			 <quote><short-title>Chesapeake Bay Science, Education, and
			 Ecosystem Enhancement Act of 2009</short-title></quote>.</text>
		</section><section id="H9CB60FD1EB0044F8AA527043A9D58CB9" section-type="subsequent-section"><enum>2.</enum><header>Reauthorization of
			 Chesapeake Bay Office of National Oceanic and Atmospheric
			 Administration</header><text display-inline="no-display-inline">Section 307 of
			 the National Oceanic and Atmospheric Administration Authorization Act of 1992
			 (15 U.S.C. 1511d) is amended—</text>
			<paragraph id="H1145632471284EB2BDD33F9233633DDF"><enum>(1)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="HE7BBF05C27E946BBA6CC7E2280467E93"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
					<clause id="id4078B32631FD45168A0A48AC080D6EA3"><enum>(i)</enum><text>by
			 striking <quote>(1) The Secretary</quote> and inserting the following:</text>

							<subparagraph id="idAC68049AD7CE40F39335188578561166"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Office shall be
				headed by a Director who shall be selected by the Secretary of Commerce from
				among individuals who have knowledge and experience in research or resource
				management efforts in the Chesapeake Bay.</text>
							</subparagraph><subparagraph id="HD932E28D698543FD8EDC5034B3BFA45F"><enum>(B)</enum><header>Duties</header><text>The
				duties of the Director are as follows:</text>
								<clause id="id67848A8D85964B38B1061570C898DCC4"><enum>(i)</enum><text>Administration
				and operation of the Office.</text>
								</clause><clause id="id1A36E26952864CC0AA7177199F2CEA83"><enum>(ii)</enum><text>Carrying out the
				provisions of this section.</text>
								</clause></subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph commented="no" id="HBD6A9859E82948EAA3C452C80065EE49"><enum>(C)</enum><text>by striking
			 paragraph (3);</text>
				</subparagraph></paragraph><paragraph id="H8A8F7E5D319745F085D8E65B489F54EE"><enum>(2)</enum><text>in subsection
			 (b)—</text>

				</subparagraph><subparagraph id="HC1C144757E0E497B8F93D1DEDCBB4743"><enum>(B)</enum><text>in paragraph (2),
			 by striking <quote>Secretary of Commerce</quote> and inserting
			 <quote>Administrator</quote>;</text>
				</subparagraph><subparagraph id="HD05E9B0BDE9540BABABF60BC6B008D70"><enum>(C)</enum><text>in paragraph
			 (3)—</text>

			 striking the matter preceding subparagraph (A) and inserting the

			 by inserting before the semicolon at the end the following: <quote>as
			 appropriate to further the purposes of this section</quote>;</text>
				</subparagraph><subparagraph id="H5E2B510361E341C1B661F8A6EBDD17EB"><enum>(E)</enum><text>by striking
			 paragraphs (5) and (7);</text>

			 end the following:</text>

						<paragraph id="H64CFFABC3EA948199882F1171200C926"><enum>(6)</enum><text display-inline="yes-display-inline">perform such functions as may be necessary
				to support the programs referred to in paragraph
				(3)</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H7E2E43A1DD724CBC9C186F598865B922"><enum>(3)</enum><text>by striking
			 subsection (c) and all that follows through the end of the section and
			 inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="HE6F689C7A2DE4A7F936300B601F0E987" style="OLC">
					<subsection id="H0E78F630550244FF8BDDF8494FE38FC1"><enum>(c)</enum><header>Program
				activities</header>
						<paragraph id="HCDB0A06CC6954649AD9210F1F99CF015"><enum>(1)</enum><header>In
				general</header><text>The Director shall implement the program activities
				required by this subsection to support the activity of the Chesapeake Executive
				Council and to further the purposes of this section.</text>
						</paragraph><paragraph id="HE3660C305B8647C69266FDC441007480"><enum>(2)</enum><header>Ensuring
				scientific and technical merit</header><text>The Director shall—</text>
							<subparagraph id="H78D76E8AA8844218A5EBF3005654A01B"><enum>(A)</enum><text>establish and
				utilize an effective and transparent mechanism to ensure that projects funded
				under this section have undergone appropriate peer review, using, to the extent
				practicable, the capabilities of the Maryland and Virginia Sea Grant
				Program;</text>
							</subparagraph><subparagraph id="H40509092D78F46F794F327E66F612C6E"><enum>(B)</enum><text>provide other
				appropriate means to determine that such projects have acceptable scientific
				and technical merit for the purpose of achieving maximum utilization of
				available funds and resources to benefit the Chesapeake Bay area; and</text>
							</subparagraph><subparagraph id="id660826945AFC4F13B98C345CAA2B1BC0"><enum>(C)</enum><text>ensure that all
				data and other products generated by any project funded under this section be
				provided to the Director.</text>
							</subparagraph></paragraph><paragraph id="HABE09DF01114460C83F601AF41E0FC3C"><enum>(3)</enum><header>Consultation
				with Chesapeake Executive Council</header><text>The Director shall, in the
				implementation of the program activities authorized under this section, consult
				with the Chesapeake Executive Council to ensure that the activities of the
				Office are consistent with the purposes and priorities of the Chesapeake Bay
				Agreement and plans developed pursuant to the Agreement.</text>
						</paragraph><paragraph id="H90EBD631BDE440FDACED08C37845DB01"><enum>(4)</enum><header>Integrated
				coastal observations</header>
							<subparagraph id="H46BBC97990EC4219B354E865CBA7AF00"><enum>(A)</enum><header>In
				general</header><text>The Director shall collaborate with scientific and
				academic institutions, State and Federal agencies, nongovernmental
				organizations, and other constituents in the Chesapeake Bay watershed, to
				support the development of an integrated observations system for the Chesapeake
				Bay.</text>
							</subparagraph><subparagraph id="H02FAC2D44D2B4DCBB048697EF6A41E3"><enum>(B)</enum><header>Specific
				requirements</header><text>To support the system referred to in subparagraph
				(A) and provide a complete set of environmental information for the Chesapeake
				Bay, the Director shall—</text>
								<clause id="H5A6B402D52CB47B89199B2FB7CDB7F05"><enum>(i)</enum><text>coordinate
				existing monitoring and observing activities in the Chesapeake Bay;</text>
								</clause><clause id="HA0F106105A5B405D8F2446EA31532FB9"><enum>(ii)</enum><text>identify new data
				collection needs and deploy new technologies, as appropriate;</text>
								</clause><clause id="HDD4425C08ED5400D00F116D44BF48781"><enum>(iii)</enum><text>facilitate the
				collection and analysis of the scientific information necessary for the
				management of living marine resources and the marine habitat associated with
				such resources;</text>
								</clause><clause id="H309D664172DA4F4C8FA740786F305258"><enum>(iv)</enum><text>coordinate with
				regional partners to manage and interpret the information described in clause
				(iii); and</text>
								</clause><clause id="H22D6986DDE5F41148713273D70F7E951"><enum>(v)</enum><text>support regional
				partners to ensure the information described in clause (iii) is organized into
				products that are useful to policy makers, resource managers, scientists, and
				the public.</text>
								</clause></subparagraph><subparagraph id="H93ED9A6783D64D3184F9400B63B4917"><enum>(C)</enum><header>Chesapeake Bay
				Interpretive Buoy System</header><text>To further the development and
				implementation of the Chesapeake Bay Interpretive Buoy System, the Director
				shall—</text>
								<clause id="HA7A458526A2D4189A8EDC5BC84BC98F3"><enum>(i)</enum><text>support the
				establishment and implementation of the Captain John Smith Chesapeake National
				Historic Trail;</text>
								</clause><clause id="H4ABD6E89A4814E6A8EFDD39B89298BAF"><enum>(ii)</enum><text>delineate key
				waypoints along the trail and provide appropriate real-time data and
				information for trail users;</text>
								</clause><clause id="H15C47FDA4D7E46EB9106358E07180966"><enum>(iii)</enum><text>interpret data
				and information for use by educators and students to inspire stewardship of
				Chesapeake Bay; and</text>
								</clause><clause id="H46B1E89006B542EDA400395C0004A3A0"><enum>(iv)</enum><text>incorporate the
				Chesapeake Bay Interpretive Buoy System into the Integrated Ocean Observing
				System regional network of observatories.</text>
								</clause></subparagraph></paragraph><paragraph id="HAB55D668AD734277A9B610F96F00EC1E"><enum>(5)</enum><header>Chesapeake Bay
				watershed education and training program</header>
							<subparagraph id="HAD1E7CCA803C4AE3AFFA18CE36FDE11"><enum>(A)</enum><header>In
				general</header><text>The Director shall establish a Chesapeake Bay watershed
				education and training program. The program shall—</text>
								<clause id="H2499E7EA77E44221B339F8A710C15483"><enum>(i)</enum><text>continue and
				expand the Chesapeake Bay watershed education programs offered by the Office on
				the day before the date of the enactment of the
				<short-title>Chesapeake Bay Science, Education, and
				Ecosystem Enhancement Act of 2009</short-title>;</text>
								</clause><clause id="H7804989AB32B48ABB387003946466B25"><enum>(ii)</enum><text>improve the
				understanding of elementary and secondary school students and teachers of the
				living resources of the ecosystem of the Chesapeake Bay;</text>
								</clause><clause id="HFB62EF080906414D9F98EB50CC5DB3B0"><enum>(iii)</enum><text>provide
				community education to improve watershed protection; and</text>
								</clause><clause id="HE94FBBB061A749008D8BBBC729F2352"><enum>(iv)</enum><text>meet the
				educational goals of the most recent Chesapeake Bay Agreement.</text>
								</clause></subparagraph><subparagraph id="HC01B572BF82741E5A1E899BDEFC963AF"><enum>(B)</enum><header>Grant
				program</header><text>The Director may award grants to support education and
				training projects that enhance understanding and assessment of a specific
				environmental problem in the Chesapeake Bay watershed or a goal of the
				Chesapeake Bay Program, or protect or restore living resources of the
				Chesapeake Bay watershed, including projects that—</text>
								<clause id="HA90AA3F0F9BC49B99EEC6EAC62006552"><enum>(i)</enum><text>provide classroom
				education, including the development and use of distance learning and other
				innovative technologies, related to the Chesapeake Bay watershed;</text>
								</clause><clause id="H455604C5F8B94DE8832D9500E5F2FBE9"><enum>(ii)</enum><text>provide watershed
				educational experiences in the Chesapeake Bay watershed;</text>
								</clause><clause id="H76D005E17D7448DA944700363E3BCB16"><enum>(iii)</enum><text>provide
				professional development for teachers related to the Chesapeake Bay watershed
				and the dissemination of pertinent education materials oriented to varying
				grade levels;</text>
								</clause><clause id="HCEE92FB123044E06B050F6913C579D33"><enum>(iv)</enum><text>demonstrate or
				disseminate environmental educational tools and materials related to the
				Chesapeake Bay watershed;</text>
								</clause><clause id="H764AA7BFAEFF4A7ABCE294D3884BCD10"><enum>(v)</enum><text>demonstrate field
				methods, practices, and techniques including assessment of environmental and
				ecological conditions and analysis of environmental problems;</text>
								</clause><clause id="HCA48368DF07A4E75A9CB9669C202EB82"><enum>(vi)</enum><text>build the
				capacity of organizations to deliver high quality environmental education
				programs; and</text>
								</clause><clause id="HC778C78CA4A74FCDBAD467A24DAA8D5B"><enum>(vii)</enum><text>educate local
				land use officials and decision makers on the relationship of land use to
				natural resource and watershed protection.</text>
								</clause></subparagraph><subparagraph id="H76E42383C3984C3B803C25F7F7E53B58"><enum>(C)</enum><header>Collaboration</header><text display-inline="yes-display-inline">The Director shall provide technical
				assistance to support the education and training program established under
				subparagraph (A) in collaboration with the heads of other relevant Federal
				agencies.</text>
							</subparagraph></paragraph><paragraph id="H2116D4AF07DA499BBE57CC83FF1C861"><enum>(6)</enum><header>Coastal and
				living resources management and habitat program</header>
							<subparagraph id="HBACD2A42CA3C4824B5EF4635E0FC81D2"><enum>(A)</enum><header>In
				general</header><text>The Director shall establish a Chesapeake Bay coastal
				living resources management and habitat program to support coordinated
				management, protection, characterization, and restoration of priority
				Chesapeake Bay habitats and living resources, including oysters, blue crabs,
				and submerged aquatic vegetation.</text>
							</subparagraph><subparagraph id="H597D25E4A47F4CD293839632E8B4BF2"><enum>(B)</enum><header>Activities</header><text>Under
				the program required by subparagraph (A), the Director may, subject to the
				availability of appropriations, carry out or enter into grants, contracts, and
				cooperative agreements and provide technical assistance to support—</text>
								<clause id="H97816A6EB284490EBEBD16DF5C86E1C8"><enum>(i)</enum><text display-inline="yes-display-inline">native oyster restoration;</text>
								</clause><clause id="H3DFBF1C1461E493FBF420D58091A6242"><enum>(ii)</enum><text display-inline="yes-display-inline">fish and shellfish aquaculture;</text>
								</clause><clause id="H91C51D173A5A484A8E35A1C46D20EB00"><enum>(iii)</enum><text>establishment of
				submerged aquatic vegetation propagation programs;</text>
								</clause><clause id="H97E32103E18C4023B011C74E29327380"><enum>(iv)</enum><text>the development
				of programs that protect and restore critical coastal habitats;</text>
								</clause><clause id="H2A53F7E89E9F471E9F7F298B7C9FDB27"><enum>(v)</enum><text>habitat mapping,
				characterization, and assessment techniques necessary to identify, assess, and
				monitor restoration actions;</text>
								</clause><clause id="H1D531D5CD968491789B6CB562354C6F"><enum>(vi)</enum><text>application and
				transfer of applied scientific research and ecosystem management tools to
				fisheries and habitat managers;</text>
								</clause><clause id="H8D115738BDA241A0A1AE80345D3DE200"><enum>(vii)</enum><text>collection,
				synthesis, and sharing of information to inform and influence coastal and
				living resource management issues; and</text>
								</clause><clause id="HA7699B87538E48958DDBFF148FD81F50"><enum>(viii)</enum><text>such other
				activities as the Director considers appropriate to carry out the program
				established under subparagraph (A).</text>
								</clause></subparagraph></paragraph></subsection><subsection id="H2C07ABDDBE864B3F0082C3EF757F4D61"><enum>(d)</enum><header>Reports</header>
						<paragraph id="HA6801B8DA06248C492314431F72D857C"><enum>(1)</enum><header>In
				general</header><text>The Director shall, not less frequently than once every 2
				years, submit to Congress a report on—</text>
							<subparagraph id="id210F01F87673477491F77E0055C3EC98"><enum>(A)</enum><text>the activities of
				the Office; and</text>
							</subparagraph><subparagraph id="idE55777027DE2408F92B281B996D0A9A4"><enum>(B)</enum><text>progress made in
				protecting and restoring the living resources and habitat of the Chesapeake
				Bay.</text>
							</subparagraph></paragraph><paragraph id="H5AC3CA669D9E439EA6B012D7861E008B"><enum>(2)</enum><header>Action
				plan</header><text>Each report submitted under paragraph (1) shall include an
				action plan for the 2-year period following submission of the report,
				consisting of—</text>
							<subparagraph id="H0A8A246885554652945B8744B72606E"><enum>(A)</enum><text>a list of
				recommended research, monitoring, and data collection activities necessary to
				continue implementation of the strategy under subsection (b)(2); and</text>
							</subparagraph><subparagraph id="H6E7794A2D5FC43A285C4D9EA9508506"><enum>(B)</enum><text>recommendations to
				integrate the activities of the National Oceanic and Atmospheric Administration
				with the activities of the partners in the Chesapeake Bay Program in order to
				meet the commitments of the Chesapeake Bay Agreement.</text>
							</subparagraph></paragraph></subsection><subsection id="H572F4848E6844C1B9080666D3D5BAF87"><enum>(e)</enum><header>Agreements</header>
						<paragraph id="HE36CE5BB59734A56AD94223DC9C5445E"><enum>(1)</enum><header>In
				general</header><text>The Director may, subject to the availability of
				appropriations, enter into and perform such contracts, leases, grants, or
				cooperative agreements as may be necessary to carry out the provisions of this
				section.</text>
						</paragraph><paragraph id="id73FC43FE6CE845E8A6A6AD5B1D757048"><enum>(2)</enum><header>Use of other
				resources</header><text>For purposes of understanding, protecting, and
				restoring the Chesapeake Bay, the Director may use, with or without
				reimbursement, the land, services, equipment, personnel, and facilities of any
				Department, agency, or instrumentality of the United States, or of any State,
				local government, Indian tribal government, or of any political subdivision
				thereof if the Director receives consent from the Department, agency,
				instrumentality, State, government, or political subdivision concerned for such
				use.</text>
						</paragraph><paragraph id="HF6AA5DC2934F4635BF2D7427BDB32471"><enum>(3)</enum><header>Donations</header><text>The
				Director may accept donations of funds, other property, and services for use in
				understanding, protecting, and restoring the Chesapeake Bay. Donations accepted
				under this section shall be considered as a gift or bequest to or for the use
				of the United States.</text>
						</paragraph></subsection><subsection id="HFAAFE06025C347DDAF6231601856EA40"><enum>(f)</enum><header>Definitions</header><text>In
				this section:</text>
						<paragraph id="H48147F2351524E1BA4AE076D190983DF"><enum>(1)</enum><header>Administrator</header><text>The
				term <term>Administrator</term> means the Administrator of the National Oceanic
				and Atmospheric Administration.</text>
						</paragraph><paragraph id="HD052C4DDCB7C4A92A92CAB360905B412"><enum>(2)</enum><header>Chesapeake Bay
				Agreement</header><text>The term <term>Chesapeake Bay Agreement</term> means
				the formal, voluntary agreements executed to achieve the goal of restoring and
				protecting the Chesapeake Bay ecosystem and the living resources of the
				Chesapeake Bay ecosystem and are signed by the Chesapeake Executive
				Council.</text>
						</paragraph><paragraph id="idD4D65379F8CE498EB4A09322C22AE1C9"><enum>(3)</enum><header>Chesapeake Bay
				Program</header><text>The term <term>Chesapeake Bay Program</term> means the
				regional Chesapeake Bay restoration partnership that includes Maryland,
				Pennsylvania, Virginia, the District of Columbia, the Chesapeake Bay
				Commission, the Environmental Protection Agency, other appropriate Federal
				agencies, and participating citizen and local elected official advisory
				groups.</text>
						</paragraph><paragraph id="HD61E167392A9445BAAE317D8AEDF98B4"><enum>(4)</enum><header>Chesapeake
				Executive Council</header><text>The term <term>Chesapeake Executive
				Council</term> means the representatives from the Commonwealth of Virginia, the
				State of Maryland, the Commonwealth of Pennsylvania, the Environmental
				Protection Agency, the District of Columbia, and the Chesapeake Bay Commission,
				who are signatories to the Chesapeake Bay Agreement, and any future signatories
				to that agreement.</text>
						</paragraph><paragraph id="H0DB621018AD44367A0130066110000F3"><enum>(5)</enum><header>Director</header><text>The
				term <term>Director</term> means the Director of the Chesapeake Bay
				Office.</text>
						</paragraph><paragraph id="H482D3B4733DA44358F00C3FE5F39F135"><enum>(6)</enum><header>Office</header><text>The
				term <term>Office</term> means the Chesapeake Bay Office established under
				subsection (a).</text>
						</paragraph></subsection><subsection id="H55E881016380448098A5DBD305BFFEE"><enum>(g)</enum><header>Authorization of
				appropriations</header><text>There is authorized to be appropriated to the
				Secretary to carry out this section—</text>
						<paragraph id="H8F858BE2C68E4D63A39D069305434FF4"><enum>(1)</enum><text display-inline="yes-display-inline">$17,000,000 for fiscal year 2011;</text>
						</paragraph><paragraph id="H2515A6748E7F4EA091B0BE87D14352C3"><enum>(2)</enum><text>$18,700,000 for
				fiscal year 2012;</text>
						</paragraph><paragraph id="H4E8C4F1E447F4BC59563402F3AFEEBDB"><enum>(3)</enum><text>$20,570,000 for
				fiscal year 2013; and</text>
						</paragraph><paragraph id="H93DEEB7B75E84DA4AF5A72CED9BBCBF1"><enum>(4)</enum><text>$22,627,000 for
				fiscal year
				2014.</text>
