<legis-type>AN ACT</legis-type> 
<official-title display="yes">To enhance citizen access to Government information and services by establishing that Government documents issued to the public must be written clearly, and for other purposes.</official-title>

<section id="H3338965036964674AAF0326BEC1574CA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Plain Writing Act of 2010</short-title></quote>.</text></section> 
<section id="HE07B3A7177C3455A80D207377B19AADA"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to improve the effectiveness and accountability of Federal agencies to the public by promoting clear Government communication that the public can understand and use.</text></section> 
<section id="H3E26DFE598D64938957A6A8E0E58D17A"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HF3E982A2C0894C67A42FFD61D0749AFB"><enum>(1)</enum><header>Agency</header><text>The term <quote>agency</quote> means an Executive agency, as defined under section 105 of title 5, United States Code.</text></paragraph> 
<paragraph id="HD25A67631C2145BC8A00FACA0D4BF47B"><enum>(2)</enum><header>Covered document</header><text>The term <quote>covered document</quote>—</text> 
<subparagraph id="HB066542CA7F44B8F8EF1E0CC1947ED15"><enum>(A)</enum><text>means any document that—</text> 
<clause id="H33DD90CE979E44F8A4C78F9A549E56AD"><enum>(i)</enum><text>is necessary for obtaining any Federal Government benefit or service or filing taxes; </text></clause> 
<clause id="H21004AD3D4DF49D381CCE6422B83A391"><enum>(ii)</enum><text>provides information about any Federal Government benefit or service; or</text></clause> 
<clause id="HE8253F80A15C4B6698BB08878C26D14C"><enum>(iii)</enum><text>explains to the public how to comply with a requirement the Federal Government administers or enforces;</text></clause></subparagraph> 
<subparagraph id="H695CD549380441299ECFCCC61F767800"><enum>(B)</enum><text>includes (whether in paper or electronic form) a letter, publication, form, notice, or instruction; and</text></subparagraph> 
<subparagraph id="H4E38896F067548F58C59B37ECA88C933"><enum>(C)</enum><text>does not include a regulation.</text></subparagraph></paragraph>
<paragraph id="HC83E7BA5E0ED4573B94B1D372CAE4962" display-inline="no-display-inline"><enum>(3)</enum><header>Plain writing</header><text>The term <quote>plain writing</quote> means writing that is clear, concise, well-organized, and follows other best practices appropriate to the subject or field and intended audience.</text> </paragraph> </section> 
<section id="H764E07283F024C688707A2B0404C8872"><enum>4.</enum><header>Responsibilities of Federal agencies</header> 
<subsection id="HDF68359A069D41579305F76F3A94AD96"><enum>(a)</enum><header>Preparation for Implementation of Plain Writing Requirements</header> 
<paragraph id="H77E8C217546A4816B500449500DA8C9C"><enum>(1)</enum><header>In general</header><text>Not later than 9 months after the date of enactment of this Act, the head of each agency shall—</text> 
<subparagraph id="H3C5BDB05C6B4489884A529A487BDF322"><enum>(A)</enum><text>designate 1 or more senior officials within the agency to oversee the agency implementation of this Act;</text></subparagraph> 
<subparagraph id="H3DC7C8FB66594B008CB9781ACE067999"><enum>(B)</enum><text>communicate the requirements of this Act to the employees of the agency;</text></subparagraph> 
<subparagraph id="HA1E559FDAF364F4383100BD9CB2B8C5A"><enum>(C)</enum><text>train employees of the agency in plain writing;</text></subparagraph> 
<subparagraph id="H5075A68D77CE4032B35C37C6CFBEA968"><enum>(D)</enum><text>establish a process for overseeing the ongoing compliance of the agency with the requirements of this Act;</text></subparagraph> 
<subparagraph id="HC5FCFA5ECB544F30A7E742435C45AA97"><enum>(E)</enum><text display-inline="yes-display-inline">create and maintain a plain writing section of the agency’s website as required under paragraph (2) that is accessible from the homepage of the agency’s website; and</text></subparagraph> 
<subparagraph id="H890773D55AA443B0B5C06A74472177B6"><enum>(F)</enum><text>designate 1 or more agency points-of-contact to receive and respond to public input on—</text> 
<clause id="H0A1DA14E6AC148FAA42515C7A7BFB851"><enum>(i)</enum><text>agency implementation of this Act; and</text></clause> 
<clause id="H4ECD015039EA4F3886D9520DAAD35F42"><enum>(ii)</enum><text>the agency reports required under section 5.</text></clause></subparagraph></paragraph> 
<paragraph id="HEF64C0ED8246449398D779282614DC0F"><enum>(2)</enum><header>Website</header><text>The plain writing section described under paragraph (1)(E) shall—</text> 
<subparagraph id="H578411CE846445C39226D0CB400C6544"><enum>(A)</enum><text>inform the public of agency compliance with the requirements of this Act; and</text></subparagraph> 
<subparagraph id="H6F4B6EBD3A2F452F95051B4D178395A2"><enum>(B)</enum><text>provide a mechanism for the agency to receive and respond to public input on—</text> 
<clause id="HE00E52700C3749A5A492BD3B5B9F0F9A"><enum>(i)</enum><text>agency implementation of this Act; and</text></clause> 
<clause id="HA7E3A9F41A55493FA589860E33E41DFA"><enum>(ii)</enum><text>the agency reports required under section 5.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H822B01A3DC6D46FF8D55E2981326BEBB"><enum>(b)</enum><header>Requirement to use plain writing in new documents</header><text>Beginning not later than 1 year after the date of enactment of this Act, each agency shall use plain writing in every covered document of the agency that the agency issues or substantially revises.</text></subsection> 
<subsection id="H000972B67B0D4AC78899D8A7096A525B"><enum>(c)</enum><header>Guidance</header> 
<paragraph id="H84CA8E781624442FAAC077227E2879F1"><enum>(1)</enum><header>In general</header><text>Not later than 6 months after the date of enactment of this Act, the Director of the Office of Management and Budget shall develop and issue guidance on implementing the requirements of this section. The Director may designate a lead agency, and may use interagency working groups to assist in developing and issuing the guidance.</text></paragraph> 
<paragraph id="H285BB8E18C794537BECB47C61245BC57"><enum>(2)</enum><header>Interim guidance</header><text>Before the issuance of guidance under paragraph (1), agencies may follow the guidance of—</text> 
<subparagraph id="HAD18438DEC904861AA4A6C2C78DD7DC9"><enum>(A)</enum><text>the writing guidelines developed by the Plain Language Action and Information Network; or</text></subparagraph> 
<subparagraph id="H65973008C53342018A5F3A6BA2039D0D"><enum>(B)</enum><text>guidance provided by the head of the agency that is consistent with the guidelines referred to in subparagraph (A).</text></subparagraph></paragraph></subsection></section> 
<section id="H5C8278D26E404AD391BF6C1D9B22A318"><enum>5.</enum><header>Reports to Congress</header> 
<subsection id="H91BC86D5D9D6490EAEDB53EC544BE932"><enum>(a)</enum><header>Initial report</header><text>Not later than 9 months after the date of enactment of this Act, the head of each agency shall publish on the plain writing section of the agency’s website a report that describes the agency plan for compliance with the requirements of this Act.</text></subsection> 
<subsection id="HC74DE5A1F7304186964D7532488DF99A"><enum>(b)</enum><header>Annual compliance report</header><text>Not later than 18 months after the date of enactment of this Act, and annually thereafter, the head of each agency shall publish on the plain writing section of the agency’s website a report on agency compliance with the requirements of this Act.</text></subsection></section> 
<section id="H8392E60CEB094E11B34F7B8325F648DE" commented="no"><enum>6.</enum><header>Judicial review and enforceability</header> 
<subsection id="H173966FDE58646BAB8827755D5A9DA59" commented="no"><enum>(a)</enum><header>Judicial review</header><text>There shall be no judicial review of compliance or noncompliance with any provision of this Act.</text></subsection> 
<subsection id="H571ED4BCA924474B8AAAA87E2F614EA8" commented="no"><enum>(b)</enum><header>Enforceability</header><text>No provision of this Act shall be construed to create any right or benefit, substantive or procedural, enforceable by any administrative or judicial action.</text></subsection></section> 
<section id="H49A5CEA6231242CBBC2EE7885CB77009"><enum>7.</enum><header>Budgetary effects of PAYGO legislation for this Act</header><text display-inline="no-display-inline"> The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></section>
