		<official-title>To provide financial aid to local law enforcement
		  officials along the Nation’s borders, and for other purposes.</official-title>

		<section id="id44DDC7E486F94B1A9763134526A92829" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Border Law Enforcement Anti-Drug
			 Trafficking Act of 2009</short-title></quote>.</text>
		</section><section id="id1EEC49B749B14B6FAF8FBCF09598FB7D"><enum>2.</enum><header>Border Relief
			 Grant Program</header>
			<subsection id="ID91F70FE9AB334732B6711032F02FDDC3"><enum>(a)</enum><header>Grants
			 authorized</header>
				<paragraph id="ID6357932A570947C883FD1EEAA4713E18"><enum>(1)</enum><header>In
			 general</header><text>The Attorney General is authorized to award grants
			 to—</text>
					<subparagraph id="idD5307D17A5F34C52A30CB73384B93321"><enum>(A)</enum><text>eligible law
			 enforcement agencies, or a coalition of such agencies, to provide the resources
			 described in subsection (b) to address drug-related criminal activity that
			 occurs in the jurisdiction of such agencies; and</text>
					</subparagraph><subparagraph id="idBAC4D114BC81462AB497F73DD9D8B836"><enum>(B)</enum><text>institutions of
			 higher education that provide assistance to law enforcement agencies in
			 counties described in subparagraph (A) or (B) of subsection (d)(1) to provide
			 the resources described in subsection (b)(4).</text>
					</subparagraph></paragraph><paragraph id="idC160DEA375384E65920C0251D13BA65C"><enum>(2)</enum><header>Competitive
			 basis</header><text>The Attorney General shall award grants under this section
			 on a competitive basis.</text>
				</paragraph><paragraph id="idC3D37B35B13F4536B202ADF121F73C25"><enum>(3)</enum><header>Priority</header><text>In
			 awarding grants for the uses described in paragraphs (1) through (3) of
			 subsection (b), the Attorney General shall give priority to law enforcement
			 agencies located in a county that is within 150 miles from the United States
			 border with Mexico.</text>
				</paragraph></subsection><subsection id="IDB31A5CF1D31A4DAAA09AD81F56BDC8EA"><enum>(b)</enum><header>Use of
			 funds</header><text>Grants awarded under this section may only be used to
			 provide additional resources for eligible law enforcement agencies to address
			 drug-related criminal activity, and for the training and assistance described
			 in paragraph (4) for organizations described in subsection (a)(2), including
			 resources to—</text>
				<paragraph id="id092F805EE3C34890BA03180BB650B928"><enum>(1)</enum><text>combat criminal
			 activities along the Southern border by—</text>
					<subparagraph id="idFA247EDD8B044FE288C8E70B7225C821"><enum>(A)</enum><text>obtaining,
			 upgrading, or maintain equipment;</text>
					</subparagraph><subparagraph id="idD0A1E997212B4D979037EDC19A3E959D"><enum>(B)</enum><text>hiring additional
			 personnel;</text>
					</subparagraph><subparagraph id="id2EE347A0AD974200B8966C45900E4C55"><enum>(C)</enum><text>reimbursing
			 operational expenditures, including overtime and transportation costs;
			 and</text>
					</subparagraph><subparagraph id="idE76C083579034A2582BA840D9C0527F3"><enum>(D)</enum><text>providing other
			 assistance necessary to address drug-related criminal activity;</text>
					</subparagraph></paragraph><paragraph id="idCA2FD3B5FA0D40C891B3177A95FC6B29"><enum>(2)</enum><text>facilitate
			 information sharing and collaboration by—</text>
					<subparagraph id="ID9a2feee60fcd4aaf8bda5f2e168f944b"><enum>(A)</enum><text>establishing,
			 maintaining, or enhancing multi-jurisdictional intelligence gathering and
			 sharing activities;</text>
					</subparagraph><subparagraph id="IDc2f9678977d1414784aa5397d14928e3"><enum>(B)</enum><text>facilitating
			 regional crime prevention and reduction efforts; and</text>
					</subparagraph><subparagraph id="ID1ab2eeba974a47ca8cd6c993e5b527c9"><enum>(C)</enum><text>strengthening
			 partnerships between Federal, tribal, State, and local law enforcement
			 agencies;</text>
					</subparagraph></paragraph><paragraph id="IDcd85a0f4890148ec8b60f1722562b1c1"><enum>(3)</enum><text>enhance jails,
			 community corrections, and detention operations by—</text>
					<subparagraph id="ID408560b1dfd04455af3a601bf9c3b1a0"><enum>(A)</enum><text>improving the
			 administration and operations of correction functions related to reducing and
			 preventing criminal narcotics activity;</text>
					</subparagraph><subparagraph id="IDa3f04f98cd71421fa5eac6223ba32c50"><enum>(B)</enum><text>improving access
			 to intelligence and collaboration between law enforcement and correctional
			 system personnel;</text>
					</subparagraph><subparagraph id="IDa8dc93aa01cd4961871d93f438914936"><enum>(C)</enum><text>reducing the
			 recidivism rates of drug offenders; and</text>
					</subparagraph><subparagraph id="ID2deaa09929974d1f83b090b4bf1d34ec"><enum>(D)</enum><text>hiring detention,
			 probation, parole, and other corrections personnel for implementation of the
			 efforts described in this paragraph; and</text>
					</subparagraph></paragraph><paragraph id="IDe0e2267ccded47fcbcb09be0a8d74f03"><enum>(4)</enum><text>provide training
			 and technical assistance, including training and assistance related to—</text>
					<subparagraph id="id613D18A686394835ACC5FAB7F298803E"><enum>(A)</enum><text>narcotics-related
			 kidnapping negotiation and rescue tactics;</text>
					</subparagraph><subparagraph id="idF3E6D09AA97347DBB5C4946FE83A3876"><enum>(B)</enum><text>intelligence and
			 information sharing on drug trafficking organizations; and</text>
					</subparagraph><subparagraph id="id32AFC6696E264ABBBD0F511E4C6F32A1"><enum>(C)</enum><text>the interdiction
			 of narcotics, weapons, and illegal drug proceeds.</text>
					</subparagraph></paragraph></subsection><subsection id="ID34018257C8DB4A1C8C328943FAF61FC4"><enum>(c)</enum><header>Application</header>
				<paragraph id="ID1CDADA85567A4950A53411E401981E23"><enum>(1)</enum><header>In
			 general</header><text>Each eligible law enforcement agency, or coalition of
			 such agencies, seeking a grant under this section shall submit an application
			 to the Attorney General at such time, in such manner, and accompanied by such
			 information as the Attorney General may reasonably require.</text>
				</paragraph><paragraph id="ID95F258B7DCB84E15A07E0D31802503D0"><enum>(2)</enum><header>Contents</header><text>Each
			 application submitted under paragraph (1) shall—</text>
					<subparagraph id="ID4F4789A939414A81A778C767D035B98A"><enum>(A)</enum><text>describe the
			 activities for which assistance under this section is sought; and</text>
					</subparagraph><subparagraph id="IDD4AD8EB529CF4524B6367DC8DFEF6F36"><enum>(B)</enum><text>provide such
			 additional assurances as the Attorney General determines to be essential to
			 ensure compliance with the requirements under this section.</text>
					</subparagraph></paragraph></subsection><subsection id="ID00B04E8B35DA4FD8A8FC2F5286AB8AB8"><enum>(d)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="id08F8FAFE245F4E8694A376D069E4FB85"><enum>(1)</enum><header>Eligible law
			 enforcement agency</header><text>The term <term>eligible law enforcement
			 agency</term> means a tribal, State, or local law enforcement agency, including
			 a community corrections agency and any agency that employs prosecutors,
			 probation officers, or parole officers, which is located or performs duties
			 in—</text>
					<subparagraph id="id55D0AAE5A0F94799A48BCCAF723E638A"><enum>(A)</enum><text>Arizona,
			 California, New Mexico, or Texas; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9845F34702F3488381BE34434AF60A75"><enum>(B)</enum><text>a jurisdiction
			 that has been designated by the Director of the Office of Drug Control Policy
			 as a High Intensity Drug Trafficking Area.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCF0264E59C2E4DF590F9715CE7C80A8C"><enum>(2)</enum><header>High intensity
			 drug trafficking area</header><text>The term <term>High Intensity Drug
			 Trafficking Area</term> means any jurisdiction designated as a <quote>High
			 Intensity Drug Trafficking Area</quote> by the National Drug Control Program
			 under section 707 of the Office of National Drug Control Policy Reauthorization
			 Act of 1998 (21 U.S.C. 1706).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID6132A134FEBD46389636CEC1ED56D79F"><enum>(e)</enum><header>Authorization
			 of appropriations</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id8632A0355AE54B5888CD972DD4ED773E"><enum>(1)</enum><header>In
			 general</header><text>There are authorized to be appropriated $100,000,000 for
			 each of the fiscal years 2010 through 2015 to carry out the provisions of this
			 section.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFCE6C0768D244876A7185FE52EC5F262"><enum>(2)</enum><header>Allocation of
			 authorized funds</header><text>Of the amounts appropriated pursuant to
			 paragraph (1)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id14E8725D7A8648C09847900F933027A3"><enum>(A)</enum><text>not more than 33
			 percent may be set aside for High Intensity Drug Trafficking Areas; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7ABBD65A93334268B1E2E2148443F4A7"><enum>(B)</enum><text>not more than 30
			 percent may be used for activities described in paragraphs (3) and (4) of
			 subsection (b).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD574167C292F44C3B4F46F58FDEC0EF1"><enum>(3)</enum><header>Supplement not
			 supplant</header><text>Amounts appropriated for grants pursuant to paragraph
			 (1) shall be used to supplement and not to supplant other tribal, State, and
			 local public funds obligated for the purposes provided under this
			 section.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id8A95D2D4FE22412A98E24952183F56BA"><enum>3.</enum><header>Enforcement of
			 Federal immigration law</header><text display-inline="no-display-inline">Nothing in this Act may be construed to
			 authorize tribal, State, or local law enforcement agencies or officers of such
			 agencies to exercise Federal immigration law enforcement authority.</text>
