			 Medicaid coverage of advanced illness care management services</header>
			<subsection id="id6AF858AC982241BD8E568D3CFC596135"><enum>(a)</enum><header>Medicare
			 coverage of advanced illness care management services</header>
				<paragraph id="idBD5C2048B01C4EA4A6BF733531DB0080"><enum>(1)</enum><header>Coverage</header><text>Section
			 1812(a)(5) of the Social Security Act (42 U.S.C. 1395d(a)(5)) is amended to
			 read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="id0E981308322842DCBDD10FB69691451A" style="OLC">
						<paragraph id="IDdb0567744e774c12af793566c7cd09bb"><enum>(5)</enum><text>for individuals
				who have a life expectancy of 18 months or less and who have not made an
				election under subsection (d)(1) to receive hospice care under this part,
				advanced illness care management services (as defined in section
				1861(hhh)).</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idDBD19A426C324FBDA0F118EAB23DB6F2"><enum>(2)</enum><header>Definition</header><text>Section
			 1861 of the Social Security Act (42 U.S.C. 1395x) is amended by adding at the
			 end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="idB54635B29AC447A6BACB51425DB6532E" other-style="archaic" style="other">
						<subsection id="id17C404EF8FEE4055866702AC0C4EFF63"><enum>(hhh)</enum><header>Advanced illness care management
		  services</header><paragraph commented="no" display-inline="yes-display-inline" id="idBCAB4124FAD240C3B1B357A8BC2C54A4"><enum>(1)</enum><text>The term <term>advanced
				illness care management services</term> means the following services furnished
				to an individual by a hospice program, as defined in subsection (dd)(2):</text>
								<subparagraph id="idC8A338EA960045539547DA756EE558A2" indent="up1"><enum>(A)</enum><text>Palliative care consultation
				services.</text>
								</subparagraph><subparagraph id="idA97BAC57FF684C2F81C810F51E16E7D6" indent="up1"><enum>(B)</enum><text>Care planning services.</text>
								</subparagraph><subparagraph id="id238FDCF80CDD42C984778406F94F6B21" indent="up1"><enum>(C)</enum><text>Counseling of individual and family
				members.</text>
								</subparagraph><subparagraph id="id2CF0FBE5D2CD43E2B5B7E982983DEEC2" indent="up1"><enum>(D)</enum><text>Discussions regarding the availability
				of supportive services (including information on advance care planning).</text>
								</subparagraph><subparagraph id="id8FBD2B4B20DA447785C00A58ACB34E1C" indent="up1"><enum>(E)</enum><text>Patient-centered care.</text>
								</subparagraph><subparagraph id="id5519538B49674470A0AD38A79A569DB7" indent="up1"><enum>(F)</enum><text>Family conference services.</text>
								</subparagraph><subparagraph id="idDFB9D39AF1254ED2BB65763D411CD1B4" indent="up1"><enum>(G)</enum><text>Respite services.</text>
								</subparagraph><subparagraph id="id0055254580084FA69FCFD6E4CC9875E5" indent="up1"><enum>(H)</enum><text>Onsite caregiver training.</text>
								</subparagraph><subparagraph id="idAE0B1068F9AA4B7E8EA9A0EBF301B000" indent="up1"><enum>(I)</enum><text>Such other services as may be
				appropriate under a hospice model of care.</text>
								</subparagraph></paragraph><paragraph id="id348D026CD7A54C05ADE0006D06172B97" indent="up1"><enum>(2)</enum><text>For purposes of paragraph (1)(F), the
				term <term>family conference services</term> means a family conference held by
				a hospice program (as so defined) for the individual and the family members of
				the individual, including services for the facilitation and provision of
				adequate follow-up to such family conference, which includes additional
				collaboration and coordination with the hospice physician or other hospice
				personnel to clarify and put into action the goals of care as outlined by the
				individual and the family members of the individual.</text>
							</paragraph><paragraph id="idABD81C3AFF1A41B88F715E59AA1D0ABF" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idC48C90CDBB474A1DAF36E0321FF07371"><enum>(A)</enum><text>For purposes of
				paragraph (1)(G), the term <term>respite services</term> means the provision of
				additional hours of care to individuals who are unable to perform 2 or more
				activities of daily living. Such services shall be targeted toward furnishing
				services to the individual and providing the caregivers of the individual a
				needed break outside of the home of the individual.</text>
								</subparagraph><subparagraph id="idEE2194837A91422B912C4826BF9A53D9" indent="up1"><enum>(B)</enum><text>For purposes of subparagraph (A), the
				Secretary shall establish, on an annual basis, a minimum and maximum number of
				hours (not to exceed 16 hours each month) for which respite services may be
				provided to individuals eligible to receive such services.</text>
								</subparagraph><subparagraph id="id3F8B077818034788B535F7B1B43D7553" indent="up1"><enum>(C)</enum><text>In subparagraph (A), the term
				<quote>activities of daily living</quote> means bathing, transferring,
				toileting, and feeding.</text>
								</subparagraph></paragraph><paragraph id="id1D96FA6F544D470B8FB89AAAF3A54222" indent="up1"><enum>(4)</enum><text>For purposes of paragraph (1)(H), the
				term <term>onsite caregiver training</term> means training provided to the
				caregivers of an individual, which is focused on training such caregivers to
				provide effective personal and technical care to individuals, with an emphasis
				on what the caregiver can expect with the disease process of the individual or
				the needs of the individual at the end of life. Such training shall be
				pragmatic and easily understood by non-health professionals as well as
				culturally and educationally appropriate.</text>
							</paragraph><paragraph id="id6F0AC8349FE94CC69B114ED185E85023" indent="up1"><enum>(5)</enum><text>In the case of a hospice program that
				is furnishing advanced illness care management services to an individual who
				becomes eligible for hospice care under this title, the hospice program shall
				notify the individual of such
				eligibility.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id0C2A9480131B407B83B7A2E5128F4C7B"><enum>(3)</enum><header>Payment based
			 on the physician fee schedule</header><text>Section 1814(i)(4) of the Social
			 Security Act (42 U.S.C. 1395f(i)(4)) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="id70999EEC354B48AE9826157BD9FE433E" style="OLC">
						<paragraph id="ID2178c776a21a48e4a484c7d62335592c" indent="up1"><enum>(4)</enum><text>The amount paid to a hospice program
				with respect to the advanced illness care management services (as defined in
				section 1861(hhh)) for which payment may be made under this part shall
				be—</text>
							<subparagraph id="id0988AD8DFB8C4FF0A1DA820F87878379"><enum>(A)</enum><text>with respect to such services, other
				than respite services, furnished by a hospice physician, an amount equal to the
				amount that would be paid for an equivalent physician consultation under the
				fee schedule established under section 1848(b);</text>
							</subparagraph><subparagraph id="id82840E34DA0F4D00AA897F0F62C37C2B"><enum>(B)</enum><text>with respect to such services, other
				than respite services, furnished by other hospice personnel, an amount equal to
				85 percent of such fee schedule amount; and</text>
							</subparagraph><subparagraph id="id1ACB8D81661E4EDDA6594062656A6AE9"><enum>(C)</enum><text>with respect to respite services,
				payment shall be at an appropriate rate to be determined by the
				Secretary</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="IDB495C052286049D7BDE800613D09F1AF"><enum>(4)</enum><header>Conforming
			 amendments</header><text>Section 1862(a) of the Social Security Act (42 U.S.C.
			 1395y(a)) is amended—</text>
					<subparagraph id="idDEF310081D0B41FFB3A12F7CB1470690"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
						<clause id="id48DAF53B019C4F2F850652256D9EBD9A"><enum>(i)</enum><text>by
			 striking <quote>and</quote> at the end of subparagraph (N);</text>
						</clause><clause id="idEDE50F95905649468A553A7576BDA561"><enum>(ii)</enum><text>by
			 striking the semicolon at the end of subparagraph (O) and inserting <quote>,
			 and</quote>; and</text>
						</clause><clause id="id5CB000EA2C904CA49545C493A8D0A32B"><enum>(iii)</enum><text>by adding at
			 the end the following new subparagraph:</text>
							<quoted-block display-inline="no-display-inline" id="ID504CE20A5AEE4D18A47A0B630CDD8650" style="OLC">
								<subparagraph id="IDEFF9FAA79F24475AB4600A8908D2599E"><enum>(P)</enum><text>in the case of
				advanced illness care management services which are respite services (as
				defined in section 1861(hhh)(3)), which are performed more frequently than is
				provided under clause (ii) of such
				section;</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="id9A7B1B29D18E4B08876F17B218B0CE87"><enum>(B)</enum><text>in paragraph (7),
			 by striking <quote>or (K)</quote> and inserting <quote>(K), or
			 (P)</quote>.</text>
					</subparagraph></paragraph><paragraph id="id376928E0D72E408F8BB8C9FF5C4F4CCA"><enum>(5)</enum><header>Effective
			 date</header><text>The amendments made by this subsection shall apply to
			 services furnished on or after January 1, 2011.</text>
				</paragraph></subsection><subsection id="id74303F2761CB4271AAB35A794A00994E"><enum>(b)</enum><header>Medicaid
			 coverage of advanced illness care management services</header>
				<paragraph id="HECBB9813752948F39B96B1A300CA8458"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1905(a) of
			 the Social Security Act (42 U.S.C. 1396d(a)) is amended—</text>
					<subparagraph id="HE7FCDC99BC754699B8C107177F00E8FE"><enum>(A)</enum><text>by redesignating
			 paragraph (28) as paragraph (29);</text>
					</subparagraph><subparagraph id="H00AE09514F7C4330811C6625CA92A1B4"><enum>(B)</enum><text>in paragraph (27),
			 by striking at the end <quote>and</quote>; and</text>
					</subparagraph><subparagraph id="H81EBC53712EE4880BB2D00DDA68FE2CC"><enum>(C)</enum><text>by inserting after
			 paragraph (27) the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="H70BEA55E6D984789A31FECB289FBE873" style="OLC">
							<paragraph id="H5694C272DB314265B921E62698A40E2"><enum>(28)</enum><text display-inline="yes-display-inline">advanced illness care management services
				(as defined in section 1861(hhh)) for individuals described in section
				1812(a)(5);
				and</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD1F951EF21E84155B85F911D6C7FD648"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 1902(a)(10)(A) of the Social Security Act (42
			 U.S.C. 1396a(a)(10)(A)) is amended by striking <quote>and (21)</quote> and
			 inserting <quote>, (21), and (28)</quote>.</text>
				</paragraph><paragraph id="idF1136791AC9A4C38A4C5412A0CDF152B"><enum>(3)</enum><header>Effective
			 date</header>
					<subparagraph id="IDecb93152b86a4c3583e6db11d0b550dd"><enum>(A)</enum><header>In
			 general</header><text>Except as provided in subparagraph (B), the amendments
			 made by paragraphs (1) and (2) take effect on January 1, 2011.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe8a423118de44d0c895c89344129aef2"><enum>(B)</enum><header>Extension of
			 effective date for State law amendment</header><text>In the case of a State
			 plan under title XIX of the Social Security Act (42 U.S.C. 1396 et seq.) which
			 the Secretary determines requires State legislation in order for the plan to
			 meet the additional requirements imposed by the amendments made by paragraph
			 (1), the State plan shall not be regarded as failing to comply with the
			 requirements of such title solely on the basis of its failure to meet these
			 additional requirements before the first day of the first calendar quarter
			 beginning after the close of the first regular session of the State legislature
			 that begins after the date of enactment of this Act. For purposes of the
			 previous sentence, in the case of a State that has a 2-year legislative
			 session, each year of the session is considered to be a separate regular
			 session of the State legislature.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA4E05866B2724BC799A46F10E71DDFF7"><enum>(c)</enum><header>Education on
			 advanced illness care management services</header><text>The Secretary of Health
			 and Human Services (in this section referred to as the
			 <quote>Secretary</quote>) shall establish a program under which physicians (as
			 defined in subsection (r) of section 1861 of the Social Security Act (42 U.S.C.
			 1395x)) are educated on the coverage of advanced illness care management
			 services (as defined in subsection (hhh) of such section) under the Medicare
			 and Medicaid programs under titles XVIII and XIX, respectively, of the Social
			 Security Act (42 U.S.C. 1395 et seq.; 1396 et seq.), including the importance
			 of early intervention in providing such care to individuals.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID8B2A3C2995A1413EAF55A7ECC3E722AF"><enum>3.</enum><header display-inline="yes-display-inline">Increasing awareness of the importance of
			 end-of-life planning</header><text display-inline="no-display-inline">Title III
			 of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42
			 U.S.C. 241 et seq.) is amended by adding at the end the following new
			 part:</text>
			<quoted-block act-name="Public Health Service Act" display-inline="no-display-inline" id="IDDC9D2745EF7644E191BC9611471E2BB0" style="OLC">
				<part commented="no" id="ID1896F3532A5340CB960585C40A1679AC" level-type="subsequent"><enum>S</enum><header display-inline="yes-display-inline">PROGRAMS TO INCREASE AWARENESS OF ADVANCE
				CARE PLANNING ISSUES</header>
					<section commented="no" display-inline="no-display-inline" id="ID006538F18C054EA59479C95E9231DE6F" section-type="subsequent-section"><enum>399GG.</enum><header display-inline="yes-display-inline">Advance care planning education campaigns
				and information phone line and clearinghouse</header>
						<subsection commented="no" display-inline="no-display-inline" id="ID7E8E06C22F50408CBAE9FBAA8012D8E6"><enum>(a)</enum><header display-inline="yes-display-inline">Advance care planning education
				campaign</header><text display-inline="yes-display-inline">The Secretary shall,
				directly or through grants awarded under subsection (c), conduct a national
				public education campaign—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID939077CFA5D34C03968FCF38CA3F2172"><enum>(1)</enum><text display-inline="yes-display-inline">to raise public awareness of the importance
				of planning for care near the end of life;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID95512A9945E042CBBDE3BDD801409D84"><enum>(2)</enum><text display-inline="yes-display-inline">to improve the public’s understanding of
				the various situations in which individuals may find themselves if they become
				unable to express their health care wishes;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID580D0038FF9E4D20A36195827F2D27D5"><enum>(3)</enum><text display-inline="yes-display-inline">to explain the need for readily available
				legal documents that express an individual’s wishes through—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idE0FA91A1C99841B698E5C25C0BFB1858"><enum>(A)</enum><text display-inline="yes-display-inline">advance directives (including living wills,
				comfort care orders, and durable powers of attorney for health care);
				and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBEB7E25F6FCC4D279EFE50D82162808F"><enum>(B)</enum><text>other planning
				tools, such as a physician’s orders for life-sustaining treatment (POLST);
				and</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8B49FCFF8CBD4CE3A1225FDA1BA9DB07"><enum>(4)</enum><text display-inline="yes-display-inline">to educate the public about the
				availability of hospice care and palliative care.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID23C99369F60B4B90BA76E557DCCDA753"><enum>(b)</enum><header display-inline="yes-display-inline">Information phone line and
				clearinghouse</header><text display-inline="yes-display-inline">The Secretary,
				directly or through grants awarded under subsection (c), shall provide for the
				establishment of a national, toll-free, information telephone line and a
				clearinghouse that the public and health care professionals may access to find
				out about State-specific and other information regarding advance directive and
				end-of-life decisions.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID50D377EBB6794B44982D743AD24BF468"><enum>(c)</enum><header display-inline="yes-display-inline">Grants</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID087E0F53F6A44D219D1E45AAFEEF5A1A"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall use funds appropriated
				under subsection (d) for the purpose of awarding grants to public or nonprofit
				private entities (including States or political subdivisions of a State), or a
				consortium of any of such entities, for the purpose of conducting education
				campaigns under subsection (a).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9A3D37D75E8645598BF1275F0D7F2993"><enum>(2)</enum><header display-inline="yes-display-inline">Period</header><text display-inline="yes-display-inline">Any grant awarded under paragraph (1) shall
				be for a period of 3 years.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2930A2D09A7C4A1F931CA25F66350987"><enum>(d)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id59B24E84604B4A23A6B3B35FBF8F9C43"><enum>(1)</enum><text display-inline="yes-display-inline">for purposes of carrying out subsection
				(b), $5,000,000 for fiscal year 2010 and each subsequent year; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9C42C14189534D2FA8669F12F40C129D"><enum>(2)</enum><text display-inline="yes-display-inline">for purposes of making grants under
				subsection (c), $10,000,000 for fiscal year 2010, to remain available until
				expended.</text>
							</paragraph></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="id6CBC4EEF35C5407FBF008941B9D0C6A0"><enum>4.</enum><header>Inclusion of
			 end-of-life planning materials in the Medicare &amp; You handbook</header>
			<subsection commented="no" display-inline="no-display-inline" id="idE8AF512B8F0646468A38891DBD7A91B2"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1804(a) of
			 the Social Security Act (42 U.S.C. 1395b–2(a)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id980B3826A1ED4D66B926DEE2BF0D8421"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking
			 <quote>and</quote> at the end;</text>

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id67A21806B9614E62AE19722DFD772D00"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to notices
			 distributed on or after January 1, 2011.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id1CD3E957ACEC46DF8605BD52E2F923EB"><enum>5.</enum><header>Senior
			 Navigation Advisory Board</header>
			<subsection id="IDa59ca39b727940069a6a494f44885d13"><enum>(a)</enum><header>Establishment</header><text>The
			 Secretary of Health and Human Services shall establish the Senior Navigation
			 Advisory Board (in this section referred to as the <term>Advisory
			 Board</term>).</text>
			</subsection><subsection id="ID4306ae1fc8744e9f86830f200aacfec3"><enum>(b)</enum><header>Membership</header><text>The
			 Board shall be comprised of advocates, researchers, government officials,
			 health care providers, ethicists, caregivers, and other individuals with
			 expertise in issues related to end-of-life care.</text>
			</subsection><subsection id="id7AE6E7EDB7DC4A628F7AF5CB9EC315CE"><enum>(c)</enum><header>Duties</header><text>The
			 Advisory Board shall advise the Secretary on issues related to end-of-life care
			 and advance care planning, including how to—</text>
				<paragraph id="idDAE80F94FEB6437BBC2C4D88E67B41CC"><enum>(1)</enum><text>increase
			 patients’ quality of life;</text>
				</paragraph><paragraph id="idED6D682723EE4326832EC2D023BB3F9F"><enum>(2)</enum><text>reduce current
			 legal hurdles to the enforcement of advance directives;</text>
				</paragraph><paragraph id="idE9FE8A6431FF45AEA6218B459B1887E8"><enum>(3)</enum><text>encourage
			 provider participation in educational and training activities surrounding
			 advanced illnesses and end-of-life care planning;</text>
				</paragraph><paragraph id="ID652a73767afa4bacb577dc489086004a"><enum>(4)</enum><text>develop quality
			 and outcome measures that hospice programs should report for advanced illness
			 care management services (as defined in section 1861(hhh) of the Social
			 Security Act, as added by section 2);</text>
				</paragraph><paragraph id="id1D820D9CE5E642ACABA65495809320C9"><enum>(5)</enum><text>determine what
			 information should be discussed in discharge planning; and</text>
				</paragraph><paragraph id="idB9470495F55A4791A8DCA14340DC1A0D"><enum>(6)</enum><text>enhance advance
			 care planning.</text>
				</paragraph></subsection><subsection id="IDfd92f8ece9014c3db1053bb37a4ab283"><enum>(d)</enum><header>Application of
			 FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall
			 apply to the Advisory Board.</text>
			</subsection><subsection id="ID1e930891797049deaadf64e296666dd3"><enum>(e)</enum><header>Pay and
			 reimbursement</header>
				<paragraph id="ID4cdcd90acf864d3681050bbb6e992b04"><enum>(1)</enum><header>No compensation
			 for members of Advisory Board</header><text>Except as provided in paragraph
			 (2), a member of the Advisory Board may not receive pay, allowances, or
			 benefits by reason of their service on the Board.</text>
				</paragraph><paragraph id="ID081f631ec456400a8afb056961c8d7d4"><enum>(2)</enum><header>Travel
			 expenses</header><text>Each member shall receive travel expenses, including per
			 diem in lieu of subsistence under subchapter I of chapter 57 of title 5, United
			 States Code.</text>
				</paragraph></subsection><subsection id="idBFF551656A524F318966D7B67031A2EB"><enum>(f)</enum><header>Report</header><text>Not
			 later than 3 years after the establishment of the Advisory Board, the Advisory
			 Board shall submit to Congress a final report containing the findings and
			 conclusions of the Advisory Board, together with recommendations for such
			 legislation and administrative actions as the Advisory Board considers
			 appropriate.</text>
			</subsection><subsection id="id4CED818843104B529A9C169633971D86"><enum>(g)</enum><header>Termination</header><text>The
			 Advisory Board shall terminate 30 days after submitting the report under
			 subsection (f).</text>
			</subsection><subsection id="id0C2882E65E824976B6073B879AEC8E5F"><enum>(h)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated such
			 sums as may be necessary to carry out this section.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="idFAA9938B3C714901BE2E5E3534EA7BD2"><enum>6.</enum><header>Requirement for
			 physicians and nurse practitioners to provide certain Medicare beneficiaries
			 with information on advance directives and other end-of-life planning
			 tools</header><text display-inline="no-display-inline">Section 1834 of the
			 Social Security Act (42 U.S.C. 1395m) is amended by adding at the end the
			 following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="id07EE596646DC44F0A90B0DF18D23EF41" style="OLC">
				<subsection commented="no" display-inline="no-display-inline" id="idEDBD1582E8DF40229DA9D60BB251161E"><enum>(n)</enum><header>Requirement for
				physicians and nurse practitioners To provide certain individuals with
				information on advance directives and other end-of-life planning tools</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id44BB9A34C1E84BB3816DE9050FE0FC88"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">No payment may be
				made under this title to a physician (as defined in section 1861(r)) or a nurse
				practitioner (as defined in section 1861(aa)(5)(A)) for items and services
				furnished on or after January 1, 2014, unless the physician or nurse
				practitioner agrees (under a process established by the Secretary) to provide
				individuals described in paragraph (2) with information on advance directives
				and other end-of-life planning tools. Such information shall be provided in a
				form and manner, and at a time, determined appropriate by the Secretary.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id529A9E9A4B6D458F8CB58CD2D584F407"><enum>(2)</enum><header>Individual
				described</header><text>An individual described in this paragraph is an
				individual entitled to, or enrolled for, benefits under part A or enrolled for
				benefits under this part with—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id91B0150689234357936F1F1E4752F5D2"><enum>(A)</enum><text>metastatic solid
				organ cancer;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idECCF4EAAAB0349ACB9C2B78C1ACCAA53"><enum>(B)</enum><text>congestive heart
				failure;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF93E1BAD962043329D728D378C9DD99F"><enum>(C)</enum><text>end stage renal
				disease;</text>
						</subparagraph><subparagraph id="ID97c06c6a9dbb4c9ab91eae72d59af086"><enum>(D)</enum><text>a progressive
				neurodegenerative disorder;</text>
						</subparagraph><subparagraph id="id27507640FEC14DA3840CE0430DA2E4E7"><enum>(E)</enum><text>oxygen dependent
				chronic pulmonary disease; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id03D0D19A84DD445B81342A61B1D2BE1F"><enum>(F)</enum><text>any other
				condition with a similar level of medical necessity determined appropriate by
				the
				Secretary.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="IDD773C462BF734C3D8C0D9AAB226658D1"><enum>7.</enum><header display-inline="yes-display-inline">Improvement of policies related to the use
			 and portability of advance directives</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID36490EE859764D9DA28067A60A774AA7"><enum>(a)</enum><header display-inline="yes-display-inline">Medicare</header><text display-inline="yes-display-inline">Section 1866(f) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1395cc(f)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDA042B6E29CB847ACA91E8B06D6145FDA"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID01DB59144C9E40D89EF1D082CF2E0CA9"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (B), by inserting
			 <quote>and if presented by the individual (or on behalf of the individual), to
			 include the content of such advance directive in a prominent part of such
			 record</quote> before the semicolon at the end;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID734715BD774C4759B5603E01B4F8921A"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking
			 <quote>and</quote> after the semicolon at the end;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID178D8ABDBB7D48F6A095B7950962234E"><enum>(C)</enum><text display-inline="yes-display-inline">in subparagraph (E), by striking the period
			 at the end and inserting <quote>; and</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDCF9B9660327A45E6941A93BCC91AF5F5"><enum>(D)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (E) the
			 following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="ID95BB87CBEB7F4F72A08472CC7BBC5570" style="OLC">
							<subparagraph commented="no" display-inline="no-display-inline" id="IDDF36F3690D764A2C86A86BFDB3EDF522" indent="up1"><enum>(F)</enum><text display-inline="yes-display-inline">to
				provide each individual with the opportunity to discuss issues relating to the
				information provided to that individual pursuant to subparagraph (A) with an
				appropriately trained
				professional.</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1EF6A16BA2FE41479B6720FFF951C803"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking <quote>a
			 written</quote> and inserting <quote>an</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE204D020D9804178ADC4F5FEE9DA0D3A"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="ID35C2DBED670347058D7B8CE4817C4BFF" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="IDD189690470334216854C15581D8AD354" indent="up1"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="ID1C27FE6DCDEE4E4FA34DD8C8AFA183EF"><enum>(A)</enum><text display-inline="yes-display-inline">In addition to the requirements of
				paragraph (1), a provider of services, Medicare Advantage organization, or
				prepaid or eligible organization (as the case may be) shall give effect to an
				advance directive executed outside the State in which such directive is
				presented, even one that does not appear to meet the formalities of execution,
				form, or language required by the State in which it is presented to the same
				extent as such provider or organization would give effect to an advance
				directive that meets such requirements, except that a provider or organization
				may decline to honor such a directive if the provider or organization can
				reasonably demonstrate that it is not an authentic expression of the
				individual’s wishes concerning his or her health care. Nothing in this
				paragraph shall be construed to authorize the administration of medical
				treatment otherwise prohibited by the laws of the State in which the directive
				is presented.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDFD136F41845B4FCFAA8079F58C0B6BEF" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The provisions of this paragraph shall
				preempt any State law to the extent such law is inconsistent with such
				provisions. The provisions of this paragraph shall not preempt any State law
				that provides for greater portability, more deference to a patient’s wishes, or
				more latitude in determining a patient’s
				wishes.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDFFB2B5D619C14223A89685EA1A8230AC"><enum>(b)</enum><header display-inline="yes-display-inline">Medicaid</header><text display-inline="yes-display-inline">Section 1902(w) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1396a(w)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDDD9B3B4B70C6420AA3726923BFA07FE7"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDD73FD4D1067C46A8B68FE2FE737114A0"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (B)—</text>
						<clause commented="no" display-inline="no-display-inline" id="ID06B20AAC476C4D10B8D3EFBBA98DEE2C"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>in the individual’s
			 medical record</quote> and inserting <quote>in a prominent part of the
			 individual’s current medical record</quote>; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID775AE0144EF747489CA11F597379D032"><enum>(ii)</enum><text display-inline="yes-display-inline">by inserting <quote>and if presented by the
			 individual (or on behalf of the individual), to include the content of such
			 advance directive in a prominent part of such record</quote> before the
			 semicolon at the end;</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA9F91E198C544ACF80531288A9E82EA7"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking
			 <quote>and</quote> after the semicolon at the end;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID719778E11E2E4E759528A1EB8328A27A"><enum>(C)</enum><text display-inline="yes-display-inline">in subparagraph (E), by striking the period
			 at the end and inserting <quote>; and</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3FCFD9815C1F4F06AFE1729E8ABABAC9"><enum>(D)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (E) the
			 following new subparagraph:</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID21D163A6A9F148F8ADBFFB031E5606E5"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking <quote>a
			 written</quote> and inserting <quote>an</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7F954568DCAF4ADA90B24B1D27A4BC78"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following
			 paragraph:</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3954E560FEA642BC945E3855CB6CD7CF" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The provisions of this paragraph shall
				preempt any State law to the extent such law is inconsistent with such
				provisions. The provisions of this paragraph shall not preempt any State law
				that provides for greater portability, more deference to a patient’s wishes, or
				more latitude in determining a patient’s
				wishes.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDACAE5173DDA24F5089ECD33A8934E7E5"><enum>(c)</enum><header display-inline="yes-display-inline">Effective Dates</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDFD2528A9ED4343DFA55A7580BB39EAE6"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), the amendments
			 made by subsections (a) and (b) shall apply to provider agreements and
			 contracts entered into, renewed, or extended under title XVIII of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395 et
			 seq.), and to State plans under title XIX of such Act (42 U.S.C. 1396 et seq.),
			 on or after such date as the Secretary of Health and Human Services specifies,
			 but in no case may such date be later than 1 year after the date of enactment
			 of this Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID400CA3FD32064566A8FB7828C4BB7C7E"><enum>(2)</enum><header display-inline="yes-display-inline">Extension of effective date for State law
			 amendment</header><text display-inline="yes-display-inline">In the case of a
			 State plan under title XIX of the <act-name parsable-cite="SSA">Social Security
			 Act</act-name> (42 U.S.C. 1396 et seq.) which the Secretary of Health and Human
			 Services determines requires State legislation in order for the plan to meet
			 the additional requirements imposed by the amendments made by subsection (b),
			 the State plan shall not be regarded as failing to comply with the requirements
			 of such title solely on the basis of its failure to meet these additional
			 requirements before the first day of the first calendar quarter beginning after
			 the close of the first regular session of the State legislature that begins
			 after the date of enactment of this Act. For purposes of the previous sentence,
			 in the case of a State that has a 2-year legislative session, each year of the
			 session is considered to be a separate regular session of the State
			 legislature.</text>
				</paragraph></subsection></section><section id="id1D6D3BAA05454981959EB715D7A4AAD2"><enum>8.</enum><header>Additional
			 requirements for facilities</header>
			<subsection id="ID97847624A5324A1FACEB61CB8F4E74E8"><enum>(a)</enum><header>Requirements</header>
				<paragraph id="id1A826E8E81D14E3E83CB892DD8868AE0"><enum>(1)</enum><header>In
			 general</header><text>Section 1866(a)(1) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395cc(a)(1)) is
			 amended—</text>
					<subparagraph id="idBB46F61BB8364CB0B49A3F108130DF7F"><enum>(A)</enum><text>in subsection
			 (a)(1)—</text>
						<clause id="ID24FC77BFF9114D97BFBC5013D6CA4E70"><enum>(i)</enum><text>in
			 subparagraph (U), by striking <quote>and</quote> at the end;</text>
						</clause><clause id="ID7A8AF1C53E704A12AE7658B6EC862279"><enum>(ii)</enum><text>in
			 subparagraph (V), by striking the period at the end and inserting a comma;
			 and</text>
						</clause><clause id="ID8EDC8D0CA96F4B45B429A897AD4A998E"><enum>(iii)</enum><text>by inserting
			 after subparagraph (V) the following new subparagraphs:</text>
							<quoted-block id="ID6A6BC5DE273543D48B6579AF12F9BA40" style="OLC">
								<subparagraph id="IDF396FBE64BAC4556BE8A0D93C7AE8D6E" indent="up1"><enum>(W)</enum><text>in the case of hospitals, skilled
				nursing facilities, home health agencies, and hospice programs, to provide
				individuals receiving care by or through the provider (and their caregivers and
				families, with the patient’s consent, or their surrogate decision-makers) with
				the opportunity to discuss the general course of treatment expected, the likely
				impact on length of life and function, and the procedures they should use to
				secure help if an unexpected situation arises, and</text>
								</subparagraph><subparagraph id="id7AB580F4D62B42C4A35FF9F1F0E6519F" indent="up1"><enum>(X)</enum><text>in the case of hospitals, skilled
				nursing facilities, and hospice programs, to—</text>
									<clause id="idB1D958061A3A4806B6BDAE956F30D6A9"><enum>(i)</enum><text>provide for an assessment of each
				individual (at the time of discharge from the provider) using an assessment
				instrument that is at least as informative as the continuity assessment record
				and evaluation (CARE) instrument developed by the Centers for Medicare &amp;
				Medicaid Services; and</text>
									</clause><clause id="id77798826B184469CB8264AD443BE8047"><enum>(ii)</enum><text>include the results of such
				assessment in the individual's medical
				record.</text>
									</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph></paragraph><paragraph id="idD501A35C8110431291DE94568F1136C3"><enum>(2)</enum><header>Effective
			 Date</header><text>The amendments made by this subsection shall apply to
			 agreements entered into or renewed on or after January 1, 2012.</text>
				</paragraph></subsection><subsection id="id7018156F540C4057B3D4201A7D26C0EE"><enum>(b)</enum><header>HHS study and
			 report on appropriate assessments at discharge</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id12A8BDA74EF743289D01AF37F86DDB99"><enum>(1)</enum><header display-inline="yes-display-inline">Study</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services
			 shall conduct a study on the extent to which the assessment of individual by
			 hospitals, skilled nursing facilities, and hospice programs under section
			 1886(a)(1)(X) of the Social Security Act, as added by subsection (a),
			 accurately reflects the actual diagnosis and care plan of the individual
			 involved at the time of discharge.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5DE32069B04B47EAB3F54B5EA0FF2633"><enum>(2)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than January 1, 2014, the
			 Secretary of Health and Human Services shall submit to Congress a report on the

			 Medicare providers To honor written orders for medical care</header><text display-inline="no-display-inline">Section 1834 of the Social Security Act (42
			 U.S.C. 1395m), as amended by section 6, is amended by adding at the end the
			 following new subsection:</text>

				honor written orders for medical care</header><text>No payment may be made
				under this title to a provider of services or a supplier for items and services
				furnished on or after January 1, 2013, unless the provider or supplier agrees
				(under a process established by the Secretary) to, in the case of an individual
				with a written order for medical care (such as a physician’s orders for
				life-sustaining treatment (POLST)), follow such order when furnishing items and
				services to the
				individual.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="id374C1AB2444442EFA40BE7B5BD9DF32B"><enum>10.</enum><header>Incentives for
			 accreditation and certification in hospice and palliative care</header>
			<subsection commented="no" display-inline="no-display-inline" id="id1BA0E38CFFBB46DCA52C332D17FC12D9"><enum>(a)</enum><header>Hospitals</header><text>Section
			 1886 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42
			 U.S.C. 1395ww) is amended by adding at the end the following new
			 subsection:</text>

					<subsection id="ID1E6277E9001147DE8B6593319DEED54F"><enum>(o)</enum><header>Incentives for
				accreditation in palliative care</header>
						<paragraph id="IDE8FBD641E95348DD9055B3614C75C5F4"><enum>(1)</enum><header>Incentive
				payment</header>
							<subparagraph id="idCC06BAF006354601848BABF1AA52FAA7"><enum>(A)</enum><header>In
				general</header><text>Subject to subparagraph (3), with respect to inpatient
				hospital services and inpatient critical access hospital services furnished by
				an eligible hospital during a payment year, if the eligible hospital has in
				place an accredited palliative care program (as determined by the Secretary)
				with respect to such year and meets utilization criteria for such program (as
				established by the Secretary) with respect to such year, in addition to the
				amount otherwise paid under this section or section 1814, there shall also be
				paid to the eligible hospital, from the Federal Hospital Insurance Trust Fund
				established under section 1817, an amount equal to the applicable percent of
				the amount that would otherwise be paid under this section or section 1814 for
				such services for the hospital for such year.</text>
							</subparagraph><subparagraph id="idBF682E6658E6479F943D04845700D9B4"><enum>(B)</enum><header>Applicable
				percent defined</header><text>The term <quote>applicable percent</quote>
				means—</text>
								<clause id="id4BE1D46C86E94CA48A492782282CB5EE"><enum>(i)</enum><text>for fiscal years
				2011 through 2016, 2 percent; and</text>
								</clause><clause id="id1952BC17BAFF45DBA5BDFE687414C49D"><enum>(ii)</enum><text>for fiscal years
				2017 through 2020, 1 percent.</text>
								</clause></subparagraph><subparagraph id="IDB1C7E164D7C94D3CBAA3C88ACF352EE2"><enum>(C)</enum><header>Form of
				payment</header><text>The payment under this paragraph for a payment year may
				be in the form of a single consolidated payment or in the form of such periodic
				installments as the Secretary may specify.</text>
							</subparagraph></paragraph><paragraph id="id12AEF04A20EB4D528C23EFDDC1AE867E"><enum>(2)</enum><header>Incentive
				payment adjustment</header><text>Subject to paragraph (3), with respect to
				inpatient hospital services and inpatient critical access hospital services
				furnished by an eligible hospital during a fiscal year after fiscal year 2020,
				if the eligible hospital does not have in place an accredited palliative care
				program (as determined by the Secretary) with respect to such fiscal year, the
				amount otherwise paid under this section or section 1814 for such services for

						</paragraph><paragraph id="id456EA16C67F44FE3AFBB65746A3E9D7D"><enum>(3)</enum><header>Exception</header><text>In
				the case of an eligible hospital with fewer than 50 beds, such hospital shall
				be deemed to meet the requirement in paragraphs (1)(A) and (2) if, in lieu of
				having in place an accredited palliative care program, the hospital provides
				patients and family members with access to a local or regional accredited
				palliative care team or program.</text>
						</paragraph><paragraph id="id2BB6FEAAD493484495A859B21779D85E"><enum>(4)</enum><header>Definitions</header><text>In
				this subsection:</text>
							<subparagraph id="id100389E6E9024960B69FDC8DF325C64E"><enum>(A)</enum><header>Eligible
				hospital</header><text>The term <quote>eligible hospital</quote> means—</text>
								<clause id="id86852B0E239F4AAF8EC68F5C0A55A52B"><enum>(i)</enum><text>a
				hospital (as defined in section 1861(e)); and</text>
								</clause><clause id="id979C652DE43D4FF89383AB8B541069A2"><enum>(ii)</enum><text>a critical
				access hospital (as defined in section 1861(mm)(1)).</text>
								</clause></subparagraph><subparagraph id="id2239887278144FF4830EEECD755C25C9"><enum>(B)</enum><header>Payment
				year</header><text>The term <term>payment year</term> means fiscal years 2011
				through 2020.</text>

				also be paid to the facility, from the Federal Hospital Insurance Trust Fund
				established under section 1817, an amount equal to the applicable percent of
				the amount that would otherwise be paid under subsection (e) for such services
				for the facility for such year.</text>
							</subparagraph><subparagraph id="idDEAA61BF6CEA46849B8A9DA10ED23DE8"><enum>(B)</enum><header>Definitions</header><text>In
				this subsection:</text>
								<clause id="id638C44C06E7B4ED980BC4134A402B87F"><enum>(i)</enum><header>Applicable
				percent</header><text>The term <quote>applicable percent</quote> means—</text>

						</paragraph><paragraph id="id4937EBF6FA374E128CA4E9A3B60B25BB"><enum>(3)</enum><header>Exception</header><text>In
				the case of a skilled nursing facility with fewer than 60 beds, such facility
				shall be deemed to meet the requirement in paragraphs (1)(A) and (2) if, in
				lieu of having in place an accredited palliative care program, the facility
				provides patients and family members with access to a local or regional
				accredited palliative care team or program.</text>
						</paragraph><paragraph id="id417D6D37DC2B40A08FF1D7DBB83F7F9F"><enum>(4)</enum><header>Limitations on
				review</header><text>There shall be no administrative or judicial review under
				section 1869, section 1878, or otherwise, of—</text>
							<subparagraph id="id4669DEBA2BB34B6A96DB4504BE1BE890"><enum>(A)</enum><text>the methodology
				and standards for determining payment amounts under paragraph (1) and payment

				general</header><text>With respect to physicians' services furnished by a
				physician during a payment year, if the physician is certified in hospice and
				palliative care (as determined by the Secretary) with respect to such year, in
				addition to the amount otherwise paid under this part, there shall also be paid
				to the physician, from the Federal Supplementary Medical Insurance Trust Fund
				established under section 1841, an amount equal to the applicable percent of
				the Secretary's estimate (based on claims submitted not later than 2 months
				after the end of the payment year) of the allowed charges under this part for
				all covered professional services (as defined in subsection (k)(3)) furnished
				by the physician during such year.</text>
							</subparagraph><subparagraph id="idD965C71AB5CF4554B769E84B372530E4"><enum>(B)</enum><header>Definitions</header><text>In
				this subsection:</text>
								<clause id="id9C9C633264654213A11546E427844D1E"><enum>(i)</enum><header>Applicable
				percent</header><text>The term <quote>applicable percent</quote> means—</text>
									<subclause id="id372EE0D34E38425482FC9A7D56DACFC3"><enum>(I)</enum><text>for 2011 through
				2016, 2 percent; and</text>

							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="idB967836F12674E6D97797E1AEFF7B379"><enum>11.</enum><header>Discharge
			 checklist pilot program</header>
			<subsection id="id4766EA69A8BD4ECEA2B1DB6F8488DAB6"><enum>(a)</enum><header>Establishment</header><text>Not
			 later than July 1, 2010, the Secretary of Health and Human Services (in this
			 section referred to as the <quote>Secretary</quote>) shall conduct a pilot
			 program under title XVIII of the Social Security Act to test the use of the
			 Centers for Medicare and Medicaid Services' discharge checklist included in the
			 publication entitled <quote>Planning for Your Discharge: A checklist for
			 patients and caregivers preparing to leave a hospital, nursing home, or other
			 health care setting</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idA029D4ABEB5D4B468E7FA1E4E4AE7CD0"><enum>(b)</enum><header display-inline="yes-display-inline">Waiver authority</header><text display-inline="yes-display-inline">The Secretary may waive compliance of such
			 requirements of titles XI and XVIII of the <act-name parsable-cite="SSA">Social
			 Security Act</act-name> as the Secretary determines necessary to conduct the
			 pilot program under this section.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id4CDEA11D0FDF479AA7640CB542DD526E"><enum>(c)</enum><header>Report</header><text>Not
			 later than 6 months after the completion of the pilot program under this
			 section, the Secretary shall submit to Congress a final report on the pilot
			 program, together with recommendations for such legislation and administrative
			 action as the Secretary determines appropriate.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idD2A7F3374410472890820371EB84679E"><enum>(d)</enum><header>Funding</header><text>There
			 are authorized to be appropriated such sums as may be necessary for purposes of
			 conducting the pilot program under this section.</text>
			</subsection></section><section id="H8E878F12CFD14E4688B11DDC92E60150"><enum>12.</enum><header>Office of
			 Medicare/Medicaid Integration</header>
			<subsection id="H4339144324A043B3B0AED091D26C7B4"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish or designate
			 an Office on Medicare/Medicaid Integration (in this subsection referred to as
			 the <quote>Office</quote>) for the purpose of aligning Medicare and Medicaid
			 program policies and procedures and developing tools to support State
			 integration efforts in order to—</text>
				<paragraph id="H04B46C76B3BF41038C11D368A4F829E3"><enum>(1)</enum><text display-inline="yes-display-inline">simplify dual eligible access to Medicare
			 and Medicaid program benefits and services;</text>
				</paragraph><paragraph id="HC8D73F59C4054EDF8B9D5D31DB6DC9C9"><enum>(2)</enum><text>improve care
			 continuity and ensure safe and effective care transitions;</text>
				</paragraph><paragraph id="H1C06A20441C54A6CBD1BD7B61FDF914"><enum>(3)</enum><text>eliminate cost
			 shifting between the Medicare and Medicaid programs and among related care
			 providers;</text>
				</paragraph><paragraph id="H517883A07A5A4C768D900013762F53E7"><enum>(4)</enum><text>eliminate
			 regulatory conflicts between Medicare and Medicaid program rules; and</text>
				</paragraph><paragraph id="H63131156441442A1A72DFC173500B379"><enum>(5)</enum><text>improve total cost
			 and quality performance.</text>
				</paragraph></subsection><subsection id="H30E42775418043ADB6DA336D90E351FD"><enum>(b)</enum><header>Responsibilities</header><text display-inline="yes-display-inline">The responsibilities of the Office are to
			 develop policies and procedures to—</text>
				<paragraph id="ID350bbf0b6b764f77ab031daa2c08316b"><enum>(1)</enum><text>identify
			 incentives for States to advance the integration of the Medicare and Medicaid
			 programs to improve total cost and quality performance, including shared cost
			 savings among consumers, plans, and Federal and State governments with respect
			 to State initiatives for advancing Medicare and Medicaid program
			 integration;</text>
				</paragraph><paragraph id="HA8B319A2C23E4272A4EBE4097148B74"><enum>(2)</enum><text>provide support for
			 coordination of Federal and State contracting and oversight for dual
			 integration programs supportive of the goals described in subsection
			 (a);</text>
				</paragraph><paragraph id="ID2cb4f9108cb14a9a95b283038272a808"><enum>(3)</enum><text>serve as a
			 liaison between Centers for Medicare &amp; Medicaid Services central and
			 regional offices to ensure consistent application of Centers for Medicare &amp;
			 Medicaid Services rules, policies, and auditing practices as such rules,
			 policies, and auditing practices pertain to dual eligibles;</text>
				</paragraph><paragraph id="IDb73ce8cb9cbe4e408ff6bc40142c52d0"><enum>(4)</enum><text>monitor total
			 combined Medicare and Medicaid program costs in serving dual eligibles and make
			 recommendations for optimizing total quality and cost performance across both
			 programs; and</text>
				</paragraph><paragraph id="idADAA7B8547A544D49A0448F76586212F"><enum>(5)</enum><text>identify
			 legislative and administrative changes that are needed to facilitate the
			 integration of benefits and oversight functions of the Medicare and Medicaid
			 programs with respect to dual eligibles.</text>
				</paragraph></subsection><subsection id="H7F1DC51980C24B15A927A773B9186D1"><enum>(c)</enum><header>Dual eligible
			 defined</header><text>In this section, the term <term>dual eligible</term>
			 means an individual who is—</text>
				<paragraph id="idB4A8DEC8A7A144BC815137806051E9C5"><enum>(1)</enum><text>entitled to, or
			 enrolled for, benefits under part A of title XVIII of the Social Security Act
			 or enrolled for benefits under part B of such title; and</text>
				</paragraph><paragraph id="idFE23D440DAAA4F619FBC52A08DCD2237"><enum>(2)</enum><text>entitled to
			 medical assistance under a State plan under title XIX of such Act.</text>
				</paragraph></subsection><subsection id="id5B47226494EA4AFFBA482B695B0AABD3"><enum>(d)</enum><header>Study</header><text>Not
			 later than January 1, 2011, the Secretary of Health and Human Services, in
			 consultation with private health information technology stakeholders and in
			 coordination with other Federal health information technology efforts, shall
			 conduct a study to determine the data that the Office should collect and
			 analyze in order to improve health care outcomes, create efficiencies in care
			 delivery, and impact Federal health care spending.</text>
			</subsection><subsection id="id19BBCF891E4A432E8B42AFA691DBE3A5"><enum>(e)</enum><header>Funding</header><text>There
			 are authorized to be appropriated such sums as may be necessary to carry out
			 the provisions of this section.</text>
			</subsection></section><section id="idA3847273BEC7499A9F41937F4A0766B1"><enum>13.</enum><header>Web-based
			 materials and grants</header>
			<subsection id="idEC80596906554376BB6911387AA92D34"><enum>(a)</enum><header>Web-Based
			 Materials</header><text>The Secretary of Health and Human Services (in this
			 section referred to as the <quote>Secretary</quote>) shall establish and
			 maintain a website that provides information, online training, and
			 instructional materials for entities, including faith-based organizations, on
			 end-of-life issues, which shall include content addressing—</text>
				<paragraph id="id9187A1D3126245BCA2DCEF8809C4E8E8"><enum>(1)</enum><text>advance care
			 planning, including common issues and questions regarding advance directives
			 and their uses;</text>
				</paragraph><paragraph id="id6CC7D1DCD89C4B19AB15062C3FC1E3A2"><enum>(2)</enum><text>hospice benefits
			 under Medicare, Medicaid, and the State Children's Health Insurance Program
			 established under the Social Security Act, including information on how hospice
			 care is administered and provided to terminally ill individuals;</text>
				</paragraph><paragraph id="id4E6284EAAF5744B3B39D92A8C7C92BFD"><enum>(3)</enum><text>palliative care,
			 including information on services that palliative care units provide for
			 terminally ill patients; and</text>
				</paragraph><paragraph id="id48D2521F44A84CB7BA96DC018A54730C"><enum>(4)</enum><text>any additional
			 information related to end-of-life care and associated issues, as determined by
			 the Secretary.</text>
				</paragraph></subsection><subsection id="idE384D2DB8D2D42EEBD2975428F9307EF"><enum>(b)</enum><header>Grants</header>
				<paragraph id="id52EA2D24D2954E8096417EB46AE1FBF6"><enum>(1)</enum><header>Hospice Care
			 Grant Program</header>
					<subparagraph id="id5F932AB9030B40C8A745A99EA163857F"><enum>(A)</enum><header>Grants
			 Authorized</header><text>The Secretary is authorized to award grants to
			 entities, including faith-based organizations, to develop and provide services
			 for terminally ill individuals who are receiving hospice care in their own
			 homes.</text>
					</subparagraph><subparagraph id="id0093850C7E6B4B1C8AA123DE61DE4B34"><enum>(B)</enum><header>Requirements</header>
						<clause id="idBF3D386EC5FC4EEB9863AB6155E87717"><enum>(i)</enum><header>Duration</header><text>The
			 grant program shall be conducted for a 5-year period, beginning not later than
			 January 1, 2011.</text>
						</clause><clause id="id5F91BB5E6A1F44E89162FE63C747FEAD"><enum>(ii)</enum><header>Amount of
			 Grants</header><text>An entity may be awarded a grant under this paragraph for
			 a fiscal year that is not less than $5,000 and not more than $250,000.</text>
						</clause><clause id="id6A115BB80EC246CE8CA836C726B2C99B"><enum>(iii)</enum><header>Number of
			 Grants</header><text>The Secretary shall award grants under this paragraph to
			 not more than 100 entities.</text>
						</clause></subparagraph><subparagraph id="id260EB498A3C7468A8EAA5AB032F3D1D8"><enum>(C)</enum><header>Additional
			 Medicaid Funds</header><text>A State may elect to provide additional funds to
			 recipients of a grant under this section, with such funds to be considered as
			 amounts expended for the proper and efficient administration of the State plan
			 under title XIX of the Social Security Act for purposes of the State receiving
			 payments under section 1903(a)(7) of that Act.</text>
					</subparagraph><subparagraph id="id860A9F1DBF674E6387CB2B336519D5A6"><enum>(D)</enum><header>Use of
			 Funds</header><text>Grants awarded pursuant to this paragraph shall be used by
			 entities to develop and provide end-of-life support services for terminally ill
			 individuals who are receiving care in their own homes, including—</text>
						<clause id="idF2FC19BA91CD4B2CB18895BFEB6B4A4E"><enum>(i)</enum><text>support for
			 caregivers;</text>
						</clause><clause id="idFF132C6F58094A4785422E923EC19DDF"><enum>(ii)</enum><text>if
			 the entity is a hospice program under the Medicare program, any additional
			 hospice care determined appropriate by the Secretary; and</text>
						</clause><clause id="id29C3862F289E439BA9CC05CDFA901853"><enum>(iii)</enum><text>any additional
			 end-of-life information or materials relating to support services determined
			 appropriate by the Secretary.</text>
						</clause></subparagraph><subparagraph id="id10EB6009C72C4E628E5E1CB5648983FC"><enum>(E)</enum><header>Application</header><text>Each
			 entity desiring a grant under this paragraph shall submit an application to the
			 Secretary at such time, in such manner, and accompanied by such information as
			 the Secretary may reasonably require.</text>
					</subparagraph><subparagraph id="id976B870A2C4A45888C005023222E82C0"><enum>(F)</enum><header>Authorization
			 of Appropriations</header><text>For the purpose of carrying out the grant
			 program established under this paragraph, there is authorized to be
			 appropriated $15,000,000 for the period of fiscal years 2011 through
			 2015.</text>
					</subparagraph></paragraph><paragraph id="id9597C8BD15414469B2190664BEE7D331"><enum>(2)</enum><header>End-of-Life
			 Educational Grant Program</header>
					<subparagraph id="id7D660A0D221046E993D529F66747EC2F"><enum>(A)</enum><header>Grants
			 Authorized</header><text>The Secretary is authorized to award grants to
			 entities, including faith-based organizations and religious educational
			 institutions, to develop and provide appropriate training and educational
			 programs addressing end-of-life care issues.</text>
					</subparagraph><subparagraph id="id4F6BF55BE2804906A473BAF089E699B9"><enum>(B)</enum><header>Requirements</header>
						<clause id="idE17A268335C249F2A7ACCADE2D8515BB"><enum>(i)</enum><header>Duration</header><text>The
			 grant program shall be conducted for a 5-year period, beginning not later than
			 January 1, 2011.</text>
						</clause><clause id="id4FAAB8C3CF234E429DB07E255B408AF0"><enum>(ii)</enum><header>Amount of
			 Grants</header><text>An entity may be awarded a grant under this paragraph for
			 a fiscal year that is not less than $5,000, and not more than $50,000.</text>
						</clause><clause id="idC75791B989704BCFBC3D8A2817EC471F"><enum>(iii)</enum><header>Number of
			 Grants</header><text>The Secretary shall award grants under this paragraph to
			 not more than 100 entities.</text>
						</clause></subparagraph><subparagraph id="id17BDC5A7D79C4961AD0C107164F77A2C"><enum>(C)</enum><header>Use of
			 Funds</header><text>Grants awarded pursuant to this paragraph shall be used by
			 entities to develop appropriate training and education programs addressing
			 end-of-life care issues and include such programs as part of their educational
			 curriculum, continuing education programs, or vocational training.</text>
					</subparagraph><subparagraph id="id94EBADDD32954092BE0800D803A93031"><enum>(D)</enum><header>Application</header><text>Each
			 entity desiring a grant under this paragraph shall submit an application to the
			 Secretary at such time, in such manner, and accompanied by such information as
			 the Secretary may reasonably require.</text>
					</subparagraph><subparagraph id="id3C451941D5654D09968A06C1202C797D"><enum>(E)</enum><header>Authorization
			 of Appropriations</header><text>For the purpose of carrying out the grant
			 program established under this paragraph, there is authorized to be
			 appropriated $10,000,000 for the period of fiscal years 2011 through
			 2015.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDCEB18B0F87644E72A24BEED4F825267E"><enum>14.</enum><header display-inline="yes-display-inline">HHS study and report on the storage of
			 advance directives</header>
			<subsection commented="no" display-inline="no-display-inline" id="id3DCC1CC79CF44F8DAB9B76FAF810E93D"><enum>(a)</enum><header display-inline="yes-display-inline">Study</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services
			 shall conduct a study on the best methods of storing completed advance
			 directives. Such study shall include an analysis of the feasibility of
			 establishing a national registry for completed advance directives, taking into
			 consideration the constraints created by the privacy provisions enacted as a
			 result of the Health Insurance Portability and Accountability Act of 1996
			 (Public Law 104–191).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID107BFA1C6DD8452AA6A30A4B91EC0BE5"><enum>(b)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than January 1, 2012, the
			 Secretary of Health and Human Services shall submit to Congress a report on the
			 study conducted under subsection (a) together with recommendations for such
			 legislation and administrative action as the Secretary determines to be
			 appropriate.</text>
			</subsection></section><section id="idCAFA9241B53D407DA64A5C6B222DA2B4"><enum>15.</enum><header>GAO study and
			 report on the provisions of, and amendments made by, this Act</header>
			<subsection id="id8D70C6F449CF4C0499B9D7560F35A0A2"><enum>(a)</enum><header>Study</header><text>The
			 Comptroller General of the United States (in this section referred to as the
			 <quote>Comptroller General</quote>) shall conduct a study on the provisions of,
			 and amendments made by, this Act, including the quality and costs (such as
			 patient and family experience, patient understanding of treatment choices, and
			 any decrease in avoidable hospital admissions) associated with such provisions
			 and such amendments.</text>
			</subsection><subsection id="idECA2DCE9B2E34354AFB7925AC0409077"><enum>(b)</enum><header>Report</header><text>Not
			 later than January 1, 2012, the Comptroller General shall submit to Congress a
			 report containing the results of the study conducted under subsection (a),
			 together with recommendations for such legislation and administrative action as
			 the Comptroller General determines appropriate.</text>
