		<official-title>To amend the Immigration and Nationality Act to permit
		  certain Mexican children, and accompanying adults, to obtain a waiver of the
		  documentation requirements otherwise required to enter the United States as a
		  temporary visitor.</official-title>

		<section display-inline="no-display-inline" id="HAA13DAB3710049A88545AD4B7D9C3C4E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Visitors Interested in Strengthening
			 America (VISA) Act of 2009</short-title></quote>.</text>
		</section><section id="HE9A75D5D674A48ACB791517B5C27B1BE"><enum>2.</enum><header>Waiver of
			 documentary requirements for certain nonimmigrant children and accompanying
			 adults</header><text display-inline="no-display-inline">Section 212(d)(4) of
			 the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (8
			 U.S.C. 1182(d)(4)) is amended—</text>
			<paragraph id="H3D7216FD47524AFB971547D700077802"><enum>(1)</enum><text>by striking
			 <quote>(4)</quote> and inserting <quote>(4)(A)</quote>;</text>
			</paragraph><paragraph id="H0294A993614B42D991F671CF01894952"><enum>(2)</enum><text>by redesignating
			 subparagraphs (A), (B), and (C) as clauses (i), (ii), and (iii), respectively;
			 and</text>
			</paragraph><paragraph id="H64A278FBD93A4DC0B72B9C317100CF56"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block id="HF98F96BBE6C349D391BDFC869143CB3E">
					<subparagraph id="H3F4D6473BFD84E548899ABE6CB3E177" indent="up2"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="HDAA15FA8B66B485DB81D37F15BEC9881"><enum>(i)</enum><text>Upon application by an
				alien who is citizen or national of Mexico, and who is applying for admission
				as a visitor under section 101(a)(15)(B) from Mexico, the Department of
				Homeland Security official in charge at a port of entry may, in the exercise of
				his or her discretion, on a case-by-case basis, waive either or both of the
				documentary requirements of section 212(a)(7)(B)(i), if satisfied that the
				alien is in possession of proper identification, as provided under clause (ii),
				and—</text>
							<subclause id="HAED35DC03C6C419EA21C0079EBB8939C" indent="up1"><enum>(I)</enum><text>is a child coming for a regular
				medical appointment (as evidenced by proof such as a letter from the medical
				professional concerned), or is the parent (or other adult chaperone)
				accompanying such a child, except that the number of adults admitted under this
				subclause shall not exceed one per child;</text>
							</subclause><subclause id="H15DE4CA8C2CD4DBD88BB79E75F6FF32E" indent="up1"><enum>(II)</enum><text>is a child coming with a student
				group to participate in an educational or cultural event (such as an athletic
				or academic event, a concert or other artistic performance, or a visit to a
				recreational, touristic, or historical site) for not more than 1 day (as
				evidenced by proof such as a letter of invitation issued to the group), or is
				an adult chaperone, such as a teacher, coach, or parent, accompanying such a
				group, except that the number of chaperones admitted under this subclause shall
				not exceed that sufficient to supervise the group involved; or</text>
							</subclause><subclause id="HE2457E08E5824E9293994CE5609837EB" indent="up1"><enum>(III)</enum><text>is a child coming to participate in
				a special community event that traditionally has been attended by individuals
				from both sides of the border (as evidenced by proof such as a public letter of
				invitation issued by the community concerned), or is a parent or other adult
				relative accompanying such a child.</text>
							</subclause></clause><clause id="HBA61D0EE35764913002D00287CC55324" indent="up1"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H2179BFA2E22B4DE3ABDC85A6439C777C"><enum>(I)</enum><text>For purposes of this
				subparagraph, in the case of a child, proper identification shall include a
				passport, birth certificate, or other proof of citizenship or
				nationality.</text>
							</subclause><subclause id="H2C9E3C6C21954932BB25B7E5EFD58BD3" indent="up1"><enum>(II)</enum><text>In the case of an adult, proper
				identification shall include a passport, birth certificate, or other proof of
				citizenship or nationality, and a government-issued driver’s license, or
				similar document issued for the purpose of identification, that contains
				personal identifying information and a photograph.</text>
							</subclause></clause><clause id="H361E160966C045C7A04C5CC3B592E32D" indent="up1"><enum>(iii)</enum><text>For purposes of this
				subparagraph—</text>
							<subclause id="H0AA832563D194815B5EEA0EF1D7E4FE7"><enum>(I)</enum><text>the term <term>child</term> means an
				unmarried person under 16 years of age; and</text>
							</subclause><subclause id="HE0FE03F0E4AE4931849E1BC1309080E5"><enum>(II)</enum><text>the term <term>adult</term> means any
				person who is not a
				child.</text>
