<section id="H11E53E7680D243DBBD40006933997857" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Child Care Facilities Financing Act of 2009</short-title></quote>.</text> </section>
<section id="HEB12D1184D954704A3F84B1F2F7157F8"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HA111D32E0912409586B261B1F947BC64"><enum>(1)</enum><header>Child care facility</header><text>The term <term>child care facility</term> means a structure used for the care and development of eligible children.</text> </paragraph>
<paragraph id="HBB92E2D44DA5416CBE35CB4C3A5F8D1A"><enum>(2)</enum><header>Child care services</header><text display-inline="yes-display-inline">The term <term>child care services</term> means child care and early childhood education.</text> </paragraph>
<paragraph id="HD066FA1C0D3D417F9E2F4F8F8D8612AA"><enum>(3)</enum><header>Community development financial institution</header><text display-inline="yes-display-inline">The term <term>community development financial institution</term> has the meaning given such term in section 103(5) of the Community Development Banking and Financial Institutions Act of 1994 (12 U.S.C. 4702(5)).</text> </paragraph>
<paragraph id="HBECDD787E0C44048A2E808D7908358B0"><enum>(4)</enum><header>Eligible child</header><text>The term <term>eligible child</term> has the meaning given such term in section 658P of the Child Care and Development Block Grant Act of 1990 (42 U.S.C. 9858n).</text> </paragraph>
<paragraph id="HA3A1BA328EE44BA88C86996948890911"><enum>(5)</enum><header>Eligible child care provider</header><text display-inline="yes-display-inline">The term <term>eligible child care provider</term> means—</text> 
<subparagraph id="idC39E73AEE16047C68A50A4EAAA660A0D"><enum>(A)</enum><text display-inline="yes-display-inline">an eligible child care provider as defined in section 658P of the Child Care and Development Block Grant Act of 1990 (42 U.S.C. 9858n); or</text> </subparagraph>
<subparagraph id="idFA517774F3684E0CAD87FECD4F08A2A7"><enum>(B)</enum><text display-inline="yes-display-inline">a Head Start center under the Head Start Act (42 U.S.C. 9831 et seq.).</text> </subparagraph></paragraph>
<paragraph id="HE64083315CF14D3BA3EDCC2225495028"><enum>(6)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term “eligible entity” means—</text> 
<subparagraph id="HA4881807BFF04BF2B7543E80B9A11C72"><enum>(A)</enum><text>a community development financial institution certified by the Department of the Treasury; or</text> </subparagraph>
<subparagraph id="H1808321E7FA54CE5A17200002280DF70"><enum>(B)</enum><text>an organization that—</text> 
<clause id="H4D8A5F087F6D490FA10035D317282E43"><enum>(i)</enum><text>is described in section 501(c)(3) of the Internal Revenue Code of 1986;</text> </clause>
<clause id="HCAE98D93AD41457CBF948F6C00812CBD"><enum>(ii)</enum><text>is exempt from taxation under section 501(a) of such Code; and</text> </clause>
<clause id="H7B3681F4C7C143958F86A555981EACC"><enum>(iii)</enum><text>has demonstrated experience in—</text> 
<subclause id="H599568693ED14E4FB44BE0C3688E505E"><enum>(I)</enum><text display-inline="yes-display-inline">providing technical or financial assistance for the acquisition, construction, renovation, or improvement of child care facilities;</text> </subclause>
<subclause id="H9415D737393C482BBD376451D2CAC4CA"><enum>(II)</enum><text>providing technical, financial, or managerial assistance to eligible child care providers; and</text> </subclause>
<subclause id="H280D833311B34490007E364CFFB6AF26"><enum>(III)</enum><text>securing private sources of capital financing for child care or other low-income community development.</text> </subclause></clause></subparagraph></paragraph>
<paragraph id="H44F6245460CD4DC7BBE2341EF20738F"><enum>(7)</enum><header>Eligible recipient</header><text display-inline="yes-display-inline">The term “eligible recipient” means—</text> 
<subparagraph id="H97D639CDCAD84BFAACEE7FCA54EFE19"><enum>(A)</enum><text>an eligible child care provider that provides child care services to an eligible child;</text> </subparagraph>
<subparagraph id="H30902045DA8B4BE09378391021E0C511"><enum>(B)</enum><text>an organization seeking to provide child care services to an eligible child; or</text> </subparagraph>
<subparagraph id="H04B5A41C57484581A1C5F621C4E3F13D"><enum>(C)</enum><text>an organization providing or seeking to provide child care services to low-income children as determined by the Secretary.</text> </subparagraph></paragraph>
<paragraph id="HFEE9F512BC9C4340B009864C4EE1C538"><enum>(8)</enum><header>Equipment</header><text>The term <term>equipment</term> includes—</text> 
<subparagraph id="HEEDBA933818E45A38FA67F9F1F3C684C"><enum>(A)</enum><text>machinery, utilities, and built-in equipment, and any necessary structure to house the machinery, utilities, and equipment; and</text> </subparagraph>
<subparagraph id="HCF44CB29F7CA4630919EE5FB06F179EF"><enum>(B)</enum><text display-inline="yes-display-inline">any other items necessary for the functioning of a child care facility, including furniture, books, and program materials.</text> </subparagraph></paragraph>
<paragraph id="H2B54A055975F490700BC472513815871"><enum>(9)</enum><header>Metropolitan area</header><text display-inline="yes-display-inline">The term <term>metropolitan area</term> has the meaning given such term in section 102 of the Housing and Community Development Act of 1974 (42 U.S.C. 5302).</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HB79F68AF61AB44399D49DAD17252EB0"><enum>(10)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term “Secretary” means the Secretary of Health and Human Services.</text> </paragraph></section>
<section id="HAD7530B7D298468A858D92843DFBFD9"><enum>3.</enum><header>Technical and financial assistance grants</header> 
<subsection id="HDEC4143AFE454D1891FD54C50363BAEF"><enum>(a)</enum><header>Grant authority</header><text display-inline="yes-display-inline">The Secretary may make grants, on a competitive basis, to eligible entities to enable the eligible entities to carry out the authorized activities described in subsection (d) in accordance with this section.</text> </subsection>
<subsection id="id30649F0BF70C4E44A62D8DA638D61492"><enum>(b)</enum><header>Requirement</header><text display-inline="yes-display-inline">In making grants under subsection (a), the Secretary shall take into account the experience and success of eligible entities in attracting private financing and carrying out the types of activities for which grants under subsection (a) are made.</text> </subsection>
<subsection id="H956A4AC42D164625A2A96D3188858B70"><enum>(c)</enum><header>Priority</header><text display-inline="yes-display-inline">In making grants under subsection (a), the Secretary shall give priority to an eligible entity—</text> 
<paragraph id="HF7E9EB0538CA4E88B2698DDC9E0290B5"><enum>(1)</enum><text>that has demonstrated experience—</text> 
<subparagraph id="HD31751C9B0B748B18767D2EC7BE8B8D4"><enum>(A)</enum><text display-inline="yes-display-inline">providing technical or financial assistance for the acquisition, construction, renovation, or improvement of child care facilities;</text> </subparagraph>
<subparagraph id="H94A3A9DA29E64700872B0EFA66676AD5"><enum>(B)</enum><text>providing technical, financial, or managerial assistance to eligible child care providers; and</text> </subparagraph>
<subparagraph id="H1E14EFDE78EA466F8EC3C1FB264BD02F"><enum>(C)</enum><text>securing private sources of capital financing for child care or other low-income community development; and</text> </subparagraph></paragraph>
<paragraph id="HEF225689BBE74248A6CA2EA124DD4D05"><enum>(2)</enum><text>whose application proposes to assist eligible recipients that serve—</text> 
<subparagraph id="H0CE4C17774454FB7AFB5D529AEBC1C"><enum>(A)</enum><text display-inline="yes-display-inline">low-income areas, including—</text> 
<clause id="HAFBDE8E3C9384872A4498D29A2320011"><enum>(i)</enum><text display-inline="yes-display-inline">a community that—</text> 
<subclause id="HEB04C5F232484BC4A7B919008DA54241"><enum>(I)</enum><text display-inline="yes-display-inline">is in a metropolitan area; and</text> </subclause>
<subclause id="H0BB7120E43E24CD489705955E3A190CE"><enum>(II)</enum><text display-inline="yes-display-inline">has a median household income that is not more than 80 percent of the median household income of the metropolitan area; or</text> </subclause></clause>
<clause id="H9594C822EC67465DB59B536D98626C60"><enum>(ii)</enum><text>a community that—</text> 
<subclause id="H1754A780AF1344CC94E975A14E30C487"><enum>(I)</enum><text display-inline="yes-display-inline">is not in a metropolitan area; and</text> </subclause>
<subclause id="H75C89AE996BD42C6815953D44C39D5B2"><enum>(II)</enum><text display-inline="yes-display-inline">has a median income that is not more than 80 percent of the median household income of the State in which the community is located; or</text> </subclause></clause></subparagraph>
<subparagraph id="H77121D6FB8CB4FDBA670B6AD8DA4F362"><enum>(B)</enum><text display-inline="yes-display-inline">individuals, including eligible children, from families with incomes at or below 200 percent of the poverty line (as defined by the Office of Management and Budget and revised annually in accordance with section 673(2) of the Community Services Block Grant Act (42 U.S.C. 9902(2))) applicable to a family of the size involved.</text> </subparagraph></paragraph></subsection>
<subsection id="H95B23D7112B346ED8DC62B23AA90E54D"><enum>(d)</enum><header>Authorized activities</header> 
<paragraph id="H6A42EC7257654C1CAC67B2C52500DAE"><enum>(1)</enum><header>Capital fund</header><text display-inline="yes-display-inline">Each eligible entity that receives a grant under subsection (a) shall deposit the grant amount into a child care capital fund established by the eligible entity.</text> </paragraph>
<paragraph id="H307BC6564AB64E8BB3BF2134D8FCF670"><enum>(2)</enum><header>Payments from funds</header><text display-inline="yes-display-inline">Each eligible entity shall provide technical or financial assistance (in the form of loans, grants, investments, guarantees, interest subsidies, and other appropriate forms of assistance) to eligible recipients from the child care capital fund the eligible entity establishes to pay for—</text> 
<subparagraph id="HE5B9C77689714CA08B3C42C503A31F9C"><enum>(A)</enum><text>the acquisition, construction, renovation, or improvement of child care facilities;</text> </subparagraph>
<subparagraph id="H439F49AE6D15400EA8D1FC50A76D7EF0"><enum>(B)</enum><text>equipment for child care facilities; or</text> </subparagraph>
<subparagraph id="H7E4B59539E5D48B5AC836464A2ECF6D"><enum>(C)</enum><text>the provision of technical assistance to eligible child care providers to help the eligible child care providers undertake facilities improvement and expansion projects.</text> </subparagraph></paragraph>
<paragraph id="H95485E3973B5405593DD7852FFFC36FE"><enum>(3)</enum><header>Loan repayments and investment proceeds</header><text display-inline="yes-display-inline">An eligible entity that receives a loan repayment or investment proceeds from an eligible recipient shall deposit such repayment or proceeds into the child care capital fund of the eligible entity for use in accordance with this section.</text> </paragraph></subsection>
<subsection id="HD95A6BAED2B74601B76F059E6B1E8D28"><enum>(e)</enum><header>Applications</header> 
<paragraph id="H4FC9D7A195F24EA9AFA741C18FF3F1E"><enum>(1)</enum><header>Eligible entities</header><text>To be eligible to receive a grant under subsection (a), an eligible entity shall submit an application to the Secretary at such time, in such form, and containing such information as the Secretary may require.</text> </paragraph>
<paragraph id="id7455E9225A664724910D9F09FA22ABC1"><enum>(2)</enum><header>Eligible recipients</header><text display-inline="yes-display-inline">To obtain assistance from an eligible entity under this section, an eligible recipient shall prepare and submit an application to the eligible entity at such time, in such form, and containing such information as the eligible entity may require.</text> </paragraph></subsection></section>
<section id="HB6DE16117A2943CFA5344B5400346C6C"><enum>4.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out this section $50,000,000 for each of the fiscal years 2010 through 2014.</text> </section>
