		<official-title>To amend the Packers and Stockyards Act, 1921, to
		  prohibit the use of certain anti-competitive forward
		  contracts.</official-title>

		<section id="IDD83C751B3EEE4ACD8B1933EDA4E59014" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Livestock Marketing Fairness
			 Act</short-title></quote>.</text>
		</section><section id="ID50fd97060c7a4edab8be6412ab2eeed9"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of the amendments made by this
			 Act is to prohibit the use of certain anti-competitive forward
			 contracts—</text>
			<paragraph id="IDf55fd0a6f8a6486b80922e23cb4d8a42"><enum>(1)</enum><text>to require a firm
			 base price in forward contracts and marketing agreements; and</text>
			</paragraph><paragraph id="ID429fe13921b949e680d605c393a493a8"><enum>(2)</enum><text>to require that
			 forward contracts be traded in open, public markets.</text>
			</paragraph></section><section id="IDEEEB2410561847E88B21C79E461B5803"><enum>3.</enum><header>Limitation on
			 use of anti-competitive forward contracts</header>
			<subsection id="ID4DAE8CEF388C4FBB8D50C9DE6FC0AA88"><enum>(a)</enum><header>In
			 general</header><text>Section 202 of the Packers and Stockyards Act, 1921
			 (<external-xref legal-doc="usc" parsable-cite="usc/7/192">7 U.S.C.
			 192</external-xref>), is amended—</text>
				<paragraph id="idC61A13C3D3824A82B6F28AF3C99515F6"><enum>(1)</enum><text>by striking
			 <quote>Sec. 202. It shall be</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id45B43D1742934EA2A2FA6CDCF3FA346F" style="OLC">
						<section id="id62E8446B0E834DBF9DDFCB998706713F"><enum>202.</enum><header>Unlawful
				practices</header>
							<subsection id="idB6DB064611AB43AEA6C0B2DA5719E3AF"><enum>(a)</enum><header>In
				general</header><text>It shall
				be</text>
							</subsection></section><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID8BDCD7ADAB534FA297F9B7DB7500005F"><enum>(2)</enum><text>by striking
			 <quote>to:</quote> and inserting <quote>to—</quote>;</text>
				</paragraph><paragraph id="ID4AD0DCB201DC42E592594823F082DA96"><enum>(3)</enum><text>by redesignating
			 subsections (a), (b), (c), (d), (e), (f), and (g) as paragraphs (1), (2), (3),
			 (4), (5), (7), and (8), respectively, and indenting appropriately;</text>
				</paragraph><paragraph id="IDFC7FFE16EB60476C9B4282FD4CF2F890"><enum>(4)</enum><text>in paragraph (7)
			 (as redesignated by paragraph (3)), by designating paragraphs (1), (2), and (3)
			 as subparagraphs (A), (B), and (C), respectively, and indenting
			 appropriately;</text>
				</paragraph><paragraph id="ID599FDEF384B446B4A3912308733BF6C2"><enum>(5)</enum><text>in paragraph (8)
			 (as redesignated by paragraph (3)), by striking <quote>subdivision (a), (b),
			 (c), (d), or (e)</quote> and inserting <quote>paragraph (1), (2), (3), (4),
			 (5), or (6)</quote>;</text>
				</paragraph><paragraph id="IDE8B5D6F8D9A04B6FBCDFC4ABC83ED9F2"><enum>(6)</enum><text>in each of
			 paragraphs (1), (2), (3), (4), (5), (7), and (8) (as redesignated by paragraph
			 (3)), by striking the first capital letter of the first word in the paragraph
			 and inserting the same letter in the lower case;</text>
				</paragraph><paragraph id="ID028F1F0D5C13422B81E115A6317EB299"><enum>(7)</enum><text>in each of
			 paragraphs (1) through (5) (as redesignated by paragraph (3)), by striking
			 <quote>or</quote> at the end;</text>
				</paragraph><paragraph id="ID8B35BAF331804E5B95C5DA3BD9F7F9AC"><enum>(8)</enum><text>by inserting
			 after paragraph (5) (as redesignated by paragraph (3)) the following:</text>
					<quoted-block id="ID43DBBDBECF834F9D006187297F64E2A2">
						<paragraph id="ID129B894172BB447A9053924263C725BD"><enum>(6)</enum><text>except as
				provided in subsection (c), use, in effectuating any sale of livestock, a
				forward contract that—</text>
							<subparagraph id="IDF8819856EBD044A7B1DE0099E530C626"><enum>(A)</enum><text>does not contain
				a firm base price that may be equated to a fixed dollar amount on the day on
				which the forward contract is entered into;</text>
							</subparagraph><subparagraph id="IDE793054D3A5A481D00B79787C33CE9DD"><enum>(B)</enum><text>is not offered
				for bid in an open, public manner under which—</text>
								<clause id="ID549F32C97E90497B9C9E52D1808CDFD8"><enum>(i)</enum><text>buyers and
				sellers have the opportunity to participate in the bid; and</text>
								</clause><clause id="ID93A73A03D759418BA091D221355695B2"><enum>(ii)</enum><text>buyers and
				sellers may witness bids that are made and accepted;</text>
								</clause></subparagraph><subparagraph id="ID397DD14CF07D4EA19D69D1FCC7D508DD"><enum>(C)</enum><text>is based on a
				formula price; or</text>
							</subparagraph><subparagraph id="ID4565536C8F564577855E1740EDEC11AD"><enum>(D)</enum><text>subject to
				subsection (b), provides for the sale of livestock in a quantity in excess
				of—</text>
								<clause id="IDBC4A60F3765B4D04BB1384B0D200BFBB"><enum>(i)</enum><text>in the case of
				cattle, 40 cattle;</text>
								</clause><clause id="ID5D24CCE92C844D8100802F62CFB50507"><enum>(ii)</enum><text>in the case of
				swine, 30 swine; and</text>
								</clause><clause id="ID47285511A85A4D158403171C9379139F"><enum>(iii)</enum><text>in the case of
				other types of livestock, a comparable quantity of the type of livestock
				determined by the Secretary.</text>
								</clause></subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id087BD2B58BF045F28AEA7B25903612CE"><enum>(9)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id7B44D2EE7EE0474FB9E9879986064EDB" style="OLC">
						<subsection id="id6A8110059C324480B04948D7EBA399A6"><enum>(b)</enum><header>Adjustments</header><text>The
				Secretary may adjust the maximum quantity of livestock described in subsection
				(a)(6)(D) to reflect advances in marketing and transportation capabilities if
				the adjusted quantity provides reasonable market access for all buyers and
				sellers.</text>
						</subsection><subsection id="idFCBE2973599D49C087E58124BC01FBEF"><enum>(c)</enum><header>Exemption for
				cooperatives</header><text>Subsection (a)(6) shall not apply to—</text>
							<paragraph id="ID29c0259e8f2a4cab97522bf91a26c483"><enum>(1)</enum><text>a cooperative or
				entity owned by a cooperative, if a majority of the ownership interest in the
				cooperative is held by active cooperative members that—</text>
								<subparagraph id="ID62bb3b736c514f4b821a90b800f3f1bd"><enum>(A)</enum><text>own, feed, or
				control livestock; and</text>
								</subparagraph><subparagraph id="ID856025751d914d559585b567440cd584"><enum>(B)</enum><text>provide the
				livestock to the cooperative for slaughter;</text>
								</subparagraph></paragraph><paragraph id="IDd5bcc6d8e1544f48941e0bdabf57e78d"><enum>(2)</enum><text>a packer that is
				not required to report to the Secretary on each reporting day (as defined in
				section 212 of the Agricultural Marketing Act of 1946 (7 U.S.C. 1635a))
				information on the price and quantity of livestock purchased by the packer;
				or</text>
							</paragraph><paragraph id="ID7d6e9803c840432d98cf90328b0cb54d"><enum>(3)</enum><text>a packer that
				owns 1 livestock processing
				plant.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID5979383AAF1946508C94129EDE09BD6E"><enum>(b)</enum><header>Definitions</header><text>Section
			 2(a) of the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/182(a)">7 U.S.C. 182(a)</external-xref>) is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="ID22A9B5E219BF418AA2AF2B001F52B97E" style="OLC">
					<paragraph id="IDe67a054dde0f4ad69bd9927e4412b706"><enum>(15)</enum><header>Firm base
				price</header><text>The term <term>firm base price</term> means a transaction
				using a reference price from an external source.</text>
					</paragraph><paragraph id="ID58533EEC9C624CE681ABC1E4CD54A5C6"><enum>(16)</enum><header>Formula
				price</header>
						<subparagraph id="ID87CE4FA1E82C46809C1F72B1F3EAF23F"><enum>(A)</enum><header>In
				general</header><text>The term <term>formula price</term> means any price term
				that establishes a base from which a purchase price is calculated on the basis
				of a price that will not be determined or reported until a date after the day
				the forward price is established.</text>
						</subparagraph><subparagraph id="ID093B85E35B7741608507D66CA9895D13"><enum>(B)</enum><header>Exclusion</header><text>The
				term <term>formula price</term> does not include—</text>
							<clause id="ID8956EEDCB0F7413E9D23D0CAEE5BC689"><enum>(i)</enum><text>any price term
				that establishes a base from which a purchase price is calculated on the basis
				of a futures market price; or</text>
							</clause><clause id="IDC4F213A39A174A9AA6DDD59E579CCD91"><enum>(ii)</enum><text>any adjustment
				to the base for quality, grade, or other factors relating to the value of
				livestock or livestock products that are readily verifiable market factors and
				are outside the control of the packer.</text>
							</clause></subparagraph></paragraph><paragraph id="ID1FE3CD2DD9844538859D856E8DB04E15"><enum>(17)</enum><header>Forward
				contract</header><text>The term <term>forward contract</term> means an oral or
				written contract for the purchase of livestock that provides for the delivery
				of the livestock to a packer at a date that is more than 7 days after the date
				on which the contract is entered into, without regard to whether the contract
				is for—</text>
						<subparagraph id="ID913AA7C8881A42B3A341E01ED1B48493"><enum>(A)</enum><text>a specified lot
				of livestock; or</text>
						</subparagraph><subparagraph id="ID7F8998C3CFFE414DA72EAEA2ADAD1574"><enum>(B)</enum><text>a specified
				number of livestock over a certain period of
				time.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
