		<section id="H0582D4CE10F648AAB05BD1398F9DB7F9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Aviation Safety Enhancement Act of
			 2009</short-title></quote>.</text>
		</section><section id="H0D5F16AF298A4B2DB1F615612856037B"><enum>2.</enum><header>Aviation safety
			 whistleblower investigation office</header><text display-inline="no-display-inline">Section 106 of title 49, United States Code,
			 is amended by adding at the end the following:</text>
			<quoted-block id="HFC40D24C47CD47288F2C2C0305ECC969" style="OLC">
				<subsection id="H03D4BDC940C5410FBCE109F345F900EE"><enum>(s)</enum><header>Aviation safety
				whistleblower investigation office</header>
					<paragraph id="H17CEBB280A194CF7AC43DB70D2403812"><enum>(1)</enum><header>Establishment</header><text>There
				is established in the Department of Transportation an Aviation Safety
				Whistleblower Investigation Office (in this subsection referred to as the
				<quote>Office</quote>).</text>
					</paragraph><paragraph id="H50842C1E7F824963A5B4CFE080C9EC6C"><enum>(2)</enum><header>Director</header>
						<subparagraph id="HE60FBEC2E58A4945A8FF382849A9D943"><enum>(A)</enum><header>Appointment</header><text>The
				head of the Office shall be the Director, who shall be appointed by the
				Secretary of Transportation.</text>
						</subparagraph><subparagraph id="HA857A4FAF4DB46059FA74D08BE8506B"><enum>(B)</enum><header>Qualifications</header><text>The
				Director shall have a demonstrated ability in investigations and knowledge of,
				or experience in, aviation.</text>
						</subparagraph><subparagraph id="H89FCBAD86E0B4C7797F47FC42776AAE7"><enum>(C)</enum><header>Term</header><text>The
				Director shall be appointed for a term of 5 years.</text>
						</subparagraph><subparagraph id="H39E30EC6868447AA00ED037BE1838C04"><enum>(D)</enum><header>Vacancy</header><text>Any
				individual appointed to fill a vacancy in the position of the Director
				occurring before the expiration of the term for which the individual’s
				predecessor was appointed shall be appointed for the remainder of that
				term.</text>
						</subparagraph></paragraph><paragraph id="H56CCB698AF904DD1A220C98D4EE61B7C"><enum>(3)</enum><header>Complaints and
				investigations</header>
						<subparagraph id="HE57CCD89BEED44C69781C9BFCE324494"><enum>(A)</enum><header>Authority of
				director</header><text>The Director shall—</text>
							<clause id="HC2832556439B4624AE2F7B706EBF0971"><enum>(i)</enum><text>receive complaints
				and information submitted by employees of persons holding operating
				certificates issued under chapter 1 of title 14, Code of Federal Regulations,
				and employees of the Administration with respect to activities that may violate
				an order, regulation, or standard of the Administration or any other provision
				of Federal law relating to aviation safety;</text>
							</clause><clause id="H7D4C0394158F4C1B0056412804B1DBC4"><enum>(ii)</enum><text>assess complaints
				and information submitted under clause (i) and determine whether a substantial
				likelihood exists that a violation of an order, regulation, or standard of the
				Administration or any other provision of Federal law relating to aviation
				safety has occurred; and</text>
							</clause><clause id="H76383797D8F642F8A0701024598BB1B1"><enum>(iii)</enum><text>based on the
				assessment conducted under clause (ii), submit written recommendations to the
				Administrator for further investigation or corrective actions.</text>
							</clause></subparagraph><subparagraph id="H30B19B57556A4B30AD006273AC987D22"><enum>(B)</enum><header>Disclosure of
				identities</header><text>The Director may not disclose the identity of an
				individual who submits a complaint or information under subparagraph (A)(i)
				unless—</text>
							<clause id="H1CE4941A07744E9AAA410521A353ED87"><enum>(i)</enum><text>the individual
				provides written consent to the disclosure; or</text>
							</clause><clause id="H2EE4EB532380496BA01C34CE6EE5B7AE"><enum>(ii)</enum><text>the Director
				determines, in the course of an investigation undertaken in response to the
				complaint or information submitted by the individual, that the disclosure is
				unavoidable.</text>
							</clause></subparagraph><subparagraph id="HB7A14CCE5B4244B88ED4CC1EF77228AA"><enum>(C)</enum><header>Independence of
				director</header><text>The Secretary of Transportation, the Administrator, or
				any officer or employee of the Administration may not prevent or prohibit the
				Director from—</text>
							<clause id="id0353F42DF6AC4B848B66A536D9E76B5E"><enum>(i)</enum><text>initiating,
				carrying out, or completing any assessment of a complaint or information
				submitted subparagraph (A)(i); or</text>
							</clause><clause id="id4E042538DCEC4703B53C0A8F24E57828"><enum>(ii)</enum><text>reporting to
				Congress with respect to any such assessment.</text>
							</clause></subparagraph><subparagraph id="HFA0258EEDE80492295A31C5C55433D76"><enum>(D)</enum><header>Access to
				information</header><text>In conducting an assessment of a complaint or
				information submitted under subparagraph (A)(i), the Director shall have access
				to all records, reports, audits, reviews, documents, papers, recommendations,
				and other material necessary to determine whether a substantial likelihood
				exists that a violation of an order, regulation, or standard of the
				Administration or any other provision of Federal law relating to aviation
				safety has occurred.</text>
						</subparagraph></paragraph><paragraph id="H2C8B8E02586A411990284D25084342FC"><enum>(4)</enum><header>Responses to
				recommendations</header><text>The Administrator shall—</text>
						<subparagraph id="idFCCAE0A2F5A24C8295518EEDC6C4E9E2"><enum>(A)</enum><text>submit a written
				response to a recommendation submitted by the Director under subparagraph
				(A)(iii); and</text>
						</subparagraph><subparagraph id="id79E9FE928E5C45569C37EF244913A8C9"><enum>(B)</enum><text>retain records
				related to any investigations or corrective actions taken in response to the
				recommendation.</text>
						</subparagraph></paragraph><paragraph id="H7C3BC88D82314C09B043BF68D0DCF08F"><enum>(5)</enum><header>Incident
				reports</header><text>If the Director determines there is a substantial
				likelihood that a violation of an order, regulation, or standard of the
				Administration or any other provision of Federal law relating to aviation
				safety has occurred and that the potential violation requires immediate
				corrective action, the Director shall expeditiously report the potential
				violation to the Administrator and the Inspector General of the Department of
				Transportation.</text>
					</paragraph><paragraph id="HE020004B6EFB4C9BAB6FFDB684C3167E"><enum>(6)</enum><header>Reporting of
				criminal violations to inspector general</header><text>If the Director has
				reasonable grounds to believe that there has been a violation of Federal
				criminal law, the Director shall expeditiously report the violation to the
				Inspector General.</text>
					</paragraph><paragraph id="H9EC8234C664441CDA1BCB0B4E579F8B3"><enum>(7)</enum><header>Annual reports
				to Congress</header><text>Not later than October 1 of each year, the Director
				shall submit to Congress a report that contains—</text>
						<subparagraph id="HCF66CA4FE70A4014BF8252FD3FDC9536"><enum>(A)</enum><text>information on the
				number of complaints and the information submitted to the Director under
				paragraph (3)(A)(i) during the preceding 12-month period;</text>
						</subparagraph><subparagraph id="HE533800EBA454B65897CECEA35731E56"><enum>(B)</enum><text>summaries of the
				submissions described in subparagraph (A);</text>
						</subparagraph><subparagraph id="H4F1D3D30E0114C1BB800FE6EEBECDD74"><enum>(C)</enum><text>summaries of
				investigations and corrective actions recommended in response to the
				submissions described in subparagraph (A); and</text>
						</subparagraph><subparagraph id="H5412A4BC949D40BA9BDE5C02B7B8B0D3"><enum>(D)</enum><text>summaries of the
				responses of the Administrator to the recommendations described in subparagraph
				(C).</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H0E489A3FC9A14CFB8BCA9438AD328669"><enum>3.</enum><header>Modification of
			 customer service initiative</header>
			<subsection id="H1ED97B194E094DA1B0D087E3AB5F3867"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
				<paragraph id="H9778ED4983AD40D298454BB688C2AE7F"><enum>(1)</enum><text>Subsections (a)
			 and (d) of section 40101 of title 49, United States Code, directs the Federal
			 Aviation Administration (referred to in this section as the
			 <quote>Administration</quote>) to make safety its highest priority.</text>
				</paragraph><paragraph id="HECFC5E3F6BE246F4BDE6B6FFA1E89B7D"><enum>(2)</enum><text>To ensure that
			 there would be no appearance of a conflict of interest for the Administration
			 in carrying out its safety responsibilities, Congress amended section 40101(d)
			 of such title in section 401 of the Federal Aviation Reauthorization Act of
			 1996 (Public Law 104–264; 110 Stat. 3244) to remove the responsibilities of the
			 Administration to promote airlines.</text>
				</paragraph><paragraph commented="no" id="HAC508EFE4A744CDAA9942388CCA25C7E"><enum>(3)</enum><text>Despite those
			 directives from Congress regarding the priority of safety, the
			 Administration—</text>
					<subparagraph commented="no" id="id57184F77228640C198BA43A769B559A7"><enum>(A)</enum><text>issued a vision
			 statement in which the Administration stated that the vision of the
			 Administration includes <quote>being responsive to our customers and
			 accountable to the public</quote>; and</text>
					</subparagraph><subparagraph commented="no" id="id3275E51F5EAE46ED822E77D08E0D0EDF"><enum>(B)</enum><text>issued a customer
			 service initiative in 2003, which required aviation inspectors to treat air
			 carriers and other aviation certificate holders as <quote>customers</quote>
			 rather than as regulated entities.</text>
					</subparagraph></paragraph><paragraph id="H45D2547525B84C02B38427D332550496"><enum>(4)</enum><text>The initiative
			 described in paragraph (3) appears to have given regulated entities and
			 Administration inspectors the impression that the management of the
			 Administration gives an unduly high priority to the satisfaction of regulated
			 entities regarding its inspection and certification decisions and other lawful
			 actions of its safety inspectors.</text>
				</paragraph><paragraph id="HE2CCF95278D2420E8EE0006002A0A500"><enum>(5)</enum><text>As a result of the
			 emphasis on customer satisfaction, some managers of the Administration have
			 discouraged vigorous enforcement and replaced inspectors whose lawful actions
			 adversely affected an air carrier.</text>
				</paragraph></subsection><subsection id="HCDA6E8620D8A40BB85201B2622D5CE6"><enum>(b)</enum><header>Modification of
			 initiative</header><text display-inline="yes-display-inline">Not later than 90
			 days after the date of the enactment of this Act, the Administrator of the
			 Federal Aviation Administration shall modify the customer service initiative,
			 mission, vision statements, and other statements of policy of the
			 Administration—</text>
				<paragraph id="H825FD5F175E1426B9F05690071E7C286"><enum>(1)</enum><text>to remove any
			 reference to air carriers and other entities regulated by the Administration as
			 <quote>customers</quote>;</text>
				</paragraph><paragraph id="H80D219CDFCC94DBF92AB1929892D0789"><enum>(2)</enum><text display-inline="yes-display-inline">to clarify that in regulating safety, the
			 only customers of the Administration are individuals traveling on aircraft;
			 and</text>
				</paragraph><paragraph id="H71528D265ABC4F3FBB1446A557175355"><enum>(3)</enum><text>to clarify that
			 air carriers and other entities regulated by the Administration do not have the
			 right to select the employees of the Administration who will inspect their
			 operations.</text>
				</paragraph></subsection><subsection id="H702E91D292644515984E434625E62257"><enum>(c)</enum><header>Safety
			 priority</header><text>In carrying out the Administrator’s responsibilities,
			 the Administrator shall ensure that safety is given a higher priority than
			 preventing the dissatisfaction of an air carrier or other entity regulated by
			 the Administration with an employee of the Administration.</text>
			</subsection></section><section id="HB16F8D7730C742E9A3CDB55183DF2FF"><enum>4.</enum><header>Post-employment
			 restrictions for flight standards inspectors</header>
			<subsection id="HAF8E2D40EA304D1286AF2C79D1DBF953"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 44711 of
			 title 49, United States Code, is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id5358643508364F5BB876AEA04F3868CD" style="OLC">
					<subsection id="HE55A5AFF2B5A4FA794488CB3C7872370"><enum>(d)</enum><header>Post-employment
				restrictions for flight standards inspectors</header><text>A person holding an
				operating certificate issued under chapter 1 of title 14, Code of Federal
				Regulations, may not knowingly employ, or engage in employment negotiations or
				make a contractual arrangement of employment with, an employee of the Federal
				Aviation Administration if the employee, in the preceding 2-year period—</text>
						<paragraph id="H576AF63648134C90954D87B76BE1600"><enum>(1)</enum><text display-inline="yes-display-inline">served as, or was responsible for oversight
				of, a flight standards inspector of the Agency; and</text>
						</paragraph><paragraph id="H7F1A0BEDE95140838F1B6D49574CBA98"><enum>(2)</enum><text>had responsibility
				to inspect, or oversee inspection of, the operations of the certificate
				holder.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H457147C916584BC7B9198E212D5772B7"><enum>(b)</enum><header>Applicability</header><text>The
			 amendment made by subsection (a) shall apply with respect to individuals
			 employed, on or after the date of the enactment of this Act, by the Federal
			 Aviation Administration.</text>
			</subsection></section><section id="id1840E2955DE64D3184843B31DC144909"><enum>5.</enum><header>Assignment of
			 principal supervisory inspectors</header>
			<subsection id="idDDD0EE3122FB487B937B57369188DB6B"><enum>(a)</enum><header>In
			 general</header><text>An individual serving as a principal supervisory
			 inspector of the Federal Aviation Administration may not be responsible for
			 overseeing the operations of the same air carrier for a continuous period of
			 more than 5 years.</text>
			</subsection><subsection id="id4D5F0D0F0B37494EB20F8B7334157CB4"><enum>(b)</enum><header>Transitional
			 provision</header><text>An individual serving as a principal supervisory
			 inspector of the Administration with respect to an air carrier on the day
			 before the date of the enactment of this Act may be responsible for overseeing
			 the operations of that air carrier until the later of—</text>
				<paragraph id="id45A9849840F848DCB96E6FB8ED19BBB9"><enum>(1)</enum><text>the last day of
			 the 5-year period described in subsection (a); or</text>
				</paragraph><paragraph id="id08F9D8D0AE6B42769A6A4A60FEB64A61"><enum>(2)</enum><text>the last day of
			 the 2-year period beginning on such date of enactment.</text>
				</paragraph></subsection><subsection id="id5358356326054506961D547EFB0E9A4B"><enum>(c)</enum><header>Issuance of
			 order</header><text>Not later than 90 days after the date of the enactment of
			 this Act, the Administrator of the Federal Aviation Administration shall issue
			 an order to carry out this section.</text>
			</subsection><subsection id="idFDD8DE49DB564956ACCC7A10EAFD6CCB"><enum>(d)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated to the
			 Administrator such sums as may be necessary to carry out this section.</text>
			</subsection></section><section id="IDbdf9f5460e6a477782bf49c9c76a3be9"><enum>6.</enum><header>Improved
			 Voluntary Disclosure Reporting System</header>
			<subsection id="ID73d135b3c6424cd3bdac186073a94932"><enum>(a)</enum><header>Voluntary
			 Disclosure Reporting Program defined</header><text>In this section, the term
			 <term>Voluntary Disclosure Reporting Program</term> means the program
			 established by the Federal Aviation Administration through Advisory Circular
			 00–58A, dated September 8, 2006.</text>
			</subsection><subsection id="ID9c121c836d0a4dcd9b7cb9e32fc13356"><enum>(b)</enum><header>Verification
			 and evaluation</header><text>The Administrator of the Federal Aviation
			 Administration shall modify the Voluntary Disclosure Reporting Program to
			 require inspectors to—</text>
				<paragraph id="IDeadd263bae8f449fbd05c8bd40242394"><enum>(1)</enum><text>verify that air
			 carriers implement comprehensive solutions to correct the underlying causes of
			 the violations voluntarily disclosed by such air carriers pursuant to the
			 Program; and</text>
				</paragraph><paragraph id="ID94112f53b0d74f4aab8c8c0fe4e598b0"><enum>(2)</enum><text>evaluate, before
			 accepting a new report with respect to a previously disclosed violation,
			 whether the air carrier implemented a comprehensive solution with respect to
			 the violation as required by paragraph (1).</text>
				</paragraph></subsection><subsection id="ID0d70b62e1b3b44d8ae41af80a6446f2d"><enum>(c)</enum><header>Supervisory
			 review of voluntary self-disclosures</header><text>The Administrator shall
			 establish a process by which each voluntary disclosure received from an air
			 carrier about the practices of that air carrier is reviewed and approved by a
			 supervisor after the initial paper review by an inspector.</text>
			</subsection></section><section id="ID4910e58fd58340ecabdd345b4e460740"><enum>7.</enum><header>National Review
			 Team</header>
			<subsection id="ID539bb217181b4bdab3b7713e81ec11f7"><enum>(a)</enum><header>Establishment</header><text>The
			 Administrator of the Federal Aviation Administration shall establish a National
			 Review Team, comprised of Federal Aviation Administration inspectors who are
			 serving or have served as principal supervisory inspectors.</text>
			</subsection><subsection id="IDee3185a816514d1da66773ce53cd022c"><enum>(b)</enum><header>Audits</header><text>The
			 National Review Team shall conduct periodic, unannounced audits throughout the
			 United States of the operations and maintenance practices and procedures of air
			 carriers to evaluate the effectiveness of the oversight of air carriers carried
			 out by the Federal Aviation Administration.</text>
			</subsection><subsection id="ID7a50ddaf3d384a1b95d9098b6b72966e"><enum>(c)</enum><header>Supervision</header><text>The
			 National Review Team shall be directly supervised by the Associate
			 Administrator for Aviation Safety.</text>
			</subsection><subsection id="IDce334ae9d1bb4935ba5843d6d6208fa1"><enum>(d)</enum><header>Limitation</header><text>The
			 Associate Administrator for Aviation Safety shall prohibit a member of the
			 National Review Team from participating in any audit of an air carrier under
			 subsection (b) if the member has previously had responsibility for inspecting,
			 or overseeing the inspection of, the operations of that air carrier.</text>
			</subsection></section><section id="HAA651726C93C4EB9973D70DCD212B91C"><enum>8.</enum><header>Headquarters
			 review of air transportation oversight system database</header>
			<subsection id="H1A616B0A40DA4E58B4E48FF188B6CB16"><enum>(a)</enum><header>Reviews</header><text display-inline="yes-display-inline">The Administrator of the Federal Aviation
			 Administration shall establish a process by which the air transportation
			 oversight system database of the Federal Aviation Administration is reviewed by
			 a team of employees of the Administration on a monthly basis to ensure—</text>
				<paragraph id="HCC08F3C4F6DD496281C8CD604DE300B8"><enum>(1)</enum><text>the identification
			 of any trends with respect to compliance or noncompliance with the regulations,
			 advisory directives, policies, and procedures of the Administration; and</text>
				</paragraph><paragraph id="H5DF243B2C7454E1BB12FB9FA4F38FD0"><enum>(2)</enum><text>that appropriate
			 actions are taken to correct any trends toward noncompliance identified under
			 paragraph (1).</text>
				</paragraph></subsection><subsection id="H77C173788AD24E3FADE44100416B24DE"><enum>(b)</enum><header>Monthly team
			 reports</header>
				<paragraph id="H9A7B7024CAF94F8BAAC476A2F3F5084C"><enum>(1)</enum><header>In
			 general</header><text>The team of employees conducting a monthly review of the
			 air transportation oversight system database under subsection (a) shall submit
			 a report on the results of the review to the Administrator, the Associate
			 Administrator for Aviation Safety, and the Director of the Flight Standards
			 Service.</text>
				</paragraph><paragraph id="H41459524CCD84FB98F93B19E498EB794"><enum>(2)</enum><header>Contents</header><text>Each
			 report submitted under paragraph (1) shall identify—</text>
					<subparagraph id="H86616E2C13A341740067BDD009E14C0"><enum>(A)</enum><text>any trends in with
			 respect to compliance or noncompliance identified under subsection (a)(1) by
			 the team of employees conducting the review required under subsection (a);
			 and</text>
					</subparagraph><subparagraph id="HD5893FCE1D364245ACEC3F7D37B3CC49"><enum>(B)</enum><text>any corrective
			 actions taken or proposed to be taken under subsection (a)(2) in response to
			 any trends toward noncompliance.</text>
					</subparagraph></paragraph></subsection><subsection id="H5ED3B7F8C602455BB1DC47B9F26C6C00"><enum>(c)</enum><header> Quarterly
			 reports to Congress</header><text display-inline="yes-display-inline">The
			 Administrator shall submit a quarterly report to the Committee on Commerce,
			 Science, and Transportation of the Senate and the Committee on Transportation
			 and Infrastructure of the House of Representatives that—</text>
				<paragraph id="id6C3BC56ECE91417E85A26FC6CEFF3A9A"><enum>(1)</enum><text display-inline="yes-display-inline">describes the results of the reviews of the
			 air transportation oversight system database conducted under subsection (a);
			 and</text>
				</paragraph><paragraph id="idC5F5386DD3184CAEA0F227A3FFC388AE"><enum>(2)</enum><text display-inline="yes-display-inline">includes copies of reports received under
			 subsection (b).</text>
				</paragraph></subsection></section><section id="id39AA60AA26BA4563A8B74F3FB837087A"><enum>9.</enum><header>Rulemaking</header><text display-inline="no-display-inline">Not later than 90 days after the date of the
			 enactment of this Act, the Administrator of the Federal Aviation Administration
			 shall prescribe such regulations as may be necessary to carry out this Act and
			 the amendments made by this Act.</text>
