		<official-title display="yes">To authorize the Attorney General to award
		  grants to State courts to develop and implement State courts interpreter
		  programs.</official-title>

		<section commented="no" display-inline="no-display-inline" id="idee537592-a6fd-4a30-a5a1-b47f544cd57d" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>State Court Interpreter Grant Program
			 Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="idc1f46019-be36-4bbe-92a0-e861b343ed75" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id10ef4a84-a019-4999-9449-ceb12a65b678"><enum>(1)</enum><text display-inline="yes-display-inline">the fair administration of justice depends
			 on the ability of all participants in a courtroom proceeding to understand that
			 proceeding, regardless of their English proficiency;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc4bf97aa-1164-4414-9227-3ba2e08a8747"><enum>(2)</enum><text display-inline="yes-display-inline">19 percent of the population of the United
			 States over 5 years of age speaks a language other than English at home;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9fc21a03-e41f-4e4f-a2df-897f03096df6"><enum>(3)</enum><text display-inline="yes-display-inline">only qualified court interpreters can
			 ensure that persons with limited English proficiency comprehend judicial
			 proceedings in which they are a party;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8f67fbdd-0c90-4986-97cf-0a3168bd0527"><enum>(4)</enum><text display-inline="yes-display-inline">the knowledge and skills required of a
			 qualified court interpreter differ substantially from those required in other
			 interpretation settings, such as social service, medical, diplomatic, and
			 conference interpreting;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id71bc878f-4244-4c17-972e-cd15f24b6a63"><enum>(5)</enum><text display-inline="yes-display-inline">the Federal Government has demonstrated its
			 commitment to equal administration of justice regardless of English
			 proficiency;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id13e9dddf-d806-4705-b989-0dfedafaf4b5"><enum>(6)</enum><text display-inline="yes-display-inline">regulations implementing title VI of the
			 Civil Rights Act of 1964, as well as the guidance issued by the Department of
			 Justice pursuant to Executive Order 13166, issued August 11, 2000, clarify that
			 all recipients of Federal financial assistance, including State courts, are
			 required to take reasonable steps to provide meaningful access to their
			 proceedings for persons with limited English proficiency;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc553d922-00d8-45a7-8aa8-7e5c2b4b9697"><enum>(7)</enum><text display-inline="yes-display-inline">40 States have developed, or are
			 developing, qualified court interpreting programs;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1b8eb65e-18f9-411a-b2bb-acf2930163a3"><enum>(8)</enum><text display-inline="yes-display-inline">robust, effective court interpreter
			 programs—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id669e1ae9-a331-4648-9b94-c0de68011056"><enum>(A)</enum><text display-inline="yes-display-inline">actively recruit skilled individuals to be
			 court interpreters;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id37c7c208-1029-4d01-9044-132c1c7502ea"><enum>(B)</enum><text display-inline="yes-display-inline">train those individuals in the
			 interpretation of court proceedings;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6db15a18-73aa-4d8e-8828-db2dcf59bdcf"><enum>(C)</enum><text display-inline="yes-display-inline">develop and use a thorough, systematic
			 certification process for court interpreters; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide054db63-d7cf-4181-80df-1d65afd23130"><enum>(D)</enum><text display-inline="yes-display-inline">have sufficient funding to ensure that a
			 qualified interpreter will be available to the court whenever necessary;
			 and</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1e228b16-d74e-4aab-8ed9-e8168de7bac1"><enum>(9)</enum><text display-inline="yes-display-inline">Federal funding is necessary to—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="idaba68dfe-af49-494d-a43b-85e7b3dbe543"><enum>(A)</enum><text display-inline="yes-display-inline">encourage State courts that do not have
			 court interpreter programs to develop them;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4308b63b-f979-43d9-b676-ea506985bac7"><enum>(B)</enum><text display-inline="yes-display-inline">assist State courts with nascent court
			 interpreter programs to implement them;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfa6433db-9bf7-4ade-8669-f156fde6bdd7"><enum>(C)</enum><text display-inline="yes-display-inline">assist State courts with limited court
			 interpreter programs to enhance them; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc49fdc2f-cd24-45b2-b4b5-c3271825f87f"><enum>(D)</enum><text display-inline="yes-display-inline">assist State courts with robust court
			 interpreter programs to make further improvements and share successful programs
			 with other States.</text>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="id5036a099-590f-4cd6-8615-7c08f50ce671" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">State court interpreter program</header>
			<subsection commented="no" display-inline="no-display-inline" id="id1f6c4d9a-d353-47af-aa90-b22fb3b86111"><enum>(a)</enum><header display-inline="yes-display-inline">Grants authorized</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id2397f097-c380-402a-a77a-c26eb5837994"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator of the Office of Justice
			 Programs of the Department of Justice (referred to in this section as the
			 <quote>Administrator</quote>) shall make grants, in accordance with such
			 regulations as the Attorney General may prescribe, to State courts to develop
			 and implement programs to assist individuals with limited English proficiency
			 to access and understand State court proceedings in which they are a
			 party.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1f1d7a9a-35b1-413b-8aca-59c1d853449f"><enum>(2)</enum><header display-inline="yes-display-inline">Technical assistance</header><text display-inline="yes-display-inline">The Administrator shall allocate, for each
			 fiscal year, $500,000 of the amount appropriated pursuant to section 4 to be
			 used to establish a court interpreter technical assistance program to assist
			 State courts receiving grants under this Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id01e0b176-e46d-403e-9c0b-3501e647f343"><enum>(b)</enum><header display-inline="yes-display-inline">Use of grants</header><text display-inline="yes-display-inline">Grants awarded under subsection (a) may be
			 used by State courts to—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idc04ccaf9-5334-4fb6-843d-9cb20a006f3f"><enum>(1)</enum><text display-inline="yes-display-inline">assess regional language demands;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfd6386b3-c441-490d-8cb3-418b09a6f22b"><enum>(2)</enum><text display-inline="yes-display-inline">develop a court interpreter program for the
			 State courts;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb0b1655a-0c04-4bbd-8811-149118e43b1a"><enum>(3)</enum><text display-inline="yes-display-inline">develop, institute, and administer language
			 certification examinations;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2b9df479-2c82-41bb-9cd8-b43500fd3333"><enum>(4)</enum><text display-inline="yes-display-inline">recruit, train, and certify qualified court
			 interpreters;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id760b8c24-3719-4c51-aae5-1c2fea3174c3"><enum>(5)</enum><text display-inline="yes-display-inline">pay for salaries, transportation, and
			 technology necessary to implement the court interpreter program developed under
			 paragraph (2); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ideaaada67-b409-4de5-a257-e27b3e44810a"><enum>(6)</enum><text display-inline="yes-display-inline">engage in other related activities, as
			 prescribed by the Attorney General.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0522e4dc-785f-4a55-a7a9-d95e6d300c6c"><enum>(c)</enum><header display-inline="yes-display-inline">Application</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id0c9174c3-fa4d-444c-b324-e5ee4fa8c140"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The highest State court of each State
			 desiring a grant under this section shall submit an application to the
			 Administrator at such time, in such manner, and accompanied by such information
			 as the Administrator may reasonably require.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4f761f9b-20bd-4c37-8bc3-d97f9b5174e7"><enum>(2)</enum><header display-inline="yes-display-inline">State courts</header><text display-inline="yes-display-inline">The highest State court of each State
			 submitting an application under paragraph (1) shall include in the
			 application—</text>
					<subparagraph id="id2A9166084E4B4C82A2F33F7CC25CD809"><enum>(A)</enum><text>a demonstration
			 of need for the development, implementation, or expansion of a State court
			 interpreter program;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfbed33ec-b288-422c-b7c1-db6c98233fc0"><enum>(B)</enum><text display-inline="yes-display-inline">an identification of each State court in
			 that State which would receive funds from the grant;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb28e8f42-12b1-4468-899c-3cdf5febbc88"><enum>(C)</enum><text display-inline="yes-display-inline">the amount of funds each State court
			 identified under subparagraph (B) would receive from the grant; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id106e07d0-c6a6-48cd-85e8-488257102537"><enum>(D)</enum><text display-inline="yes-display-inline">the procedures the highest State court
			 would use to directly distribute grant funds to State courts identified under
			 subparagraph (B).</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4856b84c-0d58-4a57-89b8-664790a2eb50"><enum>(d)</enum><header display-inline="yes-display-inline">State court allotments</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id85cf3e19-dbe1-4bbb-9fb1-aec4883b565c"><enum>(1)</enum><header display-inline="yes-display-inline">Base
			 allotment</header><text display-inline="yes-display-inline">From amounts
			 appropriated for each fiscal year pursuant to section 4, the Administrator
			 shall allocate $100,000 to each of the highest State court of each State, which
			 has an application approved under subsection (c).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7596288c-b3c2-4f00-88f6-8c781eccb58e"><enum>(2)</enum><header display-inline="yes-display-inline">Discretionary allotment</header><text>From
			 amounts appropriated for each fiscal year pursuant to section 4, the
			 Administrator shall allocate $5,000,000 to be distributed among the highest
			 State courts of States which have an application approved under subsection (c),
			 and that have extraordinary needs that are required to be addressed in order to
			 develop, implement, or expand a State court interpreter program.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id649cd34b-fd20-4f6e-9084-c5330be9bfa2"><enum>(3)</enum><header display-inline="yes-display-inline">Additional allotment</header><text display-inline="yes-display-inline">In addition to the allocations made under
			 paragraphs (1) and (2), the Administrator shall allocate to each of the highest
			 State court of each State, which has an application approved under subsection
			 (c), an amount equal to the product reached by multiplying—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idd7d6f5f7-7cc4-4ce6-a00e-2ffb83073001"><enum>(A)</enum><text display-inline="yes-display-inline">the unallocated balance of the amount
			 appropriated for each fiscal year pursuant to section 4; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd8320785-a172-4961-9b04-ebd221db9758"><enum>(B)</enum><text display-inline="yes-display-inline">the ratio between the number of people over
			 5 years of age who speak a language other than English at home in the State and
			 the number of people over 5 years of age who speak a language other than
			 English at home in all the States that receive an allocation under paragraph
			 (1), as those numbers are determined by the Bureau of the Census.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idad85f4a8-a48d-4dd3-82b7-3fc33c21a83c"><enum>(4)</enum><header display-inline="yes-display-inline">Treatment of District of
			 Columbia</header><text display-inline="yes-display-inline">For purposes of this
			 section—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ida21494b6-0ba7-4a1d-9425-247c42c5948d"><enum>(A)</enum><text display-inline="yes-display-inline">the District of Columbia shall be treated
			 as a State; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idca76867d-11ce-41b2-8b0c-0ebbaf6ff475"><enum>(B)</enum><text display-inline="yes-display-inline">the District of Columbia Court of Appeals
			 shall act as the highest State court for the District of Columbia.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id99bc37bd-174f-43c8-bbac-09b1f9c662db" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated $15,000,000 for each of the fiscal years 2010
			 through 2014 to carry out this Act.</text>
