			 <quote><short-title>Oregon Caves National Monument
			 Boundary Adjustment Act of 2009</short-title></quote>.</text>
		</section><section changed="deleted" committee-id="SSEG00" id="id05F5DB47E18A477CA3FAF0D6939D3FF1" reported-display-style="strikethrough"><enum>2.</enum><header>Findings;
			 purpose</header>
			<subsection id="idDA6265FD32CD436B95439F4E2C3EFCD5"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
				<paragraph id="id54A97C2B7A574C8C80F0BFC885E5EE26"><enum>(1)</enum><text>the Oregon Caves
			 National Monument—</text>
					<subparagraph id="id932E0112BBB0475197E69A73DB908BC1"><enum>(A)</enum><text>is comprised of a
			 rectangular area of approximately 480 acres located in the Siskiyou Mountains
			 of southern Oregon; and</text>
					</subparagraph><subparagraph id="id2DA86E6D5F714D2A8F12CEA0BB10219E"><enum>(B)</enum><text>was established by
			 Presidential Proclamation Number 876 (36 Stat. 2497), dated July 12, 1909, to
			 protect the caves, which were determined to have unusual scientific interest
			 and importance;</text>
					</subparagraph></paragraph><paragraph id="id349220AB1E634516A143C3E35BDC6ABA"><enum>(2)</enum><text>on June 10, 1933,
			 in accordance with Executive Order 6166 (5 U.S.C. 901 note), the administration
			 of the Monument was transferred from the Secretary of Agriculture to the
			 Secretary of the Interior; and</text>
				</paragraph><paragraph id="id68A5A9973B784BE4B9A09CF8D6246900"><enum>(3)</enum><text>the 1999 general
			 management plan for the Monument contains a recommendation for adding
			 surrounding land to the Monument—</text>
					<subparagraph id="id79816407894248BEB8B71F07B262AADD"><enum>(A)</enum><text>to provide better
			 protection for—</text>
						<clause id="id4DB3A8ECF3BB4CFAB8381B923DEEFB16"><enum>(i)</enum><text>cave
			 ecology;</text>
						</clause><clause id="id365011EB57B6495690C25B282474F073"><enum>(ii)</enum><text>surface and
			 subsurface hydrology;</text>
						</clause><clause id="id9EB27AFBF721449085F9C6A3FC1AD86B"><enum>(iii)</enum><text>public water
			 supplies; and</text>
						</clause><clause id="idB63F0D13168A439284A51BB397704006"><enum>(iv)</enum><text>trails and
			 views;</text>
						</clause></subparagraph><subparagraph id="idC74A0466A2534822BF1D8189D115F0E9"><enum>(B)</enum><text>to establish a
			 logical topographical boundary; and</text>
					</subparagraph><subparagraph id="idF58CB576B0764D17AC56721165D79B2A"><enum>(C)</enum><text>to enhance public
			 outdoor recreation opportunities.</text>
					</subparagraph></paragraph></subsection><subsection id="idAFC81B0A10864323B4C300FB1A6B8CDF"><enum>(b)</enum><header>Purpose</header><text>The
			 purpose of this Act is to add surrounding land to the Monument—</text>
				<paragraph id="idCE6CFBDAC14E4044B9E9987D1AC5EF7C"><enum>(1)</enum><text>to enhance the
			 protection of the resources associated with the Monument; and</text>
				</paragraph><paragraph id="id26A626F14D134197ACF8B8903936D748"><enum>(2)</enum><text>to increase public
			 recreation opportunities.</text>
				</paragraph></subsection></section><section changed="deleted" committee-id="SSEG00" id="id298F3C9EE2A74947810316C0C34CEC70" reported-display-style="strikethrough"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID601c83e74d5548b98b01440b1969f0aa"><enum>(1)</enum><header>Grazing
			 allotment</header><text>The term <term>grazing allotment</term> means—</text>
				<subparagraph id="id79796EAA442346AFB118EEB753EC7DC1"><enum>(A)</enum><text>the Big Grayback
			 Grazing Allotment located in the Rogue River-Siskiyou National Forest;
			 and</text>
				</subparagraph><subparagraph id="idF1444FFA2EE6447DAAC3AED6FA65C567"><enum>(B)</enum><text>the Billy Mountain
			 Grazing Allotment located in a parcel of land that is—</text>
					<clause id="idACC742D298634D2B809C67071DDA8CDC"><enum>(i)</enum><text>managed by the
			 Secretary (acting through the Director of the Bureau of Land Management);
			 and</text>
					</clause><clause id="idB46392B915A141B7A58D8CB8F24E0FD5"><enum>(ii)</enum><text>located in close
			 proximity to the land described in subparagraph (A).</text>
					</clause></subparagraph></paragraph><paragraph id="id712C71033CFD464DA89C65DED5EA7E8A"><enum>(2)</enum><header>Grazing lease;
			 grazing permit</header><text>The terms <term>grazing lease</term> and
			 <term>grazing permit</term> mean any document authorizing the use of a grazing
			 allotment for the purpose of grazing livestock for commercial purposes.</text>
			</paragraph><paragraph id="ID28352a7c499240deb832de19a8451fa2"><enum>(3)</enum><header>Lessee;
			 permittee</header><text>The terms <term>lessee</term> and
			 <term>permittee</term> mean a livestock operator that holds a valid existing
			 grazing lease or permit for a grazing allotment.</text>
			</paragraph><paragraph id="id93859EB7C3AB43F4A2E7ED57158C5787"><enum>(4)</enum><header>Map</header><text>The
			 term <term>map</term> means the map entitled <quote>Oregon Caves National
			 Monument, Proposed Boundary</quote> numbered 150/80,023, and dated June
			 2008.</text>
			</paragraph><paragraph id="id8F30792A3711468A871ED31D1189ACA7"><enum>(5)</enum><header>Monument</header><text>The
			 term <term>Monument</term> means the Oregon Caves National Monument established
			 by Presidential Proclamation Number 876 (36 Stat. 2497), dated July 12,
			 1909.</text>
			</paragraph><paragraph id="id685DE62491D24FCB97B30E8B94703604"><enum>(6)</enum><header>National Park
			 Service site</header><text>The term <term>National Park Service site</term>
			 means the aggregate parcel of land that is comprised of 2 parcels of land
			 depicted on the map as—</text>
				<subparagraph id="id701E73DEF7CF4CB8B5FB91F231C17439"><enum>(A)</enum><text>the
			 <quote>Existing Oregon Caves National Monument</quote>; and</text>
				</subparagraph><subparagraph id="id56372B817FBF4C1FAFA7438DF9FBD9AD"><enum>(B)</enum><text>the
			 <quote>Proposed Addition Lands</quote>.</text>
				</subparagraph></paragraph><paragraph id="idC7817AFC84254242A1ABFA5B9915876E"><enum>(7)</enum><header>National
			 Preserve</header><text>The term <term>National Preserve</term> means the
			 National Preserve designated by section 4(d).</text>
			</paragraph><paragraph id="id8446761F2F2440F68160984378C5BCDF"><enum>(8)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="id28E09BE51B264EEEB1AF747181D642C3"><enum>(9)</enum><header>Secretary
			 concerned</header><text>The term <term>Secretary concerned</term> means—</text>
				<subparagraph id="idA230DA7D1AE64ED5A8965B11429FD3C2"><enum>(A)</enum><text>the Secretary of
			 Agriculture (acting through the Chief of the Forest Service), with respect to
			 National Forest System land; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7F5D46B4D2C44FA1BE152FE16CD9D388"><enum>(B)</enum><text>the Secretary of
			 the Interior, with respect to land managed by the Bureau of Land Management
			 (including land held for the benefit of an Indian tribe).</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id98C8CABF94CB4D45923D8D7F2B3D5014"><enum>(10)</enum><header>State</header><text>The
			 term <term>State</term> means the State of Oregon.</text>
			</paragraph></section><section changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id07037FA1D31840EE8591B7A3FC1D908C" reported-display-style="strikethrough"><enum>4.</enum><header>Boundary
			 adjustment; land transfer; designation</header>
			<subsection commented="no" display-inline="no-display-inline" id="idD08D558A70EE4F41908DDCBE7360FA3D"><enum>(a)</enum><header>Boundary
			 adjustment</header><text>The boundary of the National Park Service site is
			 modified—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id2BA2C155FF854F61850C01776B85E796"><enum>(1)</enum><text>to include
			 approximately 4,070 acres of land identified on the map as the <quote>Proposed
			 Addition Lands</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id906BF67A2389444BB19309081920F6D8"><enum>(2)</enum><text>to exclude
			 approximately 4 acres of land—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id9F96D07BDD6B462A85F6AE6BA34410B1"><enum>(A)</enum><text>located in the
			 City of Cave Junction; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id82DA3ADE0F4D4A85ACD97886E9E4B9C3"><enum>(B)</enum><text>identified on the
			 map as the <quote>Cave Junction Unit</quote>.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idF81644EF4874459F882D9EF35ECA841E"><enum>(b)</enum><header>Land
			 transfer</header><text>The Secretary of Agriculture shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idAFD32A239DDC45E19D55BAF3B5DADC06"><enum>(1)</enum><text>transfer the land
			 described in subsection (a)(1) to the Secretary; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB5D78B61956245B4B94604CBE4F038CE"><enum>(2)</enum><text>adjust the
			 boundary of the Rogue River-Siskiyou National Forest to exclude the land
			 transferred under paragraph (1).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idF09813D1559248EEA4665B2858B5A8E0"><enum>(c)</enum><header>Availability of
			 map</header><text>The map shall be on file and available for public inspection
			 in the appropriate offices of the National Park Service.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id5848A800895649EFB4739ED52CAD7593"><enum>(d)</enum><header>Designation</header><text>The
			 land described in subsection (a)(1) is designated as a National
			 Preserve.</text>
			</subsection></section><section changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="idA92702E894D942FEB5EABCADE5F91177" reported-display-style="strikethrough"><enum>5.</enum><header>Designation of
			 Monument</header>
			<subsection commented="no" display-inline="no-display-inline" id="idA78FEA756644451DA944A7DEDF8A9B6A"><enum>(a)</enum><header>In
			 general</header><text>The Monument shall be known and designated as the
			 <quote>Oregon Caves National Monument and Preserve</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id6ACC4B77722D4CB0B1C1AFE76B04CC5D"><enum>(b)</enum><header>References</header><text>Any
			 reference in a law, map, regulation, document, paper, or other record of the
			 United States to the Monument shall be considered to be a reference to the
			 <quote>Oregon Caves National Monument and Preserve</quote>.</text>
			</subsection></section><section changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id4C684D120233408FA7B4C65A0174B723" reported-display-style="strikethrough"><enum>6.</enum><header>Wild and scenic
			 river designations</header><text display-inline="no-display-inline">Section
			 3(a) of the Wild and Scenic Rivers Act (16 U.S.C. 1274(a)) is amended by adding
			 at the end the following:</text>

				National Monument, Oregon</header><text>The following segments in the State of
				Oregon, to be administered by the Secretary of the Interior:</text>
					<subparagraph id="id38886238B79E4C638B9911F33C1889EF"><enum>(A)</enum><header>Cave
				Creek</header><text>The 2.6-mile segment of Cave Creek from the headwaters at
				the River Styx to the boundary of the Rogue River-Siskiyou National Forest as a
				recreational river.</text>
					</subparagraph><subparagraph id="idB6DB5F24D5D445BEA864119FA7923E95"><enum>(B)</enum><header>Lake
				Creek</header><text>The 3.6-mile segment of Lake Creek from the headwaters at
				Bigelow Lakes to the confluence with Cave Creek as a scenic river.</text>
					</subparagraph><subparagraph id="id78915417615B4A718BEDCF32CABEBB39"><enum>(C)</enum><header>No Name
				Creek</header><text>The 0.6-mile segment of No Name Creek from the headwaters
				to the confluence with Cave Creek as a wild river.</text>
					</subparagraph><subparagraph id="id8C3CB3D434944BB2BD047A8B29AAD0B2"><enum>(D)</enum><header>Panther
				Creek</header><text>The 0.8-mile segment of Panther Creek from the headwaters
				to the confluence with Lake Creek as a scenic river.</text>
					</subparagraph><subparagraph id="idD98C93F7E52B437986C213D348E807B6"><enum>(E)</enum><header>River
				Styx</header><text>The segment of River Styx from the source to the confluence
				with Cave Creek as a recreational river.</text>
					</subparagraph><subparagraph id="id4C757F2D84ED407BBA7589E6A1D6845B"><enum>(F)</enum><header>Upper Cave
				Creek</header><text>The segment of Upper Cave Creek from the headwaters to the
				confluence with River Styx as a recreational
				river.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id8821B41F6EF24E21BF496D7E8CC526E8" reported-display-style="strikethrough"><enum>7.</enum><header>Administration</header>
			<subsection commented="no" display-inline="no-display-inline" id="id7C185CE6E0F3486682324A6275ABAEE0"><enum>(a)</enum><header>In
			 general</header><text>The Secretary, acting through the Director of the
			 National Park Service, shall administer the Monument and the National Preserve
			 in accordance with—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idA2616C78A7EB48C3806110FD1068603A"><enum>(1)</enum><text>this Act;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2115393C3EB54EAD90AB4100CF162C0C"><enum>(2)</enum><text>Presidential
			 Proclamation Number 876 (36 Stat. 2497), dated July 12, 1909; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id92FE6026BB9B4660BAFA8DF8734D9BD1"><enum>(3)</enum><text>any law (including
			 regulations) generally applicable to units of the National Park System,
			 including the National Park Service Organic Act (16 U.S.C. 1 et seq.).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4030050AA6CB4267A6316E2FFDDB3FAD"><enum>(b)</enum><header>Ecological
			 forest restoration activities</header><text>As soon as practicable after the
			 date of enactment of this Act, in accordance with subsection (a), the Secretary
			 shall carry out forest restoration activities within the boundaries of the
			 Monument and the National Preserve—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id1828AED41BBD4153B16D7DB8C3BDB70A"><enum>(1)</enum><text>to reduce the risk
			 of losing key ecosystem components;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id52F31DD218BF42919EC008E2FBC8DFEF"><enum>(2)</enum><text>to restore the
			 proper role of fire in the ecosystem; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBE2F9F59576D4EBA95CF0FFAAFC303F2"><enum>(3)</enum><text>to ensure that
			 forest attributes (including species composition and structure) remain intact
			 and functioning within a historical range.</text>
				</paragraph></subsection></section><section changed="deleted" committee-id="SSEG00" id="idB8EFABD9D4FC404D8C14AA3BA37B4DAC" reported-display-style="strikethrough"><enum>8.</enum><header>Voluntary grazing
			 lease or permit donation program</header>
			<subsection id="id9D03BBE9150A4E20A68D131BC1A4492A"><enum>(a)</enum><header>Donation of
			 lease or permit</header>
				<paragraph id="id9BDC300379C146E8A09D998FE64441DD"><enum>(1)</enum><header>Acceptance by
			 Secretary concerned</header><text>The Secretary concerned shall accept any
			 grazing lease or grazing permit that is donated by a lessee or
			 permittee.</text>
				</paragraph><paragraph id="ID8f9a38a773e24642ac0268ce37222f33"><enum>(2)</enum><header>Termination</header><text>The
			 Secretary concerned shall terminate any grazing lease or grazing permit
			 acquired under paragraph (1).</text>
				</paragraph><paragraph id="ID8b963a00b5c349a3aada9273ee5fa86e"><enum>(3)</enum><header>No new grazing
			 lease or permit</header><text>With respect to each grazing lease or grazing
			 permit donated under paragraph (1), the Secretary concerned shall—</text>
					<subparagraph id="ID16acdf0f88ba44d9bf2bf04e529b5ca7"><enum>(A)</enum><text>not issue any new
			 grazing lease or grazing permit within the grazing allotment covered by the
			 grazing lease or grazing permit; and</text>
					</subparagraph><subparagraph id="ID2e8dccf03a21487d9d5cfca6266fa560"><enum>(B)</enum><text>ensure a permanent
			 end to livestock grazing on the grazing allotment covered by the grazing lease
			 or grazing permit.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id89D295D86FE74CE7ABFF2AE7B7F3143B"><enum>(b)</enum><header>Effect of
			 donation</header><text>A lessee or permittee that donates a grazing lease or
			 grazing permit (or a portion of a grazing lease or grazing permit) under this
			 section shall be considered to have waived any claim to any range improvement
			 on the associated grazing allotment or portion of the associated grazing
			 allotment, as applicable.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id329C700D9EBF4403BA932367D8A55F12"><enum>(c)</enum><header>National
			 Preserve</header><text>With respect to land located within the National
			 Preserve, the Secretary shall permit the grazing of domestic livestock—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idD77476E0C6F64C67810C5F109CFED9F4"><enum>(1)</enum><text>at a level not
			 greater than the level at which the grazing exists as of the date of enactment
			 of this Act; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAF64AAC5187E4E3899A2424865C1226A"><enum>(2)</enum><text>in accordance with
			 each applicable law (including regulations).</text>
				</paragraph></subsection></section><section changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="idD0C4019C34FF4DFEBAD229DF3F652C02" reported-display-style="strikethrough"><enum>9.</enum><header>Hunting, fishing,
			 and trapping</header>
			<subsection commented="no" display-inline="no-display-inline" id="id0987B79DE989494DB489BBBF1CE7132D"><enum>(a)</enum><header>In
			 general</header><text>Except as provided in subsection (b), the Secretary shall
			 permit hunting, fishing, and trapping on land and water within the National
			 Preserve in accordance with each applicable law (including regulations) of the
			 Federal Government and the State.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id685AF1C8C5114A6CAD05F4FDEC976AB9"><enum>(b)</enum><header>Administrative
			 exceptions</header><text>In accordance with subsection (c), the Secretary may
			 designate areas at which, and establish limited periods during which, no
			 hunting, fishing, or trapping may be permitted within the National Preserve due
			 to concerns relating to—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id8FEE0727C39E45BF8AA7E5BAF0E39EDB"><enum>(1)</enum><text>public
			 safety;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFAEB3133785F45C48B5AADD45B483BCB"><enum>(2)</enum><text>the administration
			 of the National Preserve; or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id122386CD60F8483B9BBC5C589CC58136"><enum>(3)</enum><text>the compliance by
			 the Secretary with any applicable law (including regulations).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id456C47DC86FB439BB8AE7559918F1F4C"><enum>(c)</enum><header>Consultation
			 with appropriate State agency</header><text>Except to respond to a situation
			 that the Secretary determines to be an emergency, the Secretary shall consult
			 with the appropriate agency of the State before taking any act to close any
			 area within the National Preserve to hunting, fishing, or trapping.</text>
			</subsection></section><section changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="idAB379F6785BD4D3FAAA071F5ECB47688" reported-display-style="strikethrough"><enum>10.</enum><header>Effect</header><text display-inline="no-display-inline">Nothing in this Act affects the authority or
			 responsibility of the State to carry out any law or duty of the State relating
			 to fish and wildlife on areas located within the National Preserve.</text>
		</section><section changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id5D1EE3BD4CA945549F411BC39DA75594" reported-display-style="strikethrough"><enum>11.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as are necessary to carry out this
			 Act.</text>
		</section></legis-body>
	<legis-body display-enacting-clause="no-display-enacting-clause">
		<section changed="added" committee-id="SSEG00" id="H2C60657637504D23BF72FE7A6C853C4E" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Oregon Caves National Monument
			 Boundary Adjustment Act of 2010</short-title></quote>.</text>
		</section><section changed="added" committee-id="SSEG00" id="HD8785A7C9B7545F0BB8E89821EDAABCD" reported-display-style="italic"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H947AE71B83BE43779840CC558C1357BD"><enum>(1)</enum><header>Map</header><text>The
			 term <term>map</term> means the map entitled <quote>Oregon Caves National
			 Monument and Preserve</quote>, numbered 150/80,023, and dated May 2010.</text>
			</paragraph><paragraph id="H6AD4426FA7CB46239D6DEAC25C835B27"><enum>(2)</enum><header>Monument</header><text>The
			 term <term>Monument</term> means the Oregon Caves National Monument established
			 by Presidential Proclamation Number 876 (36 Stat. 2497), dated July 12,
			 1909.</text>
			</paragraph><paragraph id="H00D6FD1344584C7591C5DC4792FE39C4"><enum>(3)</enum><header>National Monument and
			 Preserve</header><text>The term <term>National Monument and Preserve</term>
			 means the Oregon Caves National Monument and Preserve designated by section
			 3(a)(1).</text>
			</paragraph><paragraph id="id95F49F835BC140F1A4C58FBE0733B288"><enum>(4)</enum><header>National
			 Preserve</header><text>The term <quote>National Preserve</quote> means the
			 National Preserve designated by section 3(a)(2).</text>
			</paragraph><paragraph id="H7329CDB9E97444B2B58C4512AD235805"><enum>(5)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="HD040BEED9DCE4125A4AAAD3A46F5A303"><enum>(6)</enum><header>Secretary
			 concerned</header><text>The term <term>Secretary concerned</term> means—</text>
				<subparagraph id="HBB6C2E54BDF74BA3B0E1EFE84FC3F99A"><enum>(A)</enum><text>the Secretary of
			 Agriculture (acting through the Chief of the Forest Service), with respect to
			 National Forest System land; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H948A8CFCBBDC4271A3470D32B0DD304C"><enum>(B)</enum><text>the Secretary of the
			 Interior, with respect to land managed by the Bureau of Land Management.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9AF70807D03E4FAD83066324EFA18F78"><enum>(7)</enum><header>State</header><text>The
			 term <term>State</term> means the State of Oregon.</text>
			</paragraph></section><section changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="HE7B72C11BD2F489EBFB9CB4FCB708F7D" reported-display-style="italic"><enum>3.</enum><header>Designations; land
			 transfer; boundary adjustment</header>
			<subsection commented="no" display-inline="no-display-inline" id="idCE760F0266A2469AA20E24EFAD389709"><enum>(a)</enum><header>Designations</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id1738458D2F514F3C8ABA2F8F5CF0D2F5"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Monument and the
			 National Preserve shall be administered as a single unit of the National Park
			 System and collectively known and designated as the <quote>Oregon Caves
			 National Monument and Preserve</quote>.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7ABE353ABCC34E12A7C776C28C820F0A"><enum>(2)</enum><header>National
			 Preserve</header><text>The approximately 4,070 acres of land identified on the
			 map as <quote>Proposed Addition Lands</quote> shall be designated as a National
			 Preserve.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HDEF599E63E6B481EB71B3723091AC30A"><enum>(b)</enum><header>Transfer of
			 administrative jurisdiction</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H4CC16636DF9F4C738BAEF5E51629FC96"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Administrative
			 jurisdiction over the land designated as a National Preserve under subsection
			 (a)(2) is transferred from the Secretary of Agriculture to the Secretary, to be
			 administered as part of the National Monument and Preserve.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H26E6D46B48674254A593731535CA45EC"><enum>(2)</enum><header>Exclusion of
			 land</header><text>The boundaries of the Rogue River-Siskiyou National Forest
			 are adjusted to exclude the land transferred under paragraph (1).</text>
				</paragraph></subsection><subsection id="H3DAAD0A16E8E4CF284D47C0A6AD59A5E"><enum>(c)</enum><header>Boundary
			 adjustment</header><text>The boundary of the National Monument and Preserve is
			 modified to exclude approximately 4 acres of land—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H48ADBE20E6F34E63BFE91CD7D3289C0F"><enum>(1)</enum><text>located in the City of
			 Cave Junction; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H67316AFDF42C435D9D3597A9F67C0DA9"><enum>(2)</enum><text>identified on the map as
			 the <quote>Cave Junction Unit</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H3EB31AA49BD74A1EBD32E2ACB09F4BDC"><enum>(d)</enum><header>Availability of
			 map</header><text>The map shall be on file and available for public inspection
			 in the appropriate offices of the National Park Service.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HA8AFA0A4619C4FD8AD0E8BB98BE86B34"><enum>(e)</enum><header>References</header><text>Any
			 reference in a law, map, regulation, document, paper, or other record of the
			 United States to the Monument shall be considered to be a reference to the
			 <quote>Oregon Caves National Monument and Preserve</quote>.</text>
			</subsection></section><section changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="H8799DCDB13B4431E9ECA172C2E6A826F" reported-display-style="italic"><enum>4.</enum><header>Administration</header>
			<subsection commented="no" display-inline="no-display-inline" id="HC1B39669ED244EAB99540E58EF2FC82C"><enum>(a)</enum><header>In
			 general</header><text>The Secretary shall administer the National Monument and
			 Preserve in accordance with—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H23AAC670BE39473484241D98987E9C2D"><enum>(1)</enum><text>this Act;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H696515662E3C411DB01684687975AFA4"><enum>(2)</enum><text>Presidential Proclamation
			 Number 876 (36 Stat. 2497), dated July 12, 1909 ; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H20BF6FC9A654467EB7BCA256B01B0144"><enum>(3)</enum><text>any law (including
			 regulations) generally applicable to units of the National Park System,
			 including the National Park Service Organic Act (16 U.S.C. 1 et seq.).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H39D6C8431C9F440E8DE600E1C61EB02E"><enum>(b)</enum><header>Fire
			 management</header><text display-inline="yes-display-inline">As soon as
			 practicable after the date of enactment of this Act, in accordance with
			 subsection (a), the Secretary shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id80AF869EDE2845DA9676679D6ECFB3CC"><enum>(1)</enum><text display-inline="yes-display-inline">revise the fire management plan for the
			 Monument to include the land transferred under section 3(b)(1); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id13ABFA287142444ABA43C72353DB6B98"><enum>(2)</enum><text display-inline="yes-display-inline">in accordance with the revised plan, carry
			 out hazardous fuel management activities within the boundaries of the National
			 Monument and Preserve.</text>
				</paragraph></subsection><subsection id="H1F6EF6A3D79F427496449C8293DFA4E1"><enum>(c)</enum><header>Existing forest service
			 contracts</header>
				<paragraph id="id2009D5CE6402408B8ADE95C4CE42C5BB"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary
			 shall—</text>
					<subparagraph id="id5B8B2C45F19D4EBEB8EAC7DAEE8A6C06"><enum>(A)</enum><text display-inline="yes-display-inline">allow for the completion of any Forest
			 Service stewardship or service contract executed as of the date of enactment of
			 this Act with respect to the National Preserve; and</text>
					</subparagraph><subparagraph id="idBCE3C7EF71904E9E99A84F965A03EB6C"><enum>(B)</enum><text display-inline="yes-display-inline">recognize the authority of the Secretary of
			 Agriculture for the purpose of administering a contract described in
			 subparagraph (A) through the completion of the contract.</text>
					</subparagraph></paragraph><paragraph id="id89AD395130D9460B9C5E532983DB1F46"><enum>(2)</enum><header>Terms and
			 conditions</header><text display-inline="yes-display-inline">All terms and
			 conditions of a contract described in paragraph (1)(A) shall remain in place
			 for the duration of the contract.</text>
				</paragraph><paragraph id="idEDABEC716E1049678619D69E78DDB6A4"><enum>(3)</enum><header>Liability</header><text display-inline="yes-display-inline">The Forest Service shall be responsible for
			 any liabilities relating to a contract described in paragraph (1)(A).</text>
				</paragraph></subsection><subsection id="H5CABBE17242043AFA870197588239E3E"><enum>(d)</enum><header>Grazing</header>
				<paragraph id="idDE263E200E4D45B3AE24D85FD932178B"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subject to paragraph
			 (2), the Secretary may allow the grazing of livestock within the National
			 Preserve to continue as authorized under permits or leases in existence as of
			 the date of enactment of this Act.</text>
				</paragraph><paragraph id="idF03C60F4F9E54D06966E31B34B8D0D5D"><enum>(2)</enum><header>Applicable
			 law</header><text display-inline="yes-display-inline">Grazing under paragraph
			 (1) shall be—</text>
					<subparagraph id="idE49B0670826B4346ABCA57C5C9D6267C"><enum>(A)</enum><text display-inline="yes-display-inline">at a level not greater than the level at
			 which the grazing exists as of the date of enactment of this Act, as measured
			 in Animal Unit Months; and</text>
					</subparagraph><subparagraph id="id154B8235150743E39AA22F5DD4AD7B0D"><enum>(B)</enum><text display-inline="yes-display-inline">in accordance with each applicable law
			 (including National Park Service regulations).</text>
					</subparagraph></paragraph></subsection><subsection id="ID5ec6318a78f3422bb30470207e4f2d85"><enum>(e)</enum><header>Fish and
			 wildlife</header><text>The Secretary shall permit hunting and fishing on land
			 and waters within the National Preserve in accordance with applicable Federal
			 and State laws, except that the Secretary may, in consultation with the Oregon
			 Department of Fish and Wildlife, designate zones in which, and establish
			 periods during which, no hunting or fishing shall be permitted for reasons of
			 public safety, administration, or compliance by the Secretary with any
			 applicable law (including regulations).</text>
			</subsection></section><section changed="added" committee-id="SSEG00" id="H8165B323B5BF4EBCBB501D103CFA7EFB" reported-display-style="italic"><enum>5.</enum><header>Voluntary grazing lease
			 or permit donation program</header>
			<subsection id="HD81D0581E8094837A0CE7B56D7860626"><enum>(a)</enum><header>Donation of lease or
			 permit</header>
				<paragraph id="HE3E4EA156A7740FFA6CEF46683E02382"><enum>(1)</enum><header>Acceptance by Secretary
			 concerned</header><text display-inline="yes-display-inline">The Secretary
			 concerned shall accept a grazing lease or permit that is donated by a lessee or
			 permittee for—</text>
					<subparagraph id="H71EE81235E414340A774C338DDBAA72B"><enum>(A)</enum><text display-inline="yes-display-inline">the Big Grayback Grazing Allotment located
			 in the Rogue River-Siskiyou National Forest; and</text>
					</subparagraph><subparagraph id="H248D888B33B94E728C2A16128347D28D"><enum>(B)</enum><text>the Billy Mountain
			 Grazing Allotment located on a parcel of land that is managed by the Secretary
			 (acting through the Director of the Bureau of Land Management).</text>
					</subparagraph></paragraph><paragraph id="H64549C393F7946D69E6EEC69B8309DB2"><enum>(2)</enum><header>Termination</header><text display-inline="yes-display-inline">With respect to each grazing permit or
			 lease donated under paragraph (1), the Secretary shall—</text>
					<subparagraph id="HEE154A3DCEA843978F7BB597649F4754"><enum>(A)</enum><text display-inline="yes-display-inline">terminate the grazing permit or lease;
			 and</text>
					</subparagraph><subparagraph id="H7B46D6A08FB34D52B6A34CA411ACF22A"><enum>(B)</enum><text>ensure a permanent end to
			 grazing on the land covered by the grazing permit or lease.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H243E739CF6BE407E98AD85EA81B7D803"><enum>(b)</enum><header>Effect of
			 donation</header><text>A lessee or permittee that donates a grazing lease or
			 grazing permit (or a portion of a grazing lease or grazing permit) under this
			 section shall be considered to have waived any claim to any range improvement
			 on the associated grazing allotment or portion of the associated grazing
			 allotment, as applicable.</text>
			</subsection></section><section changed="added" committee-id="SSEG00" id="H76D2AEA9D09D4000A3FD7C3DFDDA6148" reported-display-style="italic"><enum>6.</enum><header>Wild and scenic river
			 designations</header>
			<subsection id="id2795D9B34F0E4CB59221257CB0C01E42"><enum>(a)</enum><header>Designation</header><text display-inline="yes-display-inline">Section 3(a) of the Wild and Scenic Rivers
			 Act (16 U.S.C. 1274(a)) is amended by adding at the end the following:</text>

			 additions</header>
				<paragraph id="idC4B2093837F5427BB15B4C2F36A1E021"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 5(a) of the
			 Wild and Scenic Rivers Act (16 U.S.C. 1276(a)) is amended by adding at the end

				Creek</header><text>The 0.8-mile segment of Panther Creek from the headwaters
