		<legis-type>A BILL</legis-type>
		<official-title>To provide that certain photographic records relating to
		  the treatment of any individual engaged, captured, or detained after September
		  11, 2001, by the Armed Forces of the United States in operations outside the
		  United States shall not be subject to disclosure under section 552 of title 5,
		  United States Code (commonly referred to as the Freedom of Information
		  Act).</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Detainee Photographic Records
			 Protection</header>
			<subsection id="id1A6814D3902D4AD78C9E4B97C34A6AE2"><enum>(a)</enum><header>Short
			 title</header><text>This Act may be cited as the <quote><short-title>Detainee Photographic Records Protection Act of
			 2009</short-title></quote>.</text>
			</subsection><subsection id="id5B99C2E5128D43F389EC2BD41CAD6F82"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
				<paragraph id="id61C5F3DA585E4C2EA53C426BBAB5962E"><enum>(1)</enum><header>Covered
			 record</header><text display-inline="yes-display-inline">The term <term>covered
			 record</term> means any record—</text>
					<subparagraph id="IDe0190d0cba8444ed886efb173cc0552d"><enum>(A)</enum><text>that is a
			 photograph that—</text>
						<clause id="id96C1A276EF004300A4F572072B67A5BF"><enum>(i)</enum><text>was
			 taken during the period beginning on September 11, 2001, through January 22,
			 2009; and</text>
						</clause><clause id="id8EB560CD2A8D4CD497A01EC513299138"><enum>(ii)</enum><text>relates to the
			 treatment of individuals engaged, captured, or detained after September 11,
			 2001, by the Armed Forces of the United States in operations outside of the
			 United States; and</text>
						</clause></subparagraph><subparagraph id="id3371CD9AB78240939027A33FDC8244AF"><enum>(B)</enum><text>for which a
			 certification by the Secretary of Defense under subsection (c) is in
			 effect.</text>
					</subparagraph></paragraph><paragraph id="idC028991C2ACC424EB002AD7F0A83A11E"><enum>(2)</enum><header>Photograph</header><text>The
			 term <term>photograph</term> encompasses all photographic images, whether
			 originals or copies, including still photographs, negatives, digital images,
			 films, video tapes, and motion pictures.</text>
				</paragraph></subsection><subsection id="id9B452963049348F8AB33A3C2C85C0F40"><enum>(c)</enum><header>Certification</header>
				<paragraph id="id5CD6034CAA434C5C9BCB47A8F41DD5AD"><enum>(1)</enum><header>In
			 General</header><text display-inline="yes-display-inline">For any photograph
			 described under subsection (b)(1)(A), the Secretary of Defense shall submit a
			 certification to the President, if the Secretary of Defense, in consultation
			 with the Chairman of the Joint Chiefs of Staff, determines that the disclosure
			 of that photograph would endanger—</text>
					<subparagraph id="id0090C2417A29415AADADA085761CE85B"><enum>(A)</enum><text display-inline="yes-display-inline">citizens of the United States; or</text>
					</subparagraph><subparagraph id="id68C3C843DE644D96B570B39F85BF52A9"><enum>(B)</enum><text display-inline="yes-display-inline">members of the Armed Forces or employees of
			 the United States Government deployed outside the United States.</text>
					</subparagraph></paragraph><paragraph id="idC3A827D2D92A4E51AA61ACB76BD00746"><enum>(2)</enum><header>Certification
			 expiration</header><text>A certification submitted under paragraph (1) and a
			 renewal of a certification submitted under paragraph (3) shall expire 3 years
			 after the date on which the certification or renewal, as the case may be, is
			 submitted to the President.</text>
				</paragraph><paragraph id="id12138087668941E2AF438699AF6E69D7"><enum>(3)</enum><header>Certification
			 renewal</header><text display-inline="yes-display-inline">The Secretary of
			 Defense may submit to the President—</text>
					<subparagraph id="id1138A2BDEE0C484C8752245621D2B57C"><enum>(A)</enum><text display-inline="yes-display-inline">a renewal of a certification in accordance
			 with paragraph (1) at any time; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1C2D8D87A62C436D8B94F84724E97EB6"><enum>(B)</enum><text display-inline="yes-display-inline">more than 1 renewal of a
			 certification.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB158EA01921F41F59C9FCD8D09C7F57E"><enum>(4)</enum><header>Notice to
			 Congress</header><text>A timely notice of the Secretary's certification shall
			 be submitted to Congress.</text>
				</paragraph></subsection><subsection id="idBC687D7D39BF4B258410A34313313340"><enum>(d)</enum><header>Nondisclosure
			 of Detainee records</header><text display-inline="yes-display-inline">A covered
			 record shall not be subject to—</text>
				<paragraph id="idBE9C2B4F30AB43BA955B7F7DDFFB8D9A"><enum>(1)</enum><text display-inline="yes-display-inline">disclosure under section 552 of title 5,
			 United States Code (commonly referred to as the Freedom of Information Act);
			 or</text>
				</paragraph><paragraph id="idBF5E730587BA40B69CB6A1DCCD6C9826"><enum>(2)</enum><text>disclosure under
			 any proceeding under that section.</text>
				</paragraph></subsection><subsection id="id36ADA36804F948DBA5560D258BD2E1EA"><enum>(e)</enum><header>Rule of
			 construction</header><text>Nothing in this section shall be construed to
			 preclude the voluntary disclosure of a covered record.</text>
			</subsection><subsection id="id3F63F0795ED64AAD9C060FD18B4AE67E"><enum>(f)</enum><header>Effective
			 date</header><text>This section shall take effect on the date of enactment of
			 this Act and apply to any photograph created before, on, or after that date
			 that is a covered record.</text>
