		<section commented="no" display-inline="no-display-inline" id="id4D2CBB4B5535474882AF21953A11ABBC" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Foreign Evidence Request Efficiency
			 Act of 2009</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="idBE0541725AC84BC9984E6797C81A1E82" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Improvements to title 18</header><text display-inline="no-display-inline">Title 18 of the United States Code is
			 amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id8B4B8A62C0D843F9B7ABF1EE84CEE21D"><enum>(1)</enum><text display-inline="yes-display-inline">in section 2703—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id4FE5614520F7456586C247C41991E0B9"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>by a
			 court with jurisdiction over the offense under investigation or an equivalent
			 State warrant</quote> and inserting <quote>(or, in the case of a State court,
			 issued using State warrant procedures) by a court of competent
			 jurisdiction</quote>;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7D04B0F59BE846E8B8640B7780F95D83"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (b)(1)(A), by striking
			 <quote>by a court with jurisdiction over the offense under investigation or an
			 equivalent State warrant</quote> and inserting <quote>(or, in the case of a
			 State court, issued using State warrant procedures) by a court of competent
			 jurisdiction</quote>; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id931FDD653AAD46FEACDF288E89D6D150"><enum>(C)</enum><text display-inline="yes-display-inline">in subsection (c)(1)(A), by striking
			 <quote>by a court with jurisdiction over the offense under investigation or an
			 equivalent State warrant</quote> and inserting <quote>(or, in the case of a
			 State court, issued using State warrant procedures) by a court of competent
			 jurisdiction</quote>;</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2556749786F044BA8AD410BA7AFFA0CD"><enum>(2)</enum><text display-inline="yes-display-inline">in section 2711(3), by striking <quote>has
			 the meaning assigned by section 3127, and includes any Federal court within
			 that definition, without geographic limitation; and</quote> and inserting the
			 following: “includes—</text>
				<quoted-block display-inline="no-display-inline" id="id6665A2773DA74F70A18F75D7171B02AF" style="OLC">
					<subparagraph commented="no" display-inline="no-display-inline" id="ID5abbca72095b41d3953e5ac9a494bf8e"><enum>(A)</enum><text display-inline="yes-display-inline">any district court of the United States
				(including a magistrate judge of such a court) or any United States court of
				appeals that—</text>
						<clause commented="no" display-inline="no-display-inline" id="IDa9ace568be5e4d8dbbffebde9f292dd4"><enum>(i)</enum><text display-inline="yes-display-inline">has jurisdiction over the offense being
				investigated;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID8ed8e8a6f00544a79ad6d27d1f3624c5"><enum>(ii)</enum><text display-inline="yes-display-inline">is in or for a district in which the
				provider of a wire or electronic communication service is located or in which
				the wire or electronic communications, records, or other information are
				stored; or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDfcec73c1e47649feb9efc85c5d37af63"><enum>(iii)</enum><text display-inline="yes-display-inline">is acting on a request for foreign
				assistance pursuant to section 3512 of this title; or</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID79f6e7f7688843bea3a90c7691c62cd9"><enum>(B)</enum><text display-inline="yes-display-inline">a court of general criminal jurisdiction of
				a State authorized by the law of that State to issue search warrants;
				and</text>
					</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE240A88A46C74883B20EBA3335A756E0"><enum>(3)</enum><text display-inline="yes-display-inline">in section 3127(2)(A), by striking
			 <quote>having jurisdiction over the offense being investigated;</quote> and
			 inserting the following: “that—</text>
				<quoted-block display-inline="no-display-inline" id="id4E0EC772E2684736A94484AD67EB84CE" style="OLC">
					<clause commented="no" display-inline="no-display-inline" id="IDe7bb0f63cbd447398b5a6d331037e14d"><enum>(i)</enum><text display-inline="yes-display-inline">has jurisdiction over the offense being
				investigated;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="ID5b02a59c6a2847f5994a40099be163f9"><enum>(ii)</enum><text display-inline="yes-display-inline">is in or for a district in which the
				provider of a wire or electronic communication service is located;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="ID1fa75e327d674db69e1914fbbd7a0d77"><enum>(iii)</enum><text display-inline="yes-display-inline">is in or for a district in which a
				landlord, custodian, or other person subject to subsections (a) or (b) of
				section 3124 of this title is located; or</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="ID18f63c25504b4145a231620a47bebd28"><enum>(iv)</enum><text display-inline="yes-display-inline">is acting on a request for foreign
				assistance pursuant to section 3512 of this
				title;</text>
					</clause><after-quoted-block>;
				</after-quoted-block></quoted-block>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB750D66468154545B743501C6FBA4155"><enum>(4)</enum><text display-inline="yes-display-inline">in chapter 223, by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="idDB2377FB9069444AB4E553B83DB46D3E" style="USC">
					<section commented="no" display-inline="no-display-inline" id="id8C3C4DF495C34AB182F0FE42064596D7" section-type="subsequent-section"><enum>3512.</enum><header display-inline="yes-display-inline">Foreign requests for assistance in criminal
				investigations and prosecutions</header>
						<subsection commented="no" display-inline="no-display-inline" id="id05783662F87D490AABC67ED5B3B15945"><enum>(a)</enum><header display-inline="yes-display-inline">Execution of request for
				assistance</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id6E4180CE18CF498F8C540942CFE46BE6"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Upon application, duly authorized by an
				appropriate official of the Department of Justice, of an attorney for the
				Government, a Federal judge may issue such orders as may be necessary to
				execute a request from a foreign authority for assistance in the investigation
				or prosecution of criminal offenses, or in proceedings related to the
				prosecution of criminal offenses, including proceedings regarding forfeiture,
				sentencing, and restitution.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id444319E69A16438EA6902E5D34B42A1E"><enum>(2)</enum><header display-inline="yes-display-inline">Scope of orders</header><text display-inline="yes-display-inline">Any order issued by a Federal judge
				pursuant to paragraph (1) may include the issuance of—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id2C70715BB45248AABA1316EF45223D1C"><enum>(A)</enum><text display-inline="yes-display-inline">a search warrant, as provided under Rule 41
				of the Federal Rules of Criminal Procedure;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA0EBE1A908C943B582CE66195B7086BB"><enum>(B)</enum><text display-inline="yes-display-inline">a warrant or order for contents of stored
				wire or electronic communications or for records related thereto, as provided
				under section 2703 of this title;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE3BF0B62FD324492AF9DB33925AFAA75"><enum>(C)</enum><text display-inline="yes-display-inline">an order for a pen register or trap and
				trace device as provided under section 3123 of this title; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2DE3B096641843E5A04C2ED59C899136"><enum>(D)</enum><text display-inline="yes-display-inline">an order requiring the appearance of a
				person for the purpose of providing testimony or a statement, or requiring the
				production of documents or other things, or both.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE2F775A6C6CC493ABB1D309137188A09"><enum>(b)</enum><header display-inline="yes-display-inline">Appointment of persons To take testimony or
				statements</header>
							<paragraph commented="no" display-inline="no-display-inline" id="idA7896E8A3894470E87115DF361C67657"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In response to an application for execution
				of a request from a foreign authority as described under subsection (a), a
				Federal judge may also issue an order appointing a person to direct the taking
				of testimony or statements or of the production of documents or other things,
				or both.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0CE6BA84FC524332A78B3366A301D218"><enum>(2)</enum><header display-inline="yes-display-inline">Authority of appointed person</header><text display-inline="yes-display-inline">Any person appointed under an order issued
				pursuant to paragraph (1) may—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDc03911d42cad4db3801a7ca2f1aaf6d5"><enum>(A)</enum><text display-inline="yes-display-inline">issue orders requiring the appearance of a
				person, or the production of documents or other things, or both;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID46f32a3c0c7243919cf19ec38a4f62d7"><enum>(B)</enum><text display-inline="yes-display-inline">administer any necessary oath; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDfce79dbe961f4e1db490485a3564df29"><enum>(C)</enum><text display-inline="yes-display-inline">take testimony or statements and receive
				documents or other things.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id20CA23121B3447A190F280660E660652"><enum>(c)</enum><header display-inline="yes-display-inline">Filing of requests</header><text display-inline="yes-display-inline">Except as provided under subsection (d), an
				application for execution of a request from a foreign authority under this
				section may be filed—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="IDa4f7a2bf3cd84303bd26cd1049c990bf"><enum>(1)</enum><text display-inline="yes-display-inline">in the district in which a person who may
				be required to appear resides or is located or in which the documents or things
				to be produced are located;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID267c315b09b844e48ed14b34309275e8"><enum>(2)</enum><text display-inline="yes-display-inline">in cases in which the request seeks the
				appearance of persons or production of documents or things that may be located
				in multiple districts, in any one of the districts in which such a person,
				documents, or things may be located; or</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9307152fb4604d9d8b5042f0c684d86f"><enum>(3)</enum><text display-inline="yes-display-inline">in any case, the district in which a
				related Federal criminal investigation or prosecution is being conducted, or in
				the District of Columbia.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id669F175C899445DD829685D46F5E74FD"><enum>(d)</enum><header display-inline="yes-display-inline">Search warrant limitation</header><text display-inline="yes-display-inline">An application for execution of a request
				for a search warrant from a foreign authority under this section, other than an
				application for a warrant issued as provided under section 2703 of this title,
				shall be filed in the district in which the place or person to be searched is
				located.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id25C61877CAA147DA85D9F4805C7FA720"><enum>(e)</enum><header display-inline="yes-display-inline">Search warrant standard</header><text display-inline="yes-display-inline">A Federal judge may issue a search warrant
				under this section only if the foreign offense for which the evidence is sought
				involves conduct that, if committed in the United States, would be considered
				an offense punishable by imprisonment for more than one year under Federal or
				State law.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id1CD44B40E9A545ADAC3A5733A373E11C"><enum>(f)</enum><header display-inline="yes-display-inline">Service of order or warrant</header><text display-inline="yes-display-inline">Except as provided under subsection (d), an
				order or warrant issued pursuant to this section may be served or executed in
				any place in the United States.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID246f41605eb34f0cb332b62d16fe4bb6"><enum>(g)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed
				to preclude any foreign authority or an interested person from obtaining
				assistance in a criminal investigation or prosecution pursuant to section 1782
				of title 28, United States Code.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDed56129e559443169ad9cda43a5c780c"><enum>(h)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">As used in this section, the following
				definitions shall apply:</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID8f6ec3482bde4ab3873c40eb40862100"><enum>(1)</enum><header display-inline="yes-display-inline">Federal judge</header><text display-inline="yes-display-inline">The terms <quote>Federal judge</quote> and
				<quote>attorney for the Government</quote> have the meaning given such terms
				for the purposes of the Federal Rules of Criminal Procedure.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa05f140bd19f42cca20f090533cdeba2"><enum>(2)</enum><header display-inline="yes-display-inline">Foreign authority</header><text display-inline="yes-display-inline">The term <quote>foreign authority</quote>
				means a foreign judicial authority, a foreign authority responsible for the
				investigation or prosecution of criminal offenses or for proceedings related to
				the prosecution of criminal offenses, or an authority designated as a competent
				authority or central authority for the purpose of making requests for
				assistance pursuant to an agreement or treaty with the United States regarding
				assistance in criminal matters.</text>
							</paragraph></subsection></section><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE9DE37526C664361B8BC8E1B40D173B8"><enum>(5)</enum><text display-inline="yes-display-inline">in the table of sections for chapter 223,
			 by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id74ab04f3-d3b8-4e6e-9d91-0cca589a7ab4" style="USC">
