		<section commented="no" display-inline="no-display-inline" id="H203AE1F921A041C00042D73611F9CFE2" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Ratepayer Recovery Act of
			 2009</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="HF097974A57264ABFBC78FA9C01055B0" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Disaster assistance for power transmission
			 and distribution facilities</header>
			<subsection commented="no" display-inline="no-display-inline" id="H1CB91B64A9CF4AE39DED27BC69D74B35"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">Section 102 of the Robert T. Stafford
			 Disaster Relief and Emergency Assistance Act (42 U.S.C. 5122) is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H00B98E7C570F4587A184E18902D47852" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="HFAD79951C3A249BE9860B1631168771D"><enum>(11)</enum><header display-inline="yes-display-inline">Private or investor-owned power
				facility</header><text display-inline="yes-display-inline">The term
				<quote>private or investor-owned power facility</quote>—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H2C14F0C7ABD6475BBDE61822A9B47B89"><enum>(A)</enum><text display-inline="yes-display-inline">means a privately-owned or investor-owned
				transmission or distribution facility that provides electric or natural gas
				service to retail customers under State or local jurisdiction; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2D84780C1C054AA19EE6B52C9DE9E3B6"><enum>(B)</enum><text display-inline="yes-display-inline">includes leased
				facilities.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HE8F61C74C76C49A0A0CFA559D9112989"><enum>(b)</enum><header display-inline="yes-display-inline">Conditions for contributions</header><text display-inline="yes-display-inline">Section 406(a) of the Robert T. Stafford
			 Disaster Relief and Emergency Assistance Act (42 U.S.C. 5172(a)) is
			 amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HA67BA793116B451100301F8917E61B6F"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H9BB6275B15CE45CABED3389BD5CB5D89"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking
			 <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9E5AFE7647404C788BE58DF000428420"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking the period
			 and inserting <quote>; and</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H726193E6A08B43AAB643086F7D65806F"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H897EE04FE43D4B48B848EEB55DA44C13" style="OLC">
							<subparagraph commented="no" display-inline="no-display-inline" id="H8ED1B5F4381549B2A981EE5F40ED255B"><enum>(C)</enum><text display-inline="yes-display-inline">subject to paragraph (4), to a person that
				owns a private or investor-owned power facility damaged or destroyed by a major
				disaster for the repair, restoration, reconstruction, or replacement of the
				facility and for associated expenses incurred by the
				person.</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4517CAB7A21442B0AECF07C92E60A72D"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraph (4) as paragraph
			 (5); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H14454B387A854C8083C13EC1EEB5009C"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (3) the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="HE59A54931B7845E182665D34BCAFC868" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="H0B0720FFA896486DB78452F0E2096BA3"><enum>(4)</enum><header display-inline="yes-display-inline">Conditions for assistance to private or
				investor-owned power facilities</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="HAF0E248E567E48169EF3EB10CD7165F4"><enum>(A)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this paragraph, the term <quote>previous
				major disaster</quote> means a major disaster—</text>
								<clause commented="no" display-inline="no-display-inline" id="H452109AF948E4FC886C82EBF6E3035C0"><enum>(i)</enum><text display-inline="yes-display-inline">occurring before the date of the major
				disaster for which Federal assistance is sought under this subsection;
				and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="HDB280919DDFB4C038FC940C00623245E"><enum>(ii)</enum><text display-inline="yes-display-inline">that was declared by the President not more
				than 10 years before the date on which the President declared the major
				disaster for which Federal assistance is sought under this subsection.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5C7DA71F1C8D4364950081FEAF796E16"><enum>(B)</enum><header display-inline="yes-display-inline">Conditioned on previous event</header><text display-inline="yes-display-inline">The President may make contributions to the
				owner of a private or investor-owned power facility under paragraph (1)(C) for
				the repair, restoration, reconstruction, or replacement of any facility damaged
				or destroyed as a result of a major disaster, only if—</text>
								<clause commented="no" display-inline="no-display-inline" id="idB13D729845954A8D9C15F34673BBDE33"><enum>(i)</enum><text display-inline="yes-display-inline">the facility damaged or destroyed as a
				result of the major disaster was damaged or destroyed by a previous major
				disaster;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="H4C560EE6593E46E0A9D52483EA23ACA"><enum>(ii)</enum><text display-inline="yes-display-inline">the cost of repairing, restoring,
				reconstructing, or replacing the private or investor-owned power facility
				damaged or destroyed by the previous major disaster exceeded $2,500 for each
				retail customer receiving electrical or natural gas service from the owner on
				the day before the date of the previous major disaster;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="H61B8715057974A8998523D9092B2A2F"><enum>(iii)</enum><text display-inline="yes-display-inline">the total costs of repair, restoration,
				reconstruction, or replacement of all private or investor-owned power
				facilities owned by such person and associated expenses incurred by the person
				as a result of the previous major disaster exceeded $500,000,000; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="HC9E707C05F524B68817D38DF4E7400EF"><enum>(iv)</enum><text display-inline="yes-display-inline">20 percent or more of the population, based
				on the most recent census data, of each geographic area in which the private or
				investor-owned power facility is located, had income that did not exceed the
				poverty line (as defined in section 2110(c)(5) of the Social Security Act (42
				U.S.C. 1397jj(c)(5))) during the year before the previous major
				disaster.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2B1A4F4FEE484A0EAF1C4F9DBB9B1326"><enum>(C)</enum><header display-inline="yes-display-inline">Application for funds</header><text display-inline="yes-display-inline">A person that owns a private or
				investor-owned power facility that meets the requirements under subparagraph
				(B) may apply for Federal assistance on or before the earlier of—</text>
								<clause commented="no" display-inline="no-display-inline" id="HA9E9059C95BC470C9141A2B1FB2186A4"><enum>(i)</enum><text display-inline="yes-display-inline">30 days after the date on which the
				President declares the major disaster for which the person requests Federal
				assistance; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="H475721C8E5344698B8A1C074935FD133"><enum>(ii)</enum><text display-inline="yes-display-inline">the date upon which person has incurred
				costs of more than the greater of $10,000,000 and <fraction>2/3</fraction> of
				the average annual net income of the person for the previous 3 fiscal years
				relating to the repair, restoration, reconstruction, or replacement of all
				private or investor-owned power facilities owned by the person that were
				damaged or destroyed as a result of the major disaster for which the person
				requests Federal assistance.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H374E350D651C4FE5A6BD03C433FA0961"><enum>(D)</enum><header display-inline="yes-display-inline">Amount of Federal assistance for disaster
				relief</header><text display-inline="yes-display-inline">The owner of a private
				or investor-owned power facility may receive assistance under paragraph (1)(C)
				for the costs of repair, restoration, reconstruction, or replacement of the
				facility and associated expenses incurred by the person that exceed the greater
				of $10,000,000 and the amount equal to <fraction>2/3</fraction> of the average
				annual net income of the person for the previous 3 fiscal years.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H432D411FCB824685BACA6667559C417D"><enum>(E)</enum><header display-inline="yes-display-inline">Aggregation for purposes of determining
				costs</header><text display-inline="yes-display-inline">For purposes of
				determining the costs of a previous major disaster under this paragraph, the
				owner of the private or investor-owned power facility may aggregate the costs
				of all previous major disasters declared during any 12-month period.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0A03BDD62A204F8A88DE68218C8B7DF7"><enum>(F)</enum><header display-inline="yes-display-inline">Approval or disapproval of
				applications</header><text display-inline="yes-display-inline">The President
				shall approve or disapprove an application for assistance submitted by a person
				under paragraph (1)(C) for a private or investor-owned power facility not later
				than 30 days after the date of receipt of the
				application.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC5598192919E44D9A62D9B54806252EF"><enum>(c)</enum><header display-inline="yes-display-inline">Federal share</header><text display-inline="yes-display-inline">Section 406(b)(2) of the Robert T. Stafford
			 Disaster Relief and Emergency Assistance Act (42 U.S.C. 5172(b)(2)) is amended
			 by striking <quote>public facility or private nonprofit facility</quote> and
			 inserting <quote>public facility, private nonprofit facility, or private or
			 investor-owned power facility</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HED0FF2A121784F45B2045C6CABD5B9B4"><enum>(d)</enum><header display-inline="yes-display-inline">Large in-lieu contributions</header><text display-inline="yes-display-inline">Section 406(c) of the Robert T. Stafford
			 Disaster Relief and Emergency Assistance Act (42 U.S.C. 5172(c)) is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HDA5240E9441C45E6B89480CE62C6F134" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="HC5C72745502B4ADDBB751EE1E0ACF91"><enum>(3)</enum><header display-inline="yes-display-inline">For private or investor-owned power
				facilities</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="H52E5DF9CF8E140FBA4385C00977389FA"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If a person that owns a private or
				investor-owned power facility determines that the public welfare would not best
				be served by repairing, restoring, reconstructing, or replacing the facility,
				the person may elect to receive, in lieu of a contribution under subsection
				(a)(1)(C), a contribution in an amount equal to 75 percent of the Federal share
				of the Federal estimate of the cost of repairing, restoring, reconstructing, or
				replacing the facility and of associated expenses, under the conditions
				described in subsection (a)(4).</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H246689746C8F4FDA97C322B3D8C9E910"><enum>(B)</enum><header display-inline="yes-display-inline">Use of funds</header><text display-inline="yes-display-inline">Funds contributed to a person under this
				paragraph may be used only within the area affected as a result of the major
				disaster for which the person requests Federal assistance to—</text>
							<clause commented="no" display-inline="no-display-inline" id="H3266ED2E77034F070093840000DB319B"><enum>(i)</enum><text display-inline="yes-display-inline">repair, restore, or expand other private or
				investor-owned power facilities owned by the person;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H14DDCD3E720E44C3805F8CFDE9896869"><enum>(ii)</enum><text display-inline="yes-display-inline">construct a new private or investor-owned
				power facility owned by the person; or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HC3DF62BEFF1C49B687EEBF973EE665F1"><enum>(iii)</enum><text display-inline="yes-display-inline">fund hazard mitigation measures that the
				person determines to be necessary to meet a need for the services and functions
				of the person in the area affected by the major
				disaster.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HC7AFAC8B46C54CB28BD8E2FE1160AD0"><enum>(e)</enum><header display-inline="yes-display-inline">Eligible cost</header><text display-inline="yes-display-inline">Section 406(e)(1)(A) of the Robert T.
			 Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5172(e)(1)(A))
			 is amended by striking <quote>public facility or private nonprofit
			 facility</quote> and inserting <quote>public facility, private nonprofit
			 facility, or private or investor-owned power facility</quote>.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HDBE9A211806D428500889700969018A" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="no-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the Administrator of the Federal Emergency Management
			 Agency shall promulgate regulations necessary to implement this Act and the
			 amendments made by this Act.</text>
