			<paragraph id="ID453364658dd04143a0786e0a4496c6ff"><enum>(1)</enum><header>Aamodt
			 adjudication</header><text>The term <term>Aamodt adjudication</term> means the
			 general stream adjudication that is the subject of the civil action entitled
			 <quote>State of New Mexico, ex rel. State Engineer and United States of
			 America, Pueblo de Nambe, Pueblo de Pojoaque, Pueblo de San Ildefonso, and
			 Pueblo de Tesuque v. R. Lee Aamodt, et al.</quote>, No. 66 CV 6639 MV/LCS
			 (D.N.M.).</text>
			</paragraph><paragraph id="ID744ff916660740929730d95667a3077a"><enum>(2)</enum><header>Abeyta
			 adjudication</header><text>The term <term>Abeyta adjudication</term> means the
			 general stream adjudication that is the subject of the civil actions entitled
			 <quote>State of New Mexico v. Abeyta and State of New Mexico v.
			 Arrellano</quote>, Civil Nos. 7896–BB (D.N.M.) and 7939–BB (D.N.M.)
			 (consolidated).</text>
			</paragraph><paragraph id="id899bcd9b-5358-4dac-997c-f7eed3ca6a95"><enum>(3)</enum><header>Acre-feet</header><text>The
			 term <term>acre-feet</term> means acre-feet per year.</text>
			</paragraph><paragraph id="id0981abe1-94e0-47c2-961f-b2ab77260f05"><enum>(4)</enum><header>Agreement</header><text>The
			 term <term>Agreement</term> means the agreement among the State of New Mexico,
			 the Nation, and the United States setting forth a stipulated and binding
			 agreement signed by the State of New Mexico and the Nation on April 19,
			 2005.</text>
			</paragraph><paragraph id="ID5d5a2dbd42df4475949cdb1cf23e73cf"><enum>(5)</enum><header>Allottee</header><text>The
			 <term>allottee</term> means a person that holds a beneficial real property
			 interest in a Navajo allotment that—</text>
				<subparagraph id="IDf7b59befb4464da98200e97a0ae20bde"><enum>(A)</enum><text>is located within
			 the Navajo Reservation or the State of New Mexico;</text>
				</subparagraph><subparagraph id="IDe3b4a1a77bdc4f8a83bde4b4de9f6015"><enum>(B)</enum><text>is held in trust
			 by the United States; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8efdb3b650e5496dac7db23fc3eaa6cc"><enum>(C)</enum><text>was originally
			 granted to an individual member of the Nation by public land order or
			 otherwise.</text>
				</subparagraph></paragraph><paragraph id="id5fc8837c-10f9-4ba9-ac45-5b3d4d1544a2"><enum>(6)</enum><header>Animas-la
			 Plata Project</header><text>The term <term>Animas-La Plata Project</term> has
			 the meaning given the term in section 3 of Public Law 100–585 (102 Stat. 2973),
			 including Ridges Basin Dam, Lake Nighthorse, the Navajo Nation Municipal
			 Pipeline, and any other features or modifications made pursuant to the Colorado
			 Ute Settlement Act Amendments of 2000 (Public Law 106–554; 114 Stat.
			 2763A–258).</text>
			</paragraph><paragraph id="id43279fb4-ff03-4e1f-b60f-2ce5c4bb7371"><enum>(7)</enum><header>City</header><text>The
			 term <term>City</term> means the city of Gallup, New Mexico, or a designee of
			 the City, with authority to provide water to the Gallup, New Mexico service
			 area.</text>
			</paragraph><paragraph id="id01c4be5d-1baf-46b5-a7f6-a40c02ddf23e"><enum>(8)</enum><header>Compact</header><text>The
			 term <term>Compact</term> means the Upper Colorado River Basin Compact as
			 consented to by the Act of April 6, 1949 (63 Stat. 31, chapter 48).</text>
			</paragraph><paragraph id="id271f2488-3689-47f3-aee5-bd437a10034d"><enum>(9)</enum><header>Contract</header><text>The
			 term <term>Contract</term> means the contract between the United States and the
			 Nation setting forth certain commitments, rights, and obligations of the United
			 States and the Nation, as described in paragraph 6.0 of the Agreement.</text>
			</paragraph><paragraph id="idfa9ab2a4-caf2-49ea-8987-a2c0b6c91c79"><enum>(10)</enum><header>Depletion</header><text>The
			 term <term>depletion</term> means the depletion of the flow of the San Juan
			 River stream system in the State of New Mexico by a particular use of water
			 (including any depletion incident to the use) and represents the diversion from
			 the stream system by the use, less return flows to the stream system from the
			 use.</text>
			</paragraph><paragraph id="id9f12e1a8-b44b-4b56-ad34-8f644fd46e30"><enum>(11)</enum><header>Draft
			 Impact Statement</header><text>The term <term>Draft Impact Statement</term>
			 means the draft environmental impact statement prepared by the Bureau of
			 Reclamation for the Project dated March 2007.</text>
			</paragraph><paragraph id="id97225c43-3bac-473e-81f5-b8698d7ed479"><enum>(12)</enum><header>Fund</header><text>The
			 term <term>Fund</term> means the Reclamation Waters Settlements Fund
			 established by section 201(a).</text>
			</paragraph><paragraph id="ida2f6c43e-1dc7-45b3-8cb5-a8040a431034"><enum>(13)</enum><header>Hydrologic
			 determination</header><text>The term <term>hydrologic determination</term>
			 means the hydrologic determination entitled <quote>Water Availability from
			 Navajo Reservoir and the Upper Colorado River Basin for Use in New
			 Mexico</quote>, prepared by the Bureau of Reclamation pursuant to section 11 of
			 the Act of June 13, 1962 (Public Law 87–483; 76 Stat. 99), and dated May 23,
			 2007.</text>
			</paragraph><paragraph id="id4038718e-f27c-4d4c-b893-4add9db9e739"><enum>(14)</enum><header>Nation</header><text>The
			 term <term>Nation</term> means the Navajo Nation, a body politic and federally
			 recognized Indian nation as provided for in section 101(2) of the Federally
			 Recognized Indian Tribe List of 1994 (25 U.S.C. 497a(2)), also known variously
			 as the <quote>Navajo Tribe</quote>, the <quote>Navajo Tribe of Arizona, New
			 Mexico &amp; Utah</quote>, and the <quote>Navajo Tribe of Indians</quote> and
			 other similar names, and includes all bands of Navajo Indians and chapters of
			 the Navajo Nation.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id90225C47A6B940C59D47699225EF3DBE"><enum>(15)</enum><header display-inline="yes-display-inline">Navajo-Gallup Water Supply Project;
			 Project</header><text display-inline="yes-display-inline">The term
			 <term>Navajo-Gallup Water Supply Project</term> or <term>Project</term> means
			 the Navajo-Gallup Water Supply Project authorized under section 302(a), as
			 described as the preferred alternative in the Draft Impact Statement.</text>
			</paragraph><paragraph id="idfece6749-ca57-4df2-a7f2-9ec4d9c86550"><enum>(16)</enum><header>Navajo
			 Indian Irrigation Project</header><text>The term <term>Navajo Indian Irrigation
			 Project</term> means the Navajo Indian irrigation project authorized by section
			 2 of Public Law 87–483 (76 Stat. 96).</text>
			</paragraph><paragraph id="ide897651e-98fc-46d9-96b3-8ef5fc215cbf"><enum>(17)</enum><header>Navajo
			 Reservoir</header><text>The term <term>Navajo Reservoir</term> means the
			 reservoir created by the impoundment of the San Juan River at Navajo Dam, as
			 authorized by the Act of April 11, 1956 (commonly known as the <quote>Colorado
			 River Storage Project Act</quote>) (43 U.S.C. 620 et seq.).</text>
			</paragraph><paragraph id="id0954104f-6bb6-402f-b90d-595fc1ffcd9a"><enum>(18)</enum><header>Navajo
			 Nation Municipal Pipeline; Pipeline</header><text>The term <term>Navajo Nation
			 Municipal Pipeline</term> or <term>Pipeline</term> means the pipeline used to
			 convey the water of the Animas-La Plata Project of the Navajo Nation from the
			 City of Farmington, New Mexico, to communities of the Navajo Nation located in
			 close proximity to the San Juan River Valley in the State of New Mexico
			 (including the City of Shiprock), as authorized by section 15(b) of the
			 Colorado Ute Indian Water Rights Settlement Act of 1988 (Public Law 100–585;
			 102 Stat. 2973; 114 Stat. 2763A–263).</text>
			</paragraph><paragraph id="id263a33be-392f-45c1-b75a-0936c5ef7af0"><enum>(19)</enum><header>Non-Navajo
			 Irrigation Districts</header><text>The term <term>Non-Navajo Irrigation
			 Districts</term> means—</text>
				<subparagraph id="id5b9111a0-c8cb-4bf1-9f5e-104dea35ac66"><enum>(A)</enum><text>the Hammond
			 Conservancy District;</text>
				</subparagraph><subparagraph id="id078188aa-95ed-4894-b7f4-57e6507f66cd"><enum>(B)</enum><text>the
			 Bloomfield Irrigation District; and</text>
				</subparagraph><subparagraph id="id2b33a238-be00-4869-adf0-e9afb9824b12"><enum>(C)</enum><text>any other
			 community ditch organization in the San Juan River basin in the State of New
			 Mexico.</text>
				</subparagraph></paragraph><paragraph id="ID2b325e2dde13454bb855c691aff88b7c"><enum>(20)</enum><header>Partial final
			 decree</header><text>The term <term>Partial Final Decree</term> means a final
			 and binding judgement and decree entered by a court in the stream adjudication,
			 setting forth the rights of the Nation to use and administer waters of the San
			 Juan River Basin in New Mexico, as set forth in appendix 1 of the
			 Agreement.</text>
			</paragraph><paragraph id="id39d1d326-30be-4d0a-9803-c1824b21d2d3"><enum>(21)</enum><header>Project
			 Participants</header><text>The term <term>Project Participants</term> means the
			 City, the Nation, and the Jicarilla Apache Nation.</text>
			</paragraph><paragraph id="idf144ea29-c7b4-4c3a-a3cf-ab63a86fa375"><enum>(22)</enum><header>San Juan
			 River Basin Recovery Implementation Program</header><text>The term <term>San
			 Juan River Basin Recovery Implementation Program</term> means the
			 intergovernmental program established pursuant to the cooperative agreement
			 dated October 21, 1992 (including any amendments to the program).</text>
			</paragraph><paragraph id="id3fe10a18-a147-4771-a5be-9d5dd3fadb3a"><enum>(23)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior, acting through
			 the Commissioner of Reclamation or any other designee.</text>
			</paragraph><paragraph id="idafa4eb60-feb0-47fe-a412-8ca50e70b11e"><enum>(24)</enum><header>Stream
			 adjudication</header><text>The term <term>stream adjudication</term> means the
			 general stream adjudication that is the subject of New Mexico v. United States,
			 et al., No. 75–185 (11th Jud. Dist., San Juan County, New Mexico) (involving
			 claims to waters of the San Juan River and the tributaries of that
			 river).</text>
			</paragraph><paragraph id="ID1f4cb35b54b94247b96633f659c0452f"><enum>(25)</enum><header>Supplemental
			 Partial Final Decree</header><text>The term <term>Supplemental Partial Final
			 Decree</term> means a final and binding judgement and decree entered by a court
			 in the stream adjudication, setting forth certain water rights of the Nation,
			 as set forth in appendix 2 of the Agreement.</text>
			</paragraph><paragraph id="id6a5ee657-5e4a-4346-a64a-687bb3e2c2bb"><enum>(26)</enum><header>Trust
			 Fund</header><text>The term <term>Trust Fund</term> means the Navajo Nation
			 Water Resources Development Trust Fund established by section 402(a).</text>
			</paragraph></section><section id="id76503f2a-aede-4f72-a2b2-985f5e34613b"><enum>3.</enum><header>Compliance
			 with environmental laws</header>
			<subsection id="id1797feed-e340-4954-a87c-7e7c05d8407c"><enum>(a)</enum><header>Effect of
			 execution of agreement</header><text>The execution of the Agreement under
			 section 401(a)(2) shall not constitute a major Federal action under the
			 <act-name parsable-cite="NEPA69">National Environmental Policy Act of
			 1969</act-name> (42 U.S.C. 4321 et seq.).</text>
			</subsection><subsection id="idc0760102-6840-47c5-b735-9f3079731921"><enum>(b)</enum><header>Compliance
			 with environmental laws</header><text>In carrying out this Act, the Secretary
			 shall comply with each law of the Federal Government relating to the protection
			 of the environment, including—</text>
				<paragraph id="id15c753c2-96d0-4acc-af2a-187075aea74a"><enum>(1)</enum><text>the
			 <act-name parsable-cite="NEPA69">National Environmental Policy Act of
			 1969</act-name> (42 U.S.C. 4321 et seq.); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idacaa11df-dbb9-4e23-b695-f4d02cda1a2d"><enum>(2)</enum><text>the
			 <act-name parsable-cite="ESA">Endangered Species Act of 1973</act-name> (16
			 U.S.C. 1531 et seq.).</text>
				</paragraph></subsection></section><section id="ID50bcc802006c4137a312ed91ad24b4aa"><enum>4.</enum><header>No reallocation
			 of costs</header>
			<subsection id="ID6af43d55ea69431d83a8a999e0d31b95"><enum>(a)</enum><header>Effect of
			 Act</header><text>Notwithstanding any other provision of law, the Secretary
			 shall not reallocate or reassign any costs of projects that have been
			 authorized under the Act of April 11, 1956 (commonly known as the
			 <quote>Colorado River Storage Project Act</quote>) (43 U.S.C. 620 et seq.), as
			 of the date of enactment of this Act because of—</text>
				<paragraph id="IDdcba30edcdbd419cba53892e7a44f084"><enum>(1)</enum><text>the authorization
			 of the Navajo-Gallup Water Supply Project under this Act; or</text>
				</paragraph><paragraph id="ID092c5a1f1928476398352f0537e0f3da"><enum>(2)</enum><text>the changes in
			 the uses of the water diverted by the Navajo Indian Irrigation Project or the
			 waters stored in the Navajo Reservoir authorized under this Act.</text>
				</paragraph></subsection><subsection id="IDf871004188af4b19a974d89531859ee2"><enum>(b)</enum><header>Use of power
			 revenues</header><text>Notwithstanding any other provision of law, no power
			 revenues under the Act of April 11, 1956 (commonly known as the <quote>Colorado
			 River Storage Project Act</quote>) (43 U.S.C. 620 et seq.), shall be used to
			 pay or reimburse any costs of the Navajo Indian Irrigation Project or
			 Navajo-Gallup Water Supply Project.</text>
			</subsection></section><section id="IDae3d7e994521472db6d8429db234dffc"><enum>5.</enum><header>Interest
			 rate</header><text display-inline="no-display-inline">Notwithstanding any other
			 provision of law, the interest rate applicable to any repayment contract
			 entered into under section 304 shall be equal to the discount rate for Federal
			 water resources planning, as determined by the Secretary.</text>
		</section><title id="idb5cb2bcc-ec14-41a4-bf4e-3b4eabe95dd7"><enum>I</enum><header>Amendments to
			 the Colorado River Storage Project Act and Public Law 87–483</header>
			<section id="id8bde7613-87f6-4023-8748-fdb664dd990e"><enum>101.</enum><header>Amendments
			 to the Colorado River Storage Project Act</header>
				<subsection id="ida854f374-7f88-48fb-aaae-7758e5b413b7"><enum>(a)</enum><header>Participating
			 projects</header><text>Paragraph (2) of the first section of the Act of April
			 11, 1956 (commonly known as the <quote>Colorado River Storage Project
			 Act</quote>) (43 U.S.C. 620(2)) is amended by inserting <quote>the
			 Navajo-Gallup Water Supply Project,</quote> after <quote>Fruitland
			 Mesa,</quote>.</text>
				</subsection><subsection id="id2ac9f4ce-488d-4860-8d76-b84bfbb3678c"><enum>(b)</enum><header>Navajo
			 Reservoir water bank</header><text>The Act of April 11, 1956 (commonly known as
			 the <quote>Colorado River Storage Project Act</quote>) is amended—</text>
					<paragraph id="id7c1a9451-b2ce-4ca6-a14b-34a0f33e0c7b"><enum>(1)</enum><text>by
			 redesignating section 16 (43 U.S.C. 620o) as section 17; and</text>
					</paragraph><paragraph id="id2169a96c-a129-4bf9-8fab-73ba3d1cf2ce"><enum>(2)</enum><text>by inserting
			 after section 15 (43 U.S.C. 620n) the following:</text>
						<quoted-block display-inline="no-display-inline" id="id757e0efd-ce7b-4ab8-a0cf-f5bab5100b8d" style="traditional">
							<section id="id0e1fe0ef-de96-4c55-bda8-5b0207729820"><enum>16.</enum><subsection commented="no" display-inline="yes-display-inline" id="id5623a4fb-f4c8-488a-b164-be76b760ee6a"><enum>(a)</enum><text display-inline="yes-display-inline">The Secretary of the Interior may create
				and operate within the available capacity of Navajo Reservoir a top water
				bank.</text>
								</subsection><subsection id="id51954417-bb34-45ca-88de-291926612a44"><enum>(b)</enum><text>Water made
				available for the top water bank in accordance with subsections (c) and (d)
				shall not be subject to section 11 of Public Law 87–483 (76 Stat. 99).</text>
								</subsection><subsection id="id440fcb87-3756-459f-b6bd-b771b5a86475"><enum>(c)</enum><text>The top water
				bank authorized under subsection (a) shall be operated in a manner that—</text>
									<paragraph id="idfd00dfc3-615b-4601-b3a4-3281d14e082c"><enum>(1)</enum><text>is consistent
				with applicable law, except that, notwithstanding any other provision of law,
				water for purposes other than irrigation may be stored in the Navajo Reservoir
				pursuant to the rules governing the top water bank established under this
				section; and</text>
									</paragraph><paragraph id="id4d846fdd-05b7-4ae9-847a-17e1b20649d5"><enum>(2)</enum><text>does not
				impair the ability of the Secretary of the Interior to deliver water under
				contracts entered into under—</text>
										<subparagraph id="id92bf8fa0-a338-458d-b023-5a030bb963b8"><enum>(A)</enum><text>Public Law
				87–483 (76 Stat. 96); and</text>
										</subparagraph><subparagraph id="id59c53ee7-f546-427d-8fa8-d4007d5df268"><enum>(B)</enum><text>New Mexico
				State Engineer File Nos. 2847, 2848, 2849, and 2917.</text>
										</subparagraph></paragraph></subsection><subsection id="id1562de23-c464-45fb-8057-61d04900ffcf"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id5bd10f68-8401-4a59-8b0b-6edffc83a229"><enum>(1)</enum><text>The Secretary of
				the Interior, in cooperation with the State of New Mexico (acting through the
				Interstate Stream Commission), shall develop any terms and procedures for the
				storage, accounting, and release of water in the top water bank that are
				necessary to comply with subsection (c).</text>
									</paragraph><paragraph id="id7e1a5eff-bedb-48ab-84d4-f328e46d5f28" indent="up1"><enum>(2)</enum><text>The terms and procedures developed
				under paragraph (1) shall include provisions requiring that—</text>
										<subparagraph id="id603c1df0-674f-48f4-8747-d2d8ab4a34d3"><enum>(A)</enum><text>the storage of banked water shall be
				subject to approval under State law by the New Mexico State Engineer to ensure
				that impairment of any existing water right does not occur, including storage
				of water under New Mexico State Engineer File No. 2849;</text>
										</subparagraph><subparagraph id="ide2ca9311-e58c-4c3b-8823-fc64184060ab"><enum>(B)</enum><text>water in the top water bank be subject
				to evaporation and other losses during storage;</text>
										</subparagraph><subparagraph id="idc1be0a90-60e6-4918-8d22-849037790e03"><enum>(C)</enum><text>water in the top water bank be
				released for delivery to the owner or assigns of the banked water on request of
				the owner, subject to reasonable scheduling requirements for making the
				release;</text>
										</subparagraph><subparagraph id="ide27ffbe3-4af0-4f0a-a189-ac6d7011e62a"><enum>(D)</enum><text>water in the top water bank be the
				first water spilled or released for flood control purposes in anticipation of a
				spill, on the condition that top water bank water shall not be released or
				included for purposes of calculating whether a release should occur for
				purposes of satisfying the flow recommendations of the San Juan River Basin
				Recovery Implementation Program; and</text>
										</subparagraph><subparagraph id="IDa093430fd10d497982339521add63a81"><enum>(E)</enum><text>water eligible for banking in the top
				water bank shall be water that otherwise would have been diverted and
				beneficially used in New Mexico that year.</text>
										</subparagraph></paragraph></subsection><subsection id="id0d50cafa-bc06-4186-8877-833f64fc472d"><enum>(e)</enum><text>The Secretary
				of the Interior may charge fees to water users that use the top water bank in
				amounts sufficient to cover the costs incurred by the United States in
				administering the water
				bank.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section id="idb99c06e8-0904-4699-bf50-b6c4bdf5adf5"><enum>102.</enum><header>Amendments
			 to Public Law 87–483</header>
				<subsection id="ide3218ba9-bdc5-4c4b-b89b-4cc29cbb674f"><enum>(a)</enum><header>Navajo
			 Indian Irrigation Project</header><text>Public Law 87–483 (76 Stat. 96) is
			 amended by striking section 2 and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idc7f514d9-4868-4a52-9a7e-1240aa21debf" style="traditional">
						<section id="id9806671b-3881-40e9-965b-6250f8e72133"><enum>2.</enum><subsection commented="no" display-inline="yes-display-inline" id="idbe8d97a0-4e93-44c5-8f7d-e8ba5781cac0"><enum>(a)</enum><text>In accordance with
				the Act of April 11, 1956 (commonly known as the <quote>Colorado River Storage
				Project Act</quote>) (43 U.S.C. 620 et seq.), the Secretary of the Interior is
				authorized to construct, operate, and maintain the Navajo Indian Irrigation
				Project to provide irrigation water to a service area of not more than 110,630
				acres of land.</text>
							</subsection><subsection id="idd771fb46-1e2a-4725-8cd4-2c5a93207a36"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id27f2dcd5-ba9b-4c53-8242-b1071c09679f"><enum>(1)</enum><text>Subject to
				paragraph (2), the average annual diversion by the Navajo Indian Irrigation
				Project from the Navajo Reservoir over any consecutive 10-year period shall be
				the lesser of—</text>
									<subparagraph id="idd7993409-1ce2-4db4-ba24-11fa6e022367" indent="up1"><enum>(A)</enum><text>508,000 acre-feet per year; or</text>
									</subparagraph><subparagraph id="idb7e96c98-5996-4d68-9c6b-0168986c4873" indent="up1"><enum>(B)</enum><text>the quantity of water necessary to
				supply an average depletion of 270,000 acre-feet per year.</text>
									</subparagraph></paragraph><paragraph id="id344efb39-7cd2-4f80-85ce-c027b0ebb256" indent="up1"><enum>(2)</enum><text>The quantity of water diverted for
				any 1 year shall not exceed the average annual diversion determined under
				paragraph (1) by more than 15 percent.</text>
								</paragraph></subsection><subsection id="id6eee1986-0ef7-457c-acc6-2c98b7842cce"><enum>(c)</enum><text>In addition
				to being used for irrigation, the water diverted by the Navajo Indian
				Irrigation Project under subsection (b) may be used within the area served by
				Navajo Indian Irrigation Project facilities for the following purposes:</text>
								<paragraph id="id1651b14e-bcad-4c82-b060-06cbb19ef42d"><enum>(1)</enum><text>Aquaculture
				purposes, including the rearing of fish in support of the San Juan River Basin
				Recovery Implementation Program authorized by Public Law 106–392 (114 Stat.
				1602).</text>
								</paragraph><paragraph id="id217ce0d2-044f-4f34-a548-b7fac38648be"><enum>(2)</enum><text>Domestic,
				industrial, or commercial purposes relating to agricultural production and
				processing.</text>
								</paragraph><paragraph id="id80524eed-d3b1-4a8a-89ad-8abc61a5ef8c"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id3428B19F7F3443CBA81D859973020F18"><enum>(A)</enum><text>The generation of
				hydroelectric power as an incident to the diversion of water by the Navajo
				Indian Irrigation Project for authorized purposes.</text>
									</subparagraph><subparagraph id="idB85DCABF25BA4E1DB90F75809F1EDF2F" indent="up1"><enum>(B)</enum><text>Notwithstanding any other provision of
				law—</text>
										<clause id="id8B327CEDBA09439786B4769773D05957"><enum>(i)</enum><text>any hydroelectric power generated
				under this paragraph shall be used or marketed by the Navajo Nation;</text>
										</clause><clause id="idFA22801C7E954C518193AE52991CF6D7"><enum>(ii)</enum><text>the Navajo Nation shall retain any
				revenues from the sale of the hydroelectric power; and</text>
										</clause><clause id="id7F157BC63FD44C74B5B5C35FD4BD86A3"><enum>(iii)</enum><text>the United States shall have no
				trust obligation to monitor, administer, or account for the revenues received
				by the Navajo Nation, or the expenditure of the revenues.</text>
										</clause></subparagraph></paragraph><paragraph id="id0cc253c4-b603-4805-b1d3-0a6b1aa9d478"><enum>(4)</enum><text>The
				implementation of the alternate water source provisions described in
				subparagraph 9.2 of the agreement executed under section 401(a)(2) of the
				<short-title>Northwestern New Mexico Rural Water Projects
				Act</short-title>.</text>
								</paragraph></subsection><subsection id="id40278990-9d69-4637-b801-ac0ea988adc6"><enum>(d)</enum><text>The Navajo
				Indian Irrigation Project water diverted under subsection (b) may be
				transferred to areas located within or outside the area served by Navajo Indian
				Irrigation Project facilities, and within or outside the boundaries of the
				Navajo Nation, for any beneficial use in accordance with—</text>
								<paragraph id="id370c4465-561d-46f1-8269-d5c901157bd5"><enum>(1)</enum><text>the agreement
				executed under section 401(a)(2) of the <short-title>Northwestern New Mexico Rural Water Projects
				Act</short-title>;</text>
								</paragraph><paragraph id="id2ea2c83e-bb7d-44ab-b8b3-b2c1fa09fec7"><enum>(2)</enum><text>the contract
				executed under section 304(a)(2)(B) of that Act; and</text>
								</paragraph><paragraph id="id99eb443d-6cdb-4f27-b155-95d155a04409"><enum>(3)</enum><text>any other
				applicable law.</text>
								</paragraph></subsection><subsection id="id2dd436af-30fc-4128-94e0-53811d58f6e1"><enum>(e)</enum><text>The Secretary
				may use the capacity of the Navajo Indian Irrigation Project works to convey
				water supplies for—</text>
								<paragraph id="id0d734022-fe2a-44ce-a4d9-5055b3a4a434"><enum>(1)</enum><text>the
				Navajo-Gallup Water Supply Project under section 302 of the
				<short-title>Northwestern New Mexico Rural Water Projects
				Act</short-title>; or</text>
								</paragraph><paragraph id="id1d5a95c5-fcce-467d-b767-f87db27d505f"><enum>(2)</enum><text>other
				nonirrigation purposes authorized under subsection (c) or (d).</text>
								</paragraph></subsection><subsection id="IDf6f61b0c4c4b4e8793478d78f33906c7"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id444DB57AF9004274A285E8C9F0290184"><enum>(1)</enum><text>Repayment of the costs
				of construction of the project (as authorized in subsection (a)) shall be in
				accordance with the Act of April 11, 1956 (commonly known as the
				<quote>Colorado River Storage Project Act</quote>) (43 U.S.C. 620 et seq.),
				including section 4(d) of that Act.</text>
								</paragraph><paragraph id="id8395c12a-1340-428a-8fd6-3b713475b194" indent="up1"><enum>(2)</enum><text>The Secretary shall not reallocate,
				or require repayment of, construction costs of the Navajo Indian Irrigation
				Project because of the conveyance of water supplies for nonirrigation purposes
				under subsection
				(e).</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="id52fbcaa9-bb0d-4fa5-a996-752d97bde481"><enum>(b)</enum><header>Runoff
			 Above Navajo Dam</header><text>Section 11 of Public Law 87–483 (76 Stat. 100)
			 is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="ide82c202d-dc6c-4533-bfaf-02e2d075715d" style="OLC">
						<subsection id="idd3115678-7ebb-48dc-a442-ee0662e3d279"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idb66731b8-13f3-4023-bf78-6fbace465422"><enum>(1)</enum><text>For purposes of
				implementing in a year of prospective shortage the water allocation procedures
				established by subsection (a), the Secretary of the Interior shall determine
				the quantity of any shortages and the appropriate apportionment of water using
				the normal diversion requirements on the flow of the San Juan River originating
				above Navajo Dam based on the following criteria:</text>
								<subparagraph id="ide0586c27-b135-42e3-8f03-354387b3e74a" indent="up1"><enum>(A)</enum><text>The quantity of diversion or water
				delivery for the current year anticipated to be necessary to irrigate land in
				accordance with cropping plans prepared by contractors.</text>
								</subparagraph><subparagraph id="idb1ca0e39-2401-4c7d-96b7-438f7c03edb2" indent="up1"><enum>(B)</enum><text>The annual diversion or water delivery
				demands for the current year anticipated for non-irrigation uses under water
				delivery contracts, including contracts authorized by the
				<short-title>Northwestern New Mexico Rural Water Projects
				Act</short-title>, but excluding any current demand for surface water for
				placement into aquifer storage for future recovery and use.</text>
								</subparagraph><subparagraph id="ide73526bc-fe09-4712-8f6e-6a75187df820" indent="up1"><enum>(C)</enum><text>An annual normal diversion demand of
				135,000 acre-feet for the initial stage of the San Juan-Chama Project
				authorized by section 8.</text>
								</subparagraph></paragraph><paragraph id="id52ab076e-d10b-4d1b-8514-8fe49600d4fd" indent="up1"><enum>(2)</enum><text>The Secretary shall not include in
				the normal diversion requirements—</text>
								<subparagraph id="id15574a78-263b-42ad-912f-b32510ba7e24"><enum>(A)</enum><text>the quantity of water that reliably
				can be anticipated to be diverted or delivered under a contract from inflows to
				the San Juan River arising below Navajo Dam under New Mexico State Engineer
				File No. 3215; or</text>
								</subparagraph><subparagraph id="id8f80b2ae-2c88-4324-bdeb-44768e40dff0"><enum>(B)</enum><text>the quantity of water anticipated to
				be supplied through reuse.</text>
								</subparagraph></paragraph></subsection><subsection id="id57634fb3-c51a-4320-9ea7-c8b614f69a86"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idd01c19d9-0409-4789-9c76-efd8931c1038"><enum>(1)</enum><text>If the Secretary
				determines that there is a shortage of water under subsection (a), the
				Secretary shall respond to the shortage in the Navajo Reservoir water supply by
				curtailing releases and deliveries in the following order:</text>
								<subparagraph id="idf531d148-7d01-4ad3-8d00-b2e10461a273" indent="up1"><enum>(A)</enum><text>The demand for delivery for uses in
				the State of Arizona under the Navajo-Gallup Water Supply Project authorized by
				section 303 of the <short-title>Northwestern New Mexico
				Rural Water Projects Act</short-title>, excluding the quantity of water
				anticipated to be diverted for the uses from inflows to the San Juan River that
				arise below Navajo Dam in accordance with New Mexico State Engineer File No.
				3215.</text>
								</subparagraph><subparagraph id="id6707acfd-7891-43de-96e4-f1a6511dcb9f" indent="up1"><enum>(B)</enum><text>The demand for delivery for uses
				allocated under paragraph 8.2 of the agreement executed under section 401(a)(2)
				of the <short-title>Northwestern New Mexico Rural Water
				Projects Act</short-title>, excluding the quantity of water anticipated to be
				diverted for such uses under State Engineer File No. 3215.</text>
								</subparagraph><subparagraph id="id54c94377-2838-4e0c-a313-cf19c931219f" indent="up1"><enum>(C)</enum><text>The uses in the State of New Mexico
				that are determined under subsection (d), in accordance with the procedure for
				apportioning the water supply under subsection (a).</text>
								</subparagraph></paragraph><paragraph id="ida6d7ebf9-5b9d-40b0-915a-eebda54ab56b" indent="up1"><enum>(2)</enum><text>For any year for which the Secretary
				determines and responds to a shortage in the Navajo Reservoir water supply, the
				Secretary shall not deliver, and contractors of the water supply shall not
				divert, any of the water supply for placement into aquifer storage for future
				recovery and use.</text>
							</paragraph><paragraph id="id13299fce-d418-45df-8ae2-f2584eaa16ef" indent="up1"><enum>(3)</enum><text>To determine the occurrence and
				amount of any shortage to contracts entered into under this section, the
				Secretary shall not include as available storage any water stored in a top
				water bank in Navajo Reservoir established under section 16(a) of the Act of
				April 11, 1956 (commonly known as the <quote>Colorado River Storage Project
				Act</quote>).</text>
							</paragraph></subsection><subsection id="idb8273316-1a52-4f2a-81de-00105a7044ad"><enum>(f)</enum><text>The Secretary
				of the Interior shall apportion water under subsections (a), (d), and (e) on an
				annual volume basis.</text>
						</subsection><subsection id="id99896370-3877-4a91-b576-595ba2f9d8e8"><enum>(g)</enum><text>The Secretary
				of the Interior may revise a determination of shortages, apportionments, or
				allocations of water under subsections (a), (d), and (e) on the basis of
				information relating to water supply conditions that was not available at the
				time at which the determination was made.</text>
						</subsection><subsection id="id80e2d818-87e9-42e9-89a6-6f15b52acae5"><enum>(h)</enum><text>Nothing in
				this section prohibits the distribution of water in accordance with cooperative
				water agreements between water users providing for a sharing of water
				supplies.</text>
						</subsection><subsection id="id5e247883-914f-4330-8233-69ef6386782e"><enum>(i)</enum><text>Diversions
				under New Mexico State Engineer File No. 3215 shall be distributed, to the
				maximum extent water is available, in proportionate amounts to the diversion
				demands of contractors and subcontractors of the Navajo Reservoir water supply
				that are diverting water below Navajo
				Dam.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="id80f5690c-f35f-422f-b22d-0740a8f1c5b5"><enum>103.</enum><header>Effect on
			 Federal water law</header><text display-inline="no-display-inline">Unless
			 expressly provided in this Act, nothing in this Act modifies, conflicts with,
			 preempts, or otherwise affects—</text>
				<paragraph id="id9239bc0a-dade-4377-b2fe-5ade2e97c634"><enum>(1)</enum><text>the Boulder
			 Canyon Project Act (43 U.S.C. 617 et seq.);</text>
				</paragraph><paragraph id="ida5362a8b-3959-41fc-a579-798a327af384"><enum>(2)</enum><text>the Boulder
			 Canyon Project Adjustment Act (54 Stat. 774, chapter 643);</text>
				</paragraph><paragraph id="idd31163c8-6a8a-4d22-b0ba-39ac1bde0c6d"><enum>(3)</enum><text>the Act of
			 April 11, 1956 (commonly known as the <quote>Colorado River Storage Project
			 Act</quote>) (43 U.S.C. 620 et seq.);</text>
				</paragraph><paragraph id="id91b360f7-a7a7-4850-babf-222d015b9212"><enum>(4)</enum><text>the Act of
			 September 30, 1968 (commonly known as the <quote>Colorado River Basin Project
			 Act</quote>) (82 Stat. 885);</text>
				</paragraph><paragraph id="id76ce0e82-ba5d-426f-938c-8d138761dc75"><enum>(5)</enum><text>Public Law

				</paragraph></section></title><title id="id6f038ad5-6d22-4d10-a5fa-4796c36a03e6"><enum>II</enum><header>Reclamation
			 Water Settlements Fund </header>
			<section id="iddff3955d-0b98-49fd-bb34-45577c4405dd"><enum>201.</enum><header>Reclamation
			 Water Settlements Fund</header>
				<subsection id="id0dd943db-c69b-4ca0-a552-e27aa9bc18c6"><enum>(a)</enum><header>Establishment</header><text>There
			 is established in the Treasury of the United States a fund, to be known as the
			 <quote>Reclamation Water Settlements Fund</quote>, consisting of—</text>
					<paragraph id="id06e9f1cf-4ef3-46f5-84e4-c28625a83f55"><enum>(1)</enum><text>such amounts
			 as are deposited to the Fund under subsection (b); and</text>
					</paragraph><paragraph id="id1a483b33-2f41-4207-a3a8-a7bfb568ee01"><enum>(2)</enum><text>any interest
			 earned on investment of amounts in the Fund under subsection (d).</text>
					</paragraph></subsection><subsection id="id962dbaab-c26a-44ae-9c37-c4de60b18280"><enum>(b)</enum><header>Deposits to
			 Fund</header>
					<paragraph id="id173855cd-c9b5-4ac8-aa31-3024f05c53d9"><enum>(1)</enum><header>In
			 general</header><text>For each of fiscal years 2009 through 2023, the Secretary
			 of the Treasury shall deposit in the Fund, if available, $120,000,000 of the
			 revenues that would otherwise be deposited for the fiscal year in the fund
			 established by the first section of the Act of June 17, 1902 (32 Stat. 388,
			 chapter 1093).</text>
					</paragraph><paragraph id="id6a929027-a96c-4302-bc8c-8f8dfb950d9f"><enum>(2)</enum><header>Availability
			 of amounts</header><text>Amounts deposited in the Fund under paragraph (1)
			 shall be made available pursuant to this section—</text>
						<subparagraph id="ide001f09d-1900-4485-afeb-36debc385435"><enum>(A)</enum><text>without
			 further appropriation; and</text>
						</subparagraph><subparagraph id="id7c73a34d-6e87-4d4d-b41c-a2096582b351"><enum>(B)</enum><text>in addition
			 to amounts appropriated pursuant to any authorization contained in any other
			 provision of law.</text>
						</subparagraph></paragraph></subsection><subsection id="id3ec2849e-0df7-4f7b-92b1-3a4030522825"><enum>(c)</enum><header>Expenditures
			 from Fund</header>
					<paragraph id="ide2c85844-d04f-486e-b87d-be678312d7fb"><enum>(1)</enum><header>In
			 general</header>
						<subparagraph id="idA3DAB753B0FB41168149F56B08B73CB0"><enum>(A)</enum><header>Expenditures</header><text>Subject
			 to subparagraph (B), for each of fiscal years 2009 through 2028, the Secretary
			 may expend from the Fund an amount not to exceed $120,000,000, plus the
			 interest accrued in the Fund, for the fiscal year in which expenditures are
			 made pursuant to paragraphs (2) and (3).</text>
						</subparagraph><subparagraph id="id7C6B9875BF274927809D0BDBAC98FBD3"><enum>(B)</enum><header>Additional
			 expenditures</header><text>The Secretary may expend more than $120,000,000 for
			 any fiscal year if such amounts are available in the Fund due to expenditures
			 not reaching $120,000,000 for prior fiscal years.</text>
						</subparagraph></paragraph><paragraph id="id6f572fcd-83ab-4d73-89b7-79bda1aec279"><enum>(2)</enum><header>Authority</header><text>The
			 Secretary may expend money from the Fund to implement a settlement agreement
			 approved by Congress that resolves, in whole or in part, litigation involving
			 the United States, if the settlement agreement or implementing legislation
			 requires the Bureau of Reclamation to provide financial assistance for, or
			 plan, design, and construct—</text>
						<subparagraph id="id8cb49a25-b7a2-4552-9c52-c8bbce2b8ee7"><enum>(A)</enum><text>water supply
			 infrastructure; or</text>
						</subparagraph><subparagraph id="id5a2105dc-aab0-4a11-8d0d-c26edc413330"><enum>(B)</enum><text>a
			 project—</text>
							<clause id="ida7a70aca-7e0e-490b-9d99-086877c2037c"><enum>(i)</enum><text>to
			 rehabilitate a water delivery system to conserve water; or</text>
							</clause><clause id="idac60fedd-4847-4cdf-9742-b57164cb83d7"><enum>(ii)</enum><text>to restore
			 fish and wildlife habitat or otherwise improve environmental conditions
			 associated with or affected by, or located within the same river basin as, a
			 Federal reclamation project that is in existence on the date of enactment of
			 this Act.</text>
							</clause></subparagraph></paragraph><paragraph id="id5c6306a1-2701-49d4-95c3-587ddc85c90b"><enum>(3)</enum><header>Use for
			 completion of project and other settlements</header>
						<subparagraph id="id2c50c0e9-ac4f-4fce-8d06-732916c57744"><enum>(A)</enum><header>Priorities</header>
							<clause id="idbb3e7d2c-b7c7-4d1a-bf42-9247b35f3fa8"><enum>(i)</enum><header>First
			 priority</header>
								<subclause id="id677D687C449542E88FE61A937C631E9D"><enum>(I)</enum><header>In
			 general</header><text>The first priority for expenditure of amounts in the Fund
			 during the entire period in which the Fund is in existence shall be for the
			 purposes described in, and in the order of, clauses (i) through (iv) of
			 subparagraph (B).</text>
								</subclause><subclause id="id40AA19CF353C4398A39EED4A1532B761"><enum>(II)</enum><header>Reserved
			 amounts</header><text>The Secretary shall reserve amounts deposited into the
			 Fund in accordance with subclause (I).</text>
								</subclause></clause><clause id="id94df6cf7-a351-4a97-9d93-cd41564c4e8c"><enum>(ii)</enum><header>Other
			 purposes</header><text>Any amounts in the Fund that are not needed for the
			 purposes described in subparagraph (B) may be used for other purposes
			 authorized in paragraph (2).</text>
							</clause></subparagraph><subparagraph id="ID8c50ec8955414d59813ccd4ccc768600"><enum>(B)</enum><header>Completion of
			 project</header>
							<clause id="id56E90E03059E43E18C66C66DE571C358"><enum>(i)</enum><header>Navajo-Gallup
			 Water Supply Project</header>
								<subclause id="idE1F5A0D25869465C881F1372856629A9"><enum>(I)</enum><header>In
			 general</header><text>Subject to subclause (II), effective beginning January 1,
			 2009, if, in the judgment of the Secretary on an annual basis the deadline
			 described in section 401(f)(1)(A)(ix) is unlikely to be met because a
			 sufficient amount of funding is not otherwise available through appropriations
			 made available pursuant to section 309(a), the Secretary shall expend from the
			 Fund such amounts on an annual basis consistent with paragraphs (1) and (2), as
			 are necessary to pay the Federal share of the costs, and substantially complete
			 as expeditiously as practicable, the construction of the water supply
			 infrastructure authorized as part of the Project.</text>
								</subclause><subclause id="idBA810254F28749288EC308FBF7852B26"><enum>(II)</enum><header>Maximum
			 amount</header>
									<item id="id08C94C0EFB224836A6897BD763EEF0FF"><enum>(aa)</enum><header>In
			 general</header><text>Except as provided under item (bb), the amount expended
			 under subclause (I) shall not exceed $500,000,000 for the period of fiscal
			 years 2009 through 2018.</text>
									</item><item id="idDC33C70C571443C4BB1D250B286FFA95"><enum>(bb)</enum><header>Exception</header><text>The
			 limitation on the expenditure amount under item (aa) may be exceeded during the
			 entire period in which the Fund is in existence.</text>
									</item></subclause></clause><clause id="IDa65cf1ba57b44dd38083c431e7a41bcb"><enum>(ii)</enum><header>Other New
			 Mexico settlements</header>
								<subclause id="id473AB6D0D90D4FE5A213CA8C160B1E1B"><enum>(I)</enum><header>In
			 general</header><text>Subject to subclause (II), effective beginning January 1,
			 2009, in addition to the funding made available under clause (i), if in the
			 judgment of the Secretary on an annual basis a sufficient amount of funding is
			 not otherwise available through annual appropriations, the Secretary shall
			 expend from the Fund such amounts on an annual basis consistent with paragraphs
			 (1) and (2), as are necessary to pay the Federal share of the costs of
			 implementing the Indian water rights settlement agreements entered into by the
			 State of New Mexico in the Aamodt adjudication and the Abeyta adjudication, if
			 such settlements are subsequently approved and authorized by an Act of
			 Congress.</text>
								</subclause><subclause id="id1EC0661051404692BDD60AC730F357A8"><enum>(II)</enum><header>Maximum
			 amount</header><text>The amount expended under subclause (I) shall not exceed
			 $250,000,000.</text>
								</subclause></clause><clause id="ID7ece8d85fdc244c384080cd13165ec81"><enum>(iii)</enum><header>Montana
			 settlements</header>
								<subclause id="id354FE383EA01479984970D4D9688D8F7"><enum>(I)</enum><header>In
			 general</header><text>Subject to subclause (II), effective beginning January 1,
			 2009, in addition to funding made available pursuant to clauses (i) and (ii),
			 if in the judgment of the Secretary on an annual basis a sufficient amount of
			 funding is not otherwise available through annual appropriations, the Secretary
			 shall expend from the Fund such amounts on an annual basis consistent with
			 paragraphs (1) and (2), as are necessary to pay the Federal share of the costs
			 of implementing Indian water rights settlement agreements entered into by the
			 State of Montana with the Blackfeet Tribe, the Crow Tribe, or the Gros Ventre
			 and Assiniboine Tribes of the Fort Belknap Indian Reservation in the judicial
			 proceeding entitled <quote>In re the General Adjudication of All the Rights to
			 Use Surface and Groundwater in the State of Montana</quote>, if a settlement or
			 settlements are subsequently approved and authorized by an Act of
			 Congress.</text>
								</subclause><subclause id="idF1F364B808064DED978EC17390B4E978"><enum>(II)</enum><header>Maximum
			 amount</header>
									<item id="idEA864033F4BD4B209D9F05A72F534138"><enum>(aa)</enum><header>In
			 general</header><text>Except as provided under item (bb), the amount expended
			 under subclause (I) shall not exceed $350,000,000 for the period of fiscal
			 years 2009 through 2018.</text>
									</item><item id="id5454EE44E05B40EF9587E2C5CB618EDC"><enum>(bb)</enum><header>Exception</header><text>The
			 limitation on the expenditure amount under item (aa) may be exceeded during the
			 entire period in which the Fund is in existence.</text>
									</item><item id="idEAF3D87DDB6D4AE1AAD593DAD9713E26"><enum>(cc)</enum><header>Other
			 funding</header><text>The Secretary shall ensure that any such funding shall be
			 provided in a manner that does not limit the funding available pursuant to
			 clauses (i) and (ii).</text>
									</item></subclause></clause><clause id="IDb6f8b4a73c8f478686a9c04337e9fd97"><enum>(iv)</enum><header>Arizona
			 settlement</header>
								<subclause id="id6F08B34AD7814A928436A55812237FD0"><enum>(I)</enum><header>In
			 general</header><text>Subject to subclause (II), effective beginning January 1,
			 2009, in addition to funding made available pursuant to clauses (i), (ii), and
			 (iii), if in the judgment of the Secretary on an annual basis a sufficient
			 amount of funding is not otherwise available through annual appropriations, the
			 Secretary shall expend from the Fund such amounts on an annual basis consistent
			 with paragraphs (1) and (2), as are necessary to pay the Federal share of the
			 costs of implementing an Indian water rights settlement agreement entered into
			 by the State of Arizona with the Navajo Nation to resolve the water rights
			 claims of the Nation in the Lower Colorado River basin in Arizona, if a
			 settlement is subsequently approved and authorized by an Act of
			 Congress.</text>
								</subclause><subclause id="idF930C5F1A47D454BAC8D6F8C4815F41E"><enum>(II)</enum><header>Maximum
			 amount</header>
									<item id="idC9EC5AFD3FC94FD198F6FE040230C5F8"><enum>(aa)</enum><header>In
			 general</header><text>Except as provided under item (bb), the amount expended
			 under subclause (I) shall not exceed $100,000,000 for the period of fiscal
			 years 2009 through 2018.</text>
									</item><item id="id9D80A01FF6D84EA78345D7E5AEFF6866"><enum>(bb)</enum><header>Exception</header><text>The
			 limitation on the expenditure amount under item (aa) may be exceeded during the
			 entire period in which the Fund is in existence.</text>
									</item><item id="id1FF1B2130D174102804C19B697A639AA"><enum>(cc)</enum><header>Other
			 funding</header><text>The Secretary shall ensure that any such funding shall be
			 provided in a manner that does not limit the funding available pursuant to
			 clauses (i) and (ii).</text>
									</item></subclause></clause></subparagraph><subparagraph id="ID004e3b52f8e54a77a8861ab60581996d"><enum>(C)</enum><header>Reversion</header><text>If
			 the settlements described in clauses (ii) through (iv) of subparagraph (B) have
			 not been approved and authorized by an Act of Congress by December 31, 2014,
			 the amounts reserved for the settlements shall no longer be reserved by the
			 Secretary pursuant to subparagraph (A)(i) and shall revert to the Fund for any
			 authorized use, as determined by the Secretary.</text>
						</subparagraph></paragraph></subsection><subsection id="idc185fb0b-4341-491e-9eed-d3ff4fab36c5"><enum>(d)</enum><header>Investment
			 of amounts</header>
					<paragraph id="ide674a369-70a0-48f6-98ca-6e31ea815010"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall invest such portion of the Fund as is
			 not, in the judgment of the Secretary, required to meet current
			 withdrawals.</text>
					</paragraph><paragraph id="id6239defd-11c3-49b2-93c9-166ef35c95ba"><enum>(2)</enum><header>Credits to
			 Fund</header><text>The interest on, and the proceeds from the sale or
			 redemption of, any obligations held in the Fund shall be credited to, and form
			 a part of, the Fund.</text>
					</paragraph></subsection><subsection id="id0a69b993-536d-4dd4-ab16-347af3eb18eb"><enum>(e)</enum><header>Transfers
			 of amounts</header>
					<paragraph id="idf9386c56-fa11-4a56-a6c8-2c9c0e809f94"><enum>(1)</enum><header>In
			 general</header><text>The amounts required to be transferred to the Fund under
			 this section shall be transferred at least monthly from the general fund of the
			 Treasury to the Fund on the basis of estimates made by the Secretary of the
			 Treasury.</text>
					</paragraph><paragraph commented="no" id="id39a07c43-9d80-484e-a2d6-90b5193b4e10"><enum>(2)</enum><header>Adjustments</header><text>Proper
			 adjustment shall be made in amounts subsequently transferred to the extent
			 prior estimates were in excess of or less than the amounts required to be
			 transferred.</text>
					</paragraph></subsection><subsection commented="no" id="id8d7a234c-126f-4f0d-bcfb-b3524a18c5ad"><enum>(f)</enum><header>Termination</header><text>On
			 September 30, 2028—</text>
					<paragraph id="id47ba716b-ee42-4a7c-b278-9237923e9bcc"><enum>(1)</enum><text>the Fund
			 shall terminate; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb95aa4e9-a930-4aeb-911e-09b1dda181ed"><enum>(2)</enum><text>the
			 unexpended and unobligated balance of the Fund shall be transferred to the
			 appropriate fund of the Treasury.</text>
					</paragraph></subsection></section></title><title id="id8fd5f67a-962c-4a03-8284-827687651b1a"><enum>III</enum><header>Navajo-Gallup
			 Water Supply Project</header>
			<section id="id8bb02632-141a-449e-bde3-d7347aeefd4a"><enum>301.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this subtitle are—</text>
				<paragraph id="idc8bd4160-7241-47e2-9969-e61d5fccebdc"><enum>(1)</enum><text>to authorize
			 the Secretary to construct, operate, and maintain the Navajo-Gallup Water
			 Supply Project;</text>
				</paragraph><paragraph id="id75a33758-7074-413b-a17e-9611098fa3f7"><enum>(2)</enum><text>to allocate
			 the capacity of the Project among the Nation, the City, and the Jicarilla
			 Apache Nation; and</text>
				</paragraph><paragraph id="ida0cff2ce-3a3a-4cb6-8c51-313faf64582b"><enum>(3)</enum><text>to authorize
			 the Secretary to enter into Project repayment contracts with the City and the
			 Jicarilla Apache Nation.</text>
				</paragraph></section><section id="id054dfa95-1087-409c-9a73-9c9385510cf3"><enum>302.</enum><header>Authorization
			 of Navajo-Gallup Water Supply Project</header>
				<subsection id="id76a13b61-7fa3-4124-9705-d13a8ff6c3a8"><enum>(a)</enum><header>In
			 General</header><text>The Secretary, acting through the Commissioner of
			 Reclamation, is authorized to design, construct, operate, and maintain the
			 Project in substantial accordance with the preferred alternative in the Draft
			 Impact Statement.</text>
				</subsection><subsection id="id87c49b8c-1efa-418a-a79c-b3d3b1e83de6"><enum>(b)</enum><header>Project
			 facilities</header><text>To provide for the delivery of San Juan River water to
			 Project Participants, the Secretary may construct, operate, and maintain the
			 Project facilities described in the preferred alternative in the Draft Impact
			 Statement, including:</text>
					<paragraph id="id3171e998-98f6-44ce-874a-c7e9cb2ce2ac"><enum>(1)</enum><text>A pumping
			 plant on the San Juan River in the vicinity of Kirtland, New Mexico.</text>
					</paragraph><paragraph id="id73a24072-d8a5-40df-b538-39875b486aed"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id72ffd6a8-6c2e-4032-a564-e694a8fc67d0"><enum>(A)</enum><text>A main pipeline
			 from the San Juan River near Kirtland, New Mexico, to Shiprock, New Mexico, and
			 Gallup, New Mexico, which follows United States Highway 491.</text>
						</subparagraph><subparagraph id="id631e953b-a5d4-4131-842a-2de771181bd2" indent="up1"><enum>(B)</enum><text>Any pumping plants associated with the
			 pipeline authorized under subparagraph (A).</text>
						</subparagraph></paragraph><paragraph id="id3281f4ac-722c-412a-9e8f-f87b62d3626c"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id5ac0d5df-a35b-48e3-8c1f-a5edba7efc88"><enum>(A)</enum><text>A main pipeline
			 from Cutter Reservoir to Ojo Encino, New Mexico, which follows United States
			 Highway 550.</text>
						</subparagraph><subparagraph id="id5a2fe20b-03af-46ab-a538-a36308f1f60c" indent="up1"><enum>(B)</enum><text>Any pumping plants associated with the
			 pipeline authorized under subparagraph (A).</text>
						</subparagraph></paragraph><paragraph id="id56937bbd-1c96-4c98-b517-dcfaebfbb6af"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id3f90cefd-4e6e-48cb-b224-be6b32fe988e"><enum>(A)</enum><text>Lateral pipelines
			 from the main pipelines to Nation communities in the States of New Mexico and
			 Arizona.</text>
						</subparagraph><subparagraph id="iddb5f6b86-b3c5-490a-bae0-5b4208a3cc7d" indent="up1"><enum>(B)</enum><text>Any pumping plants associated with the
			 pipelines authorized under subparagraph (A).</text>
						</subparagraph></paragraph><paragraph id="id842fef5b-4499-40d9-800a-00a8da1a737f"><enum>(5)</enum><text>Any water
			 regulation, storage or treatment facility, service connection to an existing
			 public water supply system, power substation, power distribution works, or
			 other appurtenant works (including a building or access road) that is related
			 to the Project facilities authorized by paragraphs (1) through (4), including
			 power transmission facilities and associated wheeling services to connect
			 Project facilities to existing high-voltage transmission facilities and deliver
			 power to the Project.</text>
					</paragraph></subsection><subsection id="idaf0810a2-7716-4f18-b7e2-0c78d807956f"><enum>(c)</enum><header>Acquisition
			 of land</header>
					<paragraph id="id8fcdbd48-a48b-49d2-96df-4febb6f711e0"><enum>(1)</enum><header>In
			 general</header><text>The Secretary is authorized to acquire any land or
			 interest in land that is necessary to construct, operate, and maintain the
			 Project facilities authorized under subsection (b).</text>
					</paragraph><paragraph id="ID984773c433bc42bb85d7a79c67b1743a"><enum>(2)</enum><header>Land of the
			 project participants</header><text>As a condition of construction of the
			 facilities authorized under this title, the Project Participants shall provide
			 all land or interest in land, as appropriate, that the Secretary identifies as
			 necessary for acquisition under this subsection at no cost to the
			 Secretary.</text>
					</paragraph><paragraph id="idb23813a4-300b-4212-a4b5-5af93cbee576"><enum>(3)</enum><header>Limitation</header><text>The
			 Secretary may not condemn water rights for purposes of the Project.</text>
					</paragraph></subsection><subsection id="idb94f9ad6-f42c-4c86-a916-ef4a953a40e2"><enum>(d)</enum><header>Conditions</header>
					<paragraph id="id437235a1-6068-498b-958b-445139e2c878"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), the Secretary shall
			 not commence construction of the facilities authorized under subsection (b)
			 until such time as—</text>
						<subparagraph id="id6a993048-c081-48af-b273-cd17cd5cad93"><enum>(A)</enum><text>the Secretary
			 executes the Agreement and the Contract;</text>
						</subparagraph><subparagraph id="id3cfb4e7f-ca43-4318-8d00-5fd849be3407"><enum>(B)</enum><text>the contracts
			 authorized under section 304 are executed;</text>
						</subparagraph><subparagraph id="id96b44e4d-d594-4c30-9982-becc64981a6d"><enum>(C)</enum><text>the
			 Secretary—</text>
							<clause id="id2ffab727-8027-4d78-9f19-4bd758caa15a"><enum>(i)</enum><text>completes an
			 environmental impact statement for the Project; and</text>
							</clause><clause id="id97dac307-78ee-41c3-a440-b0fff593b24b"><enum>(ii)</enum><text>has issued a
			 record of decision that provides for a preferred alternative; and</text>
							</clause></subparagraph><subparagraph id="id7059f0b8-8c06-46fb-9d59-d1811c5dce19"><enum>(D)</enum><text>the Secretary
			 has entered into an agreement with the State of New Mexico under which the
			 State of New Mexico will provide a share of the construction costs of the
			 Project of not less than $50,000,000, except that the State of New Mexico shall
			 receive credit for funds the State has contributed to construct water
			 conveyance facilities to the Project Participants to the extent that the
			 facilities reduce the cost of the Project as estimated in the Draft Impact
			 Statement.</text>
						</subparagraph></paragraph><paragraph id="IDe0a3ad77dcf34b8fb09215d0519f885a"><enum>(2)</enum><header>Exception</header><text>If
			 the Jicarilla Apache Nation elects not to enter into a contract pursuant to
			 section 304, the Secretary, after consulting with the Nation, the City, and the
			 State of New Mexico acting through the Interstate Stream Commission, may make
			 appropriate modifications to the scope of the Project and proceed with Project
			 construction if all other conditions for construction have been
			 satisfied.</text>
					</paragraph><paragraph id="IDb731d4e48b794dc595a29755369d8f14"><enum>(3)</enum><header>Effect of
			 Indian Self-Determination and Education Assistance Act</header><text>The Indian
			 Self-Determination and Education Assistance Act (25 U.S.C. 450 et seq.) shall
			 not apply to the design, construction, operation, maintenance, or replacement
			 of the Project.</text>
					</paragraph></subsection><subsection id="id2b5d0299-1ce0-4731-b39f-0fd174de047d"><enum>(e)</enum><header>Power</header><text>The
			 Secretary shall reserve, from existing reservations of Colorado River Storage
			 Project power for Bureau of Reclamation projects, up to 26 megawatts of power
			 for use by the Project.</text>
				</subsection><subsection id="id194e8168-734e-4c95-ba5d-d3295af6a43c"><enum>(f)</enum><header>Conveyance
			 of title to project facilities</header>
					<paragraph id="ID0ca04bba83a44f6fa8d59786b75443d3"><enum>(1)</enum><header>In
			 general</header><text>The Secretary is authorized to enter into separate
			 agreements with the City and the Nation and, on entering into the agreements,
			 shall convey title to each Project facility or section of a Project facility
			 authorized under subsection (b) (including any appropriate interests in land)
			 to the City and the Nation after—</text>
						<subparagraph id="IDccfbac780d054c52a793f319703f4221"><enum>(A)</enum><text>completion of
			 construction of a Project facility or a section of a Project facility that is
			 operating and delivering water; and</text>
						</subparagraph><subparagraph id="ideef88030-429e-4209-9d8e-1d7a8e62bc91"><enum>(B)</enum><text>execution of
			 a Project operations agreement approved by the Secretary and the Project
			 Participants that sets forth—</text>
							<clause id="id6c101bef-4335-4850-8e18-b650bc802705"><enum>(i)</enum><text>any terms and
			 conditions that the Secretary determines are necessary—</text>
								<subclause id="idac8a4c99-151b-4b93-b537-b9f33a9cf605"><enum>(I)</enum><text>to ensure the
			 continuation of the intended benefits of the Project; and</text>
								</subclause><subclause id="id743739f8-3f6a-4f93-b934-a99f7f0e3252"><enum>(II)</enum><text>to fulfill
			 the purposes of this subtitle;</text>
								</subclause></clause><clause id="id2e61933c-5bb1-483b-b4ff-e11fa166d7cd"><enum>(ii)</enum><text>requirements
			 acceptable to the Secretary and the Project Participants for—</text>
								<subclause id="id9a6cf849-2e10-447e-a282-a9b709bdae32"><enum>(I)</enum><text>the
			 distribution of water under the Project or section of a Project facility;
			 and</text>
								</subclause><subclause id="ide5444ffe-c17a-49e6-a039-f59584af16a7"><enum>(II)</enum><text>the
			 allocation and payment of annual operation, maintenance, and replacement costs
			 of the Project or section of a Project facility based on the proportionate uses
			 of Project facilities; and</text>
								</subclause></clause><clause id="id06c7782f-c811-40d2-a387-d606766f1e6b"><enum>(iii)</enum><text>conditions
			 and requirements acceptable to the Secretary and the Project Participants for
			 operating and maintaining each Project facility on completion of the conveyance
			 of title, including the requirement that the City and the Nation shall—</text>
								<subclause id="id1473c06f-2aee-47c1-9781-741010535dcf"><enum>(I)</enum><text>comply
			 with—</text>
									<item id="id72ef419c-4dab-4dd4-8ff2-d7a3ecffe7c0"><enum>(aa)</enum><text>the Compact;
			 and</text>
									</item><item id="id2ea3318f-1e58-4aa1-9d5b-4c9c8462b629"><enum>(bb)</enum><text>other
			 applicable law; and</text>
									</item></subclause><subclause id="ide25032e1-03f5-4b6c-b6d9-795fd6f792f6"><enum>(II)</enum><text>be
			 responsible for—</text>
									<item id="id13d6de7d-bee4-4112-a97f-293b853d5484"><enum>(aa)</enum><text>the
			 operation, maintenance, and replacement of each Project facility; and</text>
									</item><item id="id99b978f3-04b1-4f7e-8838-dbd392d9b080"><enum>(bb)</enum><text>the
			 accounting and management of water conveyance and Project finances, as
			 necessary to administer and fulfill the conditions of the Contract executed
			 under section 304(a)(2)(B).</text>
									</item></subclause></clause></subparagraph></paragraph><paragraph id="idc30fbb3c-7cdb-4e3a-a30a-f317dfedc697"><enum>(2)</enum><header>Effect of
			 conveyance</header><text>The conveyance of title to each Project facility shall
			 not affect the application of the Endangered Species Act of 1973 (16 U.S.C.
			 1531 et seq.) relating to the use of the water associated with the
			 Project.</text>
					</paragraph><paragraph id="IDb41d2d864d7c4cb79981153b41e3680e"><enum>(3)</enum><header>Liability</header>
						<subparagraph id="id950CE106D0FC452CB9F3C66AC80D9621"><enum>(A)</enum><header>In
			 general</header><text>Effective on the date of the conveyance authorized by
			 this subsection, the United States shall not be held liable by any court for
			 damages of any kind arising out of any act, omission, or occurrence relating to
			 the land, buildings, or facilities conveyed under this subsection, other than
			 damages caused by acts of negligence committed by the United States, or by
			 employees or agents of the United States, prior to the date of
			 conveyance.</text>
						</subparagraph><subparagraph id="id22D26779506C47AB937B6D2E1F9C86A5"><enum>(B)</enum><header>Tort
			 claims</header><text>Nothing in this section increases the liability of the
			 United States beyond the liability provided in chapter 171 of title 28, United
			 States Code (commonly known as the <quote>Federal Tort Claims
			 Act</quote>).</text>
						</subparagraph></paragraph><paragraph id="id986dfd55-4b9c-4e56-96d0-46dab8b82837"><enum>(4)</enum><header>Notice of
			 proposed conveyance</header><text>Not later than 45 days before the date of a
			 proposed conveyance of title to any Project facility, the Secretary shall
			 submit to the Committee on Resources of the House of Representatives and to the
			 Committee on Energy and Natural Resources of the Senate notice of the
			 conveyance of each Project facility.</text>
					</paragraph></subsection><subsection id="id8b63eed9-afdd-437d-b5c4-aaa02bbe5b88"><enum>(g)</enum><header>Colorado
			 river storage project power</header><text display-inline="yes-display-inline">The conveyance of Project facilities under
			 subsection (f) shall not affect the availability of Colorado River Storage
			 Project power to the Project under subsection (e).</text>
				</subsection><subsection id="id8d196753-c1bf-4b99-b55c-d67087e23ef4"><enum>(h)</enum><header>Regional
			 use of project facilities</header>
					<paragraph id="id7b2b487d-dc04-408d-96be-1214f7b9e42b"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), Project facilities constructed
			 under subsection (b) may be used to treat and convey non-Project water or water
			 that is not allocated by subsection 303(b) if—</text>
						<subparagraph id="id00286458-32af-455d-926b-7208fb563546"><enum>(A)</enum><text>capacity is
			 available without impairing any water delivery to a Project Participant;
			 and</text>
						</subparagraph><subparagraph id="id716e374d-b50d-4235-8182-e896e5d26e53"><enum>(B)</enum><text>the
			 unallocated or non-Project water beneficiary—</text>
							<clause id="id5ee7df49-5caa-4b7b-b05d-740cc5d8c1e1"><enum>(i)</enum><text>has the right
			 to use the water;</text>
							</clause><clause id="idb57e8974-7d91-4224-b065-1d0c78420b19"><enum>(ii)</enum><text>agrees to
			 pay the operation, maintenance, and replacement costs assignable to the
			 beneficiary for the use of the Project facilities; and</text>
							</clause><clause id="id8b2a2042-84dd-4051-9c9c-e7a89c257042"><enum>(iii)</enum><text>agrees to
			 pay an appropriate fee that may be established by the Secretary to assist in
			 the recovery of any capital cost allocable to that use.</text>
							</clause></subparagraph></paragraph><paragraph id="idfef9190c-de23-4af0-8ba2-ae36a45e9a27"><enum>(2)</enum><header>Effect of
			 payments</header><text>Any payments to the United States or the Nation for the
			 use of unused capacity under this subsection or for water under any subcontract
			 with the Nation or the Jicarilla Apache Nation shall not alter the construction
			 repayment requirements or the operation, maintenance, and replacement payment
			 requirements of the Project Participants.</text>
					</paragraph></subsection></section><section id="id36e29597-b359-4f4b-860b-71e4391766e3"><enum>303.</enum><header>Delivery
			 and use of Navajo-Gallup Water Supply Project water</header>
				<subsection id="id6888a5b6-486c-4072-9b51-0e5a936bea9a"><enum>(a)</enum><header>Use of
			 project water</header>
					<paragraph id="id222a084d-dd82-4974-a02c-390ce9851125"><enum>(1)</enum><header>In
			 general</header><text>In accordance with this Act and other applicable law,
			 water supply from the Project shall be used for municipal, industrial,
			 commercial, domestic, and stock watering purposes.</text>
					</paragraph><paragraph id="id2124842d-1b3b-429d-9688-55ff5ca57ff7"><enum>(2)</enum><header>Use on
			 certain land</header>
						<subparagraph id="idf12de85e-eddd-4957-876c-ab0fd013bb78"><enum>(A)</enum><header>In
			 general</header><text>Subject to subparagraph (B), the Nation may use Project
			 water allocations on—</text>
							<clause id="idb80bb08b-01c4-4cec-bac3-6eb0f1d3ec78"><enum>(i)</enum><text>land held by
			 the United States in trust for the Nation and members of the Nation; and</text>
							</clause><clause id="id41bfcb0a-e0fc-4097-9823-22db032cad6a"><enum>(ii)</enum><text>land held in
			 fee by the Nation.</text>
							</clause></subparagraph><subparagraph id="id4ee12595-6599-4c79-bb32-7d1b9cb77504"><enum>(B)</enum><header>Transfer</header><text>The
			 Nation may transfer the purposes and places of use of the allocated water in
			 accordance with the Agreement and applicable law.</text>
						</subparagraph></paragraph><paragraph id="ID90ff8b2c8d4a4ea4a63d07fc8baa0d76"><enum>(3)</enum><header>Hydroelectric
			 power</header>
						<subparagraph id="id7B4FD9D1C46741A58D2DFA27CA1F653F"><enum>(A)</enum><header>In
			 general</header><text>Hydroelectric power may be generated as an incident to
			 the delivery of Project water for authorized purposes under paragraph
			 (1).</text>
						</subparagraph><subparagraph id="idD541CFC0A94C41D99C9D33F8A694906E"><enum>(B)</enum><header>Administration</header><text>Notwithstanding
			 any other provision of law—</text>
							<clause id="id36FF437C309042E49C2A1358CAE23F40"><enum>(i)</enum><text>any
			 hydroelectric power generated under this paragraph shall be used or marketed by
			 the Nation;</text>
							</clause><clause id="id5DA4603E78B44805B4CF5CC2CE6DA3F7"><enum>(ii)</enum><text>the Nation shall
			 retain any revenues from the sale of the hydroelectric power; and</text>
							</clause><clause id="idB5993CA7A28A4E7886B016CAED995595"><enum>(iii)</enum><text>the United
			 States shall have no trust obligation or other obligation to monitor,
			 administer, or account for the revenues received by the Nation, or the
			 expenditure of the revenues.</text>
							</clause></subparagraph></paragraph><paragraph id="id2bb42b0a-3813-44cc-be00-62e7a5a6d134"><enum>(4)</enum><header>Storage</header>
						<subparagraph id="id71c74e84-6267-4935-901f-653ed36565a1"><enum>(A)</enum><header>In
			 general</header><text>Subject to subparagraph (B), any water contracted for
			 delivery under paragraph (1) that is not needed for current water demands or
			 uses may be delivered by the Project for placement in underground storage in
			 the State of New Mexico for future recovery and use.</text>
						</subparagraph><subparagraph id="id83a35789-1eef-4cbf-ab71-0270ef252fcf"><enum>(B)</enum><header>State
			 approval</header><text>Delivery of water under subparagraph (A) is subject
			 to—</text>
							<clause id="id968cdac4-a9f4-4be6-82b8-5289e5ab0406"><enum>(i)</enum><text>approval by
			 the State of New Mexico under applicable provisions of State law relating to
			 aquifer storage and recovery; and</text>
							</clause><clause id="id1064d466-b248-4462-bbcb-9fc91086096b"><enum>(ii)</enum><text>the
			 provisions of the Agreement and this Act.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="idd04c4238-e663-4006-859f-b5aca5be81fd"><enum>(b)</enum><header>Project
			 water and capacity allocations</header>
					<paragraph id="id9b878f00-6add-4220-91b7-2d33f5b6cd25"><enum>(1)</enum><header>Diversion</header><text>Subject
			 to availability and consistent with Federal and State law, the Project may
			 divert from the Navajo Reservoir and the San Juan River a quantity of water to
			 be allocated and used consistent with the Agreement and this Act, that does not
			 exceed in any 1 year, the lesser of—</text>
						<subparagraph id="id2d5c336f-5819-4df4-b70f-46c280a30296"><enum>(A)</enum><text>37,760
			 acre-feet of water; or</text>
						</subparagraph><subparagraph id="id8b8b7c64-6e2e-406f-a782-8027919354c7"><enum>(B)</enum><text>the quantity
			 of water necessary to supply a depletion from the San Juan River of 35,890
			 acre-feet.</text>
						</subparagraph></paragraph><paragraph id="ID93b7a2ad38974b7eabc8e9b496cc1826"><enum>(2)</enum><header>Project
			 delivery capacity allocations</header>
						<subparagraph id="ID2f63a468189d4fe09d69bda2f38f2e62"><enum>(A)</enum><header>In
			 general</header><text>The capacity of the Project shall be allocated to the
			 Project Participants in accordance with subparagraphs (B) through (E), other
			 provisions of this Act, and other applicable law.</text>
						</subparagraph><subparagraph id="IDabfdd54b6071483bb91b6e64ce4c2fd8"><enum>(B)</enum><header>Delivery
			 capacity allocation to the City</header><text>The Project may deliver at the
			 point of diversion from the San Juan River not more than 7,500 acre-feet of
			 water in any 1 year for which the City has secured rights for the use of the
			 City.</text>
						</subparagraph><subparagraph id="IDd3e58b8c70e948c484b18c3da6a77ce7"><enum>(C)</enum><header>Delivery
			 capacity allocation to Navajo Nation communities in New
			 Mexico</header><text>For use by the Nation in the State of New Mexico, the
			 Project may deliver water out of the water rights held by the Secretary for the
			 Nation and confirmed under this Act, at the points of diversion from the San
			 Juan River or at Navajo Reservoir in any 1 year, the lesser of—</text>
							<clause id="id408d3173-7fa0-4674-b65c-ac2014e17e6e"><enum>(i)</enum><text>22,650
			 acre-feet of water; or</text>
							</clause><clause id="idc58cfb13-85ba-46f0-b8ed-e6907714f3dc"><enum>(ii)</enum><text>the quantity
			 of water necessary to supply a depletion from the San Juan River of 20,780
			 acre-feet of water.</text>
							</clause></subparagraph><subparagraph id="ID56d1173cf7c04de987d406ee5118d0a0"><enum>(D)</enum><header>Delivery
			 capacity allocation to Navajo Nation communities in
			 Arizona</header><text>Subject to subsection (c), the Project may deliver at the
			 point of diversion from the San Juan River not more than 6,411 acre-feet of
			 water in any 1 year for use by the Nation in the State of Arizona.</text>
						</subparagraph><subparagraph id="ID1ffe84e13c424c20ae0c4f662e31e3f2"><enum>(E)</enum><header>Delivery
			 capacity allocation to Jicarilla Apache Nation</header><text>The Project may
			 deliver at Navajo Reservoir not more than 1,200 acre-feet of water in any 1
			 year of the water rights of the Jicarilla Apache Nation, held by the Secretary
			 and confirmed by the Jicarilla Apache Tribe Water Rights Settlement Act (Public
			 Law 102–441; 106 Stat. 2237), for use by the Jicarilla Apache Nation in the
			 southern portion of the Jicarilla Apache Nation Reservation in the State of New
			 Mexico.</text>
						</subparagraph></paragraph><paragraph id="ID5a5d8f42691f44889429c90c67613d28"><enum>(3)</enum><header>Use in excess
			 of delivery capacity allocation quantity</header><text>Notwithstanding each
			 delivery capacity allocation quantity limit described in subparagraphs (B),
			 (C), and (E) of paragraph (2), the Secretary may authorize a Project
			 Participant to exceed the delivery capacity allocation quantity limit of that
			 Project Participant if—</text>
						<subparagraph id="ID2d49efecb502494e8dfeb27befd39baf"><enum>(A)</enum><text>delivery capacity
			 is available without impairing any water delivery to any other Project
			 Participant; and</text>
						</subparagraph><subparagraph id="ID5d8492c8957743968649635d55d44eb3"><enum>(B)</enum><text>the Project
			 Participant benefitting from the increased allocation of delivery
			 capacity—</text>
							<clause id="ID21a0d87e9a3b498090d627bb9a77d9da"><enum>(i)</enum><text>has
			 the right under applicable law to use the additional water;</text>
							</clause><clause id="idbfd28bce-09ab-4b6a-bab2-93f6d1462120"><enum>(ii)</enum><text>agrees to
			 pay the operation, maintenance, and replacement costs relating to the
			 additional use of any Project facility; and</text>
							</clause><clause id="id1310d918-a712-4688-8e21-63296f96ab02"><enum>(iii)</enum><text>agrees, if
			 the Project title is held by the Secretary, to pay a fee established by the
			 Secretary to assist in recovering capital costs relating to that additional
			 use.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="id79eba0f7-4853-43b5-995a-858910e54159"><enum>(c)</enum><header>Conditions
			 for use in Arizona</header>
					<paragraph id="ID7ef7a194449f49eca07101157f198fb8"><enum>(1)</enum><header>Requirements</header><text>Project
			 water shall not be delivered for use by any community of the Nation located in
			 the State of Arizona under subsection (b)(2)(D) until—</text>
						<subparagraph id="IDbf6a2ab7f9b04377b98af3a054bb9776"><enum>(A)</enum><text>the Nation and
			 the State of Arizona have entered into a water rights settlement agreement
			 approved by an Act of Congress that specifies the allocation of Colorado River
			 System water to which the use in Arizona will be charged; and</text>
						</subparagraph><subparagraph id="IDf81b2fd873394943aa35738eefff79d6"><enum>(B)</enum><text>the Secretary has
			 determined by hydrologic investigation that sufficient water is reasonably
			 likely to be available to supply the use in the State of Arizona from water of
			 the Colorado River system allocated to the State.</text>
						</subparagraph></paragraph><paragraph id="idade96574-8cb6-4c0d-83d4-6bdca3226c7f"><enum>(2)</enum><header>Accounting
			 of uses in Arizona</header><text>Pursuant to paragraph (1), any depletion of
			 water from the San Juan River stream system in the State of New Mexico that
			 results from the diversion of water by the Project for uses within the State of
			 Arizona (including depletion incidental to the diversion, impounding, or
			 conveyance of water in the State of New Mexico for uses in the State of
			 Arizona)—</text>
						<subparagraph id="ida1d43e6f-c399-40eb-ae7e-fa2d0bb53dc6"><enum>(A)</enum><text>shall be
			 accounted for as a part of the Colorado River System apportionments to the
			 State of Arizona; and</text>
						</subparagraph><subparagraph id="ideebc6a3d-266b-4167-9656-a9e20a90cc8a"><enum>(B)</enum><text>shall not
			 increase the total quantity of water to which the State of Arizona is entitled
			 to use under any compact, statute, or court decree.</text>
						</subparagraph></paragraph></subsection><subsection id="id8689df2d-c6c1-497e-84f7-b000264fd903"><enum>(d)</enum><header>Forbearance</header>
					<paragraph id="idf2133c73-5d07-4837-abf3-baa37d50b792"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraphs (2) and (3), during any year in
			 which a shortage to the normal diversion requirement for any use relating to
			 the Project within the State of Arizona occurs (as determined under section 11
			 of Public Law 87–483 (76 Stat. 99)), the Nation may temporarily forbear the
			 delivery of the water supply of the Navajo Reservoir for uses in the State of
			 New Mexico under the apportionments of water to the Navajo Indian Irrigation
			 Project and the normal diversion requirements of the Project to allow an
			 equivalent quantity of water to be delivered from the Navajo Reservoir water
			 supply for municipal and domestic uses of the Nation in the State of Arizona
			 under the Project.</text>
					</paragraph><paragraph id="id491db8aa-c1a7-43ca-8ef9-7e506b76d415"><enum>(2)</enum><header>Limitation
			 of forbearance</header><text>The Nation may forebear the delivery of water
			 under paragraph (1) of a quantity not exceeding the quantity of the shortage to
			 the normal diversion requirement for any use relating to the Project within the
			 State of Arizona.</text>
					</paragraph><paragraph id="id44b48815-6e9c-4f71-a095-7457df79254a"><enum>(3)</enum><header>Effect</header><text>The
			 forbearance of the delivery of water under paragraph (1) shall be subject to
			 the requirements in subsection (c).</text>
					</paragraph></subsection><subsection id="idfbc8951e-b951-4353-8115-cb70eff5d20e"><enum>(e)</enum><header>Effect</header><text>Nothing
			 in this Act—</text>
					<paragraph id="id8eb931a6-a47d-4eb5-a8e7-e1068856a6e7"><enum>(1)</enum><text>authorizes
			 the marketing, leasing, or transfer of the water supplies made available to the
			 Nation under the Contract to non-Navajo water users in States other than the
			 State of New Mexico; or</text>
					</paragraph><paragraph id="idaa2d8e77-56e9-41cf-a446-c49604265efd"><enum>(2)</enum><text>authorizes
			 the forbearance of water uses in the State of New Mexico to allow uses of water
			 in other States other than as authorized under subsection (d).</text>
					</paragraph></subsection><subsection id="ID31d0b04f66f44e139067eb14cb0a4f1d"><enum>(f)</enum><header>Colorado River
			 Compacts</header><text>Notwithstanding any other provision of law—</text>
					<paragraph id="ID844bf032e4ed4e3587307c68c74d9fb2"><enum>(1)</enum><text>water may be
			 diverted by the Project from the San Juan River in the State of New Mexico for
			 use within New Mexico in the lower basin, as that term is used in the Colorado
			 River Compact;</text>
					</paragraph><paragraph id="IDd96dedc24a0d411b9140702c1edf4262"><enum>(2)</enum><text>any water
			 diverted under paragraph (1) shall be a part of, and charged against, the
			 consumptive use apportionment made to the State of New Mexico by article III(a)
			 of the Compact and to the upper basin by article III(a) of the Colorado River
			 Compact; and</text>
					</paragraph><paragraph id="ID7b302eb8479545cc8c69f05e96210317"><enum>(3)</enum><text>any water so
			 diverted by the Project into the lower basin within the State of New Mexico
			 shall not be credited as water reaching Lee Ferry pursuant to articles III(c)
			 and III(d) of the Colorado River Compact.</text>
					</paragraph></subsection><subsection id="ID1d5b31b8a36f417784e1744f77c81c15"><enum>(g)</enum><header>Payment of
			 operation, maintenance, and replacement costs</header>
					<paragraph id="idC747F4CF4BB1491AABEBF6B8DF1BEEBF"><enum>(1)</enum><header>In
			 general</header><text>The Secretary is authorized to pay the operation,
			 maintenance, and replacement costs of the Project allocable to the Project
			 Participants under section 304 until the date on which the Secretary declares
			 any section of the Project to be substantially complete and delivery of water
			 generated by, and through, that section of the Project can be made to a Project
			 participant.</text>
					</paragraph><paragraph id="idB8B615C6CD8C4A429CA9431726625984"><enum>(2)</enum><header>Project
			 Participant payments</header><text>Beginning on the date described in paragraph
			 (1), each Project Participant shall pay all allocated operation, maintenance,
			 and replacement costs for that substantially completed section of the Project,
			 in accordance with contracts entered into pursuant to section 304, except as
			 provided in section 304(f).</text>
					</paragraph></subsection></section><section id="id3dd33974-4eee-4579-83a5-ed7544953470"><enum>304.</enum><header>Project
			 contracts</header>
				<subsection id="idc425669a-044a-4b1e-83d4-a4f666bf2b32"><enum>(a)</enum><header>Navajo
			 Nation contract</header>
					<paragraph id="id6e94cece-51ce-4f7a-a8f4-a429b2936b4c"><enum>(1)</enum><header>Hydrologic
			 determination</header><text>Congress recognizes that the Hydrologic
			 Determination necessary to support approval of the Contract has been
			 completed.</text>
					</paragraph><paragraph id="id825e1a35-449f-4056-9ae6-2218f4ae57c3"><enum>(2)</enum><header>Contract
			 approval</header>
						<subparagraph id="id9714eb16-86e8-450a-972e-3ba8552ac20c"><enum>(A)</enum><header>Approval</header>
							<clause id="id8ce37c3f-d38b-43b8-b1e9-2d9fa36c1c78"><enum>(i)</enum><header>In
			 general</header><text>Except to the extent that any provision of the Contract
			 conflicts with this Act, Congress approves, ratifies, and confirms the
			 Contract.</text>
							</clause><clause id="idcfd0f785-ec80-4a80-9fd8-b7a8b0283874"><enum>(ii)</enum><header>Amendments</header><text>To
			 the extent any amendment is executed to make the Contract consistent with this
			 Act, that amendment is authorized, ratified, and confirmed.</text>
							</clause></subparagraph><subparagraph id="idd780a2c8-d806-4461-9f18-23d2d22b4f30"><enum>(B)</enum><header>Execution
			 of contract</header><text>The Secretary, acting on behalf of the United States,
			 shall enter into the Contract to the extent that the Contract does not conflict
			 with this Act (including any amendment that is required to make the Contract
			 consistent with this Act).</text>
						</subparagraph></paragraph><paragraph id="ID921657d5be854979a14bcc2c967b79b0"><enum>(3)</enum><header>Nonreimbursability
			 of allocated costs</header><text>The following costs shall be nonreimbursable
			 and not subject to repayment by the Nation or any other Project
			 beneficiary:</text>
						<subparagraph id="ide8cf2727-0266-4db0-ae6b-a9e7647cc42e"><enum>(A)</enum><text>Any share of
			 the construction costs of the Nation relating to the Project authorized by
			 section 302(a).</text>
						</subparagraph><subparagraph id="idcc31eb51-190f-4bd6-915e-2707222dd3d3"><enum>(B)</enum><text>Any costs
			 relating to the construction of the Navajo Indian Irrigation Project that may
			 otherwise be allocable to the Nation for use of any facility of the Navajo
			 Indian Irrigation Project to convey water to each Navajo community under the
			 Project.</text>
						</subparagraph><subparagraph id="ID06b44777b93b4dbeb4857fda16a76df3"><enum>(C)</enum><text>Any costs
			 relating to the construction of Navajo Dam that may otherwise be allocable to
			 the Nation for water deliveries under the Contract.</text>
						</subparagraph></paragraph><paragraph id="id5bc14dfa-edf4-42cb-84f9-4e82d2195492"><enum>(4)</enum><header>Operation,
			 maintenance, and replacement obligation</header><text>Subject to subsection
			 (f), the Contract shall include provisions under which the Nation shall pay any
			 costs relating to the operation, maintenance, and replacement of each facility
			 of the Project that are allocable to the Nation.</text>
					</paragraph><paragraph id="idefd6bb4b-71ad-47f1-b558-9a0d37ad1c10"><enum>(5)</enum><header>Limitation,
			 cancellation, termination, and rescission</header><text>The Contract may be
			 limited by a term of years, canceled, terminated, or rescinded only by an Act
			 of Congress.</text>
					</paragraph></subsection><subsection id="id4eb1b7b2-ef29-4273-bbee-51e94ffdc142"><enum>(b)</enum><header>City of
			 Gallup contract</header>
					<paragraph id="id213a6b33-fb0b-4c21-8dc1-1969e8bf9c03"><enum>(1)</enum><header>Contract
			 authorization</header><text>Consistent with this Act, the Secretary is
			 authorized to enter into a repayment contract with the City that requires the
			 City—</text>
						<subparagraph id="ID8365b4996a4f4b1d9134f29b74cd3333"><enum>(A)</enum><text>to repay, within
			 a 50-year period, the share of the construction costs of the City relating to
			 the Project, with interest as provided under section 5; and</text>
						</subparagraph><subparagraph id="ID8e64505b7ec14b6cb8bb6885d5f307a6"><enum>(B)</enum><text>consistent with
			 section 303(g), to pay the operation, maintenance, and replacement costs of the
			 Project that are allocable to the City.</text>
						</subparagraph></paragraph><paragraph id="IDa5ac9d8fe3e7442ebf628d4d3bafcb37"><enum>(2)</enum><header>Contract
			 prepayment</header>
						<subparagraph id="ID7ee3db3f8c7e478e94971aeb35d3ef70"><enum>(A)</enum><header>In
			 general</header><text>The contract authorized under paragraph (1) may allow the
			 City to satisfy the repayment obligation of the City for construction costs of
			 the Project on the payment of the share of the City prior to the initiation of
			 construction.</text>
						</subparagraph><subparagraph id="id500D6D4FFCEA4C7CA43BFB1AAE54E10B"><enum>(B)</enum><header>Amount</header><text>The
			 amount of the share of the City described in subparagraph (A) shall be
			 determined by agreement between the Secretary and the City.</text>
						</subparagraph><subparagraph id="IDb0199349be3740deb69a433d4c0bd0bb"><enum>(C)</enum><header>Repayment
			 obligation</header><text>Any repayment obligation established by the Secretary
			 and the City pursuant to subparagraph (A) shall be subject to a final cost
			 allocation by the Secretary on project completion and to the limitations set
			 forth in paragraph (3).</text>
						</subparagraph></paragraph><paragraph id="IDb65f58a942684c18a95183c7e0b5ee8c"><enum>(3)</enum><header>Share of
			 construction costs</header>
						<subparagraph id="ID408190d5921941fab9bf4b12618621eb"><enum>(A)</enum><header>In
			 general</header><text>Subject to subparagraph (B), the Secretary shall
			 determine the share of the construction costs of the Project allocable to the
			 City and establish the percentage of the allocated construction costs that the
			 City shall be required to repay pursuant to the contract entered into under
			 paragraph (1), based on the ability of the City to pay.</text>
						</subparagraph><subparagraph id="IDd57a8fcff7e144879766a8254a5c3c56"><enum>(B)</enum><header>Minimum
			 percentage</header><text>Notwithstanding subparagraph (A), the repayment
			 obligation of the City shall be at least 25 percent of the construction costs
			 of the Project that are allocable to the City, but shall in no event exceed 35
			 percent.</text>
						</subparagraph></paragraph><paragraph id="ID7c055ca522d147ee9b784e5c68c968a6"><enum>(4)</enum><header>Excess
			 construction costs</header><text>Any construction costs of the Project
			 allocable to the City in excess of the repayment obligation of the City, as
			 determined under paragraph (3), shall be nonreimbursable.</text>
					</paragraph><paragraph id="IDf0f65cb908454bbe8a8c31b2ea96a3b8"><enum>(5)</enum><header>Grant
			 funds</header><text>A grant from any other Federal source shall not be credited
			 toward the amount required to be repaid by the City under a repayment
			 contract.</text>
					</paragraph><paragraph id="ID17302b25a5f644a984302a16cf8fc564"><enum>(6)</enum><header>Title
			 transfer</header><text>If title is transferred to the City prior to repayment
			 under section 302(f), the City shall be required to provide assurances
			 satisfactory to the Secretary of fulfillment of the remaining repayment
			 obligation of the City.</text>
					</paragraph><paragraph id="IDc31e4c1e582d445ebbbc731940a787ab"><enum>(7)</enum><header>Water delivery
			 subcontract</header><text>The Secretary shall not enter into a contract under
			 paragraph (1) with the City until the City has secured a water supply for the
			 City's portion of the Project described in section 303(b)(2)(B), by entering
			 into, as approved by the Secretary, a water delivery subcontract for a period
			 of not less than 40 years beginning on the date on which the construction of
			 any facility of the Project serving the City is completed, with—</text>
						<subparagraph id="IDdf3178f5a63542669670664521bfd961"><enum>(A)</enum><text>the Nation, as
			 authorized by the Contract;</text>
						</subparagraph><subparagraph id="IDa476fc697e2b4ba39c642d365a0952af"><enum>(B)</enum><text>the Jicarilla
			 Apache Nation, as authorized by the settlement contract between the United
			 States and the Jicarilla Apache Tribe, authorized by the Jicarilla Apache Tribe
			 Water Rights Settlement Act (Public Law 102–441; 106 Stat. 2237); or</text>
						</subparagraph><subparagraph id="IDf6bab3c584b0467ab9d3cd2708dbc40b"><enum>(C)</enum><text>an acquired
			 alternate source of water, subject to approval of the Secretary and the State
			 of New Mexico, acting through the New Mexico Interstate Stream Commission and
			 the New Mexico State Engineer.</text>
						</subparagraph></paragraph></subsection><subsection id="id2b3a7068-bc8c-4191-9720-94836ff73059"><enum>(c)</enum><header>Jicarilla
			 Apache Nation contract</header>
					<paragraph id="id48be54c8-0cb2-4c30-a6f5-48c5678f9bb5"><enum>(1)</enum><header>Contract
			 authorization</header><text>Consistent with this Act, the Secretary is
			 authorized to enter into a repayment contract with the Jicarilla Apache Nation
			 that requires the Jicarilla Apache Nation—</text>
						<subparagraph id="ID9fb0dbec82f742c4ba9cb5e9d6af5d2d"><enum>(A)</enum><text>to repay, within
			 a 50-year period, the share of any construction cost of the Jicarilla Apache
			 Nation relating to the Project, with interest as provided under section 5;
			 and</text>
						</subparagraph><subparagraph id="IDd62ea3a0355c49168bfd4221db28972b"><enum>(B)</enum><text>consistent with
			 section 303(g), to pay the operation, maintenance, and replacement costs of the
			 Project that are allocable to the Jicarilla Apache Nation.</text>
						</subparagraph></paragraph><paragraph id="ID173a915a6f164d68abab64d124981d68"><enum>(2)</enum><header>Contract
			 prepayment</header>
						<subparagraph id="ID905daba8102d42b3b79c7e68fed6ab51"><enum>(A)</enum><header>In
			 general</header><text>The contract authorized under paragraph (1) may allow the
			 Jicarilla Apache Nation to satisfy the repayment obligation of the Jicarilla
			 Apache Nation for construction costs of the Project on the payment of the share
			 of the Jicarilla Apache Nation prior to the initiation of construction.</text>
						</subparagraph><subparagraph id="id5DA9F84FEE924399BA163AF395C227B4"><enum>(B)</enum><header>Amount</header><text>The
			 amount of the share of Jicarilla Apache Nation described in subparagraph (A)
			 shall be determined by agreement between the Secretary and the Jicarilla Apache
			 Nation.</text>
						</subparagraph><subparagraph id="IDd5e3eb48e24147a8b56b933f072d68d3"><enum>(C)</enum><header>Repayment
			 obligation</header><text>Any repayment obligation established by the Secretary
			 and the Jicarilla Apache Nation pursuant to subparagraph (A) shall be subject
			 to a final cost allocation by the Secretary on project completion and to the
			 limitations set forth in paragraph (3).</text>
						</subparagraph></paragraph><paragraph id="ID6040b87b98894613be8ea66a52c60584"><enum>(3)</enum><header>Share of
			 construction costs</header>
						<subparagraph id="ID0d84dd84d37e4dee82cddbd8553e4f7a"><enum>(A)</enum><header>In
			 general</header><text>Subject to subparagraph (B), the Secretary shall
			 determine the share of the construction costs of the Project allocable to the
			 Jicarilla Apache Nation and establish the percentage of the allocated
			 construction costs of the Jicarilla Apache Nation that the Jicarilla Apache
			 Nation shall be required to repay based on the ability of the Jicarilla Apache
			 Nation to pay.</text>
						</subparagraph><subparagraph id="ID1290496c2b1846cab0feb480ed0d7806"><enum>(B)</enum><header>Minimum
			 percentage</header><text>Notwithstanding subparagraph (A), the repayment
			 obligation of the Jicarilla Apache Nation shall be at least 25 percent of the
			 construction costs of the Project that are allocable to the Jicarilla Apache
			 Nation, but shall in no event exceed 35 percent.</text>
						</subparagraph></paragraph><paragraph id="ID441b6df430de47148ae91baa5bd4a428"><enum>(4)</enum><header>Excess
			 construction costs</header><text>Any construction costs of the Project
			 allocable to the Jicarilla Apache Nation in excess of the repayment obligation
			 of the Jicarilla Apache Nation as determined under paragraph (3), shall be
			 nonreimbursable.</text>
					</paragraph><paragraph id="ID1fbfa5abcbab46fcb1dd2d21cd4eb8db"><enum>(5)</enum><header>Grant
			 funds</header><text>A grant from any other Federal source shall not be credited
			 toward the share of the Jicarilla Apache Nation of construction costs.</text>
					</paragraph><paragraph id="ID5a49f851741349c2bb5c17bfabd1c280"><enum>(6)</enum><header>Navajo Indian
			 Irrigation Project costs</header><text>The Jicarilla Apache Nation shall have
			 no obligation to repay any Navajo Indian Irrigation Project construction costs
			 that might otherwise be allocable to the Jicarilla Apache Nation for use of the
			 Navajo Indian Irrigation Project facilities to convey water to the Jicarilla
			 Apache Nation, and any such costs shall be nonreimbursable.</text>
					</paragraph></subsection><subsection id="ID924b3a0e9d774e75911287d7a6435acc"><enum>(d)</enum><header>Capital cost
			 allocations</header>
					<paragraph id="id5D9768EE74044B54A0CDC9BCAFE26D8B"><enum>(1)</enum><header>In
			 general</header><text>For purposes of estimating the capital repayment
			 requirements of the Project Participants under this section, the Secretary
			 shall review and, as appropriate, update the Draft Impact Statement allocating
			 capital construction costs for the Project.</text>
					</paragraph><paragraph id="id221A49E93ED14AC69D98211BC6F14B49"><enum>(2)</enum><header>Final cost
			 allocation</header><text>The repayment contracts entered into with Project
			 Participants under this section shall require that the Secretary perform a
			 final cost allocation when construction of the Project is determined to be
			 substantially complete.</text>
					</paragraph><paragraph id="id30CE4364FD374632B393D44C6A20F827"><enum>(3)</enum><header>Repayment
			 obligation</header><text>The Secretary shall determine the repayment obligation
			 of the Project Participants based on the final cost allocation identifying
			 reimbursable and nonreimbursable capital costs of the Project consistent with
			 this Act.</text>
					</paragraph></subsection><subsection id="IDce1221b872a4477c909ee5868778dde2"><enum>(e)</enum><header>Operation,
			 maintenance, and replacement cost allocations</header><text>For purposes of
			 determining the operation, maintenance, and replacement obligations of the
			 Project Participants under this section, the Secretary shall review and, as
			 appropriate, update the Draft Impact Statement that allocates operation,
			 maintenance, and replacement costs for the Project.</text>
				</subsection><subsection id="IDdc3a542f3fb6461b895bc189e60e119f"><enum>(f)</enum><header>Temporary
			 waivers of payments</header>
					<paragraph id="IDb1d9f20f3df041d28b0ccd3356392bbe"><enum>(1)</enum><header>In
			 general</header><text>On the date on which the Secretary declares a section of
			 the Project to be substantially complete and delivery of water generated by and
			 through that section of the Project can be made to the Nation, the Secretary
			 may waive, for a period of not more than 10 years, the operation, maintenance,
			 and replacement costs allocable to the Nation for that section of the Project
			 that the Secretary determines are in excess of the ability of the Nation to
			 pay.</text>
					</paragraph><paragraph id="id4B7EC5B5CEB84A2D8653E0C6F3E18795"><enum>(2)</enum><header>Subsequent
			 payment by Nation</header><text>After a waiver under paragraph (1), the Nation
			 shall pay all allocated operation, maintenance, and replacement costs of that
			 section of the Project.</text>
					</paragraph><paragraph id="IDfdbad926d2114eaaa1fc1210c76d151b"><enum>(3)</enum><header>Payment by
			 United States</header><text>Any operation, maintenance, or replacement costs
			 waived by the Secretary under paragraph (1) shall be paid by the United States
			 and shall be nonreimbursable.</text>
					</paragraph><paragraph id="IDa7df2f0f8c79412daa427cc4fba24c12"><enum>(4)</enum><header>Effect on
			 contracts</header><text>Failure of the Secretary to waive costs under paragraph
			 (1) because of a lack of availability of Federal funding to pay the costs under
			 paragraph (3) shall not alter the obligations of the Nation or the United
			 States under a repayment contract.</text>
					</paragraph><paragraph id="ID7f387f0900b945ab8acb5773de8f0034"><enum>(5)</enum><header>Termination of
			 authority</header><text>The authority of the Secretary to waive costs under
			 paragraph (1) with respect to a Project facility transferred to the Nation
			 under section 302(f) shall terminate on the date on which the Project facility
			 is transferred.</text>
					</paragraph></subsection><subsection id="ID240efaec5fc842c5ab4a7633f9347ef7"><enum>(g)</enum><header>Project
			 construction committee</header><text>The Secretary shall facilitate the
			 formation of a project construction committee with the Project Participants and
			 the State of New Mexico—</text>
					<paragraph id="id4E7F7E428D7340A8BA756486B9A0A69E"><enum>(1)</enum><text>to review cost
			 factors and budgets for construction and operation and maintenance
			 activities;</text>
					</paragraph><paragraph id="idC6D32F72BDF1478CA58ED142FDEAA27C"><enum>(2)</enum><text>to improve
			 construction management through enhanced communication; and</text>
					</paragraph><paragraph id="idE2EC0C05BDCB4A1C9EBF9ECF81879785"><enum>(3)</enum><text>to seek
			 additional ways to reduce overall Project costs.</text>
					</paragraph></subsection></section><section id="ID96a435629cac4d0997672b197429fd6a"><enum>305.</enum><header> Navajo Nation
			 Municipal Pipeline</header>
				<subsection id="IDd6a4d70ede4a4720b0b1122ee9068710"><enum>(a)</enum><header>Use of navajo
			 nation pipeline</header><text>In addition to use of the Navajo Nation Municipal
			 Pipeline to convey the Animas-La Plata Project water of the Nation, the Nation
			 may use the Navajo Nation Municipal Pipeline to convey non-Animas La Plata
			 Project water for municipal and industrial purposes.</text>
				</subsection><subsection id="ID9df4ea42ba2b4234970b38c122706fa3"><enum>(b)</enum><header>Conveyance of
			 title to pipeline</header>
					<paragraph id="IDb63a6f7597344ec48a6d30fddef3d007"><enum>(1)</enum><header>In
			 general</header><text>On completion of the Navajo Nation Municipal Pipeline,
			 the Secretary may enter into separate agreements with the City of Farmington,
			 New Mexico and the Nation to convey title to each portion of the Navajo Nation
			 Municipal Pipeline facility or section of the Pipeline to the City of
			 Farmington and the Nation after execution of a Project operations agreement
			 approved by the Secretary, the Nation, and the City of Farmington that sets
			 forth any terms and conditions that the Secretary determines are
			 necessary.</text>
					</paragraph><paragraph id="ID8a5e4521e1e04843915bab15fc190acd"><enum>(2)</enum><header>Conveyance to
			 the City of Farmington or Navajo Nation</header><text>In conveying title to the
			 Navajo Nation Municipal Pipeline under this subsection, the Secretary shall
			 convey—</text>
						<subparagraph id="ID61b7b8fbce4049b48ea5897b94b26fc8"><enum>(A)</enum><text>to the City of
			 Farmington, the facilities and any land or interest in land acquired by the
			 United States for the construction, operation, and maintenance of the Pipeline
			 that are located within the corporate boundaries of the City; and</text>
						</subparagraph><subparagraph id="ID9be19689f8f446b68db0fde3a503c0e2"><enum>(B)</enum><text>to the Nation,
			 the facilities and any land or interests in land acquired by the United States
			 for the construction, operation, and maintenance of the Pipeline that are
			 located outside the corporate boundaries of the City of Farmington.</text>
						</subparagraph></paragraph><paragraph id="ID2274c4fba0864939bc8fe5f77e233079"><enum>(3)</enum><header>Effect of
			 conveyance</header><text>The conveyance of title to the Pipeline shall not
			 affect the application of the Endangered Species Act of 1973 (16 U.S.C. 1531 et
			 seq.) relating to the use of water associated with the Animas-La Plata
			 Project.</text>
					</paragraph><paragraph id="ID507afa8842c2491389c5f8da60edb74d"><enum>(4)</enum><header>Liability</header>
						<subparagraph id="id569C33193320472BA19E5144A0B6813B"><enum>(A)</enum><header>In
			 general</header><text>Effective on the date of the conveyance authorized by
			 this subsection, the United States shall not be held liable by any court for
			 damages of any kind arising out of any act, omission, or occurrence relating to
			 the land, buildings, or facilities conveyed under this subsection, other than
			 damages caused by acts of negligence committed by the United States or by
			 employees or agents of the United States prior to the date of
			 conveyance.</text>
						</subparagraph><subparagraph id="id9D3EAA298EE2432995D88FA924613C3F"><enum>(B)</enum><header>Tort
			 claims</header><text>Nothing in this subsection increases the liability of the
			 United States beyond the liability provided under chapter 171 of title 28,
			 United States Code (commonly known as the <quote>Federal Tort Claims
			 Act</quote>).</text>
						</subparagraph></paragraph><paragraph id="ID925538870d934548bc69c1375f715d3b"><enum>(5)</enum><header>Notice of
			 proposed conveyance</header><text>Not later than 45 days before the date of a
			 proposed conveyance of title to the Pipeline, the Secretary shall submit to the
			 Committee on Natural Resources of the House of Representatives and the
			 Committee on Energy and Natural Resources of the Senate, notice of the
			 conveyance of the Pipeline.</text>
					</paragraph></subsection></section><section id="idde3db99d-b149-4463-8c48-6a06c9a78e7a"><enum>306.</enum><header>Authorization
			 of conjunctive use wells</header>
				<subsection id="id5a050597-f1e8-465a-a1ba-43bd9f1c55e7"><enum>(a)</enum><header>Conjunctive
			 groundwater development plan</header><text>Not later than 1 year after the date
			 of enactment of this Act, the Nation, in consultation with the Secretary, shall
			 complete a conjunctive groundwater development plan for the wells described in
			 subsections (b) and (c).</text>
				</subsection><subsection id="id07d8ed55-751e-4f96-baeb-8d6d367834a9"><enum>(b)</enum><header>Wells in
			 the San Juan River Basin</header><text>In accordance with the conjunctive
			 groundwater development plan, the Secretary may construct or rehabilitate wells
			 and related pipeline facilities to provide capacity for the diversion and
			 distribution of not more than 1,670 acre-feet of groundwater in the San Juan
			 River Basin in the State of New Mexico for municipal and domestic uses.</text>
				</subsection><subsection id="idbd08f1e3-cf2d-4765-9c0c-97359d6ebce7"><enum>(c)</enum><header>Wells in
			 the little Colorado and rio grande basins</header>
					<paragraph id="ide89c7ddb-1001-4522-bc2c-494c7127300c"><enum>(1)</enum><header>In
			 general</header><text>In accordance with the Project and conjunctive
			 groundwater development plan for the Nation, the Secretary may construct or
			 rehabilitate wells and related pipeline facilities to provide capacity for the
			 diversion and distribution of—</text>
						<subparagraph id="ida2250f96-69c4-49d7-8ef2-10f9a06f3d27"><enum>(A)</enum><text>not more than
			 680 acre-feet of groundwater in the Little Colorado River Basin in the State of
			 New Mexico;</text>
						</subparagraph><subparagraph id="id62313a56-cb61-43ef-b49c-0f14b2b60664"><enum>(B)</enum><text>not more than
			 80 acre-feet of groundwater in the Rio Grande Basin in the State of New Mexico;
			 and</text>
						</subparagraph><subparagraph id="id0bf4f14f-0f2c-4033-a382-5e06e5a39489"><enum>(C)</enum><text>not more than
			 770 acre-feet of groundwater in the Little Colorado River Basin in the State of
			 Arizona.</text>
						</subparagraph></paragraph><paragraph id="id287ebb0a-9a08-4644-8cd9-3c3358ea8700"><enum>(2)</enum><header>Use</header><text>Groundwater
			 diverted and distributed under paragraph (1) shall be used for municipal and
			 domestic uses.</text>
					</paragraph></subsection><subsection id="id49322a54-75bb-4668-83e4-c394e4852a5b"><enum>(d)</enum><header>Acquisition
			 of land</header>
					<paragraph id="id39fc057b-52fb-4632-ac66-f5764a3f25f7"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), the Secretary may
			 acquire any land or interest in land that is necessary for the construction,
			 operation, and maintenance of the wells and related pipeline facilities
			 authorized under subsections (b) and (c).</text>
					</paragraph><paragraph id="ide7aa9427-5d96-4957-9bc6-45527c625a48"><enum>(2)</enum><header>Limitation</header><text>Nothing
			 in this subsection authorizes the Secretary to condemn water rights for the
			 purposes described in paragraph (1).</text>
					</paragraph></subsection><subsection id="idf9ed1ce4-a555-401a-9c51-d0aff92a2359"><enum>(e)</enum><header>Condition</header><text>The
			 Secretary shall not commence any construction activity relating to the wells
			 described in subsections (b) and (c) until the Secretary executes the
			 Agreement.</text>
				</subsection><subsection id="idbca1a275-4db0-47a2-b182-2e77124e871d"><enum>(f)</enum><header>Conveyance
			 of wells</header>
					<paragraph id="id0022ca75-aad7-47fd-91b7-d4a04088bd53"><enum>(1)</enum><header>In
			 general</header><text>On the determination of the Secretary that the wells and
			 related facilities are substantially complete and delivery of water generated
			 by the wells can be made to the Nation, an agreement with the Nation shall be
			 entered into, to convey to the Nation title to—</text>
						<subparagraph id="id298299dc-54b8-4fbd-8a38-121d841052e6"><enum>(A)</enum><text>any well or
			 related pipeline facility constructed or rehabilitated under subsections (a)
			 and (b) after the wells and related facilities have been completed; and</text>
						</subparagraph><subparagraph id="ida2d15a93-c143-4b34-8321-5380dba7acbf"><enum>(B)</enum><text>any land or
			 interest in land acquired by the United States for the construction, operation,
			 and maintenance of the well or related pipeline facility.</text>
						</subparagraph></paragraph><paragraph id="IDca86b4b5b40d476ba9c25461a1606544"><enum>(2)</enum><header>Operation,
			 maintenance, and replacement</header>
						<subparagraph id="id18E0FCD5869547ADB48456D4C56CDB34"><enum>(A)</enum><header>In
			 general</header><text>The Secretary is authorized to pay operation and
			 maintenance costs for the wells and related pipeline facilities authorized
			 under this subsection until title to the facilities is conveyed to the
			 Nation.</text>
						</subparagraph><subparagraph id="idF114164F46624A02B3F95E28BA75F8B4"><enum>(B)</enum><header>Subsequent
			 assumption by Nation</header><text>On completion of a conveyance of title under
			 paragraph (1), the Nation shall assume all responsibility for the operation and
			 maintenance of the well or related pipeline facility conveyed.</text>
						</subparagraph></paragraph><paragraph id="id2136a1d2-1b21-47e4-90c5-cab327e23657"><enum>(3)</enum><header>Effect of
			 conveyance</header><text>The conveyance of title to the Nation of the
			 conjunctive use wells under paragraph (1) shall not affect the application of
			 the <act-name parsable-cite="ESA">Endangered Species Act of 1973</act-name> (16
			 U.S.C. 1531 et seq.).</text>
					</paragraph></subsection><subsection id="idd7c9156c-e04d-4256-aec9-829b5bd26c0e"><enum>(g)</enum><header>Use of
			 project facilities</header><text>The capacities of the treatment facilities,
			 main pipelines, and lateral pipelines of the Project authorized by section
			 302(b) may be used to treat and convey groundwater to Nation communities if the
			 Nation provides for payment of the operation, maintenance, and replacement
			 costs associated with the use of the facilities or pipelines.</text>
				</subsection><subsection id="iddf35013c-6ff4-43e7-9aea-300d8e64eef5"><enum>(h)</enum><header>Limitations</header><text>The
			 diversion and use of groundwater by wells constructed or rehabilitated under
			 this section shall be made in a manner consistent with applicable Federal and
			 State law.</text>
				</subsection></section><section id="idf4b0d067-1ed3-457d-86ef-c94f461c04eb"><enum>307.</enum><header>San Juan
			 River Navajo Irrigation Projects</header>
				<subsection id="ide5c15b64-47fe-4dba-8ebe-db7ae2bc9aba"><enum>(a)</enum><header>Rehabilitation</header><text>Subject
			 to subsection (b), the Secretary shall rehabilitate—</text>
					<paragraph id="id404a7441-b460-4f6a-8aae-35e738d82215"><enum>(1)</enum><text>the
			 Fruitland-Cambridge Irrigation Project to serve not more than 3,335 acres of
			 land, which shall be considered to be the total serviceable area of the
			 project; and</text>
					</paragraph><paragraph id="id097131f8-8638-4ef1-bb28-ed8b8661ac52"><enum>(2)</enum><text>the
			 Hogback-Cudei Irrigation Project to serve not more than 8,830 acres of land,
			 which shall be considered to be the total serviceable area of the
			 project.</text>
					</paragraph></subsection><subsection id="ide73ef280-6f0b-4d89-be30-09f56830b3c8"><enum>(b)</enum><header>Condition</header><text>The
			 Secretary shall not commence any construction activity relating to the
			 rehabilitation of the Fruitland-Cambridge Irrigation Project or the
			 Hogback-Cudei Irrigation Project under subsection (a) until the Secretary
			 executes the Agreement.</text>
				</subsection><subsection id="id5e491fe1-7ca7-4a99-bf9d-609dd841b476"><enum>(c)</enum><header>Operation,
			 maintenance, and replacement obligation</header><text>The Nation shall continue
			 to be responsible for the operation, maintenance, and replacement of each
			 facility rehabilitated under this section.</text>
				</subsection></section><section id="ide1a16197-78c8-48c2-901d-662f9e65a857"><enum>308.</enum><header>Other
			 irrigation projects</header>
				<subsection id="id84f829da-c0a7-466a-9e7a-0cd33662e401"><enum>(a)</enum><header>In
			 general</header><text>Not later than 2 years after the date of enactment of
			 this Act, the Secretary, in consultation with the State of New Mexico (acting
			 through the Interstate Stream Commission) and the Non-Navajo Irrigation
			 Districts that elect to participate, shall—</text>
					<paragraph id="id2d20ce62-e4fb-439e-8672-144da668a173"><enum>(1)</enum><text>conduct a
			 study of Non-Navajo Irrigation District diversion and ditch facilities;
			 and</text>
					</paragraph><paragraph id="ida66fc242-3001-4a16-9c46-9e3109fd9126"><enum>(2)</enum><text>based on the
			 study, identify and prioritize a list of projects, with associated cost
			 estimates, that are recommended to be implemented to repair, rehabilitate, or
			 reconstruct irrigation diversion and ditch facilities to improve water use
			 efficiency.</text>
					</paragraph></subsection><subsection id="id89cc365c-6bd5-4f3d-a644-cd12957a05b3"><enum>(b)</enum><header>Grants</header><text>The
			 Secretary may provide grants to, and enter into cooperative agreements with,
			 the Non-Navajo Irrigation Districts to plan, design, or otherwise implement the
			 projects identified under subsection (a)(2).</text>
				</subsection><subsection id="ida7a1aa1e-b3f4-4b15-9a70-f6d7af2aa4fb"><enum>(c)</enum><header>Cost-sharing</header>
					<paragraph id="id5ebfcbc9-ddcf-4067-87a8-4844a699c6e5"><enum>(1)</enum><header>Federal
			 share</header><text>The Federal share of the total cost of carrying out a
			 project under subsection (b) shall be not more than 50 percent, and shall be
			 nonreimbursable.</text>
					</paragraph><paragraph id="id358e43e0-3168-421e-a983-5a8addaff53e"><enum>(2)</enum><header>Form</header><text>The
			 non-Federal share required under paragraph (1) may be in the form of in-kind
			 contributions, including the contribution of any valuable asset or service that
			 the Secretary determines would substantially contribute to a project carried
			 out under subsection (b).</text>
					</paragraph><paragraph id="id57973849-6728-4c4d-9a13-98edf0380f60"><enum>(3)</enum><header>State
			 contribution</header><text>The Secretary may accept from the State of New
			 Mexico a partial or total contribution toward the non-Federal share for a
			 project carried out under subsection (b).</text>
					</paragraph></subsection></section><section id="id07e7892a-a117-4a09-94eb-c745b7fa5494"><enum>309.</enum><header>Authorization
			 of appropriations</header>
				<subsection id="ida24772dd-32d5-4cc4-87cd-5c092ae31551"><enum>(a)</enum><header>Authorization
			 of appropriations for Navajo-Gallup Water Supply Project</header>
					<paragraph id="IDb1dd402ad95d4a7c83c950f267dfa051"><enum>(1)</enum><header>In
			 general</header><text>There is authorized to be appropriated to the Secretary
			 to plan, design, and construct the Project $870,000,000 for the period of
			 fiscal years 2009 through 2024, to remain available until expended.</text>
					</paragraph><paragraph id="id8ec67965-2863-4977-b918-b26fa535dedc"><enum>(2)</enum><header>Adjustments</header><text>The
			 amount under paragraph (1) shall be adjusted by such amounts as may be required
			 by reason of changes since 2007 in construction costs, as indicated by
			 engineering cost indices applicable to the types of construction
			 involved.</text>
					</paragraph><paragraph id="id78d73646-04cf-45db-a305-539c6adc5acf"><enum>(3)</enum><header>Use</header><text>In
			 addition to the uses authorized under paragraph (1), amounts made available
			 under that paragraph may be used for the conduct of related activities to
			 comply with Federal environmental laws.</text>
					</paragraph><paragraph id="ID264aa21eda264db9ad842e2d29ccf918"><enum>(4)</enum><header>Operation and
			 maintenance</header>
						<subparagraph id="ID9455b7f9d15446f997d45cd8ad4c9255"><enum>(A)</enum><header>In
			 general</header><text>There are authorized to be appropriated such sums as are
			 necessary to operate and maintain the Project consistent with this Act.</text>
						</subparagraph><subparagraph id="ID672f22eb23574b1ebfb43669fd89353f"><enum>(B)</enum><header>Expiration</header><text>The
			 authorization under subparagraph (A) shall expire 10 years after the year the
			 Secretary declares the Project to be substantially complete.</text>
						</subparagraph></paragraph></subsection><subsection id="id9aab6f9e-adad-4f61-a69d-31a97ee8c1e2"><enum>(b)</enum><header>Appropriations
			 for conjunctive use wells</header>
					<paragraph id="idc8a49f5a-ff3a-47bc-8bf5-0784437c2956"><enum>(1)</enum><header>San Juan
			 wells</header><text>There is authorized to be appropriated to the Secretary for
			 the construction or rehabilitation and operation and maintenance of conjunctive
			 use wells under section 306(b) $30,000,000, as adjusted under paragraph (3),
			 for the period of fiscal years 2009 through 2019.</text>
					</paragraph><paragraph id="id263e4b0b-a89e-4066-99e2-ecebbc1bf91a"><enum>(2)</enum><header>Wells in
			 the little Colorado and rio grande basins</header><text>There are authorized to
			 be appropriated to the Secretary for the construction or rehabilitation and
			 operation and maintenance of conjunctive use wells under section 306(c) such
			 sums as are necessary for the period of fiscal years 2009 through 2024.</text>
					</paragraph><paragraph id="ide66a95c3-dccc-4ba6-9e0f-70d60095d674"><enum>(3)</enum><header>Adjustments</header><text>The
			 amount under paragraph (1) shall be adjusted by such amounts as may be required
			 by reason of changes since 2008 in construction costs, as indicated by
			 engineering cost indices applicable to the types of construction or
			 rehabilitation involved.</text>
					</paragraph><paragraph id="idccbe2cec-2550-487c-87d7-5b6edb29eb2c"><enum>(4)</enum><header>Nonreimbursable
			 expenditures</header><text>Amounts made available under paragraphs (1) and (2)
			 shall be nonreimbursable to the United States.</text>
					</paragraph><paragraph id="idd938bee5-a350-4e34-b5bc-800df216fb53"><enum>(5)</enum><header>Use</header><text>In
			 addition to the uses authorized under paragraphs (1) and (2), amounts made
			 available under that paragraph may be used for the conduct of related
			 activities to comply with Federal environmental laws.</text>
					</paragraph><paragraph id="IDbda4cdb6c89b434986a03ce2563ca770"><enum>(6)</enum><header>Limitation</header><text>Appropriations
			 authorized under paragraph (1) shall not be used for operation or maintenance
			 of any conjunctive use wells at a time in excess of 3 years after the well is
			 declared substantially complete.</text>
					</paragraph></subsection><subsection id="idbe057365-458b-4039-87ca-60665f7185d4"><enum>(c)</enum><header>San Juan
			 River Irrigation Projects</header>
					<paragraph id="id95fd2eac-da85-48b8-985b-fa99ee12d55e"><enum>(1)</enum><header>In
			 general</header><text>There are authorized to be appropriated to the
			 Secretary—</text>
						<subparagraph id="id13c6a0d5-0b87-4391-b758-e5be19c6d028"><enum>(A)</enum><text>to carry out
			 section 307(a)(1), not more than $7,700,000, as adjusted under paragraph (2),
			 for the period of fiscal years 2009 through 2015, to remain available until
			 expended; and</text>
						</subparagraph><subparagraph id="id05e05d55-78c1-4517-9222-0bbafa5a16da"><enum>(B)</enum><text>to carry out
			 section 307(a)(2), not more than $15,400,000, as adjusted under paragraph (2),
			 for the period of fiscal years 2009 through 2018, to remain available until
			 expended.</text>
						</subparagraph></paragraph><paragraph id="ida8f41a43-fa9e-47ba-a3e3-556f915ac109"><enum>(2)</enum><header>Adjustment</header><text>The
			 amounts made available under paragraph (1) shall be adjusted by such amounts as
			 may be required by reason of changes since January 1, 2004, in construction
			 costs, as indicated by engineering cost indices applicable to the types of
			 construction involved in the rehabilitation.</text>
					</paragraph><paragraph id="idee7c6a58-8f85-4752-a8fb-5a44a3cb308b"><enum>(3)</enum><header>Nonreimbursable
			 expenditures</header><text>Amounts made available under this subsection shall
			 be nonreimbursable to the United States.</text>
					</paragraph></subsection><subsection id="id393b35b6-8cec-458c-a095-986d3b3aee6f"><enum>(d)</enum><header>Other
			 irrigation projects</header><text>There are authorized to be appropriated to
			 the Secretary to carry out section 308 $11,000,000 for the period of fiscal
			 years 2009 through 2018.</text>
				</subsection><subsection id="id7026a92e-6cc4-435f-a231-9f114f4c06f6"><enum>(e)</enum><header>Cultural
			 resources</header>
					<paragraph id="id84e06fef-09ac-440f-9915-6a4996f4d513"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may use not more than 2 percent of amounts
			 made available under subsections (a), (b), and (c) for the survey, recovery,
			 protection, preservation, and display of archaeological resources in the area
			 of a Project facility or conjunctive use well.</text>
					</paragraph><paragraph id="ida80382df-e1f5-4a03-a15b-41165a15367c"><enum>(2)</enum><header>Nonreimbursable
			 expenditures</header><text>Any amounts made available under paragraph (1) shall
			 be nonreimbursable.</text>
					</paragraph></subsection><subsection id="id256e3ba6-0445-4ce0-b618-2c1d1c4fa931"><enum>(f)</enum><header>Fish and
			 wildlife facilities</header>
					<paragraph id="id46e950f1-b030-49c8-8898-f82652a182b2"><enum>(1)</enum><header>In
			 general</header><text>In association with the development of the Project, the
			 Secretary may use not more than 4 percent of amounts made available under
			 subsections (a), (b), and (c) to purchase land and construct and maintain
			 facilities to mitigate the loss of, and improve conditions for the propagation
			 of, fish and wildlife if any such purchase, construction, or maintenance will
			 not affect the operation of any water project or use of water.</text>
					</paragraph><paragraph id="id0920138d-76b1-4576-83f6-d2487188e407"><enum>(2)</enum><header>Nonreimbursable
			 expenditures</header><text>Any amounts expended under paragraph (1) shall be
			 nonreimbursable.</text>
					</paragraph></subsection></section></title><title id="id479e6f17-055f-4d0e-a8ad-75e2d050b6cb"><enum>IV</enum><header>Navajo
			 Nation water rights</header>
			<section id="id1eba904e-3a67-4783-b047-65b03a3e8af9"><enum>401.</enum><header>Agreement</header>
				<subsection id="id04648518-9e49-4b84-92b0-7d07b9b97966"><enum>(a)</enum><header>Agreement
			 approval</header>
					<paragraph id="id87db238c-a710-4da1-abaf-33b5ee3a0a32"><enum>(1)</enum><header>Approval by
			 congress</header><text>Except to the extent that any provision of the Agreement
			 conflicts with this Act, Congress approves, ratifies, and confirms the
			 Agreement (including any amendments to the Agreement that are executed to make
			 the Agreement consistent with this Act).</text>
					</paragraph><paragraph id="id4863bc75-1fc7-4f2c-a635-3c996f382784"><enum>(2)</enum><header>Execution
			 by secretary</header><text>The Secretary shall enter into the Agreement to the
			 extent that the Agreement does not conflict with this Act, including—</text>
						<subparagraph id="idaafaffcc-4e55-4336-81cd-b2f1b4725faa"><enum>(A)</enum><text>any exhibits
			 to the Agreement requiring the signature of the Secretary; and</text>
						</subparagraph><subparagraph id="id9822140a-4832-4aa6-aa23-6e160a23fed3"><enum>(B)</enum><text>any
			 amendments to the Agreement necessary to make the Agreement consistent with
			 this Act.</text>
						</subparagraph></paragraph><paragraph id="id77c29741-50e7-4c25-a4b0-2aade723ba5c"><enum>(3)</enum><header>Authority
			 of secretary</header><text>The Secretary may carry out any action that the
			 Secretary determines is necessary or appropriate to implement the Agreement,
			 the Contract, and this section.</text>
					</paragraph><paragraph id="id5d37e22b-ad8b-402d-a0ca-3ef9dc9c10ec"><enum>(4)</enum><header>Administration
			 of navajo reservoir releases</header><text>The State of New Mexico may
			 administer water that has been released from storage in Navajo Reservoir in
			 accordance with subparagraph 9.1 of the Agreement.</text>
					</paragraph></subsection><subsection id="idd8268836-51c1-4eb9-964e-cd9bd8cf77d6"><enum>(b)</enum><header>Water
			 available under contract</header>
					<paragraph id="idc1682586-1793-48e0-9236-7f1af9b447cc"><enum>(1)</enum><header>Quantities
			 of water available</header>
						<subparagraph id="id5fc2c896-5791-4d06-b3e8-63f6de39363a"><enum>(A)</enum><header>In
			 general</header><text>Water shall be made available annually under the Contract
			 for projects in the State of New Mexico supplied from the Navajo Reservoir and
			 the San Juan River (including tributaries of the River) under New Mexico State
			 Engineer File Numbers 2849, 2883, and 3215 in the quantities described in
			 subparagraph (B).</text>
						</subparagraph><subparagraph id="idbbe8c3b5-038f-4aa2-9dc8-43f7a8b23697"><enum>(B)</enum><header>Water
			 quantities</header><text>The quantities of water referred to in subparagraph
			 (A) are as follows:</text>

			 quantity</header><text>A diversion of water to the Nation under the Contract
			 for a project described in subparagraph (B) shall not exceed the quantity of
			 water necessary to supply the amount of depletion for the project.</text>
						</subparagraph><subparagraph id="id83828d77-efb8-4d28-b5ee-3780fde45143"><enum>(D)</enum><header>Terms,
			 conditions, and limitations</header><text>The diversion and use of water under
			 the Contract shall be subject to and consistent with the terms, conditions, and
			 limitations of the Agreement, this Act, and any other applicable law.</text>
						</subparagraph></paragraph><paragraph id="id32231737-d50b-4332-b897-8e46bc502641"><enum>(2)</enum><header>Amendments
			 to contract</header><text>The Secretary, with the consent of the Nation, may
			 amend the Contract if the Secretary determines that the amendment is—</text>
						<subparagraph id="ida39bd72d-86aa-44ae-93ec-d69bf44806ec"><enum>(A)</enum><text>consistent
			 with the Agreement; and</text>
						</subparagraph><subparagraph id="idba655ad5-7ec8-45a8-9a13-50fc2a3fd6fb"><enum>(B)</enum><text>in the
			 interest of conserving water or facilitating beneficial use by the Nation or a
			 subcontractor of the Nation.</text>
						</subparagraph></paragraph><paragraph id="id4d9cb309-98b6-4adc-adfc-795a2de9a7ee"><enum>(3)</enum><header>Rights of
			 the Nation</header><text>The Nation may, under the Contract—</text>
						<subparagraph id="idb9e06949-0a69-4e93-8d17-9b21e81bf63f"><enum>(A)</enum><text>use tail
			 water, wastewater, and return flows attributable to a use of the water by the
			 Nation or a subcontractor of the Nation if—</text>
							<clause id="id8155ee32-f5b6-47f0-bacd-f43fe935c446"><enum>(i)</enum><text>the depletion
			 of water does not exceed the quantities described in paragraph (1); and</text>
							</clause><clause id="id7fae93ff-2af5-4a2f-9676-0000e24e1cc5"><enum>(ii)</enum><text>the use of
			 tail water, wastewater, or return flows is consistent with the terms,
			 conditions, and limitations of the Agreement, and any other applicable law;
			 and</text>
							</clause></subparagraph><subparagraph id="id7c25541a-5554-46ff-9bb7-aee57010307e"><enum>(B)</enum><text>change a
			 point of diversion, change a purpose or place of use, and transfer a right for
			 depletion under this Act (except for a point of diversion, purpose or place of
			 use, or right for depletion for use in the State of Arizona under section
			 303(b)(2)(D)), to another use, purpose, place, or depletion in the State of New
			 Mexico to meet a water resource or economic need of the Nation if—</text>
							<clause id="idaf6f0f8d-8c6d-44da-8fcf-2b63292d756e"><enum>(i)</enum><text>the change or
			 transfer is subject to and consistent with the terms of the Agreement, the
			 Partial Final Decree described in paragraph 3.0 of the Agreement, the Contract,
			 and any other applicable law; and</text>
							</clause><clause id="id38827f3d-0840-48bc-8f7e-1e2c90b30e87"><enum>(ii)</enum><text>a change or
			 transfer of water use by the Nation does not alter any obligation of the United
			 States, the Nation, or another party to pay or repay project construction,
			 operation, maintenance, or replacement costs under this Act and the
			 Contract.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="idc5e4d202-1522-4fbb-850b-7bc6e890fb75"><enum>(c)</enum><header>Subcontracts</header>
					<paragraph id="id7e302462-e1f1-4149-bd6a-605ffff15ca8"><enum>(1)</enum><header>In
			 general</header>
						<subparagraph id="ida8b603bc-f344-457c-b5d4-fa7edec29212"><enum>(A)</enum><header>Subcontracts
			 between nation and third parties</header><text>The Nation may enter into
			 subcontracts for the delivery of Project water under the Contract to third
			 parties for any beneficial use in the State of New Mexico (on or off land held
			 by the United States in trust for the Nation or a member of the Nation or land
			 held in fee by the Nation).</text>
						</subparagraph><subparagraph id="idd3171cbd-71dd-44bf-a192-a434094afa3b"><enum>(B)</enum><header>Approval
			 required</header><text>A subcontract entered into under subparagraph (A) shall
			 not be effective until approved by the Secretary in accordance with this
			 subsection and the Contract.</text>
						</subparagraph><subparagraph id="idbfda7ff0-f2a2-40aa-abeb-3006196f7b75"><enum>(C)</enum><header>Submittal</header><text>The
			 Nation shall submit to the Secretary for approval or disapproval any
			 subcontract entered into under this subsection.</text>
						</subparagraph><subparagraph id="id9d04000f-1932-49f7-b84f-5be31a67feb4"><enum>(D)</enum><header>Deadline</header><text>The
			 Secretary shall approve or disapprove a subcontract submitted to the Secretary
			 under subparagraph (C) not later than the later of—</text>
							<clause id="id61752e8e-3221-43eb-a17b-3f3ba56054b3"><enum>(i)</enum><text>the date that
			 is 180 days after the date on which the subcontract is submitted to the
			 Secretary; and</text>
							</clause><clause id="id68b0b391-0562-4e4f-8dbc-b07804bf1bd8"><enum>(ii)</enum><text>the date
			 that is 60 days after the date on which a subcontractor complies with—</text>
								<subclause id="id8a8afb26-d6ec-4cc8-ac37-51bd94d8393d"><enum>(I)</enum><text>section
			 102(2)(C) of the National Environmental Policy Act of 1969 (42 U.S.C.
			 4332(2)(C)); and</text>
								</subclause><subclause id="id2c9f3112-f65c-45bc-b88b-6bc401216c38"><enum>(II)</enum><text>any other
			 requirement of Federal law.</text>
								</subclause></clause></subparagraph><subparagraph id="id3f8f0074-251e-4731-af8a-0cb7c6e9a895"><enum>(E)</enum><header>Enforcement</header><text>A
			 party to a subcontract may enforce the deadline described in subparagraph (D)
			 under section 1361 of title 28, United States Code.</text>
						</subparagraph><subparagraph id="idf34fe04f-7ffa-41a0-a159-7fb4f02b17ac"><enum>(F)</enum><header>Compliance
			 with other law</header><text>A subcontract described in subparagraph (A) shall
			 comply with the Agreement, the Partial Final Decree described in paragraph 3.0
			 of the Agreement, and any other applicable law.</text>
						</subparagraph><subparagraph id="ID57b30139358342d688bfdd2fd111cd0e"><enum>(G)</enum><header>No
			 liability</header><text>The Secretary shall not be liable to any party,
			 including the Nation, for any term of, or any loss or other detriment resulting
			 from, a lease, contract, or other agreement entered into pursuant to this
			 subsection.</text>
						</subparagraph></paragraph><paragraph id="id6efce054-c6d2-4842-9660-198992ac148f"><enum>(2)</enum><header>Alienation</header>
						<subparagraph id="id921ee732-8b3d-47c8-854a-4a0290dfe519"><enum>(A)</enum><header>Permanent
			 alienation</header><text>The Nation shall not permanently alienate any right
			 granted to the Nation under the Contract.</text>
						</subparagraph><subparagraph id="ide184a8e3-b554-4c5c-af61-2a37ecf16eaf"><enum>(B)</enum><header>Maximum
			 term</header><text>The term of any water use subcontract (including a renewal)
			 under this subsection shall be not more than 99 years.</text>
						</subparagraph></paragraph><paragraph id="id6778260c-a483-4069-bdd4-f03834cf1402"><enum>(3)</enum><header>Nonintercourse
			 Act compliance</header><text>This subsection—</text>
						<subparagraph id="idab3ea5f9-c6f7-4deb-923f-7aa86b6f9b02"><enum>(A)</enum><text>provides
			 congressional authorization for the subcontracting rights of the Nation;
			 and</text>
						</subparagraph><subparagraph id="id6b9f05d7-1ef1-4e52-8382-0ba33a5e75bc"><enum>(B)</enum><text>is deemed to
			 fulfill any requirement that may be imposed by section 2116 of the Revised
			 Statutes (25 U.S.C. 177).</text>
						</subparagraph></paragraph><paragraph id="id1eb7cf00-6ed1-4bd1-acce-28d690895be5"><enum>(4)</enum><header>Forfeiture</header><text>The
			 nonuse of the water supply secured by a subcontractor of the Nation under this
			 subsection shall not result in forfeiture, abandonment, relinquishment, or
			 other loss of any part of a right decreed to the Nation under the Contract or
			 this section.</text>
					</paragraph><paragraph id="id9af3fcf3-a6a9-412d-9bcf-bac6447dddd8"><enum>(5)</enum><header>No per
			 capita payments</header><text>No part of the revenue from a water use
			 subcontract under this subsection shall be distributed to any member of the
			 Nation on a per capita basis.</text>
					</paragraph></subsection><subsection id="ida6862935-259d-40fb-826c-f4c2e8ff24dd"><enum>(d)</enum><header>Water
			 leases not requiring subcontracts</header>
					<paragraph id="id5b45af4d-693e-4d10-9e08-f4fd3f543d88"><enum>(1)</enum><header>Authority
			 of nation</header>
						<subparagraph id="ida8faef54-dc73-41b6-960b-fb78ab98a827"><enum>(A)</enum><header>In
			 general</header><text>The Nation may lease, contract, or otherwise transfer to
			 another party or to another purpose or place of use in the State of New Mexico
			 (on or off land that is held by the United States in trust for the Nation or a
			 member of the Nation or held in fee by the Nation) a water right that—</text>
							<clause id="id1e336cc8-d153-45f4-9782-cdde3b6f845e"><enum>(i)</enum><text>is decreed to
			 the Nation under the Agreement; and</text>
							</clause><clause id="idc6ee0534-fded-4ebc-9f74-741d018da3d6"><enum>(ii)</enum><text>is not
			 subject to the Contract.</text>
							</clause></subparagraph><subparagraph id="id88b1199f-a41c-418b-84fe-964c7be7f919"><enum>(B)</enum><header>Compliance
			 with other law</header><text>In carrying out an action under this subsection,
			 the Nation shall comply with the Agreement, the Partial Final Decree described
			 in paragraph 3.0 of the Agreement, the Supplemental Partial Final Decree
			 described in paragraph 4.0 of the Agreement, and any other applicable
			 law.</text>
						</subparagraph></paragraph><paragraph id="id68d321ce-9166-4c8a-8e08-ed32a6398361"><enum>(2)</enum><header>Alienation;
			 maximum term</header>
						<subparagraph id="idd50bab53-c832-4eb9-8083-11daa23b63fe"><enum>(A)</enum><header>Alienation</header><text>The
			 Nation shall not permanently alienate any right granted to the Nation under the
			 Agreement.</text>
						</subparagraph><subparagraph id="id59540e16-2e6d-45c0-8f7e-956f452fdb90"><enum>(B)</enum><header>Maximum
			 term</header><text>The term of any water use lease, contract, or other
			 arrangement (including a renewal) under this subsection shall be not more than
			 99 years.</text>
						</subparagraph></paragraph><paragraph id="IDb944d26da045476ebd1210c83f63c6f1"><enum>(3)</enum><header>No
			 liability</header><text>The Secretary shall not be liable to any party,
			 including the Nation, for any term of, or any loss or other detriment resulting
			 from, a lease, contract, or other agreement entered into pursuant to this
			 subsection.</text>
					</paragraph><paragraph id="ideca80b34-0fb0-4836-a2a0-6c0d5295aedb"><enum>(4)</enum><header>Nonintercourse
			 act compliance</header><text>This subsection—</text>
						<subparagraph id="id6222a530-c2ef-499b-92e3-946c1175f57e"><enum>(A)</enum><text>provides
			 congressional authorization for the lease, contracting, and transfer of any
			 water right described in paragraph (1)(A); and</text>
						</subparagraph><subparagraph id="id68c5689f-c19e-4307-b758-8354447ce766"><enum>(B)</enum><text>is deemed to
			 fulfill any requirement that may be imposed by the provisions of section 2116
			 of the Revised Statutes (25 U.S.C. 177).</text>
						</subparagraph></paragraph><paragraph id="id06ec758c-5f43-4214-b67f-5d820796f299"><enum>(5)</enum><header>Forfeiture</header><text>The
			 nonuse of a water right of the Nation by a lessee or contractor to the Nation
			 under this subsection shall not result in forfeiture, abandonment,
			 relinquishment, or other loss of any part of a right decreed to the Nation
			 under the Contract or this section.</text>
					</paragraph></subsection><subsection id="ida7ad64f4-85d3-4c9d-a3ef-adfec0cd7227"><enum>(e)</enum><header>Nullification</header>
					<paragraph id="idf359c535-d760-4dc3-bd27-99d28d6a11f5"><enum>(1)</enum><header>Deadlines</header>
						<subparagraph id="ide987a095-3c0a-4015-bb45-67c54352b39f"><enum>(A)</enum><header>In
			 general</header><text>In carrying out this section, the following deadlines
			 apply with respect to implementation of the Agreement:</text>
							<clause id="id791c8123-7003-4775-99f7-b4df2a0c98b5"><enum>(i)</enum><header>Agreement</header><text>Not
			 later than December 31, 2009, the Secretary shall execute the Agreement.</text>
							</clause><clause id="id7dd983f5-481d-4ddb-98be-f2d67a13c074"><enum>(ii)</enum><header>Contract</header><text>Not
			 later than December 31, 2009, the Secretary and the Nation shall execute the
			 Contract.</text>
							</clause><clause id="id338b9246-629e-4d42-9c9f-336b9fc89c1c"><enum>(iii)</enum><header>Partial
			 final decree</header><text>Not later than December 31, 2012, the court in the
			 stream adjudication shall have entered the Partial Final Decree described in
			 paragraph 3.0 of the Agreement.</text>
							</clause><clause id="idf569a382-1d41-440a-9506-ad5d7eae83ec"><enum>(iv)</enum><header>Fruitland-Cambridge
			 irrigation project</header><text>Not later than December 31, 2015, the
			 rehabilitation construction of the Fruitland-Cambridge Irrigation Project
			 authorized under section 307(a)(1) shall be completed.</text>
							</clause><clause id="id7c4108bc-3826-4f93-85fa-cc51107f14fc"><enum>(v)</enum><header>Supplemental
			 partial final decree</header><text>Not later than December 31, 2015, the court
			 in the stream adjudication shall enter the Supplemental Partial Final Decree
			 described in subparagraph 4.0 of the Agreement.</text>
							</clause><clause id="id342cd409-fd89-42ea-bc0b-a7730f9a5611"><enum>(vi)</enum><header>Hogback-Cudei
			 Irrigation Project</header><text>Not later than December 31, 2018, the
			 rehabilitation construction of the Hogback-Cudei Irrigation Project authorized
			 under section 307(a)(2) shall be completed.</text>
							</clause><clause id="id119b5317-665e-452a-a5c1-f016a485c6a2"><enum>(vii)</enum><header>Trust
			 fund</header><text>Not later than December 31, 2019, the United States shall
			 make all deposits into the Trust Fund under section 402.</text>
							</clause><clause id="ide4695e22-d5f7-41fc-9074-2f05b1735286"><enum>(viii)</enum><header>Conjunctive
			 wells</header><text>Not later than December 31, 2019, the funds authorized to
			 be appropriated under section 309(b)(1) for the conjunctive use wells
			 authorized under section 306(b) should be appropriated.</text>
							</clause><clause id="id6711b9a4-7ad5-491e-a00f-1377906a5afa"><enum>(ix)</enum><header>Navajo-Gallup
			 Water Supply Project</header><text>Not later than December 31, 2024, the
			 construction of all Project facilities shall be completed.</text>
							</clause></subparagraph><subparagraph id="ide49ebef3-0eed-480c-808d-db1863996b61"><enum>(B)</enum><header>Extension</header><text>A
			 deadline described in subparagraph (A) may be extended if the Nation, the
			 United States (acting through the Secretary), and the State of New Mexico
			 (acting through the New Mexico Interstate Stream Commission) agree that an
			 extension is reasonably necessary.</text>
						</subparagraph></paragraph><paragraph id="id19ec33d5-a5dd-4208-aa40-b05f1ba7c3e4"><enum>(2)</enum><header>Revocability
			 of agreement, contract and authorizations</header>
						<subparagraph id="idfac6d041-8d5c-4688-bc54-d10e7f73e0a3"><enum>(A)</enum><header>Petition</header><text>If
			 the Nation determines that a deadline described in paragraph (1)(A) is not
			 substantially met, the Nation may submit to the court in the stream
			 adjudication a petition to enter an order terminating the Agreement and
			 Contract.</text>
						</subparagraph><subparagraph id="id0677397d-15a5-4a45-9c05-0d37046367ab"><enum>(B)</enum><header>Termination</header><text>On
			 issuance of an order to terminate the Agreement and Contract under subparagraph
			 (A)—</text>
							<clause id="id2b8239a0-c393-405e-91dd-9d5f577aecaa"><enum>(i)</enum><text>the Trust
			 Fund shall be terminated;</text>
							</clause><clause id="id6f3bc737-bcbb-4ecd-ab2b-a47974d2cdf7"><enum>(ii)</enum><text>the balance
			 of the Trust Fund shall be deposited in the general fund of the
			 Treasury;</text>
							</clause><clause id="idabd1b8a3-4db1-4249-9e71-1e78e7a9a07f"><enum>(iii)</enum><text>the
			 authorizations for construction and rehabilitation of water projects under this
			 Act shall be revoked and any Federal activity related to that construction and
			 rehabilitation shall be suspended; and</text>
							</clause><clause id="id0b8f7d2f-6878-4e3a-97fb-cc615152c769"><enum>(iv)</enum><text>this title
			 and titles I and III shall be null and void.</text>
							</clause></subparagraph></paragraph><paragraph id="id45c9a16b-bef0-4b4c-8781-0e74a54c4603"><enum>(3)</enum><header>Conditions
			 not causing nullification of settlement</header>
						<subparagraph id="idac5c7dd3-38db-4f82-9aa9-773b1b795fc6"><enum>(A)</enum><header>In
			 general</header><text>If a condition described in subparagraph (B) occurs, the
			 Agreement and Contract shall not be nullified or terminated.</text>
						</subparagraph><subparagraph id="id87d6d880-8061-4dcf-96e8-af480dc5de46"><enum>(B)</enum><header>Conditions</header><text>The
			 conditions referred to in subparagraph (A) are as follows:</text>
							<clause id="idfee013e5-ecb8-4326-9653-490ac69b825d"><enum>(i)</enum><text>A lack of
			 right to divert at the capacities of conjunctive use wells constructed or
			 rehabilitated under section 306.</text>
							</clause><clause id="id2a3f712b-dfc0-451b-819c-292447e18c41"><enum>(ii)</enum><text>A
			 failure—</text>
								<subclause id="id871ab848-6bb3-449e-a383-5c8d147e6018"><enum>(I)</enum><text>to determine
			 or resolve an accounting of the use of water under this Act in the State of
			 Arizona;</text>
								</subclause><subclause id="id29a2acbd-0e15-4ee6-a8c3-67ca36156985"><enum>(II)</enum><text>to obtain a
			 necessary water right for the consumptive use of water in Arizona;</text>
								</subclause><subclause id="id9c4f59c0-eac0-49fc-b287-e8c803183ffe"><enum>(III)</enum><text>to contract
			 for the delivery of water for use in Arizona; or</text>
								</subclause><subclause id="id0bccaae4-8e02-4aab-b039-c030b4c9dc34"><enum>(IV)</enum><text>to construct
			 and operate a lateral facility to deliver water to a community of the Nation in
			 Arizona, under the Project.</text>
								</subclause></clause></subparagraph></paragraph></subsection><subsection id="id2d6a9dc1-5c9c-4f1a-bf7b-b7a3e8e04cfa"><enum>(f)</enum><header>Effect on
			 rights of Indian tribes</header>
					<paragraph id="id20cf9f8c-ffd7-48ab-80f3-a4c6d68116b1"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), nothing in the
			 Agreement, the Contract, or this section quantifies or adversely affects the
			 land and water rights, or claims or entitlements to water, of any Indian tribe
			 or community other than the rights, claims, or entitlements of the Nation in,
			 to, and from the San Juan River Basin in the State of New Mexico.</text>
					</paragraph><paragraph id="id5ca33f58-64d0-4dd8-95c1-3c9178a34f4c"><enum>(2)</enum><header>Exception</header><text>The
			 right of the Nation to use water under water rights the Nation has in other
			 river basins in the State of New Mexico shall be forborne to the extent that
			 the Nation supplies the uses for which the water rights exist by diversions of
			 water from the San Juan River Basin under the Project consistent with
			 subparagraph 9.13 of the Agreement.</text>
					</paragraph></subsection></section><section id="id146bb8ff-52f0-4323-a783-46e99ca961b8"><enum>402.</enum><header>Trust
			 Fund</header>
				<subsection id="id8f49a57a-fcf3-46df-b152-3b47e7eafc3e"><enum>(a)</enum><header>Establishment</header><text>There
			 is established in the Treasury a fund to be known as the <quote>Navajo Nation
			 Water Resources Development Trust Fund</quote>, consisting of—</text>
					<paragraph id="idfd7794da-269a-4036-87ec-d7bbee36aa17"><enum>(1)</enum><text>such amounts
			 as are appropriated to the Trust Fund under subsection (f); and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5c414745-e3a1-4238-87ca-facec440161f"><enum>(2)</enum><text>any interest
			 earned on investment of amounts in the Trust Fund under subsection (d).</text>
					</paragraph></subsection><subsection id="ida8f370ca-66bc-43db-a620-0334f029b887"><enum>(b)</enum><header>Use of
			 funds</header><text>The Nation may use amounts in the Trust Fund—</text>
					<paragraph id="id9a2e9686-a886-4206-83a4-975c45af13df"><enum>(1)</enum><text>to
			 investigate, construct, operate, maintain, or replace water project facilities,
			 including facilities conveyed to the Nation under this Act and facilities owned
			 by the United States for which the Nation is responsible for operation,
			 maintenance, and replacement costs; and</text>
					</paragraph><paragraph id="id7e409e1b-f445-4aa4-bb3c-588e4aff8898"><enum>(2)</enum><text>to
			 investigate, implement, or improve a water conservation measure (including a
			 metering or monitoring activity) necessary for the Nation to make use of a
			 water right of the Nation under the Agreement.</text>
					</paragraph></subsection><subsection id="id4756eaf9-e47a-47ca-a12a-56b91670bad2"><enum>(c)</enum><header>Management</header><text>The
			 Secretary shall manage the Trust Fund, invest amounts in the Trust Fund, and
			 make amounts available from the Trust Fund for distribution to the Nation in
			 accordance with the American Indian Trust Fund Management Reform Act of 1994
			 (25 U.S.C. 4001 et seq.).</text>
				</subsection><subsection id="id68d4c6e7-950c-483c-bd01-b3a78ab90497"><enum>(d)</enum><header>Investment
			 of the Trust Fund</header><text>The Secretary shall invest amounts in the Trust
			 Fund in accordance with—</text>
					<paragraph id="id8b8c763f-07f2-47e9-848e-ab0c1036c6d2"><enum>(1)</enum><text>the Act of
			 April 1, 1880 (25 U.S.C. 161);</text>
					</paragraph><paragraph id="id4cd71721-f9b1-4822-aa67-fbaa2157e03f"><enum>(2)</enum><text>the first
			 section of the Act of June 24, 1938 (25 U.S.C. 162a); and</text>
					</paragraph><paragraph id="id0c597954-1534-4627-b7df-922f685f6517"><enum>(3)</enum><text>the American
			 Indian Trust Fund Management Reform Act of 1994 (25 U.S.C. 4001 et
			 seq.).</text>
					</paragraph></subsection><subsection id="id694928b0-37d1-4f35-a755-e56e47380483"><enum>(e)</enum><header>Conditions
			 for expenditures and withdrawals</header>
					<paragraph id="id2912e2bb-3232-4392-b57c-d38b2c4e1c99"><enum>(1)</enum><header>Tribal
			 management plan</header>
						<subparagraph id="ide873dfbd-3727-43e8-8e44-f0bb6da51e71"><enum>(A)</enum><header>In
			 general</header><text>Subject to paragraph (7), on approval by the Secretary of
			 a tribal management plan in accordance with the American Indian Trust Fund
			 Management Reform Act of 1994 (25 U.S.C. 4001 et seq.), the Nation may withdraw
			 all or a portion of the amounts in the Trust Fund.</text>
						</subparagraph><subparagraph id="id15041cc6-a771-420c-8691-6c61c239092e"><enum>(B)</enum><header>Requirements</header><text>In
			 addition to any requirements under the American Indian Trust Fund Management
			 Reform Act of 1994 (25 U.S.C. 4001 et seq.), the tribal management plan shall
			 require that the Nation only use amounts in the Trust Fund for the purposes
			 described in subsection (b), including the identification of water conservation
			 measures to be implemented in association with the agricultural water use of
			 the Nation.</text>
						</subparagraph></paragraph><paragraph id="idbd2340c4-925a-45a4-ba84-edac0546c287"><enum>(2)</enum><header>Enforcement</header><text>The
			 Secretary may take judicial or administrative action to enforce the provisions
			 of any tribal management plan to ensure that any amounts withdrawn from the
			 Trust Fund are used in accordance with this Act.</text>
					</paragraph><paragraph id="id9da08a18-9adc-4246-9287-299aa855913a"><enum>(3)</enum><header>No
			 liability</header><text>Neither the Secretary nor the Secretary of the Treasury
			 shall be liable for the expenditure or investment of any amounts withdrawn from
			 the Trust Fund by the Nation.</text>
					</paragraph><paragraph id="id83ae3aaa-b1dd-4d01-85ab-d2d21d710359"><enum>(4)</enum><header>Expenditure
			 plan</header>
						<subparagraph id="id569ef7b8-863a-4b0e-b1b6-2402e1f8100e"><enum>(A)</enum><header>In
			 general</header><text>The Nation shall submit to the Secretary for approval an
			 expenditure plan for any portion of the amounts in the Trust Fund made
			 available under this section that the Nation does not withdraw under this
			 subsection.</text>
						</subparagraph><subparagraph id="idf8d4cd7e-e3ee-4e4a-b364-892b63a5eeab"><enum>(B)</enum><header>Description</header><text>The
			 expenditure plan shall describe the manner in which, and the purposes for
			 which, funds of the Nation remaining in the Trust Fund will be used.</text>
						</subparagraph><subparagraph id="id5a8ca29a-24bf-4b66-8c46-d0bd5ed10af1"><enum>(C)</enum><header>Approval</header><text>On
			 receipt of an expenditure plan under subparagraph (A), the Secretary shall
			 approve the plan if the Secretary determines that the plan is reasonable and
			 consistent with this Act.</text>
						</subparagraph></paragraph><paragraph id="id528d9e87-1333-4518-af22-1bcbbc1aaa09"><enum>(5)</enum><header>Annual
			 report</header><text>The Nation shall submit to the Secretary an annual report
			 that describes any expenditures from the Trust Fund during the year covered by
			 the report.</text>
					</paragraph><paragraph id="idb0d8daca-e31c-4355-b74a-c2b1f58a749b"><enum>(6)</enum><header>Limitation</header><text>No
			 portion of the amounts in the Trust Fund shall be distributed to any Nation
			 member on a per capita basis.</text>
					</paragraph><paragraph id="idd473c375-4edd-4242-995b-7f423935d105"><enum>(7)</enum><header>Conditions</header><text>Any
			 amount authorized to be appropriated to the Trust Fund under subsection (f)
			 shall not be available for expenditure or withdrawal—</text>
						<subparagraph id="id687ba583-a688-4205-b554-8a790b666b4d"><enum>(A)</enum><text>before
			 December 31, 2019; and</text>
						</subparagraph><subparagraph id="id6ad466f2-c518-4ad6-a413-3167448ff103"><enum>(B)</enum><text>until the
			 date on which the court in the stream adjudication has entered—</text>
							<clause id="id6891599e-dccb-42c3-b72d-aaeba710e8dc"><enum>(i)</enum><text>the Partial
			 Final Decree; and</text>
							</clause><clause id="id7e94543d-42af-4365-987b-baab2cda0df2"><enum>(ii)</enum><text>the
			 Supplemental Partial Final Decree.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="id0c14a542-382a-43c4-b00f-0d2db65bbc21"><enum>(f)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated for
			 deposit in the Trust Fund—</text>
					<paragraph id="id93e15761-5467-4a76-80b5-518e2bca58a6"><enum>(1)</enum><text>$6,000,000
			 for each of fiscal years 2009 through 2013; and</text>
					</paragraph><paragraph id="ida590673c-7732-4717-9b82-d1a4f8cb4bb3"><enum>(2)</enum><text>$4,000,000
			 for each of fiscal years 2014 through 2018.</text>
					</paragraph></subsection></section><section id="id930c0a43-8298-4fdb-9cfa-d1838fe89c2c"><enum>403.</enum><header>Waivers
			 and releases</header>
				<subsection id="IDb30100e3afbd41d584a61273f5294588"><enum>(a)</enum><header>Claims by the
			 Nation and the United States</header><text>The Nation, on behalf of itself and
			 members of the Nation (other than members in the capacity of the members as
			 allottees), and the United States, acting through the Secretary and in the
			 capacity of the United States as trustee for the Nation, shall each execute a
			 waiver and release of—</text>
					<paragraph id="ID836904b558c640c2954ffd28cb90dd20"><enum>(1)</enum><text>all claims for
			 water rights in, or for waters of, the San Juan River Basin in the State of New
			 Mexico that the Nation, or the United States as trustee for the Nation,
			 asserted, or could have asserted, in the San Juan River adjudication or in any
			 other court proceeding;</text>
					</paragraph><paragraph id="ID53ecc8e0f32c48bb877eeb34c953ea9b"><enum>(2)</enum><text>all claims that
			 the Nation, or the United States as trustee for the Nation, has asserted or
			 could assert for any damage, loss, or injury to water rights or claims of
			 interference, diversion, or taking of water in the San Juan Basin in the State
			 of New Mexico that, regardless of whether the damage, loss, or injury is
			 unanticipated, unexpected, or unknown—</text>
						<subparagraph id="IDa276e706c2f34863b91d716558c435fb"><enum>(A)</enum><text>accrued at any
			 time before or on the effective date of the waiver and release under subsection
			 (d); and</text>
						</subparagraph><subparagraph id="ID4129c713e9974a9ea06b17359642aa08"><enum>(B)</enum><text>may or may not be
			 more numerous or more serious than is understood or expected; and</text>
						</subparagraph></paragraph><paragraph id="ID0858f66cf7814789ae04c4cfacec456e"><enum>(3)</enum><text>all claims of any
			 damage, loss, or injury or for injunctive or other relief because of the
			 condition of or changes in water quality related to, or arising out of, the
			 exercise of water rights.</text>
					</paragraph></subsection><subsection id="ID87aca63362414bcc95e4293253fbdbe3"><enum>(b)</enum><header>Claims by the
			 Nation against the United States</header><text>The Nation, on behalf of itself
			 and its members (other than members in the capacity of the members as
			 allottees), shall execute a waiver and release of—</text>
					<paragraph id="IDf9097c41b3964885806fd713ad70c31e"><enum>(1)</enum><text>all causes of
			 action that the Nation or the members of the Nation (other than members in the
			 capacity of the members as allottees) may have against the United States or any
			 agencies or employees of the United States, arising out of claims for water
			 rights in, or waters of, the San Juan River Basin in the State of New Mexico
			 that the United States asserted, or could have asserted, in the stream
			 adjudication or other court proceeding;</text>
					</paragraph><paragraph id="ID02d54c9a7fde467fa3f27a5b9444bb4a"><enum>(2)</enum><text>all claims for
			 any damage, loss, or injury to water rights, claims of interference, diversion
			 or taking of water, or failure to protect, acquire, or develop water or water
			 rights for land within the San Juan Basin in the State of New Mexico that,
			 regardless whether the damage, loss, or injury is unanticipated, unexpected, or
			 unknown—</text>
						<subparagraph id="IDf85f5d8e3d09419097260f339ef852ab"><enum>(A)</enum><text>accrued at any
			 time before or on the effective date of the waiver and release under subsection
			 (d); and</text>
						</subparagraph><subparagraph id="ID5138d97f9da94dae969f0f87b540abd0"><enum>(B)</enum><text>may or may not be
			 more numerous or more serious than is understood or expected; and</text>
						</subparagraph></paragraph><paragraph id="ID864a83444514456b920ba593a34b21b4"><enum>(3)</enum><text>all claims
			 arising out of, resulting from, or relating in any manner to the negotiation,
			 execution or adoption of the Agreement, the Contract, or this Act (including
			 any specific terms and provisions of the Agreement, the Contract, or this Act)
			 that the Nation may have against the United States or any agencies or employees
			 of the United States.</text>
					</paragraph></subsection><subsection id="ID20990d1d4c42497ebae7dc17f452c889"><enum>(c)</enum><header>Reservation of
			 claims</header><text>Notwithstanding subsections (a) and (b), the Nation and
			 the members of the Nation (including members in the capacity of the members as
			 allottees) and the United States, as trustee for the Nation and allottees,
			 shall retain—</text>
					<paragraph id="ID753b9666a78248068e57eb0e81c56b13"><enum>(1)</enum><text>all claims for
			 water rights or injuries to water rights arising out of activities occurring
			 outside the San Juan River Basin in the State of New Mexico, subject to
			 paragraphs 8.0, 9.3, 9.12, 9.13, and 13.9 of the Agreement;</text>
					</paragraph><paragraph id="IDeec2fb8a9ce64052a0c3fb9f72153514"><enum>(2)</enum><text>all claims for
			 enforcement of the Agreement, the Contract, the Partial Final Decree, the
			 Supplemental Partial Final Decree, or this Act, through any legal and equitable
			 remedies available in any court of competent jurisdiction;</text>
					</paragraph><paragraph id="IDb0f0526096d643818859bd702e12a481"><enum>(3)</enum><text>all rights to use
			 and protect water rights acquired pursuant to State law after the effective
			 date of the waivers and releases described in subsection (d);</text>
					</paragraph><paragraph id="ID5b28019bb4514d1596e90f0576c6a0be"><enum>(4)</enum><text>all claims
			 relating to activities affecting the quality of water not related to the
			 exercise of water rights; and</text>
					</paragraph><paragraph id="IDd3bb8e090ec541dc80042fe777b00441"><enum>(5)</enum><text>all rights,
			 remedies, privileges, immunities, and powers not specifically waived and
			 released under the terms of the Agreement or this Act.</text>
					</paragraph></subsection><subsection id="id94a438a9-29e5-4c2c-8c0e-098a5fe9f01b"><enum>(d)</enum><header>Effective
			 date</header>
					<paragraph id="id6dc082af-e26b-4bd2-aabd-b679147708c8"><enum>(1)</enum><header>In
			 general</header><text>The waivers and releases described in subsection (a)
			 shall be effective on the date on which the Secretary publishes in the Federal
			 Register a statement of findings documenting that each of the deadlines
			 described in section 401(e)(1) have been met.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id560df3ce-07ff-4095-8a04-8007d71e3f1c"><enum>(2)</enum><header>Deadline</header><text>If
			 the deadlines in section 401(e)(1)(A) have not been met by the later of March
			 1, 2025, or the date of any extension under section 401(e)(1)(B)—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id79802627-8dd0-4ece-828b-493f229d818d"><enum>(A)</enum><text>the waivers
			 and releases described in subsection (a) shall be of no effect; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id43be66e1-ea4a-44e0-a055-3a464554430a"><enum>(B)</enum><text>section
			 401(e)(2)(B) shall apply.</text>
						</subparagraph></paragraph></subsection></section><section id="IDa6f98ca665d84b2494fdcc20017ecba5"><enum>404.</enum><header>Water rights
			 held in trust</header><text display-inline="no-display-inline">A tribal water
			 right adjudicated and described in paragraph 3.0 of the Partial Final Decree
			 and in paragraph 3.0 of the Supplemental Partial Final Decree shall be held in
			 trust by the United States on behalf of the Nation.</text>
