		<official-title>To enhance citizen access to Government information and
		  services by establishing that Government documents issued to the public must be
		  written clearly, and for other purposes.</official-title>

		<section id="H76F474A7E2B241C99618AEFB019DF476" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Plain Language Act of
			 2009</short-title></quote>.</text>
		</section><section id="H3E7BE9922F3840358078D6619575706F"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to improve the
			 effectiveness and accountability of Federal agencies to the public by promoting
			 clear Government communication that the public can understand and use.</text>
		</section><section id="H29D9CC520C3C46F9BE9F5B84612899EC"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="HF36CAD341E5A4615B1227595341405CA"><enum>(1)</enum><header>Agency</header><text>The
			 term <term>agency</term> means an Executive agency, as defined under section
			 105 of title 5, United States Code.</text>
			</paragraph><paragraph id="HC09CC43FBE784895985436C3F31C504C"><enum>(2)</enum><header>Covered
			 document</header><text>The term <term>covered document</term> means any
			 document (other than a regulation) issued by an agency to the public, including
			 documents and other text released in electronic form.</text>
			</paragraph><paragraph id="H702B87DC64D9411F8B27004CDFD580CE"><enum>(3)</enum><header>Plain
			 language</header><text>The term <term>plain language</term> means language that
			 the intended audience can readily understand and use because that language is
			 clear, concise, well-organized, and follows other best practices of plain
			 language writing.</text>
			</paragraph></section><section id="HD636C14206BC4FAFB6576072164D7716"><enum>4.</enum><header>Responsibilities
			 of Federal agencies</header>
			<subsection id="H66EFEF1871C24CEFAAA6D322324D6D"><enum>(a)</enum><header>Requirement To use
			 plain language in new documents</header><text>Not later than 1 year after the
			 date of enactment of this Act, each agency shall use plain language in any
			 covered document of the agency issued or substantially revised.</text>
			</subsection><subsection id="H441FBE9A39CA4C9200C928CBE938C0D7"><enum>(b)</enum><header>Guidance</header>
				<paragraph id="H828315296D4D49BBA2DB2EA1493761D8"><enum>(1)</enum><header>In
			 general</header>
					<subparagraph id="H42576F2902294A45BD9FB18B471E20B0"><enum>(A)</enum><header>Development</header><text>Not
			 later than 6 months after the date of enactment of this Act, the Director of
			 the Office of Management and Budget shall develop guidance on implementing the
			 requirements of subsection (a).</text>
					</subparagraph><subparagraph id="H3FD28415D3BB47F29CAB22B3ED018621"><enum>(B)</enum><header>Issuance</header><text>The
			 Director of the Office of Management and Budget shall issue the guidance
			 developed under subparagraph (A) to agencies as a circular.</text>
					</subparagraph></paragraph><paragraph id="H98A7E3C731F54204A1ED569C5000C6ED"><enum>(2)</enum><header>Interim
			 guidance</header><text>Before the issuance of guidance under paragraph (1),
			 agencies may follow the guidance of—</text>
					<subparagraph id="H62EE52EBC11F49289DC1430EB6F1712"><enum>(A)</enum><text>the writing
			 guidelines developed by the Plain Language Action and Information Network;
			 or</text>
					</subparagraph><subparagraph id="HBD9397BE75A64AD7AD81C055C002722"><enum>(B)</enum><text>guidance provided
			 by the head of the agency that is consistent with the guidelines referred to
			 under subparagraph (A).</text>
					</subparagraph></paragraph></subsection></section><section id="H73CE6745330A4F48A6C411269D200088"><enum>5.</enum><header>Reports to
			 Congress</header>
			<subsection id="HE55EF5BDB99648F29D957324D7E2442F"><enum>(a)</enum><header>Initial
			 report</header><text>Not later than 6 months after the date of enactment of
			 this Act, the head of each agency shall submit to the Committee on Homeland
			 Security and Governmental Affairs of the Senate and the Committee on Oversight
			 and Government Reform of the House of Representatives a report that describes
			 how the agency intends to meet the following objectives:</text>
				<paragraph id="HF366CF4469C446FCB8BBAF8FA25F1308"><enum>(1)</enum><text>Communicating the
			 requirements of this Act to agency employees.</text>
				</paragraph><paragraph id="HC57A6AD23817487E0008D5F3E4372B3D"><enum>(2)</enum><text>Training agency
			 employees to write in plain language.</text>
				</paragraph><paragraph id="H9F238A8C5B3D4FE8B63B12144B322594"><enum>(3)</enum><text>Meeting the
			 requirement under section 4(a).</text>
				</paragraph><paragraph id="HA87C94FEDED345299C8F64F482F5F2AB"><enum>(4)</enum><text>Ensuring ongoing
			 compliance with the requirements of this Act.</text>
				</paragraph><paragraph id="H0BE91BC64EF3445B9F8D00AB71B13194"><enum>(5)</enum><text>Designating a
			 senior official to be responsible for implementing the requirements of this
			 Act.</text>
				</paragraph><paragraph id="H45947C812EA745AD92D7F8B697F000A2"><enum>(6)</enum><text>Using, to the
			 extent practicable and appropriate, plain language in regulations promulgated
			 by the agency.</text>
				</paragraph></subsection><subsection id="HF61947007D0E43CDBED8146BC2C15FCD"><enum>(b)</enum><header>Annual and other
			 reports</header>
				<paragraph id="H20424B26D1A542EF8DE66356834D5EF7"><enum>(1)</enum><header>Agency
			 reports</header>
					<subparagraph id="H8508E4346139444B9D4CB2345E2DCDF8"><enum>(A)</enum><header>In
			 general</header><text>The head of each agency shall submit reports on
			 compliance with this Act to the Office of Management and Budget.</text>
					</subparagraph><subparagraph id="HF56C40FC30BE41FBA3AAAC28B6FFEC34"><enum>(B)</enum><header>Submission
			 dates</header><text>The Office of Management and Budget shall notify each
			 agency of the date each report under subparagraph (A) is required for
			 submission to enable the Office of Management and Budget to meet the
			 requirements of paragraph (2).</text>
					</subparagraph></paragraph><paragraph id="HA2F71030DB374ADA8BBD8D02AB14B6A6"><enum>(2)</enum><header>Reports to
			 congress</header><text>The Director of the Office of Management and Budget
			 shall review agency reports submitted under paragraph (1) using the guidance
			 issued under section 4(b)(1)(B) and submit a report on the progress of agencies
			 to the Committee on Homeland Security and Governmental Affairs of the Senate
			 and the Committee on Oversight and Government Reform of Representatives—</text>
					<subparagraph id="HFE383511A95F484E8946F2F488B1EF72"><enum>(A)</enum><text>annually for the
			 first 2 years after the date of enactment of this Act; and</text>
					</subparagraph><subparagraph id="H2641EF5D703E481EAE7922FAC76EE038"><enum>(B)</enum><text>once every 3 years
			 thereafter.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
