		  children of fallen public safety officers, and for other

		<section id="H893F3DA367484DAFB6AA29C9468E274C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Officer Daniel Faulkner Children of
			 Fallen Heroes Scholarship Act of 2010</short-title></quote>.</text>
		</section><section id="H2BD267E00B0040F482D4D6D812AC8F4E"><enum>2.</enum><header>Calculation of
			 eligibility</header><text display-inline="no-display-inline">Section 473(b) of
			 the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087mm">20 U.S.C. 1087mm(b)</external-xref>) is
			 amended—</text>
			<paragraph id="HCC4C286794EF4066A205011C8A76E1EE"><enum>(1)</enum><text>in paragraph
			 (2)—</text>
				<subparagraph id="HA0F51C6824144813BAF14FA9C5916C20"><enum>(A)</enum><text>in the matter
			 preceding subparagraph (A), by inserting <quote>(in the case of a student who
			 meets the requirement of subparagraph (B)(i)), or academic year 2011–2012 (in
			 the case of a student who meets the requirement of subparagraph
			 (B)(ii)),</quote> after <quote>academic year 2009–2010</quote>; and</text>
				</subparagraph><subparagraph id="H4E192DE657B2435A9488469CE0ABE692"><enum>(B)</enum><text>by amending
			 subparagraph (B) to read as follows:</text>
					<quoted-block id="H36D8E75390774EF6BE7CF2EB61F7AD57" style="OLC">
						<subparagraph id="HC577558871D04AD1A2688EA93D483AEC"><enum>(B)</enum><text>whose parent or
				guardian was—</text>
							<clause id="H4E93B75FD61D40D3B2437E48348BD132"><enum>(i)</enum><text>a
				member of the Armed Forces of the United States and died as a result of
				performing military service in Iraq or Afghanistan after September 11, 2001;
				or</text>
							</clause><clause id="H77FA92B50A88474CA59DB76E3850E69E"><enum>(ii)</enum><text>was actively
				serving as a public safety officer and died in the line of duty while
				performing as a public safety officer;
				and</text>
							</clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H0C0DA71A89FD4B61AB2EAA80832053FC"><enum>(2)</enum><text>in paragraph
			 (3)—</text>
				<subparagraph id="H753761A113FB4B82B16132F777315D87"><enum>(A)</enum><text>by striking
			 <quote>Notwithstanding</quote> and inserting the following:</text>
					<quoted-block id="HC40DF4CB59734EA3B87B8FB664A56606" style="OLC">
						<subparagraph id="H5618763D73674104ACEA7E98FE88204A"><enum>(A)</enum><header>Armed
				forces</header><text>Notwithstanding</text>
						</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="H89F54B2A8BAB43B59793A322F1E9E92B"><enum>(B)</enum><text>by striking
			 <quote>paragraph (2)</quote> and inserting <quote>subparagraphs (A), (B)(i),
			 and (C) of paragraph (2)</quote>; and</text>
				</subparagraph><subparagraph id="H6BAC5F3328FB43649D9D27DAB6D6FD4C"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="H5D89600E2A3B4BDBA773587486C4C500" style="OLC">
						<subparagraph commented="no" id="H8808B2B122574A52AA92C895C6807CD9"><enum>(B)</enum><header>Public safety
				officers</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of law, unless the Secretary establishes an alternate method to
				adjust the expected family contribution, for each student who meets the
				requirements of subparagraphs (A), (B)(ii), and (C) of paragraph (2), a
				financial aid administrator shall—</text>
							<clause id="H17D3C5694380479D9E858D5D44E4AC1C"><enum>(i)</enum><text>verify with the
				student that the student is eligible for the adjustment;</text>
							</clause><clause id="H5D83469850B04A18A10B62197755D8F3"><enum>(ii)</enum><text>adjust the
				expected family contribution in accordance with this subsection; and</text>
							</clause><clause commented="no" id="H2426D900E67649EEB9C3F4F101A92A4D"><enum>(iii)</enum><text>notify the
				Secretary of the adjustment and the student’s eligibility for the
				adjustment.</text>
							</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H6BA2DEE676524B28BC89DE9B68C4C7A3"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block id="H8E469FAF45704329ACEC02000AEE474A" style="OLC">
					<paragraph id="H2B634D10022C41F18F377622EB576E08"><enum>(4)</enum><header>Treatment of
				Pell amount</header><text>Notwithstanding section 1212 of the Omnibus Crime
				Control and Safe Streets Act of 1968, in the case of a student who receives an
				increased Federal Pell Grant amount under this section, the total amount of
				such Federal Pell Grant, including the increase under this subsection, shall
				not be considered in calculating that student’s educational assistance benefits
				under the Public Safety Officer’s Benefits program.</text>
					</paragraph><paragraph id="H7043FE69878847B79A4633E6C3D853CD"><enum>(5)</enum><header>Definitions</header><text>For
				purposes of this subsection—</text>
						<subparagraph id="H5E6869A8DAAE40EFA46EC8A40E1293E2"><enum>(A)</enum><text>the term
				<quote>public safety officer</quote> means an individual serving a public
				agency in an official capacity, with or without compensation, as a law
				enforcement officer, as a firefighter, or as a member of a rescue squad or
				ambulance crew;</text>
						</subparagraph><subparagraph id="HC40B5245F394416B82B8371ED4C98DFE"><enum>(B)</enum><text>the term
				<quote>law enforcement officer</quote> means an individual who—</text>
							<clause id="H82580958585A4A67B278FCEC64099343"><enum>(i)</enum><text>is
				authorized by law to engage in or supervise the prevention, detection,
				investigation, or prosecution of, or the incarceration of any person for, any
				violation of law; and</text>
							</clause><clause id="HC9723CB33112437B98E99EB0EF55306B"><enum>(ii)</enum><text>has statutory
				powers of arrest or apprehension;</text>
							</clause></subparagraph><subparagraph id="H2E0AF0E57973420A9E685ABAD5C37FE3"><enum>(C)</enum><text>the term
				<quote>firefighter</quote> means an individual who is trained in the
				suppression of fire or hazardous-materials response and has the legal authority
				to engage in these duties;</text>
						</subparagraph><subparagraph id="H8A845F2A67604533BC23B1C7CD44D267"><enum>(D)</enum><text>the term
				<quote>member of a rescue squad or ambulance crew</quote> means an individual
				who is an officially recognized or designated public employee member of a
				rescue squad or ambulance crew; and</text>
						</subparagraph><subparagraph id="HD7BF839C582348E795F0DBF8F54C13CE"><enum>(E)</enum><text>the term
				<quote>public agency</quote> means the United States, any State of the United
				States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin
				Islands of the United States, Guam, American Samoa, the Trust Territory of the
				Pacific Islands, the Commonwealth of the Northern Mariana Islands, any
				territory or possession of the United States, or any unit of local government,
				department, agency, or instrumentality of any of the foregoing, and the Amtrak
				Police and Federal Reserve Police
				departments.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H9EC4869F7DC047A6B02BE13FDEA59AD6"><enum>3.</enum><header>Calculation of
			 Pell Grant amount</header><text display-inline="no-display-inline">Section
			 401(b)(2) of the Higher Education Act of 1965, as amended by the SAFRA Act
			 (<external-xref legal-doc="public-law" parsable-cite="pl/111/152">Public Law
			 111–152</external-xref>), is amended—</text>
			<paragraph id="H39CA4DE96017497EB8FA703F7B025065"><enum>(1)</enum><text>in subparagraph
			 (A), in the matter preceding clause (i), by striking <quote>The Amount</quote>
			 and inserting <quote>Subject to subparagraph (C), the amount</quote>;
			 and</text>
			</paragraph><paragraph id="H975FE0FB2FD14A94A7D21A8D12864E77"><enum>(2)</enum><text>by adding at the
			 end the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="H82B26F672D064A4AB606E05615911C85" style="OLC">
					<subparagraph commented="no" id="H466792F92E144FD1A09A1BE69F01A7F5"><enum>(C)</enum><text>In the case of a
				student who meet the requirements of subparagraphs (A), (B)(ii), and (C) of
				section 473(b)(2)—</text>
						<clause commented="no" id="H7782E94385B84D4F8C902DEC8B33D0C6"><enum>(i)</enum><text display-inline="yes-display-inline">clause (ii) of subparagraph (A) of this
				paragraph shall be applied by substituting <quote>from the amounts appropriated
				in the last enacted appropriation Act applicable to that award year, an amount
				equal to the amount of the increase calculated under paragraph (8)(B) for that
				year</quote> for <quote>the amount of the increase calculated under paragraph
				(8)(B) for that year</quote>; and</text>
						</clause><clause id="H741459D3AB894BE993C1DC6942A2C6AA"><enum>(ii)</enum><text>such
				student—</text>
							<subclause id="HAA60C240B97D4B4081F16AC4049C8A8A"><enum>(I)</enum><text display-inline="yes-display-inline">shall be provided an amount under clause
				(i) of this subparagraph only to the extent that funds are specifically
				provided in advance in an appropriation Act to such students for that award
				year; and</text>
							</subclause><subclause id="H3F204C7846D348BABD4B1AA7409F80DC"><enum>(II)</enum><text>shall not be
				eligible for the amounts made available pursuant to clauses (i) through (iii)
				of paragraph
				(8)(A).</text>
							</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HBB34AE54877C4ABD84876CCD14419574"><enum>4.</enum><header>Budgetary
			 effects</header><text display-inline="no-display-inline">The budgetary effects
			 of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act
			 of 2010, shall be determined by reference to the latest statement titled
			 <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted
			 for printing in the Congressional Record by the Chairman of the House Budget
			 Committee, provided that such statement has been submitted prior to the vote on
			 passage.</text>
		</section><section id="H94CC0F98FD8F4F1CAD49CED7C19309DB"><enum>5.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act, and the
			 amendments made by this Act, shall take effect on July 1, 2011.</text>
