<section display-inline="yes-display-inline" section-type="undesignated-section" id="HF9FB0E9FA0DD4D488A45639D8C5DFA1C"><text display-inline="yes-display-inline">That upon the adoption of this resolution the bill (H.R. 1035) entitled <quote>An Act to amend the Morris K. Udall Scholarship and Excellence in National Environmental and Native American Public Policy Act of 1992 to honor the legacy of Stewart L. Udall, and for other purposes.</quote>, with the Senate amendment thereto, shall be considered to have been taken from the Speaker’s table to the end that the Senate amendment thereto be, and the same is hereby, agreed to with the following amendment:</text> 
<paragraph id="HA9C24B0F162E47B2A7C1F65BAB5BE599"><enum></enum><text>At the end of the Senate amendment, add the following:</text></paragraph> 
<paragraph id="HA20C621BA3D9448182202D79DFCF0078"><enum></enum><text>At the end of the bill, add the following new section:</text></paragraph></section> 
<section id="H6FEC3523318D413D887B1ECDC0F12C49"><enum>11.</enum><header>Travel Promotion Act of 2009</header> 
<subsection id="H3D7BD05824A847EAA54AFF88FB0739F1"><enum>(a)</enum><header>Short title</header><text>This section may be cited as the <quote><short-title>Travel Promotion Act of 2009</short-title></quote>.</text> </subsection> 
<subsection id="HE354E27D6F7A4E1A998C04E1A8FB3CFD"><enum>(b)</enum><header>The corporation for travel promotion</header> 
<paragraph id="H2197BA0FBEFC49FEA137DD56CA86DC50"><enum>(1)</enum><header>Establishment</header><text>The Corporation for Travel Promotion is established as a nonprofit corporation. The Corporation shall not be an agency or establishment of the United States Government. The Corporation shall be subject to the provisions of the District of Columbia Nonprofit Corporation Act (D.C. Code, section 29–1001 et seq.), to the extent that such provisions are consistent with this subsection, and shall have the powers conferred upon a nonprofit corporation by that Act to carry out its purposes and activities.</text></paragraph> 
<paragraph id="HF3D86B34F41C46E2B026D903B4B93FBD"><enum>(2)</enum><header>Board of Directors</header> 
<subparagraph id="H9B5B3579F4C44176BCA81E63AF6FC6AB"><enum>(A)</enum><header>In general</header><text>The Corporation shall have a board of directors of 11 members with knowledge of international travel promotion and marketing, broadly representing various regions of the United States, who are United States citizens. Members of the board shall be appointed by the Secretary of Commerce (after consultation with the Secretary of Homeland Security and the Secretary of State), as follows:</text> 
<clause id="H3F366832604E442E9B4154F1304FEB2A"><enum>(i)</enum><text>1 shall have appropriate expertise and experience in the hotel accommodations sector;</text></clause> 
<clause id="HE6D5C2DB903247B2B6215CA697926328"><enum>(ii)</enum><text>1 shall have appropriate expertise and experience in the restaurant sector;</text></clause> 
<clause id="HABBE2E92933D484080635DC4B92B7D4E"><enum>(iii)</enum><text>1 shall have appropriate expertise and experience in the small business or retail sector or in associations representing that sector;</text></clause> 
<clause id="HF2AF4DFC5A7F41E7893DB42C11028E13"><enum>(iv)</enum><text>1 shall have appropriate expertise and experience in the travel distribution services sector;</text></clause> 
<clause id="HA3B29BBD9ABE4BB682FD5B9660A486DD"><enum>(v)</enum><text>1 shall have appropriate expertise and experience in the attractions or recreations sector;</text></clause> 
<clause id="H87436EC6A807473991C0461CAB655504"><enum>(vi)</enum><text>1 shall have appropriate expertise and experience as officials of a city convention and visitors’ bureau;</text></clause> 
<clause id="HFD8AB6FB99864B83821CA5173BD5B475"><enum>(vii)</enum><text>2 shall have appropriate expertise and experience as officials of a State tourism office;</text></clause> 
<clause id="HB5F0A1598258420C89F85ED5A45E62E6"><enum>(viii)</enum><text>1 shall have appropriate expertise and experience in the passenger air sector;</text></clause> 
<clause id="HF04F8E47D54043B082CBE4C1E30511CC"><enum>(ix)</enum><text>1 shall have appropriate expertise and experience in immigration law and policy, including visa requirements and United States entry procedures; and</text></clause> 
<clause id="HE2BFE44725144C4EB9E91DCD64410E58"><enum>(x)</enum><text>1 shall have appropriate expertise in the intercity passenger railroad business.</text></clause></subparagraph> 
<subparagraph id="H363478C4194F410BB9FAFB5BA77EB086"><enum>(B)</enum><header>Incorporation</header><text>The members of the initial board of directors shall serve as incorporators and shall take whatever actions are necessary to establish the Corporation under the District of Columbia Nonprofit Corporation Act (D.C. Code, section 29–301.01 et seq.).</text></subparagraph> 
<subparagraph id="H0552AD3B97A64E9193F7865432015140"><enum>(C)</enum><header>Term of office</header><text>The term of office of each member of the board appointed by the Secretary shall be 3 years, except that, of the members first appointed—</text> 
<clause id="H616959F067D3451584CD2E215328D4ED"><enum>(i)</enum><text>3 shall be appointed for terms of 1 year;</text></clause> 
<clause id="H6D76A985D8A74F3685193375450C051D"><enum>(ii)</enum><text>4 shall be appointed for terms of 2 years; and</text></clause> 
<clause id="H1777CF626EAB4EE58D1E5EC02FC9BE69"><enum>(iii)</enum><text>4 shall be appointed for terms of 3 years.</text></clause></subparagraph> 
<subparagraph id="HB22D4A7970A447ECBF804BC7E7295331"><enum>(D)</enum><header>Removal for cause</header><text>The Secretary of Commerce may remove any member of the board for good cause.</text></subparagraph> 
<subparagraph id="H3B54815E50D141F488CDFA0E5E0EF441"><enum>(E)</enum><header>Vacancies</header><text>Any vacancy in the board shall not affect its power, but shall be filled in the manner required by this subsection. Any member whose term has expired may serve until the member’s successor has taken office, or until the end of the calendar year in which the member’s term has expired, whichever is earlier. Any member appointed to fill a vacancy occurring prior to the expiration of the term for which that member’s predecessor was appointed shall be appointed for the remainder of the predecessor’s term. No member of the board shall be eligible to serve more than 2 consecutive full 3-year terms.</text></subparagraph> 
<subparagraph id="H13BD948CD7764805BA103EFA7185BEFB"><enum>(F)</enum><header>Election of chairman and vice chairman</header><text>Members of the board shall annually elect one of the members to be Chairman and elect 1 or 2 of the members as Vice Chairman or Vice Chairmen.</text></subparagraph> 
<subparagraph id="H54CE9F502E384CBEBACC52E2AAE56841"><enum>(G)</enum><header>Status as federal employees</header><text>Notwithstanding any provision of law to the contrary, no member of the board may be considered to be a Federal employee of the United States by virtue of his or her service as a member of the board.</text></subparagraph> 
<subparagraph id="HDE41BF24117C4632A2DE8086EA929237"><enum>(H)</enum><header>Compensation; expenses</header><text>No member shall receive any compensation from the Federal government for serving on the Board. Each member of the Board shall be paid actual travel expenses and per diem in lieu of subsistence expenses when away from his or her usual place of residence, in accordance with section 5703 of title 5, United States Code.</text></subparagraph></paragraph> 
<paragraph id="H3D646910210942A89FF0B4517950ABC8"><enum>(3)</enum><header>Officers and Employees</header> 
<subparagraph id="H1C7172E09BBF45799E25421B9C4BCE75"><enum>(A)</enum><header>In general</header><text>The Corporation shall have an executive director and such other officers as may be named and appointed by the board for terms and at rates of compensation fixed by the board. No individual other than a citizen of the United States may be an officer of the Corporation. The Corporation may hire and fix the compensation of such employees as may be necessary to carry out its purposes. No officer or employee of the Corporation may receive any salary or other compensation (except for compensation for services on boards of directors of other organizations that do not receive funds from the Corporation, on committees of such boards, and in similar activities for such organizations) from any sources other than the Corporation for services rendered during the period of his or her employment by the Corporation. Service by any officer on boards of directors of other organizations, on committees of such boards, and in similar activities for such organizations shall be subject to annual advance approval by the board and subject to the provisions of the Corporation’s Statement of Ethical Conduct. All officers and employees shall serve at the pleasure of the board.</text></subparagraph> 
<subparagraph id="H5734C7C2AA7C4F11A43EABED6435E1D6"><enum>(B)</enum><header>Nonpolitical nature of appointment</header><text>No political test or qualification shall be used in selecting, appointing, promoting, or taking other personnel actions with respect to officers, agents, or employees of the Corporation.</text></subparagraph></paragraph> 
<paragraph id="H53B12B7030ED4E038075B06CD2029898"><enum>(4)</enum><header>Nonprofit and Nonpolitical Nature of Corporation</header> 
<subparagraph id="H76AE393645634538ACF13B92651C6231"><enum>(A)</enum><header>Stock</header><text>The Corporation shall have no power to issue any shares of stock, or to declare or pay any dividends.</text></subparagraph> 
<subparagraph id="HDFD0B922219947A5A5035B84A61550CF"><enum>(B)</enum><header>Profit</header><text>No part of the income or assets of the Corporation shall inure to the benefit of any director, officer, employee, or any other individual except as salary or reasonable compensation for services.</text></subparagraph> 
<subparagraph id="H386D575E4CCA4248BC5F32788BCA5A79"><enum>(C)</enum><header>Politics</header><text>The Corporation may not contribute to or otherwise support any political party or candidate for elective public office.</text></subparagraph> 
<subparagraph id="HA73505470D064B199E2E37F4FBC6D25C"><enum>(D)</enum><header>Sense of congress regarding lobbying activities</header><text>It is the sense of Congress that the Corporation should not engage in lobbying activities (as defined in section 3(7) of the Lobbying Disclosure Act of 1995 (5 U.S.C. 1602(7)).</text></subparagraph></paragraph> 
<paragraph id="HC1AD283998E84F5F8A3795FDB4FBC0EB"><enum>(5)</enum><header>Duties and Powers</header> 
<subparagraph id="H5FB28C35FBB9425BBCB407F0FBE06746"><enum>(A)</enum><header>In general</header><text>The Corporation shall develop and execute a plan—</text> 
<clause id="H8CFA48796BD44A96A04CE91A9050ABED"><enum>(i)</enum><text>to provide useful information to foreign tourists, business people, students, scholars, scientists, and others interested in traveling to the United States, including the distribution of material provided by the Federal government concerning entry requirements, required documentation, fees, processes, and information concerning declared public health emergencies, to prospective travelers, travel agents, tour operators, meeting planners, foreign governments, travel media and other international stakeholders;</text></clause> 
<clause id="H8B4AFB9844A4428898B30D804E4BBB0E"><enum>(ii)</enum><text>to identify, counter, and correct misperceptions regarding United States entry policies around the world;</text></clause> 
<clause id="HF74A7BAD4285475D8CBCC69A9EFEB1C6"><enum>(iii)</enum><text>to maximize the economic and diplomatic benefits of travel to the United States by promoting the United States of America to world travelers through the use of, but not limited to, all forms of advertising, outreach to trade shows, and other appropriate promotional activities;</text></clause> 
<clause id="H1D02EB0412F549959EB81C845D255745"><enum>(iv)</enum><text>to ensure that international travel benefits all States and the District of Columbia and to identify opportunities and strategies to promote tourism to rural and urban areas equally, including areas not traditionally visited by international travelers; and</text></clause> 
<clause id="HA6B8059C44F947B89F3ED496FDC3E87A"><enum>(v)</enum><text>to give priority to the Corporation’s efforts with respect to countries and populations most likely to travel to the United States.</text></clause></subparagraph> 
<subparagraph id="HA2A53E5FF8A64455B95761E8F6DD3528"><enum>(B)</enum><header>Specific powers</header><text>In order to carry out the purposes of this subsection, the Corporation may—</text> 
<clause id="H0B59A848E2094CC0A793086B2DFA157E"><enum>(i)</enum><text>obtain grants from and make contracts with individuals and private companies, State, and Federal agencies, organizations, and institutions;</text></clause> 
<clause id="HFDA87DAE8EF94D88A942B242FDD74794"><enum>(ii)</enum><text>hire or accept the voluntary services of consultants, experts, advisory boards, and panels to aid the Corporation in carrying out its purposes; and</text></clause> 
<clause id="H6EE260B68AB34A25AD107CB677E5CE27"><enum>(iii)</enum><text>take such other actions as may be necessary to accomplish the purposes set forth in this subsection.</text></clause></subparagraph> 
<subparagraph id="H739F6748064C4671924C5153C6FA9A09"><enum>(C)</enum><header>Public outreach and information</header><text>The Corporation shall develop and maintain a publicly accessible website.</text></subparagraph></paragraph> 
<paragraph id="H76D836EF23F644BBBA2B08889B4A27EF"><enum>(6)</enum><header>Open Meetings</header><text>Meetings of the board of directors of the Corporation, including any committee of the board, shall be open to the public. The board may, by majority vote, close any such meeting only for the time necessary to preserve the confidentiality of commercial or financial information that is privileged or confidential, to discuss personnel matters, or to discuss legal matters affecting the Corporation, including pending or potential litigation.</text></paragraph> 
<paragraph id="HE88BE3D81788455C90744D9756943C07"><enum>(7)</enum><header>Major Campaigns</header><text>The board may not authorize the Corporation to obligate or expend more than $25,000,000 on any advertising campaign, promotion, or related effort unless—</text> 
<subparagraph id="HA510D22048FB4E23A939631BA605A0C1"><enum>(A)</enum><text>the obligation or expenditure is approved by an affirmative vote of at least 2/3 of the members of the board present at the meeting;</text></subparagraph> 
<subparagraph id="H08E3F99DACEC467E9B700C79CFB17E32"><enum>(B)</enum><text>at least 6 members of the board are present at the meeting at which it is approved; and</text></subparagraph> 
<subparagraph id="HC28E165B6ED64A47A2DF5E1F42313DD9"><enum>(C)</enum><text>each member of the board has been given at least 3 days advance notice of the meeting at which the vote is to be taken and the matters to be voted upon at that meeting.</text></subparagraph></paragraph> 
<paragraph id="HF58EC3D83F7F4B0AA086DF92602112F7"><enum>(8)</enum><header>Fiscal Accountability</header> 
<subparagraph id="H56ACDD0F33494E948BF52951FBC48A67"><enum>(A)</enum><header>Fiscal year</header><text>The Corporation shall establish as its fiscal year the 12-month period beginning on October 1.</text></subparagraph> 
<subparagraph id="HF6F600C7EC284D828397F42C06F0FFD3"><enum>(B)</enum><header>Budget</header><text>The Corporation shall adopt a budget for each fiscal year.</text></subparagraph> 
<subparagraph id="HAE241F91D0B14E37BE3DE502E81B09BA"><enum>(C)</enum><header>Annual audits</header><text>The Corporation shall engage an independent accounting firm to conduct an annual financial audit of the Corporation’s operations and shall publish the results of the audit. The Comptroller General of the United States may review any audit of a financial statement conducted under this paragraph by an independent accounting firm and may audit the Corporation’s operations at the discretion of the Comptroller General. The Comptroller General and the Congress shall have full and complete access to the books and records of the Corporation.</text></subparagraph> 
<subparagraph id="H0DF580DF034E4ED8BA3CB285AD10BE42"><enum>(D)</enum><header>Program audits</header><text>Not later than 2 years after the date of enactment of this section, the Comptroller General shall conduct a review of the programmatic activities of the Corporation for Travel Promotion. This report shall be provided to appropriate congressional committees.</text></subparagraph></paragraph></subsection> 
<subsection id="H6C92FBEB29AF45FF943AA895FBB00A83"><enum>(c)</enum><header>Accountability measures</header> 
<paragraph id="HC2CD79C159824CAF87E0E0F1F94D2122"><enum>(1)</enum><header>Objectives</header><text>The Board shall establish annual objectives for the Corporation for each fiscal year subject to approval by the Secretary of Commerce (after consultation with the Secretary of Homeland Security and the Secretary of State). The Corporation shall establish a marketing plan for each fiscal year not less than 60 days before the beginning of that year and provide a copy of the plan, and any revisions thereof, to the Secretary.</text></paragraph> 
<paragraph id="H254A5B88BA91467DA4725ED86F13229C"><enum>(2)</enum><header>Budget</header><text>The board shall transmit a copy of the Corporation’s budget for the forthcoming fiscal year to the Secretary not less than 60 days before the beginning of each fiscal year, together with an explanation of any expenditure provided for by the budget in excess of $5,000,000 for the fiscal year. The Corporation shall make a copy of the budget and the explanation available to the public and shall provide public access to the budget and explanation on the Corporation’s website.</text></paragraph> 
<paragraph id="HB43E8283FF374F66B42910C58A818D07"><enum>(3)</enum><header>Annual Report to Congress</header><text>The Corporation shall submit an annual report for the preceding fiscal year to the Secretary of Commerce for transmittal to the Congress on or before the 15th day of May of each year. The report shall include—</text> 
<subparagraph id="H6B81CCEA2E514D6F97631CFAAA9F5DAF"><enum>(A)</enum><text>a comprehensive and detailed report of the Corporation’s operations, activities, financial condition, and accomplishments under this section;</text></subparagraph> 
<subparagraph id="HBCC910B662994EC59C988DDE53B4A102"><enum>(B)</enum><text>a comprehensive and detailed inventory of amounts obligated or expended by the Corporation during the preceding fiscal year;</text></subparagraph> 
<subparagraph id="H4B33F593F6AE40928811D339CF66DC79"><enum>(C)</enum><text>a detailed description of each in-kind contribution, its fair market value, the individual or organization responsible for contributing, its specific use, and a justification for its use within the context of the Corporation’s mission;</text></subparagraph> 
<subparagraph id="HA1746A2878C24388AF6AC6FD3DD2D032"><enum>(D)</enum><text>an objective and quantifiable measurement of its progress, on an objective-by-objective basis, in meeting the objectives established by the board;</text></subparagraph> 
<subparagraph id="H4D6C7DCC3D0E4041AB9DB0446A0EDCE5"><enum>(E)</enum><text>an explanation of the reason for any failure to achieve an objective established by the board and any revisions or alterations to the Corporation’s objectives under <internal-xref idref="HC2CD79C159824CAF87E0E0F1F94D2122" legis-path="11.(c)(1)">paragraph (1)</internal-xref>;</text></subparagraph> 
<subparagraph id="HA7857F80E5CA418ABCBF3BA74B070B65"><enum>(F)</enum><text>a comprehensive and detailed report of the Corporation’s operations and activities to promote tourism in rural and urban areas; and</text></subparagraph> 
<subparagraph id="H13E8375A42BF4B088217223E9F5DF370"><enum>(G)</enum><text>such recommendations as the Corporation deems appropriate.</text></subparagraph></paragraph> 
<paragraph id="HDA51C62974B44EC3BECAD2F6040198EF"><enum>(4)</enum><header>Limitation on Use of Funds</header><text>Amounts deposited in the Fund may not be used for any purpose inconsistent with carrying out the objectives, budget, and report described in this subsection.</text></paragraph></subsection> 
<subsection id="H78D146607EAB4E57A938C1C6CE98A04D"><enum>(d)</enum><header>Matching public and private funding</header> 
<paragraph id="H0FA09C6FA5AF4303894289D181F2B8FB"><enum>(1)</enum><header>Establishment of Travel Promotion Fund</header><text>There is hereby established in the Treasury a fund which shall be known as the Travel Promotion Fund.</text></paragraph> 
<paragraph id="HB7570261E4D44758B12089CBF28AF942"><enum>(2)</enum><header>Funding</header> 
<subparagraph id="H31B04FA96798443BA9E641940510AE05"><enum>(A)</enum><header>Start-up expenses</header><text>For fiscal year 2010, the Secretary of the Treasury shall make available to the Corporation such sums as may be necessary, but not to exceed $10,000,000, from amounts deposited in the general fund of the Treasury from fees under section 217(h)(3)(B)(i)(I) of the Immigration and Nationality Act (8 U.S.C. 1187(h)(3)(B)(i)(I)) to cover the Corporation’s initial expenses and activities under this section. Transfers shall be made at least quarterly, beginning on January 1, 2010, on the basis of estimates by the Secretary, and proper adjustments shall be made in amounts subsequently transferred to the extent prior estimates were in excess or less than the amounts required to be transferred.</text></subparagraph> 
<subparagraph id="H11FC7A337AC74719A525CA1F8AD80B7F"><enum>(B)</enum><header>Subsequent years</header><text>For each of fiscal years 2011 through 2014, from amounts deposited in the general fund of the Treasury during the preceding fiscal year from fees under section 217(h)(3)(B)(i)(I) of the Immigration and Nationality Act (8 U.S.C. 1187(h)(B)(i)(I)), the Secretary of the Treasury shall transfer not more than $100,000,000 to the Fund, which shall be made available to the Corporation, subject to <internal-xref idref="HF40DD02BE5454AABAB1391D63D3C9FFA" legis-path="11.(d)(3)">paragraph (3)</internal-xref> of this subsection, to carry out its functions under this section. Transfers shall be made at least quarterly on the basis of estimates by the Secretary, and proper adjustments shall be made in amounts subsequently transferred to the extent prior estimates were in excess or less than the amounts required to be transferred.</text></subparagraph></paragraph> 
<paragraph id="HF40DD02BE5454AABAB1391D63D3C9FFA"><enum>(3)</enum><header>Matching Requirement</header> 
<subparagraph id="HB5799DC64DA2485AB59A215EB8F99D50"><enum>(A)</enum><header>In general</header><text>No amounts may be made available to the Corporation under this subsection after fiscal year 2010, except to the extent that—</text> 
<clause id="H02531BF0A2E445578C4DA54E7F48A452"><enum>(i)</enum><text>for fiscal year 2011, the Corporation provides matching amounts from non-Federal sources equal in the aggregate to 50 percent or more of the amount transferred to the Fund under <internal-xref idref="HB7570261E4D44758B12089CBF28AF942" legis-path="11.(d)(2)">paragraph (2)</internal-xref>; and</text></clause> 
<clause id="H81CAD2A2B2C64242B18F6E1BAC9F03C3"><enum>(ii)</enum><text>for any fiscal year after fiscal year 2011, the Corporation provides matching amounts from non-Federal sources equal in the aggregate to 100 percent of the amount transferred to the Fund under <internal-xref idref="HB7570261E4D44758B12089CBF28AF942" legis-path="11.(d)(2)">paragraph (2)</internal-xref> for the fiscal year.</text></clause></subparagraph> 
<subparagraph id="H5825478EB1684A16A286CAC950100247"><enum>(B)</enum><header>Goods and services</header><text>For the purpose of determining the amount received from non-Federal sources by the Corporation, other than money—</text> 
<clause id="H391840386A484BCBB720701AE3CA9F74"><enum>(i)</enum><text>the fair market value of goods and services (including advertising) contributed to the Corporation for use under this section may be included in the determination; but</text></clause> 
<clause id="H152EF50C694E486C9272440F42D83B3F"><enum>(ii)</enum><text>the fair market value of such goods and services may not account for more than 80 percent of the matching requirement under <internal-xref idref="HB5799DC64DA2485AB59A215EB8F99D50" legis-path="11.(d)(3)(A)">subparagraph (A)</internal-xref> for the Corporation in any fiscal year.</text></clause></subparagraph> 
<subparagraph id="H0E73760712124EC5BFB562BCC919F872"><enum>(C)</enum><header>Right of refusal</header><text>The Corporation may decline to accept any contribution in-kind that it determines to be inappropriate, not useful, or commercially worthless.</text></subparagraph> 
<subparagraph id="HFD7840A444114B32B9AEE06A81B65BC6"><enum>(D)</enum><header>Limitation</header><text>The Corporation may not obligate or expend funds in excess of the total amount received by the Corporation for a fiscal year from Federal and non-Federal sources.</text></subparagraph></paragraph> 
<paragraph id="HC26B40F3DAF648338EA521FC6B2177CD"><enum>(4)</enum><header>Carryforward</header> 
<subparagraph id="HFC680E7DFF4D4CB6A87A4BEA7A653FD7"><enum>(A)</enum><header>Federal funds</header><text>Amounts transferred to the Fund under <internal-xref idref="H11FC7A337AC74719A525CA1F8AD80B7F" legis-path="11.(d)(2)(B)">paragraph (2)(B)</internal-xref> shall remain available until expended.</text></subparagraph> 
<subparagraph id="HB88785C1175348C0850967FF1F1F3C60"><enum>(B)</enum><header>Matching funds</header><text>Any amount received by the Corporation from non-Federal sources in fiscal year 2010, 2011, 2012, 2013, or 2014 that cannot be used to meet the matching requirement under <internal-xref idref="HB5799DC64DA2485AB59A215EB8F99D50" legis-path="11.(d)(3)(A)">paragraph (3)(A)</internal-xref> for the fiscal year in which amount was collected may be carried forward and treated as having been received in the succeeding fiscal year for purposes of meeting the matching requirement of <internal-xref idref="HB5799DC64DA2485AB59A215EB8F99D50" legis-path="11.(d)(3)(A)">paragraph (3)(A)</internal-xref> in such succeeding fiscal year.</text></subparagraph></paragraph></subsection> 
<subsection id="HFED49055294747F399FFF10E0206B4FC"><enum>(e)</enum><header>Travel promotion fund fees</header><text>Section 217(h)(3)(B) of the Immigration and Nationality Act (8 U.S.C. 1187(h)(3)(B)) is amended to read as follows:</text> 
<quoted-block id="HAA1B1B2270B248E8BE8BE8C524CD9007" style="OLC"> 
<subparagraph id="HF4D536730183409DA3E82BE0BAAE5BE7"><enum>(B)</enum><header>Fees</header> 
<clause id="H224BC654135B4A13B82EDE7A290DFB64"><enum>(i)</enum><header>In general</header><text>No later than 6 months after the date of enactment of the Travel Promotion Act of 2009, the Secretary of Homeland Security shall establish a fee for the use of the System and begin assessment and collection of that fee. The initial fee shall be the sum of—</text> 
<subclause id="H8C133686916441EB9D2BE406F2FEC8FF"><enum>(I)</enum><text>$10 per travel authorization; and</text></subclause> 
<subclause id="H2A5C5828D2DF46C580328450FC2C6BC2"><enum>(II)</enum><text>an amount that will at least ensure recovery of the full costs of providing and administering the System, as determined by the Secretary.</text></subclause></clause> 
<clause id="H752D3F74DFE4422A907C9947E70DB1DC"><enum>(ii)</enum><header>Disposition of amounts collected</header><text>Amounts collected under clause (i)(I) shall be credited to the Travel Promotion Fund established by subsection (d) of section 11 of the Travel Promotion Act of 2009. Amounts collected under clause (i)(II) shall be transferred to the general fund of the Treasury and made available to pay the costs incurred to administer the System.</text></clause> 
<clause id="H4EAC92D93F59481081C216959C3DA05D"><enum>(iii)</enum><header>Sunset of travel promotion fund fee</header><text>The Secretary may not collect the fee authorized by clause (i)(I) for fiscal years beginning after September 30, 2014.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HBDCC78DDFF7D4744BBAFF1CDD70FDAF6"><enum>(f)</enum><header>Assessment authority</header> 
<paragraph id="HD4E4FB4270204715A463854483D4090E"><enum>(1)</enum><header>In General</header><text>Except as otherwise provided in this subsection, the Corporation may impose an annual assessment on United States members of the international travel and tourism industry (other than those described in <internal-xref idref="HABBE2E92933D484080635DC4B92B7D4E" legis-path="11.(b)(2)(A)(iii)">subsection (b)(2)(A)(iii)</internal-xref> or (H)) represented on the Board in proportion to their share of the aggregate international travel and tourism revenue of the industry. The Corporation shall be responsible for verifying, implementing, and collecting the assessment authorized by this subsection.</text></paragraph> 
<paragraph id="H3455581088234F23B0E4B47593A15DE4"><enum>(2)</enum><header>Initial Assessment Limited</header><text>The Corporation may establish the initial assessment after the date of enactment of this section at no greater, in the aggregate, than $20,000,000.</text></paragraph> 
<paragraph id="H58AF7C901E5A4CFFB784726ADB12A85B"><enum>(3)</enum><header>Referenda</header> 
<subparagraph id="H8B58378246DE438BA66092140DFEAB6E"><enum>(A)</enum><header>In general</header><text>The Corporation may not impose an annual assessment unless—</text> 
<clause id="HA03A9574EFD241BD8660EDD879C721F1"><enum>(i)</enum><text>the Corporation submits the proposed annual assessment to members of the industry in a referendum; and</text></clause> 
<clause id="H53B31F8AE09E4D8D976CF228C8AB2FFC"><enum>(ii)</enum><text>the assessment is approved by a majority of those voting in the referendum.</text></clause></subparagraph> 
<subparagraph id="H69C5CC7AABBA4169A0C30E50CC8EFCAD"><enum>(B)</enum><header>Procedural requirements</header><text>In conducting a referendum under this paragraph, the Corporation shall—</text> 
<clause id="H3F9EF880D3D743E98B95381F9EF079A8"><enum>(i)</enum><text>provide written or electronic notice not less than 60 days before the date of the referendum;</text></clause> 
<clause id="H557A41AD97E14A43BD781DB45B7D46C3"><enum>(ii)</enum><text>describe the proposed assessment or increase and explain the reasons for the referendum in the notice; and</text></clause> 
<clause id="H49AC9CE8F37A4542970FD87D4718DED6"><enum>(iii)</enum><text>determine the results of the referendum on the basis of weighted voting apportioned according to each business entity’s relative share of the aggregate annual United States international travel and tourism revenue for the industry per business entity, treating all related entities as a single entity.</text></clause></subparagraph></paragraph> 
<paragraph id="HD44697722DC7467E8B54D966E4529347"><enum>(4)</enum><header>Collection</header> 
<subparagraph id="HEE681EE453244D22B42E9342CAFE6646"><enum>(A)</enum><header>In general</header><text>The Corporation shall establish a means of collecting the assessment that it finds to be efficient and effective. The Corporation may establish a late payment charge and rate of interest to be imposed on any person who fails to remit or pay to the Corporation any amount assessed by the Corporation under this section.</text></subparagraph> 
<subparagraph id="H8605267727AD460985FF77398D9234A5"><enum>(B)</enum><header>Enforcement</header><text>The Corporation may bring suit in Federal court to compel compliance with an assessment levied by the Corporation under this section.</text></subparagraph></paragraph> 
<paragraph id="H30CA4433AE0C4EDD963FEA1FF8DAE8D1"><enum>(5)</enum><header>Investment of Funds</header><text>Pending disbursement pursuant to a program, plan, or project, the Corporation may invest funds collected through assessments, and any other funds received by the Corporation, only in obligations of the United States or any agency thereof, in general obligations of any State or any political subdivision thereof, in any interest-bearing account or certificate of deposit of a bank that is a member of the Federal Reserve System, or in obligations fully guaranteed as to principal and interest by the United States.</text></paragraph></subsection> 
<subsection id="H3D7ED8606078451FA02CAE687F96D037"><enum>(g)</enum><header>Office of travel promotion</header><text>Title II of the International Travel Act of 1961 (22 U.S.C. 2121 et seq.) is amended by inserting after section 201 the following:</text>

<section id="H2864077419234AD081CBA1D3E519BEBB"><enum>202.</enum><header>Office of travel promotion</header> 
<subsection id="H9991C8C252CA485484615BA715A2D9B1"><enum>(a)</enum><header>Office Established</header><text>There is established within the Department of Commerce an office to be known as the Office of Travel Promotion.</text></subsection> 
<subsection id="H2428EB9CCE1A4043B25780D1CA2052D5"><enum>(b)</enum><header>Director</header> 
<paragraph id="H4D02FEAECB024428AA2107FD9F0AB7AE"><enum>(1)</enum><header>Appointment</header><text>The Office shall be headed by a Director who shall be appointed by the Secretary.</text></paragraph> 
<paragraph id="HB6727BC6519F4997AE6BF7572515015C"><enum>(2)</enum><header>Qualifications</header><text>The Director shall be a citizen of the United States and have experience in a field directly related to the promotion of travel to and within the United States.</text></paragraph> 
<paragraph id="H57079C0DD2764F71A06D37F3F325C52E"><enum>(3)</enum><header>Duties</header><text>The Director shall be responsible for ensuring the office is carrying out its functions effectively and shall report to the Secretary.</text></paragraph></subsection> 
<subsection id="HFA3B69DA337C48AD9101BEAA22774451"><enum>(c)</enum><header>Functions</header><text>The Office shall—</text> 
<paragraph id="HA3548DD8542640E491519386762CD5A7"><enum>(1)</enum><text>serve as liaison to the Corporation for Travel Promotion established by subsection (b) of section 11 of the Travel Promotion Act of 2009 and support and encourage the development of programs to increase the number of international visitors to the United States for business, leisure, educational, medical, exchange, and other purposes;</text></paragraph> 
<paragraph id="H3A752A2099D94EDE9E12DA238E0AC155"><enum>(2)</enum><text>work with the Corporation, the Secretary of State and the Secretary of Homeland Security—</text> 
<subparagraph id="H63908AC44CEE4DCE876CCD2C51C0E6DE"><enum>(A)</enum><text>to disseminate information more effectively to potential international visitors about documentation and procedures required for admission to the United States as a visitor;</text></subparagraph> 
<subparagraph id="H139341955D7D4E35B08C7697D4295312"><enum>(B)</enum><text>to ensure that arriving international visitors are generally welcomed with accurate information and in an inviting manner;</text></subparagraph> 
<subparagraph id="HFA10C42C3B894F3480CC4AC76AB71FAF"><enum>(C)</enum><text>to collect accurate data on the total number of international visitors that visit each State; and</text></subparagraph> 
<subparagraph id="HE8F45E89D9604EA7BDBA892812DC1485"><enum>(D)</enum><text>enhance the entry and departure experience for international visitors through the use of advertising, signage, and customer service; and</text></subparagraph></paragraph> 
<paragraph id="H1A409992F34E42CBAEA87B1B7017CA60"><enum>(3)</enum><text>support State, regional, and private sector initiatives to promote travel to and within the United States.</text></paragraph></subsection> 
<subsection id="H78446182B903491794D54B34C0A34F01"><enum>(d)</enum><header>Reports to Congress</header><text>Within a year after the date of enactment of the Travel Promotion Act of 2009, and periodically thereafter as appropriate, the Secretary shall transmit a report to the Senate Committee on Commerce, Science, and Transportation, the Senate Committee on Homeland Security and Governmental Affairs, the Senate Committee on Foreign Relations, the House of Representatives Committee on Energy and Commerce, the House of Representatives Committee on Homeland Security, and the House of Representatives Committee on Foreign Affairs describing the Office’s work with the Corporation, the Secretary of State and the Secretary of Homeland Security to carry out subsection (c)(2).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H61790E0978A8487A888A2FD8C23ED786"><enum>(h)</enum><header>Research program</header><text>Title II of the International Travel Act of 1961 (22 U.S.C. 2121 et seq.), as amended by <internal-xref idref="H3D7ED8606078451FA02CAE687F96D037" legis-path="11.(g)">subsection (g)</internal-xref>, is further amended by inserting after section 202 the following:</text>

<section id="HCEBD4EF7AF3A4D14B2593E53AEB3AE29"><enum>203.</enum><header>Research program</header> 
<subsection id="HF9BC317DA2564452BD29997E50ED0299"><enum>(a)</enum><header>In General</header><text>The Office of Travel and Tourism Industries shall expand and continue its research and development activities in connection with the promotion of international travel to the United States, including—</text> 
<paragraph id="H4B60CEFDA9614880B0DBAD53014249C6"><enum>(1)</enum><text>expanding access to the official Mexican travel surveys data to provide the States with traveler characteristics and visitation estimates for targeted marketing programs;</text></paragraph> 
<paragraph id="H9264E2F9BEC2457EBD36F4B0EEBB643C"><enum>(2)</enum><text>expanding the number of inbound air travelers sampled by the Commerce Department’s Survey of International Travelers to reach a 1 percent sample size and revising the design and format of questionnaires to accommodate a new survey instrument, improve response rates to at least double the number of States and cities with reliable international visitor estimates and improve market coverage;</text></paragraph> 
<paragraph id="HA993E14445FA407E80427AC29F413E06"><enum>(3)</enum><text>developing estimates of international travel exports (expenditures) on a State-by-State basis to enable each State to compare its comparative position to national totals and other States;</text></paragraph> 
<paragraph id="HB7ACB5CF6FC14708AFF38CD0E9E7F707"><enum>(4)</enum><text>evaluate the success of the Corporation in achieving its objectives and carrying out the purposes of the Travel Promotion Act of 2009; and</text></paragraph> 
<paragraph id="HCECED97F628244E7BE2BE8054751D317"><enum>(5)</enum><text>research to support the annual reports required by section 202(d) of this Act.</text></paragraph></subsection> 
<subsection id="H1C4B52DC2511439AB53FC7DF3AA8FCE5"><enum>(b)</enum><header>Authorization of Appropriations</header><text>There are authorized to be appropriated to the Secretary of Commerce for fiscal years 2010 through 2014 such sums as may be necessary to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
