		<legis-type>A BILL</legis-type>
		<official-title>To require the Secretary of Energy to conduct a study of
		  the impact of energy and climate policy on the competitiveness of
		  energy-intensive manufacturing and measures to mitigate those
		  effects.</official-title>

		<section id="idA48A0606233A403DA3D4C39FDF0E77AE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Carbon Leakage Mitigation Study Act of
			 2009</short-title></quote>.</text>
		</section><section id="ID2b27ce5a2d8743eaaf0e06332211bfb1"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="IDd23c4c52c6e44f599d36f7cb76ffc94c"><enum>(1)</enum><header>Cap-and-trade
			 program</header><text>The term <term>cap-and-trade program</term> means an
			 economy-wide program enacted by Congress under which greenhouse gas emission
			 allowances are distributed or auctioned to control those emissions under the
			 Clean Air Act (42 U.S.C. 7401 et seq.).</text>
			</paragraph><paragraph id="IDddf10c460d9949369f1576074cf336eb"><enum>(2)</enum><header>Carbon
			 leakage</header><text>The term <term>carbon leakage</term> means any
			 substantial increase (as determined by the Secretary) in greenhouse gas
			 emissions—</text>
				<subparagraph id="id95EFAE8AEDD64CD1874C7366B27E4D35"><enum>(A)</enum><text>by a
			 manufacturing facility located in a country without a greenhouse gas emission
			 regulation commensurate to a cap-and-trade program; or</text>
				</subparagraph><subparagraph id="id7EEB55353F5D44459C079A668415ABA9"><enum>(B)</enum><text>that is caused by
			 an incremental cost of production increase in the United States as a result of
			 a domestic cap-and-trade program.</text>
				</subparagraph></paragraph><paragraph id="ID3b0cc7b4819e4e9fa5775ca9045604f4"><enum>(3)</enum><header>Compensatory
			 measure</header>
				<subparagraph id="id9426FD8A4A094AEF9F1E1598267F8B9E"><enum>(A)</enum><header>In
			 general</header><text>The term <term>compensatory measure</term> means any
			 provision of a cap-and-trade program intended to mitigate the risk of carbon
			 leakage.</text>
				</subparagraph><subparagraph id="id363D6DB00D6D418490D23945713A42DC"><enum>(B)</enum><header>Inclusions</header><text>The
			 term <term>compensatory measure</term> includes a provision described in
			 subparagraph (A) relating to—</text>
					<clause id="id37D11E3F80D84698AD1FF706E90E32AD"><enum>(i)</enum><text>emission
			 allowance allocation; or</text>
					</clause><clause id="idF3AF16B799724AE299B1590336A20A3D"><enum>(ii)</enum><text>a
			 border tax adjustment.</text>
					</clause></subparagraph></paragraph><paragraph id="IDc0a31cdb026f4af2aef890170ee2d2d0"><enum>(4)</enum><header>Greenhouse
			 gas</header><text>The term <term>greenhouse gas</term> means any gas designated
			 as a greenhouse gas under a cap-and-trade program.</text>
			</paragraph><paragraph id="IDae6ee711657c4c97a081cab60e22e0db"><enum>(5)</enum><header>Output</header><text>The
			 term <term>output</term> means the total tonnage or other standard unit of
			 production (as determined by the Secretary) produced by a manufacturing
			 facility.</text>
			</paragraph><paragraph id="IDa0cdfec03eaa47a4b350ebcb77c6992a"><enum>(6)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Energy.</text>
			</paragraph></section><section id="IDa031e6009774492d8a3bd6fe31a5c335"><enum>3.</enum><header>Industry
			 productivity and carbon leakage study</header>
			<subsection id="ID80ad00e35b814b149427e72d1e35b44f"><enum>(a)</enum><header>In
			 general</header><text>Not later than 120 days after the date of enactment of
			 this Act, the Secretary, in consultation with the Secretary of Commerce, the
			 Administrator of the Environmental Protection Agency, and the heads of other
			 appropriate Federal departments and agencies, shall conduct a study—</text>
				<paragraph id="ID43e90095d03244ecb1dc7c5582c35ee6"><enum>(1)</enum><text>to characterize
			 the relative risk of carbon leakage and changes in output and investment in
			 United States industrial sectors and subsectors caused by a potential
			 cap-and-trade program implemented in the United States, in the absence of
			 commensurate greenhouse gas emission regulations in other countries; and</text>
				</paragraph><paragraph id="ID677381d050634d58941a06621dc6441b"><enum>(2)</enum><text>to estimate the
			 change in output in industrial sectors and subsectors of the United States that
			 are determined to be at risk of significant carbon leakage.</text>
				</paragraph></subsection><subsection id="IDe0f1f02e996b4747b71c3c263c1e1b8d"><enum>(b)</enum><header>Inclusions</header><text>The
			 study under subsection (a) shall include an assessment of—</text>
				<paragraph id="ID3dbe9eee0cce40c2a853dfd344a91e8b"><enum>(1)</enum><text>expected United
			 States industrial production, imports, and exports, absent a cap-and-trade
			 program;</text>
				</paragraph><paragraph id="ID244a84a5da984148ac06468e27f28883"><enum>(2)</enum><text>the direct and
			 indirect energy intensity and greenhouse gas intensity of United States
			 industries in relation to gross value-added, cost of production, and total
			 shipment values;</text>
				</paragraph><paragraph id="ID0dcfa8f4b1c34a2fbe1fe490f8ba9352"><enum>(3)</enum><text>the price
			 elasticity of United States industries;</text>
				</paragraph><paragraph id="IDcc2281493ec446b4a748bcc71490bbab"><enum>(4)</enum><text>the trade
			 elasticity of United States industries;</text>
				</paragraph><paragraph id="ID992507a973224ecb800fed6791aebc2e"><enum>(5)</enum><text>the trade
			 intensity (calculated as imports plus exports, relative to domestic
			 consumption) of United States industries;</text>
				</paragraph><paragraph id="IDc8596dc2db8741d18432f95162b1207a"><enum>(6)</enum><text>other qualitative
			 indicators of the ability of United States industries to pass on cost increases
			 to consumers, such as—</text>
					<subparagraph id="ID934402a057f0485689d96b310389d75c"><enum>(A)</enum><text>market structure
			 and concentration;</text>
					</subparagraph><subparagraph id="IDf1e2f19ffb94444ca03611a6b2c0da30"><enum>(B)</enum><text>level of product
			 differentiation;</text>
					</subparagraph><subparagraph id="ID7a8b7d9e0b734c4e828288805adca677"><enum>(C)</enum><text>the availability
			 of close substitutes for customers; and</text>
					</subparagraph><subparagraph id="IDa6be111bdd50429b99f143945db40799"><enum>(D)</enum><text>factors that
			 constrain the response of foreign producers to an increase in United States
			 production costs;</text>
					</subparagraph></paragraph><paragraph id="ID7717f077f14f445088caf391bfe7d945"><enum>(7)</enum><text>the overall risk
			 of carbon leakage, expressed in list form by sector and subsector of the United
			 States economy, resulting from a cap-and-trade program;</text>
				</paragraph><paragraph id="ID88e4bdd257094d69b848acfe88c1face"><enum>(8)</enum><text>the impacts on
			 the production, profitability, greenhouse gas emissions, and level of
			 employment of industries at risk of carbon leakage, expressed—</text>
					<subparagraph id="ID2d4807f7a54f4b49aa32674827be40e1"><enum>(A)</enum><text>by sector and
			 subsector, separately and in aggregate, as a percentage of gross domestic
			 product;</text>
					</subparagraph><subparagraph id="IDec150b945d034e4282c6350b439262c7"><enum>(B)</enum><text>in relation to
			 national production, trade, and employment projections under a potential
			 cap-and-trade program; and</text>
					</subparagraph><subparagraph id="IDcb67d0751852483890489d54a60e3a75"><enum>(C)</enum><text>as compared to
			 baseline projections absent a cap-and-trade program;</text>
					</subparagraph></paragraph><paragraph id="ID89c990270d6143f6a27ba3cfc98a077b"><enum>(9)</enum><text>the manner in
			 which the economic impacts of climate change policies compare to changes over
			 time in other factors affecting production and investment by industries, such
			 as—</text>
					<subparagraph id="ID0dc7f6a8e3f14d72882241fbb1fca523"><enum>(A)</enum><text>changes in
			 production costs;</text>
					</subparagraph><subparagraph id="ID76207fe1492848c1bc9bc1ef87d831f4"><enum>(B)</enum><text>currency exchange
			 rates;</text>
					</subparagraph><subparagraph id="ID668acc8bb56448268f6428a81c04a25c"><enum>(C)</enum><text>consumer
			 preference; and</text>
					</subparagraph><subparagraph id="ID3ae38aecde2b4cafb90e242bd5de9267"><enum>(D)</enum><text>other relevant
			 factors; and</text>
					</subparagraph></paragraph><paragraph id="IDa6f5e3407f0d4570b1a817a3f092ee5e"><enum>(10)</enum><text>the
			 highest-priority trading partners of the industries at risk of carbon leakage,
			 listed in order of priority.</text>
				</paragraph></subsection><subsection id="IDc2e403498ccc4c7b9acb233c12b7e0f2"><enum>(c)</enum><header>Report</header><text>On
			 completion of the study under this section, the Secretary shall submit to
			 Congress a report describing the results of the study, including
			 recommendations regarding data collection activities and subsequent studies by
			 the Secretary, if any.</text>
			</subsection></section><section id="ID5522a4742bbb42258819770743341626"><enum>4.</enum><header>Study of
			 measures to mitigate carbon leakage</header>
			<subsection id="ID1bc42706d231456a83adfae93dab9d06"><enum>(a)</enum><header>In
			 general</header><text>Not later than 180 days after the date of enactment of
			 this Act, but not earlier than the date of submission to Congress of the report
			 regarding the competitiveness study under section 3(c), the Secretary, in
			 consultation with the Secretary of Commerce, the Administrator of the
			 Environmental Protection Agency, and the heads of other appropriate Federal
			 departments and agencies, shall conduct a study to evaluate the impact of
			 potential compensatory measures to prevent carbon leakage resulting from a
			 cap-and-trade program.</text>
			</subsection><subsection id="ID3f405c7fe01a4651a3231e2b53182171"><enum>(b)</enum><header>Inclusions</header><text>The
			 study under subsection (a) shall include an assessment of—</text>
				<paragraph id="ID8a019dfa0cc7464c8e3fe066e4ed89ae"><enum>(1)</enum><text>compensatory
			 measures used by other jurisdictions to prevent carbon leakage under regional,
			 national, or multinational climate policies;</text>
				</paragraph><paragraph id="ID6002c8f670fa473fabf9487beb1de181"><enum>(2)</enum><text>the projected
			 risk of carbon leakage from United States industries under potential prices on
			 greenhouse gas emissions and realistic scenarios for international climate
			 policy, with compensatory measures, including—</text>
					<subparagraph id="ID1299ea22b77d44dc913bdee2b4f0c155"><enum>(A)</enum><text>the production,
			 profitability, and level of employment of the industries at risk of carbon
			 leakage, expressed separately and in aggregate;</text>
					</subparagraph><subparagraph id="ID378831e76a5f472cb6fc0cce7fee3aab"><enum>(B)</enum><text>expected changes
			 in the domestic market shares of products produced in the United States, as
			 compared to products imported into the United States; and</text>
					</subparagraph><subparagraph id="ID528b92ba636b427b9e0e9c436171684f"><enum>(C)</enum><text>expected changes
			 in the foreign market shares of products produced in the United States, as
			 compared to products produced by other countries; and</text>
					</subparagraph></paragraph><paragraph id="IDb283cc05cb3e472eb5a8dff6df23f628"><enum>(3)</enum><text>the consistency
			 of compensatory measures with international trade commitments (including
			 principles of the World Trade Organization).</text>
				</paragraph></subsection><subsection id="ID588c0ec9363c426291201cb44b336b6b"><enum>(c)</enum><header>Report</header><text>On
			 completion of the study under this section, the Secretary shall submit to
			 Congress a report describing the results of the study, including
			 recommendations of the Secretary, if any.</text>
