		<official-title>To amend the Homeland Security Act of 2002 to authorize
		  grants for use in response to homeland security events of national and
		  international significance.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Local Homeland Event Response
			 Operations Grant Act of 2009</short-title></quote>.</text>
		</section><section id="IDa7b527da2a2e415ca7d899b61f783989"><enum>2.</enum><header>Grants for local
			 homeland event response operations</header>
			<subsection id="id3CF3CFF7B7294077B4791333B9D28F98"><enum>(a)</enum><header>In
			 general</header><text>Title XX of the Homeland Security Act of 2002 (6 U.S.C.
			 601 et seq.) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idB94DB3BBC6CF49E6982F2C344C2039D0" style="OLC">
					<subtitle id="id53AFFF431B984AF199A2D407DEDCAC6C"><enum>C</enum><header>Other
				assistance</header>
						<section id="id731B470E6C1D44EEB5E5B6A255096DC8"><enum>2041.</enum><header>Grants for
				local homeland event response operations</header>
							<subsection id="ID4de63e7928b04ad89fc9db8854cb248a"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
								<paragraph id="idE211BB657CD444508BB2822C0341C36C"><enum>(1)</enum><header>Eligible
				entity</header><text>The term <term>eligible entity</term> means a law
				enforcement agency or fire department of a State or local government (including
				a tribal government), including a police department, sheriff’s office, or
				homeland security or emergency management department, that—</text>
									<subparagraph id="id82B2CD2A09314B4BA34C414EE9C087B4"><enum>(A)</enum><text>normally operates
				not more than 50 miles from—</text>
										<clause id="id178166B58CA345358D7FA9A674BA6A4E"><enum>(i)</enum><text>the location of a
				special event; or</text>
										</clause><clause id="ID2e5b66770c0a42b6ba75fe6f785ff514"><enum>(ii)</enum><text>the United
				States port of entry closest to the special event, if the special event takes
				place outside of the United States; or</text>
										</clause></subparagraph><subparagraph id="idE6C36889BAEC4852920DAE58973B6CAA"><enum>(B)</enum><text>participates in
				preparation for and activities during or directly following a special
				event.</text>
									</subparagraph></paragraph><paragraph id="id1EF4A4FBCABF4380AAEDE0041260C910"><enum>(2)</enum><header>Special
				event</header><text>The term <term>special event</term> means an event
				designated under subsection (c).</text>
								</paragraph></subsection><subsection id="ID431acf5741f34e8282d0d515c3ff2487"><enum>(b)</enum><header>Grants</header><text>The
				Secretary may make a grant to an eligible entity for overtime expenses relating
				to preparation for and activities during or directly following from a special
				event.</text>
							</subsection><subsection id="IDc293c9438d5048fa996483997c4bcb5d"><enum>(c)</enum><header>Designation of
				special events</header>
								<paragraph id="id24C51425716742469328AFE894405F02"><enum>(1)</enum><header>In
				general</header><text>Regardless of whether an event is designated as a special
				event or given another similar security designation under any other provision
				of law, the President or the Secretary may designate an event as a special
				event for purposes of this section if the event is an event of significant
				national importance (including international events of significant national
				importance) that—</text>
									<subparagraph id="id342EC531C18C44FDBA3206AB97E75446"><enum>(A)</enum><text>may
				require—</text>
										<clause id="ID1f4df5c746764ed5a9fee4630f405b0c"><enum>(i)</enum><text>extensive Federal
				interagency security and incident management preparedness;</text>
										</clause><clause id="ID1b4ae2f1e2d541b388a491f70c170e54"><enum>(ii)</enum><text>predeployment of
				Federal assets;</text>
										</clause><clause id="ID1fe273e63cbf424599a4433aabd630af"><enum>(iii)</enum><text>consultation,
				technical advice and support to specific functional areas in which the State or
				local government agencies may lack expertise or key resources;</text>
										</clause><clause id="ID72f53d6c24b943cf9854405e4392b7fd"><enum>(iv)</enum><text>designation of a
				Federal Coordinator; and</text>
										</clause><clause id="ID0ba950471be54a76a2479eb887370ba1"><enum>(v)</enum><text>development of an
				integrated Federal Support Plan; or</text>
										</clause></subparagraph><subparagraph id="id0DCB2A4F2D5F4958936BA5A6B5269AF0"><enum>(B)</enum><text>may
				require—</text>
										<clause id="IDb4969ad7c83942b89a8c8288cd43603a"><enum>(i)</enum><text>direct
				national-level Federal support and situational awareness;</text>
										</clause><clause id="ID68549d771e9f4401ac761f530f81f1d7"><enum>(ii)</enum><text>limited
				predeployment of Federal assets;</text>
										</clause><clause id="ID1c20044513cf45e8be84b1dbbf391788"><enum>(iii)</enum><text>consultation,
				technical advice, and support to specific functional areas in which the State
				or local government agencies may lack expertise or key resources;</text>
										</clause><clause id="IDf5fd560f89bc4932a3aa1ee43d6410f9"><enum>(iv)</enum><text>designation of a
				Federal Coordinator; and</text>
										</clause><clause id="IDd1571679ceaa4011b1150f43c398e897"><enum>(v)</enum><text>development of an
				integrated Federal Support Plan.</text>
										</clause></subparagraph></paragraph><paragraph id="id053689C5A3104E2FA979BB632DA4E396"><enum>(2)</enum><header>Special events
				of national significance</header><text>Any event that has been designated by
				the President as a special event of national significance under section 3056(e)
				of title 18, United States Code, or a similar provision of law shall be
				designated as a special event.</text>
								</paragraph></subsection><subsection id="IDd07b7fe11ec841238a658be74d56e30c"><enum>(d)</enum><header>Applications</header>
								<paragraph id="id26A55AE78D0C481992918705173BEF36"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">An eligible entity
				may apply for a grant under this section, and shall submit such information in
				support of the application as the Secretary may reasonably require.</text>
								</paragraph><paragraph id="id8ECDED6F291D4A4189D1AB857D725FD8"><enum>(2)</enum><header>Joint
				applications authorized</header><text>A group of eligible entities may jointly
				submit an application for a grant under this section for a single special
				event.</text>
								</paragraph><paragraph id="IDc62656031df74ed6b345f8bf249f6a8b"><enum>(3)</enum><header>Notification of
				opportunity To apply</header><text>The Secretary shall—</text>
									<subparagraph id="idA093134D342E4F6FB174B28B2C39E4DA"><enum>(A)</enum><text>notify an
				eligible entity of the opportunity to apply for a grant under this section;
				and</text>
									</subparagraph><subparagraph id="idDC6BDCA005634661BE5AB01F21198DC4"><enum>(B)</enum><text>provide access to
				application materials and adequate time for preparation and submission of
				applications.</text>
									</subparagraph></paragraph><paragraph id="ID302f4b31bb124a1a8c5048b16f0f8db5"><enum>(4)</enum><header>Separate
				applications required</header><text>An eligible entity shall separately apply
				for each special event for which the eligible entity seeks amounts under a
				grant under this section.</text>
								</paragraph><paragraph id="IDe97085b1b1784b57b1f2e7c5c74e991e"><enum>(5)</enum><header>Minimum content
				of application</header><text>The Secretary shall require that an application
				for a grant under this section, at a minimum, includes—</text>
									<subparagraph id="id0D7B3FE4E0644238ABE7DA2DCFD5530B"><enum>(A)</enum><text>the purpose for
				which the eligible entity seeks the grant;</text>
									</subparagraph><subparagraph id="idFC3D3D890D5C4172A8F161ED8EF2A61B"><enum>(B)</enum><text>a budget showing
				how the eligible entity intends to expend funds received under the grant;
				and</text>
									</subparagraph><subparagraph id="id5B16C2EA907A46499A42B1DB7EA50FA4"><enum>(C)</enum><text>a description of
				the special event for which the eligible entity seeks the grant.</text>
									</subparagraph></paragraph></subsection><subsection id="ID2076684d998a4436aab4bbcd17415ae5"><enum>(e)</enum><header>Use of
				funds</header>
								<paragraph id="idEEE2C76BACFD4558BB822D6D1EB4E92A"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">A grant under this
				section may be used by an eligible entity for salary and benefits for necessary
				overtime in preparation for, during, or directly following a special event
				by—</text>
									<subparagraph id="id8E22A89E3664474DA929C78F6568556D"><enum>(A)</enum><text display-inline="yes-display-inline">an employee of the eligible entity;
				or</text>
									</subparagraph><subparagraph id="idF0ABD069A4F94AFBBA3161750E2B6115"><enum>(B)</enum><text display-inline="yes-display-inline">a contractor of the eligible entity that
				performs law enforcement duties.</text>
									</subparagraph></paragraph><paragraph id="ID17d649aad6734d1784a9db484fd88abb"><enum>(2)</enum><header>Limitation</header><text>A
				grant under this section shall be used to supplement and not to supplant funds
				of State or local governments (including a tribal government).</text>
								</paragraph></subsection><subsection id="ID3e11a0c8d87e413a8fa712f3ad688784"><enum>(f)</enum><header>Authorization
				of appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated to the Secretary to carry out this section
				$25,000,000 for each of fiscal years 2010 through
				2015.</text>
							</subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id658DA7D4C14847DBB715A66F46D41FFD"><enum>(b)</enum><header>Technical and
			 conforming amendment</header><text>The table of contents in section 1(b) of the
			 Homeland Security Act of 2002 (6 U.S.C. 101 et seq.) is amended by adding after
			 the item relating to section 2022 the following:</text>
