		<official-title>To amend title 18, United States Code, to prohibit
		  certain deceptive practices in Federal elections, and for other
		  purposes.</official-title>

		<section id="HCDE2D16691024B319F38B3E72E57C466" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote>Deceptive Practices and Voter Intimidation Prevention Act of
			 2009</quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H63B009AE3FA243B1BB7E55E3E21B8BAB"><enum>2.</enum><header>Prohibition on
			 deceptive practices in Federal elections</header>
			<subsection commented="no" id="HCDD9F1B223154450A044237B69F34E00"><enum>(a)</enum><header>In
			 general</header><text>Chapter 29 of title 18, United States Code, is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H0518D31EDB8E404B9FA375C94FAC79A7" style="USC">
					<section id="HC80F324F1C38427E876FD63E06DA4518"><enum>618.</enum><header>Deceptive
				practices in Federal elections</header>
						<subsection id="HD02850EE98B749C281BCB4984E703497"><enum>(a)</enum><text display-inline="yes-display-inline">Whoever, within 60 days before a Federal
				election, knowingly communicates election-related information about that
				election, knowing that information to be false, with the intent to prevent
				another person from exercising the right to vote in that election, or attempts
				to do so, shall be fined under this title or imprisoned not more than 5 years,
				or both.</text>
						</subsection><subsection id="HC8A1E30A97204DFBAAFE84E90090472"><enum>(b)</enum><text display-inline="yes-display-inline">As used in this section—</text>
							<paragraph id="HA393286D91274E72BCEAF2E7F4621AE"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>Federal election</term>
				means any general, primary, run-off, or special election for the office of
				President, Vice President, presidential elector, Member of the Senate, Member
				of the House of Representatives, or Delegate or Commissioner from a territory
				or possession; and</text>
							</paragraph><paragraph id="H9CFA8532A8A246F192775C2E81910000"><enum>(2)</enum><text>the term
				<term>election related information</term> means information regarding—</text>
								<subparagraph commented="no" id="H6FE32CA5BBD04376AE8791772F2FC493"><enum>(A)</enum><text>the time, place,
				or manner of conducting the election;</text>
								</subparagraph><subparagraph id="H3D2346E3D9CE487EA0094B771C23C5C4"><enum>(B)</enum><text>the qualifications
				for or restrictions on voter eligibility for the election, including—</text>
									<clause id="H01603B8529D54D6787F7688407D598E8"><enum>(i)</enum><text display-inline="yes-display-inline">any criminal penalties associated with
				voting in the election; or</text>
									</clause><clause id="H445AE6514ADE4E0DA0C730FF5C8C41B0"><enum>(ii)</enum><text>information
				regarding a voter's registration status or eligibility;</text>
									</clause></subparagraph><subparagraph id="H5CA619F344D84A179D6E4677A7CD1C66"><enum>(C)</enum><text>with respect to a
				closed primary election, the political party affiliation of any candidate for
				office, if the communication of the information also contains false information
				described in subparagraph (A) or (B); or</text>
								</subparagraph><subparagraph commented="no" id="H44264DA0D5D340059BC175ADEF2FDA5B"><enum>(D)</enum><text>the explicit
				endorsement by any person or organization of a candidate running for any office
				voted on in the
				election.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD4C3A7F4F09D4142B0C9936FDAF1FD03"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections for chapter 29 of title 18,
			 United States Code, is amended by adding at the end the following new
			 item:</text>

			</subsection></section><section display-inline="no-display-inline" id="HBB35950A975A4A8299C0D15B79FCD174" section-type="subsequent-section"><enum>3.</enum><header>Modification of
			 penalty for voter intimidation</header><text display-inline="no-display-inline">Section 594 of title 18, United States Code,
			 is amended by striking <quote>one year</quote> and inserting <quote>5
			 years</quote>.</text>
		</section><section display-inline="no-display-inline" id="HD00C061AC47D434782CD3569E0F58BFC"><enum>4.</enum><header>Sentencing
			 guidelines</header>
			<subsection id="H466D6A9DB5EE4602A33C20E9EA03A284"><enum>(a)</enum><header>Review and
			 Amendment</header><text display-inline="yes-display-inline">Not later than 90
			 days after the date of enactment of this Act, the United States Sentencing
			 Commission, pursuant to its authority under section 994 of title 28, United
			 States Code, and in accordance with this section, shall review and, if
			 appropriate, amend the Federal sentencing guidelines and policy statements
			 applicable to persons convicted of any offense under sections of title 18,
			 United States Code, that are added or modified by this Act.</text>
			</subsection><subsection id="H12452925804849608295BCEC1C07B2B8"><enum>(b)</enum><header>Authorization</header><text>The
			 United States Sentencing Commission may, for the purposes of the amendments
			 made pursuant to this section, amend the Federal sentencing guidelines in
			 accordance with the procedures set forth in section 21(a) of the Sentencing Act
			 of 1987 (28 U.S.C. 994 note) as though the authority under that section had not
			 expired.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HC882A9AA324043259444D81ED998F48" section-type="subsequent-section"><enum>5.</enum><header>Reporting violations
			 and remedial action</header>
			<subsection commented="no" display-inline="no-display-inline" id="HE696DA9882EF46DF992026613D484BD9"><enum>(a)</enum><header>Reporting</header><text>Any
			 person may report to the Attorney General any violation or possible violation
			 of section 594 or 618 of title 18, United States Code.</text>
			</subsection><subsection commented="no" id="H3626A47FD0F34510BC335F77D52FCF9D"><enum>(b)</enum><header>Corrective
			 action</header>
				<paragraph commented="no" id="H2038DE1160B2489AB878A486E11DB093"><enum>(1)</enum><header>In
			 general</header><text>Immediately after receiving a report under subsection
			 (a), the Attorney General shall consider and review such report and, if the
			 Attorney General determines that there is a reasonable basis to find that a
			 violation has occurred, the Attorney General shall—</text>
					<subparagraph commented="no" id="H0A61893EA76249AFA2009D59CB003485"><enum>(A)</enum><text>undertake all
			 effective measures necessary to provide correct information to voters affected
			 by the false information;</text>
					</subparagraph><subparagraph id="H291B750D34C7432EB403E06811713A4"><enum>(B)</enum><text display-inline="yes-display-inline">refer any matter under the jurisdiction of
			 the Civil Rights Division of the Department of Justice to such division for
			 prosecution; and</text>
					</subparagraph><subparagraph commented="no" id="HB3FACC6969514B83989285A46EA1D17C"><enum>(C)</enum><text>refer the matter
			 to the appropriate Federal and State authorities for criminal prosecution or
			 civil action after the election.</text>
					</subparagraph></paragraph><paragraph commented="no" id="H18FAD743FE084E96B5DDB72422CC757F"><enum>(2)</enum><header>Regulations</header>
					<subparagraph commented="no" id="HD05C01529B5540C6B98B7B93A640DC9F"><enum>(A)</enum><header>In
			 general</header><text>The Attorney General shall promulgate regulations
			 regarding the methods and means of corrective actions to be taken under
			 paragraph (1). Such regulations shall be developed in consultation with the
			 Election Assistance Commission, civil rights organizations, voting rights
			 groups, State and local election officials, voter protection groups, and other
			 interested community organizations.</text>
					</subparagraph><subparagraph commented="no" id="HBF4BAA820CD24349AEDEFBC9002F2D47"><enum>(B)</enum><header>Study</header>
						<clause commented="no" id="H62F915957C4649FFB1FE00743DCD55D8"><enum>(i)</enum><header>In
			 general</header><text>The Attorney General, in consultation with the Federal
			 Communications Commission and the Election Assistance Commission, shall conduct
			 a study on the feasibility of providing the corrective information under
			 paragraph (1) through public service announcements, the emergency alert system,
			 or other forms of public broadcast.</text>
						</clause><clause commented="no" id="HCC1D1A66935149BDB5907BB06EFA721C"><enum>(ii)</enum><header>Report</header><text>Not
			 later than 180 days after the date of the enactment of this Act, the Attorney
			 General shall submit to Congress a report detailing the results of the study
			 conducted under clause (i).</text>
						</clause></subparagraph></paragraph><paragraph id="H8162D63AA72E4673B3F62CD4C4D71B4"><enum>(3)</enum><header>Publicizing
			 remedies</header><text display-inline="yes-display-inline">The Attorney General
			 shall make public through the Internet, radio, television, and newspaper
			 advertisements information on the responsibilities, contact information, and
			 complaint procedures applicable under this section.</text>
				</paragraph></subsection><subsection id="H478EB0C45A704AA8807BBCA86602C491"><enum>(c)</enum><header>Reports to
			 Congress</header>
				<paragraph id="H453EEDF4F6A34C97B809183BE4B46C5C"><enum>(1)</enum><header>In
			 general</header><text>Not later than 90 days after any primary, general, or
			 run-off election for Federal office, the Attorney General shall submit to
			 Congress a report compiling and detailing any allegations of false information
			 submitted pursuant to subsection (a) and relating to such election.</text>
				</paragraph><paragraph id="H5C7E648594FF4FAE8FE353982FDB7662"><enum>(2)</enum><header>Contents</header><text>Each
			 report submitted under paragraph (1) shall include—</text>
					<subparagraph id="HB795ADD63EA84A85B35B8E7FCA9DAEE6"><enum>(A)</enum><text>detailed
			 information on specific allegations of deceptive tactics;</text>
					</subparagraph><subparagraph id="HADD788357E2445D080001D7DC0F3E845"><enum>(B)</enum><text>statistical
			 compilations of how many allegations were made and of what type;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA2624FFCF37141778C314BAFA80739D1"><enum>(C)</enum><text>the geographic
			 locations of and the populations affected by the alleged deceptive
			 information;</text>
					</subparagraph><subparagraph id="HC1AC74822A2741A7B999B7C82F6CCE16"><enum>(D)</enum><text>the status of the
			 investigations of such allegations;</text>
					</subparagraph><subparagraph id="HB23899ABA7E44C8C9C45B4019330573E"><enum>(E)</enum><text>any corrective
			 actions taken in response to such allegations;</text>
					</subparagraph><subparagraph id="H69BA95283715483790786CEDF7DC93CF"><enum>(F)</enum><text>the rationale used
			 for any corrective actions or for any refusal to pursue an allegation;</text>
					</subparagraph><subparagraph id="H9DB5E543D3D545CB9D6EC10BFCF14F3"><enum>(G)</enum><text>the effectiveness
			 of any such corrective actions;</text>
					</subparagraph><subparagraph id="H755D08158D5E44AE899943D315B8D952"><enum>(H)</enum><text>whether a Voting
			 Integrity Task Force was established with respect to such election, and, if so,
			 how such task force was staffed and funded;</text>
					</subparagraph><subparagraph id="H884D63F17EF44EF0AD684938C6128653"><enum>(I)</enum><text>any referrals of
			 information to other Federal, State, or local agencies;</text>
					</subparagraph><subparagraph id="HDDA4B2D92DD44235B0180900D9303FB0"><enum>(J)</enum><text>any suit
			 instituted under section 2004(b)(2) of the Revised Statutes (42 U.S.C.
			 1971(b)(2)) in connection with such allegations; and</text>
					</subparagraph><subparagraph id="HCCA4D41A71774D74B4EF46343B9B7FA"><enum>(K)</enum><text>any criminal
			 prosecution instituted under title 18, United States Code, in connection with
			 such allegations.</text>
					</subparagraph></paragraph><paragraph id="H3F7DE84744B94985B7178700E25FFA07"><enum>(3)</enum><header>Report made
			 public</header><text>On the date that the Attorney General submits the report
			 required under paragraph (1), the Attorney General shall also make the report
			 publicly available through the Internet and other appropriate means.</text>
				</paragraph></subsection><subsection commented="no" id="H1998F1567BBB4E3B911B14FB11B266CD"><enum>(d)</enum><header>Delegation of
			 duties</header>
				<paragraph commented="no" id="H1C4F0067F6F24DCEAF94BDD72DE7FE69"><enum>(1)</enum><header>In
			 general</header><text>The Attorney General shall delegate the responsibilities
			 under this section to a Voting Integrity Task Force established under paragraph
			 (2).</text>
				</paragraph><paragraph commented="no" id="HC0B397A9FC2A4E9F9C9B20A7DCE4B3D"><enum>(2)</enum><header>Voting integrity
			 task force</header>
					<subparagraph commented="no" id="H05074DB08E1C40C3817061C4EFCECDEE"><enum>(A)</enum><header>In
			 general</header><text>The Attorney General shall establish a Voting Integrity
			 Task Force to carry out the requirements of this section with respect to any
			 general, primary, run-off, or special election for Federal office.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB9E0926457C1406E8BCF7A7DD457516"><enum>(B)</enum><header>Composition</header><text>Any
			 Voting Integrity Task Force established under this paragraph shall be under the
			 direction of the Assistant Attorney General for the Civil Rights Division and
			 the Assistant Attorney General for the Criminal Division, jointly.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="H740208849E704C99B3C3990154DAE574"><enum>(e)</enum><header>Federal
			 office</header><text>For purposes of this section, the term <term>Federal
			 office</term> means the office of President, Vice President, presidential
			 elector, Member of the Senate, Member of the House of Representatives, or
			 Delegate or Commissioner from a territory or possession of the United
			 States.</text>
