><enum>(b)</enum><header>Future
			 funding</header><text display-inline="yes-display-inline">Any person that fails
			 to comply with section 2(b) or the guidelines implemented under section 3 shall
			 not be eligible to receive any future emergency economic assistance unless the
			 Secretary of the Treasury, in consultation with the Financial Stability
			 Oversight Board, determines that reasonable steps have been taken to bring
			 actions into compliance with and to prevent future violations of this
			 Act.</text>
			</subsection><subsection id="id1CC4A607352B47BE9EE1E1FE49F0D954"><enum>(c)</enum><header>False
			 report</header><text display-inline="yes-display-inline">Any person that fails
			 to file a report or certification required under section 4 shall be subject to
			 a civil fine of at least $100,000.</text>
			</subsection></section><section id="id218D48574523426F9E2C4E6FDBBA9549"><enum>6.</enum><header>Effective date
			 and application</header><text display-inline="no-display-inline">This Act shall
			 take effect on the date of enactment of this Act and apply to any emergency
			 economic assistance received before, on, or after that date.</text>
