		<legis-type>A BILL</legis-type>
		<official-title>To protect the national security of the United States by
		  limiting the immigration rights of individuals detained by the Department of
		  Defense at Guantanamo Bay Naval Base.</official-title>

		<section id="idA50DA8B9623E426491BB3CEA653F7FC1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Protecting America's Communities
			 Act</short-title></quote>.</text>
		</section><section id="idBD5703B158314D738F6CC6BE22CBF9D2"><enum>2.</enum><header>Ineligibility
			 for admission or parole</header><text display-inline="no-display-inline">Section 212 of the Immigration and
			 Nationality Act (8 U.S.C. 1182) is amended—</text>
			<paragraph id="id4B4D1E87302F4E8183388D14E3E61152"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(3), by adding at the end
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="idFAB397E7101F40F0AD7A932B7EB46B12" style="OLC">
					<subparagraph id="id857350A2A866455983116F1F886E1955"><enum>(G)</enum><header>Guantanamo bay
				detainees</header><text>An alien who, as of January 1, 2009, was being detained
				by the Department of Defense at Guantanamo Bay Naval Base, is
				inadmissible.</text>
					</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="idA5A3076DA00343A9B1BADB705730A672"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d)—</text>
				<subparagraph id="id8C842AF763BA4BBE9EC3DEC6D645E84E"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting <quote>or
			 (5)(B)</quote>; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7E57CF56245D4A9FB2D2B429DD6AC605"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (5)(B), by adding at the end
			 the following: <quote>The Attorney General may not parole any alien who, as of
			 January 1, 2009, was being detained by the Department of Defense at Guantanamo
			 Bay Naval Base.</quote>.</text>
				</subparagraph></paragraph></section><section id="id369A5BC5405D49F6ACB0BF3F82D7F209" section-type="subsequent-section"><enum>3.</enum><header>Detention
			 authority</header><text display-inline="no-display-inline">Section 241(a) of
			 the Immigration and Nationality Act (8 U.S.C. 1231(a)) is amended—</text>
			<paragraph id="idD6834D40ECA648AE9366B91DA7F50FF7"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>Attorney General</quote>
			 each place it appears, except for the first reference in paragraph (4)(B)(i),
			 and inserting <quote>Secretary of Homeland Security</quote>; and</text>
			</paragraph><paragraph id="id34564D1EB5814BFBB762DC24FC289481"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idE95A85D3C12D4A3B978393B8F649E2D1" style="OLC">
					<paragraph id="id9FD78798231B43769715B3DFDC746A25"><enum>(8)</enum><header>Guantanamo bay
				detainees</header>
						<subparagraph id="id8AC0633A9A5B41F7B6A4934D66DAEF02"><enum>(A)</enum><header>Certification
				requirement</header><text>An alien ordered removed who, as of January 1, 2009,
				was being detained by the Department of Defense at Guantanamo Bay Naval Base,
				shall be detained for an additional 6 months beyond the removal period
				(including any extension under paragraph (1)(C)) if the Secretary of Homeland
				Security certifies that—</text>
							<clause id="id853D2ADD5FB64466BF282080C8D21DBA"><enum>(i)</enum><text>the alien cannot
				be removed due to the refusal of all countries designated by the alien or under
				this section to receive the alien; and</text>
							</clause><clause id="idC7D71AD997264CE88E624DB40D6A1805"><enum>(ii)</enum><text>the Secretary is
				making reasonable efforts to find alternative means for removing the
				alien.</text>
							</clause></subparagraph><subparagraph id="IDa48c9a8ce8fb4cabb3f0fcfead88a3e4"><enum>(B)</enum><header>Renewal and
				delegation of certification</header>
							<clause id="IDbad047219d914c988ad05a4928673b81"><enum>(i)</enum><header>Renewal</header><text>The
				Secretary may renew a certification under subparagraph (A) without limitation
				after providing the alien with an opportunity to—</text>
								<subclause id="id0F107E28A75340F394DF4DEC67446A71"><enum>(I)</enum><text>request
				reconsideration of the certification; and</text>
								</subclause><subclause id="idE2775DE0CE9747E89B7734472D2B606C"><enum>(II)</enum><text>submit documents
				or other evidence in support of the reconsideration request.</text>
								</subclause></clause><clause id="IDc6c594ec0b994e95bd9efe36cd59066b"><enum>(ii)</enum><header>Delegation</header><text>Notwithstanding
				section 103, the Secretary may not delegate the authority to make or renew a
				certification under this paragraph to an official below the level of the
				Assistant Secretary for Immigration and Customs Enforcement.</text>
							</clause></subparagraph><subparagraph id="idFD6AD197B5924510BFC6CB6D35D32CD4"><enum>(C)</enum><header>Ineligibility
				for bond or parole</header><text>No immigration judge or official of United
				States Immigration and Customs Enforcement may release from detention on bond
				or parole any alien described in subparagraph
				(A).</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id5EF020C12D11476EB96BB7ADC1537FBE"><enum>4.</enum><header>Asylum
			 ineligibility</header><text display-inline="no-display-inline">Section
			 208(a)(2) of the Immigration and Nationality Act (8 U.S.C. 1158(a)(2)) is
			 amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id50C896C0EE6A4BCCBDA6FA288266FBAF" style="OLC">
				<subparagraph id="idFBE5033F841B481D91D14A98BCDEC6D8"><enum>(E)</enum><header>Guantanamo bay
				detainees</header><text>Paragraph (1) shall not apply to any alien who, as of
				January 1, 2009, was being detained by the Department of Defense at Guantanamo
				Bay Naval
				Base.</text>
				</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idF9A96FCB233F4DE5822E95A32A34E8CD"><enum>5.</enum><header>Mandatory
			 detention of aliens from Guantanamo Bay Naval Base</header><text display-inline="no-display-inline">Section
			 236(c)(1) of the Immigration and Nationality Act (8 U.S.C. 1226(c)(1)) is
			 amended—</text>
			<paragraph id="id653F9D8311884598B7BC14E417679135"><enum>(1)</enum><text display-inline="yes-display-inline">in each of subparagraphs (A) and (B), by
			 striking the comma at the end and inserting a semicolon;</text>
			</paragraph><paragraph id="id1C75946B26F846B1AFD437AE4E84B655"><enum>(2)</enum><text>in subparagraph
			 (C), by striking <quote>, or</quote> and inserting a semicolon;</text>
			</paragraph><paragraph id="idFAB8DE6EE4584CE8AA54041330DDBABC"><enum>(3)</enum><text>in subparagraph
			 (D), by striking the comma at the end and inserting <quote>; or</quote>;
			 and</text>
			</paragraph><paragraph id="id8ADDD7FD6430441194E5ECA57213E7ED"><enum>(4)</enum><text>by inserting
			 after subparagraph (D) the following:</text>
				<quoted-block display-inline="no-display-inline" id="id421858C6E4C94AB3A148F3B465FAE1D6" style="OLC">
					<subparagraph id="idDF7C22833F6B460D8457308D1DBF3484"><enum>(A)</enum><text>as of January 1,
				2009, was being detained by the Department of Defense at Guantanamo Bay Naval
				Base.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="ID85b104fa212a4a17ad6f89b58ae079c8"><enum>6.</enum><header>Statement of
			 authority</header>
			<subsection id="IDf8024c0b8fb14807be4c63e7c8147884"><enum>(a)</enum><header>In
			 general</header><text>Congress reaffirms that—</text>
				<paragraph id="idAE4C09FB7D884E25A14AABF5CA9E1C12"><enum>(1)</enum><text>the United States
			 is in an armed conflict with al Qaeda, the Taliban, and associated forces;
			 and</text>
				</paragraph><paragraph id="id303A2519CB4C453FBCD5EF078E75108B"><enum>(2)</enum><text>the entities
			 referred to in paragraph (1) continue to pose a threat to the United States and
			 its citizens, both domestically and abroad.</text>
				</paragraph></subsection><subsection id="IDc6713c23952a4802843908788117d814"><enum>(b)</enum><header>Authority</header><text>Congress
			 reaffirms that the President is authorized to detain enemy combatants in
			 connection with the continuing armed conflict with al Qaeda, the Taliban, and
			 associated forces until the termination of such conflict, regardless of the
			 place at which they are captured.</text>
			</subsection><subsection id="IDac5fabdabafc4d6cab93d244be58bff5"><enum>(c)</enum><header>Rule of
			 construction</header><text>The authority described in this section may not be
			 construed to alter or limit the authority of the President under the
			 Constitution of the United States to detain enemy combatants in the continuing
			 armed conflict with al Qaeda, the Taliban, and associated forces, or in any
			 other armed conflict.</text>
