<official-title>To encourage the entry of felony warrants into the NCIC database by States and to provide additional resources for extradition.</official-title>

<section id="H47F7D366542A4CB18B97002950FFE6B9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fugitive Information Networked Database Act of 2009</short-title></quote> or the <quote><short-title>FIND Act of 2009</short-title></quote>.</text> </section>
<section id="H1CEB27642BA647F393E5C33CE5C714C2"><enum>2.</enum><header>Definition</header><text display-inline="no-display-inline">In this Act, the term <term>National Crime Information Center database</term> means the computerized index of criminal justice information operated by the Federal Bureau of Investigation pursuant to section 534 of title 28, United States Code, and available to Federal, State, and local law enforcement and other criminal justice agencies.</text> </section>
<section id="H1C8E8183101648B7BDFEC544065C00C9"><enum>3.</enum><header>Grants to encourage States to enter felony warrants</header> 
<subsection id="HCA69B8BD3C464CE78B009DD7E51514F"><enum>(a)</enum><header>State system</header><text display-inline="yes-display-inline">A State Attorney General may, in consultation with local law enforcement and any other relevant government agencies, apply for a grant from the United States Attorney General to—</text> 
<paragraph id="HBE535D12C4FB431C954D743C4800FE96"><enum>(1)</enum><text display-inline="yes-display-inline">develop and implement secure, electronic warrant management systems that permit the prompt preparation, submission, and validation of warrants and are compatible and interoperable with the National Crime Information Center database; or</text> </paragraph>
<paragraph id="H8D90F9F8387043D694CCE8008513F4A1"><enum>(2)</enum><text>upgrade existing electronic warrant management systems to ensure compatibility and interoperability with the National Crime Information Center database;</text> </paragraph><continuation-text continuation-text-level="subsection">to facilitate information sharing and to ensure that felony warrants entered into State and local warrant databases can be automatically entered into the National Crime Information Center database. The grant funds may also be used to hire additional personnel, as needed, for the validation of warrants entered into the National Crime Information Center database.</continuation-text></subsection>
<subsection id="H56C9B2A6D3B3476A9FC9AE3B76E7DD9D"><enum>(b)</enum><header>Eligibility</header><text display-inline="yes-display-inline">In order to be eligible for a grant authorized under subsection (a), a State shall submit to the United States Attorney General—</text> 
<paragraph id="H6CBD4935407D4924926E82C1D3E00E5"><enum>(1)</enum><text>a plan to develop and implement, or upgrade, systems described in subsection (a);</text> </paragraph>
<paragraph id="H51B52FEED95047E8A63FD9F506004B88"><enum>(2)</enum><text>a report that—</text> 
<subparagraph id="H010BD29B5FC44095B75DB1C639822409"><enum>(A)</enum><text>details the number of felony warrants outstanding in the State;</text> </subparagraph>
<subparagraph id="HF409553C33C74CC6A62890D202001209"><enum>(B)</enum><text>describes any backlog of warrants that have not been entered into the State and local warrant databases or into the National Crime Information Center database, over the preceding 3 years (including the number of such felony warrants);</text> </subparagraph>
<subparagraph id="H1E4C45E5C42D4DDD9690ED379FF29843"><enum>(C)</enum><text>explains the reasons for the failure of State and local government agencies to enter felony warrants into the National Crime Information Center database; and</text> </subparagraph>
<subparagraph id="HC26B19B3613546A5B927FAB3BDE61D99"><enum>(D)</enum><text>demonstrates that State and local government agencies have made good faith efforts to eliminate any such backlog;</text> </subparagraph></paragraph>
<paragraph id="H2D94C405EAAA4D8F93132464CBEA9382"><enum>(3)</enum><text>guidelines for warrant entry by State and local government agencies that will ensure that felony warrants entered into State and local warrant databases will also be entered into the National Crime Information Center database and explain the circumstances in which, as a matter of policy, certain felony warrants will not be entered into the National Crime Information Center database; and</text> </paragraph>
<paragraph id="HE8DD1ABC40744DC28D48D32C8D036004"><enum>(4)</enum><text display-inline="yes-display-inline">an assurance that the State will implement such practices and procedures as may be necessary to ensure that all felony warrants for Part I crimes (as classified for the Federal Bureau of Investigation's Uniform Crime Report) that are issued after the date of enactment of this Act are entered into the National Crime Information Center database.</text> </paragraph></subsection>
<subsection id="H59527F613F0645D8B22D0084256B7F32"><enum>(c)</enum><header>Requirements</header><text display-inline="yes-display-inline">Each State that receives a grant under this section shall, as a condition of receiving such grant, report to the Attorney General on an annual basis the number of felony warrants entered into the State and local warrant databases, the number of felony warrants entered into the National Crime Information Center database, and, with respect to felony warrants not entered into the National Crime Information Center database, the reasons for not entering such warrants.</text> </subsection>
<subsection id="H29B7136155104FA1AED2BC8D78859728"><enum>(d)</enum><header>Authorization</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Attorney General $25,000,000 for each of the fiscal years 2009 and 2010 for grants to State and local government agencies for resources to carry out the requirements of this section.</text> </subsection></section>
<section id="H9B24AB616DFC45EA97E1CD82314257F"><enum>4.</enum><header>FBI coordination</header><text display-inline="no-display-inline">The Federal Bureau of Investigation shall provide to State and local government agencies the technological standard that ensures compatibility and interoperability of all State and local warrant databases with the National Crime Information Center database.</text> </section>
<section id="H12DA7929DC9E4658989200E24B266FE5"><enum>5.</enum><header>Report regarding felony warrant entry</header> 
<subsection id="H3DFA3536E5C4414383042638B15346F8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 270 days after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the Committees on the Judiciary of the House of Representatives and the Senate a report regarding—</text> 
<paragraph id="H3C4FE4A39FE547EAA9F814D02F87867"><enum>(1)</enum><text display-inline="yes-display-inline">the number of felony warrants currently active in each State;</text> </paragraph>
<paragraph id="H6E98B543B63D4013836FF1B185FEFBB8"><enum>(2)</enum><text display-inline="yes-display-inline">the number of those felony warrants that State and local government agencies have entered into the National Crime Information Center database;</text> </paragraph>
<paragraph id="HDD317828806E4C8094B9DAB1E4F73B37"><enum>(3)</enum><text display-inline="yes-display-inline">the number of times State and local law enforcement in each State has been contacted regarding a fugitive apprehended in another State over the preceding 3 years; and</text> </paragraph>
<paragraph id="H6A5A26272128401B00C5F5A3DD00FFBA"><enum>(4)</enum><text display-inline="yes-display-inline">the number of fugitives from each State who were apprehended in other States over the preceding 3 years but not extradited.</text> </paragraph></subsection>
<subsection id="HEB39408263C641D4A500C0DA26868517"><enum>(b)</enum><header>Assistance</header><text display-inline="yes-display-inline">To assist in the preparation of the report required by subsection (a), the Attorney General shall provide the Comptroller General of the United States with access to any information collected and reviewed in connection with the grant application process described in section 3.</text> </subsection>
<subsection id="HD49CDF4A8E744059B47E6E24FC6CB3B9"><enum>(c)</enum><header>Report</header><text>On an annual basis, the Attorney General shall submit to the Committees on the Judiciary of the House of Representatives and the Senate a report containing the information received from the States under this <internal-xref idref="H59527F613F0645D8B22D0084256B7F32" legis-path="3.(c)">section 3(c)</internal-xref>.</text> </subsection></section>
<section id="HF360F340705649929329B83DE7005258"><enum>6.</enum><header>Additional resources for fugitive task forces and extradition</header> 
<subsection id="H73EF4AE34E7E40C1ACEFC24E3635B014"><enum>(a)</enum><header>Presidential Threat Protection Act of 2000</header><text display-inline="yes-display-inline">Section 6(b) of the Presidential Threat Protection Act of 2000 (28 U.S.C. 566 note) is amended by adding at the end the following: <quote>There are authorized to be appropriated to the Attorney General for the United States Marshals Service to carry out the provisions of this section $20,000,000 for fiscal year 2009 and $10,000,000 for each of the fiscal years 2010 through 2014.</quote>.</text> </subsection>
<subsection id="H11783FEF03E84F7E86ED55111824309B"><enum>(b)</enum><header>Justice Prisoner and Alien Transport System</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Attorney General for the United States Marshals Service $3,000,000 for each of fiscal years 2009 through 2014 to assist in extradition of fugitives through the Justice Prisoner and Alien Transport System.</text> </subsection></section>
