		  Act to extend reasonable cost contracts under the Medicare

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Medicare Cost Contract Extension and
			 Refinement Act of 2009</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id798BEBCB177847DD94B48AE493325FA9" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Extension of reasonable cost
			 contracts</header>
			<subsection commented="no" display-inline="no-display-inline" id="id1C4171E60DB54D4788DA96731ACD1B14"><enum>(a)</enum><header display-inline="yes-display-inline">Extension of period reasonable cost plans
			 can remain in the market</header><text display-inline="yes-display-inline">Section 1876(h)(5)(C) of the Social
			 Security Act (42 U.S.C. 1395mm(h)(5)(C)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id953B8C42DE534738843273CDB16E9A89"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (ii), by striking <quote>January
			 1, 2010</quote> and inserting <quote>January 1, 2013</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCE30BECA6EC8403EBF4947ADE55C60B6"><enum>(2)</enum><text display-inline="yes-display-inline">in clause (iii), in the matter preceding
			 subclause (I), by striking <quote>if the service area for the year
			 meets</quote> and inserting <quote>if the portion of the plan's service area
			 for the year that is within the service area of a reasonable cost reimbursement
			 contract meets</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id022D9635E4574C93A83768C9551448D3"><enum>(b)</enum><header display-inline="yes-display-inline">Extension of period reasonable cost plans
			 can expand their service area</header><text display-inline="yes-display-inline">Section 1876(h)(5)(B)(i) of the Social
			 Security Act (42 U.S.C. 1395mm(h)(5)(B)(i)) is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="idAF0F0FC65F9441DCB479648B221FBF5B" style="OLC">
					<clause commented="no" display-inline="no-display-inline" id="id1E425458EEAA4FBC8CF5D6080E8A5557" indent="up2"><enum>(i)</enum><text display-inline="yes-display-inline">the conditions for prohibiting an extension
				or renewal of a contract under subparagraph (C)(ii) are not applicable to such
				service area at the time of the application;
				and</text>
					</clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDBBF45C6243DD40BB948544678915CB31" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Application of certain Medicare Advantage
			 requirements to cost contracts extended or renewed after date of
			 enactment</header><text display-inline="no-display-inline">Section 1876(h) of
			 the <act-name parsable-cite="SSA">Social Security Act</act-name>
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1395mm(h)">42 U.S.C.
			 1395mm(h)</external-xref>), as amended by section (2), is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="ID6831A3ABBAA741E087BA4D00F28B403B"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraph (5) as paragraph
			 (6); and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBC2905CEB37A4BA2ADF9AA006567726C"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (4) the
			 following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="ID7959C823DA9141AD8C1E5CCFAA5FDB9B" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="ID2C79C9A510F24BC987C9DFF0F0907E87" indent="up1"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="ID258012FFDC584A4391E49602D29358A9"><enum>(A)</enum><text display-inline="yes-display-inline">Any reasonable cost reimbursement contract
				with an eligible organization under this subsection that is extended or renewed
				on or after the date of the enactment of the <short-title>Medicare Cost Contract Extension and Refinement Act of
				2009</short-title> shall provide that the provisions of the Medicare Advantage
				program under part C described in subparagraph (B) shall apply to such
				organization and such contract in a substantially similar manner as such
				provisions apply to Medicare Advantage organizations and Medicare Advantage
				plans under such part.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC4FFA6C5796E4926BD31F18B3177E68C" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The provisions described in this
				subparagraph are as follows:</text>
							<clause commented="no" display-inline="no-display-inline" id="IDA2B366E25E8A4525912CEDCF6D477CD4"><enum>(i)</enum><text display-inline="yes-display-inline">Section 1851(d) (relating to the provision
				of information to promote informed choice).</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID63608F12CA0B44E2A09BD7FA9C20002F"><enum>(ii)</enum><text display-inline="yes-display-inline">Section 1851(h) (relating to the approval
				of marketing material and application forms).</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDDF7EDC487D5E45E68266A4A47B839200"><enum>(iii)</enum><text display-inline="yes-display-inline">Section 1852(a)(3)(A) (regarding the
				authority of organizations to include mandatory supplemental health care
				benefits under the plan subject to the approval of the Secretary).</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID105D8FA581CE4A0EB5D55942C880FE5E"><enum>(iv)</enum><text display-inline="yes-display-inline">Section 1852(e) (relating to the
				requirement of having an ongoing quality improvement program and treatment of
				accreditation in the same manner as such provisions apply to Medicare Advantage
				local plans that are preferred provider organization plans).</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDCBFB24B8829640AFB557DA75C78EB3B8"><enum>(v)</enum><text display-inline="yes-display-inline">Section 1852(j)(4) (relating to limitations
				on physician incentive plans).</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID9722A37090A040DE951E8597CABBA6BA"><enum>(vi)</enum><text display-inline="yes-display-inline">Section 1854(g) (relating to restrictions
				on imposition of premium taxes with respect to payments to
				organizations).</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID8F7CEDF24FDF41C3ADE500DA00975000"><enum>(vii)</enum><text display-inline="yes-display-inline">Section 1856(b)(3) (relating to relation to
				State laws).</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID8E627245E3C7400C9399614D8835DEDC"><enum>(viii)</enum><text display-inline="yes-display-inline">Section 1857(i) (relating to Medicare
				Advantage program compatibility with employer or union group health
				plans).</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDF878EA3017FB44DEA1BC5E1160F26406"><enum>(ix)</enum><text display-inline="yes-display-inline">The provisions of part C relating to
				timelines for contract renewal and beneficiary
				notification.</text>
