		<official-title>To temporarily exempt certain public and private
		  development projects from any requirement for a review, statement, or analysis
		  under the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.),
		  and for other purposes.</official-title>
	</form>
	<legis-body id="H823A3DDA4D8A42F2AE2F6BF567A3F839" style="OLC">
		<section id="HB1BBBF66EE3840B384CBB76433EF3469" section-type="section-one"><enum>1.</enum><header>Public, private, and
			 agricultural projects and activities</header>
			<subsection id="HD91D6ABB6BA64D198C08BA8DF142CA21"><enum>(a)</enum><header>Exemption from
			 review</header><text>During the 3-year period beginning on the date of
			 enactment of this Act, no public or private development project that is to be
			 carried out during that period (other than such a project for which a permit is
			 required under section 404 of the Federal Water Pollution Control Act (33
			 U.S.C. 1344) or that is to be carried out on wetland (as that term is defined
			 in section 1201 of the Food Security Act of 1985 (16 U.S.C. 3801)) shall be
			 subject to any requirement for a review, statement, or analysis under the
			 National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.).</text>
			</subsection><subsection id="H61661D4CA9BA43E4B8E4B2487DA16AF"><enum>(b)</enum><header>Emergencies</header><text>Section
			 10 of the Endangered Species Act of 1973 (16 U.S.C. 1539) is amended by adding
			 at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H0A8C5A2385C64D6F9E9CE9A75FAAD282" style="OLC">
					<subsection id="HA17E0BC2B091439DA075F78289338101"><enum>(k)</enum><header>Emergencies</header><text>On
				the declaration of an emergency by the Governor of a State, the Secretary
				shall, for the duration of the emergency, temporarily exempt from the
				prohibition against taking, and the prohibition against the adverse
				modification of critical habitat, under this Act any action that is reasonably
				necessary to avoid or ameliorate the impact of the emergency, including the
				operation of any water supply or flood control project by a Federal
				agency.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD57397D8E5FD419B003755B39C07E895"><enum>(c)</enum><header>Jurisdiction
			 over covered energy projects</header>
				<paragraph id="H7343123F780D45038EDC323B595EE500"><enum>(1)</enum><header>Definition of
			 covered energy project</header><text display-inline="yes-display-inline">In
			 this subsection, the term <term>covered energy project</term> means any action
			 or decision by a Federal official regarding—</text>
					<subparagraph id="H6CD7522C797D48BF8424A5B87F002F94"><enum>(A)</enum><text>the leasing of
			 Federal land (including submerged land) for the exploration, development,
			 production, processing, or transmission of oil, natural gas, or any other
			 source or form of energy, including actions and decisions regarding the
			 selection or offering of Federal land for such leasing; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9E0F1D5D932A418EA5075CA065BD3299"><enum>(B)</enum><text>any action under
			 such a lease.</text>
					</subparagraph></paragraph><paragraph id="HFAD6BCD61F984AA3AFEEC403BF9FB89E"><enum>(2)</enum><header>Exclusive
			 jurisdiction over causes and claims relating to covered energy
			 projects</header><text display-inline="yes-display-inline">Notwithstanding any
			 other provision of law, the United States District Court for the District of
			 Columbia shall have exclusive jurisdiction to hear all causes and claims under
			 this subsection or any other Act that arise from any covered energy
			 project.</text>
				</paragraph><paragraph id="HE47230CEEF9A4D43A2DAB7BEF6F8DED7"><enum>(3)</enum><header>Time for filing
			 complaint</header>
					<subparagraph id="H3CBDEFE7607F4F22B6E6017C5DE10056"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Each case or claim
			 described in paragraph (2) shall be filed not later than the end of the 60-day
			 period beginning on the date of the action or decision by a Federal official
			 that constitutes the covered energy project concerned.</text>
					</subparagraph><subparagraph id="H9B4738728C17475AB95FF6A59800604B"><enum>(B)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Any cause or claim described in paragraph
			 (2) that is not filed within the time period described in subparagraph (A)
			 shall be barred.</text>
					</subparagraph></paragraph><paragraph id="H314493BF1CCB42B9832D44AF05ADB762"><enum>(4)</enum><header>District court
			 for the District of Columbia deadline</header>
					<subparagraph id="H4C2C5F6F92B740269EC40018CBBE3BC"><enum>(A)</enum><header>In
			 general</header><text>Each proceeding that is subject to paragraph (2)—</text>
						<clause id="H12CB411FB4984154881B82AD16B692C4"><enum>(i)</enum><text>shall be resolved
			 as expeditiously as practicable and in any event not more than 180 days after
			 the cause or claim is filed; and</text>
						</clause><clause id="H38DD94784EAC4B1990CBC8B62264E013"><enum>(ii)</enum><text>shall take
			 precedence over all other pending matters before the district court.</text>
						</clause></subparagraph><subparagraph id="H7758B695EA3E48EE98997FD8EFB72310"><enum>(B)</enum><header>Failure to
			 comply with deadline</header><text>If an interlocutory or final judgment,
			 decree, or order has not been issued by the district court by the deadline
			 required under this subsection, the cause or claim shall be dismissed with
			 prejudice and all rights relating to the cause or claim shall be
			 terminated.</text>
					</subparagraph></paragraph><paragraph id="H5FCFF51891F74D848BAC6278BF1E7F9D"><enum>(5)</enum><header>Ability to seek
			 appellate review</header><text display-inline="yes-display-inline">An
			 interlocutory or final judgment, decree, or order of the district court under
			 this subsection may be reviewed by no other court except the Supreme
			 Court.</text>
				</paragraph><paragraph id="H3F90C69FA3BB4BA5A4E1F7EFFB6793E0"><enum>(6)</enum><header>Deadline for
			 appeal to the Supreme Court</header><text display-inline="yes-display-inline">If a writ of certiorari has been granted by
			 the Supreme Court pursuant to paragraph (5)—</text>
					<subparagraph id="H6A458427A16546ABADB07C63CF91BF0"><enum>(A)</enum><text>the interlocutory
			 or final judgment, decree, or order of the district court shall be resolved as
			 expeditiously as practicable and in any event not more than 180 days after the
			 interlocutory or final judgment, decree, order of the district court is issued;
			 and</text>
					</subparagraph><subparagraph id="HF618E9EE8C3B435DAC72C425E064FFE6"><enum>(B)</enum><text>all such
			 proceedings shall take precedence over all other matters then before the
			 Supreme Court.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
