title</header><text display-inline="no-display-inline">This title may be cited
as the <quote><short-title>Mississippi Delta National
Heritage Area Act of 2009</short-title></quote>.</text>
</section><section id="H38A8CB3C056440809DE9D6968693057"><enum>102.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
<paragraph id="H76417BA226D7436EA8CB539784BFB1DF"><enum>(1)</enum><text>the historic,
cultural, and natural heritage legacies of the Mississippi Delta are—</text>
<subparagraph id="H70033CF489AC4634AC008B37EADFA6D"><enum>(A)</enum><text>nationally
significant; and</text>
</subparagraph><subparagraph id="HA3C7A095D76144079C6D2315324FDEC6"><enum>(B)</enum><text>in need of greater
recognition;</text>
</subparagraph></paragraph><paragraph id="H2E62B75C7BA34F4AA443109E655D21F3"><enum>(2)</enum><text>in the alluvial
floodplain that comprises the Mississippi Delta there are a variety of diverse
heritage resources that demonstrate—</text>
<subparagraph id="HFEEFCCD510AA44CCB0A8509BA3599B32"><enum>(A)</enum><text>the labors and
social activities of the earliest citizens of the United States, which are
revealed in—</text>
<clause id="H116393CCBC764D80BFDA224876D33C46"><enum>(i)</enum><text>numerous
residential and ceremonial mound sites; and</text>
</clause><clause id="HB27575E3339F4412A656963B83379DDD"><enum>(ii)</enum><text>sites significant
to the Quapaw, Tunica, Choctaw, and Chickasaw people and other Native
Americans;</text>
</clause></subparagraph><subparagraph id="HF25D4C8C5F364AD3A405519993CCBD57"><enum>(B)</enum><text>the clearing and
settlement of one of the last wilderness frontiers in the 48 contiguous
States;</text>
</subparagraph><subparagraph id="HB0A7501F1ED74141866637D3CCEEB99"><enum>(C)</enum><text>the immigration of
people of African, Asian, and European descent to the United States;</text>
</subparagraph><subparagraph id="H968E72BDEF724004B89B76F4733CF6B7"><enum>(D)</enum><text>the labors and
social activities of enslaved Africans who provided the bulk of the early labor
force for the development of—</text>
<clause id="HC28D6A9820E6409F8018A400F2C99661"><enum>(i)</enum><text>large-scale
plantation agriculture based on cotton, which is one of the most important
commodities ever produced in the United States; and</text>
</clause><clause id="H17A77FB9AF964EBA947524DECF00AF76"><enum>(ii)</enum><text>the
birth and subsequent perfection of the art form that is known as the
<quote>Mississippi Delta Blues</quote>;</text>
</clause></subparagraph><subparagraph id="H73A9E61C5A4A413100D5AB3672EFB9DF"><enum>(E)</enum><text>the role of the
Mississippi River as—</text>
<clause id="H39ED5491D81449629D1FC76B1E58F83C"><enum>(i)</enum><text>the
architect and sometimes unmerciful tyrant of land; and</text>
</clause><clause id="H4ABFDE36435A4AAB8EB211C24DF8E4D5"><enum>(ii)</enum><text>an
important transportation artery throughout the history of the United
States;</text>
</clause></subparagraph><subparagraph id="H3528D6199CB845CCA004FA4FE15DFF5E"><enum>(F)</enum><text>the story of the
Great Flood of 1927, which was a defining event in the history of the United
States;</text>
</subparagraph><subparagraph id="H64352933802E42E095714693D2D71BBE"><enum>(G)</enum><text>the struggles and
triumphs of the Civil Rights Movement; and</text>
</subparagraph><subparagraph id="HB301055D3F3D43F997E448CB59ECE3DB"><enum>(H)</enum><text>the emergence of
many local leaders from the Civil Rights Movement;</text>
</subparagraph></paragraph><paragraph id="H27AFEFC9F0664593A93C975840EA23F"><enum>(3)</enum><text>the Mississippi
Delta is the ancestral home of hundreds of thousands of people of the United
States who—</text>
<subparagraph id="H9CE46D13A798446B881D00DCCCE100F0"><enum>(A)</enum><text>migrated north,
east, and west during the Great Migration seeking employment and freedom and
populating the cities of the United States in the process;</text>
</subparagraph><subparagraph id="H9448682413304699AA3D5E3615B14CDF"><enum>(B)</enum><text>struggled for
equal rights and equal opportunities; and</text>
</subparagraph><subparagraph id="HC502C9A5B3234A4D98697807901C0600"><enum>(C)</enum><text>carried their
culture, including their family life, faith, food, lifestyle, and music to the
rest of the United States, which transformed the United States in the
process;</text>
</subparagraph></paragraph><paragraph id="H8944FAA0BDCF462F9FA290360000F1B7"><enum>(4)</enum><text>the scenic and
natural beauty of the alluvial floodplain known as the <quote>Yazoo-Mississippi
Delta</quote>—</text>
<subparagraph id="H5658D9A2825F4050A926FD925D06AA3C"><enum>(A)</enum><text>is distinctive and
integral to the heritage stories of the region; and</text>
</subparagraph><subparagraph id="HF7225A40BBF74A6A91247E94435248A3"><enum>(B)</enum><text>provides critical
habitat for migrating birds passing through the Mississippi Flyway;</text>
</subparagraph></paragraph><paragraph id="HCC1B92ED37BA4989ABF7557EF0796428"><enum>(5)</enum><text>the agricultural
heritage of the Delta, especially with regards to the cultivation of cotton,
soybeans, rice, and catfish has contributed significantly to the story and
economy of the United States;</text>
</paragraph><paragraph id="HB84A031DD705462AAEFF94EC45FF9DD6"><enum>(6)</enum><text>many of the
greatest leaders of the United States in literature, music, civil rights,
politics, culinary arts, poetry, society, and religion have come from the
Mississippi Delta;</text>
</paragraph><paragraph id="HD0BA55DF01B748A98E49041F9B00AD2E"><enum>(7)</enum><text>the small towns,
inns, shops, restaurants, artist’s workshops, blues clubs, churches, landscape,
and vernacular architecture make the Mississippi Delta unique;</text>
</paragraph><paragraph id="H32B019E9C51F418D9369E2BAA48C86F2"><enum>(8)</enum><text>the Mississippi
Delta is known internationally as the birthplace of the musical form known as
the <quote>Blues</quote>, which provided the basis for much of modern popular
music; and</text>
</paragraph><paragraph id="H1BDC898D8151476B8C8E121151D7B329"><enum>(9)</enum><text>there is broad
support from local governments and other interested individuals for the
establishment of the Mississippi Delta National Heritage Area to coordinate and
assist in the preservation and interpretation of the resources of the
region.</text>
</paragraph></section><section id="HB1FCFB9F183E4D59821BA7D1D648F466"><enum>103.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
<paragraph id="HFC8C96C1F0CB4AE3953650F14E5CC262"><enum>(1)</enum><header>Board</header><text>The
term <term>Board</term> means the Board of Directors of the coordinating entity
established under this title.</text>
</paragraph><paragraph id="H3F3BE20D4F8F4BF0A4BA37A375517F40"><enum>(2)</enum><header>Heritage
area</header><text>The term <term>Heritage Area</term> means the Mississippi
Delta National Heritage Area established by this title.</text>
</paragraph><paragraph id="HD9698C0D71E3469D87C300B682D25414"><enum>(3)</enum><header>Coordinating
entity</header><text>The term <term>coordinating entity</term> means the
coordinating entity for the Heritage Area designated by this title.</text>
</paragraph><paragraph id="HE942423239AF4E23914700CF27050075"><enum>(4)</enum><header>Management
plan</header><text>The term <term>management plan</term> means the management
plan for the Heritage Area developed under this title.</text>
</paragraph><paragraph id="H07856CD94FCA499DA357EB632FF9288"><enum>(5)</enum><header>Secretary</header><text>The
term <term>Secretary</term> means the Secretary of the Interior.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB48BDE1201A64A77B29C0070FCFE3854"><enum>(6)</enum><header>State</header><text>The
term <term>State</term> means the State of Mississippi.</text>
</paragraph></section><section id="H049385DF04694B66A3B35B009DA86861"><enum>104.</enum><header>Mississippi
Delta National Heritage Area</header>
<subsection id="H2D1C4C31A4B046EE8DA5633C9C6950B2"><enum>(a)</enum><header>Establishment</header><text>There
is established in the State the Mississippi Delta National Heritage
Area.</text>
</subsection><subsection id="H19AE773DF12742D5BCE414048428231D"><enum>(b)</enum><header>Boundaries</header><text>The
Heritage Area shall include all counties in the State that contain land located
in the alluvial floodplain of the Mississippi Delta, including Bolivar,
Carroll, Coahoma, Desoto, Holmes, Humphreys, Issaquena, Leflore, Panola,
Quitman, Sharkey, Sunflower, Tallahatchie, Tate, Tunica, Warren, Washington,
and Yazoo Counties in the State.</text>
</subsection><subsection id="HF9A02FF918EC481DBAD07BC74D17E375"><enum>(c)</enum><header>Map</header>
<paragraph id="H7633A879B3CD4C949092C3A0E21D2905"><enum>(1)</enum><header>In
general</header><text>As soon as practicable after the date of enactment of
this title, the Secretary shall prepare a map of the Heritage Area.</text>
</paragraph><paragraph id="H8697C89E44FF4822A8B9778065DA7D54"><enum>(2)</enum><header>Availability</header><text>The
map prepared under paragraph (1) shall be on file and available for public
inspection in the office of the Director of the National Park Service.</text>
</paragraph></subsection></section><section id="HA602658C9F39484281B26965C0900034"><enum>105.</enum><header>Designation of
partnership as coordinating entity</header>
<subsection id="HD6A4026AB3B945B2A24F5EEC00E5A7D9"><enum>(a)</enum><header>In
general</header><text>The Mississippi Delta National Heritage Area Partnership
shall be the coordinating entity for the Heritage Area.</text>
</subsection><subsection id="HBD0812938C824F90A24D7CEFFA46C7EA"><enum>(b)</enum><header>Board of
Directors</header>
<paragraph id="H7515D868D2444BD7BD1D9B1CDD444FDD"><enum>(1)</enum><header>Composition</header>
<subparagraph id="HF621D10CC4F94F278EB773F1AD001953"><enum>(A)</enum><header>Partnership</header><text display-inline="yes-display-inline">The coordinating entity shall be governed
by a Board of Directors composed of 7 members, of whom—</text>
<clause id="HBCE9C89088194849BB847DC8EF6033B9"><enum>(i)</enum><text display-inline="yes-display-inline">1 member shall be appointed by Mississippi
Valley State University;</text>
</clause><clause id="HCE7E9F64ED3F4C299C092957E517DBCC"><enum>(ii)</enum><text display-inline="yes-display-inline">1 member shall be appointed by Delta State
University;</text>
</clause><clause id="H90D8DF92DEAC48FFB4B8025F0978C06E"><enum>(iii)</enum><text display-inline="yes-display-inline">1 member shall be appointed by Alcorn State
University;</text>
</clause><clause id="HC73E9D864BA44903B21F66337D009672"><enum>(iv)</enum><text display-inline="yes-display-inline">1 member shall be appointed by the Delta
Foundation;</text>
</clause><clause id="H18C813AB4F754370B11C44BB2384E86B"><enum>(v)</enum><text display-inline="yes-display-inline">1 member shall be appointed by Delta
Council;</text>
</clause><clause id="H15F29802E6EF42E88BF9CCAE8E7ED2BC"><enum>(vi)</enum><text display-inline="yes-display-inline">1 member shall be appointed by the
Mississippi Office of Tourism Development; and</text>
</clause><clause id="H67951E2B044144DDB91608C407698F00"><enum>(vii)</enum><text display-inline="yes-display-inline">1 member shall be appointed by the Smith
Robertson Museum.</text>
</clause></subparagraph><subparagraph id="H45C6E99E302E4C31AC96572C1F2EC219"><enum>(B)</enum><header>Residency
requirements</header><text>At least 4 members of the Board shall reside in the
Heritage Area.</text>
</subparagraph></paragraph><paragraph id="H0C0F36C401344C159DD48F6B61300536"><enum>(2)</enum><header>Officers</header>
<subparagraph id="HF18687D2CCD64C77BAE1CF4FC8F6EC13"><enum>(A)</enum><header>In
general</header><text>At the initial meeting of the Board, the members of the
Board shall appoint a Chairperson, Vice Chairperson, and
Secretary/Treasurer.</text>
</subparagraph><subparagraph id="H3127CE2A4E8B4FF3B56ED47E5DA0D6CF"><enum>(B)</enum><header>Duties</header>
<clause id="H2F622B7BAD8E45C195004719A6D0945E"><enum>(i)</enum><header>Chairperson</header><text>The
duties of the Chairperson shall include—</text>
<subclause id="HD14E171CF03349C5B218266E5CC0928F"><enum>(I)</enum><text>presiding over
meetings of the Board;</text>
</subclause><subclause id="H9A2E470572BD43B3967FE1FA87DBE3FF"><enum>(II)</enum><text>executing
documents of the Board; and</text>
</subclause><subclause id="HD23BC1557ED44569B050482941B7E47"><enum>(III)</enum><text>coordinating
activities of the Heritage Area with Federal, State, local, and nongovernmental
officials.</text>
</subclause></clause><clause id="H030C8E64E9094F958697BD417458FEB7"><enum>(ii)</enum><header>Vice
Chairperson</header><text>The Vice Chairperson shall act as Chairperson in the
absence or disability of the Chairperson.</text>
</clause></subparagraph></paragraph><paragraph id="HC91EB864253D4152AD5CC70484106CED"><enum>(3)</enum><header>Management
authority</header>
<subparagraph id="HDC4B1A23224242FE82C81042593392A0"><enum>(A)</enum><header>In
general</header><text>The Board shall—</text>
<clause id="H37CD251DB50045E2B31F1B8B573FC933"><enum>(i)</enum><text>exercise all
corporate powers of the coordinating entity;</text>
</clause><clause id="H69B7A6E8DFBD434E8DFD6920AF08E980"><enum>(ii)</enum><text>manage the
activities and affairs of the coordinating entity; and</text>
</clause><clause id="HC9383238D9B342CC8B5CF74D8022E6AA"><enum>(iii)</enum><text>subject to any
limitations in the articles and bylaws of the coordinating entity, this title,
and any other applicable Federal or State law, establish the policies of the
coordinating entity.</text>
</clause></subparagraph><subparagraph id="HEE4A5F9CBECB4B7293FC029BD6D9BE86"><enum>(B)</enum><header>Staff</header><text>The
Board shall have the authority to employ any services and staff that are
determined to be necessary by a majority vote of the Board.</text>
</subparagraph></paragraph><paragraph id="H81009BD8A97742EEAD1B7DA1B4067510"><enum>(4)</enum><header>Bylaws</header>
<subparagraph id="HBBCED2192FAB4F3A9B96D691E3F568A9"><enum>(A)</enum><header>In
general</header><text>The Board may amend or repeal the bylaws of the
coordinating entity at any meeting of the Board by a majority vote of the
Board.</text>
</subparagraph><subparagraph id="H21136EFB03C54CFBA82E028B6631E0D"><enum>(B)</enum><header>Notice</header><text>The
Board shall provide notice of any meeting of the Board at which an amendment to
the bylaws is to be considered that includes the text or a summary of the
proposed amendment.</text>
</subparagraph></paragraph><paragraph id="HF2C1E11C544E4A0DA13249F9A53D1953"><enum>(5)</enum><header>Minutes</header><text>Not
later than 60 days after a meeting of the Board, the Board shall distribute the
minutes of the meeting among all Board members and the county supervisors in
each county within the Heritage Area.</text>
</paragraph></subsection></section><section id="HD0F3CC509AF5439DB4BAA9C86C061414"><enum>106.</enum><header>Authorities and
duties of coordinating entity</header>
<subsection id="H4C6202CE24FF498A972FB4048F460679"><enum>(a)</enum><header>Authorities</header><text>For
purposes of developing and implementing the management plan and otherwise
carrying out this title, the coordinating entity may make grants and provide
technical assistance to tribal and local governments and other public and
private entities.</text>
</subsection><subsection id="H0C561ABAE98D4FE3876DEE2738FF0017"><enum>(b)</enum><header>Duties</header><text>In
carrying out this title, the coordinating entity shall—</text>
<paragraph id="HBE11B5FD405D4F26B2006112CC3708C2"><enum>(1)</enum><text>implement the
management plan;</text>
</paragraph><paragraph id="HD742912100FC42B087C31E309F187858"><enum>(2)</enum><text>assist local and
tribal governments and nonprofit organizations in—</text>
<subparagraph id="HEF8207DA8BE84A559702E15ED0F964F2"><enum>(A)</enum><text>establishing and
maintaining interpretive exhibits in the Heritage Area;</text>
</subparagraph><subparagraph id="H59CFE1315739408096CFB830C272B8D8"><enum>(B)</enum><text>developing
recreational resources in the Heritage Area;</text>
</subparagraph><subparagraph id="H5AA5DD5D82F049F89BAC16B7BF1DE8DF"><enum>(C)</enum><text>increasing public
awareness of, and appreciation for, the Heritage Area;</text>
</subparagraph><subparagraph id="H494203A6C99C4EE8A37E7BE7F582D04"><enum>(D)</enum><text>restoring historic
structures that relate to the Heritage Area; and</text>
</subparagraph><subparagraph id="H1160A286C58C4DDFA15554D425EA31F5"><enum>(E)</enum><text>carrying out any
other activity that the coordinating entity determines to be appropriate to
carry out this title, consistent with the management plan;</text>
</subparagraph></paragraph><paragraph id="HF62CE9280B7B451091E2BC97ADE8672"><enum>(3)</enum><text>conduct public
meetings at least annually regarding the implementation of the management plan;
and</text>
</paragraph><paragraph id="HEA0B572170A740B5A7BF5B669C8C4F05"><enum>(4)</enum><text>for any fiscal
year for which Federal funds are made available for the Heritage Area—</text>
<subparagraph id="HFD8285C336BD4D18B6D900782F8D681D"><enum>(A)</enum><text>submit to the
Secretary a report that describes, for the fiscal year, the actions of the
coordinating entity in carrying out this title;</text>
</subparagraph><subparagraph id="HE61F43D5BBA3433D9C829836998F914E"><enum>(B)</enum><text>make available to
the Secretary for audit all records relating to the expenditure of funds by any
matching funds; and</text>
</subparagraph><subparagraph id="HD3D7C7565EB64974AF0088DB00F47195"><enum>(C)</enum><text>require, for all
agreements authorizing the expenditure of Federal funds by any entity, that the
receiving entity make available to the Secretary for audit all records relating
to the expenditure of the funds.</text>
</subparagraph></paragraph></subsection><subsection id="HBD3133352E7B4F0CB5A93EC6823F06B4"><enum>(c)</enum><header>Prohibition of
acquisition of real property</header><text>The coordinating entity shall not
use any Federal funds made available under this title to acquire real property
or any interest in real property.</text>
</subsection></section><section id="H78972B3160784388948F3E3EDA9915F7"><enum>107.</enum><header>Management
plan</header>
<subsection id="H124FE5E1F9374025B8D7FEE75C3930E2"><enum>(a)</enum><header>In
general</header><text>Not later than 3 years after the date of enactment of
this title, the coordinating entity shall develop and submit to the Secretary a
management plan for the Heritage Area.</text>
</subsection><subsection id="H2521FB2D90184038B1CCE982701C7890"><enum>(b)</enum><header>Requirements</header><text>The
management plan shall—</text>
<paragraph id="H6ACF6D839F1E4790A2B9C93D428700F3"><enum>(1)</enum><text>provide
recommendations for the conservation, funding, management, interpretation, and
development of the cultural, historical, archaeological, natural, and
recreational resources of the Heritage Area;</text>
</paragraph><paragraph id="H9CF8A0D9D6DA4D59B006039F5837E65F"><enum>(2)</enum><text>identify sources
of funding for the Heritage Area;</text>
</paragraph><paragraph id="H8D8A3E64C4F54219BE000068C654F620"><enum>(3)</enum><text>include—</text>
<subparagraph id="H3166EC0333F449E19710A119AE17D6F1"><enum>(A)</enum><text>an inventory of
the cultural, historical, archeological, natural, and recreational resources of
the Heritage Area; and</text>
</subparagraph><subparagraph id="HEBDF83974F7C40F49DDC3E8BDF73CC82"><enum>(B)</enum><text>an analysis of
ways in which Federal, State, tribal, and local programs may best be
coordinated to promote the purposes of this title;</text>
</subparagraph></paragraph><paragraph id="H3FD81BF3CE914CA3A2CBC6154FDF5C95"><enum>(4)</enum><text>provide
recommendations for educational and interpretive programs to inform the public
about the resources of the Heritage Area; and</text>
</paragraph><paragraph id="H61FDDC393F584B81AF96E6CC9B7B60AE"><enum>(5)</enum><text>involve residents
of affected communities and tribal and local governments.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD9EB98B7657F4C23AA64949400F5D6EF"><enum>(c)</enum><header>Failure To
submit</header><text>If a management plan is not submitted to the Secretary by
the date specified in subsection (a), the Secretary shall not provide any
additional funding under this title until a management plan for the Heritage
Area is submitted to the Secretary.</text>
</subsection></section><section id="HE9D25ABC52074D31003E87CDAC2521B1"><enum>108.</enum><header>Duties and
authorities of Federal agencies</header>
<subsection id="HBDE891F989D5479E98A4E0007327CB64"><enum>(a)</enum><header>In
general</header><text>On the request of the coordinating entity, the Secretary
may provide technical and financial assistance to the coordinating entity for
use in the development and implementation of the management plan.</text>
</subsection><subsection id="HBB5EC3B46FD24A9FB2AB5B999DE1ADE0"><enum>(b)</enum><header>Prohibition of
certain requirements</header><text>The Secretary may not, as a condition of the
provision of technical or financial assistance under this section, require any
recipient of the assistance to impose or modify any land use restriction or
zoning ordinance.</text>
</subsection></section><section id="H8F03E71F48564C4590B5EFD2AFBADF2"><enum>109.</enum><header>Effect</header><text display-inline="no-display-inline">Nothing in this title—</text>
<paragraph id="H2BE1BABF079F49D7B118FBC217063F48"><enum>(1)</enum><text>affects or
authorizes the coordinating entity to interfere with—</text>
<subparagraph id="H8DDAC86B88C74A068017C7D2E9467DF5"><enum>(A)</enum><text>the right of any
person with respect to private property; or</text>
</subparagraph><subparagraph id="H93C66C4485444DFA00F0ADEEE389981"><enum>(B)</enum><text>any local zoning
ordinance or land use plan;</text>
</subparagraph></paragraph><paragraph id="H374AC7DC3F5849FD98065736C336DEB3"><enum>(2)</enum><text>restricts an
Indian tribe from protecting cultural or religious sites on tribal land;</text>
</paragraph><paragraph id="H158522BA38D74E6C865B001F714BEF09"><enum>(3)</enum><text>modifies,
enlarges, or diminishes the authority of any State, tribal, or local government
to regulate any use of land under any other law (including regulations);</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H98F9D9351C1F4F9A969BC3443EA6E1A3"><enum>(4)</enum><text>modifies,
enlarges, or diminishes the authority of the State to manage fish and wildlife
in the Heritage Area, including the regulation of fishing and hunting;</text>
</paragraph><paragraph id="H22065EF4088C43789C6D48DBA779B5B"><enum>(5)</enum><text>authorizes the
coordinating entity to assume any authority to manage fish and wildlife in the
Heritage Area; or</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC5A1865733C142D6BE6E1781500025CE"><enum>(6)</enum><text>diminishes the
trust responsibilities or government-to-government obligations of the United
States of any federally recognized Indian tribe.</text>
</paragraph></section><enum>II</enum><header>Mississippi Hills
National Heritage Area Act of 2007</header>
<section id="H273BA3ECB9F742D98D752CD40001F4AF" section-type="subsequent-section"><enum>201.</enum><header>Short
title</header><text display-inline="no-display-inline">This title may be cited
as the <quote><short-title>Mississippi Hills National
Heritage Area Act of 2009</short-title></quote>.</text>
</section><section id="HC6DD05CC740E4512BF2099EDA6624D9"><enum>202.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
<paragraph id="H8129A64CC225425C819951B252C743B7"><enum>(1)</enum><text>the area in
northern Mississippi, and located in the southern foothills of the Appalachian
range, has a unique identity that is shaped by—</text>
<subparagraph id="HC76C926BDEED44A5A9711DA7BFCF8893"><enum>(A)</enum><text>a diverse
geological and geographical environment, including substantial portions
of—</text>
<clause id="H9DEDEC1A21DA4A99BDADD6DA6314DB92"><enum>(i)</enum><text>the
Red Clay Hills;</text>
</clause><clause id="H4CA8BCB907E447C983DCC577C3F808F"><enum>(ii)</enum><text>the
Flatwoods;</text>
</clause><clause id="H8CE34D68D3FF497C8CFCEAB374B159E2"><enum>(iii)</enum><text>the Pontotoc
Ridge;</text>
</clause><clause id="HE47B8E2531E5461484DFBA1669C5F353"><enum>(iv)</enum><text>the
Black Prairie; and</text>
</clause><clause id="H7D86DFA77ED44444B4337F008BABC1DC"><enum>(v)</enum><text>the
Northeastern Hills; and</text>
</clause></subparagraph><subparagraph id="H43129A57C535422FBA3600E294BCBFCC"><enum>(B)</enum><text>diverse peoples
who—</text>
<clause id="H6288ACFE28EE4B7EBD2F030094396FB5"><enum>(i)</enum><text>have
settled in the area; and</text>
</clause><clause id="H10077DE3C8F24552BB924EF95BBA99DD"><enum>(ii)</enum><text>have been
strongly influenced by the intersection of the distinctive cultures of
Appalachia and the Mississippi Delta;</text>
</clause></subparagraph></paragraph><paragraph id="HF88FD7F1C3974AB900AD7CB93BA18C2F"><enum>(2)</enum><text>the area is rich
with landmarks of diverse cultural and historical significance,
including—</text>
<subparagraph id="H92A771A69A8045FDB1368F113086AF6B"><enum>(A)</enum><text>Native American
settlements, particularly those of the Chickasaw and Choctaw tribes;</text>
</subparagraph><subparagraph id="HCAF2E87448064E8700D0414EEC94A9E3"><enum>(B)</enum><text>the Natchez Trace
Parkway;</text>
</subparagraph><subparagraph id="H6CA376E8C9ED41D4BAC9B829694B956C"><enum>(C)</enum><text>sites of important
battles and other significant actions of the Civil War, including—</text>
<clause id="H44ACE21669CE46CEB3A937E52991B31D"><enum>(i)</enum><text>the
Battle of Corinth;</text>
</clause><clause id="H72D6D631777141DA98D6C0A0FF7FD1E1"><enum>(ii)</enum><text>the
Battle of Brices Crossroads;</text>
</clause><clause id="H07AF18E4B8154183B9736CAF534B8EE5"><enum>(iii)</enum><text>the Battle of
Tupelo;</text>
</clause><clause id="H89EF68CC86324F84888D8608257FD818"><enum>(iv)</enum><text>Van
Dorns’ Raid; and</text>
</clause><clause id="H0AA08B08E7E343318FBF5611EFE1DE00"><enum>(v)</enum><text>Grierson’s
Raids;</text>
</clause></subparagraph><subparagraph id="H4E3B206BAEE64F91878C20F89B43DF73"><enum>(D)</enum><text>the Contraband
Camp in Corinth;</text>
</subparagraph><subparagraph id="H0701C7A3D3504623A152D52D602FB3D4"><enum>(E)</enum><text>the Mississippi
University for Women, the first public college for women in the United
States;</text>
</subparagraph><subparagraph id="HB09FF85366814AF7B9F2274C846C4997"><enum>(F)</enum><text>Rust College,
founded before 1867, which stands as 1 of the 5 remaining historically black
colleges in the United States;</text>
</subparagraph><subparagraph id="H3382DF5C927540A7A0FAF38B00972C22"><enum>(G)</enum><text>birthplaces of
literary and musical icons, including—</text>
<clause id="H1392EE2EA0ED4308841E6FFAB8C46DD2"><enum>(i)</enum><text>Elvis Aaron
Presley, popularly known as the “King of Rock and Roll”, born in Tupelo;</text>
</clause><clause id="H53A388A90DBA44D5AA385082F6C4009C"><enum>(ii)</enum><text>Nobel-Laureate
William Faulkner, born in New Albany;</text>
</clause><clause id="H497050B8750E41869F206CF816B9AE31"><enum>(iii)</enum><text>Tammy Wynette,

</clause></subparagraph><subparagraph id="HDBD38758E5E64A579FCB8B1DB648D546"><enum>(H)</enum><text>birthplaces of
Civil Rights pioneers, including—</text>
<clause id="HEEEDB9E474A74327A5BA27376431AAD"><enum>(i)</enum><text>Ida
B. Wells-Barnett, a formidable figure in the anti-lynching movement, born in
Holly Springs; and</text>

establishment of the Mississippi Hills National Heritage Area to coordinate and
assist in the preservation and interpretation of those resources;</text>
</paragraph><paragraph id="HE242FE34EE5D40899B631C0677597308"><enum>(5)</enum><text>the Mississippi
Hills Heritage Area Concept Plan, coordinated by the Mississippi Hills Heritage
Area Alliance is—</text>
<subparagraph id="H76EC63F3A4424034A3269F7DD86E5D67"><enum>(A)</enum><text>a collaborative
effort between the Federal Government and State and local governments in the
area; and</text>
</subparagraph><subparagraph id="H1A9F9C333D2A4E2D9736393CA83B5B93"><enum>(B)</enum><text>a natural
foundation on which to establish the Mississippi Hills Heritage Area;
and</text>
</subparagraph></paragraph><paragraph id="HDB25054D3EDE431BA3DD43ECDFC94035"><enum>(6)</enum><text>the establishment
of the Mississippi Hills Heritage Area would assist local communities and
residents in preserving the unique cultural, historical, archaeological,
natural, and recreational resources of the area.</text>
</paragraph></section><section id="H4B0C2A5C80E74142B5E1F330480D51E"><enum>203.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
<paragraph id="H3A1CC7441942478A92CCDC703DC5D837"><enum>(1)</enum><header>Alliance</header><text>The
term <term>Alliance</term> means the Mississippi Hills Heritage Area Alliance,
a non-profit organization registered by the State, with the cooperation and
support of the University of Mississippi.</text>
</paragraph><paragraph id="H9DCE60E5AE704623B1E41B00D6ABD8F"><enum>(2)</enum><header>Heritage
area</header><text>The term <term>Heritage Area</term> means the Mississippi
Hills National Heritage Area established by this title.</text>
</paragraph><paragraph id="H9D439B156ED74A1E81CD5FF7ED07758"><enum>(3)</enum><header>Management
plan</header><text>The term <term>management plan</term> means the management
plan for the Heritage Area developed under this title.</text>
</paragraph><paragraph id="H66636454DD524EBCB496457800A679F2"><enum>(4)</enum><header>Secretary</header><text>The
term <term>Secretary</term> means the Secretary of the Interior.</text>
</paragraph><paragraph id="H9A492A35AA47415AA5E300E2CC6E2782"><enum>(5)</enum><header>State</header><text>The
term <term>State</term> means the State of Mississippi.</text>
</paragraph></section><section id="HA818655EA7584C39B560E6134AB8F88"><enum>204.</enum><header>Mississippi
Hills National Heritage Area</header>
<subsection id="H75F057FA50814C4D8F1C8BACA77CBD5"><enum>(a)</enum><header>Establishment</header><text>There
is established in the State the Mississippi Hills National Heritage
Area.</text>
</subsection><subsection id="HEF729E014D28418D8DBF56BE1948EE1E"><enum>(b)</enum><header>Boundaries</header>
<paragraph id="HEFA195BC07F84F9DA6ADD07A6391516"><enum>(1)</enum><header>Affected
counties</header><text>The Heritage Area shall consist of all, or portions of,
as specified by the boundary description in paragraph (2), Alcorn, Attala,
Benton, Calhoun, Carroll, Chickasaw, Choctaw, Clay, DeSoto, Grenada, Holmes,
Itawamba, Lafayette, Lee, Lowndes, Marshall, Monroe, Montgomery, Noxubee,
Oktibbeha, Panola, Pontotoc, Prentiss, Tate, Tippah, Tishomingo, Union,
Webster, Winston, and Yalobusha Counties in the State.</text>
</paragraph><paragraph id="H93AAFA0BF2A44921B05ED7C3F2814E63"><enum>(2)</enum><header>Boundary
description</header><text>The Heritage Area shall have the following boundary
description:</text>
<subparagraph id="H96005DF4F03444DAA5D5926800BE7337"><enum>(A)</enum><text>traveling
counterclockwise, the Heritage Area shall be bounded to the west by U.S.
Highway 51 from the Tennessee State line until it intersects Interstate 55 (at
Geeslin Corner approximately 0.5 miles due north of Highway Interchange
208);</text>
</subparagraph><subparagraph id="HF1F1D4CDAFB941B5B656358F8CA7BAE7"><enum>(B)</enum><text>from this point,
Interstate 55 shall be the western boundary until it intersects with
Mississippi Highway 12 at Highway Interchange 156, the intersection of which
shall be the southwest terminus of the Heritage Area;</text>
</subparagraph><subparagraph id="H7C47D6402F24424C96A9B2BEDDF003C"><enum>(C)</enum><text>from the southwest
terminus, the boundary shall—</text>
<clause id="H5425453F5C1B43A19114249654BF8FD9"><enum>(i)</enum><text>extend east along
Mississippi Highway 12 until it intersects U.S. Highway 51;</text>
</clause><clause id="HE1624F57C3AD4E40B3F38E00127843C6"><enum>(ii)</enum><text>follow Highway 51
south until it is intersected again by Highway 12;</text>
</clause><clause id="H23418150723046FC8C026950A82D3E33"><enum>(iii)</enum><text>extend along
Highway 12 into downtown Kosciusko where it intersects Mississippi Highway
35;</text>
</clause><clause id="H71DF9FF002E3404B00CDC28E86BDB"><enum>(iv)</enum><text>follow
Highway 35 south until it is intersected by Mississippi Highway 14; and</text>
</clause><clause id="HCBC1AA47511342D5A7106BF658B63FF9"><enum>(v)</enum><text>extend along
Highway 14 until it reaches the Alabama State line, the intersection of which
shall be the southeast terminus of the Heritage Area;</text>
</clause></subparagraph><subparagraph id="H99C5F3EF7D1246D0A7B3DAF2EE7EF7AE"><enum>(D)</enum><text>from the southeast
terminus, the boundary of the Heritage Area shall follow the
Mississippi-Alabama State line until it reaches the Mississippi-Tennessee State
line, the intersection of which shall be the northeast terminus of the Heritage
Area; and</text>
</subparagraph><subparagraph id="H323AF1AD572B4A1BA3FB1D58A3131D20"><enum>(E)</enum><text>the boundary shall
extend due west until it reaches U.S. Highway 51, the intersection of which
shall be the northwest terminus of the Heritage Area.</text>
</subparagraph></paragraph></subsection></section><section id="H8DB93A9489C94C66A7D891EB1C6E84F6"><enum>205.</enum><header>Designation of
Alliance as management entity</header>
<subsection id="H09349E5AA26F483698ADB7726C00A9FD"><enum>(a)</enum><header>In
general</header><text>The Alliance shall be the coordinating entity for the
Heritage Area.</text>
</subsection><subsection id="H043AA0C9709643B183DC59DEC2A97E50"><enum>(b)</enum><header>Federal
funding</header>
<paragraph id="H811DCF5D7BC54E57AADEC771A83BFD06"><enum>(1)</enum><header>Authorization to
receive funds</header><text>The Alliance may receive amounts made available to
carry out this title.</text>
</paragraph><paragraph id="HACE7616E8DA041699C4D10186FA6AD5E"><enum>(2)</enum><header>Disqualification</header><text>If
a management plan is not submitted to the Secretary as required under this
title within the time period specified, the Alliance may not receive Federal
funding under this title until a management plan is submitted to the
Secretary.</text>
</paragraph></subsection><subsection id="H5896F7BA550748AD9352515203C22223"><enum>(c)</enum><header>Use of Federal
funds</header><text>The Alliance may, for the purposes of developing and
implementing the management plan, use Federal funds made available under this
title—</text>
<paragraph id="H7CFD38292F9C46B0B28BCFB3EB545B3B"><enum>(1)</enum><text>to make grants and
loans to the State, political subdivisions of the State, nonprofit
organizations, and other persons;</text>
</paragraph><paragraph id="HD8FEB31EEE284340B012C06D70C39B85"><enum>(2)</enum><text>to enter into
cooperative agreements with, or provide technical assistance to, the State,
political subdivisions of the State, nonprofit organizations, and other
organizations;</text>
</paragraph><paragraph id="H2FB3A7E2F73A468DAE9F00AE26FCF8E8"><enum>(3)</enum><text>to hire and
compensate staff;</text>
</paragraph><paragraph id="HC287B5B4112E40D698065074597F2456"><enum>(4)</enum><text>to obtain funds
from any source, under any program or law, requiring the recipient of funds to
make a contribution in order to receive the funds; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H09FC34581D494AEB86BF6789EDE6BA97"><enum>(5)</enum><text>to contract for
goods and services.</text>
</paragraph></subsection><subsection id="H6AB2DDBF104548C2BFCA9C8DDE14D55"><enum>(d)</enum><header>Prohibition of
acquisition of real property</header><text>The Alliance may not use Federal
funds received under this title to acquire real property or any interest in
real property.</text>
</subsection></section><section id="HF087C2B13401422B852700E93CF39384"><enum>206.</enum><header>Authorities and
duties of Alliance</header>
<subsection id="HC7DA6A2BA3AE49A7BB7379011F3CAA6E"><enum>(a)</enum><header>Authorities</header><text>To
develop and implement the management plan and otherwise carry out this title,
the Alliance may make grants to and provide technical assistance to tribal and
local governments and other public and private entities.</text>
</subsection><subsection id="H92100A381FDF4835AFE4DD4B56DFCD2"><enum>(b)</enum><header>Duties</header><text>In
carrying out this title, the Alliance shall—</text>
<paragraph id="HD8E82B898AEC41AAA307BE4D000E1CA"><enum>(1)</enum><text>implement the
management plan;</text>
</paragraph><paragraph id="HA572A72D67A746A8BE5030305122D946"><enum>(2)</enum><text>assist local and
tribal governments and non-profit organizations to—</text>
<subparagraph id="H16216FD0E03941369BC3F12E71BB4C93"><enum>(A)</enum><text>establish and
maintain interpretive exhibits in the Heritage Area;</text>
</subparagraph><subparagraph id="H8BFF83DE6E604D0E9D0018001F0081D7"><enum>(B)</enum><text>develop
recreational resources in the Heritage Area;</text>
</subparagraph><subparagraph id="H24C5A6DF8D984C108F518CA1C2F5974C"><enum>(C)</enum><text>increase public
awareness of, and appreciation for, the cultural, historical, archaeological,
natural, and recreational resources of the Heritage Area;</text>
</subparagraph><subparagraph id="HC167B1DDC5CB4148BE81C0653E29C922"><enum>(D)</enum><text>restore historic
resources that relate to the Heritage Area; and</text>
</subparagraph><subparagraph id="H85C3F56DD0E649A29F1E00E03380AC59"><enum>(E)</enum><text>carry out any
other activity that the Alliance determines to be appropriate to carry out this
title, consistent with the management plan;</text>
</subparagraph></paragraph><paragraph id="HC15881B9337649F691E59424E19E9D06"><enum>(3)</enum><text>on at least an
annual basis, conduct public meetings relating to the implementation of the
management plan;</text>
</paragraph><paragraph id="H5FEEA74E01644CF7BB981C14055D4889"><enum>(4)</enum><text>for any fiscal
year for which Federal funds are made available under this title—</text>
<subparagraph id="HD2F243E1C21F4A3BA9FFC17355FD214B"><enum>(A)</enum><text>submit to the
Secretary a report that describes, for the fiscal year, actions of the Alliance
in carrying out this title;</text>
</subparagraph><subparagraph id="H0BD5ABEDA8604A118C99EF74049FEFA9"><enum>(B)</enum><text>make available to
the Secretary for audit all records relating to the expenditure of funds and
any matching funds; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE9AA482186834826A2F037CE5E676795"><enum>(C)</enum><text>require, for each
agreement authorizing the expenditure of Federal funds by any entity, that the
receiving entity make available to the Secretary for audit all records relating
to the expenditure of the funds; and</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H12B8C612971D4EA08499D2EC3B21CF00"><enum>(5)</enum><text>ensure that each
county included in the Heritage Area is appropriately represented on any
oversight advisory committee established pursuant to this title to coordinate
the Heritage Area.</text>
</paragraph></subsection></section><section id="H8410E5D1C05C4E3AB354E41F1CD0DA36"><enum>207.</enum><header>Management of
Heritage Area</header>
<subsection id="HABFEA7EBE9B14769BD52CC918DE209F3"><enum>(a)</enum><header>In
general</header><text>Not later than 3 years after the date of enactment of
this title, the Alliance shall develop and submit to the Secretary a management
plan for the Heritage Area.</text>
</subsection><subsection id="HCEDC15328C034EE79ED8613891474897"><enum>(b)</enum><header>Contents</header><text>The
management plan shall—</text>
<paragraph id="H668A7E58670B43BF8C821246D8868129"><enum>(1)</enum><text>provide
recommendations for the preservation, conservation, enhancement, funding,
management, interpretation, development, and promotion of the cultural,
historical, archaeological, natural, and recreational resources of the Heritage
Area;</text>
</paragraph><paragraph id="H01777234D62B49C4BCA1743835F77014"><enum>(2)</enum><text>identify sources
of funding for the Heritage Area;</text>
</paragraph><paragraph id="H0680856E4142414F9DE7EFE8EB18C1E1"><enum>(3)</enum><text>include—</text>
<subparagraph id="HE01501BC07D14527008F8BE1823FDFF7"><enum>(A)</enum><text>an inventory of
the cultural, historical, archaeological, natural, and recreational resources
of the Heritage Area; and</text>
</subparagraph><subparagraph id="HF57457CE8B974F46843741468572D7D2"><enum>(B)</enum><text>an analysis of how
Federal, State, tribal, and local programs may best be coordinated to promote
and carry out this title;</text>
</subparagraph></paragraph><paragraph id="H49AFF045767645CC9C58D90075BA9FAE"><enum>(4)</enum><text>provide
recommendations for educational and interpretive programs to inform the public
about the resources of the Heritage Area; and</text>
</paragraph><paragraph id="H6A51C8D8876642EF9C25667F7583CE3B"><enum>(5)</enum><text>involve residents
of affected communities and tribal and local governments.</text>
</paragraph></subsection><subsection id="H1AF9E1F666B64F5BA7A50082E0F177B2"><enum>(c)</enum><header>Approval or
disapproval of management plan</header>
<paragraph id="H363090C981A6474A8C6C98598510D052"><enum>(1)</enum><header>In
general</header><text>Not later than 90 days after the date of receipt of the
management plan, the Secretary shall approve or disapprove the management
plan.</text>
</paragraph><paragraph id="H0AD1210FEE5746669025BA008BAFDF9D"><enum>(2)</enum><header>Disapproval and
revisions</header><text>If the Secretary disapproves the management plan, the
Secretary shall—</text>
<subparagraph id="HFCD46A4312FA48918F96FCE600C6CE73"><enum>(A)</enum><text>advise the
Alliance in writing of the reasons for disapproval;</text>
</subparagraph><subparagraph id="H007839FD77FB4210B2882600ED2F336B"><enum>(B)</enum><text>make
recommendations for revision of the management plan; and</text>
</subparagraph><subparagraph id="H76F4E70405754148A603E0DBF8FC3DCE"><enum>(C)</enum><text>allow the Alliance
to submit to the Secretary revisions to the management plan.</text>
</subparagraph></paragraph></subsection><subsection id="HDE282B72DEE544649449078D3978CFE7"><enum>(d)</enum><header>Revision</header><text>After
approval by the Secretary of the management plan, the Alliance shall
periodically—</text>
<paragraph id="HF43D57599C10460F97BE56C983D5B4DC"><enum>(1)</enum><text>review the
management plan; and</text>
</paragraph><paragraph id="H51C3914436E54B25AAF9D9696F7F4348"><enum>(2)</enum><text>submit to the
Secretary, for review and approval by the Secretary, any recommendations for
revisions to the management plan.</text>
</paragraph></subsection></section><section id="HBEFF2C7EAD0D4DA49456BB3E8004B1F"><enum>208.</enum><header>Duties and
authorities of Federal agencies</header>
<subsection id="H34ED550EDA7A4E39B579D87CC4D87D31"><enum>(a)</enum><header>In
general</header><text>Subject to the availability of appropriations, the
Secretary may provide technical assistance and grants to the Alliance to pay
the Federal share of the cost of developing and implementing the management
plan.</text>
</subsection><subsection id="HAD14111751EA44A9994296277DACEAA"><enum>(b)</enum><header>Prohibition of
certain requirements</header><text>The Secretary may not, as a condition of the
award of technical assistance or grants under this section, require any
recipient of the technical assistance or a grant to enact or modify any land
use restriction.</text>
</subsection></section><section id="H229C3DFD05CD409BB7EE652B551E5051"><enum>209.</enum><header>Effect of
Act</header>
<subsection id="H65BF99319C2B40E08D5066A976AE3EC2"><enum>(a)</enum><header>No effect on
land use authority</header><text display-inline="yes-display-inline">Nothing in
this title modifies, enlarges, or diminishes the authority of any State,
tribal, or local government to regulate any use of land under any other law
(including regulations).</text>
</subsection><subsection id="HCFDB249DC2264832BEC74670236D9E03"><enum>(b)</enum><header>Local authority
and private property not affected</header><text>Nothing in this title affects
or authorizes the Alliance to interfere with—</text>
<paragraph id="H85C0A3EC203340D79CBB2858BC32FC3B"><enum>(1)</enum><text>the right of any
person with respect to private property; or</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD0A73CC418B44665A8C66C37E0B34133"><enum>(2)</enum><text>any local zoning
ordinance or land use plan of the State or a political subdivision of the
State.</text>
</paragraph></subsection><subsection id="HAA9360C618B443F6B7C3C281B1B1FDCC"><enum>(c)</enum><header>No effect on
Indian tribes</header><text>Nothing in this title—</text>
<paragraph id="H65E62F31EC054234AE60AD4463E09BED"><enum>(1)</enum><text>restricts an
Indian tribe from protecting cultural or religious sites on tribal land;
or</text>
</paragraph><paragraph id="HC23E5803B79649F380A5B80036F2C88C"><enum>(2)</enum><text>diminishes the
trust responsibilities or government-to-government obligations of the United
States to any Indian tribe recognized by the Federal Government.</text>
</paragraph></subsection><subsection commented="no" id="H319E118CC72B4A578FB275F444C0EAB"><enum>(d)</enum><header>Management of
fish and wildlife</header><text>Nothing in this title—</text>
<paragraph commented="no" id="HE609F6D427724906AA26B59B1BAA48B8"><enum>(1)</enum><text>modifies,
enlarges, or diminishes the authority of the State to manage fish and wildlife
in the Heritage Area, including the regulation of fishing and hunting;
and</text>
</paragraph><paragraph commented="no" id="H41E08C8E9B194C06BF2800A883B1EEEE"><enum>(2)</enum><text>authorizes the
Alliance to assume any management authorities over such lands.</text>
</paragraph></subsection></section><section id="H8DFD6DED71E24F8F00E5797B954D00D"><enum>210.</enum><header>Authorization of
appropriations</header>
<subsection id="H715B28E6DD2843D38E19108BEE211EE4"><enum>(a)</enum><header>In
general</header><text>There is authorized to be appropriated to carry out this
title $10,000,000, of which not more than $1,000,000 may be made available for
any fiscal year.</text>
</subsection><subsection id="HC007CC33D3EC4F0D88767FBE80D4B797"><enum>(b)</enum><header>Federal
share</header><text>The Federal share of the cost of any activity carried out
using funds made available under this title shall not exceed 50 percent.</text>
