<official-title>To limit the use of cluster munitions.</official-title>

<section id="H362011554BA8463EAFC300706E54A1A5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cluster Munitions Civilian Protection Act of 2009</short-title></quote>.</text></section>
<section id="HC3BDD6AB8F8242BF87633CBC85BA41FD"><enum>2.</enum><header>Limitation on the use of cluster munitions</header><text display-inline="no-display-inline">No funds appropriated or otherwise available to any Federal department or agency may be obligated or expended to use any cluster munitions unless—</text>
<paragraph id="H8FC0881E475E4FB1BB81C6DDFA7CC036"><enum>(1)</enum><text display-inline="yes-display-inline">the submunitions of the cluster munitions, after arming, do not result in more than 1 percent unexploded ordnance across the range of intended operational environments; and</text></paragraph>
<paragraph id="H10E07C79484E438981E348A81EB079B6"><enum>(2)</enum><text display-inline="yes-display-inline">the policy applicable to the use of such cluster munitions specifies that the cluster munitions will only be used against clearly defined military targets and will not be used where civilians are known to be present or in areas normally inhabited by civilians.</text></paragraph></section>
<section id="HE2F8D80636B74EAEAF8FEC9B8E51B99"><enum>3.</enum><header>Presidential waiver</header><text display-inline="no-display-inline">The President may waive the requirement under section 2(1) if, prior to the use of cluster munitions, the President—</text>
<paragraph id="H6B972BB8EBA24A419F0071AB0410C15F"><enum>(1)</enum><text display-inline="yes-display-inline">certifies that it is vital to protect the security of the United States; and</text></paragraph>
<paragraph id="H6B052A87AE3C4C96A0DABF71CCA2F6FD"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 30 days after making such certification, submits to the appropriate congressional committees a report, in classified form if necessary, describing in detail—</text>
<subparagraph id="HC620009C93C74393814E1487CA85F065"><enum>(A)</enum><text>the steps that will be taken to protect civilians; and</text></subparagraph>
<subparagraph id="H644034F2F01C4E87BAAFA4CF200C8F0"><enum>(B)</enum><text>the failure rate of the cluster munitions that will be used and whether such munitions are fitted with self-destruct or self-deactivation devices.</text></subparagraph></paragraph></section>
<section id="H3B24455C98C449F4AD4255687200D1A7"><enum>4.</enum><header>Cleanup plan</header><text display-inline="no-display-inline">Not later than 90 days after any cluster munitions are used by a Federal department or agency, the President shall submit to the appropriate congressional committees a plan, prepared by such Federal department or agency, for cleaning up any such cluster munitions and submunitions which fail to explode and continue to pose a hazard to civilians.</text></section>
<section id="H61FB987090FD441F80CED6986565EB52"><enum>5.</enum><header>Appropriate congressional committees defined</header><text display-inline="no-display-inline">In this Act, the term <term>appropriate congressional committees</term> means the Committee on Foreign Relations, the Committee on Armed Services, and the Committee on Appropriations of the Senate and the Committee on Foreign Affairs, the Committee on Armed Services, and the Committee on Appropriations of the House of Representatives.</text></section>
